1. INTRODUCTION Locust Lake Village is a “Planned Community” as defined by Pennsylvania’s Uniform Planned Community Act No. 180-1996, 68 PA C.S.A. S 5101 et seq. By virtue of ownership in Locust Lake Village, individuals are obligated by covenant, easement and/or agreement imposed on their ownership interest to pay any amount for real property taxes, insurance, maintenance, repair, improvement, management, administration or regulation of any real estate (common area) owned, controlled or managed by the Association. The Locust Lake Village Property Owners Association Rules, Regulations and Guidelines (hereafter, “Rules and Regulations”) are designed to provide pertinent Community information to each owner, tenant and guest as it relates to their living and use of the Community and the construction of improvements on individually owned property. Locust Lake Village sponsored activities are given priority over the use of any recreational facilities in the Village. Particular reference is made to the summer recreation program printed for those months, which take place at each or all facilities during the summer months. This reference also includes any other seasonal activities as well. Community recreational facilities may not be used for a personal business enterprise. Specifically, the Rules and Regulations are intended to:

• Assist in the improvement and promotion of the Community, which is designed for healthful and harmonious residential and recreational living;

• Promote, assist and encourage the collective interest of all property owners in the Community;

• Assist and cooperate with owners of all lots in the Community, improved or unimproved;

• Promote and maintain the natural beauty and physical environment of the Community;

• Promote and maintain the value of all common property, all residential lots and their improvements;

• Prevent harm to the environment or to property values or other adverse effect by nuisances or other conditions detrimental to the health and welfare of the owners;

• Authorize actions as may be desirable and necessary to prevent or abate any conditions which are inconsistent with the Rules, Regulations and By-Laws, governmental requirements, deed restrictions and applicable law;

• Aid and cooperate with the owners of lots and houses in the Community in the enforcement of these Rules, Regulations and By-Laws, governmental requirements, deed restrictions and applicable law as now exist, or as may be adopted in the future;

• Exercise any and all rights, privileges and authority that may be delegated to the Board, Management or Committees from time to time by the Community; and;

• In general, to do everything necessary and proper for the accomplishments of the purposes set forth in the Rules and Regulations.

A copy of the Rules and Regulations must be maintained at your Community residence (Locust Lake Village) for quick referral by yourself, your tenants, your renters and guests. 2. COMMUNITY REMEDIES FOR NON-COMPLIANCE WITH RULES AND REGULATIONS.

A. General – Property owners have an ongoing duty to adhere to the Rules and Regulations. Such duty does not cease with a proposed sale or transfer of the property. Any outstanding violations that exist are to be corrected before ownership to a property is transferred.

The Association provides an appeal process for any Association Member who feels that a citation or violation notice is in error. Failure to abide by the Rules and Regulations shall subject property owners and tenants to correction where applicable and/or fine as established by the Board of Directors.

In the event that you determine a violation exists on your property, notify the Association Office immediately so that a remedy may be suggested as defined/determined by the Manager.

B. Appeal Procedures (Members in good standing and Tenants only)* - Violations, penalties and fines levied by authorized personnel or agents of the LLVPOA can be appealed on two levels. The first level of appeal is to the Fair Hearing Committee. The request for a hearing must be presented in writing within thirty (30) days from the date of the first notification. When a hearing is requested a $30.00 deposit (for administrative costs) will be required before the hearing is held. If the hearing is held, the deposit will be refunded. More than one continuance will require an additional $30.00 without a refund of the first $30.00 deposit. (A no show will result in loss of the $30.00 deposit.) The owner or tenant must appear in person before the Fair Hearing Committee. A request for continuance must be given no later than forty-eight

hours prior to the hearing. Following a hearing by the Fair Hearing Committee and its decision, an owner or tenant can appeal the decision of the Fair Hearing Committee to the Board at the next Board Meeting.

C. Fines and Penalties - All fines and warnings will be imposed on a member for not complying with the Rules and Regulations of the Locust Lake Village Property Owners Association. All fines and penalty fees are established by the Board and are subject to change. Multiple offenses will result in multiple fines. The property owner is ultimately responsible for any violations or financial assessments incurred by renters, tenants, guests, contractors, builders, and home improvement workers.

3. Questions regarding the Rules and Regulations The purpose of the Rules and Regulations is to give all property owners of the Locust Lake Village Property Owners Association a clear understanding of their duties, responsibilities and rights as members of the Association. Locust Lake Village Property Owners Association is a not-for-profit corporation, which exists to serve the recreation and leisure needs of the LLVPOA Owner/Member. The Rules and Regulations are also to be followed by any tenant, renter or guest. Questions regarding the Rules and Regulations or its provisions may be directed to the Locust Lake Village Property Owners Association office during normal business hours or correspondence to the Locust Lake Village Property Owners Association, 1778 Lake Lane, Pocono Lake, PA 18347 or by telephone at (570) 646-3616. 4. Definitions:* Architectural Quality - comparable in quality of design and detail as would be produced in the offices of a registered architect. Architectural Review Committee or ARC –the Committee appointed by the Board of Directors pursuant to Article IX, Section 1 of the By-Laws of the Locust Lake Village Property Owners Association. ARC Approval – Authorization by the ARC and the Association Manager to Construct, landscape, or otherwise modify properties according to documents accepted by ARC and complying with the Rules and Regulations. Assessment – common expense assessment. Association – Locust Lake Village Property Owners Association, its successors and assigns (hereafter, LLVPOA). Attached - having a common wall with primary dwelling or structure. Board – the Board of Directors of the Association. Buildings – structures intended for single-family residential use or accessory uses. Campfire – an outdoor open fire ignited directly on the ground or elevated platform to cook food or for warmth. Citation – a written notice of a financial penalty due to a violation. Clearing – any removal of trees, soil, rock or other natural growth or condition on the property in contemplation of or in connection with construction. Clearing shall not include the removal of brush or debris from the property for aesthetic purposes, which is encouraged and may be done without permit. Community or Development – Locust Lake Village. Conifers – evergreen trees. Construction – Beginning upon first cutting of trees. (add/appr. Bd. mtg. 11/16/06) Covenants or Declaration – the applicable Declaration of Covenants, Conditions and Restrictions recorded in the office of the Recorder of Deeds; typically used inter- changeably with the word Declaration.

Deck or Decking - The flat surface one uses to walk on, constructed outdoors, elevated above ground, connected to the home and enclosed by a railing support for safety. Access shall be from the home through doors and from the ground via a stairway. All decks or decking shall comply with Locust Lake Village “Color Material Standards Board”. Deed Restrictions - the common set of covenants, conditions and restrictions in deeds for residential lots in the Community. Deciduous Trees – trees that shed their leaves for part of the year. Driveway (approved) – (see pg. 21, sect. XI) follows guidelines as set forth in these Rules & Regulations. Fair Hearing Committee – a committee appointed by the Chairman of the Board to conduct appeals of citations or penalties. Fall or Earth Tone Color – substantially similar or identical color based on color and value on chip as provided by the stain or paint manufacturer. Fee – amount of money that is demanded as payment (for something). Fine – financial penalty imposed on a member, guest, occupant or invitee for violation of the Association’s legal documents, rules and regulations. Floor Area – net enclosed, weather tight, heated, usable residential floor area, and shall exclude garages, decks, and porches, outside stairs or attached storage areas. Garage (approved) – (see pg. 20, section H, para. #2) – follows guidelines as set forth in these Rules & Regulations. Grass – plants that have narrow green leaves that are commonly grown on lawns. Groundcover – a planting of low plants that cover the ground in place of grass. Guest – any individual not a member of the owner’s or tenant’s immediate family, invited by the resident to the home or property. Harmonious – the state of being architecturally and environmentally compatible and in compliance with the design review objectives set forth in these guidelines. Immediate Family – brother, sister, child, parent, grandparent or grandchild, or a spouse of any of the named relatives of a property owner. Improved Property – lot on which on a single-family dwelling has been constructed. Independent Arborist - a professional in the practice of arboriculture which is the cultivation, management, and the study of individual trees, shrubs, vines and other perennial woody plants who has no financial interest in the tree(s) that are being evaluated to be cut down. In Good Standing – a member who is in compliance with the Covenants, Bylaws and Rules, and who has paid all obligations owed to the Association including, but not limited to, dues, fines, assessments or other special charges. Inspector – the agent of the Board or its designated committee appointed by the Chairman of the Board. Junk – (see pg. 15) Landscape- improve the aesthetic appearance of (a piece of land) by changing its contours, adding ornamental features, or planting trees and shrubs. Lawn – an area of ground that is covered with short grass. Licensable motor vehicles – automobiles, mini-vans and vans carrying no more than nine (9) people and pick-up trucks, motorcycles and mopeds used for leisure or family travel and routine work travel. Living Space – defined as a heated area that is occupied as a functioning room.

Lot – any numbered residential parcel of land in Locust Lake Village, also referred to as property, now referred to as unit. Lot joinder – two adjoining lots, which have been legally merged with municipal approval into one lot and which shall be treated as one lot for the purposes of voting. Member – an Owner in Good Standing. Member and tenant-owned Commercial Licensed Motor Vehicles - shall include work pick-up trucks and vans ten thousand lbs. (10,000 lbs.) gross vehicle weight (GVW) or less in capacity, which meet all the requirements listed above for licensable motor vehicles. Mobile Home – a movable portable dwelling with or without a permanent foundation. Motor Driven Recreation Vehicles (MDRVs) -Shall include but not necessarily be limited to 4 wheel all-terrain vehicles (ATVs), snowmobiles, golf carts, dirt bikes and two (2) wheel motor driven vehicles. Nuisance – Any unreasonable, unwarrantable or unlawful use of public or private property, or injury, damage, hurt, inconvenience, annoyance or discomfort to any person in the legitimate enjoyment of his or her reasonable rights of person or property. Ornamental Lawn Grass – grasses that is grown ornamental plants. Owner – any and all owners of residential properties in the community as stated on the deed to the property. Permit – the authorization(s) to build, make improvements, or physically modify property, issued by the appropriate governmental agency(ies). Quality Drawings – comparable in quality produced in the offices of a design professional. Renter – any duly registered individual(s) or single family who temporarily occupy, via a rental agreement, the improved property of a Locust Lake Village property owner. Amenities shall be available to the renter only when the renters are registered and the owner is in good standing. Replace or Replacement - The substitution of a component of an existing structure in the same form, shape, size, location and plane shall be identical to that which will be substituted. Re-roofing shall comply with Locust Lake Village “Color Material Standards Board”. Residential – approved for improvement and use as a single-family dwelling house. Rules and Regulations – the body of rules and regulations for the community adopted by the Board. Single Family – As defined by Tobyhanna and Coolbaugh townships a single family is one or more persons (not to exceed three (3) persons unrelated to each other by blood or marriage) together with domestic servants, who maintain a common household. Special Assessment – an expense assessment above and beyond everyday village expenses. Tenancy – the period of time that a property is leased or rented to one or more individuals by a property owner. Tenant – a tenant is someone who lives in the village and has a lease of one year or more that is registered in the village office. Their Pennsylvania driver’s license or Pennsylvania issued photo ID card must be registered to their Locust Lake Village address. They can attend meetings, become members of committees, volunteer and have use of all amenities. They will have no voting privileges. Unit – any numbered residential parcel of land in Locust Lake Village, formerly referred to as property or lot. Vegetation – green leaves or plants. Warning – a written act stating a violation without a fine.

