hank you to everyone who supported the T 2015 Carpet Cleaners Carnival (CCC). We are
pleased to report that the event was a big success
again this year!
Held annually at Wicksteed Park in Kettering, the
CCC has proved hugely popular since its launch in
2011 and this year was no exception. If you didn't
attend, you really did miss out on a great day!
The 2015 Carnival was open to everyone in the
industry and was visited by both members and
non-members together with their partners,
friends and children - providing cleaners from all
over the UK with the opportunity to take a break
from work whilst remaining fully up-to-date with
the industry.
The event included an exhibition featuring big-
name manufacturers and suppliers who were
promoting the very latest equipment. Visitors
were able to meet NCCA Corporate members and
other similar businesses, compare different
systems, view new product launches, ask those
all-important questions and even bag themselves
a bargain!
The 2015 Carnival also included a seminar
programme and this year the spotlight was very
much on marketing. Feedback from visitors last
year indicated that they would like more
information on sales and marketing at future
events and, in respect of this, we organised a fully
integrated marketing programme to run at the
Carnival this year.
However, we hadn't forgotten
the popularity of the technical
seminars and the last seminar
of the day, hosted by Paul
Pearce, provided delegates with
an interesting insight into how to clean luxury
carpets and soft furnishings… an area which
many people struggle with.
Alongside the exhibition and seminars there
was also lots to keep the less industry-minded
visitors entertained, including children's activities
and even a magician. And for those who wanted
to stretch their legs, there was plenty to occupy
them within the park itself including a
playground, a lakeside area, a fairground and lots
of places to eat.
The Carnival was again pleased to support our
official event charity, Kirsty's Kids. NCCA
Member, John Bryden, who runs the charity in
honour of his daughter Kirsty and her work to
help sick and underprivileged children, has
expressed his gratitude for the assistance he
received in fundraising on the day and has said
that with everyone's help he was able to raise an
incredible £1,173!

he fifth Carpet Cleaners Carnival, held on
September 12th at Wicksteed Park, was T well attended by both NCCA members and
non-members. The exhibitors reported brisk trade
and significant enquiries, and it was great to see
new exhibitors at the show.
A series of seminars were run throughout the
day and, this year, the focus was very much on
marketing, with the first three seminars forming a
fully-integrated marketing programme to assist in
maximising opportunities for business growth.
During one of these seminars we were informed
that each and every part of what the customer
sees is integral to how they form their opinion of
us. From how we present ourselves to our van
livery, it's all part of the ‘sales’ process.
This made me start to think about the role that
Social Media now plays in our client exposure
experience. I think that we have all seen on
YouTube, Facebook etc., the 'comical' videos of
people vacuuming when the vac hose has
detached from the vacuum or similar; we also see
a lot of content where overshoes are not worn,
pre-spray is liberally sprayed around (without care
for walls or furniture) and various other haphazard
antics. In the eyes of the client, how professional is
the image that is being portrayed?
As NCCA members we have a code of ethics to
ensure that all members are seen to be
responsible, professional companies that are the
standard-bearers for this great industry of ours.
How easy is it to be seen to be the uneducated,
unprofessional, run of the mill cleaner? It is worth
bearing in mind that, if this is how we are
presenting ourselves, we could easily taint the
image of other members who take pride in the
professionalism displayed by the NCCA - those
who wish to project their own high standards
without being tarnished by others.
So, please think very carefully about the media
you are using to expose your business to a wider
audience. You need to ensure that the content is
high quality and professionally presented.
Remember… together we can make a difference
and separate the professional from the herd.

