NEW DELHI, MARCH 13 Stepping up campaign against the controversial land bill, MPs from oppo- sition parties will take out a march to Rashtrapati Bhavan next Tuesday to register their protest against the amendments proposed to be carried out in the Act of 2013. Eight parties -- Congress, Trinamool Congress, Samajwadi Party, DMK, JD(U), CPI(M), CPI and Kerala Congress (M) -- have so far confirmed their partici- pation in the march, sources said here today. Efforts are being made to rope in some other parties as well and JD(U) chief Sharad Yadav is coordinat- ing in this endeavour, they said. There is a possibility of Congress President Sonia Gandhi also taking part in the march from Parliament to the Rashtrapati Bhavan, a distance of about one km, the sources said. has rapped the Delhi govern-ment, including the Public WorksDepartment (PWD), over unau-thorised constructions being car-ried out in South Delhi'sJaunapur and Dera Mandi forestareas.

"Inspite of interim orderalready passed, the road layingprocess and cutting of trees arestill going on... Even thoughsome portions are in occupationof private individuals, it is notdisputed that since long, theentire area is declared as forestarea."

"Therefore, it is the duty of theForest Department as well as

PWD to see that there is no con-struction activity and no tree cut-ting is permitted," a bench head-ed by Justice P Jyothimani said.

The observations came whilehearing a plea by South Delhiresident Amarjit Singh Nalwaseeking a stay on all illegal activ-ities including cutting of trees,construction of residentialaccommodation and laying ofconcrete RCC roads through for-est. He has also stated that unau-thorised constructions are goingon illegally in the said area andthe authorities are not taking anysteps. The Tribunal, which hadearlier ordered status quo inrespect of construction in thearea, directed the Forest

Department as well as PWD to"scrupulously" implement theorders and file status report byApril 16, next date of hearing.

The plea filed through, advo-cate Rahul Choudhary, also seeksstay on disposal of municipalwaste, boring of illegal tubewells, burning plastic and illegalmining activities in violation ofForest (Conservation) Act, 1980in the notified forest areas ofJaunapur and Dera Mandi.

Earlier, Choudhary had con-tended that according to a notifi-cation dated April 2,1996 theRevenue Department has handedover the lands along to the ForestDepartment of Delhi govern-ment.

The apex court on March 10had restrained the media fromreporting the statements ofwitnesses which have beenrecorded after the Delhi HighCourt's March 4 order allow-ing the accused's plea to recalland re-examine 13 prosecutionwitnesses including the victim.

"He (Mishra) further addsthat this court is biasedbecause even if he 'breathes', itis recorded in the order sheet,but the court is not recordingthe conduct of father of pros-ecutrix (in taking away thecopy of the apex court orderfrom him in the court room)",the judge noted in herorder.

The court recorded it in theorder sheet after repeatedinsistence of the counsel totake on record the conduct ofthe victim's father.

The judge said, "I have triedto pacify defence counsel stat-ing that it is only a small issue.The father of the victim is alayman and moreover, he hasagain given the order of theSupreme Court to the defencecounsel now. But he stillinsists that the aforesaid berecorded".

istry has set up a high-poweredreview and monitoring committeeto fast track approval of buildingplans in Delhi and give a boost tothe construction business in thenational capital.

Urban Development Minister MVenkaiah Naidu has set up the 16-member committee which wouldbe headed by Vice-Chairman ofDelhi Development Authority(DDA).

"The committee has been man-dated to review and monitor sanc-tioning building plan approvals forland area measuring 5,000 squaremetres and more forcommercial/industrial purposesand 10,000 sq mtrs and more forresidential purposes," a statementfrom UD Ministry said.

The committee seeks to enablebuilding plan approvals within 30days from the date of application tothe concerned urban local bodies.

The committee will meet onceevery month and sort out inter-

departmental issues that result indelay in issuing the required NoObjection Certificates/clearances,it said.

The committee, if required, couldcall the applicant to seek clarity toresolve the issues.

The concerned urban local bod-ies would furnish the summaries of

such proposals in the prescribedproforma to the Committee as soonas the applications were receivedand sent to the concerned authori-ties for NOC/clearances, the state-ment said, adding that theaggrieved applicants could directlywrite to the Member-Secretary fortaking up their cases in the next

meeting of the Committee.This Committee has been set up

by Naidu in the backdrop of delaysin according approvals for buildingplans which is adversely affectingthe ranking of Delhi in terms of'ease of doing business'.

"This initiative will help inenabling FDI flows into the con-struction sector in respect of whichthe minimum built up area hasbeen reduced to 20,000 sq mt fromthe earlier 50,000 sq mtrs," it said.

Rohtash had absconded during the trial pro-ceedings and was declared as proclaimedoffender. The court, however, also acquittedhim in absentia.

The ninth accused, Rakesh, had initiallyabsconded but was killed in a police encounterin Haryana in 2007. The proceedings againsthim were abated.