LOCUST LAKE VILLAGE PROPERTY OWNERS ASSOCIATION RULES and REGULATIONS

I. Association Identification Wristbands Association identification wristbands must be worn at all times at all recreational areas, during participation in social events, or when using amenities maintained by LLVPOA. Security or other authorized personnel can request to see an Association wristband or personal identification to verify membership.

A. Members’ Wristbands Payment of all current Association dues, fees, assessments or charges on all property owned, entitles the members to wristbands in accordance with the following: Property owners may request six (6) membership wristbands at no charge. Additional wristbands up to six (6), may be purchased by a property owner for an additional fee. An additional six (6) wristbands may be requested by owners of multiple lots. Additional wristbands for a member’s immediate family will be provided on request to the Association office indicating the name, address and relationship to the member. Immediate family as it pertains to additional wristbands is: father, mother, son, daughter, in-law or ward living in the same household only. Wristbands must be worn by individuals 12 years of age or older. Owners must have wristbands at all Locust Lake Village events and when using Locust Lake amenities. Wristbands must be worn when attending LLVPOA Board Meetings. Any Association member losing or misplacing a member wristband can acquire a new one for a fee at the Association office.

B. Landlord Tenant Registration and Identification (REFER TO PAGE APENDIX A – RENTAL POLICY) The Locust Lake Village Landlord Registration and Identification Program is hereby established in order to enhance Community security and ensure that the use of Community facilities and amenities are limited to Association members in good standing, tenants, renters and their guests. Any property owner renting their property either short-term or long-term, shall pay an annual Rental Registration fee as established by the Board. Registration is required for each new rental or tenancy at no additional fee within the same calendar year. The “Registration of Property” form must be resubmitted with updated information on an annual basis thereafter. The owner, tenant and the renter shall be jointly and severally liable for damages caused by the property occupant and their guests to any Association owned property, and the owner shall be responsible for payment of all fines and assessments imposed for violation of the Association by-laws, rules and regulations or restrictive covenants. Renting property does not relieve the owner from their obligations to the Association, and the owner shall remain responsible for any failure by the tenant or renter and all guests to comply with the requirements and provisions of the rules and regulations. The owner shall verify with the Association that the proposed lease is in writing and obtain a written agreement from the tenant or renter that they will comply with the Association’s by-laws, rules, regulations and restrictive covenants. The owner shall furnish a copy of such agreement to the LLVPOA office. The lease may not be assigned to a party other than the proposed tenant or renter without the consent, which shall not unreasonably be withheld, of the Board of Directors of Locust Lake Village. The lease shall include

language stating the parties agree to comply with the Association’s By-Laws, Rules and Regulations and restrictive covenants. The property owner is responsible for providing to their renters a copy of the current Rules and Regulations. These are available at the Association office during normal hours of operation or on the Locust Lake Village website. The property owner is further responsible to the Association for compliance with these Rules and Regulations by all occupants of the property owner’s home. Property owners must include in the lease a stipulation that the lessee has received a copy of these rules and will abided by them during their tenancy.

1. Renter Identification All renters must register their vehicles and occupants of the property with the Association office no later than 24 Hrs. after arriving at the rental property. A temporary parking pass will be issued for their vehicle at this time. All vehicles that are parked at any amenity must display a parking pass. Once registered, renters will be issued up to 8 temporary wristbands for the duration of their rental provided the owner has paid the rental fee. Additional temporary wristbands can be purchased for daily or weekly use at the current fee established by the Board of Directors. A renter losing an identification wristband can acquire a new one for a fee at the Association office. 2. Tenant Identification Wristbands Any property owner renting their property long term, will be issued a total of six (6) Identification wristbands upon paying the annual rental registration fee as established by the Locust Lake Village Board of Directors.

II. TRAFFIC AND SAFETY All licensable vehicles entering the community from public roadways must have a valid vehicle registration to travel on Locust Lake Village roadways. A. Rules of Operation

1. Pennsylvania Motor Vehicle Laws All Pennsylvania motor vehicle laws will be enforced within the community. No motor vehicles of any type shall be driven or towed in a reckless manner on or along any road. All drivers of motor vehicles shall observe speed restrictions and noise limitations within the development as established by the LLVPOA. No motor vehicles shall be permitted upon any road within the development unless the same are properly and currently licensed and inspected pursuant to the laws of the state of registration and operated by licensed persons.

2. Speed Limits

Motor vehicles share the roads in Locust Lake Village with a large number of varied forms of transportation including bicycles and pedestrians. Maximum speed limits are posted throughout the Community. The maximum speed on any road within Locust Lake Village is twenty-five (25) miles per hour unless otherwise posted. The maximum speed limit in an amenity area (e.g., access roads, parking lots) is ten (10) miles per hour. Speed limits are posted on roadways and at facilities and amenities.

3. On street parking is prohibited. Temporary on street parking is permitted with permission granted by the office staff or security. On street parking cannot hinder any other traffic.

4. Enforcement Locust Lake Village rules pertaining to motor vehicles including but not limited to, maintaining the speed limit and state laws regarding traffic control devices, will be strictly enforced. Failure to comply will result in the issuance of a citation and the assessment of monetary penalty.

5. Trespassing All motorized vehicles, including association registered MDRVs, may only be operated on the member’s property, public roads or designated areas. Operation of any motorized vehicle on LLVPOA common property or another member’s property without permission will be deemed trespassing.

6. Allowing a dog to leap, run, or tow on a leash, from any type of moving vehicle, wheeled or sled, on any Locust Lake Village road or amenity is strictly prohibited. This may include any bicycles or motor driven vehicles. Offenders will be cited in accordance with the Locust Lake Village traffic violation structure. (Add. Bd. Mtg. 6/21/08)

B. Vehicle Identification

1. Property Owners A Vehicle Identification Permit is issued by the LLVPOA Association to vehicles owned or operated by members, their relatives and/or authorized personnel.

Permits are issued in two different formats. A permanent sticker permit may be issued and must be properly affixed to the vehicle as specified by the Association office. A temporary hang tag permit may be issued for vehicles that are not going to be on LLV property for an extended stay. These permits must be openly and visually displayed in order to be viewed from the exterior of the vehicle when on LLV property.

All owner/operators must obtain a LLV Vehicle Identification Permit within 24 hours of their arrival. Only permitted vehicles are allowed to be parked on any LLV approved parking areas or amenities.

To obtain a vehicle permit, a current state issued vehicle registration and current proof of insurance must be presented at the Association office. The permit may be used only for the vehicle for which it is issued.

A vehicle sticker permit is identified valid by the current Administrative guidelines established by the LLV office. A temporary hang tag permit is identified valid by the expiration date on the tag.

2. Guests, Tenants and Renters Vehicle Identification Permits

All guests, tenants and renters of property owners must obtain and display a vehicle permit issued by the Locust Lake Village POA.

Property owners upon request to the office may obtain up to six (6) temporary hang tag type vehicle permits. These permits shall be retained by the property owner to be used for distribution to their guests when they visit. These permits will remain valid for the current fiscal year in which it was issued as long as the property owner remains a member in good standing as defined in the current by-laws.

A guest permit is valid only for the period of time authorized by the owner. A tenant permit is valid for the length of the tenancy. A renter permit is valid for the length of the rental agreement. The permit is only valid when properly affixed to the assigned vehicle as specified by the Association office. To obtain a vehicle permit, a current state issued vehicle registration and a current proof of insurance must be presented. A temporary vehicle permit may only be used on the vehicle for which it is issued. Guests, tenants and renters must obtain a vehicle permit within 24 hours of arrival on LLVPOA property.

C. Types of Vehicles 1. Licensable Motor Vehicles Locust Lake Village defined vehicles that are required to be legally state licensed in order to be operated on public roadways. Automobiles, trucks with a registered Gross Vehicle Weight (GVW) of 10,000 lbs. or less, mini-vans designed to carry no more than nine (9) people, motorcycles, and mopeds used for leisure or family travel and routine work travel.

Licensable motor vehicles as previously defined herein may only be operated on the member’s property, LLV roads, public highways and/or designated areas.

2. Motor Homes, Truck Campers and Camper Trailers Owner/operators of all motor homes, campers and camper trailers must obtain a vehicle identification permit.

Only motor homes, campers and camper trailers 28 feet and under in length are permitted in Locust Lake Village and must be parked in an approved driveway. Motor homes and camper trailers over 28 feet in length must get temporary permission from Security and obtain a vehicle identification permit in order to park the vehicle in an assigned designated location.

It is prohibited to use any motor home, camper, or trailer as living space at any time within Locust Lake Village.

D. ON-LOT PARKING Snowmobiles, boats and all other associated trailers parked on a lot shall be kept in an area that provides minimal unattractive disturbance to the environment and/or neighbor.

All trailers except those explicitly designed to transport MDRVs or boats, are required to obtain a Vehicle Identification Permit in order to be parked in LLV.

Unpermitted or inoperable vehicles are not permitted on a member’s property. This will include vehicles parked in a manner which creates an unsafe condition, hazard, or nuisance. Vehicles that are confined within an enclosed permanent structure that remain out of plain view are exempt.

Written notification of a violation of this regulation will be mailed to the member’s permanent address of record as listed in the LLV office. Members will have an opportunity to obtain a Vehicle Identification Permit through the process described under Section B above. Those who do not comply must have the vehicles removed by the date indicated on the violation notice letter. Enforcement of this regulation follows those as established in the fine structure of the Rules & Regulations. (Amend. Bd mtg. March 15, 2008) Junk material including but not limited to unused, discarded, disabled or abandoned machinery, vehicles or vehicle parts, equipment, house hold furniture or appliances are not permitted on members’ property unless confined within an enclosed permanent structure. Written notification of a violation of this regulation will be mailed to the member’s permanent address of record as listed in the LLV office. Members are required to have the junk material removed by the date indicated on the violation notice letter. Enforcement of this regulation follows those as established in the fine structure of the Rules and Regulations. (Amend. Bd mtg. March 15, 2008)

E. Member/Tenant-Owned Commercial Licensed Motor Vehicles 1. 10,000 lbs. gross vehicle weight (GVW) & under

Member or tenant-owned commercial licensed motor vehicles as previously defined herein, that are used in the routine work of the resident, are to be parked in either the resident’s driveway or garage.

