    Mark your calendar for Tuesday, March 8 and Tuesday, April 12 for the monthly board meetings at Deerfield

    Community Center, preschool room. All meetings begin at 7 PM.

    MCA Board meetings are held the second Tuesday of every month.

    Montpelier homeowners are encouraged to attend.

    Hello neighbors,

    As we say good bye to cold weather, I want to en-

    courage those that have not collected their Fall

    leaves to bag them, compost them in the back yard

    or hire a young entrepreneur to help with your

    Spring clean up. Since the County no longer vac-

    uums the leaves for us, we must remove them.

    Piled leaves lead to slippery, dangerous road condi-

    tions for cars, bikers and pedestrians. In addition,

    your leaves may end up in your neighbors yard or

    clogging the storm drains.

    The Board is welcoming Spring by giving the tennis

    courts some long overdue TLC. We have contracted

    to have the court surface refurbished and once we

    clean up the fence we will hang new tennis screens.

    We are also considering some new landscaping toaddress the snow damaged bushes and the original

    hedges that look overgrown and neglected. The

    path by the tennis courts needs to be replaced and

    we have a nice new section of the enlarged play-

    ground that can accommodate a new piece of equip-

    ment. We have our work cut out for us.

    One of the first social events of the 2011 season is

    the annual MCA Easter Egg Hunt. The Social Com-

    mittee has scheduled it for Sunday, April 17th

    at 3:00

    PM on the Montpelier Pool grounds. You may check

    for complete details of the event advertised else-

    where in this newsletter. Last year the children

    found over 800 eggs and participated in several craft

    projects.

    If anyone is interested in volunteering with this or

    any of our many socials held throughout the year,

    please contact Carla Bowen at 1-888-622-4630 (Ext

    104). Volunteering is a great way to meet people in

    your neighborhood, serve your community, and en-

    joy yourself all at the same time. Students looking

    for those required volunteer hours for school are

    always an asset. The Social Committee understands

    that it may not be possible to attend every event

    they schedule, so if you can only help out occasion-

    ally, that would be greatly appreciated.

    Vultures on Eastbourne Lane

    As you may know, there is a serious problem with vul-

    tures on Eastbourne Lane and surrounding streets. These

    birds moved into that area over a year ago and have be-

    come a serious nuisance to homeowners through their

    aggressive behavior and the accumulation of their reek-

    ing and corrosive feces and regurgitations. The Montpe-

    lier Community Association Board of Trustees and the

    Architectural Control and Compliance Committee (ACCC) have taken action to ensure that any homeowner activ-ity that might encourage the birds to stay in the area has ceased. At the last regular monthly meeting of the

    ACCC on Thursday, February 3, assurances were given that nobody was actively feeding the vultures or leaving

    their garbage out in plastic bags or trash receptacles that can be broken into by the birds in their search for food.

    If anybody has any knowledge that this is not the case, they should contact a member of the Board or the ACCC

    as soon as possible with photographic evidence so that legal action can be taken.

    Despite these actions to halt all activities that might encourage these birds to stay in the area, there is little indi-

    cation that they are moving away. Indeed, this type of invasion of a residential neighborhood by both turkey vul-

    tures and black vultures is becoming increasingly common as their population increases. The Wildlife Services

    (WS) of the U. S. Department of Agriculture (USDA) has been investigating this problem for many years. Accord-

    ing to their on-line Factsheet on Vulture Damage Management (November 2010), Vultures are migratory birds

    protected by the Migratory Bird Treaty Act, State laws, and regulations. The birds, their nests, and eggs cannot

    be killed or destroyed without a Migratory Bird Depredation Permit.

    The Factsheet also indicates that, WS provides advice and direct management to help people resolve vulture con-

    flicts. Vulture management is complicated and site-specific, so consultation with wildlife professionals is vital to

    successfully resolving damage situations. Thus, while several active techniques have been suggested to per-

    suade the vultures to leave, it is best if professional advice be sought on the most effective legal action that can

    be taken by homeowners. Wildlife Services is headquartered in Washington, DC, with Operational Support Staff

    in Riverdale, MD. Homeowners concerned about the vultures are encouraged to contact Wildlife Services at the

    President B. Derrick called the meeting to order at 7:00

    PM. There was a quorum to conduct business.Arriving after quorum called: Tim Jacobs and Paul

    Secretarys Report: Tricia Douville

    The minutes of the November 2010 board meeting were

    reviewed. Trustee Fleming made a motion to accept the

    minutes. Trustee Dengler seconded the motion and it

    passed unanimously.

