It’s a cliche to say that elections have consequences — but it’s true.

We saw that especially in 2016 and then again in 2018. The elections in 2016 brought us the worst President for the environment in modern US history and a Congress that put protecting polluter profits and implementing the Trump agenda before protecting our health, environment, or democracy.

Voters began to right the ship in 2018 by sweeping progressive champions from across the country into the House. This new majority went to work right away to hold the Trump administration accountable and pass legislation that prioritizes people. The first bill passed by the House in 2019 was H.R. 1, the For the People Act, a series of democracy reforms. The House continued, passing nearly 500 bills including legislation to protect the Arctic Refuge from drilling, make Washington DC the 51st state, protect our coasts from offshore drilling, and more. Representative Alexandria Ocasio-Cortez (D-NY) and Senator Ed Markey (D-MA) introduced the Green New Deal, with hundreds of co-sponsors and the House rejected the Trump administration’s reckless spending cuts.

The House in the 116th Congress has held the Trump administration’s feet to the fire, holding hearings to investigate decisions by the Environmental Protection Agency (EPA) and the Department of the Interior (DOI) that put our health, water, and lands at risk. They have introduced bills like the Clean Water for All Act which would repeal the Trump administration’s Dirty Water Rule. In 2020, the House of Representatives impeached President Trump.

As the nation was gripped by the COVID-19 crisis, the House continued to put people first in relief efforts. In addition to the stimulus and relief bills that were also passed by the Senate and signed by the President, the House has passed bills like the HEROES Act to strengthen our elections by providing states with the funding needed to make voting safe and expand Vote-by-Mail. The HEROES Act also would establish a moratorium on utility and water shutoffs and fund a program to help low-income people afford their water bills. Despite overwhelming public support for these measures, GOP Senate leadership has indicated they are unlikely to pass the bill in its current form.

During the pandemic, the House also passed H.R. 2 in July 2020. H.R. 2 is a sweeping bill to fund a 21st century transportation system and make improvements to the nation’s failing infrastructure. It is forward-looking legislation that would create jobs and address emissions from the transportation sector, the nation’s largest source of climate change pollution.

Unfortunately the US Senate, under the leadership of Majority Leader Mitch McConnell, has remained committed to rubber stamping the President’s agenda instead of operating as a separate branch of government.

The Senate could have demanded accountability when the scandal-plagued tenures of Scott Pruitt at EPA and Ryan Zinke at DOI ended, but Senators simply confirmed their replacements — both corporate lobbyists for the fossil fuel industry — along party line votes. In fact, the Senate has spent more time confirming President Trump’s judicial and other appointments than legislating. The Senate has let important bills like H.R. 1 linger and refused to take up any significant legislation to address the climate crisis or chemical contamination of our water. The only significant environmental bill passed by the Senate was the Great American Outdoors Act (GAOA) which fully funds the Land and Water Conservation Act and addresses the maintenance backlog at our national parks. While important, passage of GAOA doesn’t come close to making up for the Senate’s refusal to put the needs of people before the profits of corporate special interests.

The Senate has equally not been up to the task when it comes to helping the country weather the COVID-19 crisis. After the initial rounds of relief bills, the Senate has demanded additional bailouts for corporations and liability protection for companies who might force their employees back to work without proper safeguards. Senate leadership is willing to let states go bankrupt, will not appropriate funding so states can ensure safe and fair elections, and is standing by as the President attempts to dismantle the US Postal Service.

We must change this.

The most important election in our history is this November. We hope you’ll use these scores as a guide at the ballot box. The people who represent us matter. For too long, too many elected officials have cared more about the powerful special interests who call the shots in Washington than people like you and me. It’s time to change that.

We must elect people in 2020 who will work with us to build the just, sustainable future we all deserve.

