POINTS OF LAW

I. Whether the respondent authorities failed and/or neglected to consider

the representations dated 16th June, 2015 an undated letter made to

respondent No.3 and a letter dated 10th December, 2015.

II. Whether the respondent authorities failed to consider that any

discrepancy in the VEC certificate of one Rojina Khatun and a pending

matter before the Hon'ble High Court being W.P. No.9399 (W) of 2011

Court filed by Rojina Khatun cannot be a hurdle in obtaining the 60 year

engagement letter for the petitioner as per the order dated 16th November,

2010 vide memo No.886-SE (Pry)/ PBRPSUS/ADMN/ 9/ 04-05 (P+II).

III. Whether the inaction on the part of the respondent authorities is thus

arbitrary, malafide, dehors the provisions of law, in colourable exercise of

powers and in violation of principles of natural justice and violative of

Article 14 and Article 19(1)(g) of the Constitution of India.

IV. Whether the inaction on the part of the respondent authorities is thus

Sheweth

1. Your petitioner is a citizen of India and permanent resident of the address

given in the cause title to this instant petition.

2. Your petitioner passed the Secondary Examination held in the year 2003

securing second division marks. Your petitioner also passed the Higher

Secondary Examination held in the year 2006 and B.A. (Three year General) in

2009 from University of Calcutta. Your petitioner pursued further education and

obtained a degree in M.A. in History in the year 2011 from Vidyasagar

University, Midnapore.

Photocopy of the mark sheets and certificates are annexed hereto and

collectively marked with the letter "P-1".

3. Your petitioner states that there exists a school namely Deorah Primary

School wherein a post of para teacher in primary section was lying vacant. It is

further stated that a notification vide S.P.O. Memo 154/ (20)/Ped)/PBRPSUS

dated 20th February, 2004 was published inviting application form the interested

and qualified candidates and your petitioner duly applied for the said post in

prescribed proforma annexing all the documents.

4. Your petitioner states that the selection committee of the school

considering all the applications submitted before them, prepared a panel

consisting names of 12 candidates under the 'Female Reserve' Post including the

name of your petitioner and submitted the said names in the panel before the

respondent no.3 for his approval. The respondent no.3 considered all the

materials on records and approved the said panel for recruitment of para teacher

in the primary section by a Memo.

Copies of the said memo 154/(20)/ped/PBRPPSUS dated 20.02.2004 and

the approved panel are annexed hereto and collectively marked with the letter

5. Your petitioner states that your petitioner was the first candidate in the

panel and therefore, she was appointed as para teacher in the primary selection

of the said school. Thereafter, your petitioner duly joined the said school in the

post of para teacher in the primary section and entered into an agreement with

the school authority' .

Copies of the appointment letter dated 8th March, 2008, joining certificate

and the agreement dated 8th March, 2008 are annexed hereto and collectively

marked with the letter "P-3".

6. Your petitioner states that after the completion of selection, appointment

and joining, your petitioner submitted all papers and documents before the

respondent no.3 on 19.03.2008 for necessary approval of appointment as a para

teacher in primary section.

Copy of the said letter dated 19.03.2008 is annexed hereto and marked

with the letter "P-4".

7. Your petitioner states that since the date of joining in the said school as

para teacher she is discharging her duties up to the fullest satisfaction of the

school authority.

8. Your petitioner states that on 16th November, 2010 the Government of

West Bengal, School Education Department being the respondent No.1 herein

passed an order. In the said order it was stated that "all Para Teachers, VRPS and

Siksha Bandhus now working on constructed basis under the PBSSM will be

engaged by the Government through the District Project Officer Sarba Siksha

Mission as per procedure laid down of Para -'2' hereinabove and will continue to

remain so engaged under contractual basis till attained of the age of 60 years".

On 22nd July, 2010, it was communicated to the District Inspector of Schools

(Secondary Education) that all para teachers duly engaged previously will

continue to be engaged till they attain 60 years of age, copies of which were also

forwarded to the respondent nos.2 and 3 herein. On 12th August, 2010 the

respondent No.3 requested J.B Pur to circulate the information regarding re-

engagement of para teachers.