    Treasurers Report: Lillian Fazio

    Copies of the financials were distributed to all.

    Two CDs were redeemed ($13,000 and $100,000)

    and deposited in the ING reserve account. Additional

    remaining in the checking was also deposited in re-

    serve. $153,859

    Capital One was charging fees for savings accounts,

    so the treasurer transferred the money to a new ING

    account.

    Trustee Fazio proposed transferring $40,000, out of

    the $71,000 in savings, to the reserve. She felt this

    would leave enough money for end of the year and

    January 2011 bills and other start-up needs. TrusteeDouville made a motion to transfer $40,000 into the

    Reserve. The amount can be increased if the money

    is not needed. Trustee Buehler felt it was premature

    to move the money into reserve until the budget was

    discussed. Trustee Fleming seconded the motion and

    it passed, with Trustee Buehler voting nay.

    Trustee Keating questioned the fees paid to the CPA

    and whether it was authorized. The CPA trained

    Trustee Fazio and M. Derrick on Quickbooks and ac-

    counting methods. Trustee Fazio recommended up-

    grading to Quickbooks 2011 (from 2008) at a cost of

    $180. Trustee Jacobs made a motion to approve

    purchasing the new Quickbooks 2011 software and

    additional training, not to exceed $500. Trustee

    Keating seconded the motion and it passed unani-

    mously.

    Trustee Fazio explained the new contingency fund/

    capital expenditures, and placing pool furniture as a

    fixed asset out of capital expenditures. Trustee

    Keating asked why our other assets (buildings, etc.)

    arent also being depreciated. The CPA will be asked

    to explain this further. An inventory also needs to be

    completed and a budget for capital expenditures.

    The budget for operating funds for 2011 was dis-

    cussed and revised. Trustee Douville made a motion

    to accept the revised budget (rolling athletic fields

    into one maintenance expenditure). Trustee Flemingseconded the motion. A question arose that the

    amount to be put in reserve should only be $18,418

    rather than $22,000. Trustee Douville revised her

    motion to accept the revised budget, putting the

    required 10% ($18,418) into Reserve and the $3,782

    excess into the contingency fund (total $8,782).

    Trustee Fleming seconded the revised motion and it

    passed unanimously.

    COMMITTEE REPORTS

    ACCC: Michael Boddie, Chairperson

    Trustee Keating reported on the meeting activities.

    Several letters went out regarding trailers and boats

    left in driveways, but most are in storage, and several

    maintenance complaints. There is also a new com-

    plaint regarding failure to seek prior approval.

    Ms. Collman asked about the house on Silverbirch

    which recently put in solar panels. Trustee Keating

    explained that these energy saving alterations cannot

    be prohibited. She expressed concerns about the

    changes that are being allowed and a lack of consis-

    tency.

    Communications Committee: Tim Jacobs, Chairperson

    Trustee Jacobs reported that everything is up todate.

    He proposed that advertising be sold on the internet.

    Trustee Fleming suggested that the ads would need

    to be changed to make them look professional on the

    site. He also offered to update the content and try to

    make it more interesting and lively. Trustee Fleming

    offered to be the webmaster and make these up-

    dates. Trustee Derrick encouraged the changes and

    suggested an additional notification system from the

    county police.

    Facilities Committee: Richard Dengler, Chairperson

    Trustee Dengler has an updated contract from Brick-

    man and will contact the three other companies.

    A bench needs to be fixed and a new swing is on or-

    der.

    Quotes for painting the fence came in at $4,700,

    $6,800 and $7600. A new fence (vinyl coated, small

    grid) would cost $14,200

    ACCC Meeting

    December 2, 2010

    Committee Members Present: Michael Boddie, Toni Byrd,

    Brian Dennis, Thomas Jaehnigen, Jack Keating, Ron Lenart,

    Pauline Pettitt, Tim Shrewsbury and Diana Sowle.

    Committee Members Absent: None.

    Community Members Present: M. Hughes

    The meeting was called to order at 7:04 PM. J. Keating

    made a motion to accept the amended November 2010

    minutes. B. Dennis seconded and the motion passed unani-

    mously

    Old Business:

    12203 Brittany Lane Letter needed regarding hole on

    the side of the house.

