Last week, fires engulfed 100 Jika Joe shacks. A number of people are currently accommodated in tents. Municipal mayor Mxolisi Nkosi said the disaster management plan will be taken to the full council for noting. “This is one of our unfunded mandates because disaster management is a district issue. This is the document which will assist us in dealing with disasters,” said Nkosi at the Executive Committee (Exco) meeting. In terms of the Disaster Management Act, 57 of 2002, each organ of state must have a disas- ter management plan and this needs to be reviewed regularly. Planning for disastrous events will enable the municipality organisational preparedness and readiness in approaching emergency and disaster cases. The effectiveness of this plan relies upon the integration by all internal and external depart- ments and the active participation at all levels on the disaster management advisory commit- tee. There are social, physical, economic environmental and political/ institutional vulnerability factors which contribute to the increase in disaster risks, including fire shacks, veld fires, floods, severe weather conditions, strong winds, transportation incidents, build- ing collapses and xenophobia attacks, to mention but a few. Excomember,andDemocraticAlliance(DA) caucus leader, Bill Lambert said that disaster management is something which Msunduzi should always consider. “This is something we should always have at the forefront of our minds. We are coming up to December and somehow in this city, December seems to herald floods on a regular basis. We need to take comfort that there is a proper plan and that we are covered,” he said. Deputy municipal manager for community services, Boniwe Zulu, said “Because we have the services that we are running, like the disaster unit, we need to have a disaster management plan. According to legislature, we need to have this plan in place.” Commenting on the Jika Joe fires, Zulu said “It was windy and it is always difficult to get closer to extinguish the flames at an informal settlement. They did manage to contain it. We have provided the victims with food parcels, sponges and tents. At Jika Joe, we were in the process of moving them into transit houses while the formal housing project is still being worked on. “At the moment, the residents are housed in tents as a temporary measure. They will be taken to the transit houses on condition that they have submitted their application to be part of the transit houses.” The deputy municipal manager for econom- ic development, Dr Ray Ngcobo, said that the area which was affected by the recent fire is the same area which was burnt down before. “People who are staying there, fortunately, are on the beneficiary list for transit houses. The problem is that the structures are not complete and so people are staying in tents. We have just agreed now with human settlement to devise a strategy on how we accommodate these people,” said Ngcobo. Msunduzi mayor Chris Ndlela said that he is happy with the speed in which municipal workers managed to extinguish the fires under windy weather conditions. THE Msunduzi Municipalitywill start to repair potholesusing local communities.

This pilot projectwill be restrict-ed to Imbali stage one and two.

“We will start this in Imbali atstagesoneandtwoasapilotproject.If it works out, we can include it aspart of the service delivery imple-

mentation plan,” said municipalmanager Mxolisi Nkosi at theExecutive Committee (Exco)meeting.

There has been a dire need foradditional effort in dealing with

roads and storm-water mainte-nance issues since the municipalinfrastructure has aged to almosta state of disrepair.

Thismeansthatpotholeseasilydevelop after just a few drops ofrainwhich shouldnot be the case,reads the report from theinfrastructure business unit.

For this pilot project to work,teams from the communities willhave to be trained first on potholerepairs using cold mix asphalt.

The trucks to be arranged bythe municipality will supplymaterials close to work sitesto avoid the long haul ofmaterialsusing wheel barrows.

The municipality will alsosupply safety gear, tools andmaterials.

Theteamswillbepaidbasedonthe number of potholes repairedor according to the square metreof repaired road surface.

MSUNDUZI Municipal manager Mxolisi Nkosisaid that there were communication setbacksthat caused the KZN Department of PublicWorks not to pay Sakhumnotho DevelopmentServices volunteer stipends for three months.

“The first phase of the contract they signedwiththedepartmenthadended,but thereweredelays from Sakhumnotho in submitting itsnew proposal. Everything had to come to astand still for three months while the depart-ment looked at the proposal,” said Nkosi,addressing the Executive Committee (Exco) onMonday.

MEMBERS of the Mountain Rise policestation are requesting assistance from thepublic to help curb the recent increase oftheft out of cars, specifically in theGlenwood area. Members allege that thereis a specific modus operandi - a silver orgrey Toyota sedan has been noticedbetween 10pm and 4am moving in theGlenwood area, allegedly identifying andtargeting specific vehicles. A group of fourAfrican males are then dropped off andwalk, stealing out of cars, and then alleg-edly hide the stolen goods in the long grasson Bishopstowe Road. A second vehicle, awhite Isuzu bakkie, allegedly picks up thestolen goods and leaves the area. Anyonewith information is urged to contact thepolice on 10111, or sector manager, CaptainVan Der Westhuizen at 033 387 9535.