Copies of the order dated 16th November, 2010 vide memo No.886-

SE(Pry)/ PBRSUS/ ADMN/ 9/ 04-05 (P+II) and the letters dated 22nd July, 2010

and 12th August, 2010 are annexed hereto and collectively marked with the

letter "P-5".

9. On 19th March, 2015, your petitioner made an application to the

respondent no.4 stating that she did not received the 60 years engagement letter

as per the order dated 16th November, 2010 vide Memo No.886-SE

(Pry)/PBRPSUS/ ADMN/9/04-05 (P+II) and requesting the respondent

authority to do the needful.

Copy of the letter dated 19th March, 2015 is annexed hereto and marked

with the letter "P-6".

10. Your petitioner states that similar representations were made to the

respondent nos.3 on 16th June, 2015 and vide an undated letter. Thereafter, on

25th June, 2015, the respondent no.4 forwarded a letter to the respondent no.3,

along with the petitioner's representations, requesting to take necessary action

with regards to obtaining the requisite engagement letter so that the petitioner

can enjoy the service period with full satisfaction in the interest of children

education. It is pertinent to mention that no further steps were taken by the

respondent authorities.

Copies of the letters dated 16th June, 2015, and 25th June, 2015 are annexed

hereto and collectively marked with the letter "P-7".

11. In or around March-April, 2015 your petitioner came to know that your

petitioner did not receive the 60 years engagement letter as there was a matter

pending W.P. No. 9399 (W) of 2011 at the Horible High Court at Calcutta being

W.P. No.9399 of 2011 filed by one Rojina Khatun. There was a discrepancy

regarding the VEC Certificate of Rojina Khatun which was in issue in the said

matter. It is pertinent to mention that such discrepancy has no relevance in your

petitioner's case and cannot be a hurdle in obtaining the 60 years engagement

letter for the petitioner. It is pertinent to mention that such facts had been

brought to light by the petitioner before the respondent no.3 vide a letter.

Copy of the said letter is annexed hereto and marked with the letter "P-8".

12. On 10th December, 2015 another representation was made to respondent

no.3 but all in vain. Your petitioner states that no steps were taken to provide for

the 60 years engagement letter to the petitioner after several representations and

enquiries for reasons best known to the respondent authorities.

Copy of the letter dated 10th December, 2015 is annexed hereto and

marked with the letter "P-9".

13. Your petitioner states that the respondent authorities failed and/or

neglected to consider the representations dated 16th June, 2015 and 10th

December, 2015 and an undated letter made to respondent no.3.

14. Your petitioner states that the respondent authorities failed and/or

neglected to provide for the 60 years engagement letter as per the order dated

16.11.2010 vide memo No.886-SE (Pry) PBRPSUS/ ADMN/ 9/ 04-05 (P+II).

15. Your petitioner states that the respondent authorities wrongfully deprived

the petitioner from being appointed for a 60 years service period in light of the

children's education.

16. Your petitioner states that the respondent authorities failed to consider

that any discrepancy in the VEC certificate of one Rosina Khatun and a pending

matte before Hon'ble High Court at Calcutta being filed by Rojuna Khatun does

not have any relevance in case of the petitioner.

17. Your petitioner states that the respondent authorities failed to consider

that any discrepancy in the VEC certificate of one Rojina Khatun and a pending

matter before Hon/1)1e High Court, being W.P. No.9399 of 2011 filed by Rojina

Khatun cannot be a hurdle in obtaining the 60 year engagement letter for the

petitioner as per the order dated 16th November, 2010 vide Memo No.886-

SE(Pry)/ PBRPSUS/ ADMN/ 9/ 04-05/ (P+II).

18. Your petitioner states that the inaction on part of the respondent

authorities deprives the petitioner of her right to obtain a 60 year service period

vide an engagement letter in spite of fulfilling all the criteria and possessing all

required qualifications.

19. Your petitioner states that the respondent authorities failed to appoint the

petitioner as para teacher in primary section of the Deorah Primary School for a

service period of 60 years as per the order dated 16th November, 2010 vide Memo

No .886-SE(Pry)/ PBRPSUS/ ADMN/ 9/ 04-05(P+II).