    12400 Cedarbrook Lane The house and yard continue

    to improve.

    12411 Cedarbrook Letter needed requesting paymentfrom board member of $50 fine (proceeding with

    shed replacement without prior approval).

    9003 Eastbourne The board provided a picture of vul-

    tures picking through food or garbage. B. Dennis

    made a motion to impose a $100 a month fine if the

    matter is not resolved within thirty days. R. Lenart

    seconded the motion and it passed unanimously.

    8819 Gramercy Lane A letter will be drafted and final-

    ized online explaining the violations to the estate

    executors: cardboard in windows, trailer in drive-

    way, debris in back yard, the extension and the un-

    acceptable surface (gravel) of the driveway.

    9001 Montpelier Drive Cease and Desist will be sent

    regarding the unkempt yard.

    9302 Montpelier Drive A shed which is larger than 120

    square feet allowed in the covenants and a concrete

    pad were erected without prior approval. R. Lenart

    made a motion to impose a $500 fine for proceedingwithout prior approval. J. Keating seconded the mo-

    tion and the motion passed with T. Shrewsbury vot-

    ing nay. T. Jaehnigen made a motion, R. Lenart

    seconded, that the shed must be removed within

    thirty days or further sanctions may be imposed.

    Approval must be requested before a new shed

    within the covenants can be erected. The motion

    passed unanimously.

    9314 Montpelier Drive The refrigerator has been re-

    moved, but the fence and mold on the siding need

    attention. Hold until January.

    8907 Royal Ridge Lane All vehicles are registered and

    the committee found no parking violations. P.Pettitt suggested that committee members contact

    the neighbor to discuss the covenants.

    New Business:

    8717 Graystone Lane Letter needed requesting re-

    moval of RV in ten days.

    12200 Cedarbrook Lane Letter needed requesting

    split rail fence be repaired or removed.

    9207 Twin Hill Lane Letter needed requesting utility

    trailer be removed within ten days or be fined $250

    Pool has been closed and winterized, but Trustee

    Buehler isnt sure if the water has been turned off at

    the grass or street.

    The pool committee met and discussed guest

    passes: a) paying the assessment on time will earn 1

    free pass good for five entries; b) an out of state

    guest pass a $25 pass which would allow one week

    of pool use for all house guests, with a possible limit

    on use; and, c) a recommendation that a Montpelier

    member be allowed to sponsor a non-Montpelier

    swim team child. The sponsored child would onlybe able to use the pool for swim team events, prac-

    tices and meets. They would pay for the swim team

    membership and an additional fee, such as $50, to

    the MCA. Ms. Collman, Swim Team Chairperson,

    discussed the declining membership and problems

    recruiting new members. Trustee Buehler made a

    motion to continue the $25, 5 punch pass, for all

    members who pay the assessment on time. Trustee

    Jacobs seconded the motion and it passed unani-

    mously. Trustee Jacobs made a motion to allow a

    member of the community to sponsor a non-

    Member child for swim team membership, and lim-

    ited to swim team activities, meets and practices, for

    the cost of registration and a $50 fee to the associa-

    tion. Trustee Buehler seconded the motion and it

    passed unanimously.

    OLD BUSINESS:

    Trustee Fleming asked for the quotes on leaf vacuuming

    from Brickman. The cost was estimated at $850 per day

    and it would probably take three or four days to do theentire neighborhood. As the majority of neighbors have

    already dealt with their leaves this year, this should be

    considered for the future and publicized before anyone

    invests their own time and money to the task.

    The next board meeting will be held on Tuesday, January

    11, 2011 at 7:00 PM at Deerfield Recreation Center, pre-

    school room. The motion was made and seconded to

    adjourn at 9:00 pm. The motion passed unanimously.

    PM. There was a quorum to conduct business.

    Secretarys Report: Tricia Douville

    The minutes of the December 2010 board meeting

    were reviewed and amended. Trustee Jacobs made a

    motion to accept the amended minutes. Trustee Fazio

    seconded the motion and it passed unanimously.

    Treasurers Report: Lillian Fazio

    The treasurer provided a report to the board

    members. A new CD was not opened because the

    rates are not much higher than what we are re-

    ceiving.

    QuickBooks 2011 was purchased for $190.79.

    W2s are ready for the accountant and he will

    charge $175 to prepare.

