The Governor in Council on the report and recommendation of the Minister of Agriculture dated October 18, 2019, [and] pursuant to Section 49 of Chapter 21 of the Acts of 2018, the Animal Protection Act, is pleased to order and declare by proclamation that Chapter 21 of the Acts of 2018, the Animal Protection Act, do come into force on and not before November 12, 2019.

WHEREAS in and by Section 49 of Chapter 21 of the Acts of 2018, the Animal Protection Act, it is enacted as follows:

49 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.

AND WHEREAS it is deemed expedient that Chapter 21 of the Acts of 2018, the Animal Protection Act, do come into force on and not before November 12, 2019;

NOW KNOW YE THAT WE, by and with the advice of the Executive Council of Nova Scotia, do by this Our Proclamation order and declare that Chapter 21 of the Acts of 2018, the Animal Protection Act, do come into force on and not before November 12, 2019, of which all persons concerned are to take notice and govern themselves accordingly.

Animal Welfare Appeal Board Regulations–replacement; Chief Inspector Qualifications Regulations–replacement

Order in Council 2019-321 dated November 12, 2019 Repeal of regulations and regulations made by the Governor in Council

pursuant to subsection 47(1) of the Animal Protection Act

The Governor in Council on the report and recommendation of the Minister of Agriculture dated October 18, 2019, and pursuant to subsection 47(1) of Chapter 21 of the Acts of 2018, the Animal Protection Act, is pleased, effective on and after November 12, 2019, to

(a) repeal the Animal Cruelty Appeal Board Regulations, N.S. Reg. 34/2015, made by the Governor in Council by Order in Council 2015-41 dated February 24, 2015;

(b) make new regulations respecting the Animal Welfare Appeal Board Regulations [animal welfare appeal board] in the form set forth in Schedule “A”, attached to and forming part of the report and recommendation;

(c) repeal the Chief Inspector Qualifications Regulations, N.S. Reg. 17/2010, made by the Governor in Council by Order in Council 2010-28 dated January 19, 2010; and

(d) make new regulations respecting the Chief Inspector Qualifications Regulations [qualifications for chief inspector], in the form set forth in Schedule “B” attached to and forming part of the report and recommendation.



N.S. Reg. 184/2019 Animal Welfare Appeal Board Regulations–replacement

Schedule “A”

Regulations Respecting the Animal Welfare Appeal Board made by the Governor in Council under subsection 47(1)

of Chapter 21 of the Acts of 2018, the Animal Protection Act

Citation 1 These regulations may be cited as the Animal Welfare Appeal Board Regulations.

Definitions 2 In these regulations,

“Act” means the Animal Protection Act;

“appeal” means an appeal of a seizure of an animal made to the Appeal Board under Section 37 of the Act;

“business day” means a day other than a Saturday, a Sunday or a holiday as defined in the Interpretation Act;

“notice of appeal” means a notice of appeal in the form prescribed by the Minister in accordance with subsection 37(1) of the Act.

Copy of seizure of animal notice to accompany notice of appeal 3 A notice of appeal must be accompanied by a copy of the seizure of animal notice that is being appealed.

Fee for notice of appeal 4 (1) The fee required to accompany a notice of appeal under subsection 37(3) of the Act is $257.52, plus

any applicable taxes.

(2) The fee prescribed in subsection (1) is refunded if the Appeal Board decides the animal is to be returned to the owner or the custodian on behalf of the owner.

Incomplete notice of appeal 5 If an incomplete notice of appeal is submitted or any required accompanying documentation is missing,

the Appeal Board may refuse to hear the appeal until the completed form or required documentation is provided.

Time period for notice of hearing appeal 6 The number of days within which notice of the time, date and place for a hearing of an appeal is required

to be given under subsection 37(5) of the Act is 5 business days after the date the Chair of the Appeal Board receives notice of the appeal.

