by the STARCLUB Field Officer was in the current Council Office or in the temporary office arrangements at the Cummins Institute. The Accountant advised that there will be sufficient room at the temporary Council Office to still be able to provide office space for the STARCLUB Field Officer.

AM/40/12 - MOBIL FUEL ARRANGEMENTS QUIGLEY/ MITCHELL That: (a) Under the provisions of Section 90 (2) of the Local Government

Act 1999 an order be made that the public be excluded from attendance at the meeting (with the exception of R PEARSON, D WINDSOR, T SMITH, L BLACKER, P AIRD AND K TELFER) in order to consider in confidence agenda item F214, AM/40/12 – Mobil Fuel Arrangements.

(b) This order is made on the grounds that the Council is satisfied that it is reasonably foreseeable that the public disclosure or discussion of the matter at the meeting could cause significant damage to the interests of the Council in respect of information, the disclosure of which could reasonably be expected to confer a commercial advantage on a person with whom the council is conducting, or proposing to conduct, business, or to prejudice the commercial position of the council; and would, on balance, be contrary to the public interest.

(c) Accordingly on this basis, the principle that meetings of the Council should be conducted in a place open to the public has been out weighed by the need to keep the information or discussion confidential.

Carried. Mayor Low explained the confidentiality provision and members of the public were excluded from the meeting. PEDLER/ MILLARD That expressions of interest in providing aircraft fuel services at the Port Lincoln Airport be sought by a public advertising process and that the outcome be presented to Council for further consideration.

F214 AIRPORT MANAGER’S REPORT cont’d: AM/40/12 - MOBIL FUEL ARRANGEMENTS cont’d: HOLMAN/ QUIGLEY That: (a) Under the provisions of Section 91 (7) of the Local Government

Act 1999 an order be made that the under mentioned document/s relating to discussion of item F214, AM/40/12 – Mobil Fuel Arrangements, having been dealt with on a confidential basis under Section 90 of the Act, should be kept confidential.

(b) This order is made on the grounds of Section 90 (3) (b) (i) & (ii)

of the Local Government Act 1999, being information the disclosure of which -

(i) could reasonably be expected to confer a commercial advantage

on a person with whom the Council is conducting, or proposing to conduct, business, or to prejudice the commercial position of the Council; and

(ii) would, on balance, be contrary to the public interest. (c) This order is to remain effective for a period of twelve months,

after which it shall be reviewed. (d) Document/s:

Carried. Following conclusion of the confidential meeting of Council, Mayor Low advised that the minutes from the Confidential Meeting were being released to the public, however the Airport Manager’s Confidential Report would be kept confidential, with this order being made on the grounds of the following:-

Section 90 (3) (b) (i) & (ii) of the Local Government Act 1999, being information the disclosure which :-

(i) could reasonably be expected to confer a commercial

advantage or a person with whom the Council is conducting, or proposing to conduct, business, or to prejudice the commercial position of the Council; and

MILLARD/ PEDLER That: (a) Under the provisions of Section 90 (2) of the Local Government

AM/42/12 - TERMINAL MATERIAL SELECTIONS & OTHER BUILDING CONTRACT DECISIONS MITCHELL/ HOLMAN That Council hereby delegates the power to the CEO to make any decisions required to ensure the ongoing construction of the Port Lincoln Airport terminal building is able to progress in a timely and efficient manner, including but not limited to the authorisation of contract variations, approval of materials samples submitted by the builder subject to the following conditions:

The project remains within the budget approved by Council or any amended budget approved by Council; and

Advice is to be sought from GHD and considered relating to any significant departures from the design and the materials specified in the request for tender documentation.

ADDENDUM TO THE AIRPORT MANAGER’S REPORT

AM/44/12 - SCREENING EQUIPMENT OTS FUNDING GRANT

The following is an extract from the Airport Manager’s Addendum:

The final funding agreement in relation to the purchase and operation of screening equipment under the Regional and Domestic Aviation Security: New Entrant Regional Airport Program has been received from the Office of Transport Security. The agreement needs to be signed and sealed by Council in order to enable the first milestone to be met within the time required. The grant is for up to $650,000 for the purchase of the equipment to meet the screening requirements that will commence on 1 July 2012 and the revised requirements that will be operative once a new terminal facility is available. MILLARD/ PEDLER That the Chief Executive Officer and Mayor sign and seal the funding agreement for the purchase and operation of screening equipment under the Regional and Domestic Aviation Security: New Entrant Regional Airport Program for a grant of up to $650,000 for the purchase of screening equipment to be used at the Port Lincoln Airport.

