    Zosimo de la Rama shows the scars he got from his hell-likeexperience with the sinking of the Doa Paz 25 years ago. Of

    the estimated 4,000 passengers of the said passenger vessel,

    the 46-year old man was just one of the 24 or so who survived

    in what is considered to be the worlds worst peacetime maritime

    BARUGO, Leyte- Theinferno-like experiencemay have happened exactly25 years ago today but itremains vivid to the mindof Zosimo de la Rama who

    was only 21 years of ageat that time of the tragedyconsidered to be the worldsworst peacetime maritimedisaster.

    Whenever I see thescars in my body, I could nothelp but recall that tragedy. Ithought it would be the endof my life but I hold on to myfaith; that God will help mesurvive from that inferno,de la Rama,46, said in aninterview at their house inBarangay Minuhang, afarming village 1.5 kmsaway from the town center.

    Indeed, he survivedthe harrowing ordeal. Hestayed at the aming waterfor eight hours before hewas rescued by a crew of a

    passing passenger ship, M/VClaudio which was en routeto Manila.

    He suffered a third-degree burn, particularly

    both his arms and at hisface when he jumped to thewater which was practicallyon re. The wounds wereso severe that he stayed formore than two months ina hospital in Manila, de laRama said.

    The tragedy was sopainful, he said, that resultedfor him to develop sometrauma. I could no longerwithstand seeing a re andgoing to the sea, de la Ramasaid.

    But I am thankful thatdespite of that harrowingexperience, I survived andnow live a normal life,de la Rama, a father offour children and work asa pedicab driver, said. Hereturned to his hometownsometimes on April, 1988

    after staying at houses of his

    relatives.de la Rama was one of

    the 24 or so passengers whosurvived when the passengership, the M/V Doa Paz,collided with an oil tankerM/T Victor, on the eveningof December 20, 1987 offthe coast of Tablas Strait inMindoro.

    He survived by jumpingo f f f rom the s ink ing

    passenger vesse l down tothe already flaming waterand swam, naked as he putoff his short and t-shirt tomake him lighter.

    After two hours or so,he said, everything turnedeerily silent with him aloneat the vast waters. A oatinglog helped him carry thenight until a passing vessel,rescued him, de la Ramasaid.

    The M/V Doa Paz was

    on its way to Manila from

    Tacloban City port when the

    collision occurred, killingmore than 4,000 passengerswho were all from various

    parts of Eastern Visayas.de la Rama said that

    he and his sister-in-law,Sally Alipio, boarded theill-fated passenger vesselon December 19 whichdeparted at the Tacloban portfor Manila at around 4 p.m.

    He said that he wasconvinced to leave hishometown by Sally to workin Divisoria, a market inManila known for wideassortment at low pricedgoods where the family ofthe latter owned a stall.

    When we entered thevessel, it was already fullwith so many people. Infact, I learned that some

    passengers chose not toboard Doa Paz as the shipwas already brimming with

    passenger s, de la Ramasaid.

    His sister-in-law was oneof those who perished withher body never recoveredor have known to have beenrecovered, de la Rama said.

    He said that his name and

    The list of passengerswas based on the numberof canvas cots available.The cots were already fully-occupied by passengers. Infact, two or three passengersshared for a single canvascot, he said, explaining whyhis name was not included inthe ofcial manifest.

    The M/V Doa Paz hadonly a capacity of more than1,500 passengers but variousaccounts claimed that at thetime of the incident, it couldhave been carrying between3,000 to 4,000 passengers.

    Meantime, the M/TVictor was an oil tankership which was loaded atthat time of the incident of8,800 gasoline and other

    petroleum products and onits way to Masbate fromBataan.

    While de la Rama has yetto fully come to terms withthe incident he experienced,some relatives of those

    who died appeared to haveaccepted the fate.Edwin Fua said that while

    it was at rst very difcultfor their family to acceptthe deaths of their motherand two of his brothers, theyhave no other recourse butto accept their cruel demise.

    We went to variousfuneral parlors in Manilafor three weeks without letup when we learned thatmany of the dead passengerswere brought there. We werehoping that we could ndtheir (dead) bodies but to

    our dismay, we never saw

    them, Fua of Tacloban Cityand 46 years old, said.

    Killed during that incidentwas his mother, Loreta and

    brothers Saturnino and JesusIV, who was already makinga name in Tacloban at thattime as a basketball player.

