၁။ဤဥပေဒကျမနမာနငငခရးသြားလပငနးဥပေဒဟ ေခၚတြငေစရမည။

1. This Law shall be called the Myanmar Tourism Law.

2. The following expressions contained in this Law shall have the meanings given hereunder:

Visitor means a traveller taking a trip to a main destination outside his/her usual environment, for less than a year, for any main purpose (business, leisure or other personal purpose) other than to be employed by a resident entity in the country or place visited.

(က)ခရးသြားလာေရးလပငနးဆသညမာ ခရးသြားလာျခငးနငစပလဥးျပးစစဥေဆာငရြကေပးေသာေဘာဂလပငနးကဆလသည။

(a)Tourism mean business undertaken related to travelling. This definition includes businesses

b) Tourist means an individual, who makes an overseas trip for any purpose to a destination away from their usual place of residence. It includes foreign tourists travelling within and entering into Myanmar, and Myanmar tourists travelling to other countries.

Tourist means a Visitor (domestic, inbound or outbound) whose trip includes an overnight stay, or as a same-day visitor (or excursionist) otherwise.

(ဂ) ခရးသညတညးခေနထငရနေနရာ ဆသညမာ ဟတည၊ မတည၊ ဧညေဂဟာ၊ တညးခခနး၊ အပရာႏငနနကေစာစာ စစဥေပးသညေနရာ၊ တညးခရပသာ၊ စခနးခတညးခသညေနရာနင စးပြားေရးအလ႔ငာ အခေၾကးေငြျဖင ငားရမးေနထငခြငေပးသည အေဆာကအအ သ႔မဟတစခနးခေနရာကဆလသည။

(c)Tourist Accommodation includes hotels, motels, lodges (ဧညေဂဟာ), l (တညးခခနး), bed and breakfast places, lodging-houses (တညးခရပသာ)၊ camps, buildings or campsites, offering commercial accommodation.

ခရးသညမား တညးခေနထငရနေနရာ ဆသညမာ ခရးသြားဧညသညမားအား

ညအပတညးခေနထငႏငေသာ စးပြားျဖစ လပငနးအားလးက ဆလသည။

Tourist Accommodation includes all forms of overnight accommodation offered to Visitors on a commercial basis.

The law should have language which covers all types of commercial accommodation – instead of listing some types of accommodations. (ဃ) ခရးစဥဆသညမာ ခရးစတငထြကခြာသည ေနရာေဒသတစခမ အျခားေနရာေဒသတစခသ႔ ခရးသြားလာေရးအတြက စနစတကေရးဆြထားသညအစအစဥကဆလသည။

(d)Itinerary means a systematically developed programme for travel from a starting destination to another destination.

(d)Tourism Destination means an area with tourist attractions.

Destination Management Organisation is an organizational entity which may encompass the various authorities, stakeholders and professionals and facilitates tourism sector partnerships towards a collective Destination vision.

(စ) ခရးလညလညေရးလပငနးဆသညမာ ခရးသညမားတစေနရာမတစေနရာသ႔သြားလာရာတြင အဆငေျပေခာေမြ႔စြာပ႔ေဆာငျခငး၊ တညးခရနေနရာစစဥေပးျခငးနင ဧညလမးညႊနစစဥေပးျခငးမားက ေဆာငရြကေပးသညစးပြားေရးလပငနးကဆလသည။

(f) Tour Operator Business means to make arrangements to transport tourists smoothly from one place to another, and arrange accommodation and guide services.

(ဆ) ဟတညလပငနးဆသညမာ ခရးသညမားတညးခရနသတမတထားေသာအခနးအေရအတြကႏင အဆငအတနးတ႔ရျပး အစားအစာအေဖာယမကာႏင အျခား၀နေဆာငမလပငနးမား စစဥလပကငေပးသညစးပြားေရးလပငနးကဆလသည။ ယငးစကားရပတြင မတညနငဧညေဂဟာလပငနးတ႔ပါ၀ငသည။

(g)Hotel Business means to provide overnight accommodation that meets the prescribed number and standard of rooms, food and beverage and other services. This expression includes motels and lodges.

ပယဖကရန Remove No need for a separate definition. Accommodation should include hotels. (ဇ) တညးခရပသာလပငနးဆသညမာ နငငျခားခရးသညမားအတြကျဖစေစ၊ ျပညတြငးခရးသညမားႏငျခားခရးသညမားအတြကျဖစေစ တညးခေရးက စစဥေဆာငရြကေပးသညစးပြားေရးလပငနးကဆလသည

(h)Guesthouse Business means the provision of overnight accommodation for foreign tourists or local tourists or a combination of both.