Derek Bolton (Honorary Member)The ‘shading phenomenon’
he mystery of shading on cut
pile carpets has been around
for as long as I can Tremember. I have seen it described
many times (in fact I may have
described it this way myself) as a
'phenomenon' and it most certainly
is… an unsightly one!
I am surprised that, after all this
time, the technical boys and girls
involved in the manufacturing side of
things have not been
able to enlighten us
as to just 'how' or
'why' it should occur.
What prompted me
to write about this
subject was a label I
came across recently in a carpet retail outlet (sadly
I didn't make use of my camera this time… I wish I
had… silly me). It stated that the cut pile carpet
was GUARANTEED against shading, however, a
little further down the label there was the usual
disclaimer stating that any phenomenon of
shading was NOT a manufacturing problem (yet
another case of conflicting information on labels!).
I did ask the nearby sales lady how they could
guarantee against shading and what process had
been adopted; the lady said that she didn't know.
Firstly I would like to remind you that there are
generally two explanations for the appearance of
what is known as shading, pooling or
watermarking.
These are:
These theories include:
1. The so-called 'natural phenomenon' - this is
where random 'watermarking' takes place soon
after some cut pile carpets are laid (there are
many theories as to why this happens).
2. Pile distortion from foot traffic.
However, on doing a bit of research, I have found
that many of the theories put forward as to the
cause of the 'natural phenomenon' have been
discounted.
1. Sub-floor irregularities - apparently this can
create, albeit very slight, a watermarking effect on
carpet fibres. Thinking about it though, this
probably wouldn't contribute to the problem until
the carpet had been 'trafficked'; therefore I
Carpet shading
newslinkpage 7
wouldn't consider this to be 'natural' occurrence,
more the result of activity.
2. Static electricity - this has also popped into the
equation but soon discounted because, as with
above, an element of foot traffic would be
required.
3. Air flow - this has been suggested at some point
but, again, if it was a potential candidate I would
suggest it falls more into the 'mechanical
distortion' than the 'natural' category.
4. Electromagnetic Fields (created by fitted
electrical wall sockets within a room) - the boffins
have discounted this suggestion as well. However,
I felt, and still feel, that it is a rational idea worth
consideration.
Now I do stress that I am 'just a carpet cleaner'
with NO technical background whatsoever,
however, I still have one or two brain cells that
function from time to time and can apply a
reasonable amount of, what I consider as,
common sense.
I still remember when I was at school (several
years ago) conducting experiments with a piece of
paper, a magnet and a few iron filings. The filings
were placed on the paper with the magnet
beneath and the paper tapped gently… the filings
rearranged themselves in patterns around the
magnet (who needs High Tech?). So, why
shouldn't carpet fibres respond in a similar way? I
would love some technical person with a few
letters after their name to enlighten me as to the
feasibility of this.
Ok, I may be wrong but let's take this a little
further. A few years ago I wrote an article on
behalf of the NCCA for a trade magazine, which
went out to retail outlets, all about shading and
pile distortion. I then received a telephone call
from an elderly gentleman who was the MD of
three carpet retail outlets in the South of England.
He said he was pleased that I had differentiated
between pile ‘shading’ and pile ‘distortion’. In the
ensuing long conversation he informed me that,
together with a friend who was an
electrical engineer, they had created a
new type of 'plug'. Allegedly this plug,
when inserted into an electrical socket,
neutralised any magnetic fields within a
building. Apparently it didn't have to be
switched on and would do its job as long
as it remained in the socket.
The MD assured me that it worked and
that, whenever and wherever a risk of
shading was identified, one of these plugs
had been fitted by his company and the