2. Prohibited Commercial Construction-Type Motor Vehicles Vehicles such as dump trucks, tractor trailers (trailer or tractor) buses, commercial travel vans, trucks or like vehicles, over 10,000 GVW are not permitted in Locust Lake Village unless temporarily providing a service or picking up/dropping off people. All commercial or construction-type and heavy vehicles are specifically prohibited from operating, parking or otherwise using the roads within Locust Lake Village unless working under a valid construction permit issued by the LLVPOA. (Amend. Bd. Mtg. 11/16/06)

F. Motor Driven Recreation Vehicles (MDRVs)

ATVS DEFINITION - An ATV is a motorized off road All-Terrain Vehicle which travels on 4 inflatable tires. Three-wheeled ATVs are not permitted. No state registration is required for use in Locust Lake Village. ATV REGISTRATION

▪ LLV property owners in good standing (current dues paid) must annually register all ATVs at the Administration Office before using such ATVs. ONLY PROPERTY OWNERS OR TENANTS MAY REGISTER AN ATV.

▪ Liability insurance in the property owner’s or tenants name must be presented when registering the ATV. ▪ The ATV OWNER must sign a Waiver of Liability and acknowledgement of assumption of risk by operator with

respect to use of roads, property and parking areas owned, controlled and maintained by LLVPOA. ▪ Upon completing registration, a flag and license plate will be issued. The flag must be attached to the ATV,

and the license plate must be attached to the rear of the ATV. ▪ The owner of the ATV is responsible for all violations and fines associated with the ATV. ▪ Renters may only use ATVs registered to the property owner and only with the property owner’s written

permission. They must register at the Administration Office as drivers before using such vehicles. RENTAL OR RENTER-OWNED ATVs ARE NOT PERMITTED TO BE DRIVEN ON LLV PROPERTY.

DRIVER REGISTRATION

▪ All adult operators must present a valid driver’s license or a Safety Certificate as proof of their knowledge of safe driving techniques and traffic laws.

▪ All operators between the ages of 14 and 18 must present a birth certificate as proof of age and a Safety Course Certificate from https://atvsafety.org/atv-ecourse . Upon verification of both documents, an LLV picture license will be issued to the participant. The applicant must contact LLV Office to arrange times and dates for photo ID processing. A parent or guardian must accompany applicant to the LLV Office to complete the application process.

RULES OF OPERATION

• All ATVs must be equipped with a muffler system in good working order. Security will use their discretion in judging an acceptable noise level. If Security deems the noise level to be unacceptable, Security may require the operator to submit to LLV’s noise level testing. The sound may not exceed 78 decibels measured at a distance of 50 feet.

• Children between the ages of 14 and 17 are permitted to drive an ATV after taking a safety course (see above) and obtaining a picture license unless they have a valid state driver’s license. The license must be available while operating ATV. If children under 14 are found to be driving said ATV, a mandatory fine will be assessed for each occurrence.

• All speed limits and road signs must be obeyed.

• All riders and passengers must wear a helmet approved by the Department of Transportation.

• No more than one person is permitted to ride on an ATV unless it is designed to accommodate passengers. To carry a passenger, the operator must be 18 years of age or older, or have an “M” designation on their driver’s license.

• No passenger should be seated in front of the operator.

• Operators must operate their ATVs only on LLV-owned roads and parking areas, staying to the extreme right of the road and riding in a single file.

• LLV traffic laws must be obeyed and ATV operators must yield to traffic.

• Pedestrians and bicyclists have the right of way over all motor vehicles, including ATVs.

• Driving on dams at Pines and Locust lakes is prohibited. A $500 FINE AND 2 WEEK SUSPENSION OF ATV DRIVING PRIVILEGES WILL BE ASSESSED FOR VIOLATING THIS RULE.

• Never drive recklessly.

• Never drive when under the influence of alcohol or drugs.

• Security will have the right to issue a citation or revoke an ATV registration through due process at any time for a violation dealing with the MDRV rules and regulations.

• Skid Chains prohibited

Hours of Operation ATVs may be operated between 8 a.m. and 9 p.m. If attending an LLV night time event, ATV operators are permitted a one-half hour time period to return home, provided the ATV has proper front and rear lights.

UTVs DEFINITION - An UTV is a 4-wheeled, motor-driven, gasoline powered Vehicle with an engine displacement of 300cc or greater. These vehicles are also described as side-by-side Utility All Terrain vehicles. UTV REGISTRATION

▪ LLV property owners in good standing (current dues paid) must annually register all UTVs at the Administration Office before using such UTVs. ONLY PROPERTY OWNERS OR TENANTS MAY REGISTER AN UTV.

▪ Liability insurance in the property owner’s or tenants name must be presented when registering the UTV. ▪ The UTV OWNER must sign a Waiver of Liability and acknowledgement of assumption of risk by operator

with respect to use of roads, property and parking areas owned, controlled and maintained by LLVPOA. ▪ Upon completing registration, a flag and license plate will be issued. The flag must be attached to the UTV,

and the license plate must be attached to the rear of the UTV. ▪ The owner of the UTV is responsible for all violations and fines associated with the UTV.

RULES OF OPERATION

▪ All UTV drivers must have a valid state-issued drivers license. ▪ All UTVs must be equipped with a muffler system in good working order. Security will use their discretion in

judging an acceptable noise level. If Security deems the noise level to be unacceptable, Security may require the operator to submit to LLV’s noise level testing. The sound may not exceed 78 decibels measured at a distance of 50 feet.

▪ All speed limits and road signs must be obeyed. ▪ LLV traffic laws must be obeyed and UTV operators must yield to traffic. If UTV is equipped with seat belts, they

must be worn. ▪ Never drive recklessly or joyride. ▪ Never drive intoxicated or under the influence of drugs or narcotics. ▪ Driving on dams at Pines and Locust lakes is prohibited. A $500 FINE AND 2 WEEK SUSPENSION OF UTV

DRIVING PRIVILEGES WILL BE ASSESSED FOR VIOLATING THIS RULE. ▪ Always be aware of your surroundings and avoid distractions such as texting and cell phone use.

• Only carry the number of passengers for which there are seats.

• If there is a cargo area, occupancy is limited to either two adults or 3-4 children.

• Driver and passengers should keep all body parts inside the UTV while it is in motion, except when using hand directional signals.

• No standing while UTV is in motion.

• Operate UTV from the driver seat only.

• Carefully look behind the UTV before backing up.

• Avoid excessive speed, sudden starts, sudden stops or fast turns.

• Do not leave keys in the UTV when unattended.

• Always yield to pedestrians and bicyclists.

• Security will have the right to issue a citation or revoke a UTV registration through due process at any time for a violation dealing with the MDRV rules and regulations.

Hours of Operation UTVs may be driven anytime, if the vehicle is equipped with proper front and rear lights.

GOLF CARTS DEFINITION: a golf cart is a four wheeled vehicle powered by either gas or battery designed to carry passengers at slow or posted speed limits. No state issued registration is required. GOLF CART REGISTRATION

▪ LLV property owners in good standing (current dues paid) must annually register all GOLF CARTs at the Administration Office before using such GOLF CARTs. ONLY PROPERTY OWNERS OR TENANTS MAY REGISTER A GOLF CART.

▪ Liability insurance in the property owner’s name must be presented when registering the GOLF CART. ▪ The GOLF CART OWNER must sign a Waiver of Liability and acknowledgement of assumption of risk by operator

with respect to use of roads, property and parking areas owned, controlled and maintained by LLVPOA. ▪ Upon completing registration, a flag and license plate will be issued. The flag must be attached to the GOLF

CART, and the license plate must be attached to the rear of the GOLF CART. ▪ The owner of the GOLF CART is responsible for all violations and fines associated with the GOLF CART. ▪ Renters may only use GOLF CARTs registered to the property owner and only with the property owner’s written

permission. They must register at the Administration Office as drivers before using such vehicles. RENTAL OR RENTER-OWNED GOLF CARTs ARE NOT PERMITTED TO BE OPERATED ON LLV PROPERTY.

DRIVER REGISTRATION: Drivers between the ages of 14 and 17 must provide a birth certificate or driver’s license as proof of age and completed

approved LLV training course. Upon verification of age, a picture license will be issued and must be visible when driving.

The applicant must contact LLV Office to arrange times and dates for photo ID processing. A PARENT OR GUARDIAN

MUST BE PRESENT AT THE TIME OF REGISTRATION.

RULES OF OPERATION

• If children under 14 are found to be driving said golf cart, a mandatory fine will be assessed for each

occurrence.

• All speed limits and road signs must be obeyed.

• LLV traffic laws must be obeyed and golf cart operators must yield to traffic.

• Never drive recklessly or joyride.

• Never drive intoxicated or under the influence of drugs or narcotics.

• Driving on dams at Pines and Locust lakes is prohibited. A $500 FINE A 2 WEEK SUSPENSION OF GOLF Cart

DRIVING PRIVILEGES WILL BE ASSESSED FOR VIOLATING THIS RULE.

• Always be aware of your surroundings and avoid distractions such as texting and cell phone use.

• Only carry the number of passengers for which there are seats.

• If there is a cargo area, occupancy is limited to either two adults or 3-4 children.

• Do not leave keys in the golf cart when unattended.

• Always yield to pedestrians and bicyclists.

• Security will have the right to issue a citation or revoke a golf cart registration through due process at any time for a violation dealing with the MDRV rules and regulations.

HOURS OF OPERATION Operation of a golf cart by anyone under the age of 17 is restricted to the daily hours of 8AM to 9PM. If a person under

the age of 17 is attending an LLV night time event and their golf cart is equipped with front and rear lights, they will be

given a one half hour time limit to return home. Drivers with a state issued drivers license over the age of 17 may drive

anytime, if the vehicle is equipped with proper front and rear lights.

SNOWMOBILES DEFINITION - A snowmobile, also known as a sled or snow machine, is a motorized land vehicle designed to travel on snow and ice. SNOWMOBILE REGISTRATION

• LLV property owners in good standing (current dues paid) must annually register all snowmobiles at the Administration Office before using such snowmobiles. ONLY PROPERTY OWNERS OR TENANTS MAY REGISTER A SNOWMOBILE.

• Liability insurance in the property owner’s or tenants name must be presented when registering the snowmobile.

• The SNOWMOBILE OWNER must sign a Waiver of Liability and acknowledgement of assumption of risk by operator with respect to use of roads, property and parking areas owned, controlled and maintained by LLVPOA.

• Upon completing registration, a flag will be issued. The flag must be attached to the snowmobile.

• The owner of the snowmobile is responsible for all violations and fines associated with the snowmobile.

• RENTAL OR RENTER-OWNED SNOWMOBILEs ARE NOT PERMITTED TO BE DRIVEN ON LLV PROPERTY.