(စ) ခရသြားလာေရဆငရာ

သယယပ႕ေဆာငေရး လပငနးဆသညမာ အျခားနငငမားမာ ျမနမာနငငသ႕ လာေရာကသမား ၊ ျမနမာ႕ခရးသြားမားမ တစေနရာမတစေနရာ သ႕ ေငြေၾကးအဖးအခပါဝငေသာ ခရးသြားမႈျပလပရာတြင သးစြေသာ စက၊ေလယဥ၊ သေဘာၤ၊ ရထား စသညတ႕ႏင႕ အျခားခရးသညက သယယပ႕ေဆာငရာတြင အသးျပေသာ ယဥလပငနးအားလးက ဆလသည။

(i)Tourist Transportation Business means activities which use a motor vehicle, plane, vessel, train or any other means to transport foreign tourists entering into Myanmar or outbound Myanmar tourists for commercial purposes.

ပယဖကရန Remove It is difficult to distinguish between mainstream transportation e.g. trains, planes etc for tourists, excursionists or travellers. Therefore, there should not be a specific category of Tourist Transportation. Services which involve transporting tourists which are specifically targetted at tourists e.g. balloon rides should primarily be regulated for safety by competent authorities, but could also be regulated as Tourism Services. Other forms of transport e.g. ebikes, kayaks should be covered by the general

(ည) ဧညလမးညႊနလပငနးဆသညမာ ခရးသညမားအားဆြေဆာငနငေသာ ခရးစဥေဒသမားကလမးညႊနျပသျခငး၊ ေျပာဆရငးျပျခငးနင ခရးစဥတစေလာက အဆငေျပေခာေမြ႔ေစေရးအတြကစးပြားေရးအလ႔ငာ စစဥေဆာငရြကေပးေသာလပငနးကဆလသည။

Tourist Guide Business means the commercial provision of explanations or commentary about tourist attractions and arranging for smooth and convenient journeys by tourists


(ဋ) အျခားလပငနးမားဆသညမာ

ခရးသြားလာေရးႏင႕ကဆငေသာ အျခားလပငနးမားက ဆလသည။

Other Tourism Services means other services related to tourism.

ခရးသြားလပငနးဆငရာ ဝနေဆာငမႈမား ဆသညမာ အျခားစာပဒတြင အဓပၸါယဖြငဆထားျခငးမရေသာ သ႕မဟတ အျခားဥပေဒမားတြင အဓပၸါယဖြငဆထားျခငးမရေသာ

Other Tourism Services means all other forms of commercial services related to tourism which are not defined elsewhere or covered by other laws.

ဥပမာ အေနျဖင႕ ခရးသြားမား အသးျပေသာ ဘတစကား၊ေလ စသည႕ စးပြားျဖစခရးသြားသး သယယပ႕ေဆာငဆငရာ ယဥမားကလညး ဥပေဒတြင ထည႕သြငးျပဌာနးရမည။

ခရးသြားလပငနးႏင ဆကစပသည စးပြားလပငနးဆငရာ ဝနေဆာငမႈအားလးက ဆလသည။

(ဌ) လငစငဆသညမာ ခရးသြားလာေရးလပငနးတြငပါ၀ငသည လပငနးတစမးမးကလပကငနငအတြက ဤဥပေဒအရထတေပးေသာ လငစငကဆလသည။ ယငးစကားရပတြင ခရးလညလညေရလပငနးလငစင၊ ဟတယလပငနးလငစင၊ တညးခရပသာလငစင၊ ခရးသညပ႔ေဆာငေရးလပငနးလငစင၊ ဧညလမးညႊနလငစငနင ခရးသြားလာေရးလပငနးဆငရာ အျခားလပငနးလငစငမားပါ၀ငသည။

License means a License issued under this Law, to operate any of Tourism service. This covers Tour Operator License, Hotel License and Guesthouse License, Tourist Transportation License, Tourist Guide License and Licenses for Other Tourism Services.

(ဌ) လငစငဆသညမာ ခရးသြားလာေရးလပငနးတြငပါ၀ငသည လပငနးတစမး မးက လပကငနငအတြက ဤဥပေဒအရ ထတေပးေသာ လငစငက ဆလသည။ ယငးစကားရပတြင ခရးသြားမား တညးခေနထငရာလပငနးမားလငစင၊ ဧညလမးညႊနလငစငနင ခရးသြားလာေရးလပငနးမားဆငရာ လပငနးလငစဥမားပါဝငသည။

License means a License issued under this Law, to operate any Tourism Service. This covers Tour Operator License, Hotel License, and Guset House License Accommodation License, Tourist Transportation License, Tourist Guide License and Licenses for Other Tourism Services.

(ဍ) ၀နၾကး႒ာနဆသညမာ ျပညေထာငစသမၼတျမနမာနငငေတာအစးရ၊ဟတညနငခရးသြားလာေရး ၀နၾကးဌာနကဆလသည။.