The US House has passed hundreds of bills during the 116th Congress while the Senate has become a legislative “graveyard”. Senate Majority Leader, Mitch McConnell, relishes his role as a barrier to common sense protections for our water and health. He has embraced the nickname, “the Grim Reaper” as he has refused to allow the Senate to take up bills that would safeguard our water, air, climate, and health; protect and improve our democracy; address our failing infrastructure; and more. The Senate has instead focused on confirming President Trump’s judicial and administrative nominees.

As a result, Clean Water Action was only able to score 5 votes in the Senate, despite scoring 18 votes in the House.

SCORING: Clean Water Action tallied 18 votes for each Representative and 5 votes for each Senator.

For a perfect 100%, a member of Congress must vote correctly on all votes for which they register a vote. Most votes followed party lines — Republicans generally voting against, and Democrats in favor of the environment. 111 Republican members of the US House scored zero or in the single digits.

225 Democratic members of the House scored 94% or higher, including 213 perfect scores of 100%. In the Senate, 45 of the 47 Democratic and Independent members scored above 80% or higher with 40 earning a perfect 100%. In contrast only one Republican member of the Senate scored 80% with the majority scoring 40% or lower. The partisan breakdown is clear — Republican Members of Congress favor corporate special interests while putting our health, environment, and climate at risk.

H.R. 1 — For the People ActThe For the People Act would make it easier for people to exercise their constitutional right to vote. It would strengthen voting rights and fair elections by enacting automatic voter registration, expanding early voting, re-enfranchising people with felony convictions, ramping up election security, and creating a federal holiday for Election Day.

It would encourage small-donor publicly-funded elections (not corporate special interest-funded elections) so lawmakers don’t have to rely on big donors and corporate money, full disclosure of political spending, and stronger oversight to make sure our rules are actually enforced.

H.R. 1 would also help bring an end to gerrymandered districts drawn to protect the incumbents, and remove partisan politics from the process. It would also tighten ethics standards for government officials and help close the “revolving-door” which allows industry hacks and polluter-friendly public officials to move freely between public agencies and the industries they regulate.

H.R. 2 — The INVEST in America ActIn many areas of our nation our infrastructure is no longer up to the task. Pipes, septic tanks, and treatment facilities have exceeded their intended lifespans and are breaking down, with the most severe impacts often falling on low-income communities and communities of color.Our transportation system encourages sprawl and auto dependency, exacerbates inequality, kills more than 35,000 people every year, and is the single largest source of to

climate emissions in the US. Much of our transportation and infrastructure lacks the resilience required to deal with the impacts of the climate crisis.

H.R. 2 makes a $1.5 trillion investment in America’s infra-structure. This bill would revamp the federal transportation program, including a massive increase in transit and rail funding. It would spur clean energy development, clean up orphan oil and gas wells, and more. It would invest in water infrastructure by funding the Clean Water State Revolving Fund (SRF) at $8 billion and the Drinking Water SRF at $5.5 billion annually, put $4.5 billion toward lead service line replacement each year, and increase funding for several other water programs over the next five years.

The INVEST in America Act will help make smart investments in our transportation and infrastructure — including green infrastructure — which will protect public health, build resilience, enhance wildlife habitat, and create quality job opportunities for workers.

NominationsThe Senate has a duty to vet and approve or disapprove of nominees for high level agency positions including cabinet members, federal judges, and nominees for the Supreme Court. During the Trump administration, the Senate has confirmed disastrous nominees who come from the industries they are charged with regulating. After Environmental Protection Agency Administrator, Scott Pruitt, and Department of the Interior Secretary, Ryan Zinke, both resigned after becoming engulfed in scandals, the Senate confirmed their replacements.

EPA Administrator Andrew Wheeler is a former coal industry lobbyist. During his time as administrator he has engaged in an all-out assault on the Clean Water Act. Wheeler’s EPA has stripped Clean Water Act protections from 1 in 5 stream miles across the country and roughly half of the nation’s remaining wetlands. He has weakened rules for the disposal of dangerous coal ash and has finalized rules to allow dirty power plants to spew even more toxic wastewater into our lakes and streams. Wheeler has consistently undermined science, supported budgets that would have devastated the agency, and has slowed efforts to tackle the climate crisis.

