Many of you are unfamiliar with how it works and why it works. The first step is the mandatory notice that you, as an attorney who is owed a fee by your client, are required to mail a notice of the right of the client to request MFA before you can take any action against them to collect. The format for the notice is available on the State Bar website and must be used exactly as printed in order to be effective. Once the client receives the notice they have 30 days to formally request MFA through either the SCBA or the State Bar program. If they fail to follow through, then you get to proceed with collection. If the client elects to arbitrate, the attorney has no choice in the matter and must participate. Upon receipt of the request to arbitrate by the program, a written response is solicited from the attorney involved in the process. After receipt of the response, the matter is assigned to one or more arbitrators, depending on the size and nature of the fee dispute. The matter can be binding or non-binding, depending on the request and response. If both sides agree to binding then it is. If either side requests non-binding, then it is not. This can be modified at the actual arbitration hearing upon written stipulation of the parties at that time. The arbitrator(s) assigned to the matter then set up a hearing to occur in a neutral setting as quickly as possible. Both sides are able to be represented by counsel and present evidence at the hearing. The rules of evidence are relaxed to a point so that the matter can be fully heard in a relatively short period of time. After the evidence is submitted, the arbitrator(s) then submit an award to the program. The award gets reviewed for errors and corrected if necessary. The final version of the award is then served on all parties. Why should I participate in Mandatory Fee Arbitration?

am sure that virtually all of you have heard

of the Mandatory Fee Arbitration Program

enabled by Business and Professions Code

sections 6200, et. seq. Many of you are unfamiliar

with how it works and why it works.

The first step is the mandatory notice that you,

as an attorney who is owed a fee by your client,

are required to mail a notice of the right of the

client to request MFA before you can take any

action against them to collect. The format for the

notice is available on the State Bar website and

must be used exactly as printed in order to be

effective.

Once the client receives the notice they have

30 days to formally request MFA through either

the SCBA or the State Bar program. If they fail to

follow through, then you get to proceed with

collection. If the client elects to arbitrate, the

attorney has no choice in the matter and must

participate.

The Court is Seeking Volunteer Attorneys

If you are experienced with Domestic Violence Restraining Orders, the Court needs your help. The Sacramento Superior Court offers Domestic Violence Restraining Order Workshops on Mondays, Wednesdays and Fridays at the Family Relations Courthouse from 8:45 a.m. until noon. The restraining order process is daunting for those unfamiliar with it. The workshops are intend-ed to increase participants’ awareness of how the legal process works and how to correctly complete the forms so that they can make informed decisions while representing themselves.

Volunteer attorneys help participants by explaining the restraining order forms as participants prepare them for same day filing. In addition, participants learn about the legalprocess, get their questions about the forms and process answered and obtain additional resource infor-mation. Volunteer attorneys must have experience with the domestic violence forms and process. Legal advice is not permitted in the workshops. If you are experienced with Domestic Violence Restraining Orders, the Court needs your help. The Sacramento Superior Court offers Domestic Violence Restraining Order Workshops on Mondays, Wednesdays and Fridays at the Family Relations Courthouse from 8:45 a.m. until noon. The restraining order process is daunting for those unfamiliar with it. The workshops are intend-ed to increase participants’ awareness of how the legal process works and how to correctly complete the forms so that they can make informed decisions while representing themselves.

Volunteer attorneys help participants by explaining the restraining order forms as participants prepare them for same day filing. In addition, participants learn about the legalprocess, get their questions about the forms and process answered and obtain additional resource infor-mation. Volunteer attorneys must have experience with the domestic violence forms and process. Legal advice is not permitted in the workshops. Why should I participate in Mandatory Fee Arbitration?

am sure that virtually all of you have heard

of the Mandatory Fee Arbitration Program

enabled by Business and Professions Code

sections 6200, et. seq. Many of you are unfamiliar

with how it works and why it works.

The first step is the mandatory notice that you,

as an attorney who is owed a fee by your client,

are required to mail a notice of the right of the

client to request MFA before you can take any

action against them to collect. The format for the

notice is available on the State Bar website and

must be used exactly as printed in order to be

effective.

Once the client receives the notice they have

30 days to formally request MFA through either

the SCBA or the State Bar program. If they fail to

follow through, then you get to proceed with

collection. If the client elects to arbitrate, the

attorney has no choice in the matter and must

participate.

Upon receipt of the request to arbitrate by the

program, a written response is solicited from the

attorney involved in the process. After receipt of

the response, the matter is assigned to one or more

arbitrators, depending on the size and nature of

the fee dispute.

The matter can be binding or non-binding,

depending on the request and response. If both

sides agree to binding then it is. If either side

requests non-binding, then it is not. This can be

modified at the actual arbitration hearing upon

written stipulation of the parties at that time.

The arbitrator(s) assigned to the matter then

set up a hearing to occur in a neutral setting as

quickly as possible. Both sides are able to be

represented by counsel and present evidence at

the hearing. The rules of evidence are relaxed to

a point so that the matter can be fully heard in a

relatively short period of time.

After the evidence is submitted, the arbitrator(s)

then submit an award to the program. The award

gets reviewed for errors and corrected if necessary.

The final version of the award is then served on

all parties.

If the award is non-binding a party, not

satisfied with the award, may appeal it by filing a

complaint in the appropriate Superior Court

rejecting the award and litigating the case. This

must be done within 30 days of service of the

award. If no appeal is filed, then this award

becomes final and binding subject to enforcement

by a court or the State Bar. If the award is binding,

then the only review is for an unsatisfied party to

ask for a re-hearing if there are grounds for one.

From the prospective of an attorney there is no

easier or faster way to resolve a fee dispute with

a client. Generally, MFA is concluded within a

matter of a couple of months as opposed to a

couple of years. My question to you is “Why

wouldn’t you participate”?
