BUSH FIRES ACT 1954 - SECTION 33NOTICE TO ALL OWNERS AND/OR OCCUPIERS OF LAND SITUATED IN THE SHIRE OF ASHBURTON
Pursuant to the powers contained in Section 33 of the Bush Fires Act 1954, you are hereby required on or before the 1st day of January, (or within fourteen days of your becoming owner or occupier of land should this be after the 1st day of January), to clear and maintain mineral earth breaks and reduce the fuel load from the land owned or occupied by you as specified hereunder and to have the specified land and firebreaks clear of all flammable material all year round.
(1) LANDINTOWNSITES-INCLUDINGMININGANDORCONSTRUCTIONACCOMMODATIONFACILITIES
1.1 Wheretheareaoflandis2000squaremetres(approximately1/2anacre)orless,allflammablematerialmustbereducedoverthewholeoftheland.Grassesshallbeslashedtoaheight75mm.
1.2 Wheretheareaoflandexceeds2000squaremetres,mineralearthbreaksofatleastfive(5)metresinwidthmustbeclearedofallflammablematerialimmediatelyinsideandalongtheboundariesoftheland.Wheretherearebuildingsonthelandadditionalmineralearthbreaksfive(5)metresinwidthmustbeclearedimmediatelysurroundingeachbuilding.
(2) LANDOUTSIDETOWNSITESINCLUDINGMININGANDORCONSTRUCTIONACCOMMODATIONFACILITIES
2.1 Forallbuildingsonlandoutsideofthetownsite,twomineralearthbreakswithawidthnotlessthanfive(5)metresandclearedofallflammablematerialmustsurroundthebuildings.Theinnermineralearthbreakmustbesitednotbelessthantwenty(20)metresfromtheperimeterofthebuildingorgroupofbuildingsandtheoutermineralearthbreaksitednotlessthanonehundred(100)metresfromtheinnermineralearthbreak.
(3) POWERLINESANDPOWERTRANSMISSIONLINESINTOWNSITESINCLUDINGMININGANDORCONSTRUCTIONACCOMMODATIONFACILITIES
3.1 AerialhazardstopowerandpowertransmissionlinesmustbemaintainedaspertheguidelinesissuedbytheEnergy Safety - Department of Mines, Industry Regulation and Safety.
Forpowerlinesconductinglessthanorequalto33,000volts;groundfuelssuchasgrassesandgroundstoreyspeciesmustbeclearedtoaminimumoffive(5)metreseithersideofacentrelinecreatedbythepoles,ortowers.Thetotalclearedareamustnotbelessthanten(10)metreswideandtheentireareamustbemaintainedtothestandardofamineralearthbreak.
3.2 Forpowertransmissionlinesgreaterthan33,000volts,amineralearthbreakofnotlessthanfive(5)metresinwidthmustbemaintainedeithersideofthewidestpointofanyarmsorcrossarmsonthepoleortower.Amineralearthbreakofnolessthanfive(5)metreswidthistobemaintaineddirectlyunderthepowerlinecorridor.AllpowerandtransmissionlinesaretobemaintainedasperAustralianStandardAS7000,toassistinminimizingtheriskfromsparksorarcingandshallbetheresponsibilityoftheownerofthetransmissionline.

(4) WATERSUPPLYPIPELINESANDINFRASTRUCTURE
4.1 Allwatersupplypipelinesandassociatedinfrastructuremusthavemineralearthbreaksnotlessthanfive(5)metreswideonbothsidesofthepipelineandallassociatedinfrastructureandbeclearedofallflammablematerialtopreventthespreadoffireanddamagetothepipelinesorassociatedinfrastructure.AccesspointsmustbeinstalledandmaintainedtoallowforEmergencyServicesaccessandmaintenanceuse.
(5) EXPLOSIVESMAGAZINESANDSTORAGEAREAS
5.1 AllFlammableMaterialsaretoberemovedtobareearthbetweenanybunkersorstoragefacilitiesandallFlammableMaterialsaretoberemovedforadistanceofnotlessthanfifteen(15)metresfromtheperimeterofanysuchstoragearea.
(6) FUELDEPOT/FUELSTORAGEAREA/HAYSTACKS/STOCKPILEDFLAMMABLEMATERIAL
6.1 Forallfueldepots/fuelstorageareasallflammablematterwithin10metresofwherefueldrums,fuelrampsorfueldumpsarelocated,andwherefueldrums,whethercontainingfuelornot,arestored.
6.2 Forallhaystacks/stockpiledflammablematerialsamineralearthbreakofnotlessthanfive(5)metresinwidthmustbeinstalledimmediatelyadjacenttoanyhaystacksorstockpiledflammablematerial.
(7) RAILWAYRESERVESINTOWNSITES
7.1 Mineralearthbreaksofatleastfive(5)metresinwidthmustbeinstalledimmediatelyinsideallboundariescontinuouswithanyrailwayreserveonwhichrailwaytrafficoperatesandaretheresponsibilityoftheowneroftherailway.
(8) APPLICATIONTOVARYFIREBREAKREQUIREMENTS
IfyouconsiderittobeimpracticaltoclearamineralearthbreakorremoveflammablematerialasrequiredbythisNotice,youmayapplytoCounciloritsAuthorisedOfficernolaterthanthe30thdayofAugust,forpermissiontoprovidefirebreaksinalternativepositionsortakealternativeactiontoremoveorabatefirehazards.IfpermissionisnotgrantedbyCouncilorAuthorisedOfficer,youmustcomplywiththerequirementofthisNotice.