Crime in Glenwood

Last week ,Maritzburg Feverran a story on twoformer Sakhum-notho volunteerswho had said thatthey were allegedlyfired from theorganization.

Sakhumnothomanagementdenied the allega-tions.

A tripartiteagreement wassigned between theKZN Department ofPublic Works, theMsunduzi Munici-pality and Sakhum-nothoDevelopmentServices to initiateaclean-up campaignwhich started on30May, 2014.

For the 2014/2015 financial year,the department hassecured R225 000towards the clean-up campaign in theCBD. This moneywill be used to paystipends for the vol-unteers. The clean-up campaign willfocuson thedemar-cated quadrantwhich is from theVictoria Road toChurch Street andPine Street toCommercial Road.

This project ranfrom 1 July, 2014andwillbeconclud-ed inDecember thisyear.

DESPITE numerousmedia reports statingthat Liberty Midlands

Mall applied to the KwaZulu-Natal Gambling Board toapprove the installationof Electronic BingoTerminal’s (EBT’s), the mallwill not be engaging in thisactivity.

Speaking to MaritzburgFever, mall manager UmiKhan has dismissed allreportsaboutthepossibilityofEBT’s.

“Over the last few days,there have been variousreports in the mediaregarding Liberty MidlandsMall granting permissionto install electronic bingoterminals on the premises.This is incorrectandinnowayhas Liberty Midlands Mall’scentremanagementagreed tothis.”

It was reported in somemedia that KZNFinanceMECBelinda Scott and the KZNGaming and Betting Boardhad received applicationsfrom 12 malls, includingLiberty Midlands Mall.

Khansaid that thedecisionto decline the request tosecure premises for anentertainment hub, thatincluded a restaurant, barfacility, lounge and bingoplaying areas, was based on avariety of factors.

“The fact that currently,Liberty Midlands Mall doesnot have any suitablepremises available was oneof the reasons; but moreimportantly, our currentleasing strategy for the centreand the fact that the centre -the largest in its catchmentarea - has become so muchmore to our customers thanjust a shopping destination.

“It is used by families andthe wider community and we

do not believe the offering issuitable for our customers,”said Khan.

After reports about thepossibilityoftheinstallationofEBT’s, a group on Facebookcalled ‘Stop EBT’ is urgingpeople to support it.

Membershavealso starteda petition urging the publicto sign it to stop malls frominstalling this system.

“From the coverage thatwe have seen in the media,the response from thepublic regarding the factthat certain malls haveapplied for permission toinstall electronic bingoterminals has been rathernegative.

“However, whilst thisis something that we arenot considering, we areunable to speculate on theresponses that other centresmay have received or theirview on the matter,” saidKhan.

Final call for Young Lady with Heart

IN light of the MsunduziMunicipality’s audited outcomesfrom the Auditor General (AG)

earlier this year, the municipalityestablisheda transformationcommitteeto tackle all the recommendations fromthe AG.

With over 60% of the Pietermaritz-burg population struggling to pay forbasic services, in January the auditorgeneral’s report revealed thatthe municipality had not achievedits objectives of basic service deliveryand infrastructure development.

The audited report showed that themunicipality’s underspent grants wereR170 million by 30 June 2013, andin total, the municipality underspentits capital budget to the amount of R33,557 million.

The financial period under reviewended on 30 June 2013, andwas for the2012/2013 financial year.

The AG’s report also statedmajor water and electricity losses.

Other issues included bad debtamounting to R801, 84 million onconsumer debts, the high percentage ofestimated meter reading, underexpenditure of grants and irregularexpenditure, to mention but a fewissues. Thiscomes in lightof the fact thatthe municipal manger, Mxolisi Nkosi,told theExecutiveCommittee (Exco) thatthe deadline for submittingfinancial reports to the Auditor General

(AG) was on 31 August for thereview of the 2013/ 2014 financialyear.

“Exco would remember thatthere were a number of meetingsthat were held between myself and theauditor general and the mayor.

“The last meeting we had withthe mayor and the AGwas on 5December lastyear. This was on theday they were going toannounce the auditoutcomes of all themunicipalities in theprovince.

