Mr. Isidoro Dell’Oro in 1863 established his firm in Yokohama as one of the first Italian silk export business with Euro-pe, when he went home in 1880 he left Japan and the company to be managed by one of his sons, Giuseppe Del-l’Oro, who established his business in Hong Kong where he continued his life until he died mid twenty century. A PRECIOUS BLACK AND GILT LACQUER SUZURIBAKO(BOX FOR WRITING UTENSILIS) AND COVER, JAPAN,MEIJI PERIOD (1869-1912)With a rectangular shape, the flush-fitting cover withshaped indentations to either sides for easy removaldecorated with tree by a river with blossoming flowersbranches and pheasants amongst clouds, all in gold, silverand black and blue takamaki-e and hiramaki-e on a nashijiground, the underside of the cover lacquered in similartechniques with a scene of flowers sprouts and rocks by asinuous river, removable inner tray and on a nashiji ground,fitted with an rectangular inkstone and a silver waterdropper with prunus flowers. In very good condition, verytiny wear on lacquer on the corners.

Some wear on thelacquer and on the surface, one knob missing.

The stand with relief incision of a dragon on the front border. Some wear on lacquer and onthe surface of the cabinet, the stand with minor wear on the surface.

Due to humidity the bases of the tiers on some sidedetached, on one cover a piece of 2 cm of lacquer re-stuck.

A MASSIVE AND FINELY PAINTED RUBY-GROUND “FAMILLE ROSE” 'THREE RAMS' BALUSTER PORCELAIN VASE, QINGDYNASTY, 19TH CENTURY, APOCRYPHAL IRON-RED SEAL MARK QIANLONGThe massive vase mightily constructed with an ovoid body rising from a splayed foot, surmounted by a tall waisted neckand flared rim, the exterior luxuriantly decorated in the Famille-Rose palette, with stylized flower heads amongst scrollingfoliage on a ruby ground, the neck flanked by two applied iron-red chilong handles accentuated with gilt highlights,the exterior of the body enameled against the white ground, with a continuous scene depicting three rams traverse ina landscape, under large pine trees from which a rising sun shines through, surroundings with detailed of fruiting andblossoming branches issuing from rockwork, including roses and peonies, berries and prunus, together with leafy trees,all between two ruby-ground bands, above with a key-fret motif band, another one, with a yellow foliate spraysencircling the lower shoulder of the body, the neck decorated with further stylized lotus blossoms with cash, bats andShou character, suspending chimes between a turquoise band of ruyi pendant collaring the lower mouth rim, the white-glazed base inscribed to the center with a six-character seal Qianlong mark in iron-red. In very good condition, aparta light star crack to the base close to the mark, and a firing defect to the joint of the lower neck, which was not wellmerged with the body, following the detachment at the joint of the neck of the vase, it was again annealed at lowtemperature with the consequence that at the joint the enamels are slightly over-fired, with some other minor firingimperfections, very small wear on the surface as well as some minute scratches and very minute flakes to the enamels,more evident at the joint of the neck.

Note: three Rams ‘san yang' design that represents a change of fortune with the arrival of Spring and the New Year and is thusclosely associated with New Year celebrations. The three rams are often shown together with the rising sun ‘taiyang’ to form therebus for 'three ram ‘yang’ bring prosperity'. The Book of Changes ‘Yijing’ first mentions the phrase san yang referring to the threemale lines, called tai – the symbol of heaven. Tai is positioned under three female lines called kun that represent earth. Hence thephrase 'sanyang kaitai' which means the New Year brings renewal and a change in fortune.

RARA ED IMPORTANTE PICCOLA FIGURA IN BRONZO DI SHIVA EPARVATI, ARDHANARISHVARA, INDIA DEL NORD EST, X SECOLO

A VERY RARE AND IMPORTANT SMALL BRONZE FIGUREOF SHIVA AND PARVATI, ARDHANARISHVARA,NORTHEASTERN INDIA, 10TH CENTURYThe finely cast bronze sculpture represent the androgynousform of Shiva and Parvati Ardhanarishvara, shown with hisupper right hand holds the tri��la, a weapon very similar tothe trident, in which the lateral prongs are curved andgenerally the central prong is longer. The right ear wearsa nakra-kundala, sarpa-kundala ("serpent-earring"). A fulleye depicted in the middle. His half has a flat masculinechest, a straight vertical chest, broader shoulder, widerwaist and muscular thigh. He wears a yagnopavita(sacred thread) across the chest, which is sometimesrepresented as a naga-yagnopavita (a snake worn as ayagnopavita) or a string of pearls or gems. Theyajnopavita may also divide the torso into its male andfemale halves. He wears ornaments characteristic ofShiva's iconography, including serpent ornaments. Thefemale half has karanda-mukuta (a basket-shaped crown)on her head or well-combed knotted hair or both. The leftear wears a valika-kundala (a type of earring). A tilaka orbindu (a round red dot) adorns her forehead, matchingShiva's third eye. The left eye normally is painted withblack eyeliner, while the male neck is sometimes adornedwith a jewelled hooded serpent, the female neck has ablue lotus matching it. In the four-armed form, one of the leftarms rests on Nandi's head, while the other is bent inkataka pose and holds a nilotpala (blue lotus) or hangsloosely at her side as ours. In quite good condition, the lower part of the feet missing,other only few small pieces missing and minor nicks on theextremities, minor surface wear and other small castimperfections and some small incrustations, all as expectedof the period and typical of this type.

