3. March 28, 2017: Officers’ Email Motion Poll: to approve the Guidelines for Disaster Relief – Approving the Guidelines for Disaster Relief Funds received through Go-Fund-Me Accounts. Basically distributions are made in the same type of way by the same people as the Strike Hardship Funds are distributed. Differences include where the moneys come from and what precipitates the need for Relief/Hardship funds. The guidelines were unanimously approved - Voting yes: Alysia, RoseAnn, Hector, Matt, Sonja, Jennifer, and Mullissa. Riko and Gwyn do not vote.

New Business –
1. The confirmation of Gorsuch to the Supreme Court – what it means to SEIU Local 521. Riko – The Conservative Block now has the majority on the Supreme Court. There are a number of cases waiting in line to be heard by the Supreme Court all with a goal of attacking and taking away Agency Fees. It is anticipated that between March – June of 2018 we will lose Agency Fees. This will mean a significant loss in revenues to unions including us. We need to prepare for this so that we will still win for our members. Members and Staff are engaged and implementing many of the approved recommendations of the Transformation Committee. It is planned that in October some of the bigger recommendations

will be approved. Riko is planning two Senior Face2Face meetings and two All Staff meetings by October.
2. Motion D – Community First Money for Kern County Negotiations. Motion: To support the Kern County Chapter Negotiations with a $25,000 contribution from the SEIU 521 Community First line item. Moved; seconded; passed as presented.
Unfinished Business –
1. Motion E – Memorialize Decisions made in the Executive Session of 4/19/17. Motion: To direct the Election Committee and Trustees to produce a memo for the Bylaws Committee, and a separate report for other changes that do not require Bylaws amendments, to cover these points: a. Summarize the general issues that the Election Committee and Trustees
believe may have contributed to misunderstandings and problems during the nomination and campaign period, and during the election period for the Chief Elected Officer Special Election.
b. Draft proposed changes to the Bylaws that will clarify and uphold the standards and processes for (a) campaigning for office, (b) organizing and implementing the voting process; (c) bringing complaints to the Election Committee during the nomination and campaign phases, and the time frame for the Election Committee to address those complaints; and (d) bringing post-election challenges to the Trustees, and the time frame the Trustees to address and report on those challenges.
c. Draft proposed changes to the Election Notice and/or the Election Rules and Procedures that will address the issues listed in Item #2 above.
The completion goal for both documents will be the end of October 2017. Moved; seconded; passed as presented.
2. Transformation Committee Update – Under Gorsuch report.
3. Member Charges Report – At this time there is no new information. President’s Report: Gwyn reported that she is working in Visalia for Region 5. She is visiting worksites, attending CLC meetings, and interview panels. We received recognition for our Diamond membership in the Memorial Park in the Fresno Fairgrounds. Alysia asked that the Officers be made aware what members are doing in supporting organizations. Chief Elected Officer’s Report: Riko Mendez
1. Update on Immigration Reform – Sonja reported that the Bakersfield Sheriff has
declared the City of Bakersfield a Non-Sanctuary City. Riko commended the leadership in Kern for all the work they are doing. The field owners don’t want ICE to take the field workers. The Caravan Against Fear – SEIU was involved and housed participants in the Fresno and San Jose Offices. SEIU Local 521 was involved in the Lawsuit regarding Sanctuary Cities brought against Trump by Santa Clara County and San Francisco that won in court today.

2. Update on Go-Fund-Me flooding Account – The Deadline has been extended to
May 15th. We have received 11 applications thus far. 3. Organizing Report – Riko reported that he has just come back from an early
childhood educators meeting. Activists from across the Country were there. It was very powerful. It was good to learn that the problems we are experiencing with child care are system wide, and that those issues are being solved in other States. Some States have collective bargaining agreements. We are working toward a collective bargaining bill being signed with the next governor, but that is not until after January 2019 (the end of Governor Brown’s current term). We are also researching the possibility of changing the landscape of child care in Santa Clara County – it involves a half cent tax that would be used for child care. The providers would become employees of the County Office of Education and therefore, be SEIU 521 members that way. There are two union jurisdictions for child care workers in California: the southern jurisdiction and the northern jurisdiction (SEIU Local 521) and they are working together. There are 9,000 child care workers in our jurisdiction. Currently we have 400 organizing members.
Written Reports & Correspondence Requiring no Action by the Officers PAC/PACE Totals Report – in packet Correspondence – none. No Oral Reports. Informational Items:
1. SEIU Local 521 Biennial Convention – we want to fill all the vacant Executive Board positions so that the participation at the Convention will be as large as possible. Alysia asked if SEJ could have some time on the Convention Agenda and have Caucus Booths set up at the Convention. Riko asked if SEJ might want to come in on Friday so their Annual SEJ Summit Agenda (which normally would have been scheduled for this weekend) might not need to be so condensed.
Adjournment: The meeting was adjourned into Executive Session at 6:54pm. Executive Session lasted approximately 10 minutes.