(9) BURNINGGARDENREFUSEDURINGLIMITEDBURNINGTIMES
9.1 Apersonmustnotburngardenrefuseataplace(otherthanarubbishtip)duringthelimitedburningtimesforthatplaceunlessitisburned:
(a)inanincineratorinaccordancewithsubsection(2);or
(b)onthegroundinaccordancewithsubsection(3).
9.2 Gardenrefuseburnedinanincineratorisburnedinaccordancewiththissubsectionwhere:
(a)theincineratorisdesignedandconstructedsoastopreventtheescapeofsparksorburningmaterial;and
(b)either
(i) theincineratorissituatednotlessthantwo(2)metresfromanybuildingorfence;or
(ii) iftheincineratorislessthantwo(2)metresfromabuildingorfence,theCounciloritsAuthorisedOfficerhasgivenwrittenpermissioninwritingfortheincineratortobeused;and
(c)thereisnoflammablematerialwithintwo(2)metresoftheincineratorwhileitisinuse;and
(d)atleastonepersonispresentatthesiteofthefireatalltimesuntilitiscompletelyextinguished;and
(e)thefireisnolongerrequired,thepersonensuresthatthefireiscompletelyextinguishedbytheapplicationofwaterorearth.
9.3 Gardenrefuseburnedonthegroundisburnedinaccordancewiththissubsectionwhere:
(a) thereisnoflammablematerial(otherthanthatbeingburned)within5mofthefireatanytimewhilethefireisburning;and
(b)thefireislitbetween6:00pmand11:00pmandiscompletelyextinguishedbeforemidnightonthesameday;and
(c)atleastonepersonispresentatthesiteofthefireatalltimesuntilitiscompletelyextinguished;and
(d)whenthefireisnolongerrequired,thepersonensuresthatthefireiscompletelyextinguishedbytheapplicationofwaterorearth.
9.4 TheCouncilorAuthorisedOfficermustnotgivepermissionundersubsection9.2(b)(ii)unlessitissatisfiedthattheuseoftheincineratorisnotlikelytocreateafirehazard.
10. ADDITIONALWORKS
10.1 InadditiontotherequirementsofthisNotice,youmayberequiredtocarryoutfurtherworkswhichareconsiderednecessarybyanAuthorisedOfficerandspecifiedbywayofaseparatewrittennoticeforwardedtotheaddressoftheowner/sasshownontheShireratesrecordfortherelevantland.
10.2 IftherequirementsofthisNoticearecarriedoutbyburning,suchburningmustbeinaccordancewiththerelevantprovisionsoftheAct.
10.3 PursuanttoSection33(4)oftheAct,wheretheownerand/oroccupieroflandfailsorneglectstocomplywiththerequisitionsofthisNoticewithinthetimesspecified,theShiremaybyitsofficersandwithsuchservants,workmenandcontractors,vehiclesandmachineryastheofficersdeemfit,enteruponthelandandcarryouttherequisitionsofthisNoticewhichhavenotbeencompliedwithandpursuanttoSection33(5)oftheAct,theamountofanycostsandexpensesincurredmayberecoveredfromtheownerandoroccupieroftheland.
10.4 Thepenaltyforfailingtocomplywiththisnoticeisafineof$5000.Apersonindefaultisalsoliable,whetherprosecutedornot,topaythecostofperformingtheworkdirectedinthisnotice,ifitisnotcarriedoutbytheowneroroccupierbythedaterequiredbythisnotice.

Bushincludestrees,bushes,plants,stubble,scrub,andundergrowthofallkindswhatsoeverwhetheraliveordeadandwhetherstandingornotstandingandalsoapartofatree,bush,plant,orundergrowth,andwhetherseveredtherefromornotsosevered.
CouncilmeanstheCounciloftheShireofAshburton.
ExplosiveshasthesamemeaninggiventoitbytheDangerousGoodsSafetyAct2004andtheregulationspursuanttoit.
Firebreak Periodmeansthetimefrom1Januaryuntil31Decembereachyear.
Flammable Materialmeansmaterialthatcanbeeasilyignitedorburnt.i.e.deadordrygrass,leaves,timber,paper,plasticandothermaterialsorthingsdeemedbyanauthorisedofficertobecapableofcombustion.Flammablematerialdoesnotincludegreengrowingtreesorliveplantsgrowinginagarden.
Fuel Depot / Fuel Storage Areameansanareaofland,abuildingorstructurewherefuel,i.e.(petrol,diesel,kerosene,liquidgasoranyotherfossilfuel)iskeptinanycontainerormanner.
Mineral Earth Breakmeansanareaofground,ofaspecifiedwidththathasallmaterial(livingordead)removedbyscarifying,cultivating,ploughingorothermeansremovedtobaremineralearth,andincludesthepruningandremovalofanylivingordeadtrees,scruborothermaterialthatoverhangstheclearedfirebreakareatoaverticalheightoffour(4)metresfromtheground.Apreparedfirebreakshallbetrafficable.
ShiremeanstheShireofAshburton.
Trafficablemeansabletobedrivenaround,unhindered,inastandardfour-wheeldrivevehicle.
Townsite Land meanslandwithinthedistrictthatiswithintheboundariesofatownsite(andforthepurposesofthisdefinition“townsite”hasthemeaninggivenitinSection6(1)oftheLocal Government Act 1995).