'phenomenon' simply hadn't occurred. The cost of
each plug at that time was £62.00 and, although it
seemed expensive, it was nothing compared with
the cost of replacing a carpet.
This idea has never been taken up, which is
unfortunate because it did make some sense to
me in the light of no other reasonable cause being
suggested. The success, although confirmed by my
new friend, has never been substantiated
elsewhere and I can't seem to find the Neutralec
website either.
I downloaded this from the Neutralec website
before it disappeared….
FOR PROTECTION AGAINST THE EFFECTS OF
ELECTROMAGNETISM (E.M.F's)
ŸEveryday electrical and electronic appliances and
cabling produce Electromagnetic Fields (E.M.F's),
the effects of which have been linked with many
illnesses.
ŸThe Neutralec Neutraliser has been developed to
combat the effects of Electromagnetism.
ŸIn 1992 'Neutralec' discovered that a major
problem for the carpet industry, 'phenomenon'
shading, is caused by E.M.F's. Newly installed
carpets in homes, offices, commercial buildings,
even airports and cruise liners, develop unsightly
patches of colour change where E.M.F's 'force'
the surface pile yarn into a different lie.
ŸNeutralec proceeded to invent and develop the
'Neutraliser' initially for the protection of
carpets, and now this compact plug-in device is
available for use in domestic, industrial,
commercial, in fact any premises, to ensure
protection against the effects of
Electromagnetism, for all persons and animals
within.
ŸThe Neutralec Neutraliser is totally safe. It uses
no electricity or battery power.
ŸBy simply plugging into a normal mains socket,
the Neutraliser's capabilities are uniquely
conveyed via the earth cabling of a premises, to
all other rooms therein. There is no need to
switch on the socket.
There have been one or two manufacturers who
have said that they have come up with the answer
to the problem of shading, but we still see
disclaimer labels on samples in the shops.
One such manufacturer is Brintons who have
developed their ‘Brinset’ process, which is used
during manufacture to eliminate the risk of these
effects.
Brinset guarantees against permanent random
shading effects in domestic installations, on all
Brintons cut pile products, for up to two years
following the installation of the carpet. After
contacting Brintons and posing the question I
received the following reply… “I can confirm that
our Brinset process does follow the principle of
ensuring that the pile is well aligned and then
using steam and heat to help give more 'set' into
the carpet''.
Hopefully, with 'tweaking' during the
manufacturing process, the shading
'phenomenon' will become a thing of the past. But
why on earth does/did it happen… the mystery
remains!

opefully you all know about TrustMark by
now but, just in case, I am going to run Hthrough it all again.
It is the Government Endorsed consumer
protection website for the promotion of trusted
tradespeople in
the Repair and
Maintenance
Industry (RMI) and
it operates under
license from the
Department of
Trade and Industry.
Its main purpose is the promotion of reputable
tradesmen and the protection of consumers from
rogue traders across the RMI. To achieve this,
TrustMark approves Scheme Operators for each
industry sector to check and vet potential
members - the NCCA is obviously the Scheme
Operator for our industry.
With consumer recognition of the TrustMark
logo at over 24%, they are now a well-established
and recognised brand.
Absolutely NOT! Other tradesman referral
websites do not have the same level of consumer
protection interest; they are more interested in
getting as many paying tradesmen as possible
signed up. TrustMark is all about educating
consumers and preventing rogue traders, poorly
trained cleaners, and ‘splash and dash’ operators,
from thriving.
What is TrustMark?
So, isn't this the same as other referral sites?
Glyn CharnockTrustMark update
Why are the NCCA Scheme Operators?
Why should I join TrustMark?
Because we are the industry experts, recognised by
the Government as such, and we have set the
standards required for carpet cleaners to become
members of TrustMark. We check, vet, and
monitor, all TrustMark members under the Carpet
and Upholstery Cleaners category, and
membership of the NCCA is the ONLY route to
gaining TrustMark accreditation within this
division.
Part of our remit is to raise standards in the
carpet and upholstery cleaning industry and
improve consumer protection in our industry
sector. This is completely in line with our aims as a
trade association.
The benefits of TrustMark membership are
obvious:
Inclusion of all your details on a website Ÿ
achieving over 7.5 million clicks through to
members details every year - Carpet and
Upholstery Cleaners category members receive
on average over 70 clicks through to their details
every month from the website. August’s statistics
show over 5,200 clicks through to members'
details (11,500 in FEBRUARY, traditionally one of
the quietest months for our industry!)
Direct links to your website from the TrustMark Ÿ
site, improving your website SEO.
Use of the TrustMark logo, recognised by 24% of Ÿ
consumers (and growing) as government
approved, on all paperwork, website and vehicle
stickers.

