    Mark your calendar for Tuesday, January 11 and Tuesday, February 8 for the monthly board meetings at Deer-

    field Community Center, preschool room. All meetings begin at 7 PM.

    MCA Board meetings are held the second Tuesday of every month.

    Montpelier homeowners are encouraged to attend.

    Dear Neighbors:

    Happy New Year!! As we transition from the hectic

    holiday season to the cold winter months ahead, you

    can rest assured that your MCA volunteers are hard

    at work and will not be lying dormant. As always, I

    encourage you to contact any of the Committee

    Chairs listed in this newsletter if you would like to

    get involved.

    Each homeowner will be receiving their annual as-

    sessment notice the end of January. Please note

    that the assessment will be $265.00 and is due

    March 1, 2011. We will also offer the Bonus Pool

    Guest Passes again this year to those that pay on

    time. Be mindful that there are additional fees and

    interest charged to any assessments that come in

    after the due date. Details will be included in theassessment letter.

    The Architectural Control and Compliance Commit-

    tee are continuing their efforts to address the turkey

    vulture complaint on Eastbourne Lane. By making

    the physical conditions unfavorable for these birds,

    neighbors can take steps to discourage them from

    roosting on their property. A wire stretched across

    the roof, motion activated sprinkler, repetitive loud

    noises, recorded bird distress calls and an effigy of a

    dead vulture are just some of the deterrent meas-

    ures offered on the internet. In addition, it would

    be prudent to keep white trash bags inside a trash

    can and not loose on your property, as they can at-

    tract turkey vultures.

    One member of the Turkey Vulture Society has rec-

    ommended that a motion-activated sprinkler system

    may be the best option to stop the birds from roost-

    ing on housetops. The product is Contech Electron-

    ics brand ScareCrow and can be found at

    I would like to remind all homeowners that Article

    IX - Architectural Control in the MCA By-laws re-

    quires that we must get prior approval for exterior

    changes and alterations that we make to our prop-

    erty. It specifically states that A Member shall not

    make changes or architectural alterations to the

    external appearance of any structure on any Lot,

    until the complete plans and specifications have

    been approved in writing by the Architectural Con-

    trol and Compliance Committee. You can read the

    rest of Article IX and all of the covenants and bylaws

    by referring to the copy of the MCA Governing Docu-

    ments that you received when you purchased your

    home or read it online at www.montpelieronline.org.

    The ACCC Approval Form and additional information

    concerning this matter can be found in each issue of

    this newsletter that is delivered to your front door

    six times a year or on the website. Our ACCC does an

    excellent job enforcing our covenants and they are

    always looking for individuals to join their team. We

    owe all those ACCC volunteers, over the last 40+

    years, a continual thanks for keeping our neighbor-

    hood looking good and our property values high!

    Montpelier Community Association, Inc.Board of Trustees Meeting Minutes

    October 12, 2010

    Trustees in Attendance: Richard Dengler, Bob Derrick,

    Patricia Douville, Dave Eisenberg, Lillian Fazio, and Jack

    Keating.

    President B. Derrick called the meeting to order at 7:00

    PM. There was a quorum to conduct business.Arriving after quorum called: Paul Buehler and Tim Ja-

    cobs.

    Trustees Absent with Cause: Julia Coldren Walker

    Community Members Present: Mary Derrick, and M.

    Hughes.

    Secretarys Report: Tricia Douville

    The minutes of the September 2010 board meeting were

    reviewed and amended. Trustee Keating made a motion

    to accept the amended minutes. Trustee Fazio seconded

    the motion and it passed unanimously.

    Treasurers Report: Lillian Fazio

    Copies of the financials were distributed to all.

    The treasurer received copies of the final audit for 2008.

    Everything looks good and there were 15 recommenda-

    tions made by the accountant which the board can re-

    view. Several of the recommendations, such as providing

    all contractors with 1099s, have already been put into

    practice. The accountant offered to meet with the

    board if they would like to discuss the audit or the recom-

    mendations.