Pulling up the police for not probing the caseproperly, the court said it made "namesakeattempt" to join passersby as independent wit-nesses and they too were let off in a "very

casual manner"."The legitimacy of judicial process may

come under cloud if the court is seen to con-done acts of violation of such safeguardswhich undermine respect of law," the judgesaid.

The court pulled up the police for failing toconduct the Test Identification Parade (TIP)proceedings of three accused Sanjay,Dharmender and Sonu, who were arrested inthe case later on the basis of disclosure state-ments of co-accused.

It said encounter took at a place where therewas poor visibility and the accused ran awaywhen bullets were fired at them, yet no TIPwas conducted on their arrest later on.

The official refused to name the culprits,saying it may reveal the identity of the vic-tim as they were known to her.

"The victim would visit India and stay inhotels. She was in touch with the culpritsfor around two years," he added.

According to the official, the victimapproached the police on Friday morningand narrated her ordeal. "On the victim`sstatement, we have registered a case andarrested the culprits."

"Despite avail-ing number ofopportunities,complainant failedto lead evidence in support oftheir case.So much so, that thecomplainant stopped appearingbefore the court. As a matter ofabundant precaution courtnotices were sent to her twice.However, despite receiving court

notices, she did not care toappear.

The court's observations cameon the complaint of the woman,who had sought protection orderto restrain her husband, allegedlyan alcoholic who tortured her atthe instigation of his father andbrother, from communicatingwith her and her son in any way.

She had alleged that soon afterher marriage in 2007, her hus-band, father-in-law and brother-in-law began inflicting crueltiesand torturing her, while pres-surising her to fulfill all their ille-gal and unwarranted dowrydemands and was later thrownout of her house along with thecouple's minor son.

In her complaint, the womanhad sought a compensation of Rsseven lakh for the expenditure ontheir marriage and the physicaltorture inflicted on her and main-tenance amount of Rs 15,000 permonth for herself and her son.

"Pakistan did not present the evidencebefore the court...The way the case has beenhandled by Pakistani agencies. Our concernis Pakistan should deal with terrorists in amanner in which the whole global communi-ty is looking at," Rijiju said, adding "There isno bad or good terrorists, a fact which hasbeen globally accepted".

India's reaction came within hours of theIslamabad High Court declaring as void thedetention order of the LeT operations com-mander Lakhvi, who was also the 2008Mumbai terror attack mastermind, and order-ing his immediate release. After his meetingwith Wadhwa, Basit said, "Lakhvi may havebeen granted bail, but the trial continues. Weall are working to complete the trial. Let thejudicial process take its course."

"Both Hindi and English should be taught,otherwise it is detrimental to the interests ofstudents. Government should take it serious-ly as now only one language is taught,"hesaid.

In another mention, MansukhlalMandaviya (BJP) said DRDO scientists were"demoralised" as there was delay in grant ofpatents for their research work in comparisonto their foreign counterparts.

"They get demoralised as it takes severalyears for getting a patent. Our scientists con-duct research but due to delays in gettingpatents, scientists of other nations get theirpatents registered," he said, seeking the inter-vention of the government in the matter.

Supporting the cause, Deputy Chairmn PJKurien asked the Minister to take up the mat-ter.

He said in order to avoid any adverse orderin a sensitive constitutional matter, the stategovernment intended to file an affidavit inthe court today contesting all the pleas madeby the petitioner.

In the affidavit, it stated that it will issue acircular reiterating the respect that is to beaccorded to the Union as also the state flagtaking recourse to J&K Prevention of Insultto the State Honour Act, 1979, in the lattercase.

A total of 126 deaths due to negligence ofroad users at unmanned level crossing havebeen reported this year till February.

While 98 people were killed in 2013-14,loss of lives in train accidents at unmannedlevel crossings was 124 in 2012-13, Ministerof State for Railway Manoj Singh said in awritten reply in Rajya Sabha on Friday.

In 2011-12, the number of casualty atunmanned level crossing was 204.

There were 45 train accidents due to negli-gence of road vehicle users at unmanned levelcrossing this year, till February.

Railways witnessed 53 train accidents in2012-13 and 47 accidents in 2013-14.

Sinha said a series of steps have been takento prevent accidents at unmanned level cross-ings which include closing of many crossingsand also construction of rail over-bridge andrail under-bridge to eliminate such crossingswhich cannot be closed down.

He said deployment of Gate Mitra/GateCounsellors at unmanned level crossings havealso been deployed at certain places.

Government offices the worldover are notoriously porous.Even those which boast of a

high standard of physical securitysometimes do not have a matchingability to protect their informationsystems. WikiLeaks is a strikingexample of how even one of the mosttechnologically advanced nationslike the United States can be foundwanting in this area.

