This letter is in response to your request for a Letter of Determination regarding the property at 501

This firm represents TMG Partners, the project sponsor for the proposed office development (Case No. 2012.1187U) (the "Project") at 501-505 Brannan Street (the "Property"). We write to request a Zoning Administrator Determination that the proposed non-accessory parking garage is permitted under Planning Code Section 182.
Background
There are approximately 73 existing off-street parking spaces on the Property, four of which are directly adjacent to the Bank of America building’ and approximately 69 of which form a legal nonconforming non-accessory parking lot. The parking lot is currently operated by a parking company (Standard Parking) under an agreement with the property owner (Bank of America). Public parking is available on an hourly, daily, and monthly basis.
The existing parking lot is a legal nonconforming use under Planning Code Section 180. Non-accessory parking lots were principally permitted on the Property from the time that the Bank of America project was approved in 1978 until 2009 when the Property was rezoned to MUO as part of the Eastern Neighborhoods rezoning .2
There is no doubt that the parking lot was legally established. The 1977 Mitigated Negative Declaration for the Bank of America project (enclosed) explains that 40 off-street

parking spaces would be provided, which exceeded permitted accessory amounts under the then-effective Planning Code. The number of spaces in the parking lot increased to at least 65 spaces sometime prior to 2009, while a non-accessory parking lot was still a principally permitted use under the Planning Code. The legal establishment of the parking lot is further evidenced by the following documents, which are also enclosed:
� 1978 building permit for the Bank of America building approved by the Planning Department (Permit Application No. 7801714), with associated plans available for review at the Department of Building Inspection showing about 45 parking spaces;
� 2000 site plan submitted with an application for the replacement of a sign cabinet (Permit Application No. 200003235235) showing about 68 parking spaces;
� 2002 and 2008 commercial parking lot permits issued by the Fire Department approving the operation of a 25,000 square foot parking lot;
� 2008 Parking Lot Location Inquiry from Police Department files which states that there were 65 parking spaces at that time; and
� 2012 Police Department commercial parking lot inspection referral with recommended approval from the Planning Department based on prior City approval of the existing use, which includes a 2008 site plan showing about 71 parking spaces.
As described above, the legal nonconforming parking lot now consists of approximately 69 spaces (not including the four spaces directly adjacent to the Bank of America building).
Proposed Proiect
The proposed Project, an office building with approximately 132,000 square feet of office space, would include an underground parking garage, which would be in the same location as the existing parking lot and would only include a fraction of the existing non-accessory parking spaces (about 34 spaces) 3 , in addition to about 31 permitted accessory spaces
.4 The Property is
As explained in the PPA application, the intent is to make 26 of the replacement spaces exclusively available to Bank of America customers and employees. The remainder will be available to the general public.
This includes 29 permitted accessory parking spaces for the proposed office uses (7% of the gross floor area of office uses) and two permitted accessory parking spaces for the existing bank branch. (The other four permitted accessory parking spaces will remain in the same location directly adjacent to the bank branch.)

proposed to be subdivided so the existing Bank of America building and the proposed Project will ultimately be located on separate parcels.
Planning Code Analysis
As explained above, the existing non-accessory parking lot is a legal nonconforming use. Planning Code Section 182(b) provides that a legal nonconforming use may be "changed to a use that is more widely permitted by the use districts of the City than the existing use" and the "new use shall be classified as a nonconforming use." The Project proposes a change in use from about 69 non-accessory surface spaces to about 34 non-accessory spaces in a garage structure. Although the structured non-accessory parking will itself be a legal nonconforming use, the change in use is permitted under Section 182(b) because a non-accessory parking garage is a different use and a use more widely permitted by the use districts of the City than the non-accessory parking lot. 5 Replacing the existing parking lot with an underground parking garage in the same location will actually decrease the overall degree of nonconformity.
We understand from discussions with Planning Department staff that there may be some concern about potential termination of the legal nonconforming use. We assure you that the project sponsor has no intent to terminate the nonconforming parking use. Rather, the intent is to change the use consistent with Section 182. The parking lot would continue to operate until the Project is approved and construction commences. Temporary suspension of the non-accessory parking use during construction of the underground parking garage would not constitute termination. A change of use under Section 182 will nearly always require a building permit and construction to establish the new use.
The Planning Department’s response to the PPA application suggests a possible concern that the Project would move a nonconforming use to another location in violation of Planning Code Section 181(a). As shown on the enclosed plans submitted with the PPA application, however, the nonconforming use would not be relocated -- the parking structure would be built in the same physical location at which the surface lot operates today. It should not matter that the current lot, which now contains both a bank branch use and a surface parking use, would be subdivided. Independent of the proposed Project, the Property could be legally subdivided in the manner proposed, so that the bank branch and surface parking uses are conducted in the same locations but on separate legal parcels. The Project would accomplish the same result, along with the permitted change of use from surface to structured parking.
Conclusion