Ministry means the Ministry of Hotels and Tourism of the Republic of the Union of Myanmar.

(ဗ) ၀နၾကးဆသညမာ ဟတညနငခရး သြားလာေရး၀နၾကးဌာနျပညေထာငစ၀နၾကးကဆလသည။

Minister means the Union Minister of the Ministry of ဟHotels and Tourism.


(ဏ) ဥးစးဌာနဆသညမာ ဟတညနငခရးသြားလာေရး၀နၾကးဌာန၊ ဟတညနငခရးသြားညႊနၾကားမဥးစးဌာနကဆလသည။ ယငးစကားရပတြင ၀နၾကးဌာနကစမဖြ႔စညးမညဥးစးဌာနမားလညးပါ၀ငသည။

Directorate means the Directorate of Hotels and Tourism.

(တ) စစေဆးေရးအဖြ႔ဆသညမာ ခရးသြားလာေရးလပငနးမားကစစေဆးနငရန ဤဥပေဒ အရ ဖြ႔စညးထားေသာအဖြြ႔ကဆလသည။

Inspectorate means a body formed under this Law in order to inspect tourism businesses.


(ထ) ဗဟေကာမတဆသညမာ ဤဥပေဒအရဖြ႔စညးေသာ

Central Committee means the Central Committee

Tourism Authority means the Tourism Authority formed under this Law.


(ဓ) တငးေဒသၾကး သ႔မဟတ ျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔ ဆသညမာ ဤဥပေဒ အရ ဖြ႔စညးေသာ တငးေဒသၾကး သ႔မဟတ ျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔ ကဆလသည။

Regional (or) State Tourism Authority means the Regional (or) State Tourism Authority formed under this Law.


(န)ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔ ဆသညမာ ဤဥပေဒအရဖြ႔စညးေသာ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔ ကဆလသည။

Union Territory Tourism Authority means the Union Territory Tourism Authority formed under this Law.


(ပ) သကဆငရာ၀နၾကးဌာနဆသညမာ ျပညေထာငစအစးရအဖြ႔ကအမးသားခရးသြားလပငနးဖြ႔ျဖးေရးအတြက အမန႔ေၾကာျငာစာထတျပန ၍ သတမတသည၀နၾကးဌာနမားကဆလသည။

Relevant Ministry means the Ministries which the Union Government shall notify are responsible for national tourism sector development


(ဖ) ပဂၢလကခရးသြားလပငနးအဖြ႔အစညးဆသညမာဤဥပေဒအရခရးသြားလပငနး၀နေဆာငမကလငစငျဖငေဆာငရြကေသာပဂလကခရးသြားလပငနးကကယစားျပသည ပဂၢလကအဖြ႔အစညးသ႔မဟတအသငးအဖ႔ကဆလသည။

Private Sector Tourism Association means the private sector organisation (or) Association that represents the private sector providers of tourism services Licenced under this Law.

Sustainable Tourism means tourism that takes full account of its current and future

Ecotourism means nature-based forms of tourism in which the main motivation of the tourists is the observation and appreciation of nature as well as the traditional cultures prevailing in natural areas.

အရညတညတ႔သည အသကေမြးဝမးေၾကာငးမႈမားက အေထာကအပ႕ျဖစေစၿပး ေဒသရ လမႈႏင႕ ယဥေကးမႈ ဓေလ႕ထးတမးအစဥအလာမား သဘာဝနင ယဥေကးမႈအေမြအႏစမားက တနဖးထားကာကြယလက ေဒသချပညသမား တးတကေစေရး ပ႕ပးသည ေဒသခလမား

Community-Based Tourism is tourism activity, community owned and operated, and managed or coordinated at the community level that contributes to the well-being of communities through supporting sustainable livelihoods and protecting valued socio-cultural traditions and natural and cultural heritage resources.

3. The main objectives of this Law are as follows:

This Law applies to tourism activities, public sector activities directed at promoting tourism, suppliers of tourism products and services, tourists and consumers of tourism products and services, as well as local communities. Its main objectives are:

a) To promote sustainable development of Tourism which respects the environment and cultural traditions, and respects existing business and social laws and regulations, by undertaking short-term and long-term projects

b) To support effective domestic and international marketing of Myanmar as a Tourist Destination;

To ensure that management, decision-making, licensing and revenue-raising from Tourism activities is decentralised to State and Regional Governments in accordance with the Constitution