A BRONZE FIGURE OF MANJUSHRI SAMANTABHADRA, CHINA, LATE MING DYNASTY, 16TH-17TH CENTURY The bodhisattva is shown seated with the legs in pralambanasana pendent on the back of a recumbent elephant, andwith the hands held in Anjali mudra as they hold the ends of lotus stems that rise to the shoulders where they support ascroll and a book. The figure is wearing a flowing dress with a long ribbon and a beaded jewelry with a high complexjeweled crown. Both pose on a lotus base. In good condition, with only a small loss to the crown of the bodhisattvaand probably to the tusk of the elephant, the surface cover with a thick layer of dust from age, minor cast imperfectionsand some oxidation, the bronze will have a great improvement by cleaning it by a professional restored.

Sarasvat�, o Saraswat�, (sanscrit, "shewho flows"), it is the first of the three great goddesses of Hinduism, alongwith Lakshmi and Durg�, and the consort (or shakti) of Shri Brahm�, theCreator. Sarasvat� has been venerated since the Vedic age as a goddessof knowledge and the arts, literature, music, painting and poetry, but alsoof truth, forgiveness, healings and births; it is often mentioned in the RigVeda and Pur��as as river gods. It is not generally adorned with jewelsand precious like Lakshmi, and indeed it is often in austere clothes. Asthe god of beginnings, he is honored at the start of rites andceremonies. He is also invoked as patron of letters and learning duringwriting sessions. Ganesha, lord of beginnings and remover ofobstacles, dances as two musicians keep rhythm on their drums.Ganesha likely emerged as a deity as early as the 2nd century CE butmost certainly by the 4th and 5th centuries CE, during the Guptaperiod, although he inherited traits from Vedic and pre-Vedic precursors,Hindu mythology identifies him as the restored son of Parvati and Shivaof the Shaivism tradition, but he is a pan-Hindu god found in its varioustraditions.

A RARE CARVED GREY STONE STELE OF LAKSHMI NARAYANA, NEPAL, 12TH CENTURYThe large finely carved deity is represented standing above on a base formed on the lower part by a large plinth oflotus petals which support a smaller double lotus pedestal. His face displays a serene expression flanked by two jewelsring and an important high crown, is depict with the right half representing Vishnu holding the chakra, conch, mace,and lotus bud stem, and with Garuda emerging below the lotus, the left representing Lakshmi holding a sutra, lotus,mirror, and water pot, with the tortoise vehicle below. The sides of the arched back-plate carved with a fine motif of afoliate scroll which also surrounds his head. A FINE AND LARGE TERRACOTTA MASK OF BHAIRAVA, NEPAL, 15TH 16TH CENTURY The mask represented Shiva in the form of Bhairava very finely and powerfully modeled in a ferocious expression withsharply arched brows flanked by serpent hooped earrings and with large bulging eyes beneath furled brows centeredby the third eye, with gaping mouth exposing the fangs encircled by a finely ornamented of moustache and beard (canstill see some of the polychrome color which adorned the mask as we can see on the illustration of the catalogue)surmounted by a foliate tiara, amid petal borders, the flaming hair arranged in rows of tight curls finely detailed andcentered by a crescent moon, serpents and skulls, the face and ornaments richly detailed. In good condition, but couldhave a great improvement made by a professional restoration which could clean showing some of the remainingpolychrome color that with can still see underneath, with some surface wear and chips and flakes on surface and tothe extremities with only very small firing imperfections, minor surface wear and minor scratches, as expected of theperiod and typical of this type.

AN UNUSUAL BRONZE FIGURE OF SHOULAO, JAPAN, 18TH 19TH CENTURYThe bronze represents the divinity of Shoulao wearing a long fluent robe and sitting on the top of a sphere with threesmall engraved shells, one of which is gilded, the sphere wrapped in a knotted tissue. The clothes and objects in the catalogue come from the private collection of the noble family of Counts ZavagliRicciardelli. They were brought to Italy by Count Antonio Zavagli Ricciardelli (1877-1970), captain of the Italian RoyalNavy, stationed since 1912 in the port of Tientsin, today's Tianjin and his wife, Baroness Matilde Di Brocchetti (1892-1982).Baroness Matilde was the granddaughter of captain Enrico Di Brocchetti, official of the Kingdom of the Two Siciliesand minister of the Italian Navy, and daughter of Admiral Alfonso Di Brocchetti, of the Italian Royal Navy, (navalattaché in Paris and president of the Superior Council of the Navy, and field assistant to His Majesty the King). BothDi Brocchetti were senators of the Kingdom of Italy and in various diplomatic missions had repeatedly sailed the seasof Africa, America, China, Japan. Antonio and Matilde married in Rome, then left for the East, first to Japan then toChina, to Beijing, following in the footsteps of the family.Antonio and Matilde lived in Beijing in the Italian garrison from 1912 to 1916, while the Italian Royal Navy maintainedits fleet in the port of Tientsin. The Italian fleet was in charge of the commercial concession and the various delegationspresent there.Their apartment was furnished with furniture, paintings and furnishings of the best Chinese tradition and collected withrefined love and passion for local art or received as a gift or handed down by their parents who had already been inthe East. When they left, the entire collection was placed in trunks and boarded on military ships returning to Europe.(Photos and information come from the Zavagli Ricciardelli Archive.)

