MULTIFUNCTIONAL COMPONENTSFactors for success in modern lightning protection

Previously, builders of lightning protection systems had to choose from an enormous range ofproducts in order to find the matching components for different connectors and holders. Thanksto our inventions, it is now possible to build a lightning protection system in compliance with regulations using only a few multifunctional components. The multifunctional design of the components offers many advantages:

The idea of multifunctional design means that the individual product is designed as a system withnumerous applications. For this reason, we refer to our components as systems.

The original Multi-Clamp - invented by J.Pröpster in 1981 - has proved itself over and over. It is themost diverse lightning protection component in the world. For universal use as T, cross, parallel, thrustand connection clamp.

The original Vario system - a cost-saving and practical solution for connecting different conductortypes.All parts are interchangeable; manufactured in pressing technique.

Technical information for planners and users (as of December 2001)

The VDE regulations VDE 0185 - DIN 57 185 part 1and 2 and VDE V0185 part 100 (ENV 61024-1) applyto the installation, planning and extension of lightningprotection systems.VDE 0185 section 4.1.2. specifies that lightning protection components must be at least equivalent tothe relevant DIN standards, i.e. their cross-section,corrosion resistance, electrical connection andmechanical strength must comply with these standards.Today’s program of DIN lightning protection components is totally insufficient for the requirementsof modern lightning protection. Some of the parts aretechnically outdated and their corrosion resistancecan no longer withstand today’s environmental conditions.Galvanized wire, for example, used either as conductor wire or as earth connection, may severelycorrode and be no longer fully functional after only ashort time.Our long years of experience with lightning protectiontechnology motivated us to develop a totally new product range, that is technically and qualitativelysuperior to many DIN components. Many of ourinventions and new designs have proved themselvesrepeatedly.Through our work with official agencies and users,we currently feature a complete program of materialsmade in stainless steel, aluminum, copper and hot-galvanized steel.Thanks to the more than 25 years of experience ofthe company’s founder in construction and manufac-turing, we can expediently carry out special orders.Benefit from our expert know-how; contact us anytime with your lightning protection problem.Important note:Many lightning protection systems, e.g. on churchtowers, or high-rise buildings, are difficult to access.The system components are subjected to greatmechanical stress and should therefore be made ofhigh-quality and stable materials. Componentsmade of plastic should not be used for industrialsites with extreme snowloads and/or a highly-polluted atmosphere.The information about possible application areas forour products is intended as product-specific infor-mation only. The application technology examplessupplied by us in writing and diagrams are the resultof many years of experience and are made to thebest of our knowledge. Concerning the legal validity of standards and VDE regulations

The regulation for the implementation of the Law onthe energy industry (Energiewirtschaftsgesetz) determines that electrical plants and equipment mustbe installed and maintained in compliance with thegenerally accepted rules of electrical engineering.“The regulations of the Association of German Electrical Engineers (VDE) are the accepted rules ofelectrical engineering.” The definition of “generallyaccepted rules of technology” was legally specifiedby the decision of the German “Reichsgericht” from10/11/1910. This decision still remains in force today:“The rules of technology are considered generallyaccepted, when the experts who are applying therules are convinced that the said rules are in compliance with the safety requirements. It is not sufficient that technical journals or technical schoolssupport the opinion that a specific rule complies withthe technical requirements. The technical rule mustbe well-proven and accepted in praxis. It is insignificant, if individual experts or a small groupof experts do not accept or know the rule in question.The most decisive factor is the general opinion thathas formed among experts.”The term of accepted rules of technology surpassesthe DIN standards; the DIN standards are sub-ordinate to the accepted rules of technology.The Trade Control Board has the right and responsibility to require the elimination of defects forequipment that poses a safety risk and to prohibit thedistribution of such equipment if the precisely defineddeficiencies are not repaired. There does not, however, exist any legal foundation that requires acertain type of construction. The regulations for thecreation of VDE rules and standards define that rulesfor construction are to be avoided as well as “statements that give the impression that legalpowers are to be exercised”.Technical development is the result of private initiative and research. Commissions can define butnot establish the current state of development andsafety standards for the general benefit. It must bepossible at all times to achieve and, if possible, surpass the defined technological standards andsafety requirements.

