1. PROJECT PLANNING Location The Village of New Paltz sanitary sewer system lies within the corporate limits of the Village of New Paltz and serves the entire Village and the State University of New York @ New Paltz. The Village is comprised of approximately 5 square miles and has a sewered population of approximately 6,000 people. Exhibit 1). Environmental Resources Present There are no environmental resources present in the project planning area. All sanitary sewers that are proposed for replacement are located in paved roadways within the public right of way. The project will be classified as a Type II SEQR project since all aspects of the proposed project will be characterized as a replacement project. Population Trends The 2020 census revealed that there was a population of 7,324, an increase from 2010 when the census indicated 6,818 residents. While the State University is in session, the population increases to approximately 13,000. Community Engagement The project will be classified as a Type II SEQR project since all aspects of the proposed project will be characterized as a replacement project. The SEQRA Classification was completed at the Village Board’s May 25, 2022 regular meeting.

History The sewer collection system consists of approximately 15 miles of pipe including four (4) inch to eighteen (18) inch diameter sewer mains, 4 pump stations and approximately 300 sanitary manholes. Sewer construction probably commenced prior to 1900 when a series of privately owned sewers were constructed through private properties and public right of ways for purposes of conveying sewage from upland residences and commercial establishments to the Wallkill River. Specific information regarding the construction of older portions of the sewer system is not available since it was constructed prior to approval authority from regulatory agencies. The earliest known report with an inventory of existing sewers and recommendations and upgrades in the collection system and construction of a “sewage treatment works” was prepared in April 1931. The majority of the existing sewer system consists of vitrified clay pipe with oakum and mortar joints and brick manholes with newer sections installed after the 1970’s consisting of PVC sewer main and precast manholes. The history of violations of regulatory requirements is outlined in the Condition of Existing Facilities. Condition of Existing Facilities
The Village has had a long history of overflowing manholes during high flow and storm events. In the winter and spring of 2003, the Hudson Valley experienced unusually high frequency of severe storm events exhibiting excessive precipitation amounts and high groundwater elevations during this period. The unusually high precipitation amounts in conjunction with aging sewers, undersized sewage conveyance pipes and siphons, sanitary sewage from the entire Village sewer collection system was unable to discharge into the sewer treatment facility located off of Huguenot Street and overflowed onto the ground surface at various locations in the Villages sewer collection system. As a result, the entire Village was impacted by this public health threat.
In response to these incidents, Riverkeeper issued a Notice of Intent to Sue the Village of New Paltz for Clean Water Act Violations and the New York State Department of Environmental Conservation (NYSDEC) issued an Order on Consent to the Village of New Paltz which was executed by the Village of New Paltz on September 7, 2003. (Exhibit 2) The Order reflects overflowing sewer manholes in violation of Sections 17-0501, 17-0505 and 17-0803 of the New York State Environmental Conservation Law. The Order outlined a Remediation /Restoration Schedule which the Village has been diligently adhering to the best of its capabilities to reduce inflow and infiltration throughout its sanitary sewer collection system as evidenced by undertaking the following projects:.

Even though the Village has focused its efforts over recent years and expended large sums of capital on engineering designs and construction projects to eliminate the problem of overflowing sewer manholes, the Village continues to experience overflowing sewer from manholes during extremely severe storm events. While the 2003 consent order was still in effect and the Village Department of Public Works reported sewage erupting from 4 subject manholes cited in the original Consent Order on June 30, 2013 and August 9, 2013. The NYSDEC responded by issuing a Notice of Violation on September 30, 2013 citing that on two separate occasions, raw sewage overflowed manholes on Water Street, Mulberry Street, Broadhead Avenue and Huguenot Street. This again was a violation of Article 17 of the Environmental Conservation Law making the Village of New Paltz subject to fines and penalties. (Exhibit 3) The Notice of Violation also indicated that Village Officials including the Mayor and Superintendent of Public Works were required to attend a technical compliance meeting on November 12, 2014 at the NYSDEC Offices in New Paltz New York. At this meeting, the aforementioned completed sewer