Law 45/2015 of 22 July 2015 amending the 2008 Constitution specifically included hotels, guesthouses and tourism in Schedules 2 (state/region regulation) and 5 (state/region taxation) of the Constitution ၂၀၀၈ ဖြ႕စညးပ အေျခခဥပေဒ၊ ဥပေဒျပငဆငခက ၄၅။၂၀၁၅ - ဇလငလ ၂၂ယ ၂၀၁၅ . သည ဟတယ၊ဧည႕ရပသာ၊ ႏင႕ အျခား ခရးသြားလပငနးဆငရာ ပါဝငသည။ ( ျပညနယ၊ တငးေဒသႀကး ဆငရာ အခြနေတာ)

(င)ခရးသြားလာေရးလပငနးဖြ႔ျဖးတးတကေရးနင စမခန႔ခြေရးဆငရာညနငးပေပါငးေဆာငရြကမက ျမငတငသြားရန

e) To enhance Tourism coordination and planning;

f) To develop human resources and increase employment opportunities by enhancing knowledge of Tourism;

To ensure that tourism contributes to the conservation of the environment, including biodiversity and marine and land ecosystems

In accordance with Article 188 and Schedule 2 of the Constitution, the Region or State Hluttaw may enact legislation concerning tourism providing it does not reduce levels of safety, environmental or consumer protection compared to Union legislation. Where legislation is not adopted at Region or State level, Union law shall apply.

5. The functions and duties of the Central Committee are as follows:

Guiding and supervising the development and implementation of a national Tourism master plan and associated national strategies and projects

(က) ျမနမာနငငခရးသြားလာေရးလပငနးဖြ႕ျဖးတးတကေရးအတြက လအပေသာကစၥရပမားက ၀နၾကး႒ာနမား၊ အစးရ႒ာနအဖြ႕အစညးမား၊ တငးေဒသၾကးနငျပညနယအစးရအဖြ႔မားနငညနငးေဆာငရြကျခငး

a) Coordinating with ministries, government organisations and State and Region Governments on matters necessary for the development of Myanmar’s Tourism sector;

(က)ျမနမာနငငခရးသြားလာေရးလပက႑ ဖြ႕ျဖးတးတကေရးအတြက လအပေသာကစၥရပမားက ျပညေထာငစ ဝနႀကးဌာနမား ႏင႕ အစးရအဖြ႕အစညးမား ညနငးေဆာငးရြကျခငး။

Coordinating with Union ministries and government organisations on matters necessary for the development of Myanmar’s Tourism sector;

b) Undertaking necessary measures and programmes to develop Tourism in less developed states and regions in Myanmar and giving guidance to increase development and the standard of living in those states and regions through Tourism;

(ဃ) ျမနမာနငငေရေျမသဘာ၀အလအပမား၊ ဇ၀မးစမးကြမားေရရညတညတေရးအတြက ခရးသြားလပငနးနငအတသဘာ၀ပတ၀နးကငထနးသမးေရးက အေထာကအကျဖစေစမညလပငနးမားကသကဆငရာအစးရ႒ာနမား၊ အဖြ႕အစညးမားနငညႏငးေဆာငရြကျခငး

12. The following are the functions and duties of the State, Region or Union Territory Tourism Authority:

a) Implementation of the policies and guidelines on Tourism set by the Central Committee;

b) Coordination with local government departments and authorities to promote enjoyment and good relations between Tourists and local people, and prevent and address safety issues and annoyances;

d) Formation of teams to scrutinise License applications and designation of their functions and responsibilities;

17. Anyone who intends to operate a Hotel or Guesthouse must seek prior permission from the Tourism Authority before commencing to build or renovate a Hotel or Guesthouse, in accordance with the designated procedures, unless otherwise

Anyone who intends to build, operate or renovate commercial Accommodation must obtain relevant permissions from the municipal Authority.

There is currently an artificial division between licencing of accommodation by municipal authorities, and by MoHT. It is recommended that these two licencing streams be unified, with the Municipal Authorities licenced to issue all Accommodation licences, in line with regional/municipal development plans.

The role of the Law should be to enable the Tourism Authority to determine classification/quality ratings လကရခရးသြားလပငနးဥပေဒတြင ျပဌာနးထားေသာ တညးခေနထင႕ရာ လပငနးမားအတြက လငစင တစခ ထပ၍ ယရမည႕ အခကသည အေသးစား အလတစား ခရးသြားလပငနးဆငရာ လပငနးမားအတြက အဟန႕အတာ ျဖစေနသလ႕ ဝနထတဝနပးတစခ ျဖစေနပါသည။

18. Anyone who has already obtained prior permission from the Ministry for building or renovating a Hotel or Guesthouse on the date this Law is enacted, without being required to resubmit the application, is required to apply for a Licence from the concerned State, Region or Union Territory Tourism Authority.

All Accommodation must be compliant with national and local building codes, fire safety requirements, as well as the provisions of environmental law.

