[12] Question number Indicative content A1 AO1 (6 marks), AO2 (6 marks) This question requires candidates to draw on their knowledge and understanding of US and UK politics (AO1) and candidates will use this to underpin their analysis (AO2). AO2 requires candidates to develop their answers, showing analytical skills to address the question – such responses will be underpinned by their use of knowledge and understanding. Candidates may demonstrate the following knowledge and understanding (AO1) of the extent to which the US and the UK constitutions are written and unwritten: l The US Constitution is largely written and codified, embodied in the original seven Articles and the subsequent 27 amendments. l Many of these provisions are a specific granting of power to the three branches of the federal government or specific rules regarding how government is to operate. l However, some provisions, although ‘written’, were left deliberately vague and therefore open to interpretation as time passed. l This interpretation has been done largely by the Supreme Court through its power of judicial review. l Some parts of the federal government (e.g. primary elections, the president’s cabinet, the Supreme Court’s power of judicial review) are not mentioned anywhere in the written Constitution. l The UK Constitution, though uncodified, is largely in written form – in acts of parliament, common law and works of authority. Candidates may refer to the following analytical points (AO2) when examining the extent to which the US and the UK constitutions are written and unwritten: l Both constitutions have some written and some unwritten aspects. l Therefore the issue focuses on ‘the extent’. l The main difference is in codification. l This also has implications surrounding entrenchment – the US Constitution has specific amendment processes, thereby entrenching the provisions and rights contained within it, while the UK Constitution has no such entrenchment. l Some advocates of constitutional reform in the UK have backed the adoption of a written constitution.