F215 AIRPORT CORRESPONDENCE Nil. F216 AIRPORT GENERAL CORRESPONDENCE Nil. F217 AIRPORT LATE CORRESPONDENCE Nil. F218 AIRPORT GENERAL BUSINESS (1) Mayor Low Mayor Low queried the status of land acquisition for the Port Lincoln

Airport. The Airport Manager explained that the Commonwealth Government has an interest in the airport by virtue of a caveat over the land requiring the Commonwealth’s approval for disposal of the airport under the terms of the transfer deed to Council. The Commonwealth are following their processes in relation to their interest in the airport being expanded to include the land which is the subject of land acquisition.

I93 DEPUTATIONS

(1) Mark Baade – SK Planning Mr Mark Baade from SK Planning spoke on behalf of developer Sea

Marine Holdings who have put forward a proposal to undertake a Development Plan Amendment over the Boston Rural Living Zone with a specific focus on the investigation into the merits of the 350m buffer with a view to the reduction or removal of Principle 1 (c) (iii) of Council’s Development Plan, at no cost to Council.

Mr Baade advised that this proposal would see the on-going availability

of affordable, serviced, well-located rural living blocks in the fastest growing part of the Council area.

Mr Baade advised that rural living blocks are becoming scarce and this will in due course impact on the affordability of these blocks of land. It was noted that though Council is undertaking a Structure Plan, Mr Baade believes the completion of this plan will not occur for sometime and the need for additional rural living allotments will be needed long before the plan is finished. Mr Baade advised that all costs of the Development Plan Amendment would be met by the Developer, and that the process would not be onerous for Council and staff. He also indicated that investigations undertaken into this policy review will flow to and support the Boston Rural Living Zone Development Plan Amendment.

The Accountant responded that these investments are likely to be withdrawn at maturity to fund Council capital works. Noted. FN/26/12 - COUNCIL BUDGET REPORT – AS AT 30/03/12 It was noted that an Addendum has been supplied in support of this budget report. Noted. FN/27/12 – LOAN BORROWINGS FOR AIRPORT UPGRADE PEDLER/ MITCHELL That Council open a Cash Advance Debenture facility with an available limit of $5 million from the LGFA to fund the Port Lincoln Airport Upgrade project; and That the Chief Executive Officer and Mayor sign and seal the Cash Advance Debenture loan documents as required.

F220 FINANCE REPORT cont’d: FN/30/12 MEETINGS ATTENDED Cr Millard queried if there had been any information received in regard to how the Carbon Tax would impact on Local Government costs. The Chief Executive Officer advised that the Local Government Association would be providing a report on the introduction of the Carbon Tax to assist Councils with new years budgeting. Noted.

ADDENDUM TO THE FINANCE REPORT

FN/31/12 – THIRD QUARTER COUNCIL BUDGET REVIEW The Accountant gave a brief overview of the new quarterly budget

F221 FINANCE CORRESPONDENCE (1) Tulka Progress Association – Request for Financial Assistance QUIGLEY/ HOLMAN

That:-

The Tulka Progress Association be thanked for their correspondence and advised that Council will not fund the proposed multi-purpose court area to be located at Tulka or the proposed multi-purpose community hall to be located at Tulka; and

The Tulka Progress Association be advised Council offers a Sporting & Community group capital grant annually for projects of this nature and that Council’s Community Development Officer is available to assist with grant applications from other bodies.

Carried. (2) Louth Bay Community Club – Request for Financial Assistance QUIGLEY/ MURRAY

That the Louth Bay Community Club be thanked for their correspondence and advised that Council will fund $900 (Excl GST) for the removal of the gum tree causing damage to the Louth Bay Community Club Building.

That the Coffin Bay Bowling Club be thanked for their correspondence and advised:-

Council offers a Sporting & Community group capital grant annually for projects of this nature;

Council can provide a Sporting & Community group loan subject to three suitable guarantors being provided;

Council’s Community Development Officer is available to assist with grant applications to other bodies; and

That the Coffin Bay Bowling Club be requested to keep Council informed of their progress with the project.

F225 CORRESPONDENCE NOT REQUIRING A COUNCIL DECISION

(1) Cr Holman Cr Holman requested the Port Lincoln Visitor Information Centre be

asked to collate the statistics they provide monthly into a more meaningful format. She suggested it would be more beneficial for Council to be provided with comparative monthly or yearly data to enable analysis of trends.

(2) Cr Pedler Cr Pedler queried the status of the State Emergency Services (SES)

request for financial assistance for the purchase of off road vehicles. The Accountant advised that correspondence had been received from the SES that due to lack of support from other Councils they have put the project on hold.

That the Works Manager’s Report be received. Carried.