State/Region/Union Tourism Authorities shall inspect the Accommodation and determine its compliance with the classification system for Accommodation established by the Myanmar Tourism Authority.

To be in line with the definitions of Chapter (1). အခနး (၁) တြင ျပဌာနးထားေသာ အဓပၸာယဖြင႕ဆခကမား ႏင႕ တညရန Tour Operator/Tourism Transportation is included under Tourism Services ခရးလည႕လညေရး လပငနး ႏင႕ ခရးသြားလပငနးဆငရာ သယယပ႕ေဆာငေရး လပငနး စသညတ႕သည ခရးသြားလပငနးဆငရာ လပငနးမား ေအာကတြင ပါၿပးျဖစသည။ Accommodation licensing is by the Municipal authority.

(ဂ) ခရးသညပ႔ေဆာငေရးလပငနး (ဃ) ဧညလမးညႊနလပငနး (င) ခရးသြားလာေရးလပငနးဆငရာအျခား၀နေဆာငမလပငနး

(ဂ) ခရးသညပ႔ေဆာငေရးလပငနး (ဃ) ျပညနယတငးေဒသႀကး ဧညလမးညႊနလပငနး (င) ခရးသြားလာေရးလပငနးဆငရာ အျခား၀နေဆာငမလပငနး

21. The State, Region or Union Territory Tourism Authority, after examining the license application to determine whether it is in accordance with the requirements shall:

အေျပာငးအလမရပါ။

(က) ညညြတပါကသတမတထားေသာလငစငေၾကးကလကခရရလင ေလာကထားသအားလငစငထတေပးရမည။

issue a License if it is in accordance with the requirements, following receipt of the designated fee;

အေျပာငးအလ မရပါ။

(ခ) မညညြတပါကလငစငထတရနျငငးပယရမည။

refuse to issue the License, if it is not in accordance with the requirements.


၂၂။ လငစငသကတမးကနဆးသညအခါသကတမးတးျမငလသသည

22. Anyone who desires to renew a License on expiry shall:


(က) သတမတခကမားနငအညသကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔ေလာကထားရမည။

shall apply to the State, Region or Union Territory Tourism Authority in accordance with the requirements;


(ခ) သကဆငရာတငးေဒသၾကးသ႔မဟ

receive a Licence extension once the Authority has

23. A License shall be valid for three years.

The State, Region or Union Territory Government: • shall adopt Rules

concerning the length of licences, and fees to be paid. Where these are not in place, the Rules established at Union level will apply

may establish Rules for different types of Tourism Services licence.

It should be for local authorities to determine licence types, validity, and fees, administer them and retain income. They should have the flexibility for local variation, if necessary. ေဒသခ အာဏာပငမား အေနနင႕ လငစငအမးအစားမားက သတမတရန၊ လငစင အသးျပနငေရး သကတမးကာလ သတမတျခငး၊ လငစငေၾကး သတမတျခငး စသညတ႕က သတမတ၍ ဤလပငနးေဆာငတာမားက ကြပကၿပး ဝငေငြရရမႈက လပေဆာငရန။ ေဒသအလက အေျခအေနက မႈတညၿပး လအပခကအလက သတမတခကမားက ေျပာငးလ သတမတခြင႕ေပးရန။

24.All holders of current Licences at the date of adoption of this Law shall be permitted to continue to operate until the date of expiry of their Licence. Upon expiry of their Licence, should they wish to continue operations, they should apply to the relevant State, Region or Union Territory Tourism


Authority for a licence renewal in accordance with the requirements.

၂၅။ ခရးသြားလာေရးလပငနးလငစငတစရပရပရရထားသသညဧညလမးညႊနလပငနးလငစငမအပ အျခားခရးသြားလပငနးလငစငတစရပရပက အျခားသတစဥးတစေယာကထလေျပာငးလပါကသကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔သတမတခကနငအညေလာကထားရမည။

25. With the exception of a Tourist Guide Licence, should any holder of a Licence for Tourism activities desire to transfer their Licence to someone else, they shall apply to the relevant State, Region or Union Territory Tourism Authority in accordance with the requirements.


၂၆။ ပဒမ၂၅အရလငစငလႊေျပာငးရနေလာကထားခကကလကခရရ သညသကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သည လငစငလႊေျပာငးလကခနငေရးအတြကသတမတခကမားနငညညြတျခငးရ၊ မရစစစျပး လႊေျပာငးလကခနငမညပဂၢလသ႔မဟတ အဖြ႕အစညးထလႊေျပာငးခြငျပျခငးသ႔မဟတ လႊေျပာငးခြငျပရနျငငးပယျခငးျပလပနငသည။

26.On receipt of the application to transfer the Licence under Section 25, the State, Region or Union Territory Tourism Authority shall examine it to determine whether it is in accordance with the requirements, and shall either approve or refuse the transfer of the Licence to the individual or organisation concerned.

