Know when to seek professional assistance.

* Ask friends, family and neighbors to recommend real estate professionals they have worked with. Do your due diligence and select a qualified professional who knows the market and is willing to listen to your wishes and concerns. You’ll be working closely with them in the coming months, so finding an agent you can relate to personally is key.

* Make a list of features and preferences that are non-negotiable, then move on to your wish list - the features you’d like but may be willing to compromise on if the right property comes on the market. Choosing the right home, especially in a buyer’s market, can seem overwhelming. Knowing your “must have” features will help narrow your options and save you time.

Is Your Home under-Protected?Just when you think you’re safe, a recent nationwide survey has uncovered that a majority of American homes are dangerously under-protected when it comes to fire and carbon monoxide (CO) poisoning.

Even those equipped with smoke and CO alarms are at risk according to the study, which revealed that two thirds of U.S. households are not in compliance with the national recommendation for the number of smoke alarms set by the National Fire Protection Association (NFPA). Even more alarming is the 90 percent of homes that do not meet the recommendation for number of carbon monoxide detectors, including 40 percent that report having zero working carbon monoxide detectors.

Should I Use a Realtor If I Am in Foreclosure? When a property owner is trying to avoid foreclosure, there are many options available. Some of them may work and others may just be a waste of time in a given situation. The person facing foreclosure needs to look at the circumstances and the availability of various options. One option that makes a lot of sense is to list the home with a realtor.

There are few things to realize when listing a home in foreclosure with a realtor. The amount of time available to list and market the house is crucial to making it work. If the house is in foreclosure and going to auction in a week, listing with a realtor may not be a hopeful option. But if the foreclosure process has just begun, listing with a realtor may be the way to go.

The first step to take is to call the lender and communicate your intentions. Contrary to popular belief, most lenders do not actually want to foreclose on a home. It is costly and time-consuming. Because of this, if the borrower is willing to work with the lender and keep the lines of communication open, a lender will generally work the borrower.

Ask for a mortgage forbearance and list the house with a competent realtor as soon as you decide this is what you want to do. A forbearance means that the lender is giving a short time to bring the mortgage current before proceeding with the foreclosure. Usually the time period will be around 60 days, but some lenders will give more or less time.

Realtors have many tools at their fingertips and a good realtor can give a property owner a realistic idea of how feasible it is to sell the home before it is foreclosed upon. A realtor will have access to the average number of days on the market (DOM) it takes for a home to sell in a particular neighborhood.

Be sure to ask the realtor for an adjusted DOM for the home that is in foreclosure. An adjusted DOM will give you an idea of how long it will take to the sell the home and at what price it should be listed given the unique qualities the home has.

For example, if most homes similar to your property are being sold in 45 days at the price of $120,000, then that gives a starting point for what the house should be listed at and how long it will take to sell. Adjusting for differences in the property is crucial because a major problem or major renovations can affect these calculations.

Listing with a realtor is best for someone with a small amount of equity in the home. In fact, the more equity there is in the home, the more likely that an offer will be made on the home that is sufficient enough to accept. An ideal situation would entail enough equity to cover the amount of any liens against the property and closing costs.

To get started, look for a realtor who has experience in the business and who has a good track record for selling homes without the listed properties spending too many days on the market.

Most realtors will charge a commission fee of about six percent. Nevertheless, the benefits definitely outweigh the expense here. Get the best realtor available who is willing to work with you. It is better to sell the home than to end up with nothing...

by: Ellen BallFall yard Cleanup It’s that time of year when we begin cleaning up our yards and preparing for the upcoming winter. The areas that most com-monly need attention are trees and shrubs, the lawn, and veg-etable or flower gardens.

Trees and shrubs often need to be trimmed back in the fall, though this will

vary, depending on the type of plant. If you’re unsure when to trim your

trees or bushes, consult a gardening book or online resource. If your trees

are taller than 10 or 15 feet, it’s best not to take the risk of doing the job

yourself. Look for a qualified arborist who can do the work for you, and be

sure to check out some references before hiring anyone to do the work.

This can also be a good time to remove any old or dying trees, as well.

Rake up all the fallen leaves and any other debris from your lawn. There

are many types of leaf bagging devices on the market today that can make

this job easier, such as leaf bag holders or special tarps designed to collect

leaves and other debris while you are raking. Once all the leaves are re-

moved, it’s important to do one final mowing at the end of the year. A fall

lawn application is also a good idea. visit your local garden center or

nursery for a recommendation of what type of product to use.

The last area that will require some fall attention is your garden and plant-

ing areas. Your work here will vary depending on what types of plants

you’re working with. In the case of annuals, especially annual vegetable

plants, it’s best to remove the plants entirely at the end of the growing sea-

son. Some vegetables like tomatoes and potatoes, if left to rot in the cool

fall weather, can transmit fungal diseases into the soil. Once annual plants

are removed, now is a good time to till the soil and add any fertilizers such

as organic matter or other soil amendments. Finish the area off by adding

a thick layer of mulch.

If the planting area in question is full of perennial plants, it’s best to leave

the plants alone and let them die back naturally during the winter months.

It is a good idea to apply a thick layer of mulch around the base of each

plant, too.

Fall yard cleanup does require some work on your part, but nothing too

difficult. With the basic steps we’ve outlined above, you will be rewarded

by a yard, lawn, and garden that will look better than ever next spring.

A loan modification allows a borrower to make lower monthly mortgage payments by agreeing to a modification of original loan terms. The idea of a loan modification is to allow homeowners struggling to make their payments every month an opportunity to catch up on their loan and recover from their hardship.

Since a loan modification is typically used to help homeowners who don’t make enough money to cover their mortgage payments every month, many wonder why can you get turned down for a loan modification if you don’t make enough money. The answer to the question is simple: because the lender only modifies loans when they think they can still make a profit.

Lenders are only willing to modify a loan so far and are only willing to lower a monthly payment by so much. If the borrower doesn’t make enough money to make monthly payments at the lowest amount the lender is willing to modify to, then in most cases the borrower is just plain out of luck. If the borrower can’t satisfy the requirements to make a lower monthly payment, the lender sees no point in modifying a loan when foreclosure remains a very real possibility for the borrower.

What does all this mean to the borrower? It means that if they make too little money they lower their chances of being approved for a modification because the lender doesn’t think that the borrower will be able to keep up with payments no matter how the loan is modified. It also means that if the borrower makes too much money they can also be denied a modification on the grounds that they should have no trouble making payments. Unfortunately for many borrowers, there is no scale or grid that lenders make public that explains the amount a borrower

must make in relation to the amount of their monthly payments in order to be approved for a loan modification.

A borrower’s best bet would be to hire an experienced foreclosure attorney who can review a person’s entire financial history and current financial standing in order to gain an accurate estimate of a person’s likelihood for modification approval. Even though the borrower may be more than deserving of a modification, the attorney could provide a unique third person perspective and offer insight based on their experience with certain lenders. If the attorney feels that the borrower would have a hard time gaining a loan modification from their lender, the attorney could immediately consider alternatives to loan modification that may better suit their

client. This will allow the borrower to cut down on the amount of time that is wasted waiting for a decision that is likely to be negative.

Even though a lender may not be likely to modify a loan if the borrower makes too much money, the attorney may still be able to convince the lender that a modification would be in the best interest of both parties through negotiation. This type of negotiation is delicate in that certain pieces of evidence and information will have to be submitted to the lender for review. If the borrower attempts to act as their own negotiator, they may leave out a vital piece of information and ruin their chances for a modification at all.
