Friedrich Wilhelm Heinrich Alexander von Humboldtwas born September 14, 1769, in Berlin, Germany, to Alexander Georg and Maria Elisabeth vonHumboldt. Known as the father of ecology, Alexander von Humboldt influenced great 19th centurynaturalists and explorers such as Charles Darwin, John Charles Fremont, John Muir, and Henry

LIBRARY: REQUEST FOR WAIVER OF THE ATTRITION POLICY (FOR POSSIBLE ACTION) -Consideration, discussion, and possible approval of a request for a waiver of the attrition policy fromJessica Anderson, Acting Library Director, for the recruitment of a Library Specialist for the DenioBranch Library, at 25 hours a week to replace the current Denio Library Specialist position currentlyfilled by Sherry Ranf, who will be retiring on October 3rd, 2019. The Denio Library is open foroperation for 20 hours a week, but the position also accounts for outreach, such as to the Field'sSchool, and programming which runs outside of normal library hours. Without this position, the otherpart-time support position, which is 10 hours a week, will be unable to maintain the full operation ofthe Denio Library. . For discussion and possible approval.

REQUEST TO CONDUCT SYSTEM ENGINEERING WORK FOR HUMBOLDT COUNTY TRAPCLUB SEPTIC SYSTEM AND POSSIBLE UPGRADE OR NEW SEPTIC INSTALLED (FORPOSSIBLE ACTION) - Consideration, discussion, and possible action regarding an update on thecurrent septic system and possible plan to connect that system to the new building beingconstructed on the site, to include, but not limited to hiring an engineer to make plans to connect thecurrent system or engineer a septic system that can connect to the building, in an amount not toexceed $5,000. The regular meeting of the Humboldt County Board of Commissioners was called to order on Monday, February 1, 2016, at 9:30 a.m. in the regular place of meeting at the Courthouse, Winnemucca, Nevada. Those present were Chairman Marlene Brissenden, Commissioners Garley Amos, Jr., Mike Bell, Ron Cerri and Jim French, Deputy District Attorney Gabrielle Carr, Administrator Dave Mendiola and Clerk of the Board Tami Rae Spero. PUBLIC COMMENTS: Chairman Brissenden asked for public comments. There was no public comment. DISCUSSION & ACTION ON CORRECTION/APPROVAL OF MINUTES – SEPTEMBER 21, 2015; OCTOBER 5, 2015; OCTOBER 19, 2015; NOVEMBER 2, 2015; NOVEMBER 16, 2015; DECEMBER 7, 2015; DECEMBER 21, 2015; JANUARY 19, 2016; FEBRUARY 1, 2016, REGULAR MEETINGS AND OCTOBER 15, 2015; JANUARY 11, 1016 AND JANUARY 25, 2016 SPECIAL MEETINGS: No minutes to approve. UPDATE ON LITIGATION IN FEDERAL COURT INITIATED BY WESTERN EXPLORATION, LLC, ELKO COUNTY, NEVADA, EUREKA COUNTY, NEVADA, AND QUANTUM MINERALS, LLC, FOR DECLARATORY AND INJUNCTIVE RELIEF TO BAR THE FEDERAL AGENCIES FROM IMPLEMENTING THE NORTHEAST CALIFORNIA/NEVADA SAGE GROUSE LAND PLANNING AMENDMENT (LUPA): Commissioner French offered a general update regarding LUPA Amendment for Bi-State. The Amendment will effect Douglas, Mineral and Esmeralda Counties. MISCELLANEOUS REPORTS AND CORRESPONDENCE: OTHER INFORMATION AND UPCOMING MEETINGS: Chairman Brissenden noted upcoming meetings. Deputy District Attorney Carr told the Commission the February 11, 2016 RPC meeting might be cancelled. REPORTS FROM COMMISSIONERS REGARDING OTHER BOARDS AND COMMITTEES THE SERVE ON: Commissioner French reported he attended the SLUPAC meeting. They decided to involve SLUPAC Board of Directors with fully implementing the State water-planning project. SLUPAC is working with NACO to engage the legislative mandate regarding RS2477 roads in Nevada. They will be involved with developing

recommendations for the Legislature. Commissioner French said he has a meeting with the AG Extension on Wednesday, February 3, 2016. Commissioner Cerri reported he attended the Elk Planning Steering Committee meeting. Commissioner Amos will be attending the Humboldt River Water Basin Authority meeting this month. Commissioner French reported he attended the Source Water Protection meeting with NDEP. He reviewed what has been accomplished, to this point. He will provide the Commission with a copy of the information gathered. Commissioner French told the Commission the Source Water Protection team would be presenting the entire document on March 9, 2016 to the public for comment. APPROVAL OF EXPENDITURES: A report identifying the expenditures being considered was attached to the agenda for review. The following motion was made by Commissioner Amos and passed unanimously: To accept the expenditures for January 14, 2016 through January 27, 2016 as presented. CONSIDERATION & POSSIBLE APPROVAL OF THE 2016 BOARD OF COUNTY COMMISSIONERS RETREAT LIST OF GOALS & PRIORITIES AS DISCUSSED DURING THE RETREAT ON MONDAY JANUARY 25, 2016: A copy of the Retreat Directives, Goals and Projects from the 2016 Humboldt County Commission Retreat was included on the on-line agenda for review (see attached). Chairman Brissenden read the list of goals and priorities discussed during the January 25, 2016 Retreat. The following motion was made by Commissioner French and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To accept the directives, objectives, goals and projects for the 2016 Humboldt

County Commission Retreat as presented. STATUS UPDATE, REVIEW & DISCUSSION OF NUISANCE COMPLAINT 4215 WALTHER LANE: Photos of the property identified as a nuisance was included on the on-line agenda for review. Administrator Mendiola reported Bobby Thomas visited the property and provided photos; that the burned out building, they were concerned about has been removed but there is still debris on the property. Chairman Brissenden told the Commission she visited the property and it looks fine. The following motion was made by Commissioner Bell and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: The property at 4215 Walther Lane owned by Johann Lyon is no longer a nuisance. ROAD MATTERS – REPORT OF PENDING ROAD DEPARTMENT PROJECTS: Road Superintendent Ben Garrett appear before the Commission. Mr. Garrett reviewed the pending road department projects on the agenda. Chairman Brissenden asked about the road at Water Canyon between the cattle guards. Mr. Garrett said it was too wet to check. Once it is dry, they can address the issue. Commissioner Cerri asked about the status of roads after all the storms. Mr. Garrett commented on the status of the roads. Commissioner Cerri commented on the creeks being full and the borrow pits. There was discussion regarding the ditches and what it would take to bring them back. Mr. Garrett noted that there is not enough gravel to fix all the roads.

CONSIDERATION OF, DISCUSSION & POSSIBLE APPROVAL OF HUMBOLDT COUNTY BICYCLE PLAN AS PART OF NDOT’S STATEWIDE BICYCLE PLAN: Included on the on-line agenda for review were copies of the Draft Humboldt County Bicycle Plan created by the State of Nevada Department of Transportation (NDOT) and a map of the proposed routes. Bill Story, Manager Bicycle & Pedestrian Programs for NDOT and serving as the designated federal Bicycle Pedestrian Coordinator for the State of Nevada appeared before the Commission. Mr. Story gave an overview of the State Bicycle Plan. They visited the Rural Counties and what they heard was a plan which would be great for the communities. They were able to secure funding to write bicycle plans for all 17 rural counties. In 2013, they began to go to all the Counties and hold workshops. The public provided input; they looked at existing conditions by driving as many roads within the County as they could. After looking at the County vision compared to the State’s vision, they made recommendations through the local plans. Mr. Story reviewed the findings from Humboldt County. This included the positive and negative aspects in the area. He reviewed the vision and goals for the Humboldt County Bike Plan. Mr. Story presented information on the National Bike Route Plan. Mr. Story presented a map of the Humboldt County Bike Route Plan. This included the high priority projects for the Humboldt County Bike Route Plan. Commissioner Cerri asked if the plan has been presented to the City Council, specifically regarding the routes that are within City Limits. Mr. Story said this is a County Plan. He said one of the reasons Humboldt County ranked high is because of the existing wide roadways. Commissioner Cerri asked who would pay the cost. Mr. Story said the local governments could pay the cost. There is also federal money through some programs and sometimes, state money is available. Commissioner Cerri asked if they could use money from RTC. Mr. Garrett indicated if the City was involved, funds from RTC could be allocated for use. There was discussion regarding the use of RTC funds. Mr. Story told the Commission this is a plan and explained how it would work for future projects. The following motion was made by Commissioner Bell and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To approve the Humboldt County Bicycle Plan as part of the NDOT Statewide Bicycle Plan. CONSIDERATION OF, DISCUSSION & POSSIBLE APPROVAL OF AN AGREEMENT BETWEEN DATAPRO SOLUTIONS, INC AND HUMBOLDT COUNTY TO IMPLEMENT NOVATIME LABOR COST MANAGEMENT SOFTWARE: Administrator Mendiola asked the Commission to table this item to the next meeting, as negotiations are ongoing. PUBLIC SAFETY RADIO SYSTEM - CONSIDERATION OF & POSSIBLE APPROVAL OF AN AGREEMENT BETWEEN RADIOSOFT, INC FOR FCC LICENSING SERVICES IN THE AMOUNT OF $11,730.00 TO FILE NEW VHF FREQUENCIES: Included on the on-line agenda for review were copies of invoices from Radiosoft Inc. Administrator Mendiola explained this is an ongoing piece of the public safety radio upgrade. He reviewed the reason for the request. Commissioner French asked for clarification that the CSI plan identified the upgrade. Administrator Mendiola indicated this is correct. PUBLIC SAFETY RADIO SYSTEM – CONSIDERATION OF, DISCUSSION & POSSIBLE APPROVAL OF AN AGREEMENT BETWEEN SUMMIT ENGINEERING AND HUMBOLDT COUNTY FOR ENGINEERING SERVICES AT THE WINNEMUCCA MOUNTAIN SITE IN THE AMOUNT OF $7,135.00 : Included on the on-line agenda for review was a copy of the proposed Agreement for Professional Consulting Services with Summit Engineering Corporation. Administrator Mendiola reviewed the request for an agreement for Summit Engineering to obtain soil samples and core the concrete foundation at the Winnemucca Mountain Tower site. The testing would be to determine the comprehensive strength of the cores to assist in determining the best options for a new Radio Communications Building. Administrator Mendiola reviewed the CSI findings during subsequent assessments for sites and the current issues at the Winnemucca Mountain Tower site. He told the Commission the options available and the cost suggesting that the best and least costly option would be to construct a new building and tower on the existing foundation. Commissioner French commented on the other uses on the site that are either authorized or not authorized. He asked if there is a P&P in place and would this require a building permit. Commissioner French asked what assurances are in place so there is not continued unauthorized use of the property. Administrator Mendiola responded that a P&P manual was received prior to the CSI report. There is nothing in place today. This is something that will be put in place at all of the sites. He told the Commission that Building and Safety Director Bobby Thomas has reviewed and identified issues as well. Commissioner Cerri asked if they build a new structure would the old building be demolished. Administrator Mendiola said it could go either way but it would be best to demolish the building. The following motion was made by Commissioner French and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To approve the proposal for an agreement between Summit Engineering and

Humboldt County for engineering services in the amount of $7,135.00 at the Winnemucca Mountain Tower Site for soil sampling and core concrete foundation.

The Commission took a recess at 10:22 a.m. reconvening at 10:27 a.m.

CONSIDERATION OF AND POSSIBLE APPROVAL OF A REQUEST FROM THE CITY OF WINNEMUCCA CONCERNING THE WINNEMUCCA SEWER TREATMENT PLANT PROJECT: The agenda noted that the City of Winnemucca will need to utilize portions of some road rights of way to install the lines associated with connecting the existing City sewage treatment plant with the new City sewage treatment plant; accordingly, the City is requesting permission from Humboldt County to utilize certain of the existing County right of ways to install the infrastructure for the sewage treatment plant connections. Presented as part of the Agenda was a memorandum from City Attorney O. Kent Maher to District Attorney Michael Macdonald detailing the request (see attached) including images of the proposed locations. City Manager Steve West and City Attorney O. Kent Maher appeared before the Commission. City Manager West updated the Commission on the status of the Sewer Treatment Plant Project including the reasons for the project, the cost of the project, the financing for the project and the process used to determine the appropriate site for the plant which would be out on Jungo just east of the railroad tracks on a section of

BLM land; he discussed the current plan and the long term plan for the site. Manager West continued explaining the process that will be needed to transfer the sewage to the new site which will include the construction of a pipeline and he explained the best route for this pipeline which will require the Commission’s approval for use of County rights-of-way. Mr. Maher stated that assuming this request is approved, the pipeline will be put into existing right-of-way the entire way except where it is on railroad property or City property but this approval must be in place to do the USDA financing. Discussion occurred regarding the Sagebrush LUPA related to sage grouse with Manager West confirming that this plan does not involve any sage grouse habitat. Deputy District Attorney Carr noted that the memorandum from the City Attorney had requested specific language on the agenda and that language was not used, she asked City Attorney Maher if this item was time sensitive or if this item could be placed on the next Commission agenda using the requested language. Mr. Maher discussed how the process would proceed but agreed that two weeks would not create an issue. Deputy District Attorney Carr recommended that the matter be placed on the next agenda using the exact language requested in the memorandum to more fully comply with the Open Meeting Law. The Board concurred.