The hem with the central terrestrial diagram and tall lishui stripes under a band of wind-tossed waves. The collar and the horse-hoof cuffs repeating the dragons pursuing the flaming pearl amongst cloudsabove waves on a midnight blue. The arms plain blue silk. Lined light blue silk. Wears in threads of the collar and cuffs,wear on sleeves silk, a few breaks in the silk due to ageing consumption, some ancient repairs.

A VERY RARE RED SILK AND FUR COURT HAT, CHINA, 19TH CENTURYA rare and most handsome for a Mandarin's court hat, Chaoguan, the gilt hat finial indicates a fourth rank by the bluePeking glass stone. The official would wear this hat when wearing his chaofu robe. The hat with fur brim has a crowncovered with a red flossed silk instead of the traditional tassels. A central simulated pearl on the rim indicates the frontof the hat. The jewel remembers the lama 'Master' stone, symbolising a pure mind, a gem capable of cutting throughany substance, but which itself could not be penetrated, the interior lined in orange. Overall in very good condition,the peacock feather plume missing.

Of compressed globular form, the interior and the base and the mouth rim exposing the ceramic body, the exteriorcovered in coating of cinnabar lacquer body finely carved through the red lacquer layers with a scene depictingscholars and attendants sitting or walking in the open air on path and terrace with fences surrounded by wutong,willows and pine trees and on the background a landscape with houses and mountains in the distance between ruyi-head and lappet borders, the neck with deep incised geometric pattern grounds and with a flower and foliate scrollswith stylized stems between rims with key-frets and lappets, on a background carved with further geometric motifs. Invery good condition, only minor wear on the surface and very minor tiny nicks on the extremities, on the top mouth rimsome minor flakes showing the ceramic body as well as for the foot, as expected of the age and typical of this type.

A Major in the Royal Italian Army, was born in Liguria in 1863 (?). He died inAfrica in fighting in Africa in 1913. He came from a family of venetian shipownersand great travellers. At 17 years of age he went to the military school in Modenaand began his military career. Lieutenant first and then colonel, he was sent toChina as a Major to assume the command at Tien-Tsin: he stayed there till 1903.Thanks to his good work in China, he was awarded the cross of a Knight of theOrdine della Corona d’Italia and of the Ordine dei SS. Maurizio e Lazzaro.In 1906 he left for Eritrea where he stayed until 1910 and he was promoted toLieutenant Colonel. Two years later, he was in Cirenaica (Libya) where he fought heroicallyand died in 1913. He was awarded the gold medal for Military Excellence.The collection here illustrated is comprised of objects he collected and received in China (he held a high militaryposition and frequented embassy parties and high society milieux): the collection have since remained with hisdescendants.

A VERY RARE LARGE SQUARE PAIR OF BLUE AND WHITE PORCELAIN ICE-CHEST, CHINA QING DYNASTY LATE 18THEARLY 19TH CENTURY Formed of square section this fine ice-chest are heavily potted with high slightly flaring sides, horizontally divided intothree sections and encircled by two raised ribs imitating metal bands, adorn with a blue scrolling motif, the sides finelypainted, with the mouth rim decorated with a reserve band of continuous ruyi heads with inside blue flowers belowan alternating foliate strap-work design, the central section with an ornament of stylized phoenix and bloom flowers,the third section painted above the foot rim in white reserve with a continuous topping decoration of scrolling stylizedphoenix, the interior all in plain white glaze and with the recessed base unglazed as well as for the encircling shortfoot rim.One in very good condition, with only very small firing imperfections, minor surface wear and minor scratches, insidethe plain white glaze with stains of stale water, the second in one side a chip with a V-shaped hairline from the mouthrim down close to the foot rim and with very small firing imperfections, minor surface wear and minor scratches, insidethe plain white glaze with stains of stale water, as expected of the age and typical of this type.

Note: Our ice-chest with this type of decoration suggest that were used by a noble consort.In the National Palace Museum Beijing we can see some example with this form in cloisonne’ with square section. Largeice chests were used in the Palace during the hot summer months. Filled with ice and placed in certain rooms used bythe Imperial family. The ice was used to cool drinks, fruit and sweet, as well as cooling the surrounding area andsomewhat alleviating the oppressive heat of Beijing, which the Manchu emperors found so uncomfortable. These chestswere sometimes placed directly on the floor beneath tables to cool both the food and those seated at the table. In winterice blocks were cut from the Inner Golden River and were stored in the five ice vaults in the Forbidden City near theGate of the Great Ancestors.

A FINE PAIR OF “DRAGON AND PHOENIX” “FAMILLE ROSE” PORCELAIN BOTTLE VASES, CHINA, QING DYNASTY,GUANGXU MARKS AND OF THE PERIOD (1875-1908)Well potted with a globular body supported on a slightly splayed foot, sweeping up to a waisted neck and flared rimis decorated to the globular lower body section with an iron-red and gilt five-clawed dragon chasing the flaming pearland a phoenix in flight chasing a gilt sun, all amongst billowing ruyi-shaped cloud scrolls, the shoulder is adorned witha band of lotus sprays alternating with gilt Shou characters all between foliate scrolls, and the flared neck is decoratedwith an interspersed motif of eight groups of flowers showing at the center the Eight Buddhist Emblems, bajixiang, allbetween a petal-lappet band of pendent ruyi-heads below the mouth rim and with a band of over-lapped waves abovethe foot. The base with a six-character mark in iron red. In very good condition with very minute firing imperfectionsand very slight wear on the surface, most notably on the gilding.