WM/26/12 – ATTENDANCE AT 20TH ANNUAL SOUTH AUSTRALIAN LOCAL GOVERNMENT ROADS AND WORKS CONFERENCE, VICTOR HARBOUR PEDLER/ QUIGLEY That the Works Manager, Cr Murray and Cr Mitchell attend the 20th Annual South Australian Local Government Roads and Works Conference to be held on Thursday 23 and Friday 24 August 2012 at the McCracken Country Club Conference Centre, Victor Harbor.

Carried. WM/27/12 – EFFLUENT REPORT MILLARD/ HOLMAN That Council endorse the actions of the Works Manager in approving an increase to the approved contract budget for the Tulka CWMS Civil Works contract from $517,236 to $566,284 (including GST and contingency sum).

WM/28/12 – CONSTRUCTION REPORT Cr Mitchell sought confirmation that the Coffin Bay Progress Association had been sent a letter advising that they were successful in receiving a Council Community Reserve Support grant of $4,000 for the installation of the old Coffin Bay foreshore playground equipment at the Morgan Reserve, Coffin Bay. The Accountant advised that a letter of confirmation has been sent to the Progress Association. Noted. WM/29/12 – MAINTENANCE REPORT Noted.

ADDENDUM TO THE WORKS MANAGER’S REPORT WM/35/12 – UN-BUDGETED EXPENDITURE – MATERIAL RAISING The following is an extract from the Works Manager’s Addendum: Consistent with Council practise over the last couple of years, DCLEP has the opportunity to commence raising material for road construction in the second half of one financial year for works to be undertaken in the following budget. This practice allows for continued utilisation of machinery and ensures that delays are not encountered in undertaking road construction works. Material raised is stored in an inventory account, and the cost to raise material is distributed to the appropriate road account when construction works are complete. This coming year it is anticipated that up to $40,000 may be spent on material raising through to the end of the financial year. Raising material in advance requires some certainty on the re-sheeting program for the following year. Although the final re-sheeting program is generally set following the adoption of the Council budget, Council’s Strategic Plan and forward works program will be used as the basis for selecting area in which to raise material. A detailed list of proposed roads for re-sheeting works in 2012/13 has been included for member’s information. PEDLER/ MILLARD That Council endorse unbudgeted expenditure in the 2011/12 financial year of up to $40,000 for the raising of rubble in preparation for the 2012/13 re-sheeting program.

W97 WORKS MANAGER’S REPORT cont’d: WM/36/12 - ROADS TO RECOVERY The following is an extract from the Works Manager’s Addendum:-

Further to the CEO’s February report CEO/12/12 there is still uncertainty surrounding the value of Council’s reference amount for the 2010-2014 Roads to Recovery funding program, and the resultant impact on the minimum ‘own source funds’ expenditure that the Council is required to make to fulfil its obligation under this program.

Staff are still in discussions with the coordinators of the Roads to Recovery program, however Council needs to be prepared should negotiations for a reduced reference amount be unsuccessful.

Should negotiations be unsuccessful, current estimates on the end of year expenditure indicate that Council may be required to spend additional funding on road maintenance or construction works to raise Council’s own source funding expenditure above the existing reference amount. It is considered that the most appropriate way to meet this requirement would be to bring forward works from the 2012/13 financial year into the 2011/12 program. The most effective way to achieve this is likely to be to complete up to a further 2.5km of re-sheeting on Greenpatch Road in the current financial year at an expected cost of $40,000.

HOLMAN/ MITCHELL That the Chief Executive Officer be given authority to authorise additional unbudgeted road works to be undertaken in the 2011/12 financial year to increase Council’s own source funding expenditure in order to ensure that Council meets the Road to Recovery reference amount.

The Works Manager advised that he has provided additional information to this agenda item. The following is an extract from the Additional Information supplied by the Works Manager:-

The Department of Planning, Transport and Infrastructure (DPTI) are

seeking Council feedback on the proposed implementation of an 80km/hr speed zone on the Tod Highway at Wanilla. The speed zoning has been requested by the local community through MP Peter Treloar, and the provided plan details the proposal which would establish an 80km/hr speed zone over a distance of approximately 780m. Side road junction advance warning signs and additional guideposts are also to be installed to improve junction definition.

This issue of vehicle speed on the highway past the settlement of Wanilla has long been a concern of the local community, and there is no apparent reason that the Council would object to the proposal which applies only to the road under the care, control and management of DPTI.

W102 WORKS GENERAL BUSINESS (1) Cr Pedler Bruce Terrace Cr Pedler queried the status of the Bruce Terrace Project, questioning

whether it will be commenced prior to the end of 2012. The Works Manager advised he felt it unlikely due to the time it will take government departments to determine funding allocations to various projects, possibly including Bruce Terrace.

