Beloved seniors and Colleagues,
Greetings from IMA TNSB State Office.Last two months were the critical months forIMA TNSB, as we had come across theshocking revelation of huge financialirregularities. With the hectic efforts of theInvestigation Team along with auditors, policeand enforcement directorate we could quantifythe loss, identify the culprit and steps are takento recover it from the person. The concernedscheme officers under whose period theseirregularities had taken place have beentemporarily relieved from their official posts tillthe investigation is completed. In continuationnow the investigation team is authorized toaudit all the accounts since the inception ofIMA TNSB FSS, PPLSSS and CGP HQaccounts.
IMA TNSB FSS started in 2004 with theobjective to help the deceased families by thevoluntary contribution of Rs. 200 per death.We have assisted 600 families to the tune of80 crore rupees in the last 14 years. In theyear 2013 April to 2015 April, the irregularitieshave taken place.. However continually till datewe have paid the fraternity contribution of 17lakhs to the deceased families. In this yearalready 59 deaths occurred and all are paidand we have funds to pay for another 10 deathsin this year. Our state council has decided toincrease the fraternity contribution to the familyto 18 lakhs from January 2019. As on date wehave 17 crores as FD in FSS I.
FSS II started on December 2017,has2750 members now and deceased family willget Rs 8,25,000/- and we are confident thenumber will add on and 10 lakhs fraternitycontribution will be reached before the end ofthis year. It is resolved to appoint regularqualified auditors for scrutinizing the day today accounts, and a dynamic website is createdwhere every member can view their financialstatus.
I wholeheartedly welcome new membersto come for leadership role in IMA. Seniorswill be there to support and hand hold. It isresolved after State President ship no one willoccupy any constitutional position of state IMAor schemes including District coordinators ofthe scheme. Past State Presidents shall be
the invited members to the schememanagement committees.
Minimum wages Act 2018 is though keptin abeyance we are continuing our lobbying toconvince the Government to constitute acommittee to revise the G.O. if it fails, we willhave no option other than to fight it in thecourt.
Clinical Establishment Act implementation,the Government has assured other than whatis stipulated in the act(the pollution controlboard certificates )no other certificates will berequired to submit along with the application.If any district official refuses to accept pleaseinform. Pollution control board certificate is onthe process also you can apply. Ensure all ourclinics and hospitals are registered in due time.
Ayushman Bharath scheme has beenincorporated with the CM health insurancescheme.. We have submitted our costing studyreport to the Government and requesting theGovernment to enroll all willing hospitals to beempanelled and the tariff is fixed in consultationwith the stake holders. We will conduct a brainstorming session on this issue in Coimbatoreshortly to finalize our stands and future actionsin this issue.
End TB is the priority concern of IMA andIMA HQ had signed an MoU with the centralhealth ministry to update our members on thisissue. In our state, every district we will havean End TB training programme. Ensure allthe TB patients are notified and all patientsreceive full course of appropriate Medication.
Our paramedical courses are gettingmuch demands from the students. The wing isactively preparing the text books for all courses.This year onwards all our students will begetting the text books.
Central IMA Election is on. All centralcouncil members will be eligible to vote. Kindlycast your votes and send by post in due time.Our central working committee meeting will beon Nov 17th and 18th at Indore and I request allCWC members to participate.
IMA TNSB started and functioning since1940, was registered as a society in the currentformat in 2003 in Salem by the then SecretaryDr. T.S. Ranganathan. However in 2011 whenI was serving as State Secretary I found out
2003 onwards till then IT returns were notfiled. Hence in 2011, I filed entire IT returns for8 years and also transferred the official addressof IMA TNSB to our HQ address in Chennaijurisdiction and filed the IT returns upto 2013-14. As on date, up to date IT returns are filedin the same number 208/2013.We are in theprocess of getting 12 A registrations for oursociety.
PPLSSS is a prestigious scheme of IMAstarted in the year 1998 and PPLSSS sinceinception paying income tax. FSS our SocialSecurity Scheme started in 2004, registeredas trust since 2016 and IT returns are filedupto date.
Schemes are functioning as separateTrust with administrative control by the electedOffice Bearers of the schemes and income taxare paid separately and PANCARD receivedfor PPLSSS, HPS, FBS, and FSS I, FSS11separately.
Every local branch are constituted onlyafter the approval of National IMA as branchunder State IMA. However many branchesare having separate trusts to govern theirproperties and building. If the buildings andproperties of branches are registered underIMA TNSB, it will be under the control of nationalIMA only.
Any member interested in the affairs ofIMA can contribute their inputs at any time andno need for any permission for that. Howeversending a panic message as IMA is going tobe dissolved or funds are going to be absolvedby the Government are only with unsolicitedintention. IMA HQ is started in 1928 and IMATNSB in 1940 and till now it is functioning withdemocratic manner and all our FD’s andproperties are coming under IT review.
The state conference will be inKumbakonam. This Mahamaham TIMACONwill be a unique one and I request all our IMAmembers to come and participate and upholdthe incoming President Dr. S. Kanaga-sabapathy and his team. Looking forward tomeet you all in Kumbakonam.