projects were discussed and the Village presented the then currently proposed project with its intended benefits for eliminating the incidents indicated in the Notice of Violation. Following the Technical Compliance Meeting, The New York State Department of Environmental Conservation issued a new Order on Consent Case No. R3-20140430-71. The Order was executed by the Village of New Paltz on October 17th 2014 and by the New York State Department of Environmental Conservation on October 20, 2014. The newly issued Order on Consent outlined a new schedule of compliance which stipulates requirements for avoiding fines and penalties amounting to $37,000.00 for each of the two (2) violations mentioned previously (Exhibit 4). The Village “Respondent” was also ordered to pay thirty thousand dollars to the Department, $5,000.00 of which was payable upon the Respondents return of the executed copy of the Order to the Department with the remaining $25,000.00 to be suspended provided that the Respondent strictly adheres to the terms and conditions of the newly issued Order. Attorneys for the Village negotiated a fine of $5,000.00 but the requirements of the Order still remain standing and consist of a Schedule of Compliance that outlines remedial activities and milestones. In summary, requirements of this Schedule are as follows:
1. Cease and Desist- The Village shall cease and desist any future violation of the NYS Environmental Conservation Law e.g.-overflowing manholes.
2. Self-Certification- All items required by the Schedule of Compliance shall be certified that the work was completed by the date indicated in the Consent Order and that it was completed in a manner as required by the Order.
3. Remedial Activities and Milestones-This requirement is divided into three parts. A report of Non Compliance, A Corrective Action Plan and a Capacity Management, Operation and Maintenance Plan.
As recently as January 18, 2022, the New York State Department of Environmental Conservation (NYSDEC) issued a Notice of Violation (NOV) to the Village of New Paltz for the 22 sanitary sewage overflows in the collection system between October 2019 and November 23, 2021. It was stipulated in this NOV that violations of the ECL are subject to penalties of up to $37,500 per day per violation. Following a Compliance Conference with the NYSDEC Region 3 Division of Water Engineers, the Village provided the NYSDEC with a Compliance Schedule for two proposed sewer projects as well as a NYSDEC Certificate of Compliance and a Wastewater Treatment Plant Rating Worksheet. All of these items were required by the NYSDEC as part of the Notice of Violation and were submitted prior to the required

submission date. (Exhibit 5) Financial Status of Existing Facilities Attached as Exhibit 6 is the current Village Budget, Billing Rate Schedule, Revenues and current Debt Schedule. I should be noted that the current budget for sanitary sewers is $142,066 which does not include sewage treatment or Administration. 3. NEED FOR PROJECT The project need is outlined as follows:
• Eliminate the public health and safety issues stemming from overflowing sewer manholes that effect the entire Village of New Paltz.
• Reduce stormwater inflow into the sewer plant from an inadequate sewage collection system routinely causes the plant to be overloaded rendering it not capable of adequately treating sanitary sewage causing raw sewage to be discharged into the Wallkill River.
• Meet the Goals indicated in the March 2014 NY Rising Community Reconstruction Program (Ulster NY Rising Community Reconstruction Plan).
• Reflect the objectives outlined in the New York State START-UP NY program,
• Comply with the NYSDEC Order on Consent that was executed as recently by the Village of New Paltz on October 17th 2014 and by the New York State Department of Environmental Conservation on October 20, 2014.
• Comply with the goals and objectives associated with the NYSDEC Engineering Planning Grant recently awarded to the Village of New Paltz to identify the remaining deficient sewers and manholes and eliminate remaining sources of inflow and infiltration.
Specific elements creating the project need are:
• NYSDEC Notice of Violation on September 30, 2013 citing that on two separate occasions, raw sewage overflowed manholes on Water Street, Mulberry Street, Broadhead Avenue and Huguenot Street.

• Issuance of The New York State Department of Environmental Conservation Order on Consent Case No. R3-20140430-71 which was entered into by the Village on. October 17th 2014 and executed by the New York State Department of Environmental Conservation on October 20, 2014. The newly issued Order on Consent outlines a new schedule of compliance which stipulates requirements for avoiding fines and penalties amounting to $37,000.00 for each of the two (2) violations mentioned previously.
• As recently as January 18, 2022, the New York State Department of Environmental Conservation (NYSDEC) issued a Notice of Violation (NOV) to the Village of New Paltz for the 22 sanitary sewage overflows in the collection system between October 2019 and November 23, 2021. • Sewer lines and manholes have deteriorated and are a source of inflow and infiltration causing the collection system to be surcharged resulting in raw sewage overflows from manholes throughout the Village in addition to the sewer plant exceeding its treatment capability and SPDES Permit
• Sewer lines that cannot be accessed for maintenance due to lack of access and misalignment of clay tile piping are the cause of blockages resulting in sanitary sewer overflows.
• Continued occurrences of overflowing sewers cause a severe public health threat and property damage throughout the entire Village of New Paltz.
Aging Infrastructure
Since the Village of New Paltz cannot afford to repair and replace all of its aging and deteriorated sanitary sewers in the collection system, it has been making progress toward eliminating the inflow and infiltration causing the sewer overflows by performing investigations of portions of the collection system suspected of receiving inflow and infiltration. Based on the results of these investigations, portions of the sewer system that require repair and or replacement due to the severity of deterioration are selected for capital construction projects by the Superintendent of Public Works and the Village’s consulting engineer. The Village has performed televising and cleaning on a significant portion of its sanitary sewers and manholes in its collection system. Some of the portions of the system could not be investigated due to small pipe diameter or obstructions in the pipe not allowing televising equipment to access.