A HIGHLY IMPORTANT AND FINELY CARVED LARGE SPINACH-GREEN JADE 'SCHOLAR' BRUSHPOT, BITONG, CHINA,QING DYNASTY, QIANLONG 1736-1795Raised on a thick cylindrical body, the sides are finely and deeply carved with a scene depicting eminent scholars ina continuous dramatic mountain landscape surrounded by rocky peaks, wutong and pine trees under a cloudy sky, twoscholar seated around a rectangular table and holding in their hands cups, one admiring a scroll and an attendantserving him the tea, above in the distance a terrace with a double-roof pavilion, each of them with a long beard andwearing a voluminous robes, other two scholar on a small terrace near a path zigzagging up the mountain to thedistant pavilion, the other winding behind a diagonal ridge of rock-work, the stone of a deep spinach-green colorvariegated with lighter green passages.In very good conditions, the stone is very well polished and preserved. There are some natural flaw lines. There arevery few small scratches and wear on the surface. There are a few very minute nicks and chips to the extremities of thecarving, as expected of the period and typical of this type, together with an Italian later wood gilded base, in goodcondition with some wear and scratches on the surface and some minor flakes on the extremities.

This material is only known from the Banlian gravelbeds near Shoushan, Fuzhou Prefecture, Fujian Province. The Chinese consider Tianhuang stone as a variety of Shoushan stonealthough true Shoushan stone mainly consists of pyrophyllite.

The baluster wall vases raisingfrom a narrow foot, each carved withlotus foliate on the tapering body andon the waisted neck between key-fret atthe shoulder and at the foot and mouth ring, flanked by a pair of handles, the center is inset with two whitejade plaques decorated with a poetic inscription, the back of the wall vases present a flat surface showingan indentation for hanging. In very good condition, only a very minor surface wear and scratches, one of theinserts of one wall vase is leaking. To be note that the two jade inserts plaques are older than the wall vases.

Quitein good condition, one handle of one vase re-stuck, a restoration on one rim and on both necks, minor wear onenamels.

DIRITTO DI SEGUITOCon Dlgs n. 118 del 13/2/2006 è in vigore dal 9 Aprile 2006 in Italia il “Diritto di Seguito”(Droit de Suite), ossia il diritto dell’autore (vivente o deceduto da meno di 70 anni) diopere di arti figurative e di manoscritti a percepire una percentuale sul prezzo di vendi-ta degli originali delle proprie opere in occasione delle vendite successive alla prima. COLLECTION OF LOTSPurchasers must collect the Lot/s by 15 working days from the date of the Auction. EXPORT OF THE LOTS PURCHASEDThe Law Decree no. 42 of January 22nd 2004 regulates the export of cultural heritageand goods outside the Republic of Italy. THE ARTIST’S RESALE RIGHTThe Artist’s Resale Right has been in force in Italy since April 9th 2006 with the Law De-cree no. 118 (13/02/2006). This represents the right of the Author/Artist (living or de-ceased within the previous seventy years) of figurative art works and manuscripts toperceive a percentage of the sale price of his/her original works upon those sales ta-king place following the initial sale of the work/s in question. Art. 9 Le stime relative al prezzo base di vendita, riportate sotto la descrizione di ogni bene sul catalogo, sono da intendersi al netto di ognionere accessorio quale, ad esempio, diritti d’asta, tasse ecc. ecc. Poiché i tempi tipografici di stampa del catalogo richiedono la de-terminazione dei prezzi di stima con largo anticipo esse potranno essere oggetto di mutamento, così come la descrizione del bene.Ogni e qualsivoglia cambiamento sarà comunicato dal banditore prima dell’inizio dell’asta sul singolo bene interessato; fermo restandoche il lotto sarà aggiudicato unicamente in caso di raggiungimento del prezzo di riserva.

Art. 10 Il completo pagamento del prezzo di aggiudicazione, dei diritti d’asta, e di ogni altra spesa accessoria dovrà essere effettua-to entro 10 giorni lavorativi dalla data dell’Asta, in valuta avente corso legale nella Nazione ove si è svolta l’asta. In caso di man-cato pagamento, fermo restando il diritto a ottenere il diritto anche dei maggiori danni, ART AUCTIONS potrà: a) restituire ilbene al mancato venditore ed esigere il pagamento dal mancato acquirente delle commissioni perdute; b) agire per otte-nere l’esecuzione coattiva dell’obbligo di acquisto; c) vendere il lotto a trattativa privata, od in aste successive, comunque indanno del mancato compratore, trattenendo a titolo di penale gli eventuali acconti versati. Nel caso il lotto rimanesse cu-stodito da ART AUCTIONS ciò avverrà a rischio e spese dell’aggiudicatario e del mancato venditore in solido. In ogni caso fi-no alla data di ritiro o restituzione l’aggiudicatario dovrà corrispondere ad ART AUCTIONS i costi di magazzinaggio (per meseo frazione di mese), di seguito elencati a titolo indicativo: € 100 + iva per i mobili; € 50 + iva per i dipinti; € 25 + iva per gli og-getti d'arte. Tale somma sarà dovuta a partire dal 16esimo giorno lavorativo dalla data dell'asta.