    As one winner of the Holiday Lights Contest did

    not pay the 2010 assessment, the $25 award will

    be put to the outstanding bill to the association. A

    letter and statement will be sent to the member. Two years still need to audited or reviewed. The

    accountant charges Formal Audit $5,000-$6,000;

    Review Audit $2,000 -$3,000; Compilation Audit

    $1,000 -$2,000 (review the books). Either way the

    accountant cannot start this work until May. Trus-

    tee Jacobs made a motion to do a Compilation

    Audit of 2009 and 2010. The motion was sec-

    onded by Trustee Fleming and passed unani-

    mously. Trustee Derrick suggested that the Gov-

    erning Documents Committee review the audit

    requirement in the bylaws. Some members felt

    that a full audit should be done every three years

    or when Treasurers change.

    ACCC: Michael Boddie, Chairperson

    Trustee Keating reported on the meeting activi-

    ties. The ACCC received a response from the

    owner charged with feeding the vultures. M. Bod-

    die received many phone calls and messages also.

    One committee member spoke with the ownerwho insists that she is not feeding the vultures and

    does not know how to get rid of them. A commu-

    nity member and neighbor reported that the vul-

    tures were fed a turkey in December and he will

    get proof of this for further action.

    All trailers and boats have been put into storage.

    A list of the section assignments will be given to

    the board. Trustee Derrick asked who had access

    to the ACCC groupsite.

    Communications Committee: Tim Jacobs, Chairper-

    son

    The committee met and approved the protocols

    (written in 2007). Members are T. Jacobs, P. Katz,

    M. Hughes, T. Fleming, C. Rucker and J. Hanagan.

    Trustee Jacobs was elected Chairperson and Trus-

    tee Fleming will be the web administrator/

    manager. Trustee Keating made a motion to ap-

    prove the members and protocols. Trustee

    Eisenberg seconded the motion and it passed

    unanimously.

    Trustee Jacobs will get the treasurer the bill for

    web services. They should be given her email ad-

    dress so that they contact her in the future.

    Trustee Fleming has updated and created a newlook for the website. He needs full access and

    password to finish the updated web design. The

    Communications Committee needs to approve the

    new look.

    Trustee Jacobs is changing his personal email com-

    panies. He is getting messages even when they

    appear rejected.

    An informal facebook page for the community has

    been started by Susan Thompson. (facebook.com/

    montpeliermd). This is a social network, not moni-

    tored, and not part of the community association.

    Facilities Committee: Richard Dengler and David

    Eisenberg, Co-Chairpersons

    Trustee Eisenberg reported that he and Trustee

    Fines for storing boats, trailers, campers, RVs in

    driveways was set at $250 a month.

    The next meeting of the ACCC will be Thursday, Janu-

    ary 6, 2011 at 7:00 PM at Deerfield Community Center.

    The meeting adjourned at 8:25 pm.

    Dengler fixed the swing set and signs around pool.

    There is yellow tape which has blown into the fenc-

    ing which needs to be removed; wood needs to be

    replaced/fixed on playground and tennis court

    benches.

    Trustee Dengler is assembling the three quotes

    needed for replacing the tennis court fence.

    Trustee Derrick reported that Trustee Buehler sent all

    board members an email with three pool management

    contract bids attached: Lighthouse ($52,000 or $55,000

    for 4 guards for peak-most of June and July; $59,000 for

    4 guards always); Continental ($54,950); Winkler

    ($53,300). All companies bid on 247 hours: Wednesday

    -Saturday to 9 PM close; Sunday-Tuesday 8:00 PM

    close; the same opening and closing dates; and purchas-

    ing all cleaning supplies. Trustee Keating asked if every-

    offered a better contract. He felt that we have thesame problems every year with Lighthouse and that

    they do not address the problems because we have

    remained with them for so many years. He would also

    like to have references. Trustee Fleming made a motion

    that the Executive Committee meet to discuss the pool

    bids and sign a contract on the boards behalf. The

    meeting will be announced so that any board member

    may attend. Trustee Keating seconded the motion and

    it passed unanimously.

    OLD BUSINESS:

    Need to get a bill from Marcia for the 1 888 MCA-

    INF number the Association now is using.

    Tennis court fountain and parking lot flood light lens

    are in. They will be installed when the weather im-

    proves.

    Trustee Keating will follow up with the community

    center management to determine an appropriate

    donation from MCA to the community center

    (suggestion made by a community member and pre-

    viously approved by the Board). He did not receive a

    response to his earlier inquiry.