In addition to the incidents indicated in the Notices of Violation and Order on Consent, the wastewater treatment plant routinely exceeds its permitted discharge limit of 1.5 million gallons per day (MGD) during severe storm events. It was noted by the wastewater facility operator that the 1.5 MGD limit was exceeded 33 times from October 17, 2019 through February 15, 2022. This is a clear indication that inflow and infiltration continue to plague the sewage collection system in the Village of New Paltz which leaves the Village vulnerable to fines and penalties from regulatory agencies since untreated sewage is discharged into the Wallkill River every time the permit is exceeded. As all Village residents are connected to the sanitary sewer system, the need for and benefit of this proposed project are Village wide which includes the State University College at New Paltz. As recently as May 24, 2021, the Village experienced an incident of sanitary sewage overflowing from a manhole at the entrance to the sewer plant. Approximately 50 gallons of sewage was discharged out of the manhole and directly into a catch basin which discharges directly into a tributary of the Wallkill River. This latest sanitary sewer overflow was immediately reported to the NYSDEC Regional Office and a formal Report of Non Compliance was submitted to the NYSDEC Regional Water Engineer. Additional sanitary sewer overflows over the two past years have been the result of untreated sewage overflowing into tributary sources of the Wallkill River. A total of 22 overflows were identified from April 2019 through October 2021. These incidents are documented in the attached the Report of Non-Compliance Events. (Exhibit 6).

and Colonial Drive, Mulberry Street and Broadhead Avenue.
All of these incidents were cited in the latest aforementioned Notice of Violation issued to the Village of New Paltz on January 18, 2022. On April 7th and 8th 2022, 4.32 inches of rain was recorded at the wastewater facility. This event led to the overflow of the facility’s primary clarifiers, into the facility’s stormwater system and into the Wallkill River at a rate of approximately 350 GPM for a duration of approximately 8 hours. The total estimated discharge of untreated sanitary wastewater into the Wallkill River was approximately 168,000 gallons. During this same rainfall event, sanitary manholes on Mulberry Street, Mohonk Avenue, Henry W. Dubois Drive and Broadhead Avenue also experienced sanitary sewage overflows. These non-compliance events at the wastewater facility and in the collection system were reported to the New York State Department of Environmental Conservation. The Non-Compliance Event Reports are also included in Exhibit 6. It is the Village’s intent to identify all remaining deficient sewers and manholes and sources if inflow and infiltration whether surface sources or subsurface sources. When these areas are identified, the Village will prepare a program for rehabilitating the subject areas and investigate funding opportunities. The funding opportunities will include but not be limited to listing on the NYSEFC Clean Water State Revolving Fund (CWSRF). With access to funding from NYSEFC, the Village will finally be in the position to address the remaining extraneous sources of I & I and terminate the Consent Order. Of course, if additional funding sources are identified after projects are developed, these sources will be pursued. In a concerted effort to obtain the capital required to complete the investigation of the condition of the remaining portions of the sanitary sewer system, the Village of New Paltz prepared an application for the 2016 NYSDEC/EFC Infrastructure Engineering Planning Grant Program. The application emphasized the need to complete this investigation in order to define the remaining sources of inflow and infiltration in the sewer system in order to bring the Village closer to terminating the NYSDEC Order on Consent which has continued for more than 14 years and consumed millions of dollars in remedial sewer construction costs. The Village of New Paltz was successful in obtaining $99,888 from the NYSDEC/EFC Infrastructure Engineering Planning Grant Program for “Consent Order Compliance DEC Engineering Grant Project” for the purpose of investigating and identifying all remaining deficient sewers and manholes that contribute to the sources of inflow and infiltration. These areas were identified under this program the Village is actively pursuing the rehabilitation of the subject areas with funding opportunities.