The appalling state of India’s pub-lic offices is a case in point. Thebuildings that house them take thecake for permitting shockingly liber-al access to vandals and marauders.The disgusting state of hygiene inmost of them in itself bears testimo-ny to their porous nature and neglect,both of which certainly promote anambience that is least conducive to asecurity culture.

Porous and unsecured

While Central government officesare a shade better than those in theStates in terms of visitor control,there is no scope for being smug.This is despite the fact that the newgovernment at the Centre has done alot to block unauthorised men,including lobbyists, from visitinggovernment offices. In a much lesscomplicated universe, in the early1950s, Rajaji, as Chief Minister ofthe Madras State, successfully keptout ruling party men from the sacredconfines of Fort St. George. This haspossibly not had the desired result asreports of leakage of valuable infor-mation from a key Ministry in thenation’s capital show.

All you need to secure entry intomany government offices in ourcountry is a reasonably attractive-looking identity card, which may notnecessarily be genuine or whosevalidity has expired. Few questionsare asked after one gains entry. Thereare no sequestered areas which areout of bounds. Greasing the palms ofsecurity staff to secure unauthorisedentry is also not an unknown prac-tice. Here again where there isdeployment of Central IndustrialSecurity Force (CISF) guards, thingsare in fairly reasonable shape.

Elsewhere, the security staff are ill-trained and clueless and thereforeabysmally inadequate.

Shastri Bhavan which houses manyimportant Ministries — includingPetroleum and Human Resource

Development — is the most promi-nent among the many administrativebuildings in the capital which usuallyresembles a kumbh mela on mostworking days. Those found on itscampus constitute a spectrum, whichincludes influence and informationpeddlers and hangers-on, watchingthe hustle and bustle of the place.Those who are there on genuine busi-ness form only a minority. The heistof documents from the UnionPetroleum and Natural Gas Ministryshould be viewed against this back-drop.

Corporate angle

We do not have an idea of what thestolen papers at Shastri Bhavan con-stituted. Speculation is that they areon commercial data, apart from over-all policy indicators. The report that afew papers with national securityimplications were also stolen has nocorroboration as yet. What is fearedas having been compromised is whatis ready meat for corporate interests,especially in the pre-Budget weeks.The temptation to pre-empt govern-

ment decisions, and overtake com-petitors is too much to resist in anambience of sordid venality. This istrue of any firm which is low onethics and largely profit-oriented.This is why we should not be overlysurprised about ‘Shastrigate’. The

phenomenon will keep repeatingitself at periodic intervals. The publicfocus should be on what the govern-ment does to identify the loopholes toreduce the frequency of such suc-cessful raids on government informa-tion storehouses.

Early reports point to no great tech-nology having been employed by thenetwork that was behind the conspir-acy to breach Shastri Bhavan. Thealleged disabling of CCTVs in thebuilding was at best vandalism. Afew at the bottom of governmenthierarchy — who go by the genericname ‘peons’ — had possibly beenbought over and the keys to the doorsleading into the offices secured for aprice and duplicated to gain entry. Itwas as simple as that if press reportsare true. This would mean thatimportant documents had either beencarelessly left behind on tables orstored in cupboards with flimsylocks. If the Delhi Crime Branchinvestigation ultimately confirmedthis, the staff concerned (possibly thesection officer/under-secretary orabove) are culpable, irrespective of

whether they connived with eachother in the crime or not. They needto be disciplined if only for an obvi-ous lack of care in protecting valu-able documents.

Security classification

There is nothing known to us tillnow which suggests that this waseither a sophisticated operation or anintricate form of cyber crime. Mediareports refer to the stand taken inofficial circles that this was conven-tional theft after taking advantage ofthe vulnerability (read greed) of thelowest functionaries. There is alsothe claim that no great damage wasdone because most sensitive informa-tion was stored in computer systems,and whenever hard copies of crucialpapers were required, the bare mini-mum was printed for circulation on aneed-to-know basis — as it should bein a modern-day office. If this standis ultimately upheld by the investiga-tion, and the theft is proved as oneconfined to physical documents —there is some extenuation that will goin favour of the higher officials.

Fundamentally, there is a need for ahard look at existing systems. Thereis also a case for extending the highstandards which have successfullyprotected information stored both inthe Prime Minister’s Office and the

Cabinet Secretariat, and possibly atthe headquarters of all three defenceforces.

What the investigation will have toaddress next is whether the leakedinformation was actually sensitiveand classified. Without establishingthis, it may not be possible to suc-cessfully press charges other thanthat of theft and trespass against theconspirators. We have a funny situa-tion where many government organi-sations mark almost every other doc-ument as either secret or top secret.Very often the decision to classify adocument is taken at the level ofunder-secretary/section officer in amechanical fashion and without anyapplication of mind. The approval ofthe joint secretary, subsequently, issaid to be routine.