CONSIDERATION OF & POSSIBLE APPROVAL OF SELECTION OF TWO APPRAISERS FROM RFP TO CONDUCT APPRAISALS ON COUNTY PROPERTIES: Included on the on-line agenda for review was a list of parcels to be appraised, a copy of a proposal from Howard N. Stockton of Stockton & Associates, LLC and a copy of a proposal from William G. Kimmel Real Estate Appraiser & Consultant. Administrator Mendiola reviewed the request and gave a brief history. A list of appraisers was compiled and a request for qualification was sent. Eight appraisers were identified. An RFP was sent and five were received out of the eight. Administrator Mendiola told the Commission the two appraisers chosen. One appraiser will do all fourteen sites and the other appraiser will appraise eleven sites. Three of the fourteen sites are airport parcels. The Airport Board and Humboldt Development Authority wanted a second appraisal on these three sites. Administrator Mendiola explained that one of the eleven properties is in Paradise Valley and that the County has agreed to first right of refusal for Mr. Stempeck. The other properties will go to auction. He has received information that may result in one of the properties being pulled from the appraisal list. This site would be a prime spot for a communications tower. Deputy District Attorney Carr explained one of the requirements of NRS 244 is that the qualifications of the appraisers have to be verified. She will work with the County Administrator to confirm they have the required qualifications. Commissioner French commented that one of the applicants wanted a deposit up front prior to the start of the project. He said he is not comfortable with this request. County Administrator said he has spoken with the appraiser (Stockton) and he will be adjusting his bid. The following motion was made by Commissioner Bell and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To approve the two appraisers from the RFP responses for conducting the

appraisals in Humboldt County on our properties. CONSIDERATION OF & POSSIBLE APPROVAL OF A REQUEST FROM THE SENIOR CITIZENS OF HUMBOLDT COUNTY FOR A DRAW-DOWN OF BUDGETED FUNDS ($7,500.00) TO COVER PROGRAM SERVICE EXPENSES FOR THE FIRST & SECOND QUARTER 2015-2016 FY HELD AS MATCH FUNDING FOR THE COUNTY TRANSIT PROGRAM: A copy of the letter of request for transit program match funding for the

2015-2016 financial year from the Senior Citizens of Humboldt County, Inc. was included on the on-line agenda for review. Administrator Mendiola reviewed the request. Deputy District Attorney Carr asked for clarification if this is a request for a grant. Administrator Mendiola said this is a grant, which has already been received. They have to come to the County to request the money. The following motion was made by Commissioner French and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To approve the request from the Senior Center of Humboldt County

for a draw-down of budgeted funds for $7,500.00 to cover the program service expenses as defined.

REGIONAL AIRPORT BOARD – CONSIDERATION OF & POSSIBLE APPROVAL OF APPOINTMENT OF HUMBOLDT COUNTY COMMISSIONER TO REGIONAL AIRPORT BOARD: Chairman Brissenden read into record letters received from Doug Glenn and Richard Robie voicing concerns about landing the helicopter at the Airport (item B). Administrator Mendiola asked which item, A or B, are they dealing with. Deputy District Attorney Carr said to start with item A. Commissioner Bell stated his interest in serving on the Airport Board; Chairman Brissenden stated she is also interested. Commissioner French said he spoke with Steve West about having a County Commissioner on the Airport Board parallel to the City Council position and that Mr. West thinks this is a good idea. Commissioner French said he supports the idea of having a presence on the Airport Board as his would be an opportunity for the Commission to provide input. Commissioner French voiced his concern with Commissioner Bell serving on the Airport Board referring to the controversy regarding the MedX helicopter. Commissioner French said they have never heard from the Airport Board regarding this issue and that his concern is the particular item causing the controversy started with the MedX AirOne helicopter proposal. Commissioner French said he would hope with Commissioner Bell’s connection with EMS there would be no agenda on his part and that he would be objective. Commissioner Bell stated he has flown for many years, has an interest in aviation, has extensive experience in budgeting and he that can remain unbiased. He continued to state that MedX AirOne is its own company and there is no benefit to the hospital. Chairman Brissenden stated her intent is to be an oversight for an objective point of view and keep the Commission up to date on what is going on with the Airport Board. Commission Cerri voiced his support for Commissioner Bell given his aviation experience and knowledge. Commissioner Amos agreed that Commissioner Bell is someone familiar with aviation. Commissioner French said he recognizes Commissioner Bell’s experience and knowledge but his worry is that it is an objective appointment. The following motion was made by Commissioner Cerri and passed with Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye. Chairman Brissenden voted nay stating she feels there would be a serious conflict of interest with Mike Bell being on the Airport Board: That they appoint Mike Bell to fill the vacant position, representing the

County Commission, on the Regional Airport Board. REGIONAL AIRPORT BOARD - CONSIDERATION & POSSIBLE ACTION, INCLUDING REVERSAL OF RECENT DECISION TO APPROVE HELICOPTER LANDING BY MEDX AIRONE: Deputy District Attorney Carr asked for clarification on the item. Is this a decision of this Commission or a decision of the Airport Board? She

asked if the Commission has oversight authority over the Airport Board. If someone did not like a decision of the Airport Board can it be appealed to the County Commission? Commissioner French explained under the cooperative agreement the Commission and Council have the appeal power relative to any issues developed out of the Airport Board. Under those provisions, that is what was requested from Mr. Robie. Deputy District Attorney Carr asked if the Commission has had an opportunity to review the decision and the materials considered by the Airport Board. The Commission indicated they have. Commissioner Bell said he reviewed and believes the City should be involved; he also questioned legally, how much they could override an FAA decision. He said he has many questions and would not be comfortable making any kind of decision at this time. He stated he would also like to get some legal opinions as well. Administrator Mendiola indicated the information provided to the Commissioners is from Steve West based on what actually happened at the Airport Board meeting which included what was considered, as well as the opinion by the FAA and the County’s liability underwriters. Commissioner Cerri said he heard they were building a hangar on Haskell Street so will this request be for the short term? Commissioner French said the proposal is to use the hangar at the airport for maintenance. Steve West, Airport Manager, said he has attended all of the meetings regarding the decision and that what this boils down to assessing and analyzing what the risk is and whether any risk is acceptable. There were many different viewpoints expressed when this was initially proposed. At that time, it was not controversial. He called the airport consultants in Colorado. They looked at Google and determined there was plenty of width for landing. He also asked Randy McCoy, a long time FBO operator at Winnemucca with substantial airport experience. Mr. McCoy indicated there was no problem with landing a helicopter at that location. Indirectly they talked with another individual who indicated, after looking at the site on Google, there was not a problem landing at this location. The item was discussed at the first Airport Board meeting, which is when the discussion became very heated. There were opinions that it was too much liability to accept. Mr. West commented he did not know how you analyze a liability or risk to that degree. He said they had several conversations with the helicopter operators. They voiced their concerns and commented on risks involved. The Board weighed what was good for the operator and the potential liability for the City, as owners. Mr. West said it was difficult with the same 3-2 vote from the Board. Mr. West said he spoke with the Insurance Pool, who spoke with the underwriters for the airport part of the City’s insurance policy. The conclusion was there is no, unnecessary liability in the situation based on the facts provided. Commissioner French said MedX AirOne is not the only company who flies helicopters in and out of the airport; he said going back 25 years ago, NDOW flew in and out of the airport. Commissioner French said his concern is setting a precedent. He said pilots could get the impression that pilot discretion dictates where they land. He commented what is being proposed is not a make or break proposal. Commissioner French voiced his concerns and commented they are looking at convenience versus safety. He said there are policies that were part of the allowance of the helicopter to land at the airport. He gave examples of some of the policies that cause him concern. Commissioner French commented on the minutes from the Airport Board Meeting and things that have happened since regarding allowing the helicopter to land at the airport. He also commented on the new hangar and landing pad to be built. Mr. West said Commissioner French’s summary of what happened was a good summary. He told the Commission about the conversation he had with the MedX AirOne owner regarding manually moving the helicopter. The helicopter operator is the best person to make the determination of the safest location to land. Mr. West

told the Commission the three members who voted for this felt the best person to make the decision of where to land is the pilot. Commissioner French said there are assumptions being made, the first is in landing the helicopter there will never be an issue and the second is that all the pilots have good, solid judgement relative to where they will put down the helicopter. With a heliport, there is a specified place to land. Mr. West said most of the concerns went away with the Hospital Board’s decision to build the hangar on Haskell St. as that will reduce the number of landings at the airport. The only time they would need to land at the airport is if there was already a second helicopter requiring maintenance or they had to get out of the weather. Commissioner French commented the helicopter would need to land and be pulled into the hangar at the new location. Mr. West said he was told there is not the distance to move the helicopter into the hangar at the new location. Commissioner Bell said he does not think there is enough information, that he would like to talk to the City, pilots, and other people to gather more information and to make any kind of decision today would not be in the best interest. Commissioner French said if this item is tabled, they will lose the thirty-day window and they would no longer have the veto option. Deputy District Attorney Carr commented on her understanding on the way this was directed and recommended a joint meeting with the City and County to consider a veto of the decision. Deputy District Attorney Carr shared information provided by Mr. Maher, City Attorney, to Mr. Macdonald, District Attorney from Wayne Carlson with Pool Pact insurance, hey confirmed no coverage concerns. There was discussion regarding a date for a special meeting. Commissioner Cerri said this is twice in the last month they have been asked to reverse a board’s decision and that he does not want to do this lightly and does not have enough information so he would want to go over the minutes and hear both sides, that there is not enough information to make a decision today. Discussion ensued regarding a special meeting with the City Council and County Commission. TESTIMONY & INFORMATION OPPOSING INTRODUCTION OF ELK INTO GRAZING ALLOTMENTS AND NEARBY PRIVATE LANDS: A copy of a document entitled “In Re: Opposition to Elk Occupation of North-Central Nevada” was included on the on-line agenda for review (see attached). Chairman Brissenden read the request by Bob Schweigert, Range Consultant representing DeLong Ranches, Happy Creek Ranch, Alder Creek Ranch, Knott Creek Ranch, and Oro Vaca, Inc. to supply testimony/information opposing the introduction of elk into their perspective Grazing Allotments and nearby private lands. Regarding the science supporting the Humboldt County Elk Management Sub-Plan, in its December 18, 2015 draft version presented to the Commission at the January 14, 2016 meeting. Mr. Schweigert and his clients would like the Elk Management Plan to be modified to reflect that the subject areas are to be managed as “elk free zones” and have the Commission consider this testimony/evidence in their final response to the Elk Management Committee prior to NDOW’s final consideration of the Elk Management Plan in late March 2016. Bob Schweigert appeared before the Commission and stated a number of his clients have written letters to the Commission and other entities expressing their concerns over this issue. He asked if the Commission had any questions about the letters. There were no questions. Mr. Schweigert said he attended a meeting on January 26, 2016 and was astonished by the lack of knowledge of the Committee Members regarding water rights and federal gazing allocations. Commissioner Amos asked if there are elk in the areas. Will DeLong and Buck Johnson from Alder Creek indicated there are none at this time. Mr. Schweigert said Eddie Booth, the committee chair, assigned a technical review team to answer the questions but that he has not had a chance to meet with Mr. Booth. Mr. Schweigert said he has problems with the plan as it stands. There are legal and biological issues along with questions about compliance. The legal issues include all decreed water and forage allocation. There is none for the elk. There are elk establishment issues, LUPA with no reference to elk, NEPA compliance; Forest Service Plan has no reference to elk in the Santa Rosa area. Biological issues include issues with historical habitat – not here, how that deals with water usage. Commissioner Cerri explained why they want the plan now rather than later. He said the plan is not perfect. He is not sure how to address the water issue. Commissioner Cerri said the Chairman of the Committee has asked NDOW to look into this. He said he agrees with the concern regarding forage allocation. The elk are not being introduced they are pioneering. Commissioner Cerri commented they are better off to have a plan for when and if the elk ever pioneer in other areas than to wait to come up with a solution. He commented on the number of elk in the past, which are not many and the difference between an established herd and one that is passing through. Commissioner Cerri said he understands the concerns but feels it is better to have a plan than to not have a plan. Mr. Schweigert commented on the current number of elk in different areas. He said NDOW has not proven they can keep the elk population at the target numbers. Commissioner Cerri said the plan includes triggers and explained how those triggers will work. Commissioner French asked what would Mr. Schweigert suggest, from NDOW’s perspective, to maintain the target numbers. Discussion ensued regarding options to maintain the target numbers. Commissioner French referred to the historical existence of elk in Humboldt County. Commissioner Cerri commented there would be a team in place made up of different agencies (NDOW, BLM Forest Service, farmers, Forest and BLM permittees) and that the team will meet at least annually to address any problems that may arise sooner than later. Mr. Schweigert commented he has

concerns and issues with the triggers. He said he is hearing, from the Commissioners, that they are willing to approve a plan, which will not be effective. Commissioner French said the plan being considered is fluid and will be visited and modified often but that they have to start somewhere. Commissioner Cerri commented on the recent aerial survey on the Oregon side, north of McDermitt wherein they counted six hundred-fifty elk. This is why a plan needs to be in place if the elk moved into Nevada. Commissioner Bell asked if, at this point, there is anything the Commission can do suggesting that they can voice concerns via a letter but cannot enforce anything. Mr. Schweigert said the Commission has the approval or disapproval authority and what they are requesting is that they not approve the plan unless it says certain things. He would recommend use of the words “Elk Free Zone”. This does not allow pioneering. Mr. Schweigert suggested NDOW start by controlling the elk population on the Santa Rosas, to prove their ability to control populations. Commissioner French asked Mr. Schweigert if his position is there should be no pioneering elk supported in the Santa Rosas west in northern Humboldt County or any parts of northern Humboldt County. Mr. Schweigert responded he wants them managed, once established in the Santa Rosas. He would like the sub-plan to require management and control of the numbers at the current population. He commented the BLM and Forest Service have a big NEPA problem. Commissioner French offered that not expecting pioneering is unreasonable and that NEPA does not apply to a pioneering wildlife species and explained. Mr. Schweigert said he understands the process and the compromises made. He commented that there is no way to control the numbers and offered suggestions on the numbers getting under control. He went back to having an “Elk Free Zone”. Commissioner Cerri commented on the statement that the Commission could stop this stating that he does not know if they can, even if they wanted to; he had asked and the ultimate decision comes from the State Wildlife Commission. The Commission’s recommendation may be considered more than the average person but he does not think they can stop it. Commissioner French said they could accept comments made from Mr. Schweigert’s clients and from the other side who would like to see elk. They need to agree and accept an initial plan as a starting point. Consider the issues that are a concern to Mr. Schweigert’s clients and the issues of the sportsmen and issues that may center on transportation and public safety. There are many things the Commission can address back to the Wildlife Commission based on testimony presented. Mr. Schweigert said they agree with the approach that has been taken. They want to know where are the teeth. Why set a number of elk allowed if there is no ability to enforce it? Commission French commented you could not say how many elk you are going to kill in a month. He said you could have responsible multiple hunts and times based on the elk numbers and locations. Commissioner Cerri said the BLM and Forest Service need to commit to no loss of AUMS. Mr. Schweigert responded as to what has happened in other areas. Commissioner Cerri said it is difficult to monitor the loss of foliage as there is no one willing to commit the money and the manpower to get monitoring done, especially aspen. Deputy District Attorney Gabrielle Carr suggested language for a motion. Discussion ensued as to what action they are being requested to make. Commissioner Cerri said he would like to run something he may have committed the Commission to, by the Commission; that the steering group will initially create the team but in the future the Commission may be asked to appoint new members as members leave the team. Commissioner French commented they could call for nominations from NDOW, the agricultural side as well as from the BLM or Forest Service. They could also set provisions for the makeup of the team. following motion was made by Commissioner French and passed with Chairman Brissenden, Commissioner French, Commissioner Bell, Commissioner Cerri and Commissioner Amos voting aye: To accept the comments submitted by Bob Schweigert relative to the elk management

plan. In addition, accept any additional information, whether it be from the agricultural side or the wildlife side. To put together a body of concerns to be included in a letter once the plan is submitted for approval.