Art. 11 L’aggiudicatario, dopo aver pagato tutte le somme dovute, dovrà ritirare i lotti acquistati entro 15 giorni lavorativi dalla data dell’Astaa suo esclusivo rischio, cura e spese, rispettando l’orario a ciò destinato da ART AUCTIONS. Nel caso in cui l’aggiudicatario non do-vesse ritirare i lotti acquistati entro il termine sopraindicato ART AUCTIONS li conserverà, ad esclusivo rischio e spese dell’aggiudica-tario, nei locali oggetto dell’asta per altri cinque giorni lavorativi. Trascorso tale periodo ART AUCTIONS potrà far trasportare, semprea rischio e spese dell’aggiudicatario, i beni presso un qualsiasi depositario, od altro suo magazzino, liberandosi, nei confronti dell’ac-quirente, con la semplice comunicazione del luogo ove sono custoditi i beni. Resta fermo il fatto che per ritirare il lotto l’aggiudica-tario dovrà corrispondere, oltre al relativo prezzo con accessori, anche il rimborso di ogni altra spesa successiva.

Art. 12 In ogni caso ART AUCTIONS potrà concordare con gli aggiudicatari diverse forme di pagamento, di deposito, di vendita atrattativa privata, di assicurazione dei beni e/o la fornitura di qualsiasi altro servizio che fosse richiesto al fine del miglior an-damento possibile dell’affare.

Art. 13 Tutti sono ovviamente tenuti a rispettare le leggi vigenti all’interno dello Stato ove è stata svolta l’asta. In particolare ARTAUCTIONS non assume nessuna responsabilità in relazione ad eventuali restrizioni all’esportazione dei lotti aggiudicati, e/oin relazione a licenze e/o permessi che l’aggiudicatario potrà dover richiedere in base alla legge vigente. L’aggiudicatarionon potrà richiedere alcun rimborso ne al venditore ne ad ART AUCTIONS nel caso che lo Stato esercitasse il suo diritto diprelazione, od altro diritto a lui riservato. I diritti maturati in relazione ad una aggiudicazione poi annullata a causa della ne-gata autorizzazione all’esportazione del lotto per contrasto tra le diverse Soprintendenze, sono comunque dovuti dal man-dante ad ART AUCTIONS se tale mancato permesso deriva dalla non comunicazione del mandante ad ART AUCTIONSdell’esistenza di una autorizzazione all’esportazione rilasciata dall’Ente competente su richiesta del mandante stesso.

Art. 14 In caso di contestazioni rivelatesi fondate, ed accettate da ART AUCTIONS a seguito della vendita di oggetti falsificati ad ar-te la Casa d’Aste potrà, a sua discrezione, dichiarare la nullità della vendita e, ove sia fatta richiesta, rivelare all’aggiudicatarioil nome del venditore. L’acquirente potrà avvalersi di questo articolo solo ed esclusivamente nel caso in cui abbia notificatoad ART AUCTIONS, ai sensi degli articoli 137 e SS CPC la contestazione con le prove relative entro il termine di 15 giorni dal-l’aggiudicazione. In ogni caso, a seguito di un reclamo accettato l’aggiudicatario avrà diritto a ricevere esclusivamente quan-to pagato per l’aggiudicazione contestata, senza l’aggiunta di interessi o qualsiasi altra somma per qualunque altro motivo.

Art. 15 Le presenti condizioni di Vendita sono accettate automaticamente alla firma della scheda di cui all’art 5 e comunque da tut-ti quanti concorrono alla vendita e sono a disposizione di chiunque ne faccia richiesta. Per qualsiasi controversia è stabilitala competenza del foro di Genova

Art. 16 Legge sulla Privacy d. lgs. 196/03 e successive modifiche e integrazioni (GDPR 2016/679). Titolare del trattamento è ART AUC-TIONS S.r.l. con sede in Genova Piazza Campetto, 2. Il cliente potrà esercitare i diritti di cui al d. lgs. 196/03 (accesso, correzio-ne, cancellazione, opposizione al trattamento ecc.ecc.), rivolgendosi ad ART AUCTIONS S.r.l.. GARANZIA DI RISERVATEZZA aisensi dell’art. 25 del d. lgs. 196/03 i dati sono trattati in forma automatizzata al solo fine di prestare il servizio in oggetto, o dialtro servizio inerente l’oggetto sociale della società, con le modalità strettamente necessarie allo scopo. Il conferimento deidati è facoltativo: in mancanza, tuttavia ART AUCTIONS non potrà dar corso al servizio. I dati non saranno divulgati. La par-tecipazione all’asta consente ad ART AUCTIONS di inviare successivi cataloghi di altre aste.

CONDIZIONI GENERALI DI VENDITA

Art. 1 I beni possono essere venduti in lotti o singolarmente ad insindacabile giudizio della WANNENES ART AUCTIONS (di seguito ARTAUCTIONS o Casa d’Aste). Le aste saranno tenute in locali aperti al pubblico da ART AUCTIONS che agisce unicamente come man-dataria nel nome e nell’interesse di ciascun venditore (il nome del quale è trascritto in tutti i registri previsti dalle vigenti leggi). Glieffetti della vendita influiscono direttamente sul compratore e sul venditore. ART AUCTIONS non assume nessuna responsabilitànei confronti dell’aggiudicatario, del venditore, o di qualsiasi altro terzo in genere.

