Pine View Estates HOA attorney Judy Sheldrew sends the BIA four testing graphs, stating it was all the information it had on the sewer, which it doesn't own.

Dated May 6, 2011.

After BIA sent the HOA and PTP a letter in March threatening to cancel the lease if the two parties didn't comply with the EPA's 2011 Notice of Violation, the HOA responded by pointing out it didn't own the sewer.

Also, the letter states the HOA welcomed BIA's help with the sewage facilities, which it could not afford to test. The letter includes graphs of 1 1/2 years of testing from Leach Fields A and B, and the monitoring wells.

Ms. Sheldrew wrote that PTP stopped managing the HOA in mid-2009, and appointed the first HOA Board from "volunteers who offered to serve as directors of the Association and operate the sewer and water systems for the benefit of the homeowners living in Pine View Estates." (page 1)

Ms. Sheldrew wrote, "the sewage treatment facilities have not functioned properly for some time, if ever." (page 2)
