The House welcomed Prof. S.C. Kakaty as a new member of the Council.

The Member-Secretary welcomed all the Hon’ble Members of the Executive Council,

Dibrugarh University and requested the Hon'ble Vice-Chancellor to take the Chair to preside

over the 330th Meeting of the Executive Council, Dibrugarh University. Accordingly, the

Chairperson extended a warm welcome to the Hon’ble Members of the Council and called

the meeting into order. He then requested the Member-Secretary to proceed with the

agenda. The Member-Secretary informed that under Section 17(vii) of the Dibrugarh University Act,

1965 (as amended upto date), Prof. S.C. Kakaty, Dept. of Head, Dept. of Statistics, D.U. has been

selected as a new member of the Executive Council, D.U. for a period of 3 (three) years or till the expiry

of his headship, whichever is earlier in place of Prof. (Mrs.), Jahnabi Gogoi Nath, Dept. of History, D.U.

The House welcomed Prof. S.C. Kakaty as a new member of the Council.

A written report on the Working of the University since 329th Meeting of the Executive Council, held on 21 March, 2016, i.e., for the period from 21.03.2016 to 26.06.2016 was placed before the Council.

Decision Resolution No. 3

Resolved to note with appreciation the written report on the Working of the University since 329th Meeting of the Executive Council, held on 21 March, 2016, i.e., for the period from 21.03.2016 to 26.06.2016.

Resolved further that the results of the examinations declared by the University during the period from 18.03.2016 to 20.06.2016, with the approval of the Vice-Chancellor, be noted.

Note

To consider recommendations of the Selection Committees, held from 1st June to 10th June, 2016 for appointment to the vacant posts of Assistant Professors, Associate Professors and Professors in the departments of the University.

Applications were invited from the eligible candidates for filling up the posts of Assistant Professors, Associate Professors and Professors in the departments of the University vide Advt. No. A-1/2016 dated 11.01.2016. The applicants who were found to be eligible as per the relevant qualifications and norms were invited to appear before the statutory Selection Committee constituted as per provision under Section 29(ii) of the Dibrugarh University Act., 1965 (as amended upto date). The Selection Committees, in its meeting held from 1st June to 10th June, 2016 interviewed the eligible candidates.

The Member-Secretary then placed before the Council the individual bio-data of the candidates who were called for interview. The Chairperson presented the recommendations of the Selection Committees. The Council examined the qualifications and experiences of the candidates, one by one, and after being satisfied, decided to approve the recommendations of the Selection Committees. The following resolutions were adopted :

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Ms. Jonali Kropi, C/o. Thengtom Rongpi, Dist. Council Driver Colony, near Children Park, Diphu, Karbi Anglong be appointed as Assistant Professor (Post No. 1), Department of Anthropology, Dibrugarh University against the post reserved for ST (Hills) in the Pay Band of Rs. 15,600/- - 39,100/- + AGP Rs. 6,000/- p.m. plus all other allowances as admissible under the rules of the University w.e.f. the date of her joining.

To consider recommendations of the Selection Committees, held from 1st June to 10th June, 2016 for promotion of teachers under Career Advancement & Promotion Scheme.

The Selection Committees, D.U. in its meetings held from 1st June to 10th June, 2016 interviewed the eligible teacher candidates of the following departments of the University for promotion from Associate Professors to Professors under Career Advancement & Promotion Scheme.

(i) Dept. of Applied Geology

(ii) Dept. of Education

(iii) Dept. of Assamese

(iv) Dept. of Political Science

The Member-Secretary then placed before the Council the individual bio-data of the candidates. The Chairperson presented the recommendations of the Selection Committees, candidate-wise in case of the candidates for Career Advancement & Promotion.

The members heard the recommendations of the Selection Committees and observed that most of the candidates for promotion from Associate Professor to Professor could not get favourable recommendation from the Selection Committees. The Council opined that the Vice-Chancellor should offer suggestion to such candidates for improvement of their performances.