Art. 2 Gli oggetti sono venduti/aggiudicati al miglior offerente, e per contanti. Nel caso in cui sorgessero delle contestazioni tra piùaggiudicatari, il banditore, a suo insindacabile giudizio, rimetterà in vendita il bene che potrà essere nuovamente aggiudica-to nella medesima asta; in ogni caso gli aggiudicatari che avessero sollevato delle contestazioni restano vincolati all’offerta fat-ta in precedenza che ha dato luogo alla nuova aggiudicazione. In caso di mancata nuova aggiudicazione il banditore, a suoinsindacabile giudizio, comunicherà chi deve intendersi aggiudicatario del bene. Ogni trasferimento a terzi dei lotti aggiudi-cati non sarà opponibile ad ART AUCTIONS che considererà quale unico responsabile del pagamento l’aggiudicatario. La par-tecipazione all’asta in nome e per conto di terzi potrà essere accettata da ART AUCTIONS solo previo deposito presso gli Ufficidella Casa d’Aste - almeno tre giorni prima dell’asta - di adeguate referenze bancarie e di una procura notarile ad negotia.

Art. 3 ART AUCTIONS si riserva il diritto di ritirare dall’asta qualsiasi lotto. Il banditore conduce l’asta iniziando dall’offerta che ritiene piùopportuna, in funzione sia del valore del lotto presentato sia delle offerte concorrenti. Il banditore può fare offerte consecutive oin risposta ad altre offerte, fino al raggiungimento del prezzo di riserva. Il banditore, durante l’asta, ha facoltà di accorpare e/o se-parare i lotti e di variare l’ordine di vendita. Il banditore può, a suo insindacabile giudizio, ritirare i lotti che non raggiungano il prez-zo di riserva concordato tra ART AUCTIONS ed il venditore.

Art. 4 Oltre al prezzo di aggiudicazione, l’aggiudicatario si impegna a corrispondere ad ART AUCTIONS, per ciascun lotto, una commis-sione di acquisto comprensiva di I.V.A. pari al:30% del prezzo di aggiudicazione fino a € 2.00025% per la parte di tale prezzo da € 2.001 fino a € 2.000.00022% per la parte di tale prezzo eccedente € 2.000.001Per i lotti che fossero in temporanea importazione, provenendo da paesi non UE oltre ai corrispettivi d’asta di cui sopra l’aggiudi-catario, se residente in un Paese UE, dovrà corrispondere ogni altra tassa conseguente, oltre a rimborsare tutte le spese necessariea trasformare da temporanea a definitiva l’importazione (i beni interessati saranno indicati con il segno**). Si ricorda che qualora ilvenditore fosse un soggetto I.V.A. l’aggiudicatario dovrà corrispondere anche le imposte conseguenti (i beni interessati saranno con-trassegnati dal segno °°).

Art. 5 Al fine di garantire la trasparenza dell’asta tutti coloro che sono intenzionati a formulare offerte devono compilare una scheda dipartecipazione con i dati personali e le referenze bancarie. ART AUCTIONS si riserva il diritto di verificare le referenze fornite e di ri-fiutare alle persone non gradite la partecipazione all’asta. All’atto della compilazione ART AUCTIONS consegnerà un cartellino iden-tificativo, numerato, che dovrà essere esibito al banditore per formulare le offerte.

Art. 6 ART AUCTIONS può accettare mandati per l’acquisto (tramite sia offerte scritte che telefoniche) effettuando rilanci tramite il banditore, ingara con le persone partecipanti in sala. In caso di offerte identiche l’offerta scritta preverrà su quella orale.

Art. 7 Nel caso di due offerte scritte identiche, che non siano superate da offerte in sala o telefoniche, ART AUCTIONS considererà ag-giudicataria quella depositata per prima. ART AUCTIONS si riserva il diritto di rifiutare, a suo insindacabile giudizio, offerte di ac-quirenti non conosciuti e/o graditi. A parziale deroga di quanto sopra ART AUCTIONS potrà accettare dette offerte nel caso siadepositata una somma a garanzia di importo pari al valore del lotto richiesto, oltre commissioni, tasse, e spese. In ogni caso all’at-to dell’aggiudicazione l’aggiudicatario comunicherà, immediatamente, le proprie complete generalità e i propri dati fiscali.

Art. 8 ART AUCTIONS agisce esclusivamente quale mandataria dei venditori declinando ogni responsabilità in ordine alla descrizione de-gli oggetti contenuta nei cataloghi ed in ogni altra pubblicazione illustrativa. Tutte le descrizioni dei beni devono intendersi pura-mente illustrative ed indicative e non potranno generare nessun affidamento di alcun tipo negli aggiudicatari. L’asta sarà precedutada un’esposizione dei beni al fine di permettere un congruo esame degli stessi da parte degli aspiranti acquirenti, affinché que-st’ultimi, sotto la loro totale e completa responsabilità, possano verificarne tutte le qualità, quali ad esempio, l’autenticità, lo statodi conservazione, il tipo, il materiale, la provenienza, dei beni posti in asta. Dopo l’aggiudicazione nessuno potrà opporre ad ARTAUCTIONS od ai venditori la mancanza di qualsiasi qualità dei beni oggetto di aggiudicazione. ART AUCTIONS ed i propri dipen-denti e/o collaboratori non rilasceranno nessuna garanzia di autenticità e/o quant’altro. Tutte le indicazioni sulla caratura ed il pe-so di metalli o pietre preziose, come sui relativi marchi, sono puramente indicative. ART AUCTIONS non risponderà di eventuali errorio della falsificazione effettuata ad arte. Nonostante il possibile riferimento ad elaborati di esperti esterni alla Casa d’Aste, ART AUC-TIONS non ne garantisce né l’esattezza né l’autenticità.