In my experience... Cecil Aigin (Honorary Member)
e learn from
experience -
sometimes Wour own and, very often,
from that of other members.
I hope that the following,
gathered from my archives,
will prove interesting and
helpful.
Satisfying a client's
expectations may often
prove a problem, particularly
when their memory of the
condition of a floor covering
stretches back over the
years. Very often the wear and tear to which a rug
has been subjected, does not enter their mind.
I had a difficult situation to deal with very many
years ago when I was new to the industry. Our
company received several old Oriental rugs for
cleaning via a trade client (which happened to be a
branch of a prominent national department
chain); the items were cleaned and returned and
we promptly received a complaint that we had
caused wear in the rugs. I called on the client, a
lady who happened to be the mother of a
prominent national sportsman, and she indicated
that the rugs possessed worn areas that had not
been present prior to cleaning. I asked to see
where the rugs had been laid and I was shown a
flagstone area in the courtyard of the period
cottage. The flagstones were uneven and I pointed
out that the worn areas coincided exactly with the
uneven edges of the paving. I explained that the
wear had not been evident prior to cleaning
because it had been hidden by soiling, but now
that the soil matter had been removed the worn
areas had been revealed.
I submitted a report to the managing director
of the store, who was taking a personal interest
in the situation. He subsequently asked me to
call on him and informed me that the carpet
sales director of their group and, also, an expert
from a prominent company of Oriental rug
importers, completely agreed that our company
was in no way responsible for any damage or
deterioration to the rugs. But (there's always a
'but') their company policy was always to make a
client happy and they intended to make an 'ex
gracia' payment even though they had no
liability.
Worn areas hidden bysoiling can often become apparentfollowing the cleaning process
page 13 newslink
He asked me how much our company would be
prepared to contribute. My response was that,
had we been in any way responsible for damage,
we would have compensated their client without
requesting any contribution from the store.
However, all their experts had confirmed that we
did not cause any damage and, under those
circumstances, I declined to contribute to their
payment.
We never received any further work from that
trade client; maybe on reflection I should have
made a commercial decision and agreed to make
a contribution.
Pile shading was always a very special 'hobby
horse' of mine too. We have all been involved in
explaining to a client that the 'watermark' was not
caused by overwetting, but was due to a change
in direction of the pile or a deterioration of the
tuft condition.
I always considered that pile reversal was a
completely different phenomenon. This may
occur spontaneously on a completely unused
carpet and, most usually, in tufted carpets where
the 'pile lean' may not be as pronounced as in a
woven carpet.
In my opinion pile reversal is caused by the
‘lean’ of the pile changing direction due to a
variation in tension in the carpet created during
installation, variable temperatures in the area, or
simply due to gravity when the pile is devoid of
'lean'.
There is a significant difference between the
appearance of a carpet with pile shading and that
of pile reversal. As we know, pile shading or pile
distortion appears to be a 'watermark' and will
follow traffic directions around furniture and into
doorways, whereas pile reversal manifests itself as
a change in shade in blocks of pile with precise
edges.
Several years ago I was asked to provide a report
on a deep pile wool carpet where significant
shading had occurred within weeks of installation.
The area in question was a large open plan sitting
room and the owners were dismayed at the rapid
change in appearance. I considered that the
significant change in pile condition was premature
and indicated this in my report. The owners
subsequently succeeded in obtaining a
replacement carpet from the manufacturers.
At about the same time as I had been dealing
with the above situation, our company had
installed a similar carpet type in a large local
house and, as I happened to be in the vicinity of
our clients, I decided to call and inspect the carpet
in order to see how it had reacted to a short time
in use.
Our clients were grateful for my attentiveness in
calling on them and I patiently waited until we
arrived at the room in question. To my concern
their carpet exhibited the same degree of pile
shading as in the previous installation and I
prepared myself for an adverse comment from the
owners. However, they immediately told me how
much they were impressed with the various 'tones
and shades' that had appeared in the carpet
surface and were totally delighted with our work.
So there you are, “one man's meat...” etc.
I suppose that it is these experiences that make
carpet cleaning such a fascinating industry.
Did I say 'fascinating'?

