TheVisionforEuropeanForensicScience2020

InordertofostercooperationbetweenpoliceandjudicialauthoritiesacrosstheEuropeanUnionwitha viewtocreating

aEuropeanForensicScienceAreaby2020,MemberStatesandtheCommissionwillworktogethertomakeprogressinthefollowingareas,aimingtoensuretheeven-handed,consistentandefficient

administrationofjusticeandthesecurityofcitizens:


TheVisionforEuropeanForensicScience2020

• accreditationofforensicscienceinstitutesandlaboratories;• respectforminimumcompetencecriteriaforforensicscience

personnel;• establishmentofcommonbestpracticemanualsandtheir

applicationindailyworkofforensiclaboratoriesandinstitutes;• conductofproficiencytests/collaborativeexercisesinforensic

scienceactivitiesatinternationallevel;• applicationofminimumqualitystandardsforscene-of-crime

investigationsandevidencemanagementfromcrimescenetocourtroom;


• recognitionofequivalenceoflawenforcementforensicactivitieswithaviewtoavoidingduplicationofeffortthroughcancellationofevidenceowingtotechnicalandqualitativedifferences,andachievingsignificantreductionsinthetimetakentoprocesscrimeswithacross-bordercomponent;

• identificationofoptimalandsharedwaystocreate,updateanduseforensicdatabases;

TheEuropeanForensicScienceArea

theareainwhichroutineforensicprocessesforthecollection,processing,useanddeliveryofforensicdataarebasedon

equivalentminimumforensicsciencestandards,andinwhichforensicserviceproviderswillworkonthebasisofacommon

approachtoimplementationofthesestandardsthatfostersclosercooperationbetweenthemandthecriminaljusticesystems.

TheActionPlanpriorities:• BestPracticeManualsforforensicdisciplines;• Stimulatingexchangeofforensicinformationfromdatabases,

forexampleintheareasofweaponsandammunition,explosivesanddrugs;

• Proficiencytestsandcollaborativeexercisesforforensicdisciplines;

• Forensicawarenessandtrainingforlawenforcementandjusticecommunities;

• Stimulateaccreditationofforensicserviceprovidersandcompetenceofforensicpersonnelonavoluntarybasis;

• StimulatingexchangeofforensicdataviaPrumandimprovingitsquality.



Foreachoftheactionsmentionedabove,adetailedroadmapshouldbepresented.

TheproposedwayforwardshouldnotrefertolegallybindinginstrumentsbutitisforeseenthattheoutcomesoftheimplementationoftheActionPlanmayserveasthefoundationforundertakinglegislativeinitiatives.

ThecontributiontothedevelopmentofforensicscienceshallbecontinuedthroughtheEuropeanCommission'sfinancialinstruments.

MidtermprogressreportoftheimplementationoftheActionPlanisexpectedinthefirsthalfof2018.


KazakhstanandprivateforensicbodiesparticipationDirectparticipationofKazakhstanintheabovementionedinitiativesisimpossible,becausethecountryisnottheEUMemberState.However,inordertomakeuseoftheEuropeanexperience,theEUproject‘EnhancingCriminalJusticeinKazakhstan’waslaunched.

TheabovementionedCouncilConclusionsarenotlimitedtothepublicbodiesonlyandtheydonotexcludetheprivateforensic

providersfromparticipationintheEuropeanForensicScienceArea.Incontrary,theprivateonesaretreatedasequallyimportantbecausethelawenforcementandjudicialauthoritiesmustbeconfidentthattheforensicdatatheyrelyonisofhighquality,

especiallyifthedatacomesfromanotherMemberState.

Astandardisatechnicaldocumentthatprovidesrequirements,specifications,guidelinesorcharacteristicsthatcanbeused

consistentlytoensurethatmaterials,products,processesandservicesarefitfortheirpurpose.Standardsensurethatproducts

andservicesaresafe,reliableandofgoodquality.

Popularstandards:ISO9000- Qualitymanagement,ISO45001- OccupationalHealthandSafety,ISO27001- Informationsecurity,etc.

ISO3166- Countrycodes(Kazakhstan3-digitscountrycodeKAZ),ISO4217- Currencycodes(KazakhstaniTenge code:KZT),ISO639- Languagecodes(KazakhlanguageAlpha-2code:kk).

Standardsarecreatedbybringingtogetherallinterestedpartiessuchasmanufacturers,consumersandregulatorsofaparticular

material,product,processorservice.Allpartiesbenefitfromstandardizationthroughincreasedproductsafetyandqualityas

wellaslowertransactioncostsandprices.

Standardsbenefitsalsoforthegovernments.Governmentscanusestandardstosupporttheirpublicpolicies.Commonstandardscanalsoremovebarriersincooperationontheinternationallevel,providingthetechnicalbasisonwhichpoliticalagreementscanbeputintopractice.