Time period for date of hearing appeal 7 The maximum number of days for fixing the date for hearing an appeal after the notice of appeal is

received by the Chair of the Appeal Board required to be given under subsection 37(6) of the Act is 10 business days.

Time period for issuing decision 8 The number of days within which the decision of the Appeal Board is required to be issued under

subsection 37(6) of the Act is 12 business days after the date the Chair of the Appeal Board receives notice of the appeal.

Time period for order of appeal board 9 (1) The number of days within which oral notice of a decision in an appeal is required to be given under

subsection 38(6) of the Act is 2 business days after the date of the hearing of the appeal.

(2) The number of days within which written reasons for a decision in an appeal is required to be given under subsection 38(6) of the Act is 10 business days after the date of the hearing of the appeal.

N.S. Reg. 185/2019 Chief Inspector Qualifications Regulations–replacement

Schedule “B”

Regulations Respecting the Qualifications for Chief Inspector made by the Governor in Council under subsection 47(1)

of Chapter 21 of the Acts of 2018, the Animal Protection Act

Citation 1 These regulations may be cited as the Chief Inspector Qualifications Regulations.

Definition 2 In these regulations, “Act” means the Animal Protection Act.

Minimum qualifications for Chief Inspector 3 The following are the minimum qualifications required by subsection 12(2) of the Act to be met by a

person appointed as Chief Inspector:

(a) a high school diploma or the equivalent;

(b) a valid driver’s licence;

(c) experience handling and training animals;

(d) necessary investigatory skills and knowledge to act as Chief Inspector.




Aquaculture Licence and Lease Regulations–amendment

Order in Council 2019-322 dated November 12, 2019 Amendment to regulations made by the Governor in Council

pursuant to Section 64 of the Fisheries and Coastal Resources Act

The Governor in Council on the report and recommendation of the Minister of Fisheries and Aquaculture dated November 5, 2019, and pursuant to Section 64 of Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act, is pleased to amend the Aquaculture Licence and Lease Regulations, N.S. Reg. 347/2015, made by the Governor in Council by Order in Council 2015-338 dated October 26, 2015, to provide clarity to the industry regarding licensing and leasing processes and the requirements for land-based and marine aquaculture sites and address various operational issues concerning aquaculture site amalgamation, applications for adjudicative amendments, licensing for non-commercial purposes, special experimental licences and special experimental leases, and other administrative functions, in the manner set forth in Schedule “A” attached to and forming part of the report and recommendation, effective on and after November 12, 2019.

Schedule “A”

Amendment to the Aquaculture Licence and Lease Regulations made by the Governor in Council under Section 64

of Chapter 25 of the Acts of 1996, the Fisheries and Coastal Resources Act

1 Section 2 of the Aquaculture Licence and Lease Regulations, N.S. Reg. 347/2015, made by the Governor in Council by Order in Council 2015-338 dated October 26, 2015, is amended by adding the following definitions where they belong in alphabetical order:

“institutional lease” means an institutional lease granted by the Administrator under Section 55A of the Act;

“institutional licence” means an institutional licence granted by the Administrator under Section 55A of the Act;

“security bond” means a surety bond or any other form of financial security acceptable to the Administrator;

2 Subsection 9(1) of the regulations is repealed and the following subsection substituted:

(1) The Minister must publish notice of an issued option to lease on the Department’s website and in the Royal Gazette Part I no later than the following dates:

(a) 30 days after the option has been issued; or

(b) 60 days after the option has been issued, if requested by the proponent and approved by the Minister.

3 The regulations are further amended by adding the following Section immediately after Section 11:



Incomplete application 11A (1) If the Minister considers an application for an aquaculture licence and aquaculture lease to be

incomplete, the Minister must notify the applicant in writing of all of the following:

(a) that the application is incomplete;

(b) that, for the application to be processed, the applicant must provide the additional required information no later than 90 days after the date of the Minister’s notice.

