GENERAL TERMS AND INSTRUCTIONS

SECTION I TERMS AND CONDITIONS

1.1 All bids submitted shall be firm for a minimum of 60 days, unless otherwise specified.

1.2 The equipment furnished under this specification shall be the latest improved model in current, as offered to commercial trade, and shall be of quality workmanship and material. The bidder represents that all equipment offered under this specification shall be new. USED, SHOPWORN, DEMONSTRATOR, PROTOTYPE OR DISCONTINUED MODELS ARE NOT ACCEPTABLE, UNLESS SPECIFICALLY STATED OTHERWISE IN THE SPECIFICATIONS.

1.3 The City reserves the right to cancel or make null and void any purchase order, if delivery cannot be made on the specified delivery date.

1.3.1 In case of default by the contractor, the City may procure the articles or services from other sources and hold the contractor responsible for any excess cost occasioned thereby.

1.4 All items shall be delivered F.O.B. destination. Delivery costs and charges shall be included in the bid, unless otherwise stated in the specifications or proposal.

1.5 The name and manufacturer, trade name, manufacturer or vendor catalog number mentioned in specifications and proposal sheet is for the purpose of designating a minimum standard of quality and type and for no other reason. Such references are not intended to be restrictive. Bids will be considered for any brand which meets or exceeds the quality of the specifications listed for any items unless, otherwise stated in the specifications or proposals.

1.6 Bid tabulations will not be given over the telephone. Vendors desiring a bid tabulation shall enclose a stamped and self addressed envelope with their bid.

1.7 Bid awards are not official until a purchase order is issued or the Purchasing Department notifies the successful vendor in writing.

SECTION II SUBMISSION OF BID

2.1 Bids received after the designated date and time will not be opened nor returned.

2.2 All bids shall be submitted on and in accordance with forms for this purpose, which are available from the Purchasing Department. Additional supplementary documentation, when requested, shall be submitted on the bidder’s letterhead.

2.3 All bids are to be submitted in sealed, plainly marked envelopes. Envelopes shall be marked in the bottom left corner with the Title of the Invitation to Bid, the Bid Number and the Opening Date. Facsimile and telephone bids will not be accepted.

2.4 All bids shall be typewritten or completed in black ink.

2.5 An authorized officer or agent of the company submitting the bid in order to be considered must sign all bids.

2.6 Bid documents shall be submitted, in duplicate, to the City of Opelika, Purchasing Department.

2.7 Bids which show any omission, irregularity, alteration of forms, additions not called for, conditional or unconditional unresponsive bids may be rejected.

2.8 Any bid submitted with corrected errors shall have the correction initialed by the person signing the bid.

2.9 Bidder shall submit with bid, the latest printed literature, model numbers, detailed specifications and pictures on equipment they propose to furnish. This literature is for informational purpose only and shall be used to help determine a product’s compliance with specifications.

2.10 Bidder shall supply the name and contact information for three references of equipment that was provided and installed for public facilities.

SECTION III BID EVALUATION

3.1 The City reserves the right to evaluate all bids, waive any technical or informalities, reject any and/or all bids and proposals, and further specifically reserves the right to make the award and/or awards in the best interest of the City.

3.2 The bid evaluation will be made on the following criteria:

3.3 The City may waive minor differences in specifications, provided these differences do not violate the specification intent, materially affect the operation for which the item or items are being purchased nor increase the estimated maintenance and repair cost to the City.

3.4 In order for a prompt pay discount to be considered as a factor in the award of this bid, the minimum days allowed for payment to receive discount shall be 15 days after receipt of a correct invoice.

3.5 The City of Opelika intends to award this bid in its entirety to one single vendor. However, the City reserves the right to award in the best interest of the City. Therefore all equipment must be bid. Any equipment left blank or “no bid” will not be considered.

3.6 All equipment bid must be sold and supplied by one single manufacturer.

3.7 Unless clearly shown on the bid that it is the intent that a reduced total price is being offered on the basis of receiving an award of all items covered by the total, any totals should be the actual sum of the extension of unit prices; otherwise, in the event of any discrepancy between a unit price(s), extended price(s) and/or total price(s), unit price shall govern and the bid will be refigured accordingly.

3.8 Alabama Bid Law allows a Local Preference to businesses located within the City of Opelika when their bid is within 3% of the lowest responsible bid. The City will extend that preference when applicable.

3.9 The City shall be sole judge as to an item meeting or exceeding the specifications.

SECTION IV BILLING AND PAYMENT

4.2 Payment by the City shall be made within thirty days, unless otherwise specifically provided, subject to any discounts offered.

4.2.1 Payment will be made by the City to the vendor upon receipt of invoice, and acceptance of the item(s) by the City.

4.2.2 Any prompt pay discount offered will be computed from the date of delivery of the equipment, supplies, or materials at destination, when final inspection and acceptance are at those points, of from the date the correct invoice is received, if the latter is later than the date of delivery.