Security classification is a double-edged weapon. It no doubt vestssanctity to a record/note in circula-tion which it would not otherwisegain. At the same time it brings abouta ludicrous situation in which every-thing that a department possesses isconverted into a treasure that has tobe protected every working day,without the means required for doingso. When those who are accused inthe Shastri Bhavan case are eventual-ly charge sheeted and taken to court,some of them could take advantageof a loose classification protocol, andare liable to be discharged, if, at theminimum, the prosecution is unableto prove either a role in the break-inor direct benefit from what was con-tained in the documents.

Investigation and justice

A lot of scrutiny and application ofmind will be needed for successfulapplication of the Official SecretsAct (OSA). Incidentally, the OSA isof 1923 vintage and a complicatedpiece of legislation. There is onestrong school of thought which saysthat the OSA has no reason to remainon our statute books after the Right toInformation Act of 2005. An indict-ment of the accused under the OSA,after thorough investigation, requiresthe scrutiny of the Ministry of HomeAffairs (MHA) and its approval, afterwhich a complaint can be filed in the

competent court.

A favourable outcome thereafterfor the investigator is usually dicey.Interestingly, a person in charge ofand responsible for the conduct ofbusiness of a company is not liable topunishment under the OS Act “if heproves that the offence was commit-ted without his knowledge or that heexercised all due diligence to preventthe commission of such offence” —Section 15 (1). A company under thescanner has already distanced itselffrom one of its executives who hasbeen arrested. These are the factorsthat make a swift delivery of justiceto the aggrieved party, viz., the state,a near impossibility.

The Modi government deserves tobe complimented for its proactivedecision to have the suspects undersurveillance and later nabbing them.If it had lost some time in bringingthem to book, it is explained by thefact that delicate operations such asthese have to be well thought out andexecuted at an appropriate moment.There cannot be any kind of heavyfootedness in the matter.

There is the final question thatshould nag most of us. Should theinvestigation continue to be in thehands of the Delhi Police, or should itbe transferred to the Central Bureauof Investigation (CBI)? In this, onecannot assume a categorical standhere. A lot will depend on the kind ofevidence that is ferreted out in thenext few weeks. If there is a nation-wide conspiracy that emerges, or ifinvestigation extends beyond ourborders, there is a case for the CBIstepping in. Otherwise, the DelhiPolice are competent enough to pro-ceed on their own steam and carryout the inquiries to their logical con-clusion. To see a ghost in the MHA’salleged reluctance to call in the CBIwill be unfair to both the Centralgovernment and the Delhi Police.

Professor Romila Thaparin a recent article (“ToQuestion or Not to

Question? That is theQuestion”) laments the declineof public intellectuals in India.She accuses them of remainingsilent in the face of authoritar-ian governance and narrowingliberal spaces, noting that“...books are banned andpulped...syllabuses changedunder religious and politicalpressure...Established publish-ers are beginning to sufferfrom a paralysis of the spine.Why do such actions provokeso little reaction among manyacademics and professionals?”Public intellectuals forProfessor Thapar are a moraland rationally driven groupwho question and challengeauthority. Professor Thapar’spublic intellectual is not aSocratic or Christ-like gadflywith a raging death drive, butis embodied in the figure ofthe Buddha. To revive our cur-rently dismal state of publicintellectualism, she insists thatwe turn to our own historicalresources to acknowledge thepresence of critical, rationalistschools of thought such as theCarvakas and the Buddhists.

Professor Thapar’s publicintellectuals are inspiring, buther analysis of public intellec-tualism in India is only partlytrue. What she points out asthe decline in public intellectu-alism paints only half the pic-ture. The decline is not of pub-lic intellectualism in general,but of the left-liberal variety ofintellectuals only. What shedoes not discuss in her analy-sis are two points: first, therevival of the liberal-right inIndia post-Modi victory, andsecond, changes in the neolib-eral market for public intellec-

tuals after 1991. Hence, toproperly analyse the state ofpublic intellectualism today,we have to account for threeconditions: the decline of theleft-liberal, the revival of theliberal-right and the broaderneoliberal academic conditionsthat underscore these changes.

Renewed self-consciousness

Public intellectualism post-Modi is marked by the rise ofthe liberal-right. This is bestillustrated by two recent arti-cles: Shekhar Gupta’s “SavingIndian liberalism from its left-liberal elite” and the other isthe launch of Swarajya maga-zine, the rationale of whichwas articulated by SandipanDeb, Editorial Director ofSwarajya, in an interview withThe Hindu (“In the cause ofright-wing liberalism,”January 29). Reading thesetwo together, it will not be anexaggeration to suggest thatthis liberal-right aggregationhas gained a renewed self-con-sciousness. It has given itself ahistorical narrative, and hasconstructed a self-recognitionbased on its opposition to theleft-liberal camp. It proclaimsits “rightful” place in India’sfuture, the “vanguard of a newIndian renaissance.” The post-independence history of theliberal-right, it suggests ironi-cally, is one of repression bythe elitist lefties. Along withthe poor and marginalised, ittoo is laying claim to being theintellectual minority, whoseaspirations were apparentlythwarted by the left. The liber-al-right’s liberation theologyseems to be based not onMahatma Gandhi, JawaharlalNehru or B.R. Ambedkar, buton C. Rajagopalachari andNarendra Modi. InvokingRajaji’s Swatantrata Party,