The Council, after discussion, decided to adopt the following resolutions :

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. Tapos Kr. Goswami, Dept. of Applied Geology, Dibrugarh University be promoted to the post of Professor, Department of Applied Geology, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 37,400/- - 67,000/- + AGP Rs. 10,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. (Ms.) Subasana Mahanta Choudhury, Dept. of Assamese, Dibrugarh University be promoted to the post of Professor, Department of Assamese, Dibrugarh University

under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 37,400/- -

67,000/- + AGP Rs. 10,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. (Ms.) Pallabi Deka Buzarboruah, Dept. of Assamese, Dibrugarh University be promoted to the post of Professor, Department of Assamese, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 37,400/- - 67,000/- + AGP Rs. 10,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. Jayanta Kr. Bora, Dept. of Assamese, Dibrugarh University be promoted to the post of Professor, Department of Assamese, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 37,400/- - 67,000/- + AGP Rs. 10,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolution No. 26

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. Satyakam Borthakur, Dept. of Assamese, Dibrugarh University be promoted to the post of Professor, Department of Assamese, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 37,400/- - 67,000/- + AGP Rs. 10,000/- p.m. plus all other allowances as admissible under the rules of the University.

Note

To consider recommendations of the Screening Committees held on 2nd and 3rd June, 2016; 6th, 7th and 8th June, 2016 and 10th June, 2016 for promotion of teachers under Career Advancement and Promotion Scheme.

Applications were invited from the eligible teachers of the University who have qualified themselves on or before 30th June, 2015 for promotion to higher grade under CAPS vide Notification No. DU/Estt-A//Promo/CAPS (Part)/2011/154 dated 15.10.2015. The Selection Committees in its meeting held from 1st June to 10th June, 2016 also interviewed the eligible candidates which were recommended by the Screening Committees held on 2nd and 3rd June, 2016; 6th, 7th and 8th June, 2016 and 10th June, 2016 for promotion of teachers under Career Advancement and Promotion Scheme from Assistant Professor (Stage-I) to Assistant Professor (Stage-II) and Assistant Professor (Stage-II) to Assistant Professor (Stage-III).

The Council decided to adopt the following resolutions :

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Mr. Gauri Shankar Das, Assistant Professor (Stage-I), Dept. of Physics, Dibrugarh University be promoted to the post of Assistant Professor (Stage-II), Dept. of Physics, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 15,600/- - 39,100/- + AGP Rs. 7,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolution No. 28

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. (Ms.) Mina Sharma, Assistant Professor (Stage-I), Dept. of English, Dibrugarh University be promoted to the post of Assistant Professor (Stage-II), Dept. of English, Dibrugarh

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Dr. Manas Pratim Barman, Assistant Professor (Stage-I), Dept. of Statistics, Dibrugarh University be promoted to the post of Assistant Professor (Stage-II), Dept. of Statistics, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 15,600/- - 39,100/- + AGP Rs. 7,000/- p.m. plus all other allowances as admissible under the rules of the University.

Resolved that as recommended by the Selection Committee held w.e.f. 01.06.2016 to 10.06.2016, Mr. Bibhuti Bhusan Kakoti, Assistant Professor (Stage-II), Dept. of Pharmaceutical Sciences, Dibrugarh University be promoted to the post of Assistant Professor (Stage-III), Dept. of Pharmaceutical Sciences, Dibrugarh University under the Career Advancement and Promotion Scheme in the Pay Band of Rs. 15,600/- - 39,100/- + AGP Rs. 8,000/- p.m. plus all other allowances as admissible under the rules of the University.

To consider the reports of the Inquiry Committees constituted to find the veracity of the facts relating to the allegations brought against the following officers of the University.

(1) Ms. Deepali Phukan, University Engineer

As approved by the then Vice-Chancellor, D.U. 2 (two) Inquiry Committees were constituted to ascertain the alleged fraudulent acts of the University Engineer on submission of false vouchers against claimed reimbursement of expenditure incurred by the University for repairing and maintenance of various civil, sanitary, water supply and electrical works of the University and also to inquire into the allegation that payments were made for the works “Developing and Raising of Land for the proposed construction of Hostel Building for DUIET (2 Nos.)” without completion of the works vide No. DU/RG/H.01.03/13/8963 dated 09.04.2013 and vide No. DU/RG/H.01.03/13/8964 dated 12.04.2013, respectively. The Committees were requested to verify all the relevant documents submitted by the University Engineer against the advances drawn by her for the repairing and maintenance works and also to inspect the site(s) and interrogate officials / persons connected with the work(s) to find out the truth.

