ORDER
1. It shall be the duty of the Chairman to maintain order and decorum at meetings. The Chairman shall speak to points of
order in preference to all other members. 2. In maintaining decorum and propriety of conduct, the Chairman shall not be challenged and no debate shall be allowed
until after the Chairman declares that order has been restored. In the event the Board wishes to debate the matter of the disorder or the bringing of order; the regular business may be suspended by vote of the Board to discuss the matter.
3. No member or citizen shall be allowed to use abusive language, excessive noise, or in any way incite persons to use
such tactics. The Chairman and/or the County Administrator shall be the judge of such breaches, however, the Board may vote to overrule both.
4. When a person engages in such breaches, the Chairman shall order the person’s removal from the building, or may order the person to stand silent, or may, if necessary, order the person removed from the County property.
PUBLIC HEARING RULES OF PROCEDURE
1. PURPOSE
The purpose of a public hearing is to receive testimony from the public on certain resolutions, ordinances or amendments prior to taking action. A hearing is not a dialogue or debate. Its express purpose is to receive additional facts, comments and opinion on subject items.
2. SPEAKERS Speakers should approach the lectern so they may be visible and audible to the Board. Each speaker should clearly state his/her name and address. All comments should be directed to the Board. All questions should be directed to the Chairman. Members of the Board are not expected to respond to questions, and response to questions shall be made at the Chairman's discretion. Speakers are encouraged to contact staff regarding unresolved concerns or to receive additional information. Speakers with questions are encouraged to call County staff prior to the public hearing. Speakers should be brief and avoid repetition of previously presented comments.
3. ACTION At the conclusion of the public hearing on each item, the Chairman will close the public hearing. The Board will proceed with its deliberation and will act on or formally postpone action on such item prior to proceeding to other agenda items.
Further public comment after the public hearing has been closed generally will not be permitted.

DISCUSSION:
Although there is no federal or state regulation requiring employers or governmental agencies to provide for bereavement leave, most employers provide some kind of leave to address a leave during times of bereavement. The Commonwealth of Virginia personnel policies do not specifically designate bereavement leave type, the intent of such leave is presently addressed in the existing Virginia Sickness and Disability Program (VSDP) which provides up to 40 hours of leave for family and other purposes, which may include bereavement as well as other specific needs. The proposed Bereavement Leave policy for Fluvanna County provides regular full time and part time benefit eligible staff up to 3 days paid bereavement leave and the option to use additional available earned leave time, if necessary, to grieve and handle matters related to a death of an immediate family member. The proposed policy provides a definition of family member and also provides authority to the County Administrator or Constitutional Officer to approve other relationships on a case-by-case basis without setting precedent.

N.10 BEREAVEMENT LEAVE (Draft 01/2015) Bereavement leave is designed to provide employees with paid time away from work to grieve and to handle matters related to a death in their immediate family. Eligibility and Length of Leave All Regular full time staff are eligible for up to three days paid Bereavement Leave upon the death of an immediate family member. Regular part time staff will be compensated for regularly scheduled work hours only on the approved Bereavement Leave days. Immediate family is defined as:
- Spouse - Child (natural/step/adopted/foster) - Parent (natural/step/adoptive) - Sibling (natural/step/adopted) - Immediate in-laws (father, mother, sister, brother, son, daughter) - Grandparents (immediate or spousal) - Legal Guardian - Person living in the same household as the employee
Other relationships may also be approved on a case-by-case basis by the County Administrator or Constitutional Officer without setting precedent. Notification Employees taking Bereavement Leave will notify their supervisor as soon as possible of the funeral arrangements, anticipated length of leave, where the employee can be reached during the Leave, and other appropriate information. In no case will Bereavement Leave begin before the Supervisor is notified. Other Circumstances If the employee requires more than 3 days leave in the event of a death in the immediate family, vacation, personal, comp, sick, or leave without pay may be requested for the additional days. An employee may request leave for the death of a non-immediate family member or a friend. In this case, vacation, personal, comp or leave without pay may be requested.