Deputy District Attorney Carr asked if the Commission wanted to add this item to a future agenda due to additional information provided. Commissioner French said not at this time. It will be in the form of an item with the final plan. The Commission took a recess at 12:32 p.m. reconvening at 12:34 p.m. COMPTROLLER – CONSIDERATION OF & POSSIBLE ADOPTION OF PLAN FOR CORRECTIVE ACTION FOR ANY APPARENT VIOLATIONS AS DETERMINED IN THE 20014-2015 HUMBOLDT COUNTY AUDIT: Sondra Schmidt, County Comptroller reviewed the issues (see attached list). They require approval of corrective action. Comptroller to the Commission dated February 1, 2016 and direct the Comptroller to forward the plan to the Nevada Department of Taxation.

PLANNING DEPARTMENT – CONSIDERATION & POSSIBLE APPROVAL OF THE COUNTY ATTRITION POLICY AND 120 DAY WAITING PERIOD FOR OPEN ADMINISTRATIVE CLERK 1/11/111/1V: Administrator Mendiola reviewed the request. He said his first consideration was to let the position sit but he has concerns about backup and succession plan. He would like to fill the position and train someone for backup. With slow activity in the Planning Department, he would like to use the individual hired in other offices after training in Planning for 5-6 months. Commissioner French commented on the 120-day period and the need for an additional person in the Planning Department with the plan to assign duties as needed in other offices. Prior to going into closed session Commissioner Cerri asked about having a Commissioner sit in on the labor negotiations. Administrator Mendiola said there has been a Commissioner sitting in on the negotiations. There was discussion as to the pros and cons of having a Commissioner sit in on negotiations. Administrator Mendiola said negotiations should start in a couple of weeks. He explained the process of reviewing the existing Collective Bargaining Agreements, notifying each Association regarding issues to be discussed during negotiations. The Associations will provide the County with items also. The Commissioners went to closed session.

Chapter 15.04 of the Humboldt County Code is amended to read as follows: 15.04.010 – International Building Code Admendments 1. Section 105.2 Exemptions from permit requirements (1) One story detached accessory buildings such as tool and storage sheds, playhouses livestock shelters and greenhouses provided the floor area does not exceed 200 square feet. (6) Sidewalks, decks, platforms, and driveways not more than 30 inches above adjacent grade and not over any basement or story below and which are not part of an accessible route. (9) Prefabricated swimming pools accessory to a Group R-3 occupancy, as applicable in Section 101.2, which are less than 24” deep in the ground or less than 5’ deep when installed entirely above ground. (10) Shade cloth structures constructed for nursery storage (nonhazardous materials) or agricultural purposes and not including service systems provided the roof area does not exceed 250 square feet. Permits for temporary shade cloth structures shall be determined by the Building Official and the International Fire Code. 2. Section 108 shall be amended to read as follows:

(a) Building permit fees shall be set using the 1991 UBC Table + an increase of 15 percent (15%) fee schedule. The minimum permit fee shall be set at $51.75 for construction valuation of $1.00 to $2,000.00. (b)When submittal documents are required by Section 106.1, a plan review fee shall be paid at the time of submitting the submittal documents for plan review. Said plan review fee shall be 65 percent (65%) of the building permit fee as shown in Table 3-A 1991 of the Uniform Building Code plus an increase of 15 percent (15%).

The plan review fees specified in this section are separate fees from the permit fees specified in Section 108 and are in addition to the permit fees. When submittal documents are incomplete or changed so as to require additional plan review or when the project involves deferred submittal items as defined in Section 106.3.4.2 an additional plan review fee shall be charged at the rate defined in this Ordinance. Expiration of Plan Review - Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing that the circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee.

(c) Additional plan review required by changes, additions or revisions to approved plans, $50.00 per hour, minimum fee-one-half hour. (d)Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work.

An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigative fee shall be equal to the amount of the permit fee required by this code. The minimum investigative fee shall be the same as the minimum fee set forth in Table 3-A of the 1991 Uniform Building Code plus an increase of 15 percent (15%). The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by laws.

(e)The building official may authorize refunding of any fee paid hereunder which was erroneously paid or collected.

The building official may authorize refunding of not more than 80 percent (80%) of the permit fee paid when no work has been done under a permit issued in accordance with this code. Fees paid for plan reviews are not refundable once the plan review has been completed. The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. (f)Expiration of permits. We consider the project to be abandoned if there has been no inspection requested or passed within 180 days. If the permit is older than one year from issuance date the permit will be expired per Section 105.5. A renewal permit will be required. 35

(g)Permit renewal fees – Renewal permits are required when a permit has been expired. The applicant may be required to submit new plans for review if new codes have been adopted. At the time of request for renewal a plan review fee will be assessed. If applicant applies for a renewal permit within 6 month of the expiration of the previous permit for the same project the building permit fee will be 50% of current permit fee schedule. Fees for plumbing, electrical, and mechanical shall also be 50% of the current fee schedule. (h)All permits for signs shall be set at fees as follows: Signs with valuation up to $25,000 shall be based on the Table 3-A of the 1991 Uniform Building Code plus an increase of 15 percent (15%). Signs with a valuation of more than $25,000 shall be a set at a standard fee of $300.00. (i)Grading Fees – IBC Appendix J The permit fees for grading shall be based on the 1997 Uniform Building Code Fee Table A-33-B. Plan review fees shall bases on 1997 Uniform Building Code Fee Table A-33-A

(j) All permits for photovoltaic projection fields with valuations up to $25,000,000.00 shall be based on Table 3-A of the 1991 Uniform Building Code plus an increase of 15 percent (15%) plus 65% plan review fee as prescribed in the 2018 International Building Code. Photovoltaic production fields with a valuation of more than $25,000,000.00 shall be set at a standard fee of $150,000 which includes the plan review fees as prescribed in the 2018 International Building Code.

3. Section 305.2 Group E, Day Care Facilities This group includes buildings and structures or portions thereof occupied by more than six children older than 2 ½ years of age who receive educational, supervision or personal care service for fewer than 24 hours per day.

Section 305.2.1 Within Places of religious worship. Rooms and spaces within places of religious worship providing such day care during religious functions shall be classified as part of the primary occupation.

Section 305.2.2 Six or fewer children. A facility having six or fewer children receiving such day care shall be classified as part of the primary occupancy. Section 305.2.3 Six or fewer children in a dwelling unit. A facility such as the above within a dwelling unit and have six or fewer children receiving such day care shall be classified as a Group R-3 occupancy or shall comply with the International Residential Code. 4. Section 308.2.5 Institutional, Group I-1 – Add new subsection to 308.2

308.2.5 Board of Health. All portions of a care facility which houses patients or residents, which is classified by the State Board of Health as ‘Category 2’, and which has an occupant load of more than 10 residents, is classified as an ‘I-1’ occupancy classifications.

5. Section 308.5 Institutional Group I-4, Day Care Facilities 308.6 Institutional Group I-4, day care facilities. This group shall include buildings and structures occupied by more than six persons of any age who receive custodial care for fewer than 24 hours per day by persons other than parents or guardians, relatives, by blood, marriage or adoption, and in a place other than the home of the person cared for. This group shall include, but not limited to, the following: Adult day care Child day care 308.6.1 Classification as Group E. A child day care facility that provides care for more than six but not more than 100 children 2 ½ years or less of age, where the rooms in which the children are cared for are located on a level of exit discharge serving such rooms and each of these child care rooms has an exit door directly to the exterior, shall be classified as Group E 308.6.3 Six or fewer persons receiving care. A facility having six or fewer persons receiving custodial care shall be classified as part of the primary occupancy. 308.6.4 Six or fewer persons receiving care in a dwelling unit. A facility such as the above within a dwelling unit and having six or fewer persons receiving custodial care shall be classified as a Group R-3 occupancy or shall comply with the International Residential Code. 6. Section 310.2 Residential Group R-1. Residential Group R-1 occupancies containing sleeping

units where the occupants are primarily transient in nature, including: Boarding houses (transient with more than 10 occupants) 36

Section 906 Portable Fire Extinguishers – Delete in its entirety. 10. Amend Chapter 9 by replacing International Plumbing Code and Sections to Uniform Plumbing

Code & Sections. 11. Section 910.1 General (Smoke and Heat Removal) Exceptions: 2. Automatic smoke and heat vents are not required within areas of buildings equipped with early suppression fast-response (ESFR) sprinklers unless the area of a Group F-1 or S-1 occupancy protected with ESFR sprinklers has an exit access travel distance of more than 250 feet (76.200 mm). 12. Section 1010.1.10 amended:

Electrical rooms with equipment rated 1,200 800 amperes or more and over 6 feet (1829 mm) wide and that contain overcurrent devices, switching devices or control devices with an exit or exit access doors, shall be equipped with panic hardware or fire exit hardware. The doors shall swing in the direction of egress travel.

13. Amend Section 1209 by adding Section 1209.4 as follows: 1209.4 Baby Changing Tables. Diaper changing tables are required to be installed in both male,

female and other restrooms, in permanent buildings that contain public restrooms as defined in Chapter 29 of the 2018 IBC. Changing tables are required when any of the following occur: new buildings, tenant improvements, new restrooms, alterations of existing restrooms, new additions, change of uses that require updating existing restrooms with additions to those facilities. Shall meet the guidelines of 603.5, 309, and 902 of ANSI/ICC A117.1-2017.

14. IBC Section 1609.3(Basic Wind Speed) and 1609.4 (Exposure) amended: The minimum basic wind speed at any site in Humboldt County shall be 90 miles per hour fastest 105 mph 3 second gust. An exposure of “C” shall be used as a minimum in the design of all structures within Humboldt County. 15. Amend Section 1704.2 Exception 2: Unless otherwise required by the building official, special inspections and tests are not required

for Group R-3 occupancies as applicable in Section 101.2 and Group U occupancies that are accessory to a residential occupancy including, but not limited to, those listed in Section 312.1.

16. Amend Section 1803.2 – Investigations Required as follows: Exception: The building official need not require a geotechnical investigation where satisfactory data from adjacent areas is provided by a licensed design professional that demonstrates an investigation is not necessary for any of the conditions in Sections 1803.5.1 through 1803.5.6 and Sections 1803.5.10 and 1803.5.11. 37

17. Amend Section 1803.6 Reporting by adding: 11. 18. Section 1809.5 #1 Frost depth for Humboldt County shall be twenty four inches (24”) deep. 19. Section 2901.1 Scope Private sewage disposal systems shall conform to NAC Chapter 444 20. Amend Section 2902.1 Minimum number of fixtures. Plumbing fixtures shall be provided in the

minimum number as shown in Table 2902.1 based on the actual use of the building or space. Uses not shown in Table 2090.1 shall be considered individually by the code official. The number of occupants shall be determined by this code. Suitable toilet facilities shall be provided and maintained in a sanitary condition for the use of workers during construction.

21. Amend Section 3102.7 by adding the following exception: Membrane structures intended to be in

place for 30 days or less may be engineered to risk category I loads provided the installation and use are per the manufacturer’s recommendations.

22. Appendix Chapter H 1. Section H113.4 - A permit is not required for the following signs. These exemptions shall not be construed as relieving the owner of the sign from the responsibility for its erections, maintenance and compliance with the provisions of this code or other laws or ordinances regulating signs. (a) Changing of the advertising copy or message on a painted or printed sign only. Except for theater marquees and similar signs specifically designed to the use of replaceable copy, electric signs shall not be included in this exception. (b) Painting, repainting or cleaning of an advertising structure or changing the advertising copy or message thereon shall not be considered an erection or alteration that requires a sign permit unless a structural change is made. (c) Signs less than 6 feet (1829 mm) above grade measured from the top of the sign and a maximum of 32 sq ft. (d) Section H111.1 – Flat signs installed on building wall fronts, which do not exceed 4x8 32 sq ft in size. This does not exempt the installer/owner from proper attachment for safety purposes. (e) Temporary signs announcing the sale or rent of property. (f) Signs erected by transportation authorities. 2. Section H113.4 – The bottom of any marquee projecting over an alley shall not be less than fifteen and one-half (15.5) feet above the ground or pavement below. 23. Appendix Chapter I Section I105.2 Footings – An unenclosed patio cover that projects 14 feet or less from the main structure shall be permitted to be supported on a concrete slab on grade without footings provided the slab conforms to the provisions of Chapter 19 of this code, is not less tha 3 ½” thick and further provided that the columns do not support loads in excess of 750 pounds (3.36 kN) per column. 15.04.020 International Residential Code Admendments 1. Section R105.2 Exemptions from permits (1) One story detached accessory buildings such as tool and storage sheds, playhouses, livestock shelters and greenhouses provided the floor area does not exceed 200 square feet. (5) Sidewalks, platforms, and driveways not more than 30 inches above adjacent grade and not over any basement or story below. (7) Prefabricated swimming pools that are less than 24” deep in the ground or less than 5’ deep when installed entirely above ground 38

(10) Decks that are not more than 30 inches above grade at any point. (11) Shade cloth covers not exceeding 250 square feet of roof area. 2. Section R108 shall be amended to read as follows:

(a) Building permit fees shall be set using the 1991 UBC Table + an increase of 15 percent (15%) fee schedule. The minimum permit fee shall be set at $51.75 for construction valuation of $1.00 to $2,000.00. (b)When submittal documents are required by Section R106.1, plan review fees shall be paid at the time of submitting the submittal documents for plan review. Said plan review fee shall be 65 percent of the building permit fee as shown in Table 3-A 1991 of the Uniform Building Code plus an increase of 15 percent (15%).