• LLV traffic laws must be obeyed and snowmobile operators must yield to traffic.

• Pedestrians and bicyclists have the right of way over all motor vehicles, including snowmobiles.

• Driving on dams at Pines and Locust lakes is prohibited. A $500 FINE AND 2 WEEK SUSPENSION OF SNOWMOBILE DRIVING PRIVILEGES WILL BE ASSESSED FOR VIOLATING THIS RULE.

• Never drive recklessly.

• Never drive when under the influence of alcohol or drugs.

• Security will have the right to issue a citation or revoke a snowmobile registration through due process at any time for a violation dealing with the MDRV rules and regulations.

Hours of Operation Snowmobiles may be operated between 8 a.m. and 9 p.m. If attending an LLV night time event, snowmobile operators are permitted a one-half hour time period to return home, provided the snowmobile has proper front and rear lights. III. COMMUNITY RECREATIONAL FACILITIES AND AMENITIES The recreational facilities and amenities are provided by the LLVPOA for use of all members in good standing, guests, registered tenants and registered renters. Badges must be displayed when using amenities.

Recreational equipment may be provided at certain recreational areas subject to following:

• One person (individually or for a group) signs for and is responsible for the care, maintenance and return of equipment so charged to them.

• Any person found damaging or losing such equipment will be responsible for replacing it with like or similar equipment or paying the cost of such replacement.

• Appropriate identification badge is shown and worn.

• Hours for recreational facilities will be observed as posted.

• All recreational facilities will be utilized at the user’s own risk.

• The rules and regulations regarding the use of each facility or amenity shall be posted conspicuously. A. Beach and Swimming Areas

The lifeguards on duty are responsible for assuring a safe, sanitary and enjoyable operation for members and guests by enforcing the Rules and Regulations established for the beach areas. These regulations are posted at the beach areas as well as beach hours of operation. Opening/closing decisions are made at the sole discretion of the Association Manager, or his agent, who also has the authority to exclude any individual whose behavior adversely affects the safety and/or enjoyment of another individual.

Beach Rules*

1. Badges must be worn at all times.

2. Children under the age of 8 MUST BE accompanied by an adult (16 years of age or older) while on the

beaches. NOTE: A child under the age of 8 may swim in the water under the observation of an adult.

Children age 4 and under must be WITHIN ARMS REACH of an adult when in the water or be supervised by

an adult while wearing an approved personal floatation device.

3. All public displays of nudity and/or public exposure, vulgarity, disorderly conduct, lewd behavior or failing to

follow a directive of the lifeguards shall be cause for immediate removal from the beach and may result

confiscation of badge through due process until the issue is resolved.

4. Lifeguards can order removal of individuals from the waterfront as a result of horseplay or other conduct

jeopardizing the safety of themselves or others.

5. Swim face masks of any kind are not permitted in the water.

6. Only Coast Guard approved floatation devices are permitted in the water. Toys and other objects that float

are permitted solely for play in shallow water.

7. No rafts are permitted in the swimming area.

8. Pets are not permitted at any beach or picnic area.

9. Glass bottles are not permitted in the beach area. They are only permitted in the picnic area.

10. Persons at the beach are responsible to clean up any trash/ debris they have left behind.

11. Please do not feed the ducks or geese.

Failure to comply with above can result in a warning or citation by LLVPOA Rangers.

SWIM AT YOUR OWN RISK:

1. All Beach Rules Apply 2. No one may swim alone. 3. Swimmers under the age of 15 must be accompanied by an adult (18 or over) who is responsible for the swimmers.

4. All swimming must be contained within the roped areas at the beaches. 5. No swimming is allowed before dawn or after dusk. Visibility is required for safe swimming.

Swimming is never permitted at Pilgrim Lake. Pets are not permitted at or on any amenity area.

B. Boating and Fishing 1. Boating Villagers are urged to use extreme caution while fishing from all watercraft. Coast Guard approved personal flotation devices are required for each occupant of all types of Watercraft on all waters in Pennsylvania. All children, aged 12 years and under, must wear a Coast Guard approved life jacket. Also, life jackets must be worn from November 1st through April 30th as required by PA Boating Regulations and Law. Boats using electric motors must be registered with the PA Fish Commission. It is legal to operate a boat registered in another state on PA waters. Boats must be registered in the state of primary use. Out of state boaters with boat validity registered in their home state are granted reciprocal privileges to boat in Pennsylvania for up to sixty (60) days.

No gasoline, other liquid fuel, gas or steam-powered boats of any kind are permitted on any lake. Boats with internal combustion motors attached to or installed in boats are not permitted in Locust Lake Village Lakes. All other, including electric powered boats are permitted on Pines Lake and Locust Lake. No boats are permitted on East Lake and Pilgrim Lake. All Pennsylvania Boat Commission rules governing boating on state waters shall apply.

No boat in excess of 18 feet in length may be docked or launched at any Association owned or private owned dock, on any lake.

All boats shall be removed from LLVPOA waters by October 31st annually. Boats left on Association property or in the water after that date will be removed to the maintenance area. It will be the boat

owner’s responsibility to transport his boat from the maintenance area after payment of the removal charge plus per diem for storage.

A seasonal fee, as established by the Board, is required only for boats moored at Locust Lake Village POA docks or placed on Locust lake Village POA racks. Kayaks owned by the same owner able to be placed side by side within the confines of the rack will be charged one fee. The seasonal fee includes one mooring tie down. If additional tie downs are needed additional fees must be paid. Boats found without current Locust Lake registration stickers or stored in un-permitted areas will be removed to the maintenance area. Removal and storage area fees will apply. (Add. 11/19/05)

2. Fishing

All persons fishing in Locust Lake Village waters must display a current Association badge along with their Pennsylvania fishing license (required of all fisherpersons 16 years of age and older). Violators are subject to a citation from authorized Association personnel and the PA Fish Commission.

Fishing season(s), fish sizes and all limits are established by the Association and the Commonwealth of Pennsylvania, but the more restrictive of either shall apply to all Locust Lake Village waters.

C. Association-Owned Areas Adjacent to Lakes Only those member-owned properties abutting the buffer strip (not easement or right of way) that surrounds the lakes and is owned by the Association may be granted permission to place sand on or modify these buffer strips. Permission to place sand or to modify these strips is granted only after a permit is issued by the LLVPOA community manager. In order to receive this permit, the property owner must submit a detailed sketch and a written description, including measurements, and/or all permits required by state, local, and federal entities of the planned work to be performed. No work or modification is to occur until after a proper review of the plan, and/or all required state, local, federal permits, inspection of the work site and issuance of the permit has occurred. The only exception to these requirements would be if the property owner has rights granted to them in their deeds that pertain to these areas adjacent to the lakes. In such a case, the property owner shall present a copy of their deed to the LLVPOA community manager for recording purposes along with all permits etc as stated above. Recreational vehicles, snowmobiles or any type of motorized vehicles are not permitted on these areas.

D. Lake Docks It is the property owner’s responsibility to obtain any local, state or Federal permits, if required, before erecting any personal docks in the lakes of Locust Lake Village. Members with permission in their property deeds to own personal docks are permitted to exercise these privileges according to the wording in their deeds. In such a case, the property owners should present a copy of their deed to the LLVPOA community manager for recording purposes. Owners of property that abuts the buffer strip (not easement or right of way) may be granted permission to put personal docks onto the lake where their property resides. Permission to install a personal dock is granted only after all required permits are issued. In order to receive the permit, the property owner or their designate must submit a sketch with measurements, and a written description of the proposed dock. No work is authorized until after proper review of the plan, inspection of the work site and presentation of the local, state and/or federal permits have occurred. Docks placed on lakes adjacent to the property owners’ lots shall be considered private (lot owner) property. Docks placed on lakes adjacent to the property owners’ lots may not exceed 120 square feet, with a maximum length of fifteen feet.

E. Tennis Courts, Basketball Court, Baseball Field, Ski Hill Regulations governing each of these amenities or facilities are posted at the site.

1. The basketball court and baseball field do not require advance registration or reservation. There is no fee required for their use.

2. The tennis courts are available for use from 8:00AM to 11:00PM each day and players wishing to use the courts after dusk should notify the office during business hours and the lights will be turned on.

3. The ski hill is open to all members, tenants and their guests for no fee. Renters are required to pay a fee for use of the ski hill. Fees are established annually and are part of the fee schedule incorporated herein and made a part hereof.

4. Association-sponsored and scheduled events take priority over individual member use of the facilities and amenities. Association amenities and facilities may not be used for private clinics, group lessons or tournaments unless sanctioned by LLVPOA.

5. Current Association Badges must be displayed.

F. Ski Chalet Rental - Private Events The Ski Chalet may be utilized by Association members in good standing for private affairs but not at times that will conflict with any scheduled Association function. Scheduling will be on a first-come/first-served basis. Association members wishing to rent the Ski Chalet must complete the appropriate rental form and must pay the established daily rental fee and security deposit. Arrangements are to be made at the Association office.0

G. Ice Skating is permitted at Your Own Risk 1. No one should ice skate alone 2. Ice skaters under the age of 12 must be accompanied by an adult (18 or over) who is responsible for the

ice skater. 3. No skating is allowed before dawn or after dusk, except for Pilgrim Lake, when illuminated. Visibility is

required for safe skating.

H. Non –LLV Sponsored Activities Clubs such as Anglers, Archery, Hookers, Ringers, etc. will be allowed use of LLV facilities to hold their

functions. However, rules concerning membership shall be established by the Club, not by LLV.* IV. SAFETY AND QUIET ENJOYMENT

A. HUNTING AND FIREARMS Hunting of any kind is strictly prohibited within Locust Lake Village. The discharge of any firearm, bow and arrow, BB gun, slingshot for other projectile device for hunting, target practice or recreation is strictly prohibited. The exceptions to this rule is: 1. the annual, Board authorized DMAP(Deer Management Assistance Program) hunting permits for the culling of the deer and the goose management program. 2. Archery target shooting and practice will be allowed at the Board approved archery range. This target shooting will be for archery only and will be by archery club members and guests with strict supervision.*

B. ANIMALS – LIVESTOCK – POULTRY* No more than four domestic animals (any combination of dogs and cats) may reside in any single household in Locust Lake Village. Service dogs shall not be included in calculating the total number of animals per household. Violations of this rule will result in the issuance of a warning or subsequent citation and fine. Failure to remedy the violation by reducing the number of animals within ninety days from the date of being notified of the violation will result in the imposition of additional penalties in accordance with the schedule stated in the Rules and Regulations.