“where much of the oldCongress-right collected,” Mr.Gupta notes that this party wasultimately pushed out byIndira Gandhi in the late 60s.Mr. Gupta says the “right waspurged, artfully by Nehru andthen crudely by his daughter.”As per this narrative, the rightwas repressed by theCongress-backed elitist lefties,reducing “liberalism to a leftmonopoly... [while the] rightmerged into saffron.”

Our universities and intellec-tuals, dominated by the left,are implicated in these accusa-tions and are accused of beingpro-Congress. Mr. Deb sug-gests that the economic ideolo-gies of the right-liberals arenot guided by cultural or reli-gious politics, but are divorcedfrom Hindutva and other exter-nal circumstances. This maybe their ideal but is historical-ly untrue given that the liberal-right has always been pitted asanti-Congress, and is nowavowedly pro-BJP, as is evi-dent in some of Mr. Deb’s ownwritings.

Professor Thapar notes theturn to neoliberal India as acause for the decline of publicintellectuals. But again this isonly partly true. More specifi-cally, the neoliberalism of the90s transformed the left whilealso providing the conditionsfor the revival of the right. Thefollowing section briefly dis-cusses the larger conditionsthat are determining the natureof public intellectualism inIndia. Public intellectuals arenot just morally and rationallydriven voices. They are espe-cially not to be romanticised asSocratic figures rendered out-cast and embracing martyrdomfor the sake of higher truths.Rather, they are creatures

determined by demand andsupply market forces. RichardPosner suggests that publicintellectuals have to be seen as“symbolic goods” in the mar-ket place, “goods, the principalcontent or function of which isexpressive or informational:art, propaganda, journalismand scholarship are all exam-ples.” These intellectuals are“information goods,” “solidar-ity goods” as well as “enter-tainment goods.”

Ethical appeal

In India, the media has beensubstantially growing since the1990s. With print media, tele-vision, websites, blogs, twitterand a competitive publishingindustry, there is a growingdemand for opinions and com-ments on matters of publicconcern. Television channelsare criticised for giving moreopinion than reporting facts.Opinion pages in newspapershave an extremely wide read-ership, in print and digital.There is a growing demand onthe Internet for alternativemedia, and blogs are becominginfluential platforms for cri-tique and dissent.

The public intellectual mar-ket is only partly about thecontent; it’s a lot more aboutreputation and credibility. Mr.Posner refers to theAristotelian category of “ethi-cal appeal” in the public intel-lectual rhetoric.

Ethical appeal is an appeal toauthority, credentials and char-acter rather than the merit ofthe argument. For instance,some Nobel laureates whowould’ve spent much of theirlives in isolated research inlaboratories, suddenly, on win-ning the prize, find a voice to

comment on peace and socialwelfare. India has somefamous ‘IIT-IIM graduatesturned novelists turned publicintellectuals’ who do the same.The same logic also grantslegitimacy to the several ITmoguls and business tycoonsto impose their ideas of poli-tics, welfare and justice, evenwhen the content of their argu-ments deserves no merit.

This raises two importantconsiderations. One is that weneed to understand the specialnature of this neoliberaldemand in order to think aboutthe skewed nature of supply.The nature of this demand is sohighly commodified and over-whelmingly materialistic thatsometimes the intellectualclass resists acting in bad con-science, refusing to be objecti-fied by such a market. Thedemand for intellectuals inmainstream media is not for acritical or radical politics, butfor tacky commentary.

The second point is thatyounger academic intellectualsare yet to grapple with theiridentity in these growing, pri-vate and wealthier academicspaces. The dilemma isbetween our cultural baggageof the ‘jhola carrying left-lib-eral professor’ imagination,vis-à-vis the privileged, con-sumptive careerism in privateuniversities and think tanks,travelling for internationalconferences. Until we grapplewith this dilemma of identityand location in the academicmarkets, our actions will con-tinue to be confused and fick-le. The silence of scholars thatProfessor Thapar laments isdue to the staleness and failureof the left-liberal scholars tostand up and face these newchallenges.