Dear office bearers and reverred leadersof IMA TNSB Greetings from IMA stateoffice.
It gives me great pleasure in writing thisletter as your state secretary. Lot of things arehappening around us. Last month was spent onthe activities of the special InvestigationsCommittee. The state office extended all possiblehelp to the committee headed by our presidentelects Dr. S. Kanagasabapathy and Dr. C. N.Raja. We have approached the police and lodgeda FIR against the main accused with evidenceof bank statements; filed a case in the court oflaw and opposed her bail applications more thanone occasion. We have approached theEnforcement Directorate for attachment of theproperty of the accused. We have managed toget our accounts audited by more than 4 auditors.
We are hopeful of a successful outcome.Meanwhile we had a special extra ordinary statecouncil meeting in Madurai on 23rd Septemberto discuss misappropriation of funds in FSS. Themeeting saw emotions running out of control andthe meeting had to be adjourned by our statePresident.
Lot of preparations went into the Andamantrip which combined tour with work.
MCM meeting of PPLSS FSS and NHBwere planned along with our state councilmeeting .
MCM meeting of PPLSS and FSS were heldon 5th & 6th and that of NHB was combinedwith the state council meeting on 7th.
The state council meeting was conductedamidst heavy rains and a packed house. Thearguments were healthy, decorum maintainedand we had useful discussion. Hopefull ofrecovering the FSS money the members werereassured by the chairman of the specialInvestigations Committee. FSS office bearerswent one step ahead and announced an increaseof the solatium from Rs 17 lakhs to Rs 18 lakhsand also unveiled a website with paymentoptions.
I am confident that we will come out of allthe difficulties with flying colours and re-establishourselves as a strong organisation with all thenegatives cleared and the confidence of themembers restored. Long live IMA.

World Osteoporosis Day (WOD), markedon October 20 each year, is a year-long
campaign dedicated to raising global awarenessof the prevention, diagnosis and treatment ofosteoporosis and metabolic bone disease. It aimsto put bone, muscle and joint health on the globalhealth agenda and reaches out to health-careprofessionals (HCPs), the media, policy makersand the public at large. The global campaign hasbeen organized by the International OsteoporosisFoundation (IOF) since 1997, and focuses on aspecific theme each year. IOF develops thecampaign strategy, messaging and toolkitmaterial, which is then rolled out through its over230 member organizations - comprised ofnational osteoporosis patient, medical andresearch societies - in more than 95 countries.
Why is World Osteoporosis Day soimportant?
WOD is a key date in the bone, muscle andjoint community agenda. It’s an occasion whenpeople around the globe unite to put the spotlighton the immense burden caused by osteoporosisand other musculoskeletal diseases, and theactions that can be taken to prevent and treatthem. HCPs, medical authorities, individuals andpolicy makers all have a role to play in helpingto reduce the disease burden. Campaign toolkitThis toolkit provides resources and outlines theactions that can be taken by each stakeholderinvolved in the global fight against osteoporosis.WOD is an opportunity to coordinate global andlocal efforts, and to work together to make asmuch noise as possible on and around October20. By uniting in our efforts, we can help makebone, muscle and joint diseases a worldwidehealth priority issue. We encourage you to take
the WOD material, translate it where necessaryand disseminate it through your networks.
Quick osteoporosis facts
1. Over 200 million people worldwide areaffected.
2. Approximately one in three women and onein five men over the age of 50 will break abone due to osteoporosis.
3. An osteoporotic fracture occurs every threeseconds.
4. A prior fracture is associated with an 86%increased risk of any fracture.
5. Hip fractures cause the greatest morbiditywith reported mortality rates up to 20-24%in the first year after a hip fracture.
6. Hip fractures can cause loss of function andindependence with: 40% unable to walkindependently; 60% requiring assistance ayear later; 33% being totally dependent onor in a nursing home in the year following ahip fracture.
7. In the European Union alone the cost offragility fractures is in excess of •37 billioneach year and will increase by 25% in 2025.
8. The majority of fragility fracture patients areneither assessed, nor treated by theirhealthcare system hence there is failure to‘Capture the Fracture’ and reduce risk.
9. Urbanization and ageing populations aredriving rapid increases in the osteoporosisdisease burden.
10. By 2050, the worldwide incidence of hipfracture in men is projected to increase by310% in men and 240% in women.