The plan review fees specified in this section are separate fees from the permit fees specified in Section R108 and are in addition to the permit fees. Expiration of Plan Review - Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing that the circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee.

(c) Additional plan review required by changes, additions or revisions to approved plans, $50.00 per hour, minimum fee-one-half hour. (d)Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work.

An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigative fee shall be equal to the amount of the permit fee required by this code. The minimum investigative fee shall be the same as the minimum fee set forth in Table 3-A of the 1991 Uniform Building Code plus an increase of 15 percent (15%). The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by laws. (e)The building official may authorize refunding or any fee paid hereunder which was erroneously paid or collected. The building official may authorize refunding of not more than 80 percent (80%) of the permit fee paid when no work has been done under a permit issued in accordance with this code. Fees paid for plan reviews are not refundable once the plan review has been completed. The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. (f)Expiration of permits. We consider the project to be abandoned if there has been no inspection requested or passed within 6 months. If the permit is older then one year from issuance date the permit will be expired per Section 105.5. A renewal permit will be required. (g) Permit renewal fees – Renewal permits are required when a permit has been expired. The applicant may be required to submit new plans for review if new codes have been adopted. At the time of request for renewal a plan review fee will be assessed. If applicant applies for a renewal permit within 6 month of the expiration of the previous permit for the same project the building permit fee will be 50% of current permit fee schedule. Fees for plumbing, electrical, and mechanical shall also be 50% of the current fee schedule.

3. Section R202 Definition of Sleeping Room – Any bedroom or other room that is intended to be or is ordinarily used for sleeping purposes. The term is deemed to include any room that contains a closet and provides for occupant privacy. 4. Section R303.1. All unfinished residential basements shall be provided with natural light by means of exterior glazed openings with an area not less than five percent of the total floor area. The unfinished basement shall be provided with one emergency escape window or door complying with International Residential Code Section R310. The unfinished basement shall also be provided with smoke detectors complying with International Residential Code Section R313. All finished residential basements shall be provided with a minimum of one window in each habitable room. 39

Sleeping rooms and required emergency escape or rescue windows and doors shall comply with International Residential Code, Section R310. Smoke detectors shall be provided per International Residential Code Section R313. 5. Chapter 2 Definitions Whole –House Mechanical Ventilation – Delete For definition applicable in Chapter 11, See Section N1101.6

Surcharge. A vertical load imposed on the retained soil that may impose a lateral force in addition to the lateral earth pressure of the retained soil. Examples include:

• Sloped retained soil • Structure footings supported by the retained soil • Adjacent vehicle loads supported by the retained soil

6. IRC Section R301.2.2 Seismic Zone shall be D-1. 7. IRC Section R301.2.1(Basic Wind Speed) and 1609.4 (Exposure) amended: The minimum basic wind speed at any site in Humboldt County shall be 90 miles per hour fastest mile and 105 miles per hour 3 second gust. An exposure of “C” shall be used as a minimum in the design of all structures within Humboldt County. 8. IRC Section R302.2 Townhouses 1. A common 2-hour fire-resistance-rated wall assembly tested in accordance with ASTM E 119 or UL 263 is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. Electrical installations shall be installed in accordance with 2017 National Electric Code. Penetrations of electrical outlets boxes shall be in accordance with Section R302.4. 2. Where the building is equipped throughout with an automatic sprinkler system, a common 1-hour fire-resistance-rated wall assembly test in accordance with ASTM E 119 or UL 263 is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. The wall shall be rated for fire exposure from both sides and shall extend to and be tight against exterior walls and the underside of roof sheathing. Electrical installations shall be installed in accordance with National Electric Code. Penetrations of electrical outlet boxes shall be in Accordance with R302.4.

3. An automatic residential fire sprinkler system shall not be required in townhouses less than 5,000 sq. ft. of living space unless the AHJ has amended the International Fire Code to include provisions pertaining to townhouses in accordance with NRS 278.586.

9. IRC Section 302.2.4 Structural Independence Townhouses separated by a common fire resistance-rated wall as provided in Section R302.2.6 10. IRC Section R303.4 Mechanical Ventilation – Delete entire section 11. IRC Section R309.2 Breezeway. Where a breezeway separates a single-family dwelling and a garage, the interior wall and gable end wall of the garage adjacent to the dwelling shall be protected with one layer of ½” sheetrock from the floor to the underside of the roof sheathing. 12. IRC Section R313.1 Townhouse Fire Sprinkler Requirement add exception:

Exclude Appendix Chapter M – Home Day Care 22. Bathrooms shall not be constructed in a garage/accessory building until a residence is located on the parcel. 15.04.030 Uniform Mechanical Code. Amendments

1. There is added to Section 115 "Fees," the following paragraph: (a) For new residential construction, three and one-half (.035) cents per square foot.

(b)Issuance fee of $51.75 will be assess for each mechanical permit issued. (c) Plan review fees, investigative fees and fee refunds shall be as set in 15.04.010 (C) 2 (a)(b)(c)(d) of this ordinance. 2. Section 304.3 Access to Appliances on Roofs. Appliances located on roofs or other elevated

locations above 30 inches shall be accessible. (NPFA 4:9,4.3.11) Section 304.3.1.1 Access Type. The inside means of access shall be a permanent, or foldable

inside stairway or ladder, terminating in an enclosure, scuttle, or trap door. such scuttles or trap doors shall be not less than 22 inches by 24 inches (559 mm by 610 mm) in size, shall open easily and safely under all conditions, especially snow; and shall be constructed so as to permit access from the roof side unless deliberately locked on the inside. Not less than 6 10 feet (3048 mm) of clearance shall be between the access opening and the edge of the roof or similar hazard or rigidly fixed rails or guards not less than 42 inches (1067 mm) in height shall be provided on structures are utilized in lieu of guards or rails, they shall be not less than 42 inches (1067 mm) in height. (NFPA 54:9.4.3.1)

. Section 304.3.1.2 Permanent Ladders – Amend as follows: (6) Fall protection or guards of not less than 42 inches in height, measured from the roof walking surface shall extend min. 6’ on each side of ladder at the roofs edge. 3. Section 937Installation of Gaseous Hydrogen Systems: Add new section to Chapter 3 9.

937.2 Installation of Gaseous Hydrogen Systems. All hydrogen systems shall comply with NFPA 2 Chapter 13 Hydrogen Technology Code, Building Code, and the Fire Code.

4. Section 508.5.5 Evaporative Cooling Systems – Add new subsection 508.1.3 to Section 508.1: 508.1.36 Evaporative Cooling Systems. Evaporative cooling systems will comply with this chapter. Evaporative coolers shall not be used for make-up air units on commercial hoods and kitchen ventilation systems. Exception: Evaporative cooling systems that are part of a listed heating air system for kitchen make up air systems. The temperature differential between the makeup air and the air in the conditioned space shall not exceed 100 F (60 C) except where the added heating and cooling load of makeup air do not exceed the capacity of the HVAC system.

5. Section 511.2.2.2 Capture and Containment Test. The permit holder shall verify the capture and containment performance of the Type I hoods. A field test shall be conducted with the all appliances under the hood at operating temperatures, with the outdoor air providing makeup air for all the hoods operating and with the source of recirculated air providing conditioning for the space in which the hood operating in located at design airflows, and with all sources of replacement air operating at design airflows for the restaurant. Capture and containment shall be verified by observing smoke or steam produced by actual or simulated cooking operation or by simulating cooking using devices such as smoke candles or smoke puffers. Smoke bombs shall not be used [ASHRAE 154:4.8.2 4.7.2] Exception: Capture and containment test not required if hood is UL and NFPA listed and manufacturer’s data lists the individual equipment below the hood.

. 6. Section 604.1 General (Insulation of Ducts) Amend Section 604.1 to read as follows: Supply-air ducts, return air-ducts, and plenum of a heating or cooling system shall be insulated to achieve a minimum thermal (R) value in accordance withthe 2009 International Energy Conservation Code Section 403.2.1 for residential and 503.2.7 for commercial. Delete Exceptions. 7. 608.1 Air‐Moving Systems and Smoke Detectors. Air‐moving systems supplying air in excess of

2000 cubic feet per minute (ft 3 /min) (0.9439 m 3 /s) to enclosed spaces within buildings shall be equipped with an automatic shutoff. Automatic shutoff shall be accomplished by interrupting the power source of the air‐moving equipment upon detection of smoke in the main supply return‐air duct or plenum upstream of any filters, exhaust air connections, outdoor air connections, or decontamination equipment and appliances air duct served by such equipment. Duct smoke detectors shall comply with UL 268A and shall be installed in accordance with the manufacturer’s installation instructions. Such devices shall be compatible with the operating velocities, pressures, temperatures, and humidities of the system. Where fire‐detection or alarm systems are provided for the building, the smoke detectors shall be supervised by such systems in an approved manner.

8. Section 609.0 Performance Test of Automatic Shutoffs. Add new Section 609.0 to Chapter 6. Upon completion and before final approval on the air-moving system, provide with the required smoke detectors, a performance test shall be performed to verify compliance of dector installation to manufactuer’s instructions and system compatibility as specified in this chapter. The permitee shall furnish the necessary test equipment and devices to perform tests and shall provide jurisdiction with an accurate, completed, and signed test report. The report shall provide the jurisdiction a form containing equivalent information. At the discretion of the Authority Having Jurisdiction, the performance test may be required to be witnesses by the Authority Having Jurisdiction, or performed by an approved third party testing agency. 9. Section 939.0 Sauna Heaters Add Section 939.1 to Section 939.0 Sauna Heaters to read as

follows: 939.0 Sauna Heaters. 939.1 General. Sauna heaters shall be listed and installed in accordance with the manufacturer’s installation instructions. Approved guards or barriers shall be installed to prevent accidental contact with the sauna heater. Ventilation shall be provided in accordance with its listing and combustion air for gas-fired heaters shall comply with Chapter 7.

10. Amend Section 1001.1 to read as follows:

For boilers and water heaters less than 120 gallon capacity, or a BTU input rating less than 200,000, or less than 160 pounds per square inch of pressure, see Chapter 5 of the Uniform Plumbing Code. For all other units contact the Mechanical Compliance Section of the Nevada Division of Industrial Relations, part of the Department of Business and Industry. 42

11. Amend Section 1301.1 to read as follows: 1301.1 Applicability. The regulations of this chapter

shall govern the installation of fuel gas piping in or in connection with a building, structure or within the property lines of premises up to 5 pounds‐force per square inch (psi) (34 kPa) for natural gas and 10 psi (69 kPa) for undiluted propane, other than service pipe. Fuel oil piping systems shall be installed in accordance with NFPA 31. Whenever there is a conflict between this code and NFPA 54 and NFPA 58 as adopted by the Nevada LP‐Gas Board for LP‐Gas installations, the adopted codes of the Nevada LP-Gas Board shall govern.

15.04.050 Uniform Plumbing Code. Amendments. 1. There are added to Section 103.4 104.3.2: (a) For new residential construction, three and one-half (.035) cents per square foot. (b) For temporary gas service $25.00

(c) Issuance fee shall be $51.75 assessed for each permit issued. (d) Plan review fees, investigative fees and fee refunds shall be as set in 15.04.010(C)2(a)(b)(c) (e) of this ordinance. 2. Section 216 Non Combustible Materials – Add new definition Materials that, when tested in accordance with ASTM E 136, have at least three of four specimen tested meeting all of the following criteria: 1. The recorded temperature of the surface and interior thermocouples shall not at any time during the test rise more than 54°F (30°C) above the furnace temperature at the beginning of the test. 2. There shall not be flaming from the speciman after first 30 seconds 3. If the weight loss of the specimen during testing exceeds 50 percent, the recorded temperature of the surface and interior thermocouples shall not at any time during the test rise above the furnace air temperature at the beginning of the test, and there shall not be flaming of the speciman. 3. Section 218 Pentration Firestop System – Delete section in its entirety. 4. Section 220 T Rating – Delete entirely 5. Section 312.7 Fire-Resistive Construction – Amend as follows: Piping penetrations of fire-resistance-rated walls, partitions, floors, floor/ceiling assemblies, roof/ceiling asemblies, or shaft enclosures shall be protected in accordance with the requirements of the building code. 6. Section 422 Minimum Number of Required Fixtures – Delete section in its entirety. 7. Table 422.1 Minimum Plumbing Facilities – Delete Table in its entirety. 8. Amend Section 712.1 to read as follows: 712.1 Media. The piping of the plumbing, drainage and

venting systems shall be tested with water or air except that plastic piping shall not be tested with air. The authority Having Jurisdiction shall be permitted to require the removal of cleanouts, etc., to ascertain whether the pressure has reached all parts of the system. After the plumbing fixtures have been set and their traps filled with water, they shall be submitted to final test.