    All delinquent accounts have been turned over to the

    attorney for collection.

    We have received a new debit card from Capital One.Several CDs are maturing and the Board needs to decide

    where to invest/deposit the money.

    COMMITTEE REPORTS

    ACCC: Michael Boddie, Chairperson

    A photo of the vultures was produced and will be

    sent to the attorney.

    The committee decided to ask members to resign

    when they know they will miss three consecutive meet-

    ings and they can rejoin the committee when they return.

    There was no quorum for the meeting so two ap-

    proval requests will be handled on-line.

    The guidelines will be signed and published in the

    newsletter and put on the web page.

    Trustee Buehler was reminded about the fine which

    he had offered to pay.

    Pool Committee: Paul Buehler, Chairperson

    The Volleyball equipment has been stored in the ga-

    rage unit.

    The water is still on at the pool and Trustee Buehler

    will notify Lighthouse to begin winterization. The pool

    cover is on, but there is too much water in it.

    The tables have been covered with a tarp. Lighthouse

    to invoice for the tarp with winterization bill.

    The record board has been taken back to Signs R Us

    because the plastic was wavy. The flag pole needs to be replaced. Trustee Dengler

    suggested a way to fix it.

    Trustee Buehler would like to replace the walkway to

    the basketball court with pea gravel.

    The underwater lights and spout still need to be

    fixed. They will be put on a hit list prior to paying for win-

    terization.

    Ping pong table has not been purchased yet, but he is

    deciding between two models. Ms. Derrick reported that

    one of the tables (Kettler 5.0) was on sale ($502) at Sports

    Authority (in store). Trustee Buehler has already been

    authorized to pay up to $600.

    Communications Committee: Tim Jacobs, Chairperson

    Trustee Jacobs was not able to update the website

    due to personal issues, but he will get to it this month.

    M. Segura will be contacted regarding the phone bill

    for the 1-800 line so MCA can reimburse her.

    Trustee Jacobs will find out what he is paying for the

    MCA website called Groupsite and arrange with the treas-

    urer to get the bill paid through MCA rather than his per-

    sonal account.

    Trustee Jacobs also announced that the County posted

    signs for cleaning the streets in Montpelier.

    Security Committee: Richard Dengler, Chairperson

    Trustee Dengler reported that the investigation con-

    tinues on the three break-ins on Graystone, although he

    is not happy with the response from the detective.

    A car was broken into on Cedarbrook.

    A Shadetree Lane resident complained that some

    Crestleigh Apartment residents trampled his fence in or-

    der to get to a party his neighbor was hosting. Although

    there continue to be issues with cut-throughs from the

    apartments, this appears to be a neighbor dispute.

    Facilities Committee: Richard Dengler, Chairperson

    Trustee Dengler will ask Brickman to clean debris

    from the drains/drainage area.

    Three bids for painting the tennis court fence, one

    coat, have been received. ($4,000, $6,000 and $6,000).

    He reported that the fence is very rusty and asked if di-

    rect to metal paint will work on rust or if the fence should

    be replaced. He will get quotes on the cost of a new

    fence.

    Brickman is coming to do the reseeding. Trustee

    ACCC REPORT

    ACCC Meeting

    October 7, 2010

    Committee Members Present: Michael Boddie, Brian

    Dennis, Jack Keating, and Diana Sowle

    Committee Members Absent: Toni Byrd, Thomas Jaehni-

    gen, Ron Lenart, Pauline Pettitt, and Tim Shrewsbury.Community Members Present: M. Hughes and Sandra

    Santos.

    The meeting was called to order at 7:05 PM, but there

    was not a quorum. As the MCA governing documents do

    not require a quorum to conduct committee meetings,

    the Board of Trustees allows the ACCC to conduct busi-

    ness meetings without a quorum present; however, for

    all decisions of the committee requiring a vote, the ACCC

    must abide by the quorum rules. Voting may take place

    online.

    Old Business:12400 Cedarbrook The yard continues to improve.