(2) If an applicant does not submit the required additional information in compliance with the deadline in clause (1)(b), the Minister must notify the applicant in writing that the application is deemed to be withdrawn.

4 The regulations are further amended by adding the following Section immediately before Section 12:

Approval to advance application for adjudicative amendment 11B (1) In this Section,

“approval” means an approval issued by the Minister under subsection 47A(4) of the Act to advance an application for an adjudicative amendment before the Review Board; and

“proposal” means a proposal to the Minister under subsection 47A(1) of the Act to advance an application for an adjudicative amendment before the Review Board.

(2) The Minister may establish procedures for evaluating proposals and issuing approvals.

(3) Subject to any extension granted under subsection (4), the prescribed duration of approvals for the purpose of clause 47A(5)(b) of the Act is 6 months.

(4) At the written request of the holder of an approval, the Minister may extend the approval’s duration for up to 6 months.

5 Section 16 of the regulations is amended by striking out “an application” and substituting “a completed application”.

6 (1) Section 24 of the regulations is redesignated as subsection 24(1) and amended by striking out “Promptly after receipt” and substituting “Subject to any order under subsection (2) respecting confidentiality, promptly after receiving”;

(2) Section 24 of the regulations is further amended by adding the following subsection immediately after subsection (1):

(2) If an applicant requests, consistent with the Review Board’s procedures, that the Review Board hold a document in confidence, the requirement to provide copies in subsection (1) does not apply until the Review Board makes an order respecting the confidentiality of the document, and the requirement must then be applied only in a manner consistent with the Review Board’s order.

7 (1) Section 26 of the regulations is amended by striking out “A party” in subsection (1) and substituting “Subject to any order under subsection (1A) respecting confidentiality, a party”.




(1A) If a party to an adjudicative hearing requests, consistent with the Review Board’s procedures, that the Review Board hold a document in confidence, the requirement to deliver copies in subsection (1) does not apply until the Review Board makes an order respecting the confidentiality of the document, and the requirement must then be applied only in a manner consistent with the Review Board’s order.

8 Subsection 33(1) of the regulations is repealed and the following subsection substituted:

33 (1) The Chair of the Review Board may determine the order of questioning at an adjudicative hearing.

9 (1) Clause 38(1)(a) of the regulations is amended by striking out “aquacultural” and substituting “aquaculture”.

(2) Subsection 38(1) of the regulations is further amended by

(a) striking out the period at the end of clause (g) and substituting a semicolon; and

(b) adding the following clause immediately after clause (g):

(h) an institutional licence or institutional lease in a designated aquaculture development area.

(3) Subsection 38(2) of the regulations is amended by

(a) striking out “either of the following” and substituting “any of the following”;

(b) striking out “49(5)” in clause (b) and substituting “52(5)”;

(c) striking out the period at the end of clause (b) and substituting a semicolon; and

(d) adding the following clauses immediately after clause (b):

(c) a renewal of a special experimental licence or special experimental lease;

(d) an amalgamation of aquaculture licences or aquaculture leases and their associated aquaculture sites.

10 (1) Section 41 of the regulations is amended by renumbering subsections (5) and (6) as subsections (4) and (5), respectively.

(2) Subsection 41(5) of the regulations is amended by

(a) adding “if it concerns a marine aquaculture site,” immediately before “it must be in relation to” in clause (d);

(b) striking out the period at the end of clause (d) and substituting a semicolon; and

(c) adding the following clause immediately after clause (d):

(e) if it concerns a land-based aquaculture site, it must be in relation to 1 or more of the factors set out in Section 43.



11 Section 51 of the regulations is repealed and the following Section substituted:

51 A holder of a special experimental licence or special experimental lease applying for a commercial aquaculture licence or aquaculture lease must apply to the Minister in accordance with Section 45 of the Act and these regulations, including any requirement to submit a proposal for an option to lease, if the application is for either of the following:

(a) the same site;

(b) an area that includes all or part of the same site.