    During November 1 and2, they offered prayers andcandles for their mother andtwo siblings at the Tacloban

    public cemetery, Fua said.We, of course, struggled

    to come to terms that theyperis hed at that trage dy.

    MUNICIPAL ORDINANCE NO. 01(Series of 2012)

    AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 06, SERIES OF1997, ENTITLED, AN ORDINANCE REGULATING COCKPIT AND COCK-FIGHTS CONDUCTED WITHIN THE MUNICIPALITY OF GEN. MACAR-THUR, EASTERN SAMAR, AND PROVIDING PENALTIES THEREOF

    (Introduced by Hon. Josefa D. Baldo)

    BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF GEN. MACAR-THUR, PROVINCE OF EASTERN SAMAR, IN SESSION ASSEMBLED, THAT:

    SECTION 1. Section 1 of Municipal Ordinance No. 06, Series of 1997, ishereby amended to read as follows:

    SECTION 1. No person/group of persons/association/corporation/cooperative or any legal entity shall be issued a Mayors Permit/Business Li-cense to operate or maintain any cockpit establishment in this municipality with-out rst having been issued and granted the corresponding Municipal CockpitFranchise by the Sangguniang Bayan.

    SEC. 2. Section 5 of said ordinance is further amended to include the fol-lowing terms and denitions:

    Municipal Cockpit Franchise refers to a special privilege conferred bythe Sangguniang Bayan to an individual or group of persons with legal person-ality to operate a cockpit. A franchise is merely a temporary business invest-ment involving renting or leasing an opportunity, not the purchase of a businessfor the purpose of ownership. Hence, it may be subject to repeal, amendment,revocation or cancellation by the granting authority when public interest so re-quires.

    Zoning Law or Ordinance refers to the Zoning Ordinance adopted by theSangguniang Bayan as Ordinance No. 11, Series of 1996 (dated Nov. 28, 1996)as appearing and incorporated in the Municipal Comprehensive DevelopmentPlan of this Municipality.

    SEC. 3. Section 6, 7 and 8 of Municipal Ordinance No. 06, Series of 1997,are hereby consecutively renumbered as Sections 8, 9 and 10.

    SEC. 4. Section 6 of Municipal Ordinance No. 06, Series of 1997, isamended to now read as:

    SEC. 6. Conditions/Requirements for Grant of Municipal CockpitFranchise:

    1. Only Filipino citizens not otherwise disqualied by existing laws orordinances shall be allowed to own, manage and operate cockpits. Cooperativecapitalization is encouraged.

    2. In accordance with Sec. 5 (b) of P.D. No. 449 (Cockghting Lawof 1974), only one (1) cockpit shall be allowed to operate in the municipality,provided, however, that this specic section can be amended for purposes of

    establishing additional cockpits, if the municipal population so warrants (e.g.,one (1) cockpit per one hundred thousand (100,000) population).

    3. New applicants shall submit their letter-request to the MunicipalMayor, through the Sangguniang Bayan, for issuance of application to establish,

    operate and maintain a cockpit. Said application shall include the following docu-ments, such as but not limited to, among others:a) Registration certicates with concerned government agencies (e.g.,

    DTI, SEC, BIR, CDA);b) Location and vicinity plan of the proposed cockpit;c) Building plan as approved by the Municipal Engineer;d) Ofcial receipt/s for payment of taxes, fees and other levies pre-

    scribed by the Local Revenue Code (e.g., permit fees/licenses for cockpit per-sonnel), as well as receipts evidencing payments for national and other speciallaws, if applicable;

    e) Health Certicate.4. Cockpits shall be constructed and operated within appropriate areas

    as prescribed in local zoning law or ordinance. The Municipal Mayor shall see toit that no cockpits are constructed within two hundred (200) linear meters fromexisting residential or commercial areas, hospitals, churches, schools and otherpublic buildings. Owners, lessees, or operators of cockpits which are now in ex-isting and do not conform to this requirement are required to comply with theseprovisions within a reasonable period to be specied by the Municipal Mayor.

    Approval or issuance of building permits for the construction and/or repair/reha-bilitation of cockpits shall be made by the Municipal Engineer in accordance withthe National Building Code as well as existing laws, regulations and ordinances.

    5. Cockpits may also be established within and/or as an adjunct of re-sorts, sports and/or recreational project sites duly recognized by and registeredwith the Philippine Tourism Authority.

    6. Applications for renewal of cockpit license shall be submitted to theMunicipal Mayor not later than December 31 of each year, accompanied by thefollowing: ofcial receipts showing payment of taxes, fees and other charges.