    12411 Cedarbrook Waiting for board member to pay

    the $50 fine for proceeding without prior approval.

    8908 Eastbourne - Working with insurance company for

    gutter repairs.

    9003 Eastbourne Vultures are present, but T. Shrews-

    bury offered to contact owner at the last meeting,

    so the committee will wait for his report.8819 Gramercy Lane The committee will discuss online

    whether to send a cease and desist letter regarding

    the debris and cardboard covering the windows.

    There was a question whether the driveway exten-

    sion is gravel or paved.

    12812 Silverbirch Owner must get county approval for

    fencing over easement. Further research needed to

    see if neighbors have been contacted for com-

    ments. T. Byrd will be asked to monitor.

    12417 Radnor M. Boddie will investigate to see if tree

    limbs remain in the yard.

    12421 Radnor New contact information will be put in

    the file.(Continued on page 8)

    Derrick asked if he had received a guarantee in writing; if

    the in-field area was removed; if the trench area was in-

    cluded; and if it will be watered.

    Swing is ready and Trustee Eisenberg put it up.

    Captain Rob Brewer, Commander of District VI, Prince

    Georges County Police, stopped by to introduce himself

    and open the channels of communication between Mont-

    pelier and the PG Police Department. He offered informa-tion on the investigation of the Graystone break-ins. He

    will check into the investigators response and follow-up.

    Statistics on crime in our area will be sent to Trustee

    Dengler.

    He spoke on the new 911 dispatch system which has been

    frustrating to some. It is no longer handled by police per-

    sonnel but by Public Safety Communications. He asked if

    there would be community interest in a Neighborhood

    Walk or Neighborhood Watch. Trustee Dengler said the

    security committee acts as a type of neighborhood watch.

    Trustee Keating asked for increased radar presence for

    speeding on Montpelier Drive. Speed cameras were also

    discussed. Captain Brewer said he would try to get some

    additional speed traps in our neighborhood.

    Captain Brewer indicated that one way for residents to get

    emergency information would be to sign up for free alert

    notices send directly to e-mail addresses and/or cell

    phones: nexle.com.

    There being no other old business, Trustee Derrick re-

    cessed the meeting at 8:45 pm in order to seat the new

    board. The new board was seated and Trustee Derrick

    called the meeting to order at 8:46 pm.

    Trustees in Attendance: Paul Buehler, Patricia Dou-

    ville, Richard Dengler, Bob Derrick, Dave Eisenberg,

    Lillian Fazio, Tim Jacobs and Jack Keating.

    Trustees Absent with Cause: Tony Fleming

    Trustee Jacobs made a motion that all former officers ofthe board remain in their position. Trustee Dengler sec-

    onded the motion and it passed unanimously. Trustee

    Douville was the third member of the Executive Committee

    for the last board, but Trustee Buehler expressed interest

    in the position. Trustee Eisenberg made a motion to vote

    for the third member for the Executive Board. Trustee

    Dengler seconded the motion. Trustee Douville was

    elected to the Executive Committee. (Votes for P. Douville-

    Dengler, Douville, Eisenberg, Fazio, Keating; votes for P.

    Buehler Buehler, Jacobs).

    President Derrick requested that the Chairmen of the com-

    mittees meet with their committees and discuss the com-

    mittee protocols, pick their Chairmen for 2011 and bring

    the results to the November Board meeting for Board ap-

    proval.

    The next board meeting will be held on Tuesday, Novem-

    ber 9, 2010 at 7:00 PM at Deerfield Recreation Center, pre-

    school room. The motion was made and seconded to ad-

    journ at 8:50 pm. The motion passed unanimously.

    President B. Derrick called the meeting to order at 7:00PM. There was a quorum to conduct business.

    Trustees Absent with Cause: Tim Jacobs

    Community Members Present: Michael Boddie, Mary

    Derrick and M. Hughes.