27. Where a Licence is temporarily suspended, withdrawn or cancelled, it shall be returned to the relevant State, Region or Union Territory Tourism Authority.


Chapter (10) Development of Human Resources in the Tourism Sector

ခရးသြားလပငနးဆငရာ လ႕စြမးအား အရငးအျမစ ဖြ႕ၿဖးတးတကေရး

၁၃။ ခရးသြားလာေရးလပငနးေဆာငရြကေနသမားသည ခရးသြားလာေရးလပငနးမားဖြ႔ျဖးတးတကေစေရးအတြက

13. Those involved in the Tourism sector shall undertake the following to develop the sector:

Human resource development by the private sector should not be regulated, beyond those aspects already covered in the 2013 Employment and Skills Development Law. (က) ခရးသြားလာေရးလပငနးဆငရာ လသားအရငးအျမစဖြ႔ျဖးတးတကေရးလပငနးမားကပါ၀ငေဆာငရြကရမည။

a) Take part in activities to improve human resources in tourism sector;


(ခ) နငငတကာစညႊနးမားနငအည၀နေဆာငမအရညအေသြး၊ အရညအခငးျပညမေစရနအေကာငအထညေဖာေဆာငရြကရမည။

b) Implement activities to raise service quality and professionalism to international standards;

14. The Ministry shall promote the sustainable development of the tourism sector by:


(က) ဗဟေကာမတမသေဘာတသညစမကနးမားက ျပညေထာငစအစးရအဖြ႔သ႔ တငျပျပးနငငေတာဘတဂတတြင ေတာငးခသးစြရမည။

a) Submitting projects approved by the Central Committee to the Union Government to request for resources from the state budget;


(ခ) ျပညပနငငမားနငနငငတကာအဖြ႔အစညးမားထမ ေငြေၾကးနညးပညာန

b)Obtaining financial and technical support from foreign

15. Businesses in the Tourism sector have the right to:

Businesses in the Tourism sector have the right to carry out their activity freely, in conformity with the provisions of this Law and its implementing regulations and other existing laws.

16. Businesses in the Tourism sector have the responsibility to:

28. If a License holder violates any License terms, or violates any of the prohibitions mentioned in Section 34, the relevant State, Region or Union Territory Tourism Authority can impose one or more of

၂၉။သကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႕ကခမတသည စမခန႔ခြေရးဆငရာအမန႔ကမေကနပသသည ယငးအမန႔ကလကခရရသညေန႔မရကေပါငး၃၀အတြငး ခရးသြားလာေရးလပငနးအာဏာပငအဖ႕သ႔ အယခ၀ငေရာကနငသည။

29. Any person who is disagrees with the administrative sanction taken by the relevant State, Region or Union Territory Tourism Authority may appeal to the Tourism Authority within 30 days of the date of receipt of that sanction.


၃၀။ခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သညပဒမ၂၉အရ အယခ၀ငေရာကျခငးနငစပလဥး၍သကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႕ကခမတသညအမန႔ကျပငဆငျခငး၊ ပယဖကျခငး သ႔မဟတ အတညျပျခငးျပလပနငသည။

30.The relevant State, Region or Union Territory Tourism Authority may amend, cancel or confirm the sanction.


၃၁။ ပဒမ၃၀အရခမတေသာခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔၏ဆးျဖတခကသည အျပးအျပတျဖစေစရမည။

31.The decision taken by the Tourism Authority under Section 30 shall be considered final.

လငစငကငေဆာငသသည ပဒမ ၃၀ အရ ဆးျဖတခကက သကဆငရာ ျပညနယ သ႕ တငးေဒသႀကအစးရ က အယခဝင လပါက ဝငနငသည။

The Licence holder may appeal a decision taken by the Tourism Authority under Section 30 to the relevant State or Region Government.

There should be some form of recourse for the licence holder လငစငကငေဆာငသအတြက အရငးအျမစ ( အကအည) တစခရေနသင႕သည။

အခနး (၁၆) တားျမစခကမား Restrictions ၃၂။ မညသမ (က) လငစငမရဘဧညလမးညႊနလပငနးမျပလပရ (ခ) ဧညလမးညႊနလပငနးကလႊေျပာငးျခငးနငလကချခငးမျပရ (ဂ) လငစငမရဘခရးလညလညေရးလပငနး၊ ဟတညလပငနး၊ တညးခရပသာလပငနး၊ ခရးသညပ႔ေဆာငေရးလပငနးနင ခရးသြားလာေရးလပငနးဆငရာအျခား၀နေဆာငမလပငနးမားမျပလပရ

32. No one shall: a) Provide Tourist Guide

services without a Licence

b) Transfer or accept Tourist Guide services

c) Operate Tour Operator Business, Hotel Business, Guesthouse Business, Tourist Transportation Business, Tourist Guide Business or Other Tourism Services without a License.