It is akin to an organised industry. The systematic“pilfering” from the Petroleum Ministry’s office inthe heart of New Delhi of documents which were

then handed over to “consultants” and interested corpo-rate entities for a price, has revealed a frightening nexus.One account says that a night guard would “steal” thedocuments while a peon would switch off CCTV cam-eras to facilitate the alleged acts of corporate espionage,some details of which are now in the public domain. Inaddition to some low-ranking staff members of theMinistry, two “consultants” and representatives of fivetop business houses have been arrested by the DelhiPolice in the case. Budget inputs, minutes of a Cabinetmeeting on disinvestment and detailed documents on thepetroleum sector, were among the documents that wereallegedly stolen by the ring. The brazen manner in whichthese were pilfered from Shastri Bhavan in Lutyen’s’Delhi goes to show that government departments caneasily be subverted by vested interests for corporategains. This rot might well extend to other ministries anddepartments. While the facts of the present case willhave to be established in a court of law, it is unlikely thatcompany representatives were acting in their personalcapacity. If it is proved, the top corporate groups who arealleged to have benefited from the documents that theyprocured through this organised system of espionagewill have much to answer for. It is likely that the DelhiPolice crackdown on the ring was triggered by the con-cern expressed by National Security Adviser Ajit Dovalin October 2014 at how “secret” information made itsway to the media. In a recent communiqu,the Home Department hasreminded DGP P KThakur that 149 IPS offi-cers in the state have notsubmitted theirImmovable PropertyReturns (IPR) during cal-endar years 2012, 2013and 2014, which "indi-cates violation of Rule 16(2) of All India Services(Conduct) Rules, 1968".

The letter has alsoasked the home DGP todirect the erring officialsto submit IPR in the for-

mat prescribed by theMHA.

The Home Departmentletter points out those 88Bihar cadre IPS officersby name, who did notsubmit their IPR for 2014,last date of which wasJanuary 31, 2015.Similarly, 26 officersfailed to submit it for theyear 2013, while 35 didnot do so for 2012.

Apart from top levelofficers, these IPS alsoinclude several IG, DIGand SP rank officers post-ed in the state, as well asthose outside on centraldeputation.

Asked about the non-submission of IPRs, DGPP K Thakur told PTI,"This is not the right timeto talk about this. TheLegislative Assembly is

in session and I am busyin it."

The MHA guidelinessay that if IPS officers donot submit annual IPR,they will not be givenpromotion to higherposts, nor will be consid-ered for empanelment,training, listing andawards. They will alsonot be given clearancefrom vigilance till theysubmit the propertydetails. Reacting to theflouting of rules by somany IPS officers, BiharHome DepartmentPrincipal Secretary AmirSubhani said, "The offi-cers should tell why theyare not submitting theirIPR. As far as actionagainst them is con-cerned, it will be takenaccording to rules."s

GUWAHATI, MARCH 13The Assam government on Friday

said it was "concerned" over gradualcut in central assistance to the state,but asserted that it would not moveback to "darker days" prior to 2001.

Replying to discussions on the statebudget for 2015-16 in the Assembly,Chief Minister Tarun Gogoi soughthelp from all stakeholders, includingMLAs, public and media, in dealingwith the problem.

"We got Rs 3,000 crore less amountin current fiscal from the Centre. Sonaturally my speed (of growth) willdecrease. In the latest budget also, Igot Rs 2,000 crore less. We are con-cerned. Everyone wants more funds,but it is going down."

"During UPA tenure also, I told thatI needed extra funds. Forget aboutincrease in funds, now we are gettinglesser than what we were getting ear-lier. It is a matter of concern," headded.

Gogoi, who also holds the Finance

portfolio, said the Union governmentwas not giving due importance toflood and erosion problems of thestate.

"They are gradually cutting fundsfor many sectors. Problems may arise

out of this. But whatever be the prob-lem, we'll not go back to darker daysprior to 2001 with no salary, noinvestment and no development," hesaid.

Gogoi also criticised the Centre

over uncertainties in releasing thefunds to the states.

"Now we do not know how muchfunds we will get. We are planningonly on the basis of an assumptionand estimation. Earlier, we wereinformed about our share," he added.The Chief Minister said the state hadmoved ahead with only one aim since2001 that it would not move back-ward.

"Prior to that (2001), Assam wasfacing very bad situation in law andorder and economic front. Then westarted reconstructing the house grad-ually. We have managed law andorder and economy of the state.Management of both are important. Iflaw and order is not there, no one willcome for investment here," hesaid.

Citing the last Economic Survey,Gogoi claimed that Assam's econom-ic growth was higher than the nation-al average and it was steadily movingahead.

in Goa will now become a sourceto generate fuel, thanks to an ini-tiative of state's one of the mostrural municipal councils atPernem.

Pernem Municipal Council hasentered into an agreement with aTamil Nadu based firm, M KAeromatics, to set up a plant thatwill generate furnace oil, met cokeand wax from the non-recyclableplastic that is usually strewn on theroads.

"The municipal council hasentered into revenue sharingagreement with the company. Theplant would be set up in thegarbage disposal dump of Pernemmunicipal council," said councilchairman Vasudev Deshprabhu.