WOD 2015 focuses on the importance ofadopting a bone-healthy diet through a person’slifetime to optimize bone strength. It conveysthe message that the first step in osteoporosisprevention begins in youth, when nutrition canhelp to maximize our bone-building potential,and continues throughout life as we strive tomaintain strong bones at older age. Whilst thiscampaign focuses on nutrition, nothing worksin isolation and there are other modifiable riskfactors that can put people at risk if notadequately managed, including sedentarylifestyle, smoking and alcohol use. A holisticapproach to osteoporosis prevention andmanagement is key and it is important thatpeople gain an indepth understanding of theirindividual risk factors in order to better controlthem. Poor nutrition is one of these critical riskfactors, which is why the WOD 2015 campaigntagline urges us to ‘Serve up bone strength’.
What role does food and nutrition play inosteoporosis prevention? They say you arewhat you eat – and that’s very true for yourbones too. Bones are formed of living tissuethat undergo a process of constant renewal
throughout life. They need the right nutrientsto stay strong and healthy with a balanced diet,containing enough calcium, vitamin D andprotein – as well as other micronutrients (e.g.,vitamin K, magnesium, zinc, carotenoids) – toreduce the risk of osteoporosis. The size andamount of bone contained in the skeletonchanges significantly throughout life. Likewise,as we age, the specific nutritional needs of ourskeleton change too. Osteoporosis has beendefined as ‘a paediatric disease with geriatricconsequences’, emphasizing that bone healthstarts to be shaped very early in life, in fact asearly as within the womb. Poor nutritional statusof the mother without adequate calcium andvitamin D intake can impact on the optimalgrowth of the baby’s skeleton. It has beenassociated with reduced adult bone mineralcontent at peak bone mass and in later life, aswell as increased risk of hip fracture. Beyondthis childhood and adolescence is a critical timefor bone building as it is during this period thatboth the size and strength of our bones increasessignificantly. Approximately half of our bonemass is accumulated during adolescence, with

a quarter being built up during the two-yearperiod of fastest growth. This process continuesuntil the mid-20s when peak bone mass isgenerally achieved (the maximum amount of bonethat can be achieved during skeletal growth).Although genetics will determine up to 80% ofthe variability in individual peak bone mass,factors such as nutritional intake and physicalactivity will help a child achieve optimal bonestrength. This is beneficial in late adulthood asthere is more bone in reserve from which to draw;unlike in their younger years adults cannot replacebone tissue as quickly as they lose it. It is believedthat a 10% increase in peak bone mineral density(BMD) – one measure of bone strength – coulddelay the development of osteoporosis by 13years.

� Controlling osteoporosis risk factors andcomplying with treatment regimens whereprescribed, can ensure people live mobile,independent, fracture-free lives for longer

Materials and actions thatIDF will develop over the twoyears of the campaign will aimto raise awareness of theimpact that diabetes has on thefamily and support network ofthose affected; and promotethe role of the family in themanagement, care, preventionand education of diabetes.
Over 425 million peopleare currently living withdiabetes. Most of these casesare type 2 diabetes, which islargely preventable throughregular physical activity, ahealthy and balanced diet, andthe promotion of healthy livingenvironments. Families have akey role to play in addressingthe modifiable risk factors fortype 2 diabetes and must beprovided with the education,resources and environments tolive a healthy lifestyle.