No dogs, cats or other animals referred to as household pets or domesticated animals are permitted in or at Association-owned facilities or amenities (beaches, picnic areas, courts, fields, etc.) or other places designated

as recreational areas, at any time. *Dogs under direct control of the owner (or person walking the dog) may swim in the designated areas as established by LLVPOA without a leash as follows: 1) the person must be in control of the dog with verbal or hand commands, 2) the dog is expected to obey reasonable commands and MUST be returned to a leash when leaving water, 3) the dog(s) must not swim near or interfere with people fishing.

Dogs must be on a leash while being walked and owners must clean up after their pets.

Continuous or excessive barking, yelping, howling or similar offensive noise; to include all items listed under the “Prohibited acts” section of Tobyhanna and Coolbaugh Township Code pertaining to animals, will not be tolerated. Animals creating a nuisance or disturbance shall subject the owner to citations

Feeding of wild animals, including feral cats, deer, bears, geese, etc. is strictly prohibited and doing so shall subject violators to citations. Feral cats shall be cats that are do not have an owner.

C. COMMUNITY and HOME SAFETY and SECURITY ALARMS

Security/fire alarm systems must be registered with Locust Lake Village and must also be registered with the Pocono Mountain Regional Police Department or Tobyhanna and Coolbaugh Townships in accordance with township ordinances. Association members are to maintain these systems in proper working order to prevent frequent false alarms. The Pocono Mountain Regional Police Department does incorporate nuisance response penalties for frequent false alarm calls.

D. OUTDOOR FIRES

• Residents must notify LLVPOA Security prior to start.

• No refuse/debris or leaf burning is permitted!

• Campfires with a flame not exceeding a height of 2’ and in a circle 3’ – 4’ in diameter. Tobyhanna and Coolbaugh Township burning bans must not be in effect. All fires shall be attended to at all times by a responsible adult.

• A working water hose must be available and in close proximity to the campfire.

• Outdoor cooking is permitted provided if it is done in or on a residential/commercial type cooking apparatus such as gas or charcoal grills, or campfire.*

• Disregarding these rules will result in a fine.

E. COMMUNITY BULLETIN BOARDS Use of the community bulletin boards is restricted to community notices, functions and events only.

F. DELIVERIES AND SERVICE REQUESTS* Merchandise deliveries and contractors responding to owner or tenant service requests may enter the community with proper invitation. Commercial vehicles are to use the designated parking spaces allocated for the Association residence being serviced and are to avoid blocking entries and exits to other residences or Association-owned common areas.

G. ASSOCIATION MEMBER PROPERTY SIGNS Association member property signs, which may be displayed, are limited to the following: name signs, security/alarm signs, electric dog fence signs and family crests or titles. Members are requested to utilize earth-tone colors. All individual signs should not exceed the total of four (4) square feet.

For sale signs, advertising signs, yard sale signs and construction signs are not permitted.

The posting or offering of advertising or promotional materials on any property in Locust Lake Village, whether by member or member’s agent, is expressly prohibited. This includes but is not limited to builders or developers posting advertising circulars.

H. FIREWOOD The cutting or gathering of firewood on Association-owned property or on member-owned property is prohibited unless permission from the Association or member-owned property is granted. Firewood must be stored in an area and not create an unsightly appearance.

I. TRASH AND RECYCLING PROCEDURES The Association has arranged for trash, garbage and recyclables to be picked up at all residences. The following removal procedures are essential in maintaining a clean and aesthetically pleasing environment.

Dumpsters are available at Pop Gassner Way with the following restrictions: Illegal Dumping at Pop Gassner Way trash dumpsters will result in a fine of $500.00. Dumpster Use Regulations

• Bagged Household Trash Only

• All Bags MUST be placed inside of dumpsters

• No Construction Material or Debris

• No Appliances, metal or furnishings

• No Automotive parts; tires, batteries

• No Lawn Debris; leaves, twigs, branches or wood

• For Use by LLV Owners, guests, tenants and renters only during Posted Hours

• Only trash generated within the confines of LLV will be accepted

Trash for pickup must be placed in a secure container. A secure container is one which is constructed to prevent access by animals. Trash for pickup containing garbage may not be left overnight in exposed plastic bags.* Items for recycling shall be placed in the appropriate township recycling container.

Residents who are not available to place and then remove their trash containers on the day of pick-up shall place their trash containers in a trash bin. A trash bin is generally constructed of pressure treated wood with a top or doors which can be secured. All trash containers are to be stored in the trash bin(s). The trash bin may also have a red flag that is raised to indicate need for collection.

Trash and recycling containers may only be left exposed at roadside (end of driveway) for 24 hours before and after collection. All residents are responsible for cleaning up any spilled trash within 24 hours of notification of the incident. Property owners or their tenants who have trash collected and who will not be in the area after the collection must make arrangements to clean up any spilled trash and to return their trash containers to the residence. Residents who have not removed spilled trash within 24 hours of the incident shall be subject to the assessment of fines in accordance with the Rules and Regulations. The Association also reserves the right to have its personnel remove the trash and assess the property owner the cost of this clean up.

Unauthorized dumping of household trash, hazardous items, leaves, trees and all other debris or junk within Locust Lake Village is prohibited and subject to penalty. Contracting debris from contractors cannot be dumped in the LLV compost site.

1. Large Trash Items Large (bulk) trash items for pickup including, but not limited to, discarded furniture, recreational supplies or equipment, appliances, etc., may not be left at roadside for longer than seven (7) days. Residents who have bulk items for pickup with the trash collection, shall notify the LLV office prior to the scheduled collection time.

All appliances containing refrigerant, such as freezers, refrigerators and air conditioners, require an official tag certifying that the refrigerant has been removed before putting them on the roadside. All freezers and refrigerators for bulk pickup must have their doors removed before being placed at the roadside. Construction material and debris may not be placed in the trash for pickup. Property owners are responsible for the removal of their own construction material. (Amend/Rev-Bd. Mtg. 5/16/09)

2. Hazardous Items

Batteries, propane tanks, motor oil, paint cans, tires and other types of hazardous liquids and materials must not be put out as trash. Contact the Association Office for information regarding proper disposal of hazardous items.

J. NUISANCES The Locust Lake Village Community and its owners have an obligation to maintain both the common facilities and individually-owned properties in a condition which prevents attractive nuisances, is aesthetically pleasing and enhances the concepts of ecological and environmentally sound principals.

1. Loud and Irritating Noise Defined as any unreasonably loud or irritating sound produced by voice, instrument, sound system, mechanical device, vehicle engine or power tool which disturbs the peace and composure of a property owner (tenant) NOT residing in the same household. This shall include, but not be limited to, alarm systems, loud radios, foul language, automobile horns, chain saws, lawn mowers, leaf blowers, sound systems, amplifying devices and other noise Nuisances must be reported to security or the office as they happen.

2. Unsightly and Unkempt Conditions The Association and its residents have an obligation to maintain both the common facilities and individually owned properties in a condition, which is aesthetically pleasing and well-kept and enhances the concepts of ecological and environmentally sound principles. Association members are responsible for the following standards as it relates to their own individually owned property. Failure to comply with the following standards will result in a violation and a fine.

a. Junk Materials In accordance with the Tobyhanna and Coolbaugh Township Nuisance Ordinances, “Junk material, including but not limited to unused, discarded or abandoned machinery, vehicle parts, equipment or appliances which are not confined within a permitted structure” is unlawful to store or dump on private property. This prohibition shall also include junked vehicles, household furniture and/or other items, which pose a hazard, attract children, animals, etc. b. Damaged Structures Damaged structures, including but not limited to, the house, auxiliary structures, fencing, screening, etc. shall be made secure and weather tight by the owner after the occurrence of the damage. Repairs and removal of any debris from the loss must be completed by the owner within thirty days or within a time frame approved by the Association Manager. Call the office for advice, should this occur.

c. Dangerous Buildings Buildings described as dangerous by Township of Tobyhanna and/or Coolbaugh Code (Chapter 64) includes but is not limited to buildings, which are dilapidated, decayed, unsafe, unsanitary or not able to provide the amenities essential to decent living. Dangerous buildings are not

permitted and must be repaired or removed by the owner within the notification period prescribed by the Township in which jurisdiction it is located. d. Fallen Trees Owners are required to remove fallen trees from improved properties when:

▪ The tree is located in an Association easement area. ▪ The tree is situated in the open. ▪ The tree is considered a nuisance to neighbors. ▪ This should occur in a timely manner.

e. Unsafe Conditions (Roadways) Association members or their agents are prohibited from:

▪ Blowing or plowing snow into the roadways of the Village. ▪ Blowing or raking leaves into the roadways or culverts of the Village. ▪ Leaving branches or brush along the roadside.

f. Garage Sales No garage sales, lawn sales, flea markets, etc., are permitted on private property unless sanctioned by Locust Lake Village POA.

3. FIREWORKS

• No fireworks shall be set off on, toward or at any community owned property, (lakes, beaches, ski hill, etc.), including roads unless sanctioned by Locust Lake Village POA.

o Class A & B fireworks are strictly prohibited in Locust Lake Village and are illegal to be set off, in PA, under PA State law.

• Class C fireworks may be set off on resident’s own property, providing a working water source is available.

4 DISORDERLY CONDUCT Members of Locust Lake Village POA are prohibited from intentionally causing a public inconvenience or annoyance by engaging in fighting, threatening or any violent behavior, this also includes making unreasonable noise, using obscene language, or gestures or causing a hazardous or physically offensive environment with any act that serves no legitimate purpose.

K. HOME BASED BUSINESSES The use or occupation of a portion of the primary dwelling unit as an office, studio or work room for purposes of running a business or producing income or profit by one or more persons residing in the dwelling unit is deemed to be a home based business. The use must be accessory and secondary and must not alter the exterior of the property or affect the residential character of the neighborhood by the introduction of noise, fumes, obnoxious odors, increased traffic or other nuisances associated with such home based business activities. The home business shall not involve the employment of any other person except those persons residing in the principal dwelling unit. Lawn mower repair, small engine repair, automobile repair, real estate and construction are strictly prohibited as are all similar occupations, which do not meet the following criteria (1-3).

1. Outdoor storage, signage and displays of products and equipment are expressly prohibited. 2. Such use shall not require external alternations or external construction features not customary in

residential dwellings. 3. There shall not be any external evidence of such use.