He said the plant, which costsaround Rs 23 crore, would be

spread across 8,000 square metres.With the capacity to treat 10 tons

of plastic daily, it will generate 6.7tons of furnace oil, three tons ofmet coke and 500 kgs of wax, hesaid.

Goa State Pollution Controlboard (GSPCB) yesterday gave itsnod for setting up the plant, whileit is awaiting approval from thestate Town and Country Planningdepartment.

Chairman Jose Manuel Noronhasaid the state generates 23 tons ofplastic waste, of which 30 per centis non-recyclable and can be sentfor the plant in Pernem.

"This will help us to keep Goaclean at least from the plasticgarbage," he said.

Located in North Goa, the plantis also expected to cater to neigh-bouring Sindhudurg district inMaharashtra.

The helpline came into beingso that people from the north-eastern states living in Gurgaoncould report cases of physicalassault as well as racial discrim-ination to police without delay.

From October 28 last yearwhen it was started, the helplinehas got a total of 27 telephonecalls until March 12 this year.Almost all of them had nothingto do with the northeast, exas-perated police officials say.

Two calls came on March 7,including one from a womanwho complained that she had

been working at a shopping mallhere on the Mehrauli-Gurgaonroad but was not getting hersalary.

But she did not disclose heridentity, and hung up.

Another call the same daycame from Gurgaon Sector 10.The person alleged that therewas Rs 10,000 in one of theclothes she mistakenly handedover to her laundryman, whorefuted the claim. She asked thepolice to get her money back.

The person who made the onlycall on March 1 reported a majortraffic jam on Sector 4-7 Chowkand said: "Please do something!"

One of the callers wanted toknow how the weather would bein the coming days. The policedirected her to the weatherdepartment.

action against former chief ministerJitan Ram Manjhi for violating theparty whip by staying away from trustvote for Chief Minister Nitish Kumartwo days ago.

"Certainly, party would take actionagainst Manjhi soon after directivefrom the top party leaders," said JanataDal-United chief whip SharavanKumar, who is also the parliamentaryaffairs minister of the state, on Friday.

Sharavan said action against Manjhiwill work as a deterrent to others infuture.

He said the whip was applicable notonly to JD-U legislators but also to therebels led by Manjhi.

Nearly a dozen rebel Janata Dal-United legislators, considered close toManjhi, voted in support of NitishKumar during the trust vote. ButManjhi skipped it.

Manjhi had sent a letter to Sharavan,raising the question as to how the whipwas applicable to him as an unattachedmember.

"I had informed Manjhi that the rela-

tion of an unattached member withoutparty affiliation cannot be severed withthe parent party and the whip is appli-cable to an unattached member also,"he said.

Sharavan said that the reply hadreached Manjhi well before the confi-dence motion was put to vote in thestate Assembly.

Nitish Kumar on Wednesday provedhis majority on the floor of the

Assembly, while the oppositionBharatiya Janata Party memberswalked out of the house during the con-fidence vote.

"The Chamberhas repeatedly brought tothe notice of the state gov-ernment vide several repre-

sentations earlier, that suchholidays for local bodyelections should not bedeclared so as to avoid lossof production and busi-ness," Kamat said.

"GCCI observes thatsuch holidays are beingroutinely declared withoutany application of mind tothe detriment of the indus-try. Also such notificationsdisrupt the harmonybetween the managementand the workforce," thestatement further said.

The GCCI has advised"all industries and com-mercial establishments inthe private sector to allowadequate time off to allbonafide electors/votersemployed by them toenable them to exercise

their voting rights".Finding loopholes in the

manner in which the publicholiday notification wasissued, Kamat said the sec-tion 25 of the NegotiableInstruments Act 1881 (Act26 of 1881) read with theGovernment of India,Ministry of Home Affairsnotification dated 28thJune 1973, that has beenquoted by the governmentto justify the public holi-day was erroneous.

The Jammu and Kashmir government hasdirected the Treasury Officers (TOs) in thestate not to entertain any bill or cheque for pay-ment after the working hours on March 30, asenior official said on Friday.

The department has issued a circular to TOswhich states that in the past some bills couldnot be verified before issuing the payment tovarious entities such as government contrac-tors. "It has been observed in the past that thebulk of bills and cheques are received at thetreasuries on March 31 and even after workinghours and this provides little or no opportunityto the concerned Treasury Officers to verifyand scrutinise the bills, cheques which dilutethe rigour of scrutiny of bills posing avoidablerisks," an official spokesperson said.

The official said that the practise has allalong been objected by the AccountantGeneral. The official added that the TreasuryOfficers have also been advised to conveythese instructions to the Drawing andDisbursing Officers (DDOs) operating in theirrespective treasuries by way of prior advice ornotice.

Jupiter's largest moon,Ganymede, has anunderground ocean

that contains more waterthan Earth's, broadeningthe hunt for places in thesolar system where lifemight be able to exist.