The findings of the said committees were placed before the 319th Meeting of the Executive Council, D.U. held on 06 May, 2013. The Council accepted the same and authorized the Vice-Chancellor to consider approval of the charges to be framed on the basis of the findings of the Inquiry Committees and directed the Registrar to serve the charge sheets to the University Engineer. Accordingly, charge notices were served to the University Engineer, D.U. vide No. DU/RG/H.01.04/13/9024-25 dtd. 31.05.2013.

The replies of the University Engineer, D.U. against the charge sheet notices served on her as per decision of the Executive Council in its 319th Meeting held on 06.05.2013 was placed in the 320th Meeting of the Executive Council, D.U. held on 13 August, 2013. The members of the Council examined the replies given by Smt. Deepali Phukan, University Engineer against the charge sheet notices served on her and opined that the University administration should prepare point-wise observations on her responses raised so that a proper decision can be taken by the Council in this regard.

The point-wise observations were prepared by the University Administration against the replies of Smt. Deepali Phukan, University Engineer, D.U. against the charges leveled against her.

The Executive Council in its 322nd Meeting held on 14 March, 2014 discussed the matter very seriously and observed that for proper investigation in both the irregularities committed, an Inquiry Committee be reconstituted comprising the members from the technical background and legal background. The Council authorized the Vice-Chancellor to constitute the Committee. Accordingly, an Inquiry Committee comprising of members from the technical background and

legal background to ascertain the alleged fraudulent acts of the University Engineer was reconstituted vide No. DU/RG/H.01.03/15/0300 dated 23.04.2015 and report of the Committee was placed before the Council for further necessary action.

The Council advised to send the report of the Inquiry Committee to Ms. Deepali Phukan and obtain a show cause reply on the report as to why the report of the Inquiry Committee instituted to examine the allegations leveled against her be not accepted by the University.

(1) Mr. Rajib Kr. Baruah, Section Officer, Accounts ‘C’ [under suspension]

An Internal Fact Finding Committee was constituted vide No. DU/RG/H.01.03/14/060 dtd. 07.02.2014 to inquire into the allegation of fraudulent acts committed by Sri Rajib Kr. Baruah, Section Officer, Accounts „C‟ [under suspension], Dibrugarh University which was placed in the meeting of the Executive Council, held on 10.06.2014. The Council discussed the report and authorized the Vice-Chancellor for initiating further necessary action.

As directed, a Charge Sheet Notice was served upon Sri Rajib Kr. Baruah for the allegations leveled against him. Accordingly, Sri Baruah submitted his written statement in response to the said Charge Sheet. Further, the Council apprised that the reply furnished by Sri Rajib Kr. Baruah, Section Officer, Accounts „C‟ (under suspension), Dibrugarh University against the charges brought against him was not convincing and therefore a 3-Member Inquiry Committee was instituted as per the provision of the D.U. Rules and Regulations (vide No. DU/RG/H.01.03/14/0824 dated 08.12.2014) to examine the matter thoroughly.

The report of the 3-Member Inquiry Committee comprising of Smt. Krishna Gohain, Registrar, AAU, Jorhat; Sri Arup Phukan, Advocate, Dibrugarh and Sri Kumarjit Dutta, Deputy Registrar (F&A), Tezpur University was placed in the meeting. Later on, as because of the inability to attend in the Inquiry Committee by Smt. Krishna Gohain, Sri Satyabrata Sarmah, Advocate was assigned the responsibilities as the Chairperson of the Committee.

The Council further advised the Member-Secretary to serve a show cause notice on Sri Baruah asking him as to why the report of the Inquiry Committee instituted to examine the allegations leveled against him be not accepted by the University.

