ARTICLE 1. GUARANTEED MAXIMUM PRICE (GMP) 1.1 Guaranteed Maximum Price (GMP): Construction Manager guarantees that it shall not
exceed a Guaranteed Maximum Price (GMP) of Twenty-Two Million, Nine Hundred Sixty-Three
Thousand, Two Hundred Forty-Three Dollars ($22,963,243.00) for the identified Project. 1.2 Basis of the GMP:
1.2.1 Construction Documents: The Scope of Work for the GMP shall be as defined in the Contract
Construction Documents, prepared by Architects RZK, Inc. entitled Brevard Public Schools New Viera
Elementary School and dated February 28, 2019 and revised April 17, 22, 24, 25, 26 and 29, 2019.
1.2.2 List of Construction Documents identified in Article 7 of this Guaranteed Maximum Price
Amendment.
1.2.3 Exceptions, Clarifications and Exclusions: The Scope of Work defined in the Construction
Contract Documents shall be modified and/or clarified as identified in Article 8 of this Guaranteed
Maximum Price Amendment.
1.2.4 Credit for Fill: The Construction Manager agrees to execute a deductive change order in an
amount equivalent to Four Dollars and Fifty Cents ($4.50) per cubic yard of fill provided by The Viera
Company and paid directly by the Owner for use on the Project.
ARTICLE 2. PROJECT TIME 2.1 Substantial Completion Date: Substantial Completion of the Work shall be achieved by June
12, 2020.
2.2 Final Completion Date: Final completion of the Work shall be achieved by September 8,
2020.
2.3 Project Schedule: Attached to this Amendment will be a schedule identifying the above
noted completion times and intermediate milestone dates estimated for the Project. The
proposed schedule shall be integrated into the Construction Manager’s Schedule upon
approval of this Guaranteed Maximum Price Amendment.
ARTICLE 3. CONSTRUCTION MANAGER FEE 3.1 Construction Manager Fee: The Construction Manager Fee for the Project shall be a Lump
Sum of Nine Hundred Twenty-Three Thousand, Nine Hundred Twenty-One Dollars
($923,921.00).
ARTICLE 4. REIMBURSABLE GENERAL CONDITIONS COSTS 4.1 General Conditions: General Conditions costs for the Project shall not exceed One Million,
Three Hundred Thirty-Seven Thousand, Three Hundred Seventy-Six Dollars ($1,337,376.00).
General Conditions costs shall be reimbursed at Construction Manager’s actual cost.
General Conditions costs shall be in compliance with the General Conditions to the
Agreement for Construction Management Services (Exhibit A) and are identified in the
attached document prepared by the Construction Manager.

ARTICLE 5. LIQUIDATED DAMAGES 5.1 Substantial Completion: Construction Manager shall pay Owner One Thousand Dollars
($1,000.00) as liquidated damages for each day that Substantial Completion extends
beyond the Substantial Completion Date.
5.2 Final Completion: Construction Manager shall pay Owner Five Hundred Dollars ($500.00)
as liquidated damages for each day that Final Completion extends beyond the Final
Completion Date.

SECTION 01
GMP Summary
The Viera Area Elementary School ‘V’ Project to be located on a new campus at 8300 Stadium Parkway in Viera, Florida 32940. The Guaranteed Maximum Price (GMP) encompasses the following scope of services; The project includes site development, utilities and improvements including but not limited to site fill, paved drives, parking area, sidewalks, covered walkway canopies, ramps, curbs, exterior signage, electrical service and utilities to the structure. The new main structure is a single story building of reinforced precast concrete tilt wall system on concrete footings, with a slab on grade. The main frame and roof structure are products of a pre-engineered metal building (PEMB) manufacturer. The exterior material include a standing seam metal roof and the exterior face of the concrete tilt wall system shall have a texture coating. The interior finishes include a suspended acoustical tile ceiling, painted and textured gypsum wallboard on furring or metal stud framing. Floors are specified to be covered with VCT, carpet, porcelain tile or epoxy paint. Interior doors are solid core with some specialty doors. The HVAC system includes water cooled chillers, cooling towers, pumps, AHU’s and VAV’s with ducted supply and return air. The Plumbing System includes toilet fixtures, work sinks and condensate as well as the various piping systems for sanitary sewer and domestic water distribution. The Electrical System includes power for convenience and theatre systems, lighting for ordinary Illumination and theatre production and wiring for various theatre communication systems. The exterior will have a hardscape and landscaping.