20. In view of the aforesaid facts and circumstances, the petitioner was unable

to apply and join the two year D.Ei.Ed cause (through ODL Mode) during 2015-

2017 for the in-service Para -teachers.

A copy of the notification dated 29th December, 2015 for commencement

of the said course is annexed hereto and marked with the letter "P-10".

21. Your petitioner states that the inaction on part of the respondent

authorities is thus arbitrary, mala fide, dehors the provisions of law, in

colourable exercise of powers and in violation of principles of natural justice and

violative of Article 14 and Article 19(1)(g) of the Constitution of India.

22. Your petitioner states that the inaction on the part if the respondent

authorities violates the petitioner's right to equality as guaranteed under Article

14 of the Constitution of India.

23. Your petitioner states that the inaction on the part if the respondent

authorities violates the petitioners' right to equality as guaranteed under Article

16 of the Constitution of India.

24. Your petitioner states that the inaction on the part of the respondent

authorities is in violation of the petitioners' right to life guaranteed under Article

21 of the Constitution of India.

25. Being aggrieved by and dissatisfied with the inaction on the part of the

respondent authorities and/or each of them, the petitioner begs to move this writ

petition inter alia on the following grounds;

GROUNDS

For that the respondent authorities failed and/or neglected to consider the

representations dated 16th June, 2015 an undated letter made to

respondent No.3 and a letter dated 10th December, 2015.

II. For that the respondent authorities failed and/or neglected to provide for

the 60 years engagement letter as per the order dated 16th November, 2010

vide Memo No.886-SE(PRY)/PBRPSUS/ADMN/9/04-05(P+II).

III. For that the respondent authorities wrongfully deprived the petitioner

from being appointed for a 60 year service period in light of the children's

education.

IV. For that the respondent authorities failed to consider that any discrepancy

in the VEC certificate of one Rojina Khatun and a pending matter before

Hon'ble High Court, being No.9399 of 2011 filed by Rojina Khatun does

not have any relevance in case of the petitioner.

V. For that the respondent authorities failed to consider that any discrepancy

in the VEC certificate of one Rojina Khatun and a pending matter before

the Hon'ble High Court being W.P. No.9399 (W) of 2011 Court filed by

Rojina Khatun cannot be a hurdle in obtaining the 60 year engagement

letter for the petitioner as per the order dated 16th November, 2010 vide

memo No.886-SE (Pry)/PBRPSUS/ ADMN/ 9/ 04-05 (P+II).

VI. For that the inaction on part of the respondent authorities deprives the

petitioner of her right to obtain a 60 year service period vide an

engagement letter in spite of fulfilling all the criteria and possessing all

required qualifications.

VII. For that the respondent authorities failed to appoint the petitioner as para

teacher in primary section of the Deorah Primary School for a service

period of 60 years as per the order dated 16th November, 2010 vide memo

no.886-SE/ PBRPSUS/ ADMN/ 9/ 04-05(P+II).

VIII. For that due to the action and/or inaction on part of the respondent

authorities, the petitions was unable to join the two year L. El. Ed Course

during 2015-2017 for the in service para teachers.

IX. For that the inaction on the part of the respondent authorities is thus

arbitrary, malafide, dehors the provisions of law, in colourable exercise of

powers and in violation of principles of natural justice and violative of

Article 14 and Article 19(1)(g) of the Constitution of India.

For that the inaction on the part if the respondent authorities violate the

petitioners right to equality as guaranteed under Article 14 of the

Constitution of India.

XI. For that the inaction on the part if the respondent authorities violates the

petitioners right to equality as guaranteed under Article 16 of the

Constitution of India.

XII. For that the inaction on the part of the respondent authorities is in

violation of the petitioners right to life guaranteed under Article 21 of the

Constitution of India.

26. Your petitioner states that any further and formal demand of Justice

would be an empty and idle formality.

27. In view of the facts and circumstances it is just and proper that an order be

passed directing the respondent authorities to consider representations dated

16th June, 2015 undated letter made to respondent no.4 and 10th December, 2015

made by the petitioner to the respondent authorities.

