The 161st meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 26 th to 29th
May, 2010 at Conference Hall, NRC, NCTE, Jaipur. The following members and convener were present:

AGENDA ITEM NO 161.02.00 CONSIDERATION OF THE COURT CASES
The Hon’ble High Court of Uttarakhand has passed order dated 14.10.2009 in the Writ petition no. 1761/2009 which as under:- “It is directed that till next date of listing the decision/order dated 26.09.2009 passed by the respondent no. 3 in its meeting dated 5th to 7th
August, 2009 in respect of petitioner institution shall not be given effect to”
The directions of the Hon’ble High Court of Uttarakhand may be followed.

3. 2. Shri Rishikul B.ED. College, Near Water Tank, Laxmangarh, Sikar- 332311, RajasthanRJ – 1075, B.Ed. Course
The institution has submitted the Court order dated 14.05.2010 passed by the High Court of Rajasthan at Jaipur Bench in the civil Writ Petition no. 6944/2010. The Court order as under:- “Counsel inter-alia submits that Regional Committee of NCTE in terms of Section 14(1) NCTE Act granted recognition/permission for starting B.ED, Course with in-take of 100 students vide order dated 02.08.2007 however, vide show cause notice dated 04.08.2009 certain deficiency were pointed out, to which detailed reply was submitted by the petitioner along with documents in support of where but without application of mind, Regional Committee by a non-speaking order dated 04.02.2010 decided to withdraw recognition w.e.f. academic session 2010-2011 against which appeal was preferred but was dismissed without assigning reasons vide order dated 12.04.2010. In the meanwhile, operation of orders dated 04.02.2010 and appellate order dated 12.04.2010 shall remained stayed till further orders. Stay order will be effective only after service upon respondents.”
The directions of the Hon’ble High Court of Rajasthan, Jaipur may be followed.
4. 3. Global College of Higher Education, On Mansa Nangal Khurd Road, Vill - Nangal Khurd, Distt. - Mansa - 151505, Punjab
The NRC constituted a Visiting Team for inspection of the institution. The V.T. members personally contacted to the management of the institution. The management of the institution categorically

refused to get inspection caused on 19 - 20 October, 20009 (Two dates suggested by the V. T.). Hence, no inspection was caused.
The Visiting Team members submitted their report to NRC office on 26.10.2009 & the matter was placed before the NRC in its 154th meeting held on 09 - 11 January, 2010 and the committee decides to close the file of the institution. Accordingly order was issued on 19.01.2010 to the institution.
The institution preferred an appeal to the NCTE Hqtrs on 05.02.2010 and the Appeal Council was rejected the appeal vide its order dt. 12.04.2010.
Then, the institution filed a writ petition No. 7654 / 2010 in the Hon'ble High Court of Punjab & Haryana at Chandigarh against the NRC's order dt. 19.01.2010 & the Appeal Council's order dt. 12.04.2010.
The petition is disposed of with a direction to the respondents to conduct a fresh inspection of the college accordingly in accordance with rules. The petitioner shall, however deposit the fee of the inspection team etc., as required under rules within one week. Once fee deposited, the respondents will arrange the conduct of the inspection of the college within four weeks thereafter.
5. 4. Padmawati Bal Vidyapeeth, Pocket- B, NS/PS, Defence
The institution was recognized vide office order no. F.NRC/NCTE/F73/UP-2704/2008/45464 dated 19.04.2008.

The said institution filed a writ petition on 361/2010 in the Hon’ble High Court Allahabad.
We have heard Sri U.N. Sharma, learned Senior Counsel assisted by Sri Neraj Tiwari, learned counsel appearing on behalf of the appellants, learned Standing Counsel for the respondent no. 1, Sri Anurag Khanna, learned counsel for the University and Sri R.A. Akhtar, learned counsel for respondent no. 2.
The present special appeal has been filed against the judgment and order dated 18.01.2010 passed by the Hon’ble Single Judge by which petitioner’s writ petition, the appellants herein, has been dismissed on the ground that it is premature. It is admitted between the parties that similar order was passed in Special Appeal no. 299 of 2010 (Savita Devi Mahavidyalaya Vs. State of U.P. & others) and a Division Bench of this Court vide order dated 09th March, 2010 had disposed of that special appeal with certain observations. The order dated 09th March, 2010 passed by a Division Bench is reproduced below:
“The order impugned dated under challenge is the order passed by the learned Single Judge on 18.01.2010 by which the writ petition of the writ petitioner institutions was dismissed holding that the writ petition is premature in nature and the petitioners can seek appropriate remedy when an order