    Secretarys Report: Tricia Douville

    The minutes of the October 2010 board meeting were

    reviewed. Trustee Keating made a motion to accept the

    minutes. Trustee Douville seconded the motion and it

    passed unanimously.

    Treasurers Report: Lillian Fazio

    Copies of the financials were distributed to all.

    Two CDs mature in December ($13,000 and

    $100,000).

    $39,000 needs to go back into the Reserve and the

    rest will be deposited into checking until the board de-

    cides where to invest the rest. Trustee Fazio will bring

    suggestions on investment choices.

    The budget will be ready for approval at the Decem-

    ber meeting. Trustee Fazio will distribute an excel version

    to all board members for their review and discussion.

    2009 audit was discussed. Our accountant estimated

    an audit to be $5,000. Trustee Keating thought this wasoverpriced and offered to get another quote.

    Capital expenditures were discussed. The tennis

    courts and parking lot will need attention this year. Addi-

    tional concrete decking and the baby pool may need at-

    tention this year as well.

    Trustee Keating made a motion to increase the as-

    sessment to $265. Trustee Douville seconded the motion.

    The assessment has not been increased in five years, the

    reserve needs to be funded, and most board members

    would rather increase the assessment rather than impose

    a special assessment. The motion to increase the assess-

    ment to $265 passed unanimously.

    COMMITTEE REPORTS

    ACCC: Michael Boddie, Chairperson

    Trustee Buehler was reminded about the fine which

    he had offered to pay.

    Boats and trailers must be removed from the prem-

    ises as of November 1.

    The committee felt that the turkey vulture issue was

    in the hands of the board and no longer an ACCC issue.

    The board, under the attorneys direction, wants the com-

    mittee to follow proper procedures in this matter as this is

    a violation of the covenants, Article IV Uses, Section 3.

    Two board members reported that there is a bad odor andeither the birds are being fed or the homeowner is not

    securing the trash properly.

    Trustee Keating made a motion to accept Mr. Boddie

    as chairperson of the ACCC committee. Trustee Eisenberg

    seconded the motion and it passed unanimously. A list of

    members was turned over to the board.

    Mr. Boddie discussed a neighbor complaint which is not a

    covenant matter. Trustee Derrick will look into the mat-

    ter.

    Communications Committee: Tim Jacobs, Chairperson

    The minutes and newsletters have been updated. Trustee

    Fleming will work with Trustee Jacobs on the website.

    The Yahoo group monitors should be reminded that

    emails on the list serv are supposed to be signed.

    Facilities Committee: Richard Dengler, Chairperson

    Trustee Dengler requested that Trustee Eisenberg be

    approved as co-chair. Trustee Keating made a motion to

    accept Trustee Dengler and Trustee Eisenberg as co-chairs

    of the Facilities Committee. Trustee Buehler seconded the

    motion and it passed unanimously.

    The baby swing is broken.

    Bids for landscaping were discussed. Trustee Dengler

    has an offer from Brickman for three years. The gatecloser will continue, but a new contract for grounds trash

    and leaves is needed.

    Trustee Buehler felt that only 50% of the grass is grow-

    ing. Trustee Dengler will ask Brickman to fix it.

    Members of the Facilities Committee are: P. Pettit, H.

    Bailey, P. Stainer, G. Hynes, B. Jacobs.

    The locks will be changed when winterization is com-

    plete and will be given to responsible people.

    Quotes are still needed for either a new fence or paint-

    ing of the fence.

    Pool Committee: Paul Buehler, Chairperson

    Members of the pool committee are: T. Forrey, M.

    Middlebusher, E. Brown de Colstoun. There is no pool

    chair yet.

    The pool was winterized on November 1. Bathrooms

    dismantled as required, a sump pump will keep the water

    below skimmer levels. Lights will be done in the spring.

    Trustee Keating does not believe that the line to the ten-

    nis court could have been blown out. Trustee Buehler will

    check on that and make sure that the bathroom parts

    are put in bags and boxed. The fill spout has not been

    done.

    Recycling cans/bags will be taken to the curb.