28. The circumstances also justify that an order be passed directing the

respondent authorities to take necessary action and obtain a 60 year engagement

letter for the petitioner as per the order date 16th November, 2010 vide memo

no.886-SE/ (Pry)/ PBRPSUS/ ADMN/ 9/ 04-05(P+II).

29. The circumstances also justify that an order be passed appointing the

petitioner as para teacher in primary section of the Deorah Primary School for a

service period of 60 years as per the order dated 16th November, 2010 vide memo

no.886-SE(Pry)/ PBRPSUS/ ADMN/ 9/ 04-05(P+II).

30. Unless and until the writ court entertain, try and determine the cause, the

petitioner will suffer irreparable loss and injury.

31. The balance of convenience is entirely in favour of passing of order as

prayed for herein.

32. Your petitioner submits that there is no other alternative. efficacious and

speedy remedy open to the petitioners and the relief's as prayed for herein

before, if granted, would be complete and adequate to the petitioners.

33. Your petitioner states that the petitioner has not moved or initiated any

other case or proceeding before any court of law on the same and similar cause of

action save and except as states hereinbefore.

34. Your petitioner submits that cause of action arose and the records of the

case are lying in the Appellate Side Jurisdiction of the Horible Court so as to

invoke the Writ Jurisdiction of this Flon'ble Court in the Appellate Side.

35. Your petitioner states that there had been no delay/ laches on part of the

petitioners.

36. This application is bona fide and for the ends of Justice.

Therefore, the petitioner humbly prays

before this Hon'ble Court for the

following;

a) A writ or writs, order or orders

direction or directions in the nature of

their agents servants and assignees to

consider the representations dated 16th

June, 2015, undated letter made to and

10th December, 2015 made by the

ORDER

The Government had for sometime been examining the present process of

engagement of Pam Teachers, VRP and Siksha Bandhus under Sarba Siksha Abhijan as

serious complaints were received about the present system of yearly renewal of contract by

the School Management Committee / VEC and the actual mode of work and performance of

such Para Teachers, VRP and Siksha Bandhus. Further in term of Finance Department

observation under their U.O. No. Group-P 1429 dated 234-2010 such Para Teachers, VRP

and Siksha Bandhus also need be engaged directly by the District Project Office.

2. After careful consideration of the matter it has now decided that all Pam Teachers,

VRP and Siksha Bandhus will now be engaged by the District Project Officer on the basis of

the recommendation of a District Level Committee consisting of following members:

a) District Magistrate / Additional District Magistrate

Nominated by the District Magistrate cithAirman.

b) ICarraadhaksha Siksha-O-Sanskriti Tathya-O-Kreera Sthayee Sarnity of the Zilla Parishasd • Member

c) Chairman, DPSC • Member

d) District Inspector of Schools (SE) Member e) District Inspector of Schools (PE) Member f) District Project Officer, SSM Member Convener

3. The above Committee will recommend the existing Para Teachers, VRPs and Siksha

Bandhus after due verification of their records, date of birth, educational

qualifications and other relevant particulars.

4. In terms of the observations of Finance Department order under their WO No. 1429 P' dated 23-4-2010 and in continuation of this Department NO SE (P)/PBRPSUS/ADMN/9

/04-05 dated 9-6-2010 it is further ordered that all Para Teachers, VRPs and Siksha Sandhi's

now working on contractual basis under the PBSSM will be engaged by the Government

through the District Project Officer, Serbs Siksha Mission as per procedure laid down at

Para-`2' hereinabove and will continue to remain so engaged under contractual'baSis till

attainment of the age of 60 years.

5. There will, however, be an annual system of objective appraisal of their performance

through an Open Performance Report (OPR) as per format to be prepared and circulated by

the State Project Director, Sarba Siksha Nlission, West Bengal keeping in mind the dudes and

responsibilities of the Para Teachers, VRPs and Siksba Bandbus as laid down at the

Alumnae-I to this Order. Such annual OPRs will be initiated in case of Para Teachers by the

Head Master Teacher in Charge of the school where he / she is posted, reviewed by the Si.

