I. COMPLAINT POLICY

Complaints against anyone violating the rules are to be made to the offrce, in writing, andcontaining the signature ofthe individual filing the complaint. A standard form isavailable from the Management Office. The Board and/ or manager will, in mostinstances, contact the alleged violator after receipt of each complaint and a reasonable

effort will be made to gain the violator's agreement to cease the violation.

If the reasonable efforts to gain compliance are unsuccessfirl, the unit owner will be

subject to a sanction in accordance with the penalty provisions contained hereunder.

II. PENALTY F'OR VIOLATION OF'RULES AND REGULATIONS

l. If any unit owner or tsnant is found by the Board of Managers (hereinafter "Board') tobe an wreasonable source of annoyance or to adversely affect the rights of others,prompt action will be initiated.

2. Prior to the imposition of a fine for the rule violation, the procedure outlined belowshall be utilized:

A. Prior to imposing a charge for damages or an enforcement assessment pursuant todivision (B) (12) of this section, the board of direstors shall give the unit owner a

written notice that includes the following:l) The nature of the alleged violation.2) A demand that the alleged violation terminate immediately.3) The action required to abate the violation.4) Depending upon the nature of the violation, the letter will state either of the

following:

a) A l0 day time period dqing which the violation may be abated withoutfurther action by the Board of Managers; or

b) A stateme,nt that any subsequent violation of the same nrle shall result infurther action by the Board of Managen including the possible impositionofa fine.

B. In the event that the violation is not abated during the time period specified in thedemand letter for abatement or if the rules is violated again, the Board of Directorsshall serve the alleged violator and owner of the unit in which the alleged violator

,resides with a written notice of a hearing to be held by the Board of Managers insession. Service of said notice shall be by either certified mail return receipt or bypersonal service, Service of said notices shall be made at any time within 12 monthsof the date of service of the demand letter upon the alleged violator. The Notice ofhearing shall include, but is not limited to:

l. The nature oftbe alleged violation.2.\\e time and place of the hearing, which date shall not be less than 30

days from the date of service ofthe ootice of the hearing upon the allegedviolator.

3. A request to attend the hearing and to produce at that time any statemen!evidence, witnesses on his or her behalf.

4.The ability of the Board to impose a fine of up to but not exceeding$75.00 per occrxrence for rule violation; in addition to any costs of repairand cleaning for any properly danage to the building.

HEARING

l. The hearing shall be conducted in an executive session of the Board witha quorum.

2. At the hearing, proof of the notice of the hearing and request to be heardshall be placed in the minutes of the meeting. Proof of Notice shall bedeemed adequate if a copy of the notice together with either r€tumreceipt stub from the U.S. Postal Service (in the case of certified mail),or the affidavit of the penion wbo delivered the notice (in the case ofpersonal senrice) is offered.

3. The Board shall present its evidence and witness and the alleged violatorshall have the right to present evidence and witress.

4. The imposition of a fine shall require a unanimous vote of a quorum ofthe Board of Managers. In making its determination, the Board must findby a preponderance of the evidence that the alleged violator is guilty ofsaid violation.

III. ENYIRONI}{ENT OF COMMON AREAS

I. GENERAL

A. The conunon areas are for the we and enjoyment of all tenants and all membersof the Association; therefore, we require everyone to be considerate in their use.

B. The Association holds all tenants and members with children (see Section IV,Article lA) responsible for the actions of their children. No congregating orplaying in the hallways, elevators, driveways, laundry room, garage, or parkingareas are permitted. Children are not pemritted in the exercise room, or pool andspa area urless accompanied by their parents or guardian.

C. Littering or vandalism of any sort is stictly prohibited,-J-

D' Hallways must be kept free oftoys, bicycles, doorrnats, Iitter, boots, and all otherpersonal items. Children shall not play in hallways, storage lockers, stairwells or.elevators.

E' Any damage atbibuted to a pet will be assessed to the owner of that unit.

IV. RESIDENT RESPONSIBILITIES

1. CHILDREN

A. Children under l8 are not permitted in the exercise rooms/spa area, billiardroom, or outdoor patio without an adult present to supervise them.

2. GTIESTS

A. Guests are the responsibility of the resident. Guests will abide by the Rulesof the West Chateau.

B. The office will NOT allow a guest to gain entry to your unit through the useof office keys at any time.

3. PROPER ATTIRE

A. Street clothes are to be worn at all times in the common areas of the building.

B. A robe fype covering must" as a minimum, be worn to and from the pool andsun deck.

C. Shoes or sandals are to be worn at all times.

4. NOISE

A. No loud or excessive noise.

B. Stereos and televisions must be kept at a minimum level.

C. All noise must be confined to yow unit.

5. SOLICITING

A. There will be no soliciting of any kind on the premises. If you are bothered bythis matter, please contact the office.