V. ON-LOT SEPTIC SYSTEM MAINTENANCE and POLICY Locust Lake Village community sewage disposal needs are serviced by the use of on-lot septic systems and/or sand mounds. It is of extreme importance to the Association, the environment and the owner that these systems be maintained on a periodic but regular basis by the owner. The state regulations for these systems are monitored and enforced by the township. Septic systems suspected of malfunction shall be reported directly to the Township by the individual reporting or by the Association Management Office. Locust Lake Village will require septic tanks to be inspected or pumped by a qualified pumper/ hauler every 5 years from their last inspection/ pumping or every 3 years for properties adjacent to the lake. Therefore, that person shall have the tank inspected/ pumped at least every 5 years/3 years or when an inspection reveals that the septic is filled with solids or with scum in excess of 1/3 of the liquid depth of the tank. Any resident can file an anonymous complaint about a nearby septic problem that would be investigated by Locust Lake Security, Tobyhanna Township or Coolbaugh that may require an inspection or pump out in less than 5 years/ 3 years. Receipts from that pumper/ hauler shall be submitted to Locust Lake Village Office to be recorded. However, the ultimate responsibility is for insuring Locust Lake Village Office with a copy of this report rests with the homeowner. Failure to comply with these regulations governing inspection, cleaning and maintenance of septic tanks may subject the owner to citations and monetary penalties as provided herein. LOT DEVELOPMENT AND BUILDING REQUIREMENTS VI. PURCHASE AND RESALE OF LOCUST LAKE VILLAGE PROPERTY Locust Lake Village is a “Planned Community” as defined by Pennsylvania’s Uniform Planned Community Act No. 180-1996, 68 PA C.S.A. S 5101 et seq. By virtue of ownership in Locust Lake Village, individuals are obligated by covenant, easement and/or agreement imposed on their ownership interest to pay an amount, set by the Board at budget process, for real property taxes, insurance, maintenance, repair, improvement, management, administration or regulation of any real estate (common area) owned, controlled or managed by the Association.

A. Resale Certificates Section 5407 of the PA Uniform Planned Community Act No. 180 requires the property owner to furnish the prospective purchaser before execution of the contract for sale or otherwise before conveyance, a copy of the Deed Restrictions, a copy of the Bylaws, a copy of Rules and Regulations and a Resale Certificate disclosing all fees, charges, assessments owing to the Association at the time title to the property is transferred.

The Association office will prepare the Resale Certificate on the seller’s behalf for a fee, as established by the Board. The seller must be a property owner in good standing and will therefore assume all responsibility for satisfying all requirements of the Resale Certificate including, but not limited to, payment of all fees, charges and/or assessments owing to the Association before title to the property is transferred.

B. Capital Improvement Fees A Capital improvement fee will be charged by LLVPOA on the resale or transfer of properties within the village as stipulated in the Pennsylvania Planned Communities Act.

The fee on an improved lot will be equal to and no greater than the dues on that lot for the previous year. The fee for an unimproved lot will be equal to and no greater the ½ the dues on an improved lot for the previous year. These fees will be deposited into the Capital Reserve Replacement Fund for replacement of existing facilities or equipment common to the community. C. Lot joinders A ‘lot joinder’ request must be submitted to the Locust Lake Village Property Owners Association for Approval after it has

been approved by Monroe County.

Documentation required by Association Manager or agent, for review, shall include:

1. Deed showing lot ownership;

2. Addendum to the deed displaying County approval;

3. A written request for approval to the Board of Directors of Locust Lake Village Property Owners Association, Inc.

4. Final joined plot map showing actual dimensions of the joined properties and any improvements thereto.

A lot joinder is legal, binding and final, and cannot be UN-joined in the future. Once joined, dues become thirty three (33%) percent of the dues set for an extra lot in the annual budget each year, ADDED to the dues for the joined lot with a house. Such lot joinders would NOT be exempt from any assessments. Lots which are not buildable due to inability to perc may be joined and dues for such lots become fifty percent (50%) of the dues set for an extra lot in the annual budget each year added to the dues for the joined lot with the house. Such lots would not be exempt from any assessments.

“Units (lots) determined to be unbuildable due to inability to perc or declared wetlands must be certified as such by October 30th to be assessed for dues reduction for the next year.

Perc status is to be determined by a certified inspector. Copies of all pertinent information shall be given to the Association office for review and record keeping. Notification from the Association office as to any reductions will be given after the documents have been reviewed.

VII. APPROVALS and PERMITS Applications for new construction permits must be submitted in duplicate and include the following: A form of Certificate of Compliance must be completed prior to any approvals. The Architectural Review Committee will review plans. After the plans are approved, the owner can then go to the township with a copy of the Certificate of Compliance. Once Township approval is given the final Locust Lake Village permit can be obtained. 1. The name, address, and contact person of the contractor hired to do the construction. The contractor must be an

insured company, registered in the Commonwealth of Pennsylvania. The contractor shall furnish a copy of his/their insurance policy or binder, which also names Locust Lake Village Property Owners Association as an additional insured, to the property owner and Association office before a permit will be issued.

2. A copy of the deed and contract.

3. A building and sewer permit from Tobyhanna or Coolbaugh Township. 4. A quality plot plan showing location of the proposed house, proposed addition, accessory building, well, and septic system. Also, the area in which trees are to be removed for construction must be shown. The location shall be shown for all drives and walks. This plan shall have all necessary dimensions for an accurate review. Topography shall be shown in areas where grades exceed 10%, with erosion control indicated. (Bd. Mtg 07/18/09) 5. All blueprints and their complementing specifications will be used for construction. All Construction shall conform to the IRC (International Residential Code for One and Two-Family Dwellings) latest edition. (Bd. Mtg 07/18/09) 6. A check for permit review and approval made out to the Locust Lake Village Property Owners Association. The cost will vary for new construction, additions, decks, sheds, etc. 7. Any proposed deviations from the original blueprints or specifications must be submitted for review and approval and the proposed changes from the original submission must be clearly identified in the new submission.

8. All new construction applications are required to include material color samples of all exterior construction materials with the actual paint, stain or vinyl color to be applied. 9. Approval and permits are required before any new construction or work on a lot may be performed. (Add. Bd. Mtg. 11/16/06) 10. All properties which are subject to testing must be returned to the original condition.

▪ The Association Manager will approve or reject all requests for new construction permits. If the permit is not approved, a written explanation will be given to the applicant. The application fee is not refundable. Approval, modification or rejection must be submitted within ten (10) days.

▪ A copy of the permit and the construction plans must be available for inspection at the site at all times. The

permit card must be visible.

a. Mobile homes are not permitted on any lot or building site. b. Any off site constructed home to be assembled in Locust Lake Village, on a permanent foundation, must be approved/disapproved by the Board on a one to one basis.

10. A LLVPOA permit shall be required before perc testing properties. Locust Lake Village reserves the right to inspect all construction sites during construction to verify compliance with these rules and regulations. Any violations may result in a stop work order. In the event common area damage (roads, parking, etc.) occurs during any construction, the contractor and owner shall be assessed for the cost of all repairs. VIII. NEW BUILDING CONSTRUCTION REQUIREMENTS AND CONDITIONS. When building a new home or addition, a plot plan must be submitted to the Association Manager for approval, showing the area in which trees are to be removed. Only trees, which are in the area of construction and within 20’ of the line of the building foundation, shall be allowed to be removed. Trees in the direct line where the driveway, septic field, walks, or decks and porches are to be built may be removed. However, it is recommended that an attempt be made to work around existing trees when placing drives and walks. Dead trees may be removed anywhere on any lot. Trees marked and approved for clearing beyond the 20’ buffer area must be replaced elsewhere on the property. Deciduous trees may be utilized in place of evergreens provided they are of adequate size, indigenous to the Community and location. New trees shall be at least eight foot high conifers or 2 ½” to 3” caliper deciduous trees. Newly planted trees must survive in perpetuity. (Bd. Mtg 07/18/09) All trees, which are cut down, shall either be removed from the lot in their entirety or cut into firewood sized logs and stacked neatly on the site, or may be utilized for landscaping. There shall be no burning or burying of brush, trees, stumps or other refuse on any lot within Locust Lake Village.

A. All new homes or additions shall be enclosed with all exterior finishes, doors and windows completed within six (6) months of start of construction. All initial landscaping shall be completed within 12 months of start of construction.

B. All construction within Locust Lake Village shall be done between the hours of 8:00 AM and 5:00 PM, Monday through Saturday. There is no construction permitted on Sundays and major holidays or holiday weekends.

C. A dumpster and porta potty will be on site for the length of the construction period. The Contractor must make arrangements to place a dumpster on-site for the daily collection of construction debris. The commercial dumpster shall be located on the lot being improved and outside of any community right-of-way, easement,

parking or streets, when starting of framing or demolition. Porta potties are required at the start of tree clearing.

D. All lots shall be kept as clean as possible during construction and the surrounding and adjacent areas shall be policed by the contractor as required. Dumpsters will be kept covered and emptied, as needed. There is to be no burying or burning of construction debris anywhere in Locust Lake.

E. During construction, no structure of a temporary nature, trailer, tent, shack, garage, barn or any other out-building shall be used on any lot, at any time as a residence, either temporarily or permanently.

F. No supply storage vehicles will be permitted on any property during the construction of the home without written permission from the Association office.

G. Use and Size

➢ All dwellings must conform to Township (Tobyhanna or Coolbaugh) codes, regulations and ordinances. ➢ Each lot may have only one dwelling. ➢ Dwellings may be single story, one and one-half story, two story or three story buildings. ➢ Living area is the floor space designed for and finished for essential living. ➢ The minimum living area in all dwellings is 1200 square feet, with the first floor taking up at least 900 square

feet. ➢ No living accommodations are permitted above the uppermost floor. ➢ The maximum allowable lot coverage is thirty percent (30%.)

ONE STORY DWELLINGS.

The floor space designed for and finished as essential living area of a one-story dwelling must be no less than 1200 square feet in size.

ONE AND ONE-HALF TO THREE STORY DWELLINGS

Buildings higher than one story shall be constructed so that the first or principal floor is not higher than four feet above the highest natural ground level along the building exterior walls. A one and one-half or two story dwelling shall be constructed so that the principal floor has at least one- half of the total building floor area designated for and finished as living space. The half story is to be finished and located wholly or partly within the roof frame. A two-story or higher dwelling shall consist of upper and lower floor levels, with each designed and finished wholly or partly as living accommodations. (A split-level design is considered a two-story configuration for this evaluation.) Actual floor space square footage measurements are taken to the outside of exterior walls, where applicable. Attached garage, carport space, breezeway, deck porch and areas of similar appendages to the dwelling are excluded. H. Attached Building Additions, Alterations, Garages, Enclosures, Free Standing accessory Buildings and Decks

1. Any addition or alteration to an existing dwelling shall complement the existing form size, and shape of the existing building. If the existing building does not meet the criteria of these guidelines, it is suggested that the new addition make all possible efforts to ameliorate or correct the deficiencies of the existing structure. addition shall be approved or exacerbate an existing non-conforming condition which is objectionable to the community.

2. Garages may be added to the existing single family dwelling or detached with the following provisions:

a. All garages must abide by all set back provisions and conform in style to the exterior of the home. b. Maximum two car detached garages are permitted. c. Maximum three car attached garages are permitted when no other garage space is previously

incorporated or existing (includes in-basement garage). d. The roof peak height of any attached garage shall not exceed the roof peak height of the home. e. The roof peak height of any detached garage shall not exceed fourteen feet (14’), without approval of

the Board of Directors. f. Living space may not be incorporated into space located above detached garages.