(2) Cr Holman Waiving of Transfer Station Fees Cr Holman requested that waste disposal fees be waived for the

Cummins Hall cleanup in preparation for use by Council administration. HOLMAN/ MURRAY That Council support the clean up of the Cummins Hall for Council Staff

occupation, and any rubbish needing to be delivered by the Cummins Hall Committee to the Cummins Waste Transfer Station will have the fees waived prior to the end of April 2012.

regarding the condition of Warrow Road. (4) Cr Murray Lincoln Highway/ Murray Drive Intersection Cr Murray advised that he felt it was of great importance that the

Lincoln Highway/ Murray Drive Intersection be upgraded to include some lighting, realignment or a speed limit reduction. Mayor Low advised that Cr Murray should bring this issue to Council as a ‘Notice of Motion’ if he was seeking Council support for upgrade of the intersection.

5) Mayor Low Rural Property Addressing Mayor Low queried when Rural Property Addressing would be

undertaken in our Council area. The Works Manager advised that staff have been waiting for Australia Post to finalise addresses. He advised that a decision has now been taken to proceed with developing a specification for project delivery as the time frame for Australia Post to finalise its review remains unclear.

ADDENDUM TO THE DEVELOPMENT MANAGER’S REPORT DM/37/12 – SEPTIC TANK PUMPING CONTRACTS – CUMMINS

The following is an extract from the Addendum to the Development Manager’s Report: Correspondence has been received from Veolia Environmental seeking Council’s consideration towards a review of the current contract rates associated with the pumping of the Cummins septic tanks.

In 2009, West Coast Liquid Waste was bought by Veolia Environmental. As a result of this takeover Veolia inherited the septic tank pumping contracts with Council.

The Cummins Septic Tank Pumping contract is for a period of 6 years with pumping to occur in line with the following schedule:

06/07 – Areas E and F 07/08 – Areas G and H 08/09 – Areas A and B 09/10 – Areas C and D 10/11 – Areas E and F 11/12 – Areas G and H

In the 2011/12 financial year all septic tanks in areas G and H are due to be pumped (approximately 25% of township). Prior to commencing the pumping schedule Veolia is seeking Council’s consideration in increasing the rates to cover the increased costs associated with disposal of bio solids at the Port Lincoln SA Water facility.

The following rates are proposed by Veolia and all figures shown are inclusive of GST:

The contract was originally entered into with West Coast Liquid Waste in early 2006 with the 2011/12 financial year (this FY year) being the last year of the contract. At the time the contract was let Council had a bio solids disposal facility located at its Coffin Bay Wastewater Treatment Plant (CBWWTP). As a result of Council having this facility the contract rates that were accepted were based on the contractor being able to dispose of the bio solids at that facility at no cost to the contractor.

In 2010 the Works Department advised that the operation and maintenance of the bio solids unit was costing significant dollars and regular pumping of further processed solids from the facility’s sump was also being required at significant cost. Staff determined at that time that the bio solids unit should be shutdown due to the significant operating costs and that the contractor would need to dispose of the bio solids at the SA Water facility in Port Lincoln.

The original contract rates that were accepted by Council were for disposing of the bio solids at the CBWWTP facility. As this option is no longer available to the contractor it is deemed reasonable that Council consider increasing the contract rates to cover the additional costs associated with disposing of the bio solids at the SA Water facility.

Given the above I am recommending that Council accept the proposed variation to the Schedule of Rates for the Cummins Septic Tank Pumping contract.

CEO/32/12 – CUMMINS OFFICE REDEVELOPMENT …Cr Holman and Cr Quigley declared a qualified conflict of interest due to them being members of the Cummins and District Enterprise Committee. MITCHELL/ PEDLER That Council hereby delegates the power to the CEO to undertake the following: -

Make any decisions to ensure the re-development of the Cummins Council Office is able to progress in a timely and efficient manner, including but not limited to the authorisation of contract variations and approval of materials within the construction contract approved by Council; and

Make arrangements for the temporary relocation of Council’s administration during the construction phase, including the payment of any required premise rental and business costs associated with the use of the premises. That the CEO make arrangements for Council meetings to be held in alternative locations during the Council office construction phase.

handling on the Eyre Peninsula to be held 9.00am Tuesday 22 May at Port Lincoln Hotel.

Cr Millard advised that grain from Cummins is now being transported to

port by road. Local Government Association Luncheon Forums Mayor Low advised there will be a series of forums to be held by the

LGA that will invite particular speakers to provide an address. On the 10 May 2012, Minister Gago will be speaking at the forum with Minister Conlin to speak at the 25 July forum.