B. No commercial sigru may be displayed on or from any part of thecondominium properfy, other than those signs exempted in Section v,paragraph number 16.

A, All move-in and move-out times must be ananged through the office toassure you ofhaving the service elevator available for you use. Theelevator must be rEserved for either 9:00 arn or 12:30 pm. A reflrndabledeposit of $F5*80 must be left at the office to protect against possibledamage to the common area.

B. An inspection of the elevators and hallways will be made before and after themove and any damage found to be caused from such will be charged to you.

C. Moving and delivery of furniture shall be via the freight entrance. No movingor delivery of furniture through the front doors will be permitted.

F. The above stated Rules apply to floor-to'floor moves, as well as furniture andappliance delivery.

G. Excessive materials for moving such as boxes, etc. are to be taken to theRubbish Room in the Southwest comer of the garage. Do not leave thismaterial in the normal rubbish pick-up area.

BALCONIBS

Balconies are part of the limited corlmon areas. Only patio fumiture is allowed.This includes flower boxes. Balconies are not to be used for the storage ofitems. Do not put carpeting of any type on the balconies. Clothes and otheritems are not to be hung or draped over the balcony railings. Do not hangany plants, decorations, etc. from the balcony ceiling, exterior walls, or from theoutside of the railings. Winds can dislodge them causing damage to yourwindows, units below and vehicles below. Do not throw anyttring from thebalconies-including cans, bottles, cigarette butts etc. Sweeping must beconfined to your balcony space. Hosing of balconies is not permitted. Nobarbcque grills of any fype are permitted either in the suites or on the balconies.

8. BULLETIN BOARD

The bulletin board located in the Mail Room is intended for messages to the othertenants. Small notices of sales or services are permitted, such as babysitting, carwash, day care, and furniture. No outside cortmerciat or religious solicitation ispermitted.

BUSINESS

No business of any kind, except the Beauty Salon, may be operated from anyunit in the building.

CAR WASH

The car wash bay in tbe garage is provided to residents on a first-come,first-serve basis. Each resident may use the facility for not longer than a 45minute period. cars parked in the bay ovemight will be towed at the owner'sexpense.

V. OWNER RESPONSIBILITIES

1. GENERAL

A. Maintenance fees are due on the first of the month and are considered late if notreceived by the 10h of the month.

B. A late fee of $25.00 per month shall be charged for any payments received afterthe 10'h of the month.

J. If you're an owner in the building you cannot be employed by the WestChateau.

K. Signs and/or posters are prohibited from unit windows and large items areprohibited from window sills. All units must have drapes, curtains, or blindson the windows. Theuse of blankets, etc., is prohibited as a window covering.

L. No one is to tamper with any mechanical equipment under any circumstances.If there is a problem, notiff the offrce, or afterhours call216- 281-1968.

M. The use of balls (of any kind), footballs, baseballs, or Frisbees will not bepermined in the corrunon areas and limited common areas.

N. The playing of hockey, baseball, football, rollerblading, or any other activesport or games may not be played in the common areas and limited comrnonareas.

O. Water beds are permitted as long as proof of insurance for any damages causedby the bed is given prior to assembly of the bed.

P. The common areas and limited corlmon areas shall not be altered inappearance.

Q. It is the responsibilily of each owner to replace the batteries in the smokedetectors in their units as often as needed.

2. ENTRANCE DOORS/SECURITY

A. Do not allow anyone to enter the building at the time you enter. All visitors shallbe identified before allowing them access to the building.

B. No entrance way doors are to be propped open at any time for any purpose.

3. IJMT ENTITANCES

A. No rugs, ntats, or any other items may be placed outside the doors of unia.

B. Bottles or packages/tash may not be left outside the door for pickup.

C. No changes may be made in the color or d6cor of the doors.

D. No items such as boots, shoes, etc., may be left outside the doors.

4. ELEVATORS

A. Common care and courtesy must be used while operating the elevators.

B. The two elevators in the front lobby are for passengers only.

C. Appliances, furnishings, bicycles, move-ins/outs are to use the service elevator onlyand are prohibited from the lobby elevators.

5. MAIL ROOM

A. If you are going to be away from the building and unable to pickup your mail formore then three days, please make arrangements with the postal service to haveyour mail held for delivery.