“After we receivedthose outcomes on 5December, we theninvited theAGto the fullcouncil in January topresent the same auditoutcome,” said Nkosi.He said that in thepresentation by the AGinJanuary, therewas noreferenceof themayor being labelled a “lame duck” forapparently not following the AG’sinstructions.

“Normally, when the AG has givenan audit outcome, they give out whatis referred to as management outcomeswhich are the things thatmanagement needs to attend to.

“We have established a transforma-tioncommitteethat ischairedbythemu-nicipal manager. This committee dealswiththerecommendationsoftheAG,”hesaid. Nkosi said that they continue to

have challenges in spending grants.“We are addressing that by holding

weekly capital expenditure meetingsand setting up weekly targets,” he said.

Mayor Chris Ndlela said thathe will be meeting with chairpersonsof various portfolio committees andresponsible deputy municipal

managers to deal withthe expenditure of the2013/ 2014 financialyear.

In view of the waterand sanitation chal-lenges that are con-fronting the entirecountry, Nkosi saidthat the Department ofWater Affairs has di-rected that all munici-palities should developtheir water servicesdevelopment plans.

Nkosi said that aconsultant has been

appointed and the total cost ofdeveloping the water services plan willbe somewhere in the region of aboutR1,6 million. Following a call from theAG that themunicipality should achieve100%of all itsmeter readingswhich arefree from estimations, the municipalityhas slowlymade strides to improve this.

In June this year, Maritzburg Feverreported that at the time, there wereonly 12% estimated readings in waterand electricity and that meter readinghad improved from60% last year July to88% in May this year.

A successfulreunion

IT is almost that time of the year againwhenyoungwomencongregateattheroyalpalacein Nongoma in an age-old custom of

presenting reeds - and themselves - to KingGoodwill Zwelithini.

We are told that it was once a beautifultradition that entailed participation by femalevirgins who were proud of their wholesomeways. They deemed it an honour to acknowl-edge their chastity

. Today it may be safer to simply call theparticipants…participants.

Male virgins are not treated with quite thesame celebratory attitude, but that is a subjectfor another column.

Thetraditionwasrevived24yearsagobytheKZNmonarch, to instill pride in young virgins,to encourage them to retain their purity in aworld where traditional morals have beenwatereddown.ForZulus andSwazis, the occa-sion is also a chance for the king to select a newwife, or participant.

When the custom was reintroduced in theearly nineties, I remember that on average, themaidens looked a lot older than those of today.In today’s ceremonies, it is not frownedupon tosee10-year-oldgirlsparticipating inthefestivalin the name of culture.

This is where the culture divide gets a littlefuzzy.

Because of the kind of work I do, I often findmyself at corporate and government eventswheresemi-clothedschoolgirls formpartof thefestivities, ostensibly to provide an Africanauthenticity.

As the father of a 12-year-old girl, I almostalways find myself shuddering at thesefunctionswhen I see the reactions to theparad-ing of maidens - cameras are whipped out,Tabletsareplacedonrecordandphotosofsemi-clothed young girls are able to be sent aroundthe world at the click of a button.

Somewhere in the audience, there is alsobound to be one of those “creepy uncle”- types

trying desperately not to lick his lips.In slightly altered circumstances (that is,

without cultural “practice” providing ration-ale), men and women photographing semi-clothed children would be imprisoned.

This brings me to the parents who sign theobligatorydisclaimersallowingtheirdaughtersto undress, jump onto a stage and dance.

What are they thinking? Are they thinking?If a pole and strobe light were added to the

props,wouldparents still behappy for their15-year-olds to participate?

Thereeddanceisusuallyprecededbyvirgin-ity testing,meaning that if youwant todance forthe king, it has to be proven that you are fit todo so - which in this casemeans you need to bea virgin to gyrate in front of him.

Therehavebeenwelldocumentedcallsinthepast - and indeedsomegroupsmakecalls everyyear - to ban virginity testing.

Stalwarts within the Zulu nation tell us thatthis is a direct attack on Zulu culture.

I disagree.Being born in Richards Bay, I am a Zulu

poster-boy,butthepracticedoesnotsitwellwithme. To have a virginity tester don a glove anddigitally penetrate your lady-bits so she canconfirm your hymen is intact is ludicrous,particularly because doctors tell us that thehymen does not need sexual penetration torupture.

A virginity test will, in essence, conditionyoung women into believing that there willalwaysbeandshouldbesomeonewhohasmoresay over their bodies than they do. There is nodoubt that the reed dance is good for tourism,what with the spike in all of those unaccompa-nied male tourists making their way fromEurope at this time of year.