Interior Secretary David Bernhardt is a former lobbyist for the oil and gas industry. He has refused to recuse himself from decisions involving his former clients. Bernhardt has supported efforts to increase drilling on public lands and pledged to sell leases to drill in the Arctic refuge before the Trump administration potentially ends. He appointed anti-public lands activist, William Perry Pendley, to run the Bureau of Land Management and oversaw the disastrous move of BLM headquarters from Washington DC to Grand Junction, CO. Bernhardt has also defended violent tactics used by US Park Police to disperse peaceful protestors in front of the White House.

1. S. 47, Public Lands Package The Public Lands Package permanently reauthorized the Land and Water Conservation Fund and protected millions of acres of land and hundreds of miles of wild rivers across the country. The pro-environment vote was YES.S. 47 passed 363-62 on February 26, 2019 and was later signed into law.

2. H.R. 1, the For the People ActH.R. 1 would restore our democracy by strengthening voting rights, reforming campaign finance laws, and improving ethics requirements for elected officials and lobbyists. The pro-environment vote was YES.H.R.1 passed 234-193 on March 8, 2019. It has not be taken up by the Senate.

3. H.R. 9, the Climate Action Now ActH.R. 9 was the first major climate bill the House voted on in a decade. It would keep the United States in the Paris Agreement, and would compel the Executive branch to come up with a plan to achieve the goals we pledged to meet.The pro-environment vote was YES.H.R. 9 passed 231-190 on May 2, 2019. It has not been taken up by the Senate.

4. H. Amendment 352 to H.R. 2740, to Withdraw from the Paris Climate AgreementThis amendment to the appropriations bill would have removed the U.S. from the Paris Climate Agreement. The pro-environment vote was NO.This amendment failed 183-241 on June 18, 2019.

5. H.R. 2740, Energy and Water, and other Departments FY20 AppropriationsThe “Minibus” spending bill would fund several federal agencies, including programs to promote clean energy, fight climate change, and invest in water infrastructure. With this vote, the House rejected Trump’s Dirty Budget which proposed funding cuts to key programs.The pro-environment vote was YES.H.R. 2740 passed on June 19, 2019. It was not taken up by the Senate.

6. H. Amendment 437 to H.R. 3055, Blocking the Clean Power PlanThis amendment to the appropriations bill in 2019 would have blocked funds to implement the Clean Power Plan, which regulates carbon emissions from power plants.The pro-environment vote was NO.This amendment failed 190-240 on June 20, 2019.

7. H. Amendment 442 to H.R. 3055, Blocking Methane Pollution LimitsThis amendment to the appropriations bill in 2019 would have blocked EPA’s methane pollution limits for new and modified oil and gas infrastructure.The pro-environment vote was NO.This amendment failed 191-241 on June 20, 2019.

8. H. Amendment 449 to H.R. 3055, Eliminating EPA Chemical Hazard Safety ProgramThis amendment to the appropriations bill in 2019 would have prohibited funds from being allocated to EPA’s Integrated Risk Information System (IRIS), which characterizes the health hazards of chemicals found in the environment. The pro-environment vote was NO.This amendment failed 157-275 on June 20, 2019.

9. H.R. 3055, Interior, Environment and other Departments FY20 AppropriationsThis “Minibus” spending bill would fund numerous federal programs, including those at the Environmental Protection Agency and Department of Interior. It would provide funding for pollution prevention, drinking water, and other programs — and rejected Trump’s Dirty Budget cuts.The pro-environment vote was YES.H.R. 3055 passed 227-194 on June 26, 2019. It was not taken up by the Senate.

10. H.R 205, Stopping Offshore Drilling in Eastern GulfThis bill would permanently extend the moratorium on oil drilling in certain areas of the Gulf of Mexico.The pro-environment vote was YES.H.R. 205 passed 248-180 on September 11, 2019. It has not been taken up by the Senate.