    NEW BUSINESS

    Trustee Fazio reported that Ms. Hynes, a member of the

    Facilities Committee, would like the pool hill cleared of

    weeds and dead branches to make room for Japanese

    maples and other plants. The Facilities Committee

    should meet to discuss specific plans so all know whats

    happening. Will the ivy be removed or left in place?

    The scope of work needs to be defined first becausethere are many opinions on what should be done. A

    member suggested that the hill in the playground needs

    to be cleared also. Once the scope is approved by the

    Board the Committee can then get 3 bids.

    Trustee Eisenberg reported that a tree from the pool

    area fell and broke a portion of the fence of a member

    on Silverbirch Lane. Trustee Eisenberg will talk to the

    neighbor and discuss plans for fixing the fence and re-

    moving the tree. Trustee Derrick suggested the Facility

    Committee use volunteers for the cleanup of the fallen

    tree if at all possible rather than contracting with a busi-

    ness.

    The next board meeting will be held on Tuesday, Febru-

    ary 8, 2011 at 7:00 PM at Deerfield Recreation Center,

    preschool room. The motion was made and seconded

    to adjourn at 8:14 pm. The motion passed unani-

    mously.

    9003 Eastbourne M. Boddie received many messages

    and phone calls and a written response regarding

    the fine for providing food for vultures. B. Dennis

    reported that the owner says she is not providing

    food for them and they are damaging her property

    and she would like to be rid of them also. As there is

    no additional proof to the contrary, C. Dennis will

    contact the owner to discuss further action.

    8819 Gramercy Lane Hold until February for a re-

    sponse to letter to the estate executors explainingthe violations: cardboard in windows, trailer in

    driveway, debris in back yard, the extension and the

    unacceptable surface (gravel) of the driveway.

    TREASURERS REPORT

    At our Annual Meeting members of the community and

    the Board of Trustees discussed the possibility of form-ing a Neighborhood Watch Program in Montpelier. The

    goals of this program would be to reduce crime by tran-

    sitioning our present Gate Keeper team into a more

    formal program as endorsed by our police department.

    The Neighborhood Watch Program involves no patrol-

    ling, just an increased level of vigilance, but with a more

    defined reporting procedure. We would need to train

    block captains and additional participants to fully staff

    the program, so the number of volunteer participants is

    critical to our success.

    If you were unable to attend the February 23rd

    meeting

    at the Towne Center Police Substation, but have an

    interest in this program, please let me know. Other

    communities have substantially reduced their crime

    rate by adopting the Community Watch program.

    Safety at Home: Keep doors and windows locked,

    regardless of whether they areupper or lower level windows/entrances and garage doors (keepthem closed with interior doorlocked)

    Install and use a peephole in yourdoor(s)

    Do not answer knocks at the doorwithout first checking to see whoit is. Utilize peepholes or windowsto know who's there (even if youare expecting someone)

    Instruct children and other familymembers not to answer/open thedoor automatically

    Require identification from allstrangers (includes delivery/repairpersons and police officers). Ifyou're not sure of a person's ID,call the company/agency the per-son says they're from

    Keep hands free of excessive pack-ages/bulky items

    Never enter your home if you seethat a door or window have beenforced. Go to a neighbor's and callpolice

    Never place a key over your door-way or under a flowerpot, etc. Ifyou want, you can leave a sparekey with a neighbor that is wellknown to you

    In dating situations, such as blinddates or when attending late nightevents, it is recommended thatyou double date with another cou-ple or take a friend with you

    When returning home duringhours of darkness, if possible, usea cellular telephone to alert some-one inside your residence to ob-serve your arrival

    Several Montpelier residents have been told that our Montpelier Post Office could be closed when the lease on

    their space runs out in late April. As we all have heard, the Postal Service has enormous budget problems and

    ton Post, the Postal Service plans to begin closing as many as 2,000 post offices this March and will review an-

    other 16,000 that are operating at a deficit. Current laws only allow the Postal Service to close offices for leaseexpirations and maintenance problems not for profitability. The Postal Service is lobbying Congress to allow it

    to close unprofitable post offices.

    Unfortunately, our Montpelier Post Office has both maintenance problems and an expiring lease so it is a likely

    candidate for closure although postal staff said that a final decision had not yet been made. If you would like