The Carpet Cleaners Carnival 2015
n September 12th we held our fifth Carpet O Cleaners Carnival at Wicksteed Park in
Kettering.
The Carnival, which is open to everyone in the
cleaning industry together with their friends and
family, was a huge success again this year -
attracting visitors from all corners of the UK!
At 9.30 the doors were opened to cleaning
companies all eager to expand their knowledge
and learn something new. And from the feedback
we've received since the event we are pleased to
report that the people who came this year were
very impressed.
If you didn't attend, here's what you missed…
Each year the Show gets bigger and better and
this year we were pleased to welcome some
exciting new exhibiting companies to the event.
The CCC exhibition is not just focussed on carpet
cleaning; it brings together everyone involved in
the cleaning, maintenance and restoration of
flooring and soft furnishings and, at the Carnival
this year, many aspects of this industry (including

hard floor cleaning and restoration products,
leather cleaning and restoration products and
more) were on show.
Visitors to the event were able to meet with big-
name manufacturers and suppliers who were
promoting the very latest equipment and offering
the chance for hands-on testing, allowing visitors
the rare opportunity to get up-close with a variety
of different machines and to compare various

THE SEMINARS
Introduced to the event last year, and a huge
attraction to visitors, was a programme of
seminars which ran alongside the exhibition
throughout the day, and this year the spotlight
was very much on marketing.
Many people struggle with their marketing,
especially in this day and age with the multitude
of promotional channels available, and feedback
from visitors last year indicated that they would
like more information on sales and marketing at
future events.

In respect of this, this year we organised a
comprehensive, integrated seminar programme
to help cleaners to optimize their communications
strategies. From the initial promotional material,
right through to how to close the sale and 'clinch
the deal', we had it all covered.
However, we hadn't forgotten the popularity of
the technical seminars and the last seminar of the
day, hosted by Paul Pearce, provided delegates
with an interesting insight into how to clean
luxury carpets and soft furnishings… a very tricky
area that many people struggle with.
TRUSTMARK PRESENTATION
KIRSTY'S KIDS
In the exhibition hall NCCA Director, Glyn
Charnock, hosted a short presentation on
TrustMark, the Government-Approved Standards
Scheme for tradesmen working in consumers'
homes.
His talk included details on what TrustMark is,
why the NCCA have become Scheme Operators for
the Carpet and Upholstery Cleaners category, the

FUN FOR EVERYONE
Throughout the day there was plenty to keep
friends, family and the less industry-minded
visitors entertained.
Inside the exhibition hall there were children's
activities (including face-painting and an excellent
crossword treasure hunt game) and magic
performed by brilliant close-up and cabaret
magician, John Martin, whose tricks were enjoyed
equally by both the adults and children who
attended.
And for those who wanted to stretch their legs,
there was also plenty to occupy them within the
park itself. Wicksteed offers everything a family
could need to enjoy a great day out. From the
play area, fairground and lake activities to the

visitors were able to make their day as fun-filled
or as relaxed as they wanted.
Since the event we have received a huge amount
of positive feedback from the visitors who
attended this year.
Here are some of the comments you made:
“I had a great day at the 2015 Carnival! I met up
with some old friends and picked up more
valuable ideas from Allan Simmon's marketing
seminars, even though I have seen them a few
times before… you never stop learning!
It was good to see some new suppliers, such as
TileMaster. I had a very interesting conversation
with the Print and Deliver guys and the Best Of
girls. TLC looks to be an interesting project and I
can see the benefits and look forward to getting
involved with it.
Well done to everyone involved in organising the
event, particularly Allan Simmons who I know put
a lot of time and effort into getting the exhibitors

