General Eligibility Requirements for Advertising
1. ProductsorserviceseligibleforadvertisinginPDApublicationsshallbegermaneto,effectivein,andusefultothescienceandtechnologyofpharmaceuticalmanufacturing,andshallbecommerciallyavailable.
2. ProductswhichareprohibitedfrombeingmarketedintheUnitedStatesbytheFoodandDrugAdministration(FDA)oranyUnitedStatesgovernmentagencyareineligibleforadvertisinginPDApublications.
3. PharmaceuticalproductsforwhichwrittenapprovalofaNewDrugApplicationbytheFDAisaprerequisiteformarketingwillbeeligibleforadvertisingonlyaftersuchapprovalhasbeengranted.
4. Completescientificandtechnicaldataconcerningtheproduct’ssafety,operationandusefulnessmayberequiredandmustbefurnishedtoPDAuponrequest.PDAreservestherighttodeclineadvertisingforanyproductwhichisinvolvedinlitigationwithrespecttoclaimsmadeinthemarketingoftheproduct.
5. Abookorpublicationproposedforadvertisingmayberequestedforreviewsothatitseligibilitymaybedetermined.
6. MiscellaneousproductsandservicesnotintheaboveclassificationmaybeeligibleforadvertisingiftheysatisfythegeneralprinciplesgoverningeligibilityforadvertisinginPDApublications.