Diabetes can drivefamilies into poverty.Managing diabetes effectivelyrequires daily treatment, regularmonitoring, a healthy diet andlifestyle and ongoing education.In many countries, the cost ofinsulin injection and dailymonitoring alone can consumehalf of a family’s averagedisposable income, and regularand affordable access toessential diabetes medicines are
out of reach for too many.Improving access to affordablediabetes medicines and care istherefore urgent to avoidincreased costs for theindividual and family, whichimpact on health outcomes.
Less than 1 in 4 familymembers have access todiabetes educationprogrammes. Family supportin diabetes care has beenshown to have a substantialeffect in improving healthoutcomes for people withdiabetes. It is thereforeimportant that ongoing diabetesself-management educationand support be accessible to allpeople with diabetes and theirfamilies to reduce the emotionalimpact of the disease that canresult in a negative quality oflife.

During World Antibiotic Awareness week,12-18 November 2018, WHO and partners
will reach out to the general public, healthprofessionals, governments, farmers,veterinarians, the food and feed industry andothers via a social media campaign usinginfographics, quizzes, and success stories toraise awareness of the need to act on antibioticresistance and what kinds of steps we can take.
In the lead-up to World Antibiotic AwarenessWeek, the Food and Agriculture Organizationof the United Nations (FAO), the World HealthOrganization (WHO) and the WorldOrganisation for Animal Health (OIE) aretogether calling for responsible use of antibioticsin humans and animals to reduce the emergenceof antibiotic resistance.
Antibiotic resistance is rising to dangerouslyhigh levels in all parts of the world andthreatening our ability to treat commoninfectious diseases. Infections affecting people– including pneumonia, tuberculosis, bloodpoisoning and gonorrhoea – and animals alikeare becoming harder, and sometimesimpossible, to treat as antibiotics become lesseffective.
Antibiotics are often overprescribed byphysicians and veterinarians and overused bythe public. Where they can be bought forhuman or animal use without a prescription,the emergence and spread of resistance is madeworse. Examples of misuse include taking
antibiotics for viral infections like colds and flu,and using them as animal growth promoters onfarms or in aquaculture.
To tackle these problems, WHO, FAO and OIEare leveraging their expertise and workingtogether in a ‘One Health’ approach to promotebest practices to reduce the emergence andspread of antibiotic-resistant microbes in bothhumans and animals.
“Antibiotic resistance is a global crisis that wecannot ignore,” says Dr Tedros AdhanomGhebreyesus, Director-General of WHO. “If wedon’t tackle this threat with strong, coordinatedaction, antimicrobial resistance will take us backto a time when people feared common infectionsand risked their lives from minor surgery."
“The overuse of antimicrobials blunts theireffectiveness, and we must reduce their misusein food systems,” says José Graziano da Silva,Director-General of FAO. “Antimicrobialveterinary medicines are a crucial tool for animalhealth and welfare and safe food production,but they are by no means the only tool.”
“Like in human health, veterinary medicine hastremendously progressed thanks to antibiotics.Preserving their efficacy and availability throughtheir responsible use associated with goodhusbandry and prevention practices, is thereforeessential to preserve animal health and welfare,”highlights Dr Monique Eloit, Director-Generalof OIE. �

prospective binding. Hospitalsbuilt before the date of ordercan have adequate Fire fightinginfrastructure & training to getlicense.
2. Hospital buildings with lessthan G+2 should be exemptedfrom requirement of ramp. Forbuildings more than G+2 ifOperation theatre and IntensiveCare Unit can be shifted to 1st
floor they can be considered forrelaxation of requirement oframp. The width of the ramp canbe 1.5m with prospective effectand less than 1.5m alsoretrospectively if required so asto have comfortable movementof stretcher. The gradient of theramp could be a min 1:6 andmore. The ramp should haveproper side railings preferablyon both sides for safety.Prefabricated/steel ramps alsocan be considered withadequate anti-skid heat