Partially insulated systems are more common. To designsuch a system, the well-known mesh method is used to install an interceptionsystem. In recent years, the roof top installation of electronically controlled equipment, such as air conditioning systems,ventilation devices and ducts, solar and photo-voltaic panels, metal chimneys, cyclones as well as radio linkand mobile radiotelephone antennas, has become increasingly popular.The protection of this equipment from direct lightning strikes requires common overvoltage protection, as wellas additional insulated lightning protection systems.The latest IEC standard 62305 addresses this issue.

4.Lightning protection interception polefor block foundations

This system was developed to protect objects and installations, such aspotentially explosive areas, current distributors, transformer plants or otherplants with especially hazardous areas. To ensure compliance with currentstandards VDE 0185/1, /2 and ENV 61024-1, we recommend the installationof an insulated lightning interception system using interception poles.Installation of several poles results in a fictitious interception conductor (VDE 0185/1). With this method, it is also possible to completely encase larger objects within a protective zone and avoid bridging a horizontallyinstalled interception conductor.

The interception pole is imbedded in a concrete block foundation that mustbe prepared according to the manufacturer information provided by us. Askfor our data sheet JP-LPH/BFM with all the important information aboutblock foundations.

1. General:

All deliveries are subject to our terms, even if the buyer specifies differentterms. Any arrangements that have not been included in the confirmed orderor that have not been confirmed by us in writing, are non-binding.

2. Proposals:

If not arranged otherwise, our proposals are non-binding and non-comitting.

We do not accept any responsibility and liability for any malfunction and otherdefects of products that we manufacture according to the design plans of thecustomer, if the malfunction and defects can be linked to the customer’sinstructions. Documents, such as figures, drawings, information about weightand dimensions of products represent only approximations; unless suchinformation is described as “binding”. We reserve the copyright for all costestimates, drawings and other documents. Any such documents become ourproperty and may not be disclosed to third parties. Any infringements areliable for full damages. In case of infringement, we also reserve the right towithdraw immediately from a contract. Constructional designs are alsosubject to change. Drawings and other documents included in our bids mustbe returned to us or paid for immediately as requested, if a contract has beengranted. The amount of the payment will be determined based on economicfactors.

3. Ordering, Contracting:

Orders are only valid once they have been confirmed by us in writing. An order can also be confirmed by posting a bill.

4. Prices

All prices are in EURO not including sales tax. If not agreed upon otherwise,all prices are factory prices including standard packaging. Sales tax will becalculated based on the valid rate on the day of delivery. From the list prices,any agreed upon rebates will be deducted. We reserve the right to re-calculate the prices for products or energy costs that are associated withan official authorization, if the official authorization takes effect in the timebetween contracting and product delivery. Additionally, we also reserve theright for a re-calculation, if collectively agreed upon wage and salaryincreases have taken effect in the time between contracting and productdelivery. The prices listed for components made of copper, brass or redbronze are based on a DEL copper quote of 153.39 EURO. Should the DELquote rise over 12.78 EURO per 100 kg, we will charge an additionalnonferrous metal fee. The price calculation is based on the DEL quote of thefollowing day after the order has been confirmed. If one of our cost pricefactors is excluded from the price fixing process and a traceable cost pricefactor arises subsequently, we will be authorized to re-calculate the price, ifthe price increase occurs in the time between contracting and productdelivery. The prices listed are non-binding, recommended prices. They mustbe increased or lowered by our customers, if the customers sell our products.

5. Payment terms

If not agreed upon in writing, all payment must be paid in full within 8 daysafter invoice date with a 2% discount or within 30 days after invoice date.Payment is automatically considered overdue, the day after these appointedpayment dates have expired. A payment reminder to establish the debt is notrequired.

We reserve the right to charge overdue payments first to the cost, then to theinterest and thereafter to the oldest, still outstanding bills, even if thecustomer makes different payment arrangements at the time of making a payment. If, after closing of a contract, we are informed that a customer willnot be granted a credit that is intended to pay for the cost of the contracteditems, we are entitled to ask prepayments or security deposits for alldeliveries or to withdraw from the contract. If prepayments or securitydeposits are not made within the time period appointed by us, we are entitledto claim damages due to default. If the customer falls behind with makingpartial or full payment, all of our payment claims become due immediately.

The buyer has no right to retain or reject the services owed to him. From thedue date of the payment, the buyer will be charged with late interest that is2% higher than the interest normally charged by our bank. For orders with a net value (value of items without shipping costs and sales tax) of less thanEURO 40.00, a minimum charge of EURO 5.00 will be added. Cash sales areexcluded.