Art. 9 The Estimates relative to the initial sale price, indicated beneath the description of each object in the Catalogue, are intended as NETand do not include, for example, the commissions (buyer’s premium), taxes etc. Since the printing time employed for the making ofthe Catalogue requires price Estimates in advance, these latter may be subject to change, as may also the description of the object.Each and every change will be communicated to the Auctioneer before the beginning of the Auction in relation to each object con-cerned. The Lot/s will, however, only be sold upon reaching the reserve price.

Art. 10 The entire payment of the hammer price, the commissions applied (buyer’s premium) as well as all other expenses must be paid forwithin ten working days of the Auction date, in the legal currency of the State in which the Auction has taken place. In the case oflack of due payment, after full compensation of damages made to ART AUCTIONS, the AUCTION HOUSE may:return the object to the Seller and demand full payment from the Purchaser of the due commissions/premium;undertake action in order to forcefully obtain the obligations of purchase;sell the Lot/s privately or in subsequent Auctions, to the disadvantage of the original Purchaser, treating any sums paid by the latteras a form of sanction. If the Lot/s is kept by ART AUCTIONS this will be at the risk and expense of the Purchaser and the original Sel-ler. In each case, until the collection or return dates the Purchaser will pay ART AUCTIONS the costs of storage (by month or parts ofmonth) as follows: 100 euro + vat for furniture, 50 euro + vat for paintings, 20 euro + vat for objects. This sum must be paid from thesixteenth day following the Auction.

Art. 11 The Purchaser, after having paid all the sums due, must collect the Lot/s acquired within fifteen working days of the Auction date,at his/her own risk and expense, in full consideration of the opening hours of ART AUCTIONS. Should the Purchaser not collect theLot/s during the above-mentioned times ART AUCTIONS will keep them at the risk and expense of the Purchaser in the AUCTIONHOUSE for a further five working days. Once this period has passed, ART AUCTIONS will remove the object/s (at the Purchaser’s ownrisk and expense) to the storage space deemed most appropriate by the AUCTION HOUSE. The AUCTION HOUSE will inform thePurchaser of the place where the object/s are kept. Let it be clearly understood that in order to collect the object/s the Purchaserwill have to pay, apart from the price plus commissions (buyer’s premium) etc, any refund due to subsequent expenses incurred bythe AUCTION HOUSE.

Art. 12 In each case, ART AUCTIONS may agree with the Purchaser/s upon different forms of payment, storage, private sale, insurance of theobject/s and/or granting of any other service requested in order to achieve the most successful results possible.

Art. 13 Everybody has, obviously, to respect the current Laws within the State where the Auction is held. In particular, ART AUCTIONS assu-mes no responsibility in relation to potential restrictions concerning the export of purchased objects and/or in relation to licencesor permits that the Purchaser might have to request on the basis of current Laws. The Purchaser will not be able to request any re-fund either from the Seller or from ART AUCTIONS should the State exercise its right to pre-emption or any other right it may pos-sess. The rights that have matured in relation to the hammer price of a sale that has been annulled on account of it not receivingauthorisation for export due to the lack of agreement of the cultural authorities concerned are, nevertheless, to be paid by the ven-dor to ART AUCTIONS if permission was not given because the vendor did not previously inform ART AUCTIONS of the existence ofauthorisation (for export) given by the relevant authority upon the request of the vendor him/herself.

Art. 14 In the case of disputes that are revealed to be well-founded and accepted by ART AUCTIONS subsequent to the sale of false objects, theAUCTION HOUSE may, at its own discretion, declare the sale null and void and, if requested, reveal the name of the Seller to the Purcha-ser. The Purchaser may make use of this Article (Article 14) only and exclusively in the case that s/he has notified ART AUCTIONS – accor-ding to Articles 137 and following in the Code of Civil Procedure – of the dispute in question with the relative proof within fifteen days ofthe Auction date. In each case, subsequent to an accepted claim the Purchaser has the right to receive exclusively what was paid as thedisputed hammer price without the addition of interests or other sums for any other reason.

Art. 15 The current Sale Conditions are accepted automatically upon signing the form (see Article 5) and by all those individuals who takepart in the Sale. The above-mentioned Conditions are at the disposal of any individual who requests to see them. Any case of con-troversy is within the jurisdiction of the Genoa Law Courts.

Art. 16 Privacy Law (Legislative Decree 196/03 including all subsequent amendments and supplements by GDPR 2016/679). Data Control-ler: ART AUCTIONS S.r.l. with headquarters in GENOA, Piazza Campetto, 2. The Customer may exercise his/her rights according to Le-gislative Decree 196/03 (access, correction, cancellation, opposition etc), by contacting ART AUCTIONS S.r.l. GARANZIA DIRISERVATEZZA according to Article 25 of Legislative Decree 196/03. The information is computerised with the sole intention of pro-viding the above-mentioned service or any further service relative to the Company, in such a way that is strictly connected to thequestion at hand. The supply of data is optional: in default of which, ART AUCTIONS will not be able to perform the service required.Data will not be divulged. Participation in an Auction allows ART AUCTIONS to send subsequent Catalogues of other Auctions.