4. Existing hospitals should notbe intimidated unnecessarilyfor creation of new rampstructure/unnecessary firesafety equipments as itinvolves huge capital andwould translate higher bills forthe patients. It should only beneed based with necessaryequipments.
5. All hospitals should displaythe fire exit plan for safety.
6. The Department of Fire &Rescue Services (DFRS)should be an advisory body.They can suggest remedialmeasures and suitable actioncan be suggested through theHonourable Health Secretary.
7. IMA Nursing Home Board cantake the responsibility toperiodically train its members &staffs on handling fire fightingequipments & mock drills canalso be conducted. Eveneducational videos if given bythe Department of Fire &Rescue Services (DFRS) can bescreened by all branches ofIMA to train Doctors &Paramedical staffs.
8. The fire safety license which isrenewed every year can be
extended for a period of 3 yearsand the license renewed oncein 3 years.
These suggestions are givenbearing in mind that hospitals arefacing very difficult times.� On 01/10/2018 we met the new
Labour Secretary and upraisedhim about the proceedings tillthe previous Secretary’s tenure.We had lot of discussions andthe outcome will becommunicated shortly aftersome more deliberations.
� It was decided at the StateCouncil Meeting at Andamanto have a separate meetingregarding insurance packagerates and Ayushman BarathScheme based on our costingstudy. The dates will beintimated through the NHBcoordinators.
� We have a meeting with TNPCBon 15/10/18 at Chennairegarding Bio-Medical WasteManagement.
� I request one and all to take partin the Brain Storming Sessionsand activities of NHB to makeus stronger.

happened earlier. Each one can go through the accountsstatements and know the details.
This year book would be sent to individual members soon.We have raised the Benefit amount to be given to the
deceased members families to Rs. 18,00,000, from thepresent Rs. 17,00,000, after approval by the MCM & theSCM. After approval at the Annual General bodymeeting, this will come into effect.
FSS 1: Membership as on 30-09-2018 is 9472.In September we had 5 new members joining the
scheme which shows the faith the IMA family has onthe FSS, though the embezzlement of money thathappened during 2013 -15 dampened the membershipgrowth. Please be reassured that the scheme is workingwell.
We have so far paid death benefit of Rs. 9,22,94,000to the deceased members families this year. We haveenough funds to pay for the families.
We are sad to delete 64 members due to non paymentof old dues arrears, in spite of our best efforts requestingthem by phone calls, mails, and sms to make them payfailed, after giving them due notice by registered post.

Contract is defined as anagreement between two ormore persons which creates anobligation to do or not to do aparticular thing. Contract maybe implied or expressed.
An implied contract is oneinferred from conduct of partiesand arises where one personrenders services undercircumstances indicating thathe expects to be paid therefore,and the other person knowingsuch circumstances, availshimself of benefit of thoseservices.
An express contract is anactual agreement of the parties,the terms of which are openlyuttered or declared at the timeof making it, being stated indistinct and explicit language,either orally (oral agreement)or in writing (Writtenagreement).
The doctor-patient contractis almost always of the implied

While a doctor cannot beforced to treat any person, hehas certain responsibilities forthose whom he accepts aspatients. It is an impliedcontract. Implied contract is notestablished when:
� The doctor renders first-aidin an emergency;
� He makes a pre-employment medicalexamination for aprospective employer;
� He performs anexamination for Lifeinsurance purpose;
� He is appointed by the trialcourt to examine theaccused for any reason;and
� He makes an examinationat the request of anattorney for law suitpurposes.
A doctor-patient contractrequires that the doctor must:
� Continue to treat such aperson;
� With reasonable care;
� With reasonable skill;
� Not to undertake anyp r o c e d u r e / t r e a t m e n tbeyond his skill; and
� Must not divulge secretsabout the patient exceptunder certaincircumstances, e.g., whererequired by law, etc..,
These various require-ments will now be discussed inthe succeeding paragraphs.

� The patient has recoveredfrom the illness, for whichtreatment was initiated;
� The patient/attendant doesnot pay the doctor’s fees (incase of a privatepractitioner);
� The patient/attendantconsults another doctor (ofany branch) without theknowledge of the firstattending doctor;
� The patient/attendants donot co-operate nor followthe doctor’s instructions;
� The patient is under someother responsible care, e.g.,the patient, after admissionin a hospital, comes undercare of senior doctors/unithead;
� The doctor has given duenotice (oral or written) fordiscontinuing treatment;
� The doctor is convinced thatthe illness is a fictitious one;
� The patient has been
referred elsewhere fortreatment
Reasonable care
� A doctor must use clean andproper instruments, andprovide his patients withproper and suitablemedicines if he dispensesthem himself;
� He should write theprescriptions legibly, usingstandard abbreviations andmention instructions for thepharmacist in full;
� He should give fulldirections to his patients asregards administration ofdrugs and other measures,preferably in local writtenlanguage;
� He must suggest/insist onconsultation with aspecialist in the followingcircumstances:
� When the case iscomplicated;
� When the question arisesabout performing anoperation which may be