9. Amend Section 723.1 to read as follows: 723.1 General. Building sewers shall be tested by

plugging the end of the building sewer at its points of connection with the public sewer or private sewage disposal system and completely filling the building sewer with water from the lowest to highest point thereof, or by approved equivalent low‐pressure air test. Plastic DWV piping systems shall not be tested by the air test method. The building sewer shall be watertight.

10. Amend Section 1107.2 to read as follows: 1107.2 Methods of Testing Storm Drainage Systems.

Except for outside leaders and perforated or open‐jointed drain tile, the piping of storm drain systems shall be tested upon completion of the rough piping installation by water or air, except

that plastic pipe shall not be tested with air, and proved tight. The Authority Having Jurisdiction shall be permitted to require the removal of cleanout plugs to ascertain whether the pressure has reached parts of the system. One of the following test methods shall be used in accordance with Section 1109.2.1 through Section 1109.2.3.

11. Section 1202.1 Installation - Add the following Whenever there is a conflict between this code and NFPA 54 and NFPA 58 as adopted by the Nevada LP-Gas Board for LP-Gas installations, the adopted codes of the Nevada LP-Gas Board shall govern0 12. Article 230.70(A)(1) of the National Electric Code is amended to read as follows: (a)The service disconnection means shall be installed outside of a building or other structure at a readily accessible location nearest the point of entrance of the service conductors. The disconnecting means may be located independent of the building or structure served, in direct line of sight, but not to exceed thirty feet (30’). Exception: The service disconnect means may be installed within a building when an external remote shunt trip switch is provided. All shunt trip switches shall be located at seven feet (7’) above finished grade at a location approved by the fire department. All shunt trip switches shall be located within a twelve inch (12”) equilateral triangle, red in color. 6. Amend Section 240.51(B) of Section 240.51 Edison‐Base Fuses to read: 240.51(B) Replacement

Only. Plug fuses of the Edison‐base type shall be used only for replacements in existing installations where there is no evidence of overfusing or tampering. In any existing building where alterations or additions are made to any of the premises wiring, all fuse holders shall comply with Article 240.54.

7. Amend Section 250.118(4) of Section 250.118 Types of Equipment Grounding Conductors to read as follows: 250.118 Types of Equipment Grounding Conductors (4) Electrical metallic tubing with the exception of where the metallic raceway is subject to either damage or likely to be disturbed in the future under normal operating conditions, this determination shall be made by the Authority Having Jurisdiction. FPN: An example of “subject to damage” is a surface installed conduit running along a traffic path. An example of “likely to be disturbed” is a surface installed conduit running across a rooftop, where future re‐roofing operations will require the conduit to be shifted, damaged, removed or relocated.

8. Amend Section 250.120 to read as follows:

250.120 Equipment Grounding Conductor Installation. An equipment grounding conductor shall be installed in accordance with 250.120(A), (B), and (C). All raceways installed on roofs shall contain an equipment grounding conductor sized per Table 250.122 installed with the circuit conductors. Exception: Low voltage, communication and similar type systems unless required elsewhere in the Code.

9. Amend Section 358.12 to read as follows:

358.12 Uses Not Permitted. EMT shall not be used under the following conditions: (1) Where subject to severe physical damage. (2) For the support of luminaires or other equipment except conduit bodies no larger than the largest trade size of the tubing. (3) In direct contact with earth.

10. 700.10(D) Fire Protection Amend Section 700.10(D) of Section 700.10 Wiring, Emergency System to read as follows: 700.10(D) Fire Protection. Emergency systems shall meet the additional requirements in (D)(1) through (D)(3) in the following occupancies: (1) Assembly occupancies for not less than 1000 persons (2) Buildings above 23 m (75 ft) 55 ft in height (3) Health care occupancies where persons are not capable of self‐preservation. (4) Educational occupancies with more than 300 occupants

11. 700.12 General Requirements Amend Section 700.12 to read as follows: 700.12 General Requirements. Current supply shall be such that, in the event of failure of the normal supply to, or within, the building or group of buildings concerned, emergency lighting, emergency power, or both shall be available within the time required for the application but not to exceed 10 seconds. The supply system for emergency purposes, in addition to the normal services to the building and meeting the general requirements of this section, shall be one or more of the types of systems described in 700.12(A) through (E). Unit equipment in accordance with 700.12(F) shall satisfy the applicable requirements of this article. In selecting an emergency source of power, consideration shall be given to the occupancy and the type of service to be rendered, whether of minimum duration, as for evacuation of a theater, or longer duration, as for supplying emergency power and lighting due to an indefinite period of current failure from trouble either inside or outside the building. Equipment shall be designed and located so as to minimize the hazards that might cause complete failure due to flooding, fires, icing, and vandalism. Equipment for sources of power as described in 700.12(A) through (E) shall be installed either in spaces fully protected by approved automatic fire suppression systems (sprinklers, carbon dioxide systems, and so forth) or in spaces with a 1‐hour 2‐hour fire rating where located within the following: (1) Assembly occupancies for more than 1000 persons. (2) Buildings above 23 m (75 ft) 55 feet in height with any of the following occupancy classes‐ assembly, educational, residential, detention and correctional, business, and mercantile (3) Health care occupancies where persons are not capable of self‐preservation (4) Educational occupancies with more than 300 occupants

15.04.110 International Energy Conservation Code Amendments

1. Exclude all references to International Residential Code (Mechanical) Chapters 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, and Appendices B, C & D and replace with 2012 2018 Uniform Mechanical Code.

2. Exclude all references to International Residential Code (Plumbing) Chapters 24, 25, 26,

27, 28, 29, 30, 31, 32, 33 and Appendices A, I and N and replace with 2018Uniform Plumbing Code.

3. Section 101.4.3 Additions, alterations, renovations or repairs. – Add the following exception:

4. Section 202 Definitions – Amend Section to include the following definitions. Casino. A business with a Non-restricted Gaming License from the Nevada Gaming Commission and State Gaming Control Board. It includes the gaming area(s) as well as the adjacent areas within the building envelope. Casino Gaming Area. The space within a casino wherein gaming is conducted. The area shall also include accessary uses within the same room(s) as, or substantially open to the gaming floor(s). Such areas shall include, but not be limited to lobbies, balconies, public circulation areas, assembly areas, restaurants, bars, lounges, food courts, retail spaces, mezzanines, convention pre-function areas, cashiers’ cages, player’s clubs, customer support, conservatories and promenades that share the same atmosphere, spillover lighting and theme lighting with the adjacent gaming floor area.

Occupant Sensor (Lighting). A device that detects the presence or absence of people within an area and causes lighting to be regulated accordingly. The term “occupant sensor” applies to a device that controls indoor lighting systems. Motion Sensor (Lighting). A device used to control outdoor lighting system. 5. Section 303.1.3 Fenstration and product rating – Add two new subsections and amend Section 303.1.3 as follows: U-factors of fenestration products (windows, doors and skylights) shall be determined in according with NFRC 100 by an accredited, independent laboratory, and labeled and certified by the manufacturer. Products lacking such a labeled U-factor shall be assigned a default U-Factor from Tables 303.1.2(1) or 303.1.3(2) or ASHRAE 90.1 Tables A-8.1 A and B or Table 8.2. The solar heat gain coefficient (SHGC) of glazed fenstration products (windows, glazed doors and skylights) shall be determined in accordance with NFRC 200 by an accredited, independent laboratory, and labeled and certified by the manufacturer. 15.04.020 International Residential Code A. Adopted. The 2018 Edition of the International Residential Code with appendices excluding the mechanical, plumbing and electrical chapters and appendices, and Appendix Chapter M – Home Day Care; published by the International Code Council is adopted by the county with changes or modifications as set out in subsection C of this section.

The 2018 Edition of the International Fire Code with appendices thereto as published by International Code Council and as amended by the Nevada State Fire Marshal is adopted by the County. Fees assessed for fire code plan reviews shall be the same fee schedule as adopted by the Nevada State Fire Marshal under Nevada Administrative Code 477.750. 15.04.050 Uniform Plumbing Code.

A. Compliance with Statutory Requirements. 1. NRS 444.350 states that all construction, alteration or change in the use of a

building or other structure in this state shall be in compliance with the latest edition of the Uniform Plumbing Code adopted by the International Association of Plumbing and Mechanical Officials.

2. Adoption of NRS Chapter 278.582 pertaining to minimum plumbing fixtures in certain construction and expansions.

B. Adopted. The 2018 Edition of the Uniform Plumbing Code with appendices is declared to be the latest edition which is in effect in the county as mandated by NRS 444.350, with changes or modifications thereto and therein as set out in subsection D of this section, which modifications and changes are deemed reasonably necessary because of geographic, topographic or climatic conditions of the county.

C. Definitions. The term "authority having jurisdiction" as used in the Uniform Plumbing Code means the county building official and such other person or persons as designated by the board of county commissioners.

D. Amendments. Amendments – See Humboldt County Building Department 2018 Code Amendments

E. References to the International Plumbing Code or the International Fuel Gas Code shall refer to the Uniform Plumbing Code.

F. Public Facilities. Every place of business selling beer, wine or intoxicating liquor to be consumed on the premises and every service station dispensing petroleum products for vehicle use shall provide for public usage a minimum of one water closet and one lavatory for women and one water closet and one urinal and lavatory for men.

15.04.060 National Electric Code. A. Compliance with Statutory Requirements. NRS 278.583 states that all construction,

alteration or change in the use of a building or structure in this state is to be in compliance with thetechnical provisions of the latest edition of the National Electric Code adopted by the National Fire Protection Association.

B. Adopted. The 2017 Edition of the National Electric Code as adopted by the National Fire Protection Association at its annual meeting is declared to be the latest edition, which is in effect as mandated by NRS 278.583.

A. Compliance with Statutory Requirements. NRS 489.251 directs that regulations be adopted by the State of Nevada pertaining to safety standards for installation, support and tie down of mobile homes/manufactured house or commercial coaches and inspection of plumbing, heating, cooling, fuel burning and electrical systems connections.

B. Adopted. The Nevada Administrative Code, Chapter 489. C. Mobile Home/Manufactured House Foundation Requirements:

(a)Concrete/masonry foundations shall be installed per Humboldt County minimum requirements. (b)All other foundations shall be installed per NRS Chapter 489. (c)A minimum of sixteen inches (16") shall be required from the bottom of the chassis frame member to the top of the footing (runner). (d)When mobile homes/manufactured houses are installed on runners or permanent foundations complying with real property conversion standards all items required for real property conversion shall be completed at the time of the mobile home/manufactured house final inspection.

D. Mobile Home/Manufactured House Set-Up Fees. The following mobile home/manufactured house set-up fees, in addition to those provided in Chapter Nevada Administrative Chapter 489.380 and Section 325 of the Rules and Regulations as set forth by the State of Nevada Manufactured Housing Division will be charged:

(a) Lot development permit fees shall be per the adopted fees under the Uniform Plumbing Code and the National Electrical Code as written in this ordinance Sections 15.04.050 D.(c) and 15.04.060 C.1.(a). (b) For inspection of each poured concrete/runner foundation - $51.75 per inspection. (c) Perimeter foundation is assessed separately per square feet using the International Residential Code fee schedule. (See Section 15.040.020 (C)(2)(a)

(d) For special inspection for conversion to real property - $51.75 per inspection

(e) Investigative fees may be assessed if work has been commenced without first obtaining the required permit.

E. Expiration of Mobile Home/Manufactured Home Permits. . We consider the project to be abandoned if there has been no inspection requested or passed within 6 months and the permit will be expired.

F. Permit renewal fees – Renewal fees are required when a permit has been expired. The fees will be per the State of Nevada Manufactured Housing Division’s current fee schedule.

15.04.110 15.04.140 International Energy Conservation Code

A. The 2009 Edition of the International Energy Conservation Code with ANSI/ASHRA/IESNA Standard 90.1 as published by the International Code Council is adopted by the county.

B. Amendments – See Humboldt County Building Department 2018 Code Amendments

15.04.120 15.04.10 Business License Survey Fee. Business License Surveys and Required Inspections. A plan review fee of $50.00 per hour

(minimum of one hour) and a $51.75 fee for each inspection shall be assessed for all business licenses. These fees include inspection and plan reviews of existing or new buildings. 15.04.130 15.04.160 Board of Appeals.

Any provision of any of the uniform or national codes adopted by this chapter notwithstanding, there is created a board of appeals consisting of five members, to be appointed in accordance with the procedure in the county for appointment of members to boards and commissions. The county building official shall sit as ex-officio members of the board of appeals without vote. The board of appeals, in addition to performing duties as required by the various codes, shall hear any appeals made in writing within ten days of a decision, action or non-action by the county building department. The Board of Appeals shall perform duties and act under the bylaws approved by the Board of Appeals. 15.04.140 15.04.170 Violation-Penalty.

Any provision of any of the international, uniform or national codes adopted by this chapter notwithstanding, any person, firm or corporation violating any provision of any section or sections of any of the codes adopted by this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished as provided in Chapter 1.08 of this code. 1. EXECUTIVE SUMMARY Purpose of Document

This Statement of Work (“SOW”) specifies the deliverables and defines the responsibilities and other relevant terms applicable to the planning and delivery of microwave and associated products from Aviat U.S., Inc. (“Aviat Networks” or “Aviat”) and its partners, as well as the professional services required to engineer and implement the proposed solution for Humboldt County (“Customer”). Execution of the services listed in this SOW is governed by Aviat’s standard terms and conditions (“Agreement”). Neither party is obligated to provide any services until the Agreement is executed by both parties and an order has been placed for services by Humboldt County and accepted by Aviat Networks. Where the terms of the Agreement differ from the terms of the SOW, the terms in the SOW shall control. Any capitalized term not defined herein shall have the meaning ascribed to it in the Agreement.

