WI IFREAS, schools in the Sullivan County school system are experiencing significantturbulenceattributableto a continuingdeclinein studentenrollmentand municipal annexations;and

WHEREAS, the County Commission desireschat all existingschool facilities andeducationalresourceswithin the county andmunicipalities are utilized as efficiently as possible in order to

provide a quality educationto all Sullivan County studentsand maximum value to county

taxpayers;and

WHEREAS,T. C. A. authorizesthe multiple schoolsystemsexisting within a single county toenterinto mutually agreeableand beneficial agreementspertainingto the operation of publicschoolswithin theirdistricts.

WHEREAS,pursuantto ResolutionNo. 36 approvedJanuary17, 1983 (copy attached),SullivanCounty enteredinto a 30 year Grant ofEasementwith theUnited Statesof AmericathroughtheTennesseeValley Authority (“TVA”) datedNovember2, 1982 as well as an AssignmentofEasementdatedApril 23, 1983 to South Holston Ruritan Club for use of propertyon SouthHolston Lake identified as TVA Tract No. XTSH-33RE and being utilized by South HolstonRuritanClub for communitypurposes;and

WHEREAS,saidGrantof Easementexpiredon November1, 2012andTVA is not agreeabletoextendingthe terms of the previous agreementdue to TVA’s guidelinesandpolicies havingchangedsincethepartiesenteredinto thepreviousagreementin 1983;and

WHERAS, thecurrent guidelinesandpolicies on useof TVA ownedpropertyfor recreationalpurposesare suchthat a new long-term grant of easementor leaseagreementto allow SouthHolstonRuritan Club to continueusing thepropertywould requiretheup-front paymentof anapplicationfeeof$5,000which is not economicallyfeasible;and

WHEREAS,asan alternativeto a long-termgrant of easementor leaseagreement,TVA offersthe option of entering into a license agreementwhich requires an initial $1,500 up-frontapplicationfee (final costto be determined)andthe approvaloftheTVA Regional WatershedOffice;however,saidLicenseAgreementis subjectto beingterminatedat anytime; and

WHEREAS,TVA hasadvisedthat if TVA entersinto a LicenseAgreementdirectly with SouthHolston Ruritan Club for continueduse of the property,that South Hoiston Ruritan Club, inaddition to theapplicationfee, will be requiredto pay annual feesto TVA in a minimal amountof $16,000,but that said annualfeeswill not be chargedif the LicenseAgreementis betweenTVA and Sullivan Countyandthensubletto SouthHolstonRuritan Club; and

WHEREAS, South HolstonRuritan Club hasrequestedthat Sullivan County,on behalfof theRuritan Club, submit a ReservoirLand Use Application to TVA for approval of a LicenseAgreement between TVA and Sullivan County and subsequentAssignment of LicenseAgreementbetweenSullivan County andSouthHoistonRuritan Club to allow theRuritan Clubto continueusing the propertyfor recreationalcommunitypurposeswith all costs associatedtherewithto bepaidby SouthHoistonRuritanClub andat no cost to Sullivan County;

WHEREAS,Sullivan County Sheriff’s Office is submittingan applicationfor an EdwardByrne MemorialJusticeAssistance Grant (JAG) for the 2013-2014Fiscal Year. This grant has been awardedto theSheriffsOffice for thepastseveralyears. This yearthegrantis in theamountof$23,134.00. This is a 100percentfunding grant. No matchingfundsarerequired;and

WHEREAS, the program funds will be used to purchaseequipmentand supplies that will be used inspecificareasoflaw enforcement.

NOWTHEREFORE BE IT RESOLVED that the Board of County Commissioners of SullivanCounty, Tennessee, assembled in Regular Session hereby approves Sullivan County Sheriff’s Officesubmitting an application to the Department of Justice for a “JAG” GRANT with total funding inthe amount of$23,134.00.

SECTION 2: Tenn. Code Ann. § 54-1-126 provides that the Departmentshall enter into a written contract that provides that the Agency is solelyresponsible for all maintenance of the completed work of the Project. Therefore,the provisions set forth in Tenn. Code Ann. § 54-1-126 shall apply to this

Agreement. The Agency shall be solely responsible for and pay all costsassociated with maintenance of the Project.

SECTION 3 The Agency shall assume all liability for third-party claims anddamages arising from the maintenance, existence, and use of the Project to theextent provided by Tennessee Law and subject to the provisions, terms andliability limits of the Governmental Tort Liability Act, T.C.A. Section 29-20-101, etseq, and all applicable laws.

SECTION 4: The Agency agrees to comply with all applicable federal andTennessee laws and regulations in the performance of its duties under thisAgreement. The parties hereby agree that failure of the Agency to comply withthis provision shall constitute a material breach of this Agreement,and subject theAgency to the repayment of all funds expended, or expenses rri~ur~ed,under thisAgreement

SECTION 9: The Department may terminate this Agreement without causefor any reason. Said termination shall not be deemed a Breach of Contract by theDepartment. The Department shall give the Agency at least thirty (30) dayswritten notice before the effective termination date. Upon such termination, theAgency shall have no right to any actual general, special, incidental,consequential, or any other damages whatsoever of any description or amount.

SECTION 10: This Agreement may be modified only by a writtenamendment, which has been executed and approved by the appropriate parties asindicated on the signature page of this Agreement.

SECTION 11: The Department shall have no liability except as specificallyprovided in this Agreement.

SECTION 12: The Agency warrants that no amount shallindirectly to an employee or official of the State of Tennessee as wages,compensation, or gifts in exchange for acting as an officer, agent, employee,subcontractor, or consultant to the Agency in connection with any workcontemplated or performed relative to this Agreement.

SE1 pency shall be solely responsible for and pay all costsassociatei iance and operation of all electrically operated devicestogether w~lQIte~tSlatedequipment, wiring and other necessary appurtenances,and the Agency shall furnish electrical current to all such devices which may beinstalled as part of the project. Additionally, the Agency shall be solely responsiblefor and pay all costs associated with the maintenance and operation of solar-powered devices, including, but not limited to, replacement of solar panels,batteries, lights and lenses.

SECTION III: The Agency agrees to comply with all applicable federal andstate laws and regulations in the performance of its duties under this contract. Theparties hereby agree that failure ofthe Agency to comply with this provision shallconstitute a material breach of this agreement and subject the Agency to therepayment of all state funds expended, or expenses incurred, under thisagreement.

WHEREAS,the TennesseeCountyServicesAssociation(TCSA) holdsthehealthand safetyof its teenagersandadultsas aChiefconcern;and

WHEREAS,throughTtCanWait.com,Facebook,text-to-pledge,tweet-to-pledgeandevents,morethan 1.5 millionpeoplehavecommittedto nevertext and drive; and

WI-IEREAS, 98 percentofAmericancommutersknow sendinga text or emailwhile driving is not safe;and

WHEREAS,nearly50 percentofcommuterstext while behindthe wheelandmorethan40 percentof commuters

whotext while driving reportedtheactivity asbeinga habit;and

WHEREAS,aVirginia Techstudyshowedthosewhosendtext messageswhile driving are23 timesmorelikely tocrash;and

WI-IEREAS, a driver thatsendsa text messagewhile driving not only jeopardizeshis or hersafety,but alsothesafetyof passengers,pedestrians,andotherdrivers.

NOW ThEREFOREBE IT RESOLVED that the Board of County Commissioners of Sullivan County,Tennessee,assembledin Regular Sessionhereby affirms their support of the It Can Wait National Day OfAction, the nationwide “no-texting-while-driving” movement.