Decision Resolution No. 40

Resolved that Ms. Deepali Phukan, University Engineer and Sri Rajib Kr. Baruah, Section Officer, Accounts „C‟ (under suspension), Dibrugarh University be served Show Cause Notices asking them as to why the University should not accept the reports of the Inquiry Committees instituted by the University to inquire into the alleged charges brought against them.

Addl. Item No. 1 To consider discussion on amalgamation of the Centre for Studies in Biotechnology and the Centre for Bioinformatics Studies of the University, as recommended by the Adviser, DBT, Govt. of India.

Note Under report to the Academic Council and Executive Council, amalgamation of the Centre for Studies in Biotechnology and the Centre for Bioinformatics Studies of the University has been approved vide No. DU/DR-A/43-1/16/783 dated 14.06.2016. Henceforth, these two Centres have been amalgamated as Centre for Biotechnology and Bioinformatics.

The Members of the Council discussed the matter regarding amalgamation of the Centre for Studies in Biotechnology and Centre for Bioinformatics Studies and suggested to place the matter before the appropriate forum of the University to report its approval.

The Hon‟ble Members expressed concern on the process of amalgamation of the Centre for Studies and Biotechnology and the Centre for Bioinformatics Studies of the University without placing the matter of amalgamation before the Academic Council as well as the Post Graduate Board of the University.

Note

To consider discussion for regularization of teaching and non-teaching staff of the Directorate of Distance Education (DDE) of the University, as recommended by the BoM, DDE.

During the visit of the inspection team of DEB, UGC on 4th & 5th January, 2013 for granting recognition to DDE, D.U., the team highly objected on the matter of running the Office with non-regularized teaching and non-teaching staff in the DDE. The team, on receiving an „Undertaking‟ from the Registrar, D.U. with the assurance that the authorities of the D.U. would regularize the posts, agreed upon to grant recognition on some terms and conditions. Further, the Board of Management, DDE in its 52nd (Emergent) Meeting held on 09th April, 2015 has constituted a Committee for examining the matter of regularization of the faculty members and the non-teaching staff of the DDE. And reference to the Resolution Nos. (3), (4) and (5) along with the observations under Item No. (3) of the 54th Meeting of the BoM, DDE, D.U. and as supported by the recommendations given by the Committee constituted for regularization of the posts, some teaching and non-teaching posts may perhaps be considered for regularization.

The Note on the matter submitted by the Director, DDE and Extracts of the 54th Meeting of the BoM, DDE are placed for perusal and necessary action.

The members of the Council discussed the matter and taking into consideration the seriousness of matter, the Council decided to approve the matter in principle. However, to consider the matter favourably, the Council decided to authorize the Vice-Chancellor to institute a Committee for examining all the aspects.

Resolved that the proposal for regularization of the teaching and non-teaching staff of the Directorate of Distance Education (DDE) of the University, as recommended by the BoM, DDE be accepted and the Vice-Chancellor be authorized to institute a Committee for examining all the aspects to consider the matter.

The Council discussed the matter and suggested to forward the matter to the Govt. of Assam for consideration of its approval. The Council observed that being a state University, such kind of policy matter is not under the control of the authority.

Boruah as the Director, in-charge in the Centre for Library & Information Science Study and Prof. P.K. Bhuyan as the Centre in-charge in the Centre for Atmospheric Studies for two more years, w.e.f. 1st July, 2016.

The Board of Management, Centre for Library & Information Science Studies held on 26.06.2016 has recommended to continue the service of Prof. Bhim Kanta Boruah as Director In-Charge of the Centre even after his joining the University as Emeritus Fellow for another period of 2 (two) years, w.e.f. 1st July, 2016.

The Board of Management, Centre for Atmospheric Studies held on 26.06.2016 has recommended to continue the service of Prof. Pradip Kr. Bhuyan as Director In-Charge of the Centre for the 2 (two) years period from July 01, 2016 to June 30, 2018.

The Council discussed the matter and opined that smooth functioning of the administration and considering the present circumstances, the existing Act, Regulation, Rules etc. of the University are urgently required to amend.

Resolved that a high level committee be constituted to review the provision for amendment of the Dibrugarh University Acts, Rules, Rugulations etc.