Project Scope This SOW applies to Humboldt County Nevada Microwave Radio Project proposed by Aviat Networks and cannot be extended to other projects. Aviat Networks will provide the following services to Humboldt County:

Any required services or material not specified in this SOW will be provided by Humboldt County and will not be considered part of Aviat Networks’ responsibilities. Aviat Networks reserves the right to quote and perform services not specified in this SOW in accordance with the terms and conditions of the Agreement. Once Aviat Networks approves the new services, the new services will be added to this SOW in a mutually signed amendment to this SOW and the release of a new services purchase order. For a full list of Aviat provided equipment, please refer to the project equipment list. Humboldt County and Aviat Networks acknowledge that meeting the planned project completion date requires the cooperation of the parties. Any changes requested by Humboldt County before the design freeze date stated in Appendix B will be considered part of the design finalization phase of the project and not subject to a formal change order, if at Aviat Networks’ sole discretion, the requested change falls within the original scope and hours of the project. Any changes requested by Humboldt County after the design freeze date will be subject to review by Aviat Networks and may, at Aviat Networks’ sole discretion, result in a change order fee and/or a delay in delivery to the field. See Appendix B for more detail on the design freeze. Completion and accuracy of all deliverables are subject to the integrity of the information provided by Humboldt County Aviat Networks is not responsible for validating the accuracy of the information provided by Humboldt County Any changes resulting from incorrect information provided by Humboldt County or any third party associated with Customer, will be charged to Humboldt County as a billable change order. Humboldt County furthermore agrees that any delays caused by inadequate site readiness for which Humboldt County was responsible for may prohibit Aviat Networks from meeting the project completion date, and Aviat Networks may adjust the completion date. Unless otherwise agreed to in a mutually signed amendment to this SOW, any cost impact such delays might have on this SOW will be charged to Humboldt County as a billable change order. In the event of such delays, Aviat Networks and Humboldt County will make a reasonable effort to resolve the issue and mutually agree on new project milestones. Documents, deliverables, and work submitted by Aviat Networks to Humboldt County shall be reviewed and approved in ten (10) working days from the date of receipt. If the documents, deliverables, or work submitted by Aviat Networks include equipment 59

production or OEM ordering, Customer shall not review, approve, or comment on the documents, deliverables, or work, and the documents deliverables, or work shall, at Aviat’s option, either be (i) placed on hold or (ii) deemed accepted. Aviat shall invoice Customer for equipment upon shipment of the equipment. Aviat shall invoice Customer for services upon completion of the services. Customer shall pay all invoices issues by Aviat within thirty (30) days of Aviat’s issuance of the invoice. If Customer does not pay an invoice within thirty (30) days of issuance of the invoice, Aviat shall assess a late penalty of the lesser of one-and-a-half percent (1.5%) or the greatest amount allowed by law. System Summary The turnkey proposal consists of 4 hops of 6/11 GHz microwave radios, antenna system, spares, factory integration and installation services. The proposed system covers in this proposal will be referred as phase one system.

The phase one is comprised of 4 links and 4 sites in a ring configuration as Rose Creek loop as follows; 1. Winnemucca Mtn. to Rose Creek, single RF channel MW radios 2. Rose Creek to Sports Stadium, single RF channel MW radios 3. Sports Stadium to Dispatch, dual RF channel radios 4. Dispatch to Winnemucca Mtn, dual RF channel radios

The IRU600 indoor microwave radios with 180 Mbps capacity are proposed for each single channel. All proposed radio equipment are non-protected and equipped with non protected L2 Ethernet card on each direction of the ring. The Ethernet traffic can be protected by switching to other direction of the ring with implementation of ERP (Ethernet Ring Protection) in case of any hardware failure. The Layer 3 design along with router hardware are not included in the proposal. For System monitoring, the ProVision server and 50 nodes software are included in the proposal. ProVision is a comprehensive Element Management solution for events, faults, performance, configuration and inventory management. It is based on SNMP (Simple Network Management Protocol), the widely accepted standard for performing network management functions. This would be mostly used to monitor and configure Eclipse units. The Material and services on NA190506-27034 & NA170830-59844 are covered by this SOW NA170830-59844: MW radio quote, including all factory and installation services for MW radios, field installation services for antennas/WG and LMR cables. 2. Phase one system installation scope covers the installation, alignment and test of microwave dishes, radios, dehydrators and waveguide. Also included is the installation of all items flagged as “Aviat” in the “Install” column for Winnemucca Mtn., Rose, Sports Stadium and Dispatch tables.

3. Demarcation for installation of non-MW antennas and lines is from the antenna connector on the tower all the way down to the arrestor coax and accessories is to be installed by Aviat. Humboldt County will provide the antenna and Aviat will install the antenna. Beyond the arrestor, inside the equipment shelter, the coax and all related equipment will be installed by "others".

4. CSI will provide installation specifications and drawings for all non-MW installation scope items. 5. The Tait communications radios will be installed by "others". 6. Aviat site and path surveys quoted by Aviat is to support the microwave link engineering, installation and testing. 7. Aviat project manager (PM) and project engineer PE) will attend the installation kick-off meeting in Humboldt County, rest of

Validity of Quote A Quote is an invitation for an offer and a notice to Customer of these Conditions which automatically expires after one hundred and eighty (180) days from the date of Quote, (i) if Customer has not issued Aviat US a purchase order or (ii) if the Quote is not signed by Customer and returned to Aviat US within such time frame.

Period of Performance This project Period of Performance is 24 weeks After Receipt of Order (ARO), any delays beyond Aviat’s control will be addressed as a change order to Humboldt County, this includes any changes to the design, field implementation and coordination requiring additional hours for Network Engineer, Configurations Engineer, Drafter, Transmission Engineer, Program Manager, Project Engineer, and field crews.

If the battery is not to be installed at the time of receipt, it is recommended that it be stored indoors in a cool [77°F (25°C) or less], clean, dry location. Do not stack pallets or cell terminal damage may occur. The storage interval from the date of battery shipment to the date of installation and initial charge should not exceed six (6) months. If extended storage is necessary, the battery should be charged at regular intervals until installation can be completed and float charging can be initiated. When in extended storage, it is advised to mark the battery pallets with the date of shipment and the date of every charge. If the battery is stored at 77°F (25°C) or below, the battery should be given a freshening charge within 6 months of the date of shipment and receive a freshening charge at 6-month intervals thereafter. Storage at elevated temperatures will result in accelerated rates of self-discharge. For every 18°F (10°C) temperature increase above 77°F (25°C), the time interval for the initial freshening charge and subsequent freshening charges should be halved. Thus, if a battery is stored at 95°F (35°C), the maximum storage interval between charges would be 3 months (reference Appendix B). Storage beyond these periods without proper charge can result in excessive sulphation of plates and positive grid corrosion which is detrimental to battery performance and life. Failure to charge accordingly may void the battery’s warranty. Initial and freshening charge data should be saved and included with the battery historical records.

5. APPENDIX A: PROJECT MANAGEMENT Responsibilities Aviat Networks will assign an Aviat representative to be the primary point of contact for this SOW (“Project Manager”) for the duration of the project. The Project Manager will work with Humboldt County to facilitate effective resource management, escalations, approval processes, scheduling, communication, and reporting with Aviat engineers and other designated vendors as needed. The Project Manager is responsible for maintaining control of the project and assuring compliance with the project and Customer specifications. Aviat Networks will not be responsible for the resolution of Humboldt County vendor issues affecting the completion of the project. Any documentation and standards not listed in this SOW will default to Aviat Networks standards, where applicable. Although face-to-face communication and on-site meetings with Humboldt County are essential elements of the service, some activities that do not require face-to-face contact will be performed in the Project Manager’s Aviat Networks office in order to reduce travel and living costs. These activities are at the discretion of the Project Manager. Refer to section 2.1.2 for a full list of Project Management responsibilities. Project Schedule The project schedule for Aviat engineers, Aviat sub-contractors, and for Humboldt County’s supporting vendors will be developed (or updated if a schedule is included with this proposal) and maintained in Microsoft Project and will identify project deliverables, key milestones, resource assignments, and track project progress against each milestone. Humboldt County and Aviat Networks agree to collaboratively review and agree to the project milestones and deliverable dates prior to the execution of any services on the project. A copy of the project schedule will be available upon request in .pdf or .mpp format. It will be the responsibility of Humboldt County to track and deliver against all Humboldt County internal (including Humboldt County sub-contractors) milestones. The overall project plan generated by the Aviat Networks Project Manager will show major deliverable milestones, but not internal milestones of Humboldt County or their contractors. Tracking of Humboldt County and Humboldt County’s contractor internal milestones will remain the responsibility of the Humboldt County Communications Plan Establishment of a communications plan will be done in accordance with the principles of project management established by the Project Management Institute (PMI®) unless otherwise agreed to. The plan will involve representatives from Aviat Networks and Humboldt County and any other entities as mutually agreed between the parties for project kickoff meetings, periodic progress meetings, or problem escalations as needed. The plan will include the location and frequency of any such meetings, the format for formal communication and meeting minutes, attendee or distribution lists with contact details, methods of communication, and escalation and management level lists. Humboldt County will make appropriate staff available for regular consultation and meetings with the Aviat Networks Project Manager. Customer’s failure to attend regular meetings or respond to Aviat Networks questions in a timely manner could result in a delay of the project deliverables and a billable change order. Change Management Plan Establishment of a change management plan will be done in accordance with the principles of project management established by the Project Management Institute (PMI®) and will include confirmation from Aviat Networks and Humboldt County’s understanding of the process. Each party will work closely with the other to manage any scope changes through the term of the project and understand their impact on the project performance from a cost, quality, and schedule perspective. Any such change may be subject to a change order fee and will be communicated to Humboldt County prior to the implementation of the change. Any change order approvals will be submitted in writing. Refer to section 1.2 and Appendix B for more details on change orders. Quality Standards and Procedures Quality standards and procedures documents will be provided by Humboldt County prior to execution of this SOW. If no documentation is provided by Humboldt County prior to execution of this SOW, the standards and procedures will default to Aviat Networks best practices guide. Resource Management Plan Establishment of a resource management plan will be done in accordance with the principles of project management established by the Project Management Institute (PMI®), identifying principle team members by function, including backup resources (if required). APPENDIX B: NETWORK ENGINEERING Microwave System and Network Design The Aviat Networks representative who oversees the network (“Network Engineer”) will provide the overall technical direction of the system design and will work with Humboldt County to insure system integrity, verify that all sub-systems and Aviat Networks furnished OEM equipment is compatible, and that the desired performance of the system is realized. The network design portion of the project consists of three phases:

1. Preliminary design 2. Final design 3. Design freeze

Preliminary Design Phase During the preliminary design phase, the Network Engineer will gather data to establish the design criteria and any special Customer requirements that need to be incorporated into the final design. The Network Engineer will review and translate the system configuration into specific hardware requirements. Equipment selection will be based on the requirements, input and requests from Humboldt County, functionality of the equipment, and recommendations from the Network Engineer. Aviat Networks will provide Humboldt County with a summary of the preliminary system design prior to commencing field surveys. All preliminary designs are subject to change. Changes can include, but are not limited to changes based on:

• Survey results. • Vendor shortages or long lead times. • Customer requests. • Engineering recommendations.

Design Finalization Phase After receipt of the order and the project kickoff meeting, Aviat Networks and Humboldt County enter into the design finalization phase. During this phase, the Network Engineer will incorporate any required changes stemming from the path and/or site surveys into the design and confirm the final design details. Changes can include but not limited to:

• Antennas (types, sizes, models, quantities, and mounts). • Waveguide (types and lengths), waveguide accessories and dehydrators. • Power systems, cabling, and other material that could not be finalized prior to conducting the field surveys.

During this phase, Humboldt County may also request changes to the system design if the changes fall within the original scope and hours of the projects. Any changes outside of the original scope or agreed schedule are subject to review and acceptance by Aviat Networks to determine the impact and cost on the overall project. Aviat Networks will provide a formal submission detailing the final system design and equipment list and highlight changes needed to the preliminary design. Humboldt County shall review the data and schedule a meeting, if necessary, to discuss any concerns. If no concerns are noted, it is Humboldt County’s responsibility to approve the final design in writing (email is acceptable) before the design is frozen and equipment is placed on order (unless otherwise agreed to in this SOW or with the Project Manager). Any delay in the approval of the final design could result in a delay in material delivery to the field. This might require a review by Humboldt County and Aviat Networks of the project schedule and deadlines. Design Freeze Phase As part of the Design Finalization Phase, a date will be set for the design freeze at which the final design and all changes must be approved and accepted by both parties. Following the design freeze, the Bill of Materials and documentation will be submitted to Aviat’s factory and the system will be scheduled for manufacturing. The Network Engineer will concurrently review all design documents and finalize any traffic plans, NMS plans, synchronization plans, traffic cutover requirements, as well as any special factory and field acceptance testing requirements for the project. During the Design Freeze Phase, the design is frozen and no further changes to the system design will be accepted without a formal change order and reevaluation of the project and delivery schedules. Refer to the project schedule for details on the planned start and finish dates for each of these phases. Deliverables Refer to section 2.2.3 for a full list of Aviat Networks design deliverables.

APPENDIX C: TRANSMISSION ENGINEERING Microwave Path Design The Aviat Networks representative who oversees transmission (“Transmission Engineer”) ensures the delivery of the best possible network solution by providing the technical direction for the over-the-path RF performance of Aviat Networks system implementation. All microwave paths designs are preliminary, pending final path surveys and frequency coordination. This includes:

• Antenna selections, antenna centerlines, and antenna mounts. • Total transmission line lengths. • Path calculations and profiles. • The size, type, quantity and configuration of each component.