GENERAL CONDITIONS OF SALE

Art. 1 The objects may be sold in Lots or individually according to the final opinion of WANNENES ART AUCTIONS (here follows referred toas ART AUCTIONS or AUCTION HOUSE). The Auctions will be held in premises that are open to the public by ART AUCTIONS whichacts simply as AGENT in the name and interests of each Seller (the name of the said Seller is written in all the Registers required byLaw). The Sale directly concerns the Purchaser and the Seller. ART AUCTIONS does not assume any responsibility in relation to thePurchaser, the Seller or any Third Party concerned.

Art. 2 The objects are sold to the highest bidder for cash. Should any disputes arise among more than one Purchaser, the Auctioneer(his/her decision is final) will put the object up for sale once more so it can be purchased again in the same Sale. In each case, thePurchasers who disputed the former Sale of the object in question are still bound by the initial bid (which gave rise to the subsequentSale of the object). Should the subsequent purchase fall through once again the Auctioneer (his/her decision is final) will decide whichperson may successfully purchase the Lot/s. Each transfer to Third Parties of the Lot/s purchased does not become the responsibili-ty of ART AUCTIONS which considers the Purchaser as the sole person/s responsible for payment. bidding at an Auction in the na-me of and for Third Parties may be accepted by ART AUCTIONS only after sufficient bank references as well as a power of attorneyhave been received by the AUCTION HOUSE at least three days before the Auction.

Art. 3 ART AUCTIONS reserves the right to withdraw any Lot/s from the Auction. The Auctioneer starts the Auction beginning with the bidthat s/he believes to be the most opportune, based upon both the value of the Lot/s as well as the competing bids. The Auctione-er may make further bids or in response to other bids, until the reserve price is reached. The Auctioneer, during the Auction, may grouptogether or separate Lot/s and vary the order of the Sale. The Auctioneer may – and his/her decision is final – withdraw Lot/s thatdo not reach the reserve price agreed upon between ART AUCTIONS and the Seller.

Art. 4 In addition to the hammer price, the Purchasers agree to pay to ART AUCTIONS a buyer’s premium on the hammer price of each lotsold, V.A.T. included. On all lots we charge: 30% of the hammer price up to and including € 2.00025% on that part of the hammer price over € 2.001 and up to and including € 2.000.00022% on that part of the hammer price above € 2.000.001For those Lots being temporarily imported and coming from non-EU States, apart from the above-mentioned detractions, the Purcha-ser – if resident in an EU member-State - will pay all other subsequent taxes, as well as refund all expenses required to transform the tem-porary import status of the object/s to a status that is permanent (the objects are indicated by the sign **). If the Seller is in possessionof a VAT number the Purchaser will also pay all subsequent taxes (the objects are indicated with a °°).

Art. 5 In order to guarantee the highest levels of transparency during the Auction for all those who intend to make bids, prospective bidders arerequired to fill out a participation form with personal information and bank details. ART AUCTIONS reserves the right to make checks on thedetails/references provided and to refuse those who might not be welcome. Upon completion of the form ART AUCTIONS will supply anumbered identification paddle which will have to be shown to the Auctioneer in order to proceed with bidding.

Art. 6 ART AUCTIONS may accept absentee bids (by means both of written as well as telephone bids) that will be undertaken by the Auc-tioneer, in direct competition with those present in the Auction Room. Should there be a case of identical bids, the written bid willprevail upon the oral bid.

Art. 7 Should there be two written bids that are not beaten by bids made in the Auction Room or telephone bids, ART AUCTIONS will con-sider the Purchaser to be the one who made the bid first. ART AUCTIONS reserves the right to refuse – its decision is final – bids ma-de by Purchasers who are not known or welcome. ART AUCTIONS may, however, partially in reference to the above-mentioned,accept bids if there is a guaranteed sum deposited equal to the value of the Lot that is requested, apart from commissions (buyer’spremium), taxes and expenses. In each case, at the moment of Purchase, the Purchaser will immediately inform the AUCTION HOU-SE of his/her personal information and taxation details.

Art. 8 ART AUCTIONS acts exclusively as the agent for the Sellers and bears no responsibility in terms of descriptions of the objectsin the Catalogues or in any other illustrated publication. All the descriptions of objects are intended purely as illustrative andindicative. They may not generate any form of reliance as far as the Purchaser is concerned. The Auction will be preceded bya public viewing of the objects in order to allow for a careful examination of the objects on behalf of aspiring bidders. In thisway, potential Purchasers will have the opportunity to and be responsible for a complete examination of all the qualities ofthe object/s in question: for example, the authenticity, the state of preservation, the type, the material and the provenance ofthe objects being auctioned. Following the Purchase, no one will be able to dispute or criticise ART AUCTIONS or the Sellersfor the lack of any form of quality in reference to the object being auctioned. ART AUCTIONS and its employees/consultantswill issue no guarantee of authenticity. All those indications relative to the carats and the weight of metals or precious stones,as well as their relative marks, are merely indicative. ART AUCTIONS is not responsible for any potential errors or falsifications.Notwithstanding any potential reference to descriptions by experts external to the AUCTION HOUSE, ART AUCTIONS does not ei-ther guarantee the accuracy or the authenticity of such comments.

Dichiaro di conoscere ed accettare integralmente le condizioni di vendita stampate sul catalogo ed espressamente esonero Wannenes Art Auctions da ognie qualsiasi responsabilità per le offerte che per qualsiasi motivo non fossero state eseguite in tutto o in parte e/o per le chiamate che non fossero state effettuate, anche per ragio-ni dipendenti direttamente da Wannenes Art Auctions.

RICHIAMO ALLE CONDIZIONI GENERALI DI VENDITA E VARIE1.