12 The regulations are further amended by adding the following heading and Sections immediately after Section 51:

Institutional Licences and Leases

Applying for institutional licence 51A An applicant for an institutional licence must apply in a manner determined by the Administrator.

Applying for institutional lease 51B If the proposed aquaculture site is on Crown land, an applicant for an institutional licence must also

apply for an institutional lease.

13 Section 53 of the regulations is amended by

(a) striking out “aquaculture licences and leases” and substituting “aquaculture licences and aquaculture leases”; and

(b) striking out “special experimental licences and leases” and substituting “special experimental licences and special experimental leases”.

14 Section 56 of the regulations is amended by adding the following subsection immediately after subsection (6):

(6A) For a holder of an institutional licence, the amount required for a security bond is 50% of the applicable amount specified in subsection (5).

15 The regulations are further amended by adding the following Section immediately after Section 59:

Use of aquaculture site 59A An aquaculture licence holder must use all of the aquaculture site for aquaculture purposes, to the

degree and in the manner determined by the Administrator.

16 Section 62 of the regulations is amended by striking out “Minister must issue” and substituting “Administrator must issue”.

17 (1) The table in subsection 77(1) of the regulations is amended by adding the following rows immediately after the row beginning “Renewal of special experimental licence or lease”:

18 (1) Subsection 78(1) of the regulations is amended by striking out “An aquaculture licence” and substituting “Except as provided in subsection (1A) for an institutional lease or institutional licence, an aquaculture licence”.


(1A) There is no annual fee for an institutional lease or an institutional licence.

(3) Subsection 78(3) of the regulations is amended by adding “other than one conducted under an institutional lease or institutional licence” immediately after “For any type of aquacultural operation”.

19 Section 79 of the regulations is amended by

(a) adding “annual” immediately before “fee” in the heading; and

(b) striking out “a fee” wherever it appears and substituting “an annual fee”.




Summary Offence Tickets Regulations–amendment

Order dated November 6, 2019 Amendment to regulations made by the Attorney General and Minister of Justice

pursuant to Section 8 of the Summary Proceedings Act

Made under Section 8 of Chapter 450 of the Revised Statutes of Nova Scotia, 1989,

the Summary Proceedings Act

I, Mark Furey, Attorney General and Minister of Justice for the Province of Nova Scotia, pursuant to Section 8 of Chapter 450 of the Revised Statutes of Nova Scotia, 1989, the Summary Proceedings Act, effective on and after the date of this order, hereby

(a) amend Schedule M-26 to the Summary Offence Tickets Regulations, N.S. Reg. 281/2011, made by order of the Attorney General and Minister of Justice dated October 4, 2011, to designate certain offences under the Town of Windsor Bylaws as summary offence ticket offences, in the manner set forth in the attached Schedule “A”; and

(b) order and direct that the penalty to be entered on a summons in respect of an offence set out in amendments to the schedules to the Summary Offence Tickets Regulations, N.S. Reg. 281/2011, as set forth in the attached Schedule “A”, is the out-of-court settlement amount listed in the out-of-court settlement column set out opposite the description for the offence, and includes the charge provided for in, and in accordance with, Sections 8 and 9 of the Act.

Amendment to the Milk Producer Licensing Regulations made by the Dairy Farmers of Nova Scotia

pursuant to clauses 9(f) to (i) and 15(1)(a) of Chapter 24 of the Acts of 2000, the Dairy Industry Act

Subsection 13(1) of the Milk Producer Licensing Regulations, N.S. Reg. 125/2017, made by the Dairy Farmers of Nova Scotia on October 14, 2016, and approved by the Natural Products Marketing Council on August 21, 2017, is repealed and the following [subsection] substituted:

Penalty for violating bacteria count, somatic cell count or abnormal freezing point standard 13 (1) A producer is subject to a penalty as set out in subsection (2) if the following circumstances

occur:

(a) for a bacteria count penalty,

(i) a bacteria count higher than the bacteria count standard in Section 56 of the milk production regulations has been found in the current month and in at least 40% of the tests of the producer’s milk within a 3-month period that includes the current month,

(ii) where at least 3 bacteria count test results are available within the continuous 3-month period, and where only 3 test results are available, all 3 bacteria count test results must be higher than the bacteria count standard in Section 56 of the milk production regulations in order to result in a penalty;

(b) for a somatic cell count penalty,

(i) a somatic cell count higher than the somatic cell count standard in Section 56 of the milk production regulations has been found in the current month and in at least 40% of the tests of the producer’s milk within a 3-month period that includes the current month,



(ii) where at least 17 somatic cell count test results are available within the continuous 3-month period;

(c) for an abnormal freezing point penalty,

(i) an abnormal freezing point as set out in Section 3 of the Abnormal Freezing Point Standard for Cow’s Milk Regulations has been found in the current month and in at least 40% of the tests of the producer’s milk within a 3-month period that includes the current month,

(ii) where at least 3 abnormal freezing point test results are available within the continuous 3-month period, and where only 3 test results are available, all 3 abnormal freezing point test results must meet the definition of an abnormal freezing point set out in Section 3 of the Abnormal Freezing Point Standard for Cow’s Milk Regulations.

2 The table in subsection 14(4) of the regulations is amended by

(a) striking out “$3.00/hl” and substituting “$6.00/hl”;

(b) striking out “$4.50/hl” and substituting “$9.00/hl”; and

(c) striking out “$6.00/hl” and substituting “$12.00/hl”.

3 Sections 23 and 24 of the regulations are repealed.

Regulations Respecting a Prohibition on Winter Parking of Vehicles made by the Provincial Traffic Authority under subsection 202(1)

of Chapter 293 of the Revised Statutes of Nova Scotia, 1989, the Motor Vehicle Act

Citation 1 These regulations may be cited as the Winter Parking Ban Regulations.

Application 2 These regulations apply to any highway that is subject to the Public Highways Act.

Limitation on parking 3 Notwithstanding that certain traffic signs have been erected which may permit motor vehicles to park or

stand upon sections of highway during the hours stated thereon, an owner, driver or person having control or custody of any vehicle must not park the vehicle upon any highway in Appendix A or any highway in the communities listed in Appendix A

(a) between 1 a.m. and 6 a.m.;

(b) in a manner that hinders, inconveniences or prevents the removal of snow or ice from a highway unless the vehicle is attended by a person authorized to operate and capable of operating it on a highway; or

(c) from 1 hour after a snowstorm starts to 2 hours after the snowstorm stops.

Determination of boundary 4 For the purposes of these regulations, the boundaries of a community are determined in accordance with

the Geographical Names Program established by the Government of Nova Scotia.

Exception 5 Section 3 does not apply to any of the following vehicles:

(a) a motor vehicle registered to a medical practitioner who is registered under the Medical Act if all of the following apply:

(i) the vehicle is parked reasonably near the medical practitioner’s office or residence,

(ii) the vehicle is immediately available to the medical practitioner for professional calls;

(b) a motor vehicle parked by a medical practitioner who is registered under the Medical Act if all of the following apply:

(i) the medical practitioner is engaged in their occupation,

(ii) the vehicle is parked in reasonable proximity to the location where the medical practitioner is engaged in their occupation;

(c) a motor vehicle registered to a police department, the Royal Canadian Mounted Police or the Canadian Forces;

(d) a commercial vehicle parked by a driver for the purpose of loading or unloading merchandise;

(e) a motor vehicle registered to a public utility as defined in the Public Utilities Act that is parked reasonably near the residence of its driver and immediately available for emergency calls.

Effective dates These regulations are effective from December 15, 2019, to March 31, 2020, both dates included.