Equipment proposals are simply a reflection of these preliminary designs and subject to change. It is further understood that any changes to existing or proposed antenna centerlines could justify the need for tower stress analysis or, if modification is impractical, construction of a new tower. Any such requirements will be the responsibility of Humboldt County unless otherwise stated in the Agreement. In the event that Humboldt County elects not to use Aviat Networks to perform path surveys, the performance of the microwave system will not be guaranteed by Aviat Networks and it will be up to Humboldt County to resolve any path reliability or obstruction issues. Refer to the Warranty of Path Engineering Services section below for further detail. In the event that Customer selects Aviat Networks to perform the path surveys, a formal submission detailing the results of the path survey and highlight changes needed to the preliminary design will be submitted to Humboldt County. It is expected that Humboldt County review the path survey data and schedule a meeting, if necessary, to discuss any concerns or alternate means of providing path continuity/system reliability. If no feedback is received from Humboldt County before the final system design approval, Aviat Networks will assume Humboldt County‘s acceptance of the survey data, and will immediately proceed with frequency coordination (if applicable). Microwave Path Survey, Frequency Planning and Licensing The microwave path survey shall include the following services:

• Identify geographical location of sites and antenna, waveguide length and tower requirements. • Verify path clearance objectives for each of the paths from existing or new tower locations. • Document obstruction, critical points, and reflection points in each of the paths. • Verify tower coordinates and site elevations. • Establish coordinates and height requirements for new towers, as needed for governmental agency registration and licenses

filed by Humboldt County • Confirm antenna centerlines and waveguide length requirements. Catalog antennas on the existing structures noting any

space limitations in the survey report. An Aviat engineer will review the tower for new antenna design space limitations specific to this project only but will not perform a complete tower audit.

• Perform frequency coordination based on available FCC records to reduce the potential for interference between internal or external radio sources on a given system or network.

• Aviat Networks, upon receipt of Humboldt County’s authorization, will prepare the FCC License Application Form 601 with the appropriate technical data. Information such as site location, radio type, and frequency will be listed. Aviat Networks will complete and submit the Construction Complete Form 601 on line via FCC Universal Licensing System (“ULS”).

• File Antenna Structure Registration (“ASR”) form for towers over 200 feet. The results of the survey will be utilized by Aviat Networks for preparation of final performance calculations, frequency coordination, government licensing, and tower registration requirements. In the event where Aviat Networks will not be performing the path survey, Humboldt County shall provide all the documents needed for Aviat Networks to complete the frequency coordination, licensing, and final system design. Aviat Networks will not be held accountable for validating the accuracy of the information provided by Humboldt County and assumes no responsibility in any inaccuracies of any part of the path engineering based on the information provided by Humboldt County or any contact affiliated with Humboldt County. Any corrective action required as a result of this will be billed to Humboldt County as a billable change order. Survey Procedures Preliminary path profiles are drawn based on the supplied site coordinates and contour information extracted from the best available topographic mapping. A field site survey is conducted to verify site coordinates and elevations based on North American Datum 1983 (“NAD83”) and gather information related to the proposed radio equipment and antenna locations, site access, and site development constraints. A field path survey is then conducted to verify path profile elevations, measure all natural and manmade potential obstructions and assess the reflective potential of all natural and manmade surfaces. Antenna centerline heights were calculated for the proposed frequency band by applying suitable clearance criteria based on the propagation characteristics of the geographic area. The path survey report is considered to be a representation of the information gathered in the field and as such, reflects a snap-shot in time at the time of the survey. It is not intended to show the final as-built configuration if any of the parameters were changed or updated after the survey report has been released.

Path calculation sheets are then generated for each hop, based upon the recommended centerline heights. Antenna sizes and the choice of propagation protection diversity are chosen to meet the required fade margin and the desired path propagation reliability. Propagation outage and reliability calculations are based on the Vigants model (ref. “Space Diversity Engineering”, BSTJ, 1/75). Design Criteria Path clearance criteria must be established for each path on the basis of total system performance objectives, economic considerations, and careful analysis of local atmospheric conditions derived from published climatological data, where available, and reported microwave transmission experience pertinent to the area. Antenna heights much greater than actually needed cause an unwarranted increase in system cost, and on paths with significant ground reflections, this can increase the exposure to multipath and ground reflection signal fading. It is desirable to locate the antennas high enough so that even under severe super-standard atmospheric refractive conditions (surface ducting) there is adequate clearance such that signal entrapment does not significantly degrade the fade margin of the path or generate excessive multipath fade activity. The choice of clearance criteria for a microwave path is a balance between cost and performance. The path clearance criterion as applied to a given geographic area is a function of the degree and direction of atmospheric beam bending and can conveniently be defined by the equivalent earth radius K factor:

The median propagation value of K = 4/3 allows the normal microwave horizon to be slightly extended when compared to the optical horizon; however, under certain meteorological conditions (for example, during nighttime super-refractivity usually associated with temperature inversions) the value of K increases to 2 or greater for periods of several minutes to several hours. This increases the path clearance and results in the heavy multipath fade activity seen on some reflective paths and antenna decoupling power fading on others. Microwave path performance calculations and warranties The microwave path design models most frequently employed within the industry (e.g., Vigants, and ITU-R P-530) provide a reasonably accurate (and therefore usually guaranteed) estimate of the cumulative time a path will be out of service due to random atmospheric multipath fading under normal atmospheric conditions. These models do not (and cannot) accommodate abnormal, unusual, anomalous, or otherwise unpredictable conditions of weather or atmospheric refractivity. Microwave frequency engineering/inter-system interference analysis Aviat Networks will partner with Comsearch, a CommScope company, to provide cost-effective frequency planning and FCC licensing services for radio communications systems (if required). The planning software used, considers specific operating parameters of both the proposed microwave system and the environment microwave systems (license and proposed) to properly consider the interference potential of the new path or system. Parameters and data elements incorporated into the modeling include, but are not limited to:

• Antenna type, antenna height, elevation, antenna radiation pattern • Receiver filter performance • Terrain • Radio modulation • Path orientation • Receiver threshold

These elements are required to accurately predict specific interfering levels into and from the existing microwave systems. The accuracy of the calculations is ensured by real-time maintenance of the Comsearch point-to-point microwave, earth station, radio equipment, antenna, interference objective, and contact database.

Microwave frequency selection The interference analysis performed on the microwave system identifies available frequencies considering existing and proposed systems found in the Comsearch database. When applicable, an analysis of the systems in the adjacent bands can be done to ensure the microwave system does not receive unwanted threshold degradation. In bands shared with satellite systems, an analysis of potential interference with earth stations and with the geo-stationary satellite orbit can also be done. Additionally, co-located or nearby transmitters already licensed in the required frequency band can be identified in order to reduce the possibility of “bucking” an existing high/low frequency plan that could increase the possibility of receiver overload or reflective interference from a nearby system. Microwave frequency coordination and FCC licensing The majority of microwave bands subject to FCC Rule Part 101 require prior coordination with existing licensees. Aviat Networks will partner with Comsearch to perform the frequency coordination and FCC licensing on behalf of the Customer (if required). The procedure will include notification of the technical parameters of the proposed system to all existing and proposed licensees in the area and frequency band of operation. Frequency coordination will also be performed with Canadian and Mexican authorities in border areas when necessary. By FCC rule, recipients are given 30 days to respond, or in some cases an expedited response can be requested. Upon completion of the prior coordination process, documentation required to satisfy FCC Rule Part 101.103 (d) can be prepared on behalf of the Customer. This will include any necessary exhibits, including supplemental showings required upon submittal of the requested license application. The FCC filing process includes:

• Filing of the FCC Form 601 microwave application upon written approval from Customer and providing an electronic copy of the application to Customer via email.

• Tracking the status of the application until the license is granted by the FCC. Amendments will be handled expeditiously on behalf of Customer for any questions or concerns from the FCC.

• Email notifications to the licensee when the license is granted by the FCC. • Filing of the required completion of construction notification with the FCC upon written approval from the licensee and

notification of the filing via email. Special Considerations On all microwave radio paths traversing urban areas there exists the possibility of multiple on- and off-path structural reflections which generate long-delayed echoes, as well as terrain scatter RF intra- and inter-system interference. Long delayed, low-level echoes have no effect on digital radio performance; however, the terrain scatter mechanism cannot be accurately predicted nor precisely measured without an extensive and expensive field trial. Consequently, this mechanism is specifically excluded from all current industry-wide path survey and frequency coordination performance guarantees. The structure supporting the microwave antenna can take many forms. The antenna is most often mounted on a tower but can be mounted on a variety of structures such as roof tripods, penthouse wall, wooden telephone pole, or metal monopole. It is recommended that Customer conduct a structural analysis of the support structure to determine if the structure will support the additional loading imposed by the antenna and its mount. The structure must also meet the twist and sway requirements per EIA/ANSI 222G. Site Access Access to work sites will be made available by Humboldt County for a minimum of 10 hours per day, 5 days per week or per the agreed schedule in the project plan. All roads leading to work sites shall not require more than a 4-wheel drive vehicle unless stated otherwise and agreed to by both Humboldt County and Aviat Networks. Any delays or additional cost caused by poor road conditions or site access issues not discussed prior to the start of the surveys will be billed to Humboldt County as a billable change order and could have a negative impact on the project completion schedule. FCC Rules for Filing Accuracy CFR 47, Part 1.929 specifies that filing accuracy for site coordinates shall be (+/-) 1” latitude and longitude, and for ground elevation (+/-) 1 meter (3.28 ft.). Part 1.929(k) (covering modification of FCC licenses) specifies that any change in site coordinates >5” latitude or longitude shall require prior authorization and re-coordination. Therefore, wherever our survey results deviate more than (+/-) 5” latitude or longitude, or more than +3.28 ft. site elevation, frequency re-coordination will be recommended. Terms and Conditions When Aviat Networks performs reliability calculations or path studies (path profiles from mapping or digitized data only) based solely on information supplied by or on behalf of the Customer, these calculations and studies are provided solely for budgetary purposes and shall not be construed as or be used for an installable design. When conducting a path survey, Aviat Networks will verify site coordinates and ground elevations, and record trees and man-made fixed obstructions on the path. This information will be recorded on the profile for that particular path. Aviat Networks will assign an appropriate growth factor to tree heights. When Aviat Networks performs frequency planning based, in part or its totality, on data provided by the Customer at the time of the study, Aviat Networks will not be responsible for any interference case that might arise due to errors or omissions in such data. As

the usage of microwave bands increase and there is more sharing with satellite services, it may be necessary to perform frequency interference studies and additional path surveys (to determine blockage) to alleviate the possibility of interference from satellite earth stations. Warranty of Path Engineering Services Aviat Networks warrants that the installed radio communication path will conform to Customer’s multipath performance reliability objectives when Aviat Networks has performed the path survey, recommended the path design, and implemented such recommendations. This warranty is for a period of fifteen (15) months from the date of the survey or one (1) year from the date of installation of the microwave path, whichever expires first. All Aviat Networks field activities and path propagation analysis will utilize current hardware, software, engineering practices and judgment with the goal of meeting normal Path Loss, as defined in TIA/EIA Standard RS-252-A. Aviat Networks is not responsible for paths that it does not survey, nor for changes in path design beyond those specifically allowed in the path survey report or in writing after the field survey is completed, including but not limited to: • Any change in path design; • Any movement in site locations; • Any building or other structure built on-path after date of survey; • Any disturbance of the terrain which may cause blockage or reflection; • Any additional frequency interference source; • Any change of available antenna mounting space on tower. Any one of these changes listed will nullify the warranty, and the Customer shall in such case bear the total cost of determining that such change was the cause. Aviat Networks will not be responsible for degraded path performance when such degradation is due to such anomalous propagation conditions as: • Long-term loss of fade margin due to antenna decoupling misalignment caused by widely-varying k-factor changes; • Long-term loss of fade margin due to atmospheric boundary layering (“ABL”) causing wave front defocusing (beam spreading),

signal entrapment (blackout fading), ducting, and other such occurrence. • Excessive rain outage rates beyond the published crane and/or chart data used in the calculation; • Degradation resulting from certain types of multipath interference attributed to unidentifiable off-path terrain features or structures; • Any other technological or atmospheric condition not foreseeable through the exercise of prudent engineering knowledge and

judgment. Additionally, Aviat Networks will not be responsible for degraded path performance when: • Non-Aviat Networks radio equipment is installed on a surveyed path; • Aviat Networks radio equipment is not installed by Aviat Networks; • Existing antenna and waveguide system is used without test and inspection performed by Aviat Networks. Aviat Networks designs the microwave path based upon engineering practices and standards common to the industry. When path loss or reliability objectives are not achieved, Customer’s sole remedy, and Aviat Networks’ exclusive liability in connection with path engineering, shall be that Aviat Networks will provide incremental labor and material to optimize the antenna system to meet the requirements created during initial installation. Where anomalous propagation is suspected in an installed microwave path, Aviat Networks will work with the Customer to obtain reasonable evidence that such condition exists. The total retroactive costs for such study shall be the responsibility of the Customer, and Aviat Networks will provide in-office engineering support at Customer’s expense. The cost of relocating towers, antennas, passive reflectors, or other measures required to remedy this type of problem shall solely be the responsibility of the Customer. Deliverables Refer to section 2.3.3 for a full list of Aviat Networks path design deliverables.

