The 349th Meeting of Registration Committee (RC) was held under the Chairmanship of Dr.

The Minutes of 348th meeting were confirmed with slight modification as under :
i. Agenda Item No. 3.2. A clarification may be sought from Ministry of Environment & Forests (MoE & F), regarding exemption about use of Methyl Bromide in Quarantine and pre-shipment applications as per Rule 3 (a) (2A) vide Gazette Notification No. SO 1353 (E) dated 23rd May, 2013 from MoE & F.

2.1 Applications pending under various sub-sections of the Insecticides Act, 1968 .
Noted with satisfaction. 3.0 Government Business
3.1 Consideration of recommendations of committee to develop guidelines for weeding out/retention of old technical records.
The recommendations of the Committee with slight modifications as annexed (Annexure – I) are accepted, subject to approval by DAC.
3.2 Consideration of the issues discussed in the Open House Meeting held on 27th May, 2014 in the CIPMC Auditorium, Faridabad.
The recommendations of Open House along with comments of Secretariat of CIB&RC (Annexure – II) were discussed and approved by RC with constitution of following committees for submitting report to RC within two months on the issues pertaining to guidelines
i. A Committee has been formed under the Chairmanship of Dr. T. P. Rajendaran, OSD, NIBSM, Raipur to look into the issue of TIM Vs. TI, TI (New Source), twin Pack, bulk packaging guidelines and other guidelines related issues. The other members are as under: a. Dr. S. N. Sushil, Plant Protection Adviser, Dte. Of PPQ & S, Faridabad. b. Dr. Gajbhiye, Head of Department of Chemistry, IARI, New Delhi. c. Dr. Tanwir Alam, Joint Director, IIP, New Delhi. d. Mr. D. Bhattacharya, Deputy Director ( Chem), CIB&RC, Faridabad. e. Dr. A. N. Singh, Deputy Director (WS), CIB&RC, Faridabad – Member Secy.
ii. The terms of the reference of the existing Expert Committee under the
Chairmanship of Dr. A. N. Mukhopadhyay, Ex- VC, AAU shall be expanded to review the toxicity guidelines & protocols for the studies for registration of bio-pesticides and their combinations. It has been decided that Dr. Shalini Chawla, Professor, MAMC and Member RC and Dr. Sarita Bhalla, Specialist Grade – I may be inducted in the existing Expert Committee.
3.3 Decision of Hon’ble High Court of Kerala at Ernakulam in Writ Appeal No. 617, 630, 648 and 649 of 212 w.r.t. registration/import permit for Boric Acid.
i. RC noted the directives of the DAC as annexed in agenda. ii. RC noted with dissatisfaction that the indigenous manufacturers of Boric Acid are
not supplying the information on the prescribed proforma with the quantum of such pesticides being manufactured and sold by them to ascertain and verify the end-use of such products. In view of this the Committee decided that the communication may be sent from DAC to Ministry of Chemicals & Fertilizers for getting compliance of the Order of the Hon’ble High Court of Kerala.
iii. Henceforth, RC decided to issue the import permit in consonance with the recommendations of nodal ministry/department and quantity applied for, whichever is less, also considering the un-utilized stock.

3.4 Approval of Protocol for sub acute studies of M/s Sudarshan Chemicals Industries Ld.,. of product Cartap hydrochloride Technical.
Approved.
3.5 Mandatory requirement of documents for registration u/s 9(4) FIM/FI/TI category.
Approved as proposed in Agenda and to be implemented w.e.f. 1st August, 2014 (Annexure – III).
3.6 Consideration of case of Tropical Agrosystem Pvt. Ltd. regarding illegal import of Imidacloprid Technical.
In view of satisfactory report from CIL, Custom Authorities may be informed for releasing the consignment of Imidacloprid Technical.
3.7 Consideration of case of a complaint on illegal import of Dimethoate Technical & Pendimethalin Tech. by M/s Modern Insecticides Ltd., Ludhiana.
The Committee deliberated the issues in detail and decided that since the registrant, on realizing the mistake, did not get the material released or used it, and deported the same at his own, following action may be immediately taken:-
(i) Relevant Certificates of Registration issued to them may be called back and amended suitably; and
(ii) an affidavit be obtained from the firm stating that whatever they have stated in reply to the show cause notice is true and correct, and if they are found to be involved in such activity again, legal action shall be taken against them besides cancellation of the Certificates of Registration.
(iii) A stern warning may also be issued by APPA & Secretary (CIB&RC) to the registrant.
3.8 Report on illegal import of Methyl Parathion technical for China
The Committee deliberated the issues in detail and decided as under:
(i) That recommendation be made to DAC for the cancellation of the Certificate of Registration of the firms mentioned in agenda as per TLC report involved in illegal import from China, the country where the manufacture and export of Methyl Parathion Technical is banned since 2008.
(ii) The Customs Authorities may be informed not to permit any import of Methyl Parathion Technical from China.
(iii) The consignment pending with Customs, Kolkata may be deported as per Customs Act as the material does not confirm to the specification.
(iv) A complete report about other importers/firms involved in illegal import of Methyl Parathion Technical be completed at the earliest by TLC and put up in next meeting of RC for consideration.

3.9 Consideration of case of a complaint on illegal import of Dimethoate Technical clarification required.
In view of the clarification sought by the Director (Customs), a Public Notice may be issued on the website of CIB&RC to the effect that intention of RC is to keep the source name for import of Dimethoate Technical in abeyance and not the material. It is further clarified that as this source does not exist the material already imported, may not to be allowed to be entered in the country.