/AL at CLRC level and accepted by the DPO. In case of VRPs and Siksha Bandhus such

6. It has also been decided that engagement of such Para Teachers, VRPs, and Siksha

Bandhus may continue as such even after the project of Sarba Siksha Abhijan is winded up

by Govt. of India on the same terms and conditions as prevalent before winding up of the

project. Aim. being discharged on attainment of 60 years of age of the Pam Teachers, Siksha

Bandhu and VRPs will be paid a lump sum amount of Rs 1 lakh only as one time.payments

as token of their service rendered in connection with education of Primary & Upper Primary

stages for at least a period of 10 (ten) years.

7. However, before effecting connected engagement of those employees the District LOGI

Committee as provided under Para-2, will send recommended lists of all such Pant Toadtpr,

Sticsha Bandhu and Voluntary Resource Persons duly prepared' by them to the &bop!

Education Department through the State Project Director, SSM for its approval. All District

Magistrates as Chairman of the committee are therefore, requested to prepare the lists as per

profortna given at Anna-tine I1 to this Order and send the same to this department through

State Project Officer SSM for obtaining the approval before actual signing of contract.

Details of the terms.of the Agreement will be sent you in due count.

This is in continuation of this office orders issued under No. 273- SE(P)/PBRPSUS/ADMN/9/04205 and dated 23.04.2010 and No.376-

SE(P)/PBRPSUS/ADMN/9/04-05 dated 09.06.2010 and issues with the instructions of

TEACHERS

This is to notify for information of all concerned that the process for the online registration into TWO 'Year D.EI.Ed. Course (through ODL Mode), 2015-17 for the in-service Para-teachers, engaged under the approval of

the Paschim Banga Sarva Siksha Mission, is going to commence in terms of the order of the Government of West Bengal in the Department of School Education, No 766-SSE/15, Date: 18/12/2015, read with the approyal-order of the NCTE No. F.62-3/2011/NefEN&S, Date: 24/04/2015 and subsequent clarifications in November4015. The eligible untrained in-service pant-teachers are requested to register themselves online through www.wbsed.gov.in for the Two Year D El Ed course (through ODL-Mode)72015-17.

The date of starting of online registration will be published on 4th January, 2016.

Essential conditions of eligibility for registration into the said course are: I. The applicant should be working as a para teacher under the approval of PBSSM for at least two years and

he/she should be eligible to be "engaged upto 60 years of age as per Notification No. 2'73

SE(P)/PBRPSUS/ADMN/9/04-05 dtd 23-04-2010 read with no. 376-SE(Pry) dtd 09-06-2010. Must pass H. S. Or its Equivalent Examination with 50% ( for unreserved category para-teachers),or with 45% (for reserved category para-teachers, such as SC/ST/OBC-AJOBC-13/PH/Ex-servicemenempted Category)

Or Must be a graduate from a recognized university irrespective of the percentage of marks therein

111. In case of a. not having passed the H S or its equivalent examination with 50% or 45% (as the case may be), b. not being a graduate from any recognized university

c. being a madhyarnik-pass para teacher

the applicant para teacher must have registered himself/herself with the West Bengal 'Council of Rabindth Open Schooling (WBCROS) or National Institute for • Open Schooling (NIOS) for upgradation of •abademic qualification. Such candidates, must put the registration/enrolment number at the time of online registration.

This is further to inform all concerned that i. The Two year D.EI.Ed. course (through ODL-Mode)-2015-17 for the in-service Para-teachers is, being

conducted by West Bengal Board of Primary Education in accordance with the approval orar of the NCTE mentioned herein above.

i. A para teacher undergoing the Two Year D.EI.Ed. Course through ODL mode may simultaneously upgrade his/her academic qualification for the course or percentage of marks in the H.S. or its equivalent examination through either WBCROS or NIOS. But she/he will not be declared to have passed the training course, unless and until she/he attains the minimum academic qualifications through such up-graddtion.

iii. The registered para-teachers will be informed of their study centre-Vhrough the D.l./S.l.s of SchodlS of the respective districts.

iv. Such registered para-teachers will be provided with the printed study materials and details of the course from their respective study centres.