3. Free standing accessory buildings such as sheds and gazebos may be permitted subject to the following:

a. Structure meets all set back requirements. b. Structures incorporate similar materials and architecture as the existing dwelling. c. An appropriate Township permit has been obtained and submitted to the office. d. Structures shall not exceed 192 square feet, maximum length not to exceed 16’, maximum width not to

exceed 12’ and a maximum height of 10 feet. No deviations will be permitted! e. Sheds are to be behind the front edge of the house, at the side or rear of the house, according to

setbacks. The street address on corner lots will be considered the front of the residence. (Add. Bd. Mtg. 10/21/06.)

Free standing accessory structures (including garages), shall not be permitted on any single individual lot when a single-family dwelling is not present on the same lot. Storage trailers, metal sheds, freestanding carports or other such similar temporary structures are not permitted except for temporary periods approved by the office. IX. UTILITIES (WATER, SEWAGE DISPOSAL AND FUEL TANKS) Water System State and local permits for all individual water supply systems are required for all building sites. All systems must be located, constructed and equipped in accordance with the requirements, standards and recommendations of the State and/or local public health authorities. Sewage Disposal All individual sewage disposal systems must be permitted for any lot or building site and such a system must be designated, located and constructed in accordance with the requirements, standards and recommendations of the State and/or local public health authorities. All sand mounds must be seeded to blend in with the natural surroundings and maintained (groomed) as needed. Fuel Tanks Fuel tanks shall be located to the rear or side of each dwelling. Acceptable screening consists of wood lattice or similar product, year round greenery or other recommended material. Tanks must meet property line setbacks. X. PLACEMENT ON SITE A. Setbacks – Residential Buildings Home structures or portions thereof or appurtenant thereto shall not be located on any building lot nearer than: 50 feet from the front property line (i.e. main roadway); 15 feet from the side property lines; 40 feet from the rear property line; 20 feet from any secondary road.

B. Detached Accessory Structures Detached accessory structures shall not be located on any building lot nearer than 8 feet from home structure; 50 feet from the front property line; 15 feet from the side property line; and 25 feet from the rear property line.

Property owners requesting a variance from any of these setback requirements shall show cause to the Board or its designated agent. All affected neighbors shall be notified and allowed to comment on the proposed variance. Corner lots must clarify which street will be considered the main roadway.

C. Topography Requirements

When placing a building, addition or accessory building on the site, the owner shall take into account the natural terrain of the surrounding area. Buildings may take advantage of views, while respecting the lay of the land. Undue recontouring shall not be undertaken. A building shall be set on the land without disturbing the natural grades. (Bd. Mtg 07/18/09)

New homes should respect the positioning of existing neighboring structures to preserve the optimum privacy for all homeowners.

XI. DRIVEWAYS A. Materials

All driveways should have a minimum of 6” thick base of shale or comparable material. The driveway should be finished in stone, tar and chip or asphalt pave. All drives shall be a maximum of twenty (20’) wide. Where a drive is crossing a drainage ditch or stream, a suitably sized culvert pipe must be installed. A minimum of 12” in diameter or larger is required.

The Association Manager or agent shall determine whether a culvert pipe is required, and its size. Installation of the required culvert pipe shall be at the owner's expense.

B. Driveway Location

Driveways shall be located 15’ from any street intersections. It is recommended that the Driveway follows the natural contour of the site without any undue grading.

C. Permits

A permit shall be required to alter an existing driveway, including enlargement, paving, relocation, or other improvement. No work on driveway improvements shall be started without first obtaining a driveway improvement permit. Permit not required for re-stoning existing driveway.

XII. LANDSCAPING

A. Trees All Locust Lake Village property owners shall apply for a permit to remove any tree(s) six (6) inches or larger in diameter.

Applications for tree cutting can be obtained at the Locust Lake Village office at no charge. The application shall be completely filled out and signed by the property owner or a person designated by the property owner. Before the permit is issued, an inspection of the property shall be conducted. The tree(s) for which the permit is being issued shall be clearly marked. Those tree(s) approved for cutting shall be clearly marked by the LLV manager or a LLV designated agent at the time of inspection. Only the tree(s) that have been marked by the LLV manager or agent shall be cut and/or removed.

In the event of a disagreement as to the condition of the tree(s) and the need to cut, the property owner at his/her expense shall seek out the opinion of a third party certified arborist as to the condition of the tree(s) and the need to cut and/or remove the tree(s) from the property. Reports or written statements from the contractor who is cutting the tree(s) shall not be accepted.

After the permit is issued, Locust Lake Village Security shall attach the permit in a visible location on the property. The permit shall be valid for sixty (60) days from the time of issue. Failure to obtain a permit prior to the cutting of any tree(s) or cutting of any tree(s) on an expired permit shall result in a violation with a fine of $250.00 per tree and the required replacement with a tree(s) indigenous of the North East Pa. Region, with a minimum caliper of 2.5”-3” in diameter and a minimum of 8’ in height. All replacement trees shall be properly maintained and cared for in an effort to guarantee the health of the tree(s) for as long as the property owner is in possession of the property.

In the event of inclement weather or unforeseen circumstances should the permit expire, the contractor or property owner shall be required to obtain an extension for the original permit from the Locust Lake Village office.

Prior to the cutting of any tree(s) all contractors shall provide proof of liability insurance listing Locust Lake Village as an additional insured to the Locust Lake Village office.

The Locust Lake Village office shall be contacted on the day of the scheduled cutting of tree(s) for the LLV manager or designated LLV agent to perform a visual inspection once all cutting is completed.

B. Shrubbery and Planting

It is recommended that minimal landscaping be done on any lot except to restore what has been disturbed by construction and to ensure harmony with the environment. Preservation of the natural terrain, which maintains the beauty of Locust Lake Village, is the goal of these rules and regulations. If landscaping is to be done around a home, it is recommended that native vegetation is used. Also be aware of what is subject to deer and weather destruction.

Landscaping should be used to conceal obtrusive objects such as exposed foundations, satellite dishes and raised septic systems. Ground cover is a solution to steep hillsides or restoring areas disturbed by building construction. These shall be shown on plot plans.

XIII. RETAINING WALLS AND FENCING

A. Retaining Walls Landscape retaining walls should be of a natural material and color(s) such as fieldstone, rubble stone, landscape ties or landscape pavers.

B. Fencing All fencing must be approved by the Association Manager or agent, and must comply with the following, except as

hereafter provided:

• Chain link fencing is prohibited, except for dog pens. Dog pens of chain link fabric with a total area of 60 square feet, which are attached to the back of the owners dwelling, are permitted.

• Fencing shall be wood or composite materials the resemble wood and be in earth tone colors.

• Open type fencing such as Split Rail and Post/Beam are permitted.

• Closed (solid) or near solid type fencing including picket, stockade and board on board are prohibited.

• Maximum fence height is 4 feet.

• Swimming pool fences must be no further than 15 feet from the edge of the pool and may be of solid construction or of chain link fabric and must comply with township regulations.

• Approved fencing, although part of the landscape plan, situated in a setback or association utility easement may be subject to removal as needed at the owner’s expense.

• There shall be no fencing on the side or front of a property. XIV. OUTDOOR SWIMMING POOLS AND EXTERIOR HOT TUBS

A. Swimming Pools Above ground type swimming pools are not permitted within Locust Lake Village. Only approved in ground type swimming pools are permitted within Locust Lake Village.

To obtain approval, a construction plan must be submitted to the Association office and a permit must be obtained.

The construction plan application must include the following: ➢ Size of pool indicating dimensions and depths ➢ Location of pool (plot plan shall be submitted indicating all associated equipment structures and setbacks

). ➢ How pool will be filled (not from well as it will deplete water table). Written documentation must be

provided to Association office upon fill completion. ➢ Drawdown and drainage plan for the pool. Must not impact environmentally or geologically with any

neighboring property. ➢ Type and layout of fence including material composition and dimensions. ➢ Proof of current homeowner’s insurance indicating liability coverage of the pool. ➢ Construction must comply with all State, Township, and Locust Lake Village building code requirements

currently in place. All township approved documents, plans and permits shall be submitted for review.

Approval shall be obtained from the Association manager or designated agent. During construction, the site will be inspected, at least three times:

➢ During preparations ➢ During initial construction ➢ Before final completion

Fencing surrounding swimming pool area is subject to fencing standards set forth in these rules and regulations. Fencing and gate must be in compliance with current adopted IRC building codes of Tobyhanna Township and Coolbaugh Township relating to in ground swimming pools. All pools will have a lockable gate. Pools must be covered during the off-season. Any pool that lapses into a state of disrepair or non-use for a period exceeding twelve (12) months shall be filled in. Property and terrain shall be returned to a state of natural beauty being in compliance with the existing natural aesthetically pleasing guidelines of Locust Lake Village. The property owner must take precautions when applying chemical treatment to pool, assuring these will be environmentally safe and not become harmful to surrounding vegetation and wildlife. All in-ground pools must be placed so as not to be visible from the front of the property.

Small portable child wading pools are permitted with the following restrictions:

➢ Maximum outside dimension may not exceed 8 feet in diameter, length or width. ➢ Pool cannot be capable of holding 20 inches or more of water in depth. ➢ The Pool must be removed and stored from view when not in use for more than 48 hours.

B. Exterior Hot Tubs

Approval for exterior hot tubs is required and a permit must be obtained prior to installation.

To obtain approval, a construction plan must be submitted to the Association office and a permit must be obtained.

The construction plan application must include the following: a. Size of hot tub indicating dimensions, capacity in gallons, and depth. b. Location of hot tub (plot plan shall be submitted indicating all associated equipment structures and

setbacks). c. Drawdown and drainage plan for hot tub. Must not impact environmentally or geologically with any

neighboring property. d. Construction must comply with all State, township, and Locust Lake Village building code requirements

currently in place. e. All township approved documents, plans and permits shall be submitted for review and retention.

Exterior hot tubs shall be built into decks or discretely placed, landscaped and provided with safety covers. Hot tubs must be constructed and placed so as not to be visible from the front of the property.

The property owner must take precautions when applying chemical treatment to the hot tub, assuring these will be environmentally safe and not become harmful to surrounding vegetation and wildlife.

XV. EXTERIOR LIGHTING All lights shall be shielded when necessary to eliminate broadcasting onto adjacent properties and roadways. A. Flood and High Intensity

The use of floodlights or other forms of high intensity lighting shall be limited to those fixtures which may be affixed to the dwelling or garage. Such lighting shall be utilized to light walkways around the home, decking or other immediate pedestrian traffic areas.

1. Low-Level Lighting

Low-level lighting use is limited to driveways, exterior walks, and landscaped areas. Such lighting shall be ground level and may not exceed an installed fixture height of four (4’) feet. Such lighting shall be shielded when necessary to prevent broadcasting onto adjacent properties.