Researchers saidThursday that auroraeglimpsed by the HubbleSpace Telescope helpedconfirm the long-suspectedsubsurface saltwater onGanymede, the largestmoon in the solar system.

The Galileo spacecraft,which arrived at Jupiter in1995, had already detecteda possible magnetic fieldon Ganymede.

The Hubble SpaceTelescope confirmed thatdiscovery by observingchanges in the auroraearound the celestial body.

"Since the 1970s, therewere speculations and

models that Ganymedecould possess an ocean,"said Joachim Saur of theUniversity of Cologne inGermany.

"We do not have theseambiguities anymore," hetold reporters.

The latest findings fromHubble "provide the bestevidence to date for theexistence of an ocean onGanymede."

Aurorae, which Nasadescribes as "ribbons ofglowing, hot electrifiedgas" can be seen in regionsaround the north and southpoles of the moon.

Because aurorae are con-trolled by a moon or aplanet's magnetic field,observing changes in theirbehavior can lead to betterunderstanding of whatexists under the crust.

Researchers found thatJupiter's own magnetic

field interacts withGanymede's, causing arocking motion in the auro-rae. This motion is reducedby magnetic frictionapplied by the presence ofGanymede's undergroundocean.

Heidi Hammel, execu-tive vice president of theAssociation of Universitiesfor Research in Astronomy,said the approach showed

that a space telescopecould be "a powerful tool"to make inferences aboutthe interior of a moon.

Already, scientists knowthere are oceans beneathsurfaces of Jupiter's moonEuropa and Saturn's moonEnceladus. Jupiter's moonCallisto is believed to havesubterranean water as well.

"Every mission that wesend to various places in

the solar system is just tak-ing us one step further tofinding that truly habitableenvironment -- a water-richenvironment in our solarsystem," said Hammel.

Now, much more can belearned about the condi-tions on Ganymede --which is larger than theplanet Mercury - when aEuropean Space Agencymission, called Jupiter's

Icy Moons Explorer(JUICE) launches in 2022and arrives at Jupiter in2030, she added.

"Hubble observationshave now confirmed thepresence of a salty, electri-cally conducting oceanunder the crust ofGanymede, and so whenthe JUICE mission ulti-mately goes into orbitaround Ganymede it will

have a very, very rich andexciting science mission,"Hammel said.

Much remains to belearned about the tempera-ture and depth ofGanymede's ocean.

As of now, scientists esti-mate the ocean is 10 timesdeeper than Earth's oceansand is buried under a 95-mile (150-kilometer) crustmade up of mostly ice.

As to the water tempera-ture, they only know it iswarm enough to be liquid,said Saur.

Jupiter is a gas giant,composed mainly ofhydrogen and helium, andis the largest planet in thesolar system.

Its four largest moons,Ganymede, Io, Europa andCallisto, can be seen withbinoculars on a clear night.

smashed a brisk century beforeNew Zealand huffed and puffedto a thrilling three-wicket winover Bangladesh to sign off theirleague engagements unbeaten inpool A of the ICC cricket WorldCup here on Friday.

Chasing a competitive 289 towin, New Zealand rode on a 131-run third-wicket partnershipbetween Guptill (105) and RossTaylor (56) to stay atop pool Awith 12 points, followed by SriLanka (8), Australia (7) andBangladesh (7).

Bangladesh, who had reachedthe quarterfinals for the first timeafter beating England lastMonday, are now most likely totake on defending championsIndia in the last eight stage afterfinishing fourth.

However, a final position ofthe pool will only be known afterthe Australia-Scotland match atHobart tomorrow. If the min-nows can stun the four-timechampions by a big margin, theposition of the teams maychange.

Deshpande.The FIR was lodged by constableRavindra Patil, who was thenSalman's body guard. He informedthe court that the superstar was onthe wheels when the accident tookplace.

Rajendra Kadam told the courtthat the first thing he has done onreaching the accident spot was torescue constable Ravindra Patilfrom the mob. "We then sent theinjured to the hospital," he said.

"I saw that a white Land Cruiserhad rammed American Expressbakery and had climbed threestairs. It's number plate was lyingon the spot."

Mr Kadam further said thatwhen he reached the spot, he sawfive persons "entangled andtrapped beneath the car". "It wasn'tpossible to remove them withoutlifting the car with the help of acrane," he said. The injured weretaken to Bhabhahospital.

He saw bloods on the tyre of theleft wheels of the actor’s car andhe seized the papers of the vehicleand the keys and marked them."As the tyre was burst, there wasblood on the wheel base too," hesaid.

The officer producedbefore the court evidenceslike blood-stained soilsample, pieces of fibreglass, white frontbumper of the carinvolved in theaccident.

Mr Kadam saidthat he arrived atthe accident spot

at 2.50 am and conducted panch-nama between 3.05 am and 4.20am, when he was cross-examinedby Salman’s lawyers ShrikantShivade.
