Project Background 1 Background
National Highways Authority of India (NHAI), under Ministry of Shipping, Road Transport & Highways (MOSRT&H), Government of India has embarked on the ambitious National Highways Development Project (NHDP) comprising phases including development of the Golden Quadrilateral connecting the four metros of the seven country as well as the North-South and East-West Highways. The Government of India has mandated the National Highways Authority of India (NHAI) to implement the National Highway Development Project (NHDP). The National Highway-24 (NH-24) connects the national capital, Delhi and bordering Historical city of Lucknow. Upgrading the existing two lane highway to four lanes between these two major cities is a major and an integral component of the Government of India’s NHDP. The project is to be executed under DBOT pattern under NHDP Phase-III.
2 Description of Project Road
The Project Highway is a section of the National Highway-24, starting from km post 148.000 and ending at km 262.000 on NH-24, in the states of Uttar Pradesh, India (hereinafter, referred to as the Project Highway), and making a total length of 121.800 km (Index Map Fig. 1.1). This existing segment is two lanes for last decade. Project road lies between 28°47’ N, 78°45’ E to 28°25’ N, 79°26’ E.
The Project Highway passes through three districts of Uttar Pradesh, viz. Moradabad, Rampur and Bareilly. There are major urban centers like Rampur, Milak, Mirganj, Fatehganj etc. and many semi-urban centers along the Project Highway. The Project Highway is joined and/ or intersected by some National Highways and a number of State Highways (SH), Major District Roads (MDR), and Other District Roads (ODR). The Project Highway is also crossed at seven locations by railway lines. This highway in its immediate influence area serves as the main arterial road on which small traffic streams merge at different locations of the Project Highway.
3 Widening Proposals
The existing alignment of the road is generally retained except realignment at sensitive receptor location or bypasses at very congested location. The project road is conceived as partially access controlled.
The typical widened cross-section would consist of the following salient features:
i) 4-lanes of 3.5 m width each
ii) 1.5 m wide paved shoulders
iii) 1.0 m wide earthen shoulders
iv) 4.5 m wide median in rural stretch and 1.2 wide median in urban stretches

v) 7m service roads in Urban Section, except at Major Bridge and ROB locations.
vi) All ROB widened to 6-lane configuration.
4. Award of Concession
i) The Authority invited proposals by its Notice/ Request for Qualification dated 15-04-2009 (the “Request for Qualification” or “RFQ”) for short listing of bidders for construction, operation and maintenance of the above referred section of NH 24 on DBFOT basis and had short listed certain bidders including, inter alia, the IL&FS Transportation Networks Limited.
ii) The Authority had prescribed the technical and commercial terms and conditions, and invited bids (the “Request for Proposals” or “RFP”) from the bidders shortlisted pursuant to the RFQ for undertaking the Project.
iii) After evaluation of the bids received, the Authority had accepted the bid of the IL&FS Transportation Networks Limited and issued its Letter of Award No. NHAI/BOT/11019/17/2008/UP/47 dated 29-12-2009 (hereinafter called the “LOA”) to the selected bidder requiring, inter alia, the execution of this Concession Agreement within 45 (forty-five) days of the date of issue thereof.
iv) The selected bidder has since promoted and incorporated Moradabad – Bareilly Expressway Limited “the Concessionaire” as a limited liability company under the Companies Act 1956, and has requested the Authority to accept the Concessionaire as the entity which shall undertake and perform the obligations and exercise the rights of the selected under the LOA, including the obligation to enter into this Concession Agreement pursuant to the LOA for executing the Project.
v) By its letter dated 11-01-2010, the Concessionaire has also joined in the said request of the selected bidder to the Authority to accept it as the entity which shall undertake and perform the obligations and exercise the rights of the selected bidder including the obligation to enter into this Concession Agreement pursuant to the LOA. The Concessionaire has further represented to the effect that it has been promoted by the selected bidder for the purposes hereof.
vi) The Authority has agreed to the said request of the selected bidder and the Concessionaire, and has accordingly agreed to enter into this Concession Agreement with the Concessionaire for execution of the Project on DBFOT basis, subject to and on the terms and conditions of the Agreement signed on 19-02-2010.
vii) Concessionaire fulfilled all its obligations, Condition Precedents, & Applicable Permits within the stipulated time to achieve the financial close in accordance with Article 24 and requested the Authority to declared the “Appointed Date”