The Village of New Paltz Streets that were included in the scope of the investigation are as follows:
• Bonticou View Drive • Prospect Street • Mulberry Street • Grove Street • North Oakwood Terrace • Millrock Road • North Manheim Boulevard • Harrington Street • Colonial Street • Main Street • Hasbrouck Avenue • South Chestnut Street • Wurts Avenue • Huguenot Street • Southside Avenue
Other Streets that were originally included in this and previous investigations but were unable to be televised due to undersized sewer mains of severely deteriorated conditions of the sewer mains or complete lack of access included the following:
• South Chestnut Street • Harrington Street • Prospect Street
With the funding obtained from the NYSEFC under the Engineering Planning Grant, a subcontractor was retained by the consulting engineer to perform the sewer and manhole cleaning and TV investigations.
The investigation project consisted of cleaning and televising approximately 15,270 LF of sanitary sewer main and approximately 82 manholes throughout the Villages sewer collection system suspected of receiving inflow and infiltration. The project was substantially completed in June 2017. Documentation of the video investigations was provided to the Village of New Paltz and was reviewed by the Village Superintendent of Public Works and the Villages Engineer for evidence of inflow and infiltration in the sewer lines and manholes. The investigation sought to identify abnormalities and deficiencies in the existing sewer pipe and manholes including but not limited to the following:

In addition, sewers that could not be accessed with investigation equipment due to undersized sewer pipe (6” or less), severe misalignments, broken pipe or lack of access manholes were also considered for replacement. In all of these cases, sewer pipe consisted of aging clay tile pipe. Manholes in these specific sections of sewer were also evaluated at the same time the cleaning and televising was completed for the sewer lines. Generally, the condition of each manhole was evaluated along with the type of construction and most importantly, if there were any signs if infiltration. An Engineering Report based on the findings of the investigation identifying all deficient sewers and manholes and sources of inflow and infiltration was be prepared and submitted to the NYSDEC as part of the NYSDEC/EFC Engineering Planning Grant requirements. The engineering report included prioritized recommendations and a schedule for implementation of corrective actions be taken to minimize and mitigate inflow and infiltration.
The Engineering Report outlined findings from the investigation of sanitary sewers located in the following streets that exhibited the most severe conditions reflecting the aforementioned conditions in the greatest frequency. Of the remaining streets investigated, sewers exhibiting the greatest degree of deterioration resulting in inflow and infiltration into the sewer system causing overflows and exceeding the treatment capacity at the wastewater treatment facility were prioritized based on the severity of deterioration the greatest number of deficiencies as follows:

After reviewing the findings of the investigation, it was determined that trenchless pipe rehabilitation was not feasible and would require direct replacement. These sections of sewer will receive a direct replacement with the removal of the deteriorated pipe and installation of new SDR 35 sanitary sewer pipe. Sewers that could not be accessed due to severe deterioration, lack of access manholes or undersized in a deteriorated condition will also be replaced to provide for a functioning, maintainable sanitary sewer. The results of the manhole investigations were reviewed and evaluated by the Superintendent of Public Works and the Engineer. Any manhole that exhibited any sign of infiltration will be replaced with a new precast manhole or repaired as required. Deteriorated manholes that are located at junctions of sewers will be replaced as part of the project. Junctions or sewers lacking access will receive a new 4’ diameter manhole with a proper access for maintenance. Photographs and map key of the aforementioned locations are included in Exhibit 7. It should be noted that this project is specifically indicated in the March 2014 NY Rising Community Reconstruction Program (Ulster NY Rising Community Reconstruction Plan). Investigation and Permanent Wastewater Collection System Repairs. The Description specifically states “Scope and implement improvements to the existing collector sewer system, make point repairs and collector sewer replacement as needed. This project would reduce the inflow and infiltration associated with flooding events to safeguard the plants processes. The existing sewer collection system was overwhelmed during Hurricane Irene and Tropical Storm Lee causing contaminated waters to go into the Wallkill River. Improvements to the collection system combined with hardening the WWTP would minimize failure of the infrastructure during the 100 year storm events”. If implemented, this project will directly respond to this strategy as outlined in the NY Rising Community Reconstruction Plan. The Village’s sewer collection system and wastewater treatment facility handles 100% of the sanitary sewer generated by State University of New York College at New Paltz. Since SUNY New Paltz was recently approved by New York State for the START-UP NY program, it is imperative that the wastewater treatment and collection facilities serving the SUNY Campus remain completely functional and free from inflow and infiltration to effectively provide this institution with the wastewater service it requires as an economic development initiative developed by Governor Cuomo. Reasonable Growth The areas that are being considered for sanitary sewer replacement will unlikely be experiencing any population growth in the foreseeable future. This is since there are existing properties that currently are utilizing the sanitary sewer that is proposed to be replaced and no new construction or population increase is anticipated in this area. 4 . ALTERNATIVES CONSIDERED Description Alternatives to his project were considered and found to be lacking feasibility were the following:
• The null alternative-not taking any action to correct the situation. Under this
alternative, sanitary sewers would continue to overflow throughout the Village and the sewer plant would continue to be in violation of its SPDES Permit and the Village will continue to be subject to fines and penalties.
• Install new sanitary sewers and manholes in alternative locations. This alternative would not be feasible as the existing sewer lateral connections