SEIU Local 521 Officers’ Motion Motion Letter: B/1 Date: May 23, 2017 Motion Title: San Mateo County Central Labor Council COPE Awards Dinner - $2,000 for a table of 10 Recommended By: San Mateo COPE Committee unanimously on May 11th, 2017 Background: San Mateo Central Labor Council is having their 87th Annual COPE Banquet on Friday July 14th at the The Westin San Francisco Airport, 1 Old Bayshore Highway, Millbrae. They are honoring Mike Lagomarsino with the Unity Award and San Mateo City Council Community Award. San Mateo City Council is receiving the Community Award for being the first City in San Mateo County to vote for a $15 minimum wage by 2019. We have been working closely with the San Mateo Central Labor Council to pass a living wage ordinance within San Mateo County and provided assistance with all the elected officials in the jurisdictions that we represent. In addition, we are working with San Mateo Labor Council to get $15 minimum wage in Redwood and Daly Cities. SEIU Local 521 Officers’ Motion Motion Letter: B/2 Date: May 23, 2017 Motion Title: Confirm Sole Endorsement of Juan Gonzalez for the Kern County Employees’ Retirement Association Special Election 2017 and up to $5000 toward the campaign. Recommended By: Kern County Chapter Officers Meeting on May 11th,2017 and SEIU 521 Town Hall Endorsement Forum on May 17th, 2017. Background: At the Kern County Chapter Officers Meeting on May 11th, 2017, 8 out of 9 officers attended and all 8 voted to pass the motion for Juan Gonzalez to receive the SEIU 521 sole endorsement for the Kern County Employees’ Retirement Association Special Election 2017 for the General Member Seat and up to $5,000 toward the campaign. This motion was approved by the officers before the SEIU 521 Town Hall Endorsement Forum was held on May 17th, therefore the motion was written as “pending the results of the SEIU 521 Town Hall Endorsement Forum on May 17th, 2017”. At the SEIU 521 Town Hall Endorsement Forum on May 17th, 2017 only one candidate turned in the Candidate Questionnaire and signed the Candidate Pledge, therefore members only interviewed Juan Gonzalez. The same motion was made for a sole endorsement for Juan Gonzalez to receive the SEIU 521 Endorsement for the Kern County Employees’ Retirement Association Special Election 2017 for the General Member Seat and up to $5,000 toward the campaign. The Kern County Employees’ Retirement Association (KCERA) is a multi-employer, defined benefit pension plan in Kern County, California, governed by the County Employees’ Retirement Law of 1937 (CERL) and subject to the requirements of the Public Employees’ Pension Reform Act of 2013 (PEPRA). KCERA is considered a “governmental plan,” as defined in Section 414(d) of the Internal Revenue Code. KCERA administers service retirements, disability retirements and survivorship benefits on behalf of nearly 18,000 active, deferred and retired members and their beneficiaries. The plan provides lifetime retirement benefits to members who meet the minimum age and service credit requirements. After a retired member dies, an eligible beneficiary may be entitled to a lifetime continuance of the benefit. ABOUT THE KCERA BOARD The KCERA Board of Retirement is a nine-member board with two alternates. The Board consists of the Kern County Treasurer-Tax Collector; four members who are appointed by the Kern County Board of Supervisors; and four members who are elected by the KCERA membership: two general, one safety and one retired. Safety and retired members also elect one alternate each. Except for the Treasurer-Tax Collector, all Board members serve a three-year term with no limit on the number of terms that can be served.

Responsibilities of the Board The Board of Retirement is the exclusive governing and policy-making body of KCERA. Its primary mandate, as directed by law, is to provide KCERA members with the retirement benefits promised by their employers (i.e., KCERA’s plan sponsors). Guided by this directive, the Board performs numerous functions, such as setting policy for the efficient operation of KCERA; controlling the investment of pension assets; selecting external professional service providers; hiring executive staff to lead KCERA; ruling on disability retirement applications; authorizing the disbursement of funds; adopting contribution rates and actuarial assumptions; and administering retirement benefits effectively and lawfully. Fiduciary Obligations Board members are considered fiduciaries, or trustees. As fiduciaries, they are to “discharge their duties solely in the interest of, and for the exclusive purposes of, providing benefits to participants and their beneficiaries ….” Furthermore, trustees must act “with the care, skill, prudence and diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiar with these matters would use in the conduct of an enterprise of a like character and with like aims.” [California Government Code Section 31595] Motion: To approve a sole endorsement for Juan Gonzalez for the Kern County Employees’ Retirement Association Special Election 2017 for the General Member Seat and up to $5,000 toward the campaign. SEIU Local 521 Officers’ Meeting Motion Motion Letter: D Date: May 23, 2017 Motion Title: Concurrence of Additional Appointments to the Scholarship SEIU Local 521 Executive Board Committees as follows: Recommended By: Gwyn Harshaw, Local 521 President Background: In the March 2016 Executive Board Motion concurring the President’s appointments of Members to the various Executive Board Committees, authorization was given to add additional Officers, Delegates, and members to the Committees at a later time if necessary. Because of the large number of scholarship applications and that there are only three members appointed to the Scholarship Committee, it is felt that additional members are needed to help with the work of the Scholarship Committee. Background: The next SEIU Local 521 Convention is just around the corner. It is scheduled to take place in San Jose – October 13-15, 2017. There will be the required election process for Delegates to attend the Convention. The Local 521 Bylaws set out that process. It is time for the Election Committee for the election process to be appointed. In compliance with the Local Bylaws volunteers who will not seek Delegate status for the Convention are, herein, requested for appointment by the Local President or designee with concurrence by the Officers.