viii) Authority Communicated the appointed date as 04-12-2010 through letter No: NHAI/BOT/11019/17/2008/UP/15575 dated 07-12-2010.
ix) Subsequent upon the receipt of Appointed Date Concessionaire started the work in accordance with Scope of Work Defined in Schedule B together with the provision of Project Facility as specified in Schedule – C and in conformity with Specifications and Standards set forth in Schedule – D, performing and fulfilling all its obligations in accordance with provisions of the Concession Agreement and matter incidental there to or necessary for performance of any or all of the obligations of the Concessionaire under Concession Agreement.
4. Project Stretch
For the Construction purpose the Project Highway is divided into three sections and Concessionaire has deployed the 3 separator construction contractors for 3 Sections.

Stretch: From km 148.000 to km 190.000 and Major Structures (Major & Minor Bridges/VUP/ROB/GS with Piles) for entire stretch
Section – 2: Construction Contractor – M/s GR Infraprojects Limited
Stretch: From km 190.000 to km 236.500
Section – 3: Construction Contractor – M/s APCO Infratech Limited
Stretch: From km 236.500 to km 269.800

Health Checkup Camp - Free Health Check-up organized by Parivarthan Team at Dalpatpur,
Moradabad in presence of District Magistrate of Moradabad. - Health Camp has been successfully organised at Shankarpur in
Rampur District on dated 12 fab’14 in which Doctor examined 330 patients and gave medicines according to their Health problem and referred the patient if necessary to government hospital.

Land Acquisition of Milak Bypass: Action taken:: Award pronounced for five villages and being pursued for
remaining 1 village. Earthwork, GSB and Subgrade is in progress at available work front of 2.800 mtr. Local protest are still active due to delay in payment by NHAI.
Transfer of 1.451 Ha of Defence land to NHAI in Fatehgang bypass of Barellly district. (affected length : approx. 200 metres)
Action taken : Four lane has been completed in Defense Land in anticipation of approval which is in process at MOD
Bareilly Bypass Out of 30 kms of Bareilly bypass, 29.400 kms has been handed over ( 600 mtr ) land yet to be acquired due to HT ,LT line and Bilay Dham

1) Project Framework
NHAI has awarded the work to Concessionaire based on Standard Model Concession Agreement prepared by Planning Commission based on that the Broad Project Framework is as below:
The Concessionaire cannot initiate the proposal of deployment of Project Supervision Consultancy in light of non availability of work front and forced to take a view to have supervision from its own staff
Geogrids, expansion joints, pre stressing etc. and concurred the same.
Test results of borrow areas has also been reviewed by IE

Mix Designs for various highway and concrete mixes has been reviewed by IE
& remaining is in progress.
All bearings incorporated and procured so far have been tested at source by
the representative of the Independent Engineer / Railway Authorities.
Details of various source submitted IE for concurrence is attached at
Annexure – IX. This Annexure also includes the concurrence accorded for the
Sources & Mix Designs.
Testing of the materials for source and mix design and routine testing is being
done at the 3 different laboratories in three Sections of the Project Highway.

