Republic of the Philippines ENERGY REGULATORY COMMISSION REQUEST FOREXPRESSION OFINTEREST PROCUREMENT OF CONSULTING SERVICES FOR THE TECHNICAL ASSISTANCE ON THE ESTABLISHMENT OF RULES ON RETAILAGGREGATION 1. The Energy Regulatory Commission (ERC), through the 2017 General Appropriations Act intends to apply the sum of Eight Million Pesos(Php8,000,000.00), being the Approved Bu'dget for the Contract (ABC) to payments under the contract for Procurement of Consulting Services for the Technical Assistance on the Establishment of Rules on Retail Aggregation. Bids received in excess of the ABC shall be automatically rejected at the opening of the financial proposals. 2. The ERC now calls for the submission of eligibility documents for the Procurement of Consulting Services for the Technical Assistance on the Establishment of Rules on Retail Aggregation. Eligibility documents of interested consultants must be duly received by the BAC Secretariat on or before 29 September 2017 (Friday) at two o'clock in the afternoon (2:00 P.M.) at the Mezzanine floor, Pacific Center Building, San Miguel Ave., Ortigas Center, Pasig City. Application for eligibility will be evaluated based on a non- discretionary "pass/fail" criterion. The Technical Consultant needed by the CMD-MOS in the performance of its tasks shall have the following qualifications: a. Extensive background in economics, finance, law or engineering or other related discipline; b. Highly-familiar with the Electric Power Industry Reform Act (EPIRA) and its Implementing Rules and Regulations (IRR) and the workings of the electricity market and of a jurisdiction wherein retail market is already operational; c. With at least ten (10) years extensive experience in providing consulting and quantitative service related to electric market monitoring and electricity reforms and a minimum of five (5) years of relevant work practice related to the electricity market; and d. 1. DELIVERABLESSuch technical team shall provide the following:

A.Provide a report containing the following:a. Various retail aggregation models implemented III

other jurisdiction.b. Best international practices which may be applicable

to the local current structure; andc. General assessment of the existing CREM scheme.

B.Draft Rules on Retail Aggregation;C.Final Rules on Retail Aggregation;D. General recommendations on the resolution of pending

Issues and strengthening of competition in the retailmarket;

E.Facilitate and provide training on other jurisdictions thatemploy similar monitoring and enforcement system andmarket design with the Philippine CREM as to ensure aproductive knowledge exchange; and

F.Meetings and discussions with the Commission on rules onretail aggregation and commentary on the submittedpropositions of stakeholders during the conduct of a publicconsultation. .

3. Interested bidders may obtain further information from ERC-BACSecretariat and inspect the Bidding Documents at the addressgiven below during Monday through Friday, 8:00 A.M. to 5:00P.M.

4. A complete set of Bidding Documents may be acquired by interestedBidders starting on 21 September 2017 (Thursday) from theaddress below and upon payment of a non-refundable fee for thebidding documents in the amount of PhP10,000.00. The method ofpayment shall be in cash.

It may also be downloaded free of charge from the website of thePhilippine Government Electronic Procurement System (PhiIGEPS)and the website of the Procuring Entity, provided that Bidders shallpay the applicable fee for the Bidding Documents not later than thesubmission of their bids.

5. The BAC shall draw up the short list of consultants from those whohave submitted Expression of Interest, including .the eligibilitydocuments, and have been determined as eligible in accordance withthe provisions of Republic Act 9184 (RA 9184), otherwise known asthe "Government Procurement Reform Act", and its ImplementingRules and Regulations (IRR). The short list shall consist of Five (5)

prospective bidders who will be entitled to submit bids. The criteriaand rating system for short listing are: .

(Note: Only the top 5 ranked Firms with at least 70% points based on theshortlisting criteria will be invited to submit the Technical (Ind FinancialProposals. Should less than the required number apply for eligibility andshortlisting pass the eligibility check, and/or pass the minimum score required inthe shortlisting, the BAC shall consider the same.)

a. Experience Factor - Bidder must have at least ten (10)year work experience in any electricity industry and at least(7) years of experience in the operations of retail electricitymarket of a jurisdiction where retail competition isoperational;

b. Technical Qualification Factor - Bidders must have anextensive background in economics, finance, engineering;highly- familiar with the EPlRA and IRR the workings ofthe electricity market and of a country wherein retailmarket is already operational;

c. Firm Track Record Factor-Bidder must have beenpreviously engaged in providing consulting services relatedto energy market to include analysis of data submissionsand other technical data and on crafting of retail electricitymarket rules.

6. Bidding will be conducted through open competitive biddingprocedures using non-discretionary "pass/fail" criterion as specifiedin the IRR of RA9184. '

Bidding is open to all interested bidders, whether local or foreign,subject to the conditions for eligibility provided in the IRR of RA9184.

7. The Procuring Entity shall evaluate bids using the Quality BasedEvaluation (QBE) procedure. The criteria and rating system for theevaluation of bids shall be provided in the Instructions to Bidders.

8. The contract shall be completed within six (6) months.'

9. The ERC reserves the right to reject any and all bids, declare afailure of bidding, or not award the contract at any time prior tocontract award in accordance with Section 41 of RA 9184 and itsIRR, without thereby incurring any liability to the affected bidder orbidders.