မညသမဆ (က) လထအေျချပခရးသြား လပငနးအတြကအပါအဝင မမေဒသတြင လမးညြနမႈမားမ လြ၍ လငစငမရဘဧညလမးညႊနလပငနးမျပလပရ။ (ခ)ဧညလမးညႊနလပငနးကလႊေျပာငးျခငးနငလကချခငးမျပရ (ဂ)လငစငမရဘခရးလညလညေရး

လပငနး၊ ဟတညလပငနး၊ တညးခရပသာလပငနး၊ ခရးသညပ႔ေဆာငေရးလပငနးနင ခရးသြားလာေရးလပငနးဆငရာအျခား၀နေဆာငမလပငနးမားမျပလပရ လငစငမရပ ခရးသြား ဝနေဆာငမႈမား မျပလပရ (ဃ)ဤဥပေဒအရ ခြင႕ျပခကရယျခငး မရပ ခရးသြားလပငနးကလပေဆာငျခငးမျပေစရ။

No one shall: Provide Tourist Guide services without a Licence, except where this guiding service is provided only in their local community, including for the purpsoes of Community Based Toursim • Transfer or accept Tourist

Guide services • Operate Tour Operator

Business, Hotel Business, Guesthouse Business, Tourist Transportation Business, Tourist Guide Business or Other Tourism Services without a License.

To allow for local community guides in CBT who should not be required to register as National or Regional Tour Guides လထအေျချပခရးသြားလပငနးက လပေဆာငမည႕ ေဒသခ လမးညြနမားက နငငေတာ အဆင႕ သ႕မဟတ ျပညနယတငးေဒသ အဆင႕ လမညြနအျဖစ မတပတငရန မလပ လပေဆာငခြင႕ျပရန The concept of ‘transferring or accepting Tourist guide Services is unclear and would appear to be covered in (a) Combine with 33 ခရးသြားလမးညြနး ဝနေဆာငမႈ က ေျပာငးေရြ႕ျခငး၊ လကချခငးသည ရငးလငးမႈမရေသာ အသးအနနးျဖဟျပး ၄ငးအေၾကာငးအရာသည အပဒ (၃၃) တြင ေပါငးစညးျပဌာနးနငသည။

• Tourism Services without a permission obtained according to this law.

၃၃။မညသမဤဥပေဒအရခြငျပခကမရဘ (က) ဟတညလပငနးလငစငကလႊေျပာငးျခငး၊ လကချခငးမျပရ။ (ခ) တညးခရပသာ လပငနးလငစငကလႊေျပာငးျခငး၊ လကချခငးမျပရ။ (ဂ) ခရးလညလညေရးလပငနးလငစင၊ ခရးသညပ႔ေဆာငေရးလပငနးလငစငနင ခရးသြားလာေရးလပငနးဆငရာအျခား၀နေဆာငမလပငနးလငစငမားက လႊေျပာငးျခငး၊ လကချခငးမျပရ။

33. No one, without a permission obtained according to this Law shall: a) Transfer or accept a

Hotel Business License; b) Transfer or accept a

Guesthouse Business License;

c) Transfer or accept a Tour Operator License, Tourist Transportation License or Other Tourism Service License.

ပယဖကရန To Remove Amended to reflect that there is only being one form of Tourism Services Licence mentioned in this Law. ဤခရးသြားဥပေဒတြင ခရးသြားလပငနးဝနေဆာငမႈလငးစင ႏင႕ ပတသတ၍ လငစငတစမးထ ရသညက ထငဟတေအာင ျပငဆငထားျခငးျဖစပါသည။

အခနး(၁၇) ျပစဒဏမား

၃၅။ ပဒမ ၃၂၊ ပဒမခြ (က) ပါတားျမစခကက ေဖာကဖကကးလြနေၾကာငးျပစမထငရား စရငျခငးခရလငထသက တစနစထကမပေသာေထာငဒဏျဖစေစ၊ ကပသနးနစဆယထကမပေသာေငြဒဏျဖစေစ၊ ဒဏနစရပလးျဖစေစခမတရမည။

35. Whosoever commits an offence under section 32 (a) shall, if convicted, be liable to imprisonment for a term not exceeding one year or a fine of twenty lakhs kyats, or both.

ပဒမ ၃၂၊ ပဒမခြ (က) ပါတားျမစခကက ေဖာကဖကကးလြနေၾကာငးျပစမထငရား စရငျခငးခရလငထသက ကပဆယသနးေသာ ဒဏေငြက ေပးေဆာငေစရမည။

Whosoever commits an offence under section 32 (a) shall, if convicted, be liable to imprisonment for a term not exceeding one year or a fine of ten lakhs kyats, or both.