Nichols, County Administrator Fred Payne, County Attorney Kelly Belanger Harris, Clerk to the Board of Supervisors CALL TO ORDER/PLEDGE OF ALLEGIANCE/MOMENT OF SILENCE Mr. Steven M. Nichols, County Administrator, called the annual Organizational Meeting of Wednesday, January 7, 2015, to order at 4:00 pm, in the Circuit Courtroom in Palmyra, Virginia. After the Pledge of Allegiance was recited, Mr. Nichols called for a moment of silence. 2014 Organizational Meeting of the Fluvanna County Board of Supervisors Election of Chairperson - This action will elect a Chairperson to the Board of Supervisors for 2015. Mr. Steven M. Nichols, County Administrator, opened the floor for nominations for Chairperson.
Mr. Ullenbruch nominated Supervisor Booker, and it was seconded by Mr. O’Brien. VOTE COUNT: 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, & Weaver. NAY: None With a vote of 5-0, Supervisor Booker was elected Chairperson.
Chairperson Booker welcomed the supervisors to the first meeting of 2015. Election of Vice-Chairperson - This action will elect a new Vice-Chairperson to the Board of Supervisors. Chairperson Booker opened the floor for nominations for Vice-Chairperson.
Mr. Weaver nominated Supervisor Ullenbruch, and it was seconded by Mr. Sheridan. VOTE COUNT: 5-0 AYE: Booker, Ullenbruch, O’Brien, Sheridan, & Weaver. NAY: None. With a vote of 5-0, Supervisor Ullenbruch was elected Vice-Chairperson.
Resolution Entitled “Organizational Meeting of the Fluvanna County Board of Supervisors 2015” - The Code of Virginia requires an annual organizational meeting of the Board of Supervisors for the election of officers and the conduct of such other business as to meeting times and dates.
MOTION: Mr. Sheridan moved to adopt the resolution entitled “Organizational Meeting of the Fluvanna County Board of Supervisors 2015” which designates the location, day, and time of meetings.
Meeting Place: Circuit Courtroom of the Fluvanna County Courts Building Meeting Times:
Day Meetings begin at 4:00 p.m. and end at 8:00 p.m., unless extended; Night Meetings begin at 7:00 p.m. and end at 11:00 p.m., unless extended; When scheduled, Work Sessions begin at 4:00 p.m. prior to the evening meeting.
Mr. Ullenbruch seconded. The motion carried with a vote of 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, & Weaver. NAY: None. Selection of Dates for the Board Meetings - This action will adopt the Board of Supervisors 2015 Regular Meeting Calendar, as presented.
MOTION: Mr. Ullenbruch moved to adopt the Board of Supervisors 2015 Regular Meeting Calendar as presented. Mr. Weaver seconded and the motion carried with a vote of 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, and Weaver. NAY: None.
Adoption of Board By-Laws and Rules of Practice and Procedures - This action will adopt the Fluvanna County Board of Supervisors By-Laws and Rules of Practice and Procedures.
MOTION: Mr. Ullenbruch moved to adopt the Fluvanna County Board of Supervisors By-Laws and Rules of Practice and Procedures. Mr. O’Brien seconded. The motion carried with a vote of 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, and Weaver. NAY: None.
Special Presentation - Mr. Nichols presented Mrs. Booker with a Plaque recognizing Mrs. Booker for her service on the Board of the Virginia Association of Counties since 2012.

ADOPTION OF AGENDA MOTION Mr. O’Brien moved to accept the Agenda for the January 07, 2015, Regular Meeting of the Board of Supervisors. Mr. Ullenbruch seconded and the Agenda was adopted with a vote of 5-0. AYE: Booker, O’Brien, Sheridan, Ullenbruch, and Weaver. NAY: None.
COUNTY ADMINISTRATOR’S REPORT Mr. Nichols reported on the following topics:
Jason Smith, Parks & Recreation Director • Letter of Appreciation from the Virginia Recreation and Park Society (VRPS) • Served as Special Events and Activities Chair for the 60th Annual VRPS Conference
New signs at Pleasant Grove Park Chamber Ribbon Cutting
• Village Oaks Subdivision • Tuesday, January 13th, 10:00 am
Bobby Popowicz and other regional economic development partners will be making a joint presentation to the Virginia Economic Development Partnership (VEDP) in Richmond, VA on February 6, 2015 to showcase the Region. Event brings awareness of the great location and workforce the region has to offer. Each county will have the opportunity to speak about their program and assets.
Will present FY15 Budget Update and pending CIP Projects List at Jan 21st Work Session for Board review and discussion. • May need to delay or cancel some projects.
The Board of Equalization BOE will meet for hearings with citizens starting in January: January 13, 15, 20, 22, & 27, at 10 am – 4 pm in the “BOE Building,” the small brick building in front of the Commissioner of Revenue/Treasurer’s office. More dates to be added as warranted.
BOARD OF SUPERVISORS UPDATE Ullenbruch—Will attend the Jail Board meeting, January 8, 2015. Booker—Interagency Meeting; Youth Advisory Council—afterschool program for middle-schoolers beginning in February; some transportation will be available for a fee. PUBLIC COMMENTS #1 Chairperson Booker opened the first round of Public Comments.
• Scott Leake, staff member from Congressman Robert Hurt’s office, wished to welcome the Board to a new year and commended the Board on its collegial behavior. Made brief comments on what is happening in Congress; noted ongoing budget issues on the national level, including sequestration. Reminded Supervisors that there will again be a local elected officials appreciation dinner in late March/early April with formal invitations to follow.
• Franklin Butler, 1535 Bybees Church Rd, addressed the Board with his concerns regarding his wish for the county to enact a barking dog ordinance. Mrs. Booker asked Mr. Nichols to speak to what has historically been considered in the County. Mr. Nichols noted that there is no Barking Dog Ordinance; Mr. Fred Payne noted that there is a legal remedy which can be found in Nuisance Law. Mr. Payne also noted that there is no ability to legislate good neighbors. Mr. Butler thanked the Board for listening.
With no one else wishing to speak, Chairperson Booker closed the first round of Public Comments. PUBLIC HEARINGS None. ACTION MATTERS None. PRESENTATIONS Strategic Initiatives Update, Dr. Jackie Meyers, highlighted several changes since her last update, including:
Market Fluvanna, Gala Celebration, January 24, 2015 at the Fluvanna High School; Partnership with Piedmont Wine Country Partnership; First Annual Report is nearly complete; Planning Commission hopes to present a completed draft of the Comprehensive Plan to the Board of Supervisors in
March 2015; Emergency Services Cost Recovery; Potential Meals Tax referendum; Business License discussions;