6. Guidelines for registration of TI V/s TIM u/s 9(3)
The Chairman, ASRB & RC informed that the Committee has already taken a considered view on the issue and accordingly guidelines have been reviewed and finalized by making an Expert Committee under the Chairmanship of PPA, which also consulted the associations of pesticide industry and accordingly a minor change was duly made so that the applications are not rejected at preliminary scrutiny stage. As such, the issue stands settled. However, the RC will take a view again while considering these minutes in its meeting in due course.
This issue has already been settled by the RC on the recommendation of EC under the chairmanship of PPA. However if RC feels this may again be reformed an EC for recommendation.

7. Guidelines for 9 (3) (New Source) V/s TI
It was explained that a few guidelines were reviewed in the recent past and that this issue shall also be looked into while considering the minutes in the meeting of the RC.

8. Bio pesticides laced with chemical pesticides
Industry representative informed the market is flooded with bio-pesticides laced with chemical pesticides, thus, ruining and bringing bad name to the beautiful environment-friendly approach of plant protection, IPM. Some unscrupulous elements are engaged in manufacture of spurious bio-pesticides, which operate flight-by-night. They are reaping the benefit at the cost of crops of poor farmers. 11. I Illegal import of Pesticides
(a) Illegal sale of imported pesticides in domestic market against import for export registration etc.
(b) Illegal import of pesticides from doubtful sources.
The House was updated about regular updation of source of import Any change may be brought to notice of Sectt. It was also decided that a letter may be written to the Member (Customs), Central Board of Excise and Customs, Department of Revenue, Ministry of Finance, North Block, Central Sectt, New Delhi-110 001 to inform the Customs Officers posted at all international transit ports/points to be cautious about it and do not let illegally imported consignments pass through such ports/points. Quality violators may be brought to the book by way of administrative and legal actions. Source approved for import of pesticides (Technical and Formulation) may be got verified from the regulatory authority of the country.
A letter may be written to the Customs authority not to release in India any consignment imported from illegal source. Violators should be booked and stern action should be taken. Source verification also has to be done regularly.

12. Court case about import of formulations without registering the technical
The House was informed that the matter is sub-Judice in the Hon’ble High Court of Gujarat and the final Order is yet to come. Therefore, decisive action could be taken only on receipt of the same.

13. Guidelines for grant of registration of insecticides for export only under section 9(3) of the Insecticides Act, 1968 (Ref. point no.3.1 of 347th RC Minutes)
The revised guidelines for registration under export only categories have been approved by RC, which shall come into force w.e.f. July 01, 2014.

14. Verification of Testing Facilities for Generating and Accepting toxicity studies data for GLP certified/compliance laboratories for the purpose of Registration of Pesticides.
RC categorically clarified that 26 GLP laboratories are existent in the country for such studies. More could be in the offing. This situation is going to arise at least once, as & when this requirement is imposed. Therefore, earlier, the better. There could be teething problems, which have to be borne with. The situation shall ease with the progress of time.

15. Documents to be filed along with the registered applications u/s 9(4).
This issue has been discussed with the officials of NIC who expressed their inability to modify the existing software. The Secretary (CIB&RC) also clarified that the office bearers of a company, their status, address of manufacturing premises/corporate office, etc. keep changing from time to time. Therefore, submission of requisite documents for grant of registration under this category cannot be dispensed with.

16. Categorization of filing applications under section 9(4) by the existent and the new applicants
Associations of pesticide industry suggested to divide the application u/s9(40 in to two categories as under:
(a) Old/existing applicants; and (b) new applicants.

He lamented that as & when the RC tries to regulate and streamline the receipt of applications to facilitate quick registrations to meet genuine needs, one of the associations seeks legal recourse against it. The RC has, therefore, decided to adopt ‘first come, first serve’ basis to deal with the applications. RC is open to considering innovative ideas, provided all the associations have consensus on the issue.
17. Visiting hours in the Secretariat of CIB&RC on visitors day.
The Secretary (CIB&RC) accepted the demand of the industry associations to extend the visiting hours from 14.30 – 16.30 hours to 14.30 -17.15 hours on every Tuesday and Thursday.

18. Validity of the Manufacturing License
The house was informed that as per the Rule 11 of the Insecticides Rules 1971 the validity of the Manufacturing License of Pesticides is for a Period of 2 years. Secretary (CIB & RC) clarified that Government of India has increased the duration of retail sale license for household insecticides from 2 years to 10 years. However, there is no change in the duration of licenses with regard to any other license, including the manufacturing license.

organizing workshop on Bio-pesticides.
Associations of bio-pesticide manufacturers informed that they are planning to hold a workshop on the bio-pesticides. Secretary (CIB&RC) welcomed it and assured if any kind of help is required in organizing the proposed workshop, Sectt of CIB&RC would be happy to extend a helping hand. He also desired that the proposed workshop be held at an early date.

The Secretary (CIB&RC) informed the house that there are several reasons for it, viz. failing of a lot of samples in CIL at the time of registration u/s 9(3), applicants seeking higher shelf-life at the time of regular registration, etc. despite the fact that the sample of the same product had passed at the time of provisional registration u/s 9(3B). Therefore, there is no harm, if the RC wants to get satisfied with the quality of the product twice. Hence, dispensing with this requirement is not considered appropriate.