B. The Association is not responsible for the loss or damage to mail or packages dueto the recipients failure to procure them.

6. LATJNDRY ROOM

A. The lint filters must be cleaned after use of the dryers and the lint should be put inthe trash can and not on the floor. No soaps, empty detergent packages, or otherdebris may be left on the floor or in the area unless it is placed in the properdisposal unit.

B. Laundry must be removed promptly from machines when finished.

C. Please be considerate of other residents in using these appliances.

7, BICYCLES

A. Bicycles are not permitted in the lobby of the building. You may store themIn the bicycle storage room at your own risk. The storage room key may beobtained from the office, If there is no space in the bicycle room when you desireto store your bicycle, you must store it in yoru unit.

C. No "Big Wheels" or tricycles are permitted in the common areas of the building.

D' Bicycles must be brougbt into or exit througb the service elevator located in thewest end of the building.

TRADE PERSONS

Owners are responsible.for the interior of their units.

Repairmen, tradesmen, and deliverymen must be instructed to register at theoffice' Owners and tenants must instuct such persons to registerln the office.

You must notiff the office at the time of their arrival and the nature of the workto be done, otherwise access to the building will be denied.

The office is not responsible for giving entry to and supenrising in-suite main-tenance and repairs.

Tbe Association, its €ents, and employees are not responsible for any darnage

9r theft that may occur in your suite by workmen. you must report theft to ti'eCleveland Police.

The.office must be given a24how notice for the delivery of fumiture and orappliances. You must speciff the name of delivery company and expected dayof delivery.

Furniture and appliances must be delivered through the west enhance and theservice elevator used.

IO. PARTY ROOM

C. A deposit of $150.00 is required. If the room and furnishings are left in properorder, after the occasion of the renting, the deposit will be returned. If the room "

is not in acceptable order, the deposit will not be retumed.

I I. RECREATION AREAS

A. All guests using these areas must be accompanied by a resident, at all times.Wet bathing suits are not permitted in the exercise rooms, and shoes must bewom, at all times. Toys and inflatable objects are not permitted in the pool withthe exception of infanUchildren swimming helpers. Food and beverages are notallowed in the pool area.

B. Each unit is allowed 2 guests only for all recreation areas at one time.

C.

Individuals utilizing the recreational facilities, do so at their own risk

STORAGE LOCKERS

There are storage lockers located in the basement and on each floor of thebuilding. Locker room and lockers have been assigned to each unit.

Illegal, flammable, corrosive and hazardous items and chemicals are not allowedto be stored in lockers.

All lockers should be cleared upon vacating the properry.

SMOKE DETECTORS

It is the responsibility of each resident to replace the batteries as required in theinstalled smoke detector in his unit.

GROCERY CARTS

Carts in the basement of the building are to be used for the convenience of theresidents. Carts are stored by the passenger elevators in the lower level and mustbe retumed there, after use.

I5. FOR SALE/RENT SIGNS

A. No " For Sale" or " For Rent" signs are permitted on the property other than signs

. for "Open House" which may be posted outside the mainentatrce to the buildingand only duing the hours in whichthe unit is "Open".

B. Window signs are not permitted.

VI. PARKING AND MOTOR VEIIICLES

I. GENERAL

A. All residents are require{to register their vehicles with the office.

B. No mechanical repairs, oil changing and antifreeze changing, are to be made onthe premises.

C. All vehicles must bear cunent state license tags.

D. The speed limit in the parking and access area is 5 M.P.H.

E. No playing, congregating, or loitering in cars, or in the access areas, is peruritted.Violators will be subject to a fine.

F. Motor vehicles are to be parked between the lines marked off.

G. Vehicles that are parked in fue lanes, drives, aisles, blocking another vehicleor another vehicle's garage space, whicb is a violation, arre subject to immediatetow.

H. All owners who choose to rent their parking space to a secondary party - mustprovide West Chateau Condominium Assoiiation a copy of tbe iease. Ownerswho chose to simply allow anotherparty to park in their space must noti$ theassociation of their intent to do so.

I. Any motor vehicle found in vioiation of the Rules and Regulations may be towedand stored at the owner's exp€nse, in addition to any other fines imposed.

2. PARKING AREAS

A. The front parking lot is for visitors only. Vehicles belonging to residents which areparked in the same location, in this area for more than 24 hours, are subject toticketing and towing.

B. There are numbered car spaces available for rent on the deck. Contact the office toobtain one of these spaces.

' C. Unit owners who do not occupy their suite(s) must park in the visitor's parkingarea at the front of the building.