against the petitioners is passed.
Mr. U.N. Sharma, learned Senior Advocate, appearing for the appellant, has contended before us that though the Inspection Team was formed for the purpose of inspection but the same has been made under Section 17(1) of the National Council for Teachers Education Act, 1993 (for the sake of convenience hereinafter referred to as ‘ACT’). According to him there is no scope of inspection under section 17 of the said Act and no opportunity has been provided by such authority before holding an opinion that there should be an inspection.
On the other hand, Mr. Anurag Khanna, learned counsel appearing for the respondent- University and Mr. R.A. Akhtar, learned counsel appearing for National Council for Teacher Education, both have contended before us that the inspection can be made under section 13 of the Act. Therefore, at this stage the appellants cannot be said to be aggrieved, hence the order impugned is correct.
We are of the view that there should not be any necessity of interference in the order passed by learned Single Judge until a decision is taken by the authority on the basis of the information provided to it by the institution no cause of action may arise. It appear to us that under section 17(1) of the Act, an inspection has been initiated by the authority. However, such authority is not legally expert to say under which section

inspection will be made. Perhaps they found that there is contravention of the provisions of the Act, therefore they decided to make an inspection. Passing any order to inspect the institution may lead to violation of principles of natural justice because at no point of time, the Regional Committee called upon the petitioners to explain the position.
Mr. Anurag Khanna, on the other hand, has contended before us that under Section 17 proviso 1 of the Act, no order of withdrawal of recognition can be passed unless a reasonable opportunity of hearing and making representation against the proposed order has been given to such recognized institution.
According to us, there should not be a mechanical application of such proviso. We are of the view that the minutes, though it is written and shown to be under Section 17 of the Act, should not be construed in the matter as if a decision has been taken about the institution concerned without giving an opportunity of hearing to it to represent the case before passing an appropriate order. If the appellants are aggrieved by any such order, they can prefer an appeal under Section 18 of the Act and even thereafter if they are aggrieved, they can proceed further in accordance with law. Therefore, at this stage, though it is written that the notice has been given under Section 17 of the Act, it cannot be construed to be under Section 17 alone but it is on the basis of such subjective value and procedure under

Section 13 of the Act also.
The special appeal is accordingly disposed of without imposing any cost”

The said institution filed a writ petition on 370/2010 in the Hon’ble High Court Allahabad.

the petitioners is passed.
Mr. U.N. Sharma, learned Senior Advocate, appearing for the appellant, has contended before us that though the Inspection Team was formed for the purpose of inspection but the same has been made under Section 17(1) of the National Council for Teachers Education Act, 1993 (for the sake of convenience hereinafter referred to as ‘ACT’). According to him there is no scope of inspection under section 17 of the said Act and no opportunity has been provided by such authority before holding an opinion that there should be an inspection.
On the other hand, Mr. Anurag Khanna, learned counsel appearing for the respondent- University and Mr. R.A. Akhtar, learned counsel appearing for National Council for Teacher Education, both have contended before us that the inspection can be made under section 13 of the Act. Therefore, at this stage the appellants cannot be said to be aggrieved, hence the order impugned is correct.
We are of the view that there should not be any necessity of interference in the order passed by learned Single Judge until a decision is taken by the authority on the basis of the information provided to it by the institution no cause of action may arise. It appear to us that under section 17(1) of the Act, an inspection has been initiated by the authority. However, such authority is not legally expert to say under which section

inspection will be made. Perhaps they found that there is contravention of the provisions of the Act, therefore they decided to make an inspection. Passing any order to inspect the institution may lead to violation of principles of natural justice because at no point of time, the Regional Committee called upon the petitioners to explain the position.
Mr. Anurag Khanna, on the other hand, has contended before us that under Section 17 proviso 1 of the Act, no order of withdrawal of recognition can be passed unless a reasonable opportunity of hearing and making representation against the proposed order has been given to such recognized institution.
According to us, there should not be a mechanical application of such proviso. We are of the view that the minutes, though it is written and shown to be under Section 17 of the Act, should not be construed in the matter as if a decision has been taken about the institution concerned without giving an opportunity of hearing to it to represent the case before passing an appropriate order. If the appellants are aggrieved by any such order, they can prefer an appeal under Section 18 of the Act and even thereafter if they are aggrieved, they can proceed further in accordance with law. Therefore, at this stage, though it is written that the notice has been given under Section 17 of the Act, it cannot be construed to be under Section 17 alone but it is on the basis of such subjective value and procedure under Section 13 of the Act also.