6. Reservations of Ownership

Delivered goods remain our property until they are paid in full and allpayments as specified in the terms of payment have been settled. The buyer’s claims from the resale of the reserved goods and/or furthermanufacturing steps involving the use of our goods are fully transferred to us.Further marketing of our goods is only permitted within the context of properbusiness operations. If the buyer sells or delivers the reserved goods with orwithout further processing, together with other goods that are not ourproperty, the buyer can only present claims that equal the value of thereserved goods. The buyer has no other rights of disposal concerning thereserved goods. Furthermore, if we request so, the buyer is obliged to informsus about his buyer and the arranged selling price and to report to his debtorthe transfer of the payment.

7. DeliveryThe agreed delivery times commence on the day on which the contractbecomes legally effective. Unforeseen events, such as war, mobilization,natural phenomena, uncontrollable disturbances of normal factory operations,delayed delivery or quality defects of raw materials etc., damaging ofimportant work pieces, or difficulties of various kinds due to unstableeconomic conditions, entitle us to extend the delivery time, until these eventshave been eliminated. We are also entitled to withdraw from the contract ifany such events occur, even if we had already extended the delivery timepreviously. The buyer is not authorized to cancel the contract due to any suchevents or to claimd damages. 8. ShippingThe delivery is considered to have taken place as soon as the goods havebeen shipped out from the factory or the storehouse, even if carriage paiddelivery has been arranged. Upon the buyer’s request and at his costs, wecan insure the delivery against breakage, transport or fire damage.9. Guarantee and liabilityAny claims due to incomplete and/or faulty delivery or defects of the goodssupplied must be made in writing immediately after receipt of the goods. We are entitled to take back faulty goods, to issue a credit or to replace withfaultless goods, if the defect has been claimed immediately. This applies alsoto defects that were not recognized during the immediate entry inspection.We do not warrant defect and damages if the goods have been modified orinstalled incompletely. Further claims by the buyer, such as transformation,reduction of the purchasing price, damages, as well as claims brought forthby third parties are excluded. We are only liable for damages arising directlyon the delivered item. We are not liable for any losses or other damagesincurred by the buyer. The liability is not affected in case of intention or grossnegligence. The liability becomes ineffective if the buyer has claimeddamages due to default because the product is lacking an advertized propertyaccording to §§ 463, 480 II BGB (German Civil Code). Compensation islimited to predictable damages. If we infringe upon the agreed contract out ofgross negligence or if fault can be established for an indebtedness at the timethe contract becomes effective, our liability is limited to standard contract,predictable damages. We deliver only functional goods. A warranty for using the goods for thepurpose intended by the customer can only be given, if we have issued ourexpressed written consent.So far as our liability for damages is excluded or limited, it can also be applied to any other claims, including claims due to indebtedness at the time the contract becomes effective, infringement of minor obligations and claims arising from the producer’s liability according to § 823 BGB(German Civil Code).The above paragraph does not apply to claims according to §§ 1, 4Produkthaftungsgesetz (Product Liability Law) or for claims due to inability orunforeseen events.So far as our liability is excluded or limited this also applies to the personalliability of our employees, representatives, deputies and assistants.Any liability claims cease in agreement with § 477 BGB (German Civil Code),excluding claims arising from the producer’s liability according to §§ 823 cont.BGB (German Civil Code).10. Returning goodsDelivered products can only be returned in exceptional cases and only withour approval. The goods must be originally packaged. Goods that have beendelivered more than 3 months ago cannot be returned.In order to cover the costs for handling returned goods, we charge a returnfee amounting to 10% of the goods’ net value. If, for special reasons, weagree to take back unpacked parts or parts that are not in their originalpackage, a fee for new packaging amounting to 10% will be added to thereturn fee. Transport costs for returned goods will not be paid by us.11. Data protectionThe buyer’s data that concern our business relationship will be handledaccording to the Federal Data Protection Law.12. JurisdictionGerman law is applicable to the contractual sales and delivery terms and toall resulting contractual and commercial relationships. The UN AgreementAbout Contracts for the International Sale of Goods (CISG) from 04/11/1980is not applicable.Place of fulfillment and jurisdiction for delivery, payment and any kind ofliabilities, including such resulting from payment by draft or check, is the cityof Neumarkt/Opf.Invalidity of one part of these terms of delivery does not affect the other partsof this agreement. In this case, the invalid part is replaced by the currentlylegal regulation.Any changes or alterations of these terms of delivery require the writtenconsent of the seller.