would need to be relocated at significant additional cost. This alternative would eliminate the cured in place pipe lining option which saves the owner significant cost and reduces disturbance to the existing infrastructure (roadway pavement, curbing, sidewalks etc.)
• The installation of new gravity sanitary sewer lines and manholes and reconnecting existing users to the new and rehabilitated construction in the same location as the existing system is the only available option.
Design Criteria It should be noted that all design criteria for the replacement sanitary sewers is in accordance with the 2014 Edition of Recommended Standards for Wastewater Facilities commonly referred to as “Ten State Standards”. Design elements include pipe size, grade, manhole design and pressure testing requirements. Since the project will be classified as a replacement, all As-Built Plans and testing will be provided the New York State Department of Environmental Conservation Division of Water-Region 4. Map A USGS Topographic Map with the proposed project location(s) is included in Exhibit 1. Also included is a scale map of the Village of New Paltz Sanitary Sewer Collection System with keyed photo locations to corresponding photos are also included in Exhibit 1. Environmental Impacts Since the direct replacement alternative is the only viable option for an alternative, the environmental impacts will be limited to construction within the paved right of way of the Village of New Paltz. This will include sewage bypass pumping and standard construction housekeeping practices by the contractor. Land Requirements Land requirements will not be an issue for the selected alternative as all construction will occur within the Villages Public Right of Way. Potential Construction Problems The potential construction problems for this project are standard problems encountered in most sanitary sewer replacement projects of this type. These problems include traffic and pedestrian control, rock removal, bypass sewage pumping and restoration of the

construction site. All of these items are monitored on a full-time basis by the municipality’s consulting NYS Licensed Professional Engineer. Sustainability Considerations The project once completed will have a minimum expected life of at least 100 years with proper maintenance from the owner. Total Project Cost Estimate (Engineer’s Opinion of Probable Cost) Total capital costs for the sewer collection system upgrades including installation of new gravity sewer mains, sanitary siphons, manholes, and siphon chambers as well as related engineering, inspection, and legal/administrative expenses for the project are estimated to be $914,450 (Exhibit 8). Annual Operating Budget The total budgeted cost for operation and maintenance for sewer administration and the sanitary sewers in the Village’s collection system in the FY 2022-2023 is $259,614. This is outlined in the Village Budget in Exhibit 7.
5. SELECTION OF AN ALTERNATIVE A net present worth analysis was not completed as there is no scope for alternative locations for the sewer rehabilitation/replacement. Sanitary sewers will be replaced in the same location as the current location of the Village of New Paltz sanitary sewer collection system. Additionally, sanitary sewer laterals from properties that are served by the collection system will be reconnected at the existing locations along the sewer main. 6. PROPOSED PROJECT (RECOMMENDED ALTERNATIVE) In an effort to eliminate the sewer overflows at the subject locations on Colonial Drive, Henry W. DuBois Drive, Prospect Street, Mulberry Street, Water Street, Broadhead Avenue, Huguenot Street and Mohonk Avenue indicated in the aforementioned NYSDEC Notice of Violation and newly entered into NYSDEC Order on Consent and also reduce excessive hydraulic overloading incidents at the sewer plant which serves the entire Village, an additional scope of sanitary sewer remediation was formulated.