Thankfully, a ban on any kind of photogra-phy, unless it is from accredited and verifiedjournalists,will reduce thenumber of photos ofbarebreastedchildrenontheinternet,butthereare still the creepy uncle-types who go to thefestival.

Cultural preservation should be celebrated -but it must also take into account social changeand the fact that it canbeeasily exploitedby theunscrupulous.

Would it be culturally devastating for ouryoung women to cover their breasts to avoidfalling victim to some opportunistic pervert,whetherhecomes in the formofabusinessmanor royalty?

I don’t think so.

THE rights of unmarried fathersin respect of their childrenwere,untilJuly2007,regulated

by the Natural Fathers of Childrenborn out of Wedlock Act of 1997.

This entire Act has now beenrepealed by the Children’s Act 38 of2005.

In terms of the Children’s Act, anunmarried father can acquire paren-

possible for an unmarried father toacquire automatic rights in respect ofhis child.

Hewill alsobeable toacquire suchresponsibilities and rights through aparental responsibilities and rightsagreement with a person alreadyhaving such rights and responsibili-ties (usually themotherof thechild) interms of section 22 of the Children’sAct.

How can an unmarried fatheracquire automatic rights in terms ofSection 21 of the Childrens Act?

Inorder foranunmarried father toautomatically acquire parental rightsand responsibilities under section 21the following requirements must bemet:1.He must be or have been living in apermanent life partnership with the child’smother at the time the child is born; or2.If he is not living or has never lived withthe mother in a life partnership then inorder for him to acquire automatic parental

rights and responsibilities;(a) he must consent to being identified asthechild’sfatherorapplytobesoidentifiedor he must pay damages in terms ofcustomary law; and(b) he must contribute or must haveattempted to contribute to the child’supbringing for a reasonable period; and(c) he must contribute or must haveattempted to contribute to expenses inconnection with the maintenance of thechild for a reasonable period.

If there isnodispute that the fathercomplieswiththeconditionssetout insection 21, then he and the motherwill be co-holders of parental rightsand responsibilities.

In such a case, the fatherwould beable to exercise his parental rightsand responsibilities sufficiently if heand the mother draw up a parentingplan in termsof section33, settingouthow they would exercise theirrespective responsibilities and rightsin respect of the child.

What happens where there is adispute?

If the child’s mother disputesallegations that the requirementshave been satisfied by the father,then the matter must be referredto one of the following serviceproviders for mediation, namely, thefamily advocate, social worker,social service professional or othersuitably qualified person.

The courts cannot be approachedbefore such mediation has takenplace. If mediation fails or is notpossible, then one of the parties canapproach the High Court for anappropriate order.

The best interests of the childwouldrequireaproperassessmentofthe circumstances before arrange-ments are made.

For example, if the unmarriedfather has never previously hadcontactwiththechild, itwouldbenec-essary to phase in the contact.

THE Comrades MarathonAssociation (CMA) recentlylaunched its campaign for the

90th Comrades MarathonThe 2015 campaign is centred on

the CMA’s vision of an all-inclusiveComrades Marathon, with theslogan: ‘BePartof It -Bamba Iqhaza’.

“We invite every Comradesrunner, stakeholder, volunteer andsupporter to be a part of this iconicrace inonewayoranother.Therearenumerous ways to get involved andparticipate in the camaraderie whileuniting thenation through this iconicevent. The90theditionof the racewill berun on Sunday, 31 May 2015.

The ‘up-run’ will start at theDurban City Hall at 5.30am and end12 hours later at the Oval CricketStadium in Pietermaritzburg, cover-ing a distance of 87km.

Entrieshaveopenedandwill closeon 30 November 2014 or as soon asthe special entry cap of 23 000 hasbeen reached. Prospective entrants

are encouraged to get their entries inearly so as to avoid disappointment.The local entry fee is R380.

ambled over - he could not coach aspecific team, he had his own cricketon Saturdays - and said, “Cook, thinkyou’re [legendary cricketer and OldHiltonian] Mike Procter? Don’t eventry hitting sixes over extra cover.”

It was tradition for Adcock to bowland,despitehisage, itwas immediate-ly apparent - seeing that long run-up,beautiful gather and deliver - why topbatsmen the world over quiveredwhen they spotted the whites of hiseyes.TherewasverylittlecricketonTVthen, television only arrived in SAwhen I was 12, so kids had to get outthere and see their heroes in the flesh.Andthat’swhatmadeitsomemorable.