    7. In case the cockpit was constructed more than ten (10) years beforethe date of renewal of license application, an additional certicate from the Mu-nicipal Engineer shall be required stating thereof that such cockpit is free frommaterial, structural or other physical hazards;

    8. Municipal cockpit franchise shall be valid for a period of fteen (15)years, renewable for such number of years subject to the discretion and reviewof the granting authority. Said franchise may be amended, repealed, cancelledand revoked anytime should public interest so require.

    9. A Municipal Cockpit Franchise Fee of Ten Thousand Pesos(P10,000.00) shall be collected and paid to the Municipal Treasurer prior to therelease of the corresponding SB resolution granting the same.

    10. A Municipal Cockpit Franchise is non-transferable. Hence, any saleand/or transfer of the same shall be construed as violation of this ordinance.

    11. It shall be the responsibili ty of the franchisee to provide proper park-ing area, clean restroom with sufcient water supply and maintain cleanlinesswithin the cockpit area and its premises.

    12. In accordance with Sec. 4 (f) of Presidential Decree No. 449 (Cock-ghting Law of 1974), as amended, no gambling of any kind shall be permittedon the premises of the cockpit of place of cockghting during cockghts.

    SEC. 5. The penalty provisions mentioned in Sec. 6 of Municipal OrdinanceNo. 06, Series of 1997, is further amended now to read as follows:

    SEC. 7. Penalty Provisions. The following shall be imposed for anyviolation of this Ordinance:

    a) First Offense a ne of P1,000.00;b) Second Offense a ne of P1,500.00;c) Third Offense a ne of P2,500.00 or imprisonment of not less than

    fteen (15) days but not more than three (3) months, or both ne and imprison-ment at the discretion of the court;

    d) In case of violations committed by cockpit owner/s, the penalty tobe imposed shall be one (1) to six (6) months suspension from operating the

    cockghting business, in addition to the aforementioned penalties;e) The ofcers of juridical persons/corporate entities such as the Presi-

    dent, General Manager and other managing persons shall be liable in their per-sonal capacity and shall be sanctioned in accordance with the provision impos-ing penalties to natural persons.

    SEC. 6. Repealing Clause. Local ordinances, resolutions, orders, rules andregulations that are inconsistent with this ordinance are hereby repealed, modi-ed or amended accordingly.

    SEC. 7. Separability Clause. If any provision of this ordinance is declaredunconstitutional or illegal, the remaining parts hereof shall not be affected andshall therefore remain in full force and effect.

    SEC. 8. Effectivity Clause. This ordinance shall take effect immediately onthe day following its publication if a newspaper of general circulation in the prov-ince, or at the end of posting this ordinance for three (3) consecutive weeks in atleast three (3) conspicuous place/s in the municipality, whichever occurs later.

    TACLOBAN CITY- Theleader of the soldiers who

    were reportedly involved inthe killing of a well-knwonbotanist Leonardo Co and histwo companions two years

    ago said that he is willing toproduce them as long as thereis an order for him to do so.

    Colonel Joel Nacnac,commanding officer of the19th Infantry Battalion basedin Kananga town in Leyte,

    said that they would abidewhatever will be the decisionof the Department of Justiceor the courts.

    As long as there is anorder coming from the DOJ orthe courts for me to produce

    the soldiers, I will abide thatorder. What we just want isthat a fair deliberations over

    the case, Nacnac, said in aphone interview said.It was learned from

    Nacn ac th at th e so ld ie rsaccused to be responsible in

    the killing of Co and his twocompanions, Julius Borromeoand Sofronio Cortez, are still

    active.He said that they knew

    already the findings andthe recommendation of the

    Commission on HumanRights seeking for criminal

    and administrative complaintsbe led against them.

    We will abide any orderissued by the court or the DOJ.We will not hide anything,the Army leader said.

    D e s p i t e o f t h erecommendation of the CHR,Nacnac said that they stil l

    hold on their earlier positionthat the three were killedduring a legitimate operationsby the soldiers agains t the

    members of the NPA.Co,together with his

    companions, were killed inthe mountains in Kananga

    town last November 15, 2010.The group of Co was

    conducting a bioderversity

    research in the area ascommissioned by the EnergyDevelopment Corp.(EDC)

    when the incident happened.The so ld iers , led byLt.Ronald Odchimar, claimedthat they were in the arearunning after members of the

    rebel group, the New PeoplesArmy.