Specifically, new gravity sanitary sewer lines, replacement of existing manholes that were identified as deficient or not having access in the sewer investigation funded by the aforementioned NYSDEC Engineering Planning Grant are as follows: South Chestnut Street Direct Replacement of 680 LF Clay Tile Pipe with 8” Ø SDR 35 Sanitary Sewer Installation of 4 Sanitary Manholes Reconnection of 19 Sanitary Sewer House Laterals Harrington Street Direct Replacement of 610 LF Clay Tile Pipe with 8” Ø SDR 35 Sanitary Sewer Installation of 4 Sanitary Manhole Reconnection of 18 Sanitary Sewer House Laterals Prospect Street Direct Replacement of 1160 LF Clay Tile Pipe with 8” Ø SDR 35 Sanitary Sewer Installation of 5 Sanitary Manhole Reconnection of 25 Sanitary Sewer House Laterals Photos and photo key map of these areas are included as Exhibit 7. The project will be completed through public bidding utilizing Federal and State prevailing wage rates and will comply with all Federal, State and Local procurement requirements. Since the project involves replacement and rehabilitation of existing infrastructure, a relatively short regulatory approval and permitting process is anticipated. Long term operation and maintenance of these improvements will be undertaken by the Village of New Paltz Department of Public Works as part of the Village’s overall sewer system operation. As this project is a replacement and rehabilitation of existing sewers it will be classified as a Type II SEQR activity. The permits which will be required and length of time for obtaining them after submission of plans are as follows:

The Village of New Paltz Sewer District is wholly contained within the corporate limits of the Village of New Paltz. The district serves all residents within the Village corporate bounds in addition to the State University at New Paltz which lies within the Village Bounds.
The Village sewer collection system is subject to the New York State Environmental Conservation Law and the Federal Clean Water Act.
The Village of New Paltz was issued a Notice of Violation on September 30, 2013 from the New York State Department of Environmental Conservation for raw sewer overflows from manholes on four (4) streets on two (2) separate occasions and was cited for violations of Article 17 of the Environmental Conservation Law.
The Village of New Paltz entered into a new Order on Consent on October 20th 2014 with the New York State Department of Environmental Conservation. The newly issued Order on Consent outlines a schedule of compliance which stipulates requirements to be completed by the Village of New Paltz for avoiding fines and penalties amounting to $37,000.00 for each of the violations indicated in the Order. The Village continues to upgrade its sewage collection system in an effort to eliminate inflow and infiltration with the financial resources it has available. The proposed work indicated in this report is critical to the health and safety of the all Village residents by eliminating overflowing sewer manholes.
The Village of New Paltz was successful in obtaining $99,888 from the NYSDEC/EFC Infrastructure Engineering Planning Grant Program for “Consent Order Compliance DEC Engineering Grant Project” for the purpose of investigating and identifying all remaining deficient sewers and manholes that contribute to the sources of inflow and infiltration.

As a result of the findings from the investigation funded by the NYSDEC/EFC Engineering Planning Grant, Village is required to replace or rehabilitate deteriorated, inaccessible or undersized sanitary sewers and manholes on Harrington Street, Prospect Street and South Chestnut Street.
The project’s benefit area is the entire Village and the majority of the Village’s population is a low to moderate income group with Census Tract classifications 9534 block group 1, 2 & 3 and 9535 block group 1 & 2.
Sanitary sewage backs up as a result of hydraulic overloading from inflow and infiltration during storm events causing raw sanitary sewage to flow on the ground surface through private properties and public right of ways. Overflowing raw sewage causes significant public health hazard as well as property damage. The wastewater facility operator indicated that the 1.5 MGD limit was exceeded 33 times from October 17, 2019 through February 15, 2022 causing untreated sewage to discharge into the Wallkill River leaving the Village vulnerable to fines from the New York State Department of Environmental Conservation resulting from SPDES Permit violations and litigation from environmental groups such as “Riverkeeper”.
The proposed project will: (1) eliminate potential public health threats related to manholes overflowing with sanitary sewage; (2) minimize property damage by eliminating sanitary overflows onto private property and into residences. (3) bring the Village into compliance with the Federal Clean Water Act and New York State Environmental Conservation Law.
The estimated cost to continue removing inflow and infiltration that causes sewer overflows throughout the Village in order to continue complying with the existing consent order is $914,450. This figure includes other costs such as preliminary and detailed engineering, surveying, construction inspection services, and legal/administrative services.