    Motors will not be taken out this year.

    No quotes yet for the management contract. Trus-

    tee Derrick suggested getting online, website quotes

    with a standard opening and closing date.

    Social Committee: Carla Bowen, Chairperson

    Trustee Buehler made a motion to approve C. Bowen as

    chairperson. Trustee Keating seconded the motion and

    it passed unanimously.

    Security Committee: Richard Dengler, Chairperson

    Trustee Dengler reported unusual activity at 3 am in the

    Orwood Lane and Cedarbrook Lane area. Trustee Flem-

    ing made a motion to accept Trustee Dengler as chair-

    person of the committee. Trustee Keating secondedthe motion and it passed unanimously.

    Tennis Committee: Lillian Fazio, Chairperson

    Trustee Fazio discussed the tennis court refurbish-

    ing. The weather is now too cold but we can lock in the

    price now and the work will be done when the weather

    permits in the spring. Trustee Keating asked her to

    make sure that a deposit isnt required until spring.

    Trustee Keating made a motion to accept Trustee

    Fazio as the Tennis Committee chairperson. Trustee

    Dengler seconded the motion and it passed unani-

    mously.

    OLD BUSINESS:

    Trustee Fazio and M. Hughes have not been able to get

    information regarding the 888 phone bill. They will con-

    tinue trying to contact Ms. Segura.

    NEW BUSINESS:

    Trustee Fleming offered to chair the Governing

    Documents committee. Trustee Derrick made a motion

    to appoint Trustee Fleming as chairperson. Trustee

    Keating seconded the motion and it passed unani-

    mously. Trustee Derrick suggested that a clean ver-

    sion, with all the amendments, be created in time for a

    new printing.

    Trustee Fleming was also asked to work on the

    website and help keep it up to date and relevant. Trus-

    tee Fazio has still not received the bill. The chairman-

    ship of the Communications Committee has not been

    voted on yet.

    Trustee Fleming also suggested that themes or top-

    ics can be set for upcoming board meetings. Ms. Witt, in an e-mail to Trustee Derrick, suggested

    that a donation be made to the Community Center for

    all their help. Trustee Douville will draft a letter asking

    if there is anything that they need. She also asked if the

    board would consider hiring someone to pick up leaves

    in the neighborhood. Trustee Dengler will ask Brickman

    for a quote.

    The next board meeting will be held on Tuesday, De-

    cember 13, 2010 at 7:00 PM at Deerfield Recreation

    Center, preschool room. The motion was made and

    seconded to adjourn at 8:45 pm. The motion passed

    unanimously.

    New Business:

    8713 Granite Lane Ms. Santos presented a request

    to widen and repave a driveway. The commit-

    tee will vote online. The overall width cannot

    exceed 25 feet, per the Covenants, and the re-

    quired neighbors signature is still needed.

    (Online vote results after all information pro-

    vided: Approved).

    P. Pettitt requested clarification regarding signs al-

    lowed in yards. As the sign in question was on the

    county right-of-way, the committee felt that it had no

    jurisdiction.

    Guidelines will be signed and printed in the newslet-

    ter and posted online.

    Old Business:

    12206 Brittany Place Vacant house should be moni-

    tored, but the yard is being maintained.12208 Brittany Place Most of the debris on the porch

    has been removed. Thank you.

    12400 Cedarbrook Lane The yard continues to im-

    12411 Cedarbrook Lane M. Boddie will speak to the

    board member who offered to pay the $50 fine

    for proceeding without prior approval.

    8908 Eastbourne Lane - M. Boddie reported that the

    gutters have been repaired. Thank you.

    9003 Eastbourne Lane The board is handling the vul-

    ture issue so the matter is closed.

    8819 Gramercy Lane A letter to the estate executors

    will be drafted to explain the violations: Card-board in windows, trailer in driveway, debris in

    back yard, the extension and the unacceptable

    surface (gravel) of the driveway. The committee

    will revise the letter online and it will be sent

    after review.