MOTION Mr. Weaver moved to approve the items on the Consent Agenda for January 7, 2015. Mr. Ullenbruch seconded and the motion passed 5-0. AYES: Booker, Ullenbruch, O’Brien, Sheridan, and Weaver. NAYS: None. ABSENT: None.
UNFINISHED BUSINESS Mr. Weaver asked if there is any documentation or supporting information about the budget being provided to Supervisors before the Budget Briefings, Work Sessions, or next Board Meeting. Mr. Nichols indicated that there are issues that need clarifying before he sends that information. Mr. O’Brien asked what the issues are. Mr. Nichols noted that continued Emergency Services, CSA, and the Regional Jail costs are impacting the budget process. The County Administrator and Finance Department will meet with individual Supervisors on January 20th for initial draft budget reviews. NEW BUSINESS None. PUBLIC COMMENTS #2 Chair Booker opened the floor for the second round of public comments. With no one wishing to speak, Chair Booker closed the second round of public comments. CLOSED MEETING
MOTION TO ENTER INTO A CLOSED MEETING At 5:10pm, Mr. Weaver moved the Fluvanna County Board of Supervisors enter into a closed meeting, pursuant to the provisions of Section 2.2-3711 A.5 and Section 2.2-3711 A.6, of the Code of Virginia, 1950, as amended, for the purpose of discussing Prospective Industry and Investment of Funds. Mr. Sheridan seconded. The motion carried, with a vote of 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, and Weaver. NAY: None. ABSENT: None.
MOTION TO EXIT A CLOSED MEETING & RECONVENE IN OPEN SESSION At 5:56pm, Mr. Weaver moved that the Closed Meeting be adjourned and the Fluvanna County Board of Supervisors convene again in open session and “BE IT RESOLVED to the best of my knowledge (i) only public business matters lawfully exempted from open meeting requirements under Section 2.2-3711-A of the Code of Virginia, 1950, as amended, and (ii) only such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed, or considered in the meeting.” Mr. O’Brien seconded. The motion carried, with a roll call vote of 5-0. AYE: Booker, Ullenbruch, O’Brien, Sheridan, and Weaver. NAY: None. ABSENT: None.

DISCUSSION:
The School System currently has a fleet of vehicles used primarily to transport special needs children to and from locations outside of the County. The School System contacted the County to help source another vehicle to replace another vehicle in their aging fleet. The Taurus was used by the Sheriff’s Office as an Administrative vehicle. The mileage is extremely low (Approx. 50K miles) for the model year. The Taurus is in good condition and will serve as a reliable replacement for the School.

RURAL RUSTIC ROAD PROJECT ROUTE 714, UNION CHURCH ROAD
The Board of Supervisors of Fluvanna County, in regular meeting on the 21st day of January, 2015, adopted the following:
RESOLUTION
WHEREAS, Section 33.1-70.1 of the Code of Virginia, permits the hard surfacing of certain unpaved roads deemed to qualify for designation as a Rural Rustic Road; and
WHEREAS, any such road must be located in a low-density development area and have no more than 1,500 vehicles per day; and
WHEREAS, the Board of Supervisors of Fluvanna County, Virginia desires to consider whether Route 714 Union Church Road, From: Route 640 Shores Road To: End of State Maintenance should be designated a Rural Rustic Road; and
WHEREAS, the Board is unaware of pending development that will significantly affect the existing traffic on this road; and
WHEREAS, the Board believes that this road should be so designated due to its qualifying characteristics; and
WHEREAS, this road is in the Board’s six-year plan for improvements to the secondary system of state highways.
NOW, THEREFORE, BE IT RESOLVED, the Board hereby designates this road a Rural Rustic Road, and requests that the Residency Administrator for the Virginia Department of Transportation concur in this designation.
BE IT FURTHER RESOLVED, the Board requests that this road be hard surfaced and, to the fullest extent prudent, be improved within the existing right-of-way and ditch-lines to preserve as much as possible the adjacent trees, vegetation, side slopes, and rural rustic character along the road in their current state.
BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Virginia Department of Transportation Residency Administrator.