The Village of New Paltz entered into a C~,;ent Order with the Department of Environmental ConseTvat:ion with the effective date of Octo~ 21, 2003 regarding lhe Village waste water treatment system. A copy of that Order is attached. The Order contained a schedule of compliance which reqwres upgrades to the sptem and submission of various plans, i..h.cluding a report, plan md schedule to eliminate sources of inflow and infiltration into the system and overflowing manholes. Due to required additional improvements to the Village's system, and new proposed development that would use the Village's system, it is apparent that additional improvements are neceisary. The following is a 4st of items that U1e Depar~t believes a:re app-ropriate lmpTovemenb given the cutrent situation in the Village.
'By signing th.is letter, the Village of New Paltz is agreeing to the terms and conditions of the prior Consent Order, along with the list of required actions below. All other terms and conditions of the original Consent Order remain w,changed and in full force end effect

2) The Village .shall complete and submit to the Department an engineering report and updated survey of its collection system (including b;ibuta1-y systems in othe.t jur\sdktioru;}, identifying ail remaining sources of I/ t, and present :1. pla~ together with a schedule for its impleml:!ntation, for all necessary corrective measttl'!:!S tl'lat will be needed to e.limmate .sarrit.:ixy .sewer overflows· (SSO&); from the ~ntire system, and prevent theil' reocc:urrence.
3) The Vi~lage shall complete by October 15, 2009 all work necessary to eomtnate surcharged manholes on Henry W. DuBois Drive. Mulberry Street, Ouuch Street, Prospect St, Broadhead Avenue, fo;mtSt., Huguenot St., Water St, and Plai.rui Rd,, and. any other rmpermitred

I am writing to acknowledge receipt of the February 5, 2015 letterfrom Mr. Rich Ruth, P.E. (Brinnier & Larios, P.C.) on behalf of the Village, requesting a time extension for completion of items B. 2. and C. 1. in the Village's Consent Order Schedule of Compliance for the above Consent Order (effective date 10/20/2014). By this letter we are accepting the requested modifications to the due dates of submitting an engineering report and the Capacity, Management, Operation and Maintenance Plan "CMOM".
The revised compliance dates are as follows:
B. 2. By April 6, 2015, the Respondent shall submit to the Department's review and approval an engineering report, certified by a Professional Engineer licensed in New York State that: (1) compiles and describes the data collected in the investigation phases of the plan; and (2) analyzes and characterizes the results of the data and information that has been collected. The engineering report shall include prioritized recommendations and a schedule for implementation of corrective actions to be taken to minimize and mitigate inflow and infiltration;

C. 1. By June 8, 2015, the Respondent shall submit to the Regional Water Engineer for review and approval an approvable CMOM program for the entire sanitary sewer system in the Village. Respondent shall begin implementation of the approved CMOM program within 3 months of Department approval.
The remainder of the original schedule of compliance continues to be in effect.
If you are in agreement with this Consent Order modification, please execute it and return to my attention at the above address. Once DEC has also signed this Modification, it will become effective and a copy will be sent to you.

On November 23 , 2021 , a comprehensive compliance inspection of the above referenced facility was conducted by this Department to assess compliance with the State Pollutant Discharge System (SPDES) Permit and Article 17 of the Environmental Conservation Law (ECL) . A copy of the inspection report is enclosed for your use , please note the facility received an unsatisfactory rating .
At the time of the inspection , it was noted that there have been 22 sanitary sewage overflmNs in the collection system between October 2019 and the time of the inspection . For a detailed list of the overflow events , please see the inspection report .. Sanitary sewage overflows are a violation of 6 NYCRR Part 750 and Article 17 of the ECL.
Please be advised that violations of the ECL are subject to penalties of up to $37 ,500 per day per violation . The Department recognizes the efforts that the Village has made to mitigate inflow and infiltration . and will take this into account when determining appropriate enforcement action .
Please provide a schedule for the implementation of the project outlined in the December 2021 Capacity lvlanagement Operation , and 1\1iaintenance program report and complete the attached Certification of Compliance by Februa ry 28 , 2022.