Planning and Progress
1) Quality Control & Quality Assurance The in-house supervision team deployed by Concessionaire is regularly
supervising the construction activities and monitoring the quality aspects,
progress, traffic and safety aspects of the project on day-to-day basis.
Routine laboratory and field density test are being carried out to assure the
quality of work. Random quality checks are being witnessed by
representatives of IE also.
The Quality Assurance Plan & Method Statement is submitted by the
concessionaire to Authority & IE.
Additional quality tests requested by IE/NHAI are also regularly conducted
to satisfaction of Authority concern.
2) Construction Programme, Resource Deployment, Monthly planned Quantities
Construction Methodology, Procurement, Engineering and Resource Based
Construction Time Schedule have been submitted to IE for review &
comments.
The concessionaire shall have to update the Construction Methodology,
Procurement, Engineering and Resource Based Construction Time Schedule
and submitted to IE for final approval in accordance with clause 12.1 of the
Concession Agreement based on Schedule of handing over of Land by
NHAI.
The resource deployments in terms of Plants & Equipments are ahead of the
planned deployment as indicated in the Annexure – VIA. The details of The
Targets v/s Progress of Important quantities has been included in Annexure
– VA.
The Project Progress in terms of physical work has been included in the S-
curve as attached at Annexure – XI.
3) Safety & Traffic Management Concessionaire has deputed a dedicated qualified and trained Safety Expert
with his team to oversee the safety and environmental aspect of the Project
Highway. The Safety expert will advise the Contractors for effective
implementation of safety norms.

Safety Management Team mobilized by the contractor is ensuring proper
Traffic & Safety Management along the entire stretch of the project road
especially at locations where the work is under progress. Provision of
barricades and reflective delineators are being made at deep shoulder
cuttings, on the temporary/ permanent diversions and at the location of
deep excavations. Cautionary Boards as well as other sign boards are being
provided at regular intervals to avoid any possibility of accidents. MBEL
and ITNL are monitoring the traffic and safety aspects along the project road
in order to ensure the smooth movement of traffic. All necessary and
preventive steps have been taken to ensure that proper arrangements for
diversion from the existing road are made.
Location specific diversion plan has been submitted before the diversion of
traffic to IE for review.
4) Maintenance of Existing Carriageway Existing carriageway is being maintained by the Concessionaire as per the
requirement. Pot holes if occurs are being attended immediately. Emphasis is on
preventive maintenance. Concessionaire is affected in cash flow due to non
handing over of the ROW by NHAI, Because if the land would have been handed
over to Concessionaire, work would have been completed by Concessionaire in
New Carriageway and traffic could be diverted and saved maintenance cost.
NHAI should consider the reimbursement of the expenses of maintenance of
Road to Concessionaire. To this effect, Concessionaire has written to NHAI and IE
on its position towards the maintenance of existing road.

Section 8 Status of Clearance, Approvals and Hindrances
1) Clearance & Approvals
NHAI is yet to acquire the land of total 3.153 km, i.e 120mtr at Approach of
Rajedha Bridge , 200 mtr in Rampur Bypass, 2.65 km in Millak Bypass , 280mtr in
Defense and( Fatehganj Bypass) and 600mtr (Bareilly Bypass) . Status of Balance
land to be acquired is detailed in Annexure-III
Vilay Dham structure to be dismantled by State PWD (All legal issues are settled) as Flyover is to be constructed at this location.
2) Utility Shifting & Other Hindrances
Electric Utilities
Estimate for shifting of LT Lines lines and poles have been obtained from
Respective electricity divisions for most of the locations and a few are still to be
obtained. The status of the same is detailed in Annexure- XII

Water Pipe Line
No water pipe line is noticed yet but likely to be existed in the urban portions.
2) Community Property Structures
Details are enclosed in Annexure-XII
List of other major hindrances has been indicated in letter of Project Director PIU

for Expeditious removal of hindrances in smooth implementation of Project.

The estimate for relocation of Police Station has been sent for approval of competent Authority. Even construction of LHS carriageway is not possible until the construction of RHS Service Road and RE Wall.
Masjid at Mundapandey town & compensation of the same of ` 7,25,472/- has already been paid by Authority through District Admn. to the authorised represntative of the Masjid Committee vide PIU letter no. 11011/5/2009/BOT/PIU‐MBD/4733 dated 29.08.2013. But construction of new Masjid in lieu of old is still in progress at site. Hence old Masjid falling in alignment of 4‐laning could not be demolished so far.
