Solemandates –what you needto know to avoid pitfallsThere is no doubt that the bestway to sell your property forthe most money the marketwill pay is with a sole man-date. By sole mandate I meanwhere you give an exclusiveinstruction to one estate agen-cy to market your property ef-fectively, use the correct strat-egies to attract the strongestpossible buyer enquiry, com-municate honestly so youhavetherealmarketfeedback,and then negotiate to get youthe highest price.
Therearefourissuesinplaywhen it comes to the sale ofyour property; the marketing you need, theservice you need, when your property willsell, and how much it will sell for.
Thefirst twoissuesarewithinthecontrolof the estate agency you list with. The sec-ond two issues are in the hands of the mar-ket – the buyers. Whilst the marketing andservice will have an influence on these lasttwoissues– thebuyerswilldeterminewhatyour property is worth today and when itwill sell.
When you enter into a sole mandate tosell your property it is only legal and bind-ingwhenithasallof the following:Asellingprice, a commission rate or amount, and anexpiry date. If any of these three are miss-ing, then your sole mandate is invalid andnot binding. Especially be aware of solemandates that have as an expiry date “untilsold”, or “until cancelled by mutual agree-ment”. These are invalid and a breach ofthe Code of Conduct.
In addition to these three legal require-ments forasolemandate,youwouldbepru-
dent to ensure your solemandate also has the fol-lowing:
) A commitment inwriting from the agent tomarket your home, withdetail on what the market-ing plan includes, specifi-cally relating to when andwhere they will advertise.
) A commitment to de-liver a minimum servicelevel to you, with the mini-mum expectation clearlyindicated.
) A clause allowing youto put the estate agency to
terms should they not stick to their under-takings, failing which you can cancel themandate without any penalty.
It’s amazing how many sellers sign solemandates with none of these undertakingsfrom estate agents and then feel trapped intheir mandate without recourse. If thesecommitmentsarenotmadeinwriting, thendon’t sign the mandate. Choose an estateagency that will commit to writing whatthey promise.
The Consumer Protection Act allows forthe cancellation of a sole mandate on 20business days’ notice, but not without rea-sonable penalty. So you could take thisroute – but it would be much better to holdtheestateagenttotheirpromisesandiftheyfail todosoafternoticetorectify,makesureyou have a cancellation clause without pen-alty to you. A sole mandate with a companythat does what they promise is the best wayto sell. But don’t be caught out by signinga mandate that doesn’t protect you in theevent of non-performance.

Fuel con-sumption has benefited hugely, with overallconsumption plummeting to 7,7 litres per100 km.This is followed by a 2.0-litre turbodiesel– the only compression-ignition Boxer en-gine in the world – and priced at R529 000.While peak power and torque remain at110 kW and 350 Nm respectively, the torquepeak starts lower down and continues fur-ther up the rev range. Consumption has im-proved to 6,3 litres per 100 km.The flagship of the range is the Outback3.6R-S, with the smooth , 3.6-litre H6 engineunder its aluminium bonnet.