    This ensued a firefight

    between the two groups.At that time of the incident,

    the 19th IB was headed byCol. Federico Tutaan who is

    now assigned in Mindanao.This claim of the military,

    however, was dismissed byvarious human rights group

    saying that there was noencounter and that the threewere killed by the soldiersas they were mistaken to be

    rebels.Ofcials of the Katungod-

    Sinirangan Bisayas, a human

    rights group based in the city,found the recommendationof the CHR rather slowconsidering that the incident

    happened more than twoyears.

    Irma Mepico-Balaba,regional coordinator of

    the Katungod-SiniranganBisayas, said that initialinvestigations by various

    groups have revealed thatthere was no encounter andthat the soldiers of the 19th

    IB were the ones who shotand killed Leonardo Co andhis two companions.

    We are not happy on thepart of the Katungod.That is

    not the kind of justice that weare expecting so long as thoseresponsible are still active

    in service and not in jail,Mepico-Balaba said.

    We are sad that it tookthem (CHR) two years to

    determined the fact that theyidentified elements of the

    19th IB have violated humanrights and international

    humanitarian law, she said.She said that the group

    hopes that the case of Co andhis two companions would

    be given justice and not onlyup to recommendation level.

    Filing of charges must

    follow soon right after ittook the CHR two long yearsof slow-paced progress.Ever since, the evidence had

    been so strong against themilitary that they pointedtheir guns to Prof. Costeam and strafed them down

    dead, Dean Lacandazo,regional secretary-general ofKatungod, said in a separate

    For Jazmine Bonifacio,who lost her mother Pureza,younger brother Antonio,an uncle, an aunt and fourcousins, she still nd it hardto accept the kind of deathsthat they have.

    Up to this time, I stillwant to see their remains andit would only be the time thatI would totally accept theirdeaths. In fact, I refused to

    a suggestion that we makegraves for them, she said.

    Twenty-ve years afterthe tragedy, she still missesher mother and younger

    been an emotional closureon her part had she saw the

    You wake up today with the

    same world you saw yesterday,

    right?

    Are you happy the end of the

    world predicted by philosophers

    and false prophets did not come

    true? The December 21 dooms-

    day is a plausible theory that cre-

    ates uncertainty for some.

    The Mayan of Central Amer-

    ica, according to Ned Potter of

    abcnews.go.com, made a new

    calendar that started on year 3114

    BC that to end after 5,126 years.

    It replaced the old cylinder calen-

    dar that lasted for 52 years only.

    Hence, the 5,126 that began

    on 3114 ends today.

    Some astronomers

    watching the sky calculated

    today is the date of the plan-

    etary alignment. They cal-

    culated derailment of one

    of the planets will hit earth,

    so, the end of the world.

    If you believe you are still

    alive enjoying the coolness

    of December then the as-

    tronomer must be laughing

    this moment.

    The Mayans lamented

    unscrupulous persons want-

    ing to be known in the ex-

    penses of other persons.

    pen today is used by mon-

    eymakers, businesspersons

    promoting products.

    mid the nancial difculties that people

    face, Christmas seems bleak and silent a

    celebration this year than in the past. Wehad been hit by various disasters, both natural

    and man-made with repercussions devastating

    to the lives of the greater number. Only the rich

    and powerful seem enjoying the season while

    the less privileged make do with whatever bless-

    ings they have at hand this Christmas. Many of

    our people had been hard-pressed making both

    ends meet that they miss to realize the coming

    of the yuletide season and eventually this great

    day, Christmas day.

    We had been used to the practice of the less

    signicant and less essential, mainly with merry

    celebration of sumptuous meals and overflowing

    drinks. That had been the binding factor that

    draws every family into the dining table as the

    clock ticks into the day past midnight on Christ-

    mas eve. Families no matter the socio-economic

    condition, would nd the means to put some-

    thing for the family to partake on the eve we

    mark as the birth of our Savior Jesus Christ.

    Others are into various practices that pose

    danger and risks to lives and properties. Ignit-

    ing recrackers and reworks somehow add

    to the merriness of the celebration although

    to the peace-loving and those wanting silence

    for the soul, nd recrackers irksome and an-

    noying. Many people are duped into spending

    so much for noise and hazardous celebration,

    sacricing what ought to be spent for basic

    needs and food for the family.