3.2 Qualifications and Assumptions
The following is a summary of Qualifications and Assumptions:
1. The cost of staff identified in the General Conditions not stationed on site, but working exclusively on the project, shall be reimbursed by the SBBC as shown in the attached General Conditions exhibit.
2. The cost of suitable import fill dirt material available on the adjacent property and calculated into this GMP proposal is $4.50 per cubic yard.
3. If any additional fill dirt materials are required and not immediately available at the cost of $4.50 per cubic yard, then additional costs per cubic yard will be required and paid by the Owner.
4. The GMP Proposal includes $46,730 for independent material testing and inspections.
5. The GMP Proposal includes $26,250 for Engineer’s threshold inspections & testing.
6. The GMP Proposal only includes provisions for independent material testing and threshold Inspections. Any other testing or inspections are not included within the GMP Budget.

3.3 Exclusions
The following is a listing of Exclusions;
1. The GMP excludes any FF&E, including but not limited to, Furniture, Kiln, Technology, Flat Panel Teaching Displays, Televisions, Phones, Computers, and DVD/VCR Players.
2. The GMP excludes any emergency generator, automatic transfer switches and fuel tanks.
3. The GMP excludes any and all liquid propane tanks and Stage 1 gas regulators.
4. The GMP excludes any temporary utilities or infrastructure if TVC has not completed their work on time and provide availability when required to service project requirements.
5. The GMP excludes removal of unsuitable soils or other unknown hazardous conditions.
6. Removal of “casual water” (normal rainwater) is included in the GMP, however, mass site dewatering, well pointing, mud pumping and subterranean drilling of any type is not included.
7. The GMP excludes 3rd Party Commissioning of any type (note: the GMP does include Threshold Inspections).
8. The GMP excludes any provisions for wall covering or wall paper.
9. The GMP excludes any provisions for an irrigation system.
10. The GMP excludes the cost of Permitting, Permit Expediting and Impact fees.
11. The GMP excludes the cost of any start-up chemicals.
12. The GMP excludes the cost of any start-up electric consumption charges.

3.4 Value Engineering Recommendations
Final Design Documents include value management ideas discussed by the project team and School Board of Brevard County during the design development process. These value management items have been incorporated into the Guaranteed Maximum Price Proposal through the inclusion of the current contract documents as listed in the Exhibit C-1 Section 02 List of Contract Documents and Section 3.1 Specifications Listing.

3.6 Add Alternates Schedule
The following is a summary of Add Alternates which have been incorporated into the GMP Estimate:
1. Provide add alternate for the Covered Play canopy and the restrooms, office, storage and electrical rooms. 2. Provide add alternate for black vinyl coated fencing in lieu of the aluminized coated fencing. 3. Provide deduct for VCT with vinyl base in all locations that are indicated to be porcelain tile floor with porcelain tile base. 4. Provide add alternate for acoustical wall treatments (AWT) within Multi-Purpose / Dining – 200 and Hall – 205. 5. Provide add alternate for the water cooled chillers to have low delivery water temperature option. 6. Provide a ground rod based lightning protection system for the entire facility. See Section 3.5 Allowance Schedule, Item 9. 7. Provide electronic controlled LED school marquis sign with message board. See Section 3.5 Allowance Schedule, Item 3. 8. Provide add for conduits for future connections associated with covered play building.

Master Project Schedule
Master Project Schedule Narrative: Site Work & Underground Utilities: The project schedule reflects commencement of construction activities on July 8th, 2019 for the new elementary school. Mobilization will begin on 7/8/2019 with immediate erection of temporary fence and SWPPP silt fence. Clearing and grubbing will begin shortly after and the project site will be graded for the building pad. Once the site is graded and the building pad in place the underground utilities will begin. Slab on Grade & Form Panels: The slab will be poured in two stages. The first pour will be around the perimeter of the building so that the panels can be formed on the slab and the MEP trades can continue to work where the slab is not poured. Once the plumbing is finished the interior slab will be poured. Erect Tilt Panels & PEMB: The end of October the precast panels will be tilted into place. Once the panels are in place and finalized the pre-engineered metal building will be erected. The PEMB erection will last about two months including roof placement and dry-in. Interior Finishes: Beginning in early January 2020 once the building is dried in the interior metal framing and drywall will be installed. MEP rough in, interior finishes, and MEP trim out will follow through until May of 2020. Parking Lots and Landscape: The roads, parking lots, sidewalks, and landscaping will be constructed in early March and April of 2020. Final Inspections: Subcontractor inspections will take place in the end of May. Punchlist and Test & Balance activities will continue until June with Building Final Inspections the first week of June and a Substantial Completion date of June 12th of 2020.