11. H.R. 1941, Stopping Offshore Drilling in Pacific and Atlantic OceansThis bill would prohibit new oil and gas leasing or preleasing in the Atlantic Outer Continental Shelf planning area (North Atlantic, Mid-Atlantic, South Atlantic, and the Straits of Florida) or the Pacific Outer Continental Shelf planning area (Washington/Oregon, Northern California, Central California, and Southern California).The pro-environment vote was YES.H. R. 1941 passed 238-189 on September 11, 2019. It has not been taken up by the Senate.

12. H.R. 1146, Protecting the Arctic Refuge from DrillingThis bill would prohibit the Department of the Interior from administering oil and gas leasing, development, production, and transportation in and from the Coastal Plain of the Arctic National Wildlife Refuge in Alaska.The pro-environment vote was YES.H.R. 1146 passed 225-193 on September 11, 2019. It has not been taken up by the Senate.

13. H. Amendment 738 to H.R. 535, Protecting Water from PFAS DischargesThis amendment to the PFAS Action Act would require EPA to regulate PFAS discharges under the Clean Water Act.The pro-environment vote was YES.This amendment passed 242-168 on January 20, 2020. It has not been taken up by the Senate.

14. H.R. 535, the PFAS Action ActThe PFAS Action Act would take several steps to protect the public and the environment from PFAS chemicals, including directing EPA to set drinking water standards, regulating PFAS under the Clean Water and Clean Air Acts, funding cleanup of PFAS contamination, and more.The pro-environment vote was YES.H.R. 535 passed 247-159 on January 20, 2020. It has not been taken up by the Senate.

15. H.R. 51, DC StatehoodThis bill would establish Washington DC as the 51st state in the US, bringing voting representation in Congress to the District’s more than 700,000 residents for the first time ever.The pro-democracy vote was YES.H.R. 51 passed 232-180 on June 26, 2020. It has not been taken up by the Senate.

16. H. Amendment. 829 to H.R. 2, Lead Service Line ReplacementThis amendment would establish a comprehensive lead service line replacement program and allocates $4.5 billion annually for five years.The pro-environment vote was YES.This amendment passed 240-181 on July 1, 2020. It has not been taken up in the Senate.

17. It will also provide $1.9 billion per year for 5 years to address the major maintenance backlog at our national parks, forests, refuges, and wildlife areas. The pro-environment vote was YES.H.R. 1957 passed 310-107 on July 22, 2020. It was signed into law on August 4, 2020.

S. 47, Public Lands Package The Public Lands Package permanently reauthorized the Land and Water Conservation Fund and protected millions of acres of land and hundreds of miles of wild rivers across the country. The pro-environment vote was YES.S. 47 passed 92-8 on February 212, 2019 and was later passed by the House and signed into law.

4. S. J. Res 53, Overturning the Dirty Power ScamThis bill would have blocked the Trump Administration’s Dirty Power Scam regulation, which rolled back carbon emissions limits for power plants.The pro-environment vote was YES.S.J. Res 53 failed 41-53 on October 17, 2019.

Note on the low number of scored Senate votes: Majority Leader Mitch McConnell (R-KY) calls himself the “grim reaper” and has refused to allow the Senate to take up hundreds of bills passed by the House. The Senate has mainly concerned itself with confirming judicial nominees and passing a few large pieces of legislation like the Great American Outdoors Act and the initial round of COVID-19 relief bills.

5. S. 3422, the Great American Outdoors ActThe Great American Outdoors Act is a landmark bill for our public lands. It fully funded the Land and Water Conservation Act, which was permanently reauthorized by S. 47, at $900 million per year. It will also provide $1.9 billion per year for 5 years to address the maintenance backlog of the National Park Service, the United States Fish and Wildlife Service, the Bureau of Land Management, the Forest Service, and the Bureau of Indian Education. The pro-environment vote was YES.S. 3422 passed 73-25 on June 17, 2020. It was later passed by the House and signed into law on August 4, 2020.