    Some people are into buying gifts for pre-

    sents to those people they love, forgetting

    if not purposely excluding those whom they

    consider unworthy for being not their friend

    anyway. The gift giver is in a good mood of

    LABOR PAINS

    As the pain subsided, Tonya glanced nervously at the lighted clockon the dresser. She wished she could have a cigarette. The hardest thingabout pregnancy so far was giving up smoking, but she wanted to do itfor the baby. Besides, it wouldnt be too much longer now. The ultra-sound showed it was a girl so she and Rick named her Nykesha. Shecould feel Nykesha now, moving inside her, maybe getting ready to beborn tonight. When Nykesha moved like that, Tonya would sing her anold African song her grandmother taught he r when she was small. So shesang softly and wondered of this was how Mary felt the night baby Jesuswas born. A baby stirring in a mothers womb always seems to give riseto thoughts of Christmas. She heard Rick fumble for his glasses. Whattime is it, honey? he asked, groggy. Tonya smiled and touched her hus-bands handsome face. Its time for us to get up.     With all these global and

    local concerns this Christ-

    mas, I, on a recent Decem-

    ber night, found myself au-

    diting what I have reected

    on and written for LSDE to

    consider as printworthy for

    the year. I am lucky to have

    churned in at least aroundfty or so with favorite fa-

    miliar themes to include:

    patriotism and governance,

    relationships, humor and

    adversity, family lives and

    selected global issues.

    The night being a rainy

    one, was not a good idea to

    start an argument. But I did

    say that I recalled that most

    of my columns were home

    consumption and none were

    combative nor offensive. Isthat right? Most having in-

    consequential arguments,

    but were of genuine con-

    cern and empathy towards

    the subject matter. Should

    I say I never wrote anything

    that buttressed prejudice

    nor enmity. Of course, as

    I am always, matters and

    ideas were always inspired

    by idealized imageries.

    Whatever else I did,

    the great spread of mobile

    phones and the internet

    does not help in getting us

    to know each other. Indeed,bigotry and half-baked,

    manipulated fact spreads

    only faster. As one Nigeri-

    an-American writer says,

    We are unreconstructed

    but our technology is re-

    newing itself. In my case,

    I just write and spin in an

    effort to reach out fans like

    Tutz in Afghanistan, Tmar

    in New York and Cynthia inNorth Carolina.

    The internet technology

    has created one global vil-

    lage, with each netizen de-

    veloped a strong, emotional

    narrative of victimhood and

    life without the other. In our

    heaving cities, where life

    is more rushed and stress-

    ful than ever, people retreat

    into their ats and increas-

    ingly segregated enclaves,

    divided by economic class.

    They may share public and

    work places but they usu-

    ally remain strangers. Inmy neighborhood, I hardly

    know anybody, and the op-

    posite is true. This segrega-

    tion extends across physical

    spaces and religions. The

    media ourish but they lo-

    calize their programming

    faster than ever, further

    isolating people across re-

    gions.

    As I write this, the head-

    lines discuss the conten-

    tious church opposition

    against divorce, the need

    for recracker zones come

    New Years Day, and of-

    cials under suspension for

    misdemeanors. All these

    however, will forever, be

    strangers from another.

    place is a gift also fromGod. We need to take careof it and cultivate it to itsfullness.

    Amid the darkness that

    is descending in the worldtoday, a darkness that ischaracterized by false andseductive lights, we needto approach the baby in themanger surrounded by hisadoring mother and fos-ter father, and by the purehearts of simple but privi-

    leged shepherds.He is the true light who

    can generate hope in usand in the world today that

    We have to go beyondsentimentalism and thefrills with which commer-cialism has shrouded thisevent, and discover the truespirit of Christmas, imbib-ing it as fully as possible.

    the darkness of the modernlights. It is the Son of God,this helpless infant in themanger, who can truly testand determine the authen-ticity or falsity of the manyideologies presented to ustoday.

    He is not afraid to live

    with us in any condition

    we might nd ourselves in.In fact, we are told that hehas assumed our humanityin its fullness, including inits wounded state now with-out committing any sin, toshow us the way of how tolive in the world of today.

    We need to get to knowhim more and more, andfollow his path as closelyas possible. He already toldus that if we want to followhim, we should be will-ing to deny ourselves andto carry the cross. With isgrace and our efforts, lets

    be prepared for this.But lets be familiar with

    his teaching and his ways.In him, truth and charity

    Any prediction regard-ing the end of the world

    be ignored, because as in

    the days of Noah until the

    because the Word of God

    will not return to Him un-

    really an end of the world

    to come in the immediate