The operator grades are di v ided into two designations. a number ( l . 2. 3. or ..J. with I being the lowes t and ..J. the highest grade). and the letter ".-\." to r wastewater treatment plant operators working at facilities Ltsing the ac tivated sludge process . .--\.II other treatment processes hav e no letter designation . The sco ring system is based on types of treatment processes at the 'vvas tewater treatment plant and flo1,,v . Generally, the treatment unit receives points only for its designed purpose or function ( example - a spare aerobic digester being used as a gravity thickener only recei ves points for an aerobic digester) . Below are so me basic guidelines for comp leting the sco ring sheet. These guidelines are intended to cover most but not all possible options. DE C, specificall y FO .-\S . will make the tina l determination regarding sco ring quest ions. No addit ional points will be given for units/ items not li sted in the scoring system .
l l flow Scoring - Flow scoring should be based on the 30-day average design flow limi t of the treatment plant. [f the JOday average design flow is not known , the SPDES permit 30-da1 average flow limit shou ld be used. [f the average design fl ow is not known and there is no SPDES permit tlow limit, tlow points will be based on actual tl o1,,v measurements - the flow points will be calculated from the maximum recorded JO-day average tlow . The calcul ated flow point sco re should be rounded to the nearest whole number . Examp le: J pts x 6 . ..J. MGD = 19 . .2 or l 9 Flow Points.
2 l Raw sewage or effluent pumping - can be onsite. or offs ite such as a pump station if there are no connect ions betwee n the pump station and the plant.

7) A lagoon or pond is not an activated sludge process unless it meets the fo llowing definition: .-\ mixture o f wastewater and activated sludge is agitated and aerated. The activated sludge is then separated from the treated wastewater by sedimentation and returned or wasted to the process as needed.
8 l Trickling Filters - No double scoring for trickling filters . Two trickling filters in se ries or parallel are l unit regardless o t· differences in size, media or rec irculation capab ility. If one or more units has recirculation, the facility receives 11 po ints (TF with recirculation) .
9 l Polishing Pond - to be considered a polishing pond, the pond must directly fol low a se ttling unit that has sludge withdrawal. Example; Two lagoons in series do not receive po ints for a lagoo n and a polishing pond eve n if the seco nd lagoo n is unaerated . A. trickling filter followed by a seco ndary clarifier then a pond or lagoon will receive points for the po lishing pond.

On Sunday, November 24, 2019 the Department of Public Works received a call from the New Paltz Police Department regarding multiple sewer overflows throughout the village. Upon arrival it was found that manholes on Prospect Street. Mulberry Street, Water Street and Broadhead Avenue had overflowed. The department called and left a message with the DEC and reported online with NY Alert. These overflows were caused by heavy rains and saturated ground. Our sewer treatment plant recorded 3 inches of rain . All visible debris was cleaned up and lime was spread over the affected area.

Upon arrival this department found the line flowing freely and no record of pump station faults. This department ran the line with degreaser and didn't sense any obstructions. May 7, 2020
At approximately 1pm on May 5, 2020 The Village of New Paltz Department of Public Works responded to what was thought to be a water main break located in front of 12 Main Street. After the blacktop was removed, Village staff noticed they were now dealing with sewer at which time our effort then turned to trying to clear the sewer blockage. The Village crew removed a large amount of non-flushable wipes and towel type material including several pieces of broken clay tile main. After the Village realized the extent of the condition, Roehr' s Construction was called in to set up emergency bypass pumping to eliminate the sewer overflow. As of 7am on May 7, 2020 Roehr's Construction has begun excavation to make the necessary repairs.

On Monday, August 23, 2021 during a heavy rain event the Department of Public Works during a routine inspection found four manholes overflowing. The manhole locations affected were Water Street, our ·entrance to our Sewer Treatment Plant on Huguenot Street, Mulberry Street and 'Broadhead Avenue.

On Wednesday, September 1, 2021 during Tropical Stonn Ida the Department of Public Works during a routine inspection found seven manholes overflowing. The manhole locations affected were Mohonk Avenue, Hemy W Dubois, Colonial Drive, Prospect Street, Broadhead Avenue, Mulberry Street and Huguenot Street.

Tile following is a sumrnary of the overflow event on April 8,2022 .
\Ne received 4 .32 inches of 1·a in during the night of April 7--April 8, 2022.
J.1:00 AfVI our primary clarifiers started to overilow .
The overflow went into our stormw ater system and into the Wallkill River.
The overf low was at a rate of approximately 350 GPM. The event lasted from 11:00 AM until about 7:00
PIVl . VVe c lea ned the impacted area .
W e are taking apart the check valve that keeps the Wallkill River out o f the plant on the effluent line t o
ens ur~ proper operation .