SECTION 5 INSURANCE

5.0 The contractor, at its own expense, shall keep in force and maintain during the life of the contact, the amount listed below:

GENERAL SPECIFICATIONSSTATIONARY WEIGHT EQUIPMENT

Frame ConstructionFrame shall be constructed of mechanical quality steel purchased in mill run quantities. Frame shall be primarily 2 ½” x 4 ½” oval shaped tubing with 11 gauge wall thickness. Movement arms shall be primary 1 5/8” x 2 ¾” oval shaped tubing with 11 gauge wall thickness. Frames shall be welded (not bolted together) for maximum structural integrity and minimum maintenance when possible. Larger machines have bolt-together configuration to facilitate movement through smaller doorways and difficult installations.

Frame FinishPrior to applying finish, each part shall be chemically washed to prepare surface for maximum adhesion. The frames shall be coated with an electrostatic epoxy powder coat finish applied in a powder form and baked at 400°F. The frames shall be clear coated for added protection, which results in a smooth, consistent finish which is very hard, assuring scratch and chip resistance.

Weight SelectionWeights are selected by using a 7/16” selector pin, which completely penetrates the weight plate and locks in place using a magnetic ring to eliminate any change of disengaging during use. The selector pin shall be connected to the weight to eliminate loss of substitution of substandard pins.

Incremental Weight SystemWeights shall have an incremental system that allows user to increase resistance by 5# increments (5#, 10#, 15#). The system shall utilize a secondary weight stack and shall be adjustable with a pull and turn of the dial that is integrated on the top plate of the primary weight stack.

Weight PlatesWeight plates shall be machined form solid 1” thick steel. Finish shall be a wrinkle gray powder coat. The thickness of the plate shall be held to precise tolerance by machining the entire upper and lower surfaces which results in a better pin fit to the stem.

Weight Plate BushingsEach plate (not just the top weight) shall contain low friction bushings, which surround the guide rods to minimize friction and noise.

Top Weight BushingsThe top weight shall be stabilized with an engineered composite structure with self-lubricating bushings. The bushings shall be self lubricating in order that the guide rods will not require lubrication.

Weight Stack Guide RodsGuide rods shall be ¾” cold drawn steel, turned ground and polished with hard chrome finish

Weight Stack SuspensionWeight rubber bumpers shall be suspended under each stack to reduce shock and vibration stresses to the frame and facility floor.

Weight Selection ShaftThe shaft shall be constructed of zinc plated cold finished steel and precision drilled for accurate pin selection.

Weight TransportWeight transport shall be 7x19 construction, 3/16” galvanized steel, internally lubricated, nylon-coated aircraft cable with breaking strength rated at over 4, 000 pounds.

Cable AdjustmentAll cables shall be adjusted at the top weight utilizing a metric 24mm open-end wrench.

Weight Stack GuardsAll weight stacks shall be fully guarded on the backside to prevent bystanders from inadvertent contact with the weight stack during use. Front weight stack guards shall be available upon request that meets EN957 standards.

PulleysAll pulleys shall be at lease 4 ¼” working diameter using fiberglass-impregnated nylon with precision fit cable groove and double sealed bearings.

Pulley CoversAll pulleys shall be covered to minimize the danger of a moving pulley catching a person’s finger or clothes.

CamsAll cams shall be CNC machined from solid polymer and individually designed for each unit to match the appropriate muscle strength capability curve.

Counter Balanced Input ArmsInput arms on the equipment shall be counter balanced where appropriate to eliminate the weight of the assembly from the weight selected by the user.

Integral BearingsBearings shall be sealed bearings with a basic radial load rating of over 2,000 pounds. Bearings shall be mounted within precision-machined housings for optimal alignment, which results in smooth and friction free movement.

RollersInternal seat carriage adjustment rollers shall be made of molded polymer mounted on machined steel axles for smooth, durable operation.

Support RailsSLP shall have wire brushed stainless steel rails. Polished will not be accepted.

BoltsAll hardware shall be stainless steel

UpholsteryUpholstery shall be vinyl that is resistant to wear and stains from sweat and other deteriorating factors.

FoamThree and four pound EVA foam (deformation resistant) or equal shall be used on all machines. The foam shall be injection molded directly to the multi-ply wood support board with integral 10mm T-nuts.

Hand GripsHand grips shall be an extruded 60-durometer-thermorubber compound that is non-absorbing, wear and tear resistant and exhibits good dry and wet frictional characteristics. The grips shall be retained with aluminum collars, which eliminate the tendency of the grip to slide off the handle.

Seat AdjustmentsNumeric seat and pad adjustments correctly align body to machine for proper posture, muscle isolation and body stabilization. Gas assisted springs (where applicable) to improve ease of use on adjustments. Internal roller mechanism on seat adjustment provides smooth and consistent operation.

Foot PlatformsAll foot platforms shall be molded rubber with a slip resistant texture.

Instructional PlacardEquipment shall include visual placards that provide step by step instructions as well as picture to illustrate proper use and muscles trained.

Equipment AnchoringAll machines shall have holes in the feet, which allow for easy anchoring to the floor to minimize the possibility that they will be tipped.

WarrantyEquipment shall carry a 10 year minimum warranty on frames, 5 years on integral bearings, guide rods, pulleys and weight plated, 1 year on cables and grips and 90 days on upholstery and any items not specified.

The City realizes that specifications may vary slightly among manufacturers. The City welcomes bids from any manufacturer who has fitness equipment believed to be equal or to exceed these specifications. The City will consider all bids and will award the contract to the supplier whose bid is believed to be in the best interest of the City.
