[The following specific data for the Works to be bid shall complement, amend, or supplement the provisions in the Instructions to Bidders. Wherever there is a conflict, the provisions herein shall prevail over those in the Instructions to Bidders.]

Instructions to Bidders Clause Reference

1.1 The Employer is Pakistan Water and Power Development Authority (WAPDA). Name and address of the Employer’s representative for the purpose of correspondence is:

1.1 The works correspond to Kachhi Canal Project.

The Kachhi Canal Project is to be executed under the various contracts.

The Works under this Contract consists of:

Contract No. KC-6A-1(R):- Construction of Main Canal and Distribution System (Remaining Works of Earthwork, Structure & Lining of Main Canal) From RD 1005+000 To RD 1045+000)

The construction of following major works is included but not limited to under this Contract:

12 Kilometer earthwork 12 kilometer canal lining Re-habilitation works on Village Road Bridge 1 No.

Sub-Clause 3.1 is substituted with the following:3.1 The Invitation for Bids is open to all bidders meeting the following requirements:

a) Duly Licensed by Pakistan Engineering Council in the Category relevant to their bid value. In case of a Joint Venture, each partner must possess PEC license in the Category relevant to the value of %age share in the Joint Venture. Lead firm share should not be less than 40% in the Joint Venture and number of Partner should not be more than three (3).

b) Foreign firm(s) can participate in bidding by forming a Joint Venture with Pakistani firm(s) with a share not exceeding 70% and share of Pakistani firm(s) at least 30% pursuant to prevailing PEC By-Laws for “Construction & Operation of Engineering Works”.

c) Meets the Post-qualification Criteria provided as “Attachment to Bidding Data”.

8.1 Time limit for clarification:

Minimum number of days to seek clarification by the prospective bidder shall be 14 days.

10.1 Bid language:

The Bid Language shall be English.

The Sub-Clause 11.1(b) is substituted with the following:11.1(b) “(i) The Employer shall determine to its satisfaction whether the Bidder that is selected

as having submitted the lowest evaluated and substantially responsive bid is eligible and meets the post-qualification criteria specified in Attachment to Bidding Document.

(ii)The determination shall be based upon an examination of the documentary evidence of the Bidder’s qualifications submitted by the Bidder, pursuant to Attachment to Bidding Document.

(iii) An affirmative determination shall be a prerequisite for award of the Contract to the Bidder. A negative determination shall result in disqualification of the bid, in which event the Employer shall proceed to the next lowest evaluated bid to make a similar determination of that Bidder’s qualifications to perform satisfactorily.”

The Sub-Clause 11.1(c) is substituted with the following:

11.1(c) Furnish Technical Proposal:

The bidder has to submit a technical proposal in sufficient detail to demonstrate the adequacy of the bid in meeting requirements for timely completion of the Works. .

The Sub-Clause 11.1(d) is added as follows:

11.1(d) If a bidder / joint venture is post qualified in more than one contract for Kachhi Canal Project awarded, then the cash flow requirement for the remaining contract(s) will be reviewed. In case, after successive downward adjustment(s) for the already awarded contract(s), the cash flow requirement for the next contract(s) is not met, he will not be eligible for subsequent award.

The Sub-Clause 11.1(e) is added as follows:

11.1(e) A bidder (single entity or a joint venture) will not be eligible for award of more than two contracts considering all the packages related with construction of Project Colony in Thor Valley.

Sub-Clauses 11.4(a), 11.4(b) & 11.4(c) are added as follows:

11.4(a) “The Bidder shall have the nationality of any country except that which, as a matter of law or official regulation, Pakistan prohibits commercial relations with that country. The Bidder shall be deemed to have the nationality of a country if the Bidder is a citizen, or is constituted, incorporated, or registered and operates in conformity with the provisions of the laws of that country, as evidenced by its Articles of Incorporation or Documents of Constitution, and its Registration Documents.”

11.4(b) “The Bidder and all parties constituting the JV shall not have a conflict of interest. Bidders shall be considered to have a conflict of interest, if they participated as a consultant in the preparation of the design or technical specifications of the Works that are the subject of this prequalification. Where a firm, or a firm from the same economic

or financial group, in addition to consulting, also has the capability to manufacture or supply goods or to construct works, that firm, or a firm from the same economic or financial group, cannot normally be a supplier of goods or works, if it provided consulting services for the contract corresponding to this prequalification, unless it can be demonstrated that there is not a significant degree of common ownership, influence or control.”

11.4(c) “Government-owned entities shall be eligible only if they can establish that they are legally and financially autonomous, and operate under commercial law, and that they are not dependent agencies of the Employer.

13.1 This clause is replaced with the following: “Bidders to quote entirely in Pak Rupees and all Payments to the Bidders shall be made in Pak Rupees only and no foreign currency payment is admissible”.

14.1 Period of bid validity:147 days

15.1 Amount of Bid Security:

Minimum 2% of bid amount.

15.2 This Sub-Clause is substituted with the following:“The Bid Security shall be, at the option of the bidder, in the form of Deposit at Call or a Bank Guarantee issued by a Scheduled Bank in Pakistan or from a foreign bank duly counter guaranteed by a Scheduled Bank in Pakistan in favour of the Employer, that is, General Manager (Central) Water,Wapda, 3-Canal Bank, Mughalpua, Lahore. valid for a period 28 days beyond the Bid Validity date.

The Security for a bid submitted by a Joint Venture shall be in the name of the Joint Venture.”

Irrevocable Bank Guarantee from any Schedule Bank in Pakistan for an amount equal to 10% of the Contract Price stated in the Letter of Acceptance; or irrevocable Bank Guarantee from a Bank located out side Pakistan duly counter-guaranteed by a Schedule Bank in Pakistan.