    12417 Radnor Lane M. Boddie reported that the tree

    limbs are gone. Thank you.

    12812 Silverbirch Lane Owner did not provide county

    approval for fencing over the easement or re-

    quired signatures so the request for approval

    was denied.

    The committee will assist with paperwork if a

    ACCC REPORT

    Our "semi-brilliant" idea (tongue-in-cheek) about Mont-

    pelier "Seniors Helping Seniors" continues to "chug"

    along.

    We have about 20 volunteers offering to help others. We

    have had perhaps 5 requests for information or help.

    Several of the volunteers have attended to all those re-

    quests, never having to do much beyond lending a brief

    helping hand, just listening, or offering to be "there"

    when the time really comes.

    Nevertheless, our efforts were well-meaning, and all of

    us continue to stand ready to help Seniors or others

    needing similar help to continue to "live in place" in their

    own long-time homes.

    ALL EXTERIOR CONSTRUCTION,

    ALTERATIONS, SHEDS, FENCES,

    REQUIRE PRIOR APPROVALNo new construction, addition, or alteration of a Mont-

    pelier home shall be made without prior approval (see

    approval form on preceding page) from the Architec-

    tural Control & Compliance Committee. This includes

    satellite dish installation. All exterior colors and mate-

    rials shall blend harmoniously with the neighboring

    dwellings. Proceeding without prior approval shallconstitute a covenant violation subject to enforce-

    ment, including fines.

    BOAT, CAMPER, RV, TRAILER

    ENFORCEMENTBoats, campers, RVs, and camping trailers must be in

    storage from November 1 through April 30.

    UNLICENSED CARSArticle IV, section 5 of the covenants states no vehicle

    can be stored on any lot except inside the garage. All

    cars, covered or uncovered, must have a valid license

    tag and sticker. Residents may be required to provideproof of licensing if the license tag is not clearly visible

    on the vehicle. In addition to the covenant above,

    Prince Georges County Code states it is unlawful to

    have more than one motor vehicle ... dismantled, inop-

    erable or unlicensed on your premises. The one vehicle

    that is allowed must be inside a closed garage.

    USE OF PODS, DUMPSTERS, ETC.The ACCC requests notification before placing a POD,

    dumpster, or similar structure on any lot. Please in-

    clude the maximum time that the structure will be on

    the lot. Use an Approval Form for notification.

    Bulky Trash Collection is provided by ap-pointment only. To schedule an appointment,call (301) 952-7600 or e-mail Bulky Trash,

    Monday through Friday, between 7:30 a.m.and 4:00 p.m. Appointments are scheduledfor normal County workdays on a first-come,first-served basis.

    If the County fails to make the scheduled

    collection date due to inclement weather, we

    will reschedule the collection for the nextday. If the homeowner fails to place items at

    the curb by 6:30 a.m. on the scheduled col-lection day and the items are not picked up,

    the homeowner will have to reschedule forthe next available date.

    Note: Bulky Trash Collection does not pick

    up materials from evictions, foreclosures,unoccupied properties, commerical proper-

    ties, apartment complexes, home renova-

    tions, remodeling projects or clean lot en-forcement. The disposal of materials fromthese sites is the responsibility of the land-

    lord, contractor or business owner.

    Bulky Trash CollectionThe Architectural Control and Compliance Committee has received several complaints from Montpelier resi-

    dents concerning mattresses, cribs, and other large items left at the curb for many days to several weeks. It is

    a violation of Article VI, Section 1 of the Covenants to allow garbage or rubbish to remain on any Lot. If you

    have scheduled a trash pick-up, please be a good neighbor and put the items out no earlier than 24 hours be-

    fore the scheduled pick-up.

    VULTURES ARE HERE AND THEY LIKE YOUR TRASH !

    Please remember: Put garbage in covered containers or dark-colored trash bags.

    White plastic bags are especially appealing to the birds vultures have been observed breaking into white

    bags searching for food while ignoring dark trash bags. Lets all try to remove as many food sources as possible.