2. Security Lighting

Security lighting (flood light type) is permitted, affixed to home, garage or driveway areas when lighting is on working timer and triggered by movement and once timer is triggered, the light shall not remain on longer than five minutes.

XVI. Satellite Dishes Satellite dishes shall be 18 inches or less in diameter. Shrubbery or other landscaping is recommended. No trees shall be cut down for installation of dishes or other antennae. XVII. EXTERIOR MATERIAL AND COLOR STANDARDS The following requirements shall be met for new homes, additions, alterations, repainting and re-siding the exterior of any building is being performed on any property. Colors and materials shall be selected from the “COLOR and MATERIAL STANDARDS” board on file in the office. A. DECKS 1. All decking shall be constructed of natural wood or Trex-type (synthetic composite) material. 2. Wood decks may be clear coated, stained or painted. B. MATERIALS AND COLOR REQUIREMENTS

1. Foundations which protrude from grade shall be parged, painted, stuccoed, or veneered with natural or synthetic stone.

2. Exterior House Materials a. Building siding shall be wood, vinyl or fiber cement board, metal or bend metal material. b. Trim, fascia and soffit material shall be wood, vinyl, fiber cement board, metal or bend metal material.

c. Natural or synthetic stone may be used as stone facing for a portion of the exterior of a building. 3. Roofing material shall be asphalt shingles, wood shakes or metal. Colors shall be chosen from the ‘COLOR and MATERIAL STANDARDS’ board. 4. All exterior colors for any building on any property for new or refinished work shall be chosen from the ‘

COLOR and MATERIAL STANDARDS’ board. 5. A fine for all construction violations may be assessed to the property owner for not complying with all of the above requirements. (Amend. Bd. Mtg. 10-9-10)

XVIII. Lawns It is recommended that lawns be kept to a minimum size and height in order to maintain as much of the natural environment as possible and to minimize the use of pesticides and fertilizers, due to the effect on wells and lakes. XIX. Lawn Decorations: In order to keep Locust Lake in harmony with nature, the use of commercial lawn decorations are discouraged and are limited to re-creations of animals, plants, flowers, etc. that appear naturally in Locust Lake’s environment. In all cases, decorations must be of natural coloration and construction. Plastic decorations are discouraged but when utilized are to meet the natural coloration.

Owners should bear in mind the visibility of their gardens and ornaments from the street and neighbors. Locust Lake Village strives to achieve privacy in a forested area, so respect for neighbors are paramount. ▪▪▪▪▪▪▪▪▪▪▪▪▪▪▪▪ APPENDIX A – FINES SCHEDULE TRAFFIC AND NON-TRAFFIC VIOLATIONS, ADDITIONAL CONSTRUCTION VIOLATIONS, VANDALISM VIOLATIONS, RENTAL FEE VIOLATIONS ENFORCEMENT OF RULES AND REGULATIONS The power to determine whether a member, tenant, renter or guest has violated LLVPOA Rules or By-Laws and affix assessments is given to the Board of Directors or its agent under the Article VII, Section I, item N of the By-Laws of LLVPOA and Pennsylvania Non-Profit Corp. Law 7403. In addition, further restrictions or actions may be assessed by the Board or its agent when it is deemed to be appropriate. Violations of the Rules and Regulations of LLVPOA including, but not limited to those below, will result in a warning or a monetary assessment in the form of a Citation. The fine schedule is defined and categorized into two groups. THESE FINE SCHEDULE GROUPS ARE LABELED AS TRAFFIC AND NON-TRAFFIC OFFENSES The fine assessment fees are:

$ 80.00 – 1st offense; $150.00 – 2nd offense; $300.00 – 3rd and each succeeding offense in the same grouped category.

Note** There must be a minimum of one (1) year between offenses in the same grouped category to be considered a first offense violation.

Traffic violations, including but not limited to:

Failure to comply with or obey any traffic control device

Violation of MDRV rules and regulations as defined

Use of an unregistered or improperly registered vehicle on Association property

Parking in non-designated parking areas

Operating a vehicle so as to create a hazardous condition or nuisance

Failure to display, in a visible area, the registration indicators issued when the recreational vehicle was registered

Failure to stop for Locust Lake Village Security when requested to do so

Exceeding posted speed limits

Failure to stop for a stop sign

Careless driving or driving too fast for conditions

Fraudulent use of the electronic rear gate, including but not limited to physical lifting of the gate arm, fraudulent use of any gate card, piggyback entry and intentionally circumventing the closed gate arm to gain entry. (Add. 4/22/06)

Non-Traffic violations, including but not limited to:

Operating any motor driven machinery or tools chainsaw before 8:00 AM or after 6:00 PM

Allowing dogs or cats to roam unattended or to become a nuisance

Failure to properly secure garbage resulting in scattering by animals or weather elements

The placement of discarded furniture, tools, equipment, building materials, recreational supplies or other trash by the roadside for longer than seven (7) days.

Unsightly property condition violations

Possession of unlicensed or abandoned vehicles within the confines of Locust Lake Village.

The discharging of unauthorized fireworks, firearms, single projectile weapons, pellet guns within the confines of Locust Lake Village.

Trespassing

Nuisances as defined

Vandalism or damage to private and/or community property

Hunting, fishing and boating violations

Badge policy violations

Beach and swimming area regulation violations

Burning regulation violations

Allowing unauthorized persons to use property owner badges Additional fees and procedures for non-compliant non-traffic violations: 1. A letter and a copy of the page from the Locust Lake Village Rules, Regulations and Guidelines (referencing the violation) shall be sent out to the property owner with the first warning to correct the violation within 7 days from receipt of the letter and warning. 2. A letter and the first citation in the amount of $80.00 shall be sent out to the property owner on the 8th from receipt of the first letter giving the property owner 5 days to correct violation if the violation has not already been corrected. 3. A letter and the second citation in the amount of $150.00 shall be sent out to the property owner on the 6th day from receipt of the previous citation giving property owner two days to correct violation if the violation has not already been corrected. 4. A letter and the third citation in the amount of $300.00 shall be sent out on the third day from receipt of the previous citation giving the property owner 24 hours to correct the violation if the violation has not already been corrected. This letter shall notify the property owner that they will be assessed $100.00 per day for non-compliance and

a loss of all amenity privileges if accrued fines and citations are not paid in full. 5. After 30, 60, and 90 days from receipt of the third citation a statement shall be sent out demanding payment in full for all citations and assessed fines. Along with the 90 day statement a letter stating Locust Lake Village will start legal action for non-payment of past due citations, fines, assessments and to have the violation corrected.( Note: All letters warnings, citations, etc. shall be sent registered mail stating the property owner is responsible for all fees, postage, administration expenses, legal expenses, etc. Pictures including a time date stamp shall be taken of all violations and sent along with the warning, all citations and letters. The head of Security, the manager, one representative of ARC and one representative of the Board of Directors shall inspect the property together

• Intentional vandalism to Locust Lake Village property shall result in assessment of $ 500.00 - 1st offense

$ 750.00 - 2nd offense $ 1,000.00 - 3rd offense Local police may be notified and LLVPOA can pursue criminal prosecution. The fine for cutting/removal of trees without a Locust Lake Village permit or doing so on an expired permit is $250.00. Non payment of rental fee Failure to comply with the rental policy, outlined in Appendix A shall subject the property owner to the following charges: $ 1000.00 – 1st offense $ 750.00 – each subsequent offense

$ 500.00 – each additional thirty (30) day period of non-compliance Any and all legal, administrative and collection costs are incurred by the property owner. APPENDIX C – LOT DEVELOPMENT AND BUILDING FEES 1. FEES

A. General The following work requires a LLVPOA permit. Exterior repair work for 5% or less of an existing condition does not require a permit. Failure to obtain a permit according to below paragraph “B. FEE SCHEDULE “will result in a fine of $25.00 plus the cost of the fee. Permit fee shall be paid by the property owner.

Note: (1) includes tree cutting, footings, foundation, septic module, garage, porch, deck, patio and driveway. (2) There shall be no fee for deck repairs as long as there is no alteration in the shape, style or square footage of the deck. A fee of $25.00 shall be charged when the repair alters the shape, style or square footage. RESPONSIBILITY All fines levied against the property for breach of Locust Lake Village construction regulations and restrictions by the Builder or Property Owner shall be the responsibility of The Property Owner. FINES

1) Any contractor or property owner who performs any type of work such as construction, exterior alterations, painting, staining, roofing and tree cutting without a permit will subject the property owner to a fine.

2) Any contractor or property owner not posting required permits in plain sight on the property prior to commencement of the work specified on the permit or does any work requiring a permit without the issuance of a permit will subject the property owner to a fine.

3) Any contractor or property owner or his agent clearing or excavating land before a permit is issued will subject the property owner to a fine. The fine will constitute an immediate stop of work.

4) Any contractor driving track machines, heavy equipment, or construction vehicles of any type in any road in Locust Lake Village will be responsible for all costs of repairs to the roads & adjacent properties resulting in damages from the above mentioned machinery & vehicles.

5) Non-compliance with the requirements for a dumpster and portable toilets will subject the property owner to a fine.

6) Any contractor who parks construction related equipment and vehicles on any Locust Lake Village road or any LLVPOA owned property overnight will subject the property owner to a fine.

7) Any contractor or property owner who burns stumps, tree limbs, branches or alike within Locust Lake Village will subject the property owner to a fine.

8) Any construction continuing on an expired permit will subject the property owner to a fine. 9) Any contractor making any deviation during construction to the approved documents will result in an immediate

“stop work order” and will subject the property owner to a fine. 10) Any contractor not abiding by The Rules and Regulations requirements for work hours will subject the property

owner to a fine. 11) Contractors who do not notify The LLVPOA Administration Office two days prior to the delivery of a

prefabricated house or a portion there of or the excavation for the footings will subject the property owner to a fine.

12) Any contractor advertisement sign is prohibited. Non compliance with this requirement will subject the property owner to a fine.

13) The property owner or contractor who removes any tree outside the originally approved designated area without the written approval of LLVPOA will subject the property owner to a fine and the owner will be required to plant new trees at least eight foot high conifers or 2 ½” or 3” caliper deciduous trees for each tree removed. It is the owners responsibility to keep the tree alive in perpetuity. Failure to keep the trees alive in perpetuity will result in a fine a fine.

14) Construction violations (e.g. work hours, set-backs, porta potty, dumpsters, exterior painting, siding, etc., of all buildings, etc.): (Amend. Bd. Mtg. 10-9-10)

15) Non-compliance of porta-potty and dumpster, when applicable, will result in assessment of $100.00 for the first offense, followed by a one week notification for Compliance followed by an assessment of $100.00 per day, until compliant. (Add. 10/15/05)