D. No commercial vehicles, camFers, boats, boat tailers, or inoperable or abandonedvehicles are permitted on ttre parking deck.

E. Any abandoned or inoperable automobile may be towed from the premises at the

owner's risk and expgnse.

3, GARAGE AND VISITORS PARKING

A. All cars in the garage must be registered.

B. Mechanical work is not permitted in the garage.

C. The speed limit is 5 m.p.h.

D. There is no storage permined in the garage area.

E. The area in front of the building is for visitors only.

F. Campers, large vehicles, and/or commercial vehicles are not perrnitted on theproperfy.

G. If your jet skis, wave runners, snowmobiles fit in your garage space only, theyare permitted.

VII. TRASH DISPOSAL

A. Trash cans are located in the West stairwell near maintenance office, and eastsideof garage. AII trash is to be put in nzsh bags and deposited into trash containers.

B. Violators will be fined.

YIII. PETS

A. The term '?ets'refers to cats, birds, fisll hamsters, guinea pigs, and similar non-venomous rodents. *Pets" also refers to those dogs that resided in the buildingprior to June I I, 1986. AII creatures not specified herein, are prohibited.

B. Snakes and reptiles are not permitted in the building.

C. Pets are the responsibility of pet ownem.

D. All pets mnst be carried in the common area of the inside of the building whenbeing taken into and out of the building. There are no exceptions.

E. Pets are forbidden in the laundry room.

F. Pets are forbidden in hallways, except in carriers or cages.

G. Accidents that occur from yourpet inside the building common areas are to be

immediately cleaned'by the pet owner.

H. Damage done by pets shall be assessed to the owner of the unit in which the petin issue, resides.

IX. SALES AIYD/OR LEASING OF' I]MTS

I. SALE

A. To assist in tbe orderly transfer and processing of your unit, please notiff theoffice in writing when yoru unit is placed on the market for sale. Please indicatethe following:

(l) Name of owner(2) Current address and phone number(3) Realtor and agent

B. Thirry (30) days prior to proposed sale and tansfer of your unit, the followinginformation is to be submitted to the office, in writing:

l) The units' copies of the Association Declaration, By-laws, and Rulesand Regulations, must be transferred to the new owner. A cost of twenty-five dollars will be assessed to the seller for reproduction of these items ifnot tansferred. The names of the building manager and board membersmust be transfened to the new owner.

2) No *For Sale" or "Open Hortse'signs are permitted at any time insideor outside the units.

. "Open House' signs may be posted outside'the main entrance onty during thosehours in which the unit is opened.

At the Board Meeting held on March I l, 2008, the Board of Directors voted to make the following change to

the Lake Edge Condominiums Rules & Regulations which will become effective April 21, 2008:

Article VI, Parking and Motor Vehicles, Section 2, Parking Areas, Item A has been deleted Item Astates:

A. The front parking lot is for visitors only. Vehicles belonging to residents which are parked in the

same location, in this area for more than24 hours, are subject to ticketing and towing.

Furthermore, be advised that:

Article VI, Parking and Motor Vehicles, Section 3, Garage and Visitors Parking, Item E will be

enforced. Item E states:

E. The area in front of the building is for visitors only.

Investor Owners should inform their tenants of this change.

At our Quarterly Meeting of April 11,2006, the Board of Directors voted to make the following changes roour Rules & Regulations:

The Billiard Room was renarned to THE LOUNGE

Article IV RESIDENTS RESPONSIBILITIES, Item 6 MOVING

A. All move-in and move-out times must be arranged through the office to assure you of having theservice elevator available for your use. The service elevator may be reserved for ONLY one move a

day, Moves must begin at 9:00 am and finish no later then 4:00pm. All moves MUST use ONLY theservice entrance located off of W, 104h. If you have a large moving van, you MUST park on W.l04th, not in our driveway, Please ENTER AND EXIT only at W. 104'h. DO NOT DRIVETHROUCH to Lake Avenue because your truck will not clear our canopy.

D. The hours for moving are as follows:Monday through Friday 9:00 A.M. to 4:00 P,M, and Saturday 10:00 A.M. to 2:00 P.M.ONLY.

Please add items H and I to read as follows:

H. lf you are a renter, and do not leave the $400.00 refundable deposit, (for in or out move) the owner ofthe unit will be assessed $400.00 for your non-compliance.

l. If you are an owner selling your unit, part of the closing cost will be a $25.00 transfer fee and a

$400,00 refundable moving deposit. Once you have completed your move, we will inspecr thearea; if no damage is found your $400.00 deposit will be mailed to you,