This is an excessive penalty for provision of unlicensed tour guide services. တရားဝငလငစငမရေသာ ခရးသြားလမးညြနလပငနးမားအတြက ျပစဒဏဟာ မားျပားလြနးပါသည။

၃၆။ ပဒမ ၃၂၊ ပဒမခြ (ခ) ပါတားျမစခကက ေဖာကဖကကးလြနေၾကာငးျပစမထငရား စရငျခငးခရလငထသက တစနစထကမပေသာေထာငဒဏျဖစေစ၊ ကပဆယသနး

36. Whosoever commits an offence under session 32 (b) shall, if convicted, be liable to imprisonment for a term not exceeding one year or a fine of ten lakhs kyats, or both.

39. Whosoever commits an offence under session 33 (b) shall, if convicted, be liable to imprisonment for a term not exceeding one year or a fine of fifty lakhs kyats, or both.

40. Whosoever commits an offence under session 33 (c) shall, if convicted, be liable to imprisonment for a term not exceeding one year or a fine of thirty lakhs kyats, or both.

အခနး(၁၈) အေထြေထြ

၄၁။ ဗဟေကာမတ၊ ခရးသြားလာေရးလပငနးအာဏာပငအဖ႔၊ သကဆငရာတငးေဒသၾကးသ႔မဟတျပညနယခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔တ႔တြင အဖြ႔၀ငျဖစေသာနငင၀နထမးမဟတသမားက ဤ ဥပေဒပါလပငနးတာ၀နမားေဆာငရြကေနစဥအတြငး ရာဇသတၾကးပဒမ၂၁အရ ျပညသ႔၀နထမးျဖစသညဟမတယရမည။ ယငးအဖြ႔၀ငတ႔၏လစာ၊ စရတနင ခးျမငေငြကျပညေထာငစအစးရအဖြ႔က သတမတသညအတငးခစားခြငရသည။

41. Members of the Central Committee, Tourism Authority, Region, State or Union Territory Tourism Authorities who are not Servants, shall be regarded as Civil Servants for the purposes of the Criminal Code Section 21 while undertaking responsibilities related to this Law. These members shall have the right to enjoy gratuities and allowances as allowed by the Union Government.


၄၂။ ပဒမ ၃၅၊ ၃၆၊ ၃၈၊ ၃၉ နင ၄၀တ႔ပါ ျပစမမားကရအေရးယပငခြငရေသာ ျပစမမားအျဖစသတမတသည။

42. Offences mentioned in Section 36, 38, 39, and 40 shall be deemed as cognizable offences.

၄၃။ ဤဥပေဒပါျပ႒ာနးခကမားကအေကာငအထညေဖာေဆာငရြကရာတြင (က) ၀နၾကး႒ာနသညနညးဥပေဒမား၊ စညးမဥးနင စညးကမးမားကျပညေထာငစအစးရအဖြ႔၏

43. In implementing this Law, a) the Ministry may, with

the consent of the Union Government, issue necessary byelaws, rules and regulations


သေဘာတညခကျဖငထတျပနနငသည။ (ခ) ၀နၾကး႒ာနနငခရးသြားလာေရးလပငနးဆငရာအာဏာပငအဖြ႔သညအမန႔ေၾကာျငာစာ၊ အမန႔၊ ညႊနၾကားခကနင လပထးလပနညးမားကဗဟေကာမတ၏ သေဘာတညခကျဖငထတျပနနငသည။ (ဂ) ဥးစး႒ာန၊ တငးေဒသၾကး သ႔မဟတျပညနယခရးသြားလာေရးလပငနး အာဏာပငအဖြ႔ သ႔မဟတ ျပညေထာငစနယေျမခရးသြားလာေရးလပငနးအာဏာပငအဖြ႔တ႔သည အမန႔ႏငညႊနၾကားခကမားက ၀နၾကး႒ာန၏သေဘာတညခကျဖငထတျပနနငသည။

b) the Ministry and the Tourism Authority may with the consent of the Central Committee issue notifications, orders, directives and procedures

c) the Department and the State, Region or Union Territory Tourism Authorities may, with the consent of the Ministry, issue orders and directives

၄၄။ ျမနမာနငငဟတယနငခရးသြားလာေရးဥပေဒ (နငငေတာျငမ၀ပပျပားမတညေဆာကေရးအဖြ႔ ဥပေဒအမတ ၁၄/၉၃) ကဤဥပေဒျဖငရပသမးလကသည။

44. The Hotel and Tourism Law (State Law and Order Restoration Council Law No. 14/93) is hereby repealed by this Law.