AboutStandards

Therearesomeexistingcommonanduniversalstandardsapplicablefortheuseofforensicscienceproviders,suchas:ISO17025whichcanbeimplementedintheforensiclaboratories’workorISO17020fortheinspectionbodiesdealingwiththesceneofthecrimeexaminations.

Theyarehoweverforgeneraluseandassuchtheyarenotalwayseasilyunderstandableandinterpretableinforensicscience

environment.



CEN/TC419ForensicScienceProcesses

Asthefollow-upoftheCouncilConclusionsof2011,inJanuary2012,thePolishCommitteeonStandardisationsenttotheEuropeanCommitteeforStandardization(CEN)arequesttoestablishthe

technicalcommitteededicatedtostandardisationinforensicscience.InMay2012,afternecessarynegotiationswithitsmembers,CENapprovedtheResolutiononCreationofanewProjectCommittee:

“CEN/TC419:ForensicScienceServices”

inordertoworkonEuropeanStandardsonforensicscienceservices.



Theaimofthatinitiativewastostandardisetheforensicscienceprocessesinawaythatensuresthatnewsectorspecificstandardsare

tailoredexactlyforforensicusesandtheyareunderstandable,unambiguousandeasilyinterpretable.



Duringitsfirstmeeting,inNovember2012,CEN/TC419decidedthatthefourWorkItemswillbepartofitsworkprogramme:• Crimescene,exhibithandlingandcontrol;• Deliveryofresultsthroughtheprocessesofforensicscience

examinationsandanalysisofvarioustypesofphysicalmaterial;• Evaluationandinterpretationoftheresultsofforensicscience

examinationsandanalysisinthecontextofthecase;• Reportingresultsandconclusionsfromtheforensicscience

examinationandanalysis,dataexchangeandthestandardizationofthedocumentationusedforforensicpurpose.

SomeyearslateritappearedthatthesameworkisdoneinparallelintheotherpartsoftheglobeandthesituationismatureenoughinordertostartadiscussiononInternationalStandards

forforensicscience.

TheworkofCEN/TC419hasbeenshiftedonthegloballevelandnowitisbeingdonebyISO/TC272‘ForensicSciences’CommitteeoftheInternationalOrganizationforStandardization,whichisresponsibleforstandardisationinaworld-widedimension.

TheHorizon2020(anditspredecessorthe7thFrameworkProgrammeforResearchandTechnologicalDevelopment)is

thefinancialinstrumentforresearchandinnovation,withtheemphasisonexcellentscience,industrialleadershipand

tacklingsocietalchallenges.


DGRTDGrantsInJuly2012,theEuropeanCommissionlaunchedtheFP-7WorkProgrammefor2013inthearea‘Security’.Asthefollow-upoftheCouncilConclusionsof2011,theECproposedthefollowingtopic:• DevelopmentofaCommonEuropeanFrameworkfortheapplication

ofnewtechnologiesinthecollectionanduseofevidence.

Theothertwoforensic-relatedtopicsinthatprogrammewere:• Europeantoolbox,focusingonprocedures,practicesandguidelines

forCBRNforensicaspects.• Frameworkandtoolsfor(semi-)automatedexploitationofmassive

amountsofdigitaldataforforensicpurposes.


DGRTDGrantsIntheHorizon2020WorkProgramme,in‘SecuritySocieties’section,fortheperiod2014-2015theprojectsinthefollowingforensictopicswereforeseen:• Toolsandinfrastructureforthefusion,exchangeandanalysisof

bigdataincludingcyber-offensesgenerateddataforforensicinvestigation.

• Advancedeasytousein-situ forensictoolsatthesceneofcrime.• Mobile,remotelycontrolledtechnologiestoexamineacrime

sceneincaseofanaccidentoraterroristattackinvolvingCBRNEmaterials.

• InternetForensicstocombatorganizedcrime.


DGRTDGrantsIntheWorkProgramme2016-2017inthe‘SecuritySocieties’,Horizon2020proposes:• Forensicstechniqueson:a)tracequalification,andb)

broadeneduseofDNA,• Toolkitsintegratingtoolsandtechniquesforforensic

laboratories.

TheprojectproposalsmustberelatedwithavisiononEuropeanForensicScience2020includingthecreationofaEuropeanForensicScienceAreaandthedevelopmentofforensicscienceinfrastructureinEurope.


Kazakhstanandprivateforensicbodiesparticipation

AccordingtoGeneralAnnexestotheHorizon2020WorkProgramme2016-2017,Kazakhstanistheeligiblecountrytoreceivefunding

throughHorizon2020grants.

Publicandprivateforensicbodies(theforensicend-usersortheentrepreneursofforensictechnologies)areequallyimportantfor

theproperexecutionoftheHorizon2020objectivesandparticipationofthelatteronesishighlyexpectedinthe

abovementionedandfutureprojects.