8. APPENDIX D: PROJECT ENGINEERING Microwave Site Design The Aviat representative overseeing implementation (“Project Engineer”) will perform field site surveys to verify that telecommunications equipment can be installed, powered and commissioned effectively at each site, antennas, waveguide and accessories can be connected to radios (towers, shelters and buildings), and Customer traffic, alarms and dehydrator lines are fully engineered. Microwave Site Survey The microwave site survey is intended to gather data and identify the gap(s) between the site’s present state and the site readiness for equipment installation, document any visible issue with the existing infrastructure and equipment that would pose a quality or safety issue during installation, gather environmental data and requirements for telecommunication equipment to function properly (including but not limited to HVAC, temperature, humidity, the general state of the facility as well as seismic evaluation and compliance if required), record flooring, ceiling, racking data and requirements to mount new equipment (including floor plans, relay rack profiles, aisle numbering plans, and ceiling hangers, ladders, and anchor materials required to meet quality and safety standards. The survey is also intended to record AC, DC, grounding (as is and to be), and breaker assignments and ensure power and grounding standards are met, identify demarcation types and location between new and existing equipment as well as the type of termination and the details required to terminate to the Customer provided equipment, identify existing radio equipment (fixed and mobile) as well as their operating frequencies, record existing waveguide, dehydrator component and their associated cabling, identify all required or existing tower structures, mounting structures, antenna mounting types, waveguide ladder systems, entryway into telecom shelters, and energy sources. The results of the survey will be published and released in a site survey report and will be utilized by Aviat Networks for preparation of final power calculations, waveguide requirements, field OEM requirements, installation specifications, field test plans, and traffic cutover plans. In the event where Aviat Networks will not be performing the site survey, Humboldt County shall provide all the documents needed to Aviat Networks to complete the site engineering and final system design. Aviat Networks will not be responsible for validating the accuracy of the information provided by Humboldt County and assumes no responsibility in any inaccuracies of any part of the site engineering and microwave site design when such design is based on the information provided by Humboldt County or any contact affiliated with Humboldt County. Any corrective action required as a result of this will be billed to Humboldt County as a billable change order. Site Access Access to work sites will be made available by Humboldt County for a minimum of 10 hours per day, 5 days per week or per the agreed schedule in the project plan. All roads leading to work sites shall not require more than a 4-wheel drive vehicle unless stated otherwise in this SOW and agreed to by both Humboldt County and Aviat Networks. Any delays or additional cost caused by poor road conditions or site access issues not discussed prior to the start of the surveys will be billed to Humboldt County as a billable change order and may have a negative impact on the project completion schedule. Field Installation Management Aviat Networks will manage the day-to-day activities of the field installation with support from Humboldt County to ensure the project remains on schedule as per the agreed project schedule. 9. APPENDIX E: INSTALLATION, INTEGRATION & TESTING The installation, integration, and testing services include design-supported methodologies, product expertise, and field-proven processes to help ensure a quality installation and testing of critical system paths and hardware so that the network performs according to its design. Aviat Networks will designate a primary point of contact to answer any Humboldt County questions, provide guidance, and address issues specific to this service. This SOW is based on an Aviat Networks standard installation schedule of 10-hour days, 6 days per week. Aviat Networks will adjust this SOW for work week schedules outside of Aviat Networks’ standard. Installation work performed during maintenance windows is not included in this SOW unless specifically identified. All work will be done in accordance with Aviat Networks’ best practices guide. Scope Delivery of this service will utilize the design documentation developed as part of the planning and design phase. Field crews will utilize this documentation to:

• Install antenna systems • Install transmission lines • Install indoor microwave equipment, racks and components • Perform antenna alignment • Perform system testing

System implementation is predicated upon completion of civil construction and complete site readiness. Antenna, waveguide and equipment installation activities will be performed at the same time on a per-site basis. As part of the delivery of this service, Aviat Networks may choose to integrate equipment at the manufacturer’s location to minimize onsite installation time and provide a common point for quality assurance inspections. If staging areas are utilized as part of the project, equipment and materials will be delivered from these facilities to site by the installation crews. It is recommended that Humboldt County provide maintenance technicians during any service affecting work. The successful completion of all installation, integration, and testing services are based on uninterrupted, contiguous-site installation and testing. Additional mobilizations are not included in the pricing and project schedule. If installation is delayed due to inclement weather, inaccessible sites(s), incomplete site preparation, or construction, the following charges may apply and will be billed to Humboldt County as a billable change order:

• Standby time for antenna installation teams will be charged at a rate of $1,220 per person per day. • Standby time for radio teams will be charged at a rate of $1,225 per person per day. • If re-mobilization of the installation crew is necessary, then a two-week advance notice is required. • Re-mobilization will be billed on a time-and-expenses basis. • Service costing assumes use of 4-wheel drive vehicles for all project related vehicles. Additional requirements such as ATVs

may require additional service costs. • If the field crew(s) is required to work out of contiguous sequence due to conditions beyond the control of Aviat Networks, a

charge equal to one day for each crew person will be assessed to the Customer for each occurrence. Site Access Access to work sites will be made available by Humboldt County for a minimum of 8 hours per day, 5 days per week or per the agreed schedule in the project plan. Site Services All work permits, public agency approvals, leasing agreements, zoning permits or inspections required at each site, soil analysis, foundation design, civil documentation for existing shelters or towers, architectural blueprints, plot plans, structural analysis for new or existing antenna systems, location of all site boundaries and features (including locating and marking tower location, true North, property boundaries, paved areas, landscaping, fences and any other underground/overhead obstruction which could interfere with construction and access), and/or other related documentation for this project will be obtained, conducted, completed and made available to all parties involved prior to the start of any installation, integration or testing services. All other construction and installation work will be conducted in accordance with local city, county, state, and government laws and regulations. All equipment including radios, antennas and racks will be stored by Customer in a secure location at the site or at a designated location. Humboldt County shall be responsible for the loss of any equipment, tools, or personal belongings from any secured location provided or monitored by Humboldt County Installation

Humboldt County shall verify that each site is ready for installation and commissioning activities, including Humboldt County supplied equipment installation and power up prior to the start of any such services and shall be responsible for any delay caused or cost incurred due to sites not being ready, as stated in the project scope of this SOW. An inspection will be performed with Humboldt County after completing the physical installation. Workmanship deficiencies will be noted on a punch list for immediate correction. This inspection is not intended to verify operation of the new system or suitability of components, but rather to inventory and document that all equipment and materials from the schedule of values are installed to acceptable workmanship quality standards. Site drawings will be reviewed and red-lined to reflect the installed condition. Testing Test crews will begin work immediately after installation is complete. Testing, based on a standard set of Aviat Network test cases, will be performed on all provided equipment to confirm configuration, operation and manufacturer’s specifications. Test data will be recorded on field test sheets, by technical field personnel who will also be responsible for documenting test results and any changes made to the design documentation. The test crews will be trained on the equipment and utilize test equipment to perform all tests. Test equipment will have valid calibration certifications, which can be verified prior to commencing any tests. It is recommended that Humboldt County take the opportunity to have their maintenance technicians witness or participate in field commissioning testing to gain on-the-job training and experience on the new system components. Commissioning tests will consist of a set of standard Aviat Networks test cases and include turn-up and performance verification tests and circuit tests to verify end-to-end continuity and equipment operation as well as any other tests documented in the field acceptance test plan. The field acceptance test plan shall be approved and agreed to by Aviat Networks and Humboldt County prior to test execution. Test results will be recorded on field test data sheets and submitted to Humboldt County Refer to the field acceptance test document for details on the test to be performed. System tests will be performed on a logical section/loop of the system. The system tests will be designed to demonstrate performance and functionality of system features as-well as end-to-end operation of individual circuits/services. System test results will establish benchmark system performance and operation prior to cut-over and acceptance. The test data sheets prepared during commissioning and system testing will become the base line document for maintenance and performance evaluation of the system over an extended period of time. Humboldt County will be required to review the commissioning and acceptance testing and results and red-lined drawings and provide approval of the data and authorization to proceed with cut-over activities. Traffic Cut-over All cut-over activities will be the responsibility of Humboldt County Safety The health and safety of all individuals, whether in the field, plant or office, takes precedence over all other concerns. Management's goal is to prevent accidents and to reduce personal injury and occupational illness and comply with all safety and health standards. A code of safe conduct is important to the efficiency of operations. To the greatest degree possible, Humboldt County will provide physical safeguards required for personal safety and health in keeping with the highest standards. Aviat Networks requires a written report from Customer for all accidents and incidents, no matter how small. Safety and first aid material and supplies will be provided to all Aviat Network construction and installation personnel or made available at each site for the duration of this project. All safety and first aid material will be stocked at acceptable levels and will have not exceeded the expiration dates where applicable. Humboldt County will be responsible for providing Aviat Networks with the location and phone numbers of all local emergency agencies. 10. APPENDIX F: ASSUMPTIONS & EXCLUSIONS The following assumptions will govern the delivery of the project management service:

• This SOW and associated pricing is based on Humboldt County completing all items set forth in this SOW as being Humboldt County responsibility to ensure site readiness.

• Any inaccuracies in FCC data may drive additional services costs during field implementation. In addition, any other troubleshooting tasks related to frequency interference issues that are not directly attributable to Aviat Networks are subject to additional service fees at rates define in this SOW.

• All equipment interconnections or termination points, unless specified otherwise, are estimated to be fifty (50) feet. This project does not include any cabling between buildings, rooms, or floors, unless specifically identified in this SOW.

• Customer provided construction drawings will have sufficient details for Aviat engineering to order antenna mounting or any other related material required. Any re-engineering to provide correct mounts or material required by Aviat Networks may increase cost to Humboldt County

Unless otherwise stated in this SOW, the services provided by Aviat in this SOW shall be subject to the following terms:

• Aviat shall not be responsibility for managing Humboldt County project responsibilities and deliverables. • This SOW is a listing of roles and responsibilities to be provided by Aviat Networks. Aviat Networks shall not be

responsible for the condition of existing equipment or the deficiencies of non-Aviat Networks provided labor. Only the labor addressed in this SOW shall be provided by Aviat Networks.

• On-site technicians will decline any Humboldt County request for work outside the scope of work defined and agreed upon in this SOW unless it is addressed in a change order.

• Aviat Networks proprietary documentation used by service delivery teams to perform this service is not available to Humboldt County

• Aviat shall not provide proprietary information on methods, procedures, or tools to perform the services in this SOW. • Aviat shall not perform any and services that are not specifically described within this SOW as being provided by Aviat

Networks. • Aviat Networks will not be responsible for the resolution of other vendor issues affecting the completion of the cutover.

Aviat Networks can provide guidance and support to Humboldt County in resolving interoperability issues, where applicable.

• Aviat shall not repair equipment not in the engineering drawings. Equipment requiring repair that is not included in the engineering drawings but is still under warranty must follow Aviat’s repair and return procedures.

• Additions or changes to ironwork, cable racks, or fiber ducts are not included and can be quoted separately after site visit information is collected

• AC power drop wiring within three (3) feet of DC power plants is excluded, unless specifically quoted

SUMMARY: A RESOLUTION IN SUPPORT OF THE INDIVIDUAL RIGHT OF HUMBOLDT COUNTY CITIZENS TO KEEP AND BEAR ARMS AS PROTECTED BY ARTICLE 1, SECTION 11 OF THE NEVADA CONSTITUTION AND THE SECOND AND FOURTH AMENDMENTS OF THE UNITED STATES CONSTITUTION.

RESOLUTION NUMBER:

states: WHEREAS, Article 1, Section 11 of the Nevada Constitution 1. Every citizen has the right to keep and bear arms for security

and defense, for lawful hunting and recreational use and for other lawful purposes.

2. The military shall be subordinate to the civil power; No standing army shall be maintained by the state in time of peace, and in time of War, no appropriation for a standing army shall be for a longer time than two years; and

WHEREAS, the Second Amendment of the United States Constitution, states:

A well-regulated Militia, being necessary to the security of a free state, the right of the people to keep and bear Arms, shall not be infringed; and

WHEREAS, the Fourth Amendment of the United States

Constitution, states: The right of the people to be secure in their persons, houses,

papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized; and

WHEREAS, Pursuant to NRS 282.020, members of the

Legislature and all officers, executive, judicial and ministerial, shall, before they enter upon the duties of their respective offices, take and subscribe to the following oath:

and economic benefit from all safe forms of firearms recreation, hunting, and shooting conducted within Humboldt County using all types of firearms allowable under the United States and Nevada constitutions; and

WHEREAS, We the Humboldt County Board of County

Commissioners take seriously the protection of our rights under the United States and Nevada Constitution; and

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF HUMBOLDT COUNTY, NEVADA THAT:

1. That the Humboldt County Board of County Commissioners opposes the enactment of any legislation, state or federal, that would unconstitutionally infringe upon the lawful rights of residents to keep and bear arms, including the rights of private individuals to lawfully sell or transfer their legally owned firearms without undue government burden and to be free from unreasonable search and seizure;

2. That the Humboldt County Board of County Commissioners fully supports the oath of office taken by its elected officials and adopts it as its own.

SUMMARY: RESOLUTION PROCLAIMING SEPTEMBER 14, 2019 AS

“HUMBOLDT DAY” IN HUMBOLDT COUNTY, NEVADA

PROCLAMATION

WHEREAS, Friedrich Wilhelm Heinrich Alexander von Humboldt was born

September 14, 1769, in Berlin, Germany, to Alexander Georg and Maria

Elisabeth von Humboldt; and

WHEREAS, Friedrich, better known as Alexander von Humboldt, was

educated in Germany at the University of Frankfurt an der Oder, the

University of Göttingen, and the School of Mines in Freiberg, Saxony, and

earned an appointment in the Mining Department of the Prussian

government where he invented a safety lamp and established a technical

school for young miners; and

WHEREAS, Alexander’s great passion for botany and enthusiasm for

scientific exploration led him to finance a four-year expedition to Central

and South America where his explorations resulted in doubling the

number of known plant varieties with his name incorporated into more

than 300 of their species names; and

WHEREAS, While adventuring through South America, Alexander von

Humboldt ascended Mount Chimborazo to a height of 19,286 feet that

held as the world mountain climbing record for three decades, and he

became the first documented person to recognize that a lack of oxygen

in the air at great heights results in mountain sickness; and

WHEREAS, He was a great promoter of international cooperation in

science and developed abiding friendships with famous scientists while

evoking the respect of the populace by sharing his vision of scientific

contributions through 30 scientific volumes; and

WHEREAS, Known as the father of ecology, Alexander von Humboldt

influenced great 19th century naturalists and explorers such as Charles

Darwin, John Charles Fremont, John Muir, and Henry David Thoreau; and

WHEREAS, In 1845, John C. Fremont helped create the first accurate map

of the river that made the journey across Nevada’s Great Basin possible

and gave it Alexander von Humboldt’s last name; one of the oldest

counties in Nevada, this Humboldt County, also shares the moniker; now,

therefore, be it

PROCLAIMED, That on September 14, 2019, the 250th Anniversary of

Friedrich Wilhelm Heinrich Alexander von Humboldt’s birth, we will stop

to appreciate his pioneering work in environmentalism and celebrate his

plentiful scientific accomplishments.