“Dear NCCA team, many thanks for a great day at
Wicksteed Park on Saturday - my first visit.
My colleague and I (with a mere 66yrs in carpet
cleaning between us) were asking ourselves, on
the way to the venue, where all the enthusiastic
suppliers of our products and the cleaners are
these days (there just doesn't seem to be anyone).
Then, on arrival, we met Richard from Chemspec,
Derek Bolton, followed by Tony Abbott, Alan Cox
and Paul Pearce (they made us experienced
cleaners look like mere amateurs!).
Paul's presentation on viscose carpets reassured
us. Thank you Paul, you seemed to be speaking for
only ten minutes (although I know it was a lot
longer); we were blessed. The way you
communicate the knowledge you have to both
new and old carpet cleaners is a testimony to the
enthusiasm you have for your subject. Your
presentation alone was well worth the visit. We
went away with more knowledge than we came
with and a renewed enthusiasm for our
profession. Many thanks NCCA!” - Alan Arnold (AA
Carpet, Curtain and Upholstery Cleaners).

“I had a great day and a great Friday BBQ,
meeting old friends and welcoming new ones. I
can't wait until next year's event already.” - Billy

“Thanks for hosting the event. It was a really
enjoyable day.” - Sean O'regan (Sor Clean).

all had a great time, especially our son Harry.” - Ian

“Dear Nigel and members of the NCCA Admin
Team, I wanted to say what a wonderful day I had
at the 2015 Carnival.
I arrived early (before the Exhibitors had set up)
for a coffee and bacon sarnie and was, I believe,
the last attendee to leave. There was so much to
see and learn! Allan Simmons and his advice on
marketing (the 'Black Art' as Nicky described it) was
fantastic! I also got some great ideas on rug
cleaning from John Bryden and a 'freebie' from Paul
Pearce (some Sebo dry carpet powder)… these
things alone were more than worth the hour's
drive! I have also been in touch with Alex Rimmer,
from The TileMaster, since the event as I think he
has a great product and I will be contacting at least
one other exhibitor shortly. A great day out, and 'all
for nowt'! I will certainly be there next year. Oh,
and just one more thing… the magician. Well, he
was just....... magic!” - Tom Laity (ServiceMaster).
We would like to say a big ‘Thank You’ to the
exhibitors, the people who hosted the seminars
and, of course, the visitors who attended.
We look forward to seeing you all at our event
again next year… and, for those of you who
missed it this year, we look looking forward to
seeing you there too.
A BIG 'THANK YOU' FROM EVERYONE AT THE

cClure Naismith has been in business
for one hundred and eighty nine
years. They are a firm of solicitors Mestablished in Glasgow with branches in Edinburgh
and London. Before the recession they were doing
well, with a turnover of £15.4m in the financial
year 2007/2008. Planning for further expansion,
and requiring premises that
reflected their image, they
subsequently took on leases for
new offices costing £944,000 per
year.
Unfortunately the recession not
only put paid to their growth
plans but, in the current year
2014/2015, turnover dropped to
£10m resulting in their going into
administration which will lead to the break-up of
the firm.
In the forty years I have been in the Industry I
have seen so many small businesses start, grow
and then just fizzle out or implode… simply
because the owners failed to keep a grip on their
costs!
It is all too easy to get in above your heads,
either by convincing yourself that a new expensive
piece of kit is guaranteed to make you money, or
that you will be more respected if you keep a new
van on the road, or that it will make all the
difference if you get out of the garage and into
your own workshop. All of these are great ideas,
but they come at a cost.
It is important before doing any of them to count
the costs first. Just as you should have a rule that
you don't take on a job unless you can afford NOT
to be paid for it, you should also have a rule when
it comes to spending money.
When I purchased my last vehicle, the finance
company paid me £500.00 to take on a 0% hire
purchase loan. It was tempting to use this as an
opportunity to upgrade the vehicle
I was purchasing but, as it was
something I didn’t actually need to
do, I made the decision not to.
Do be careful. It might be a great
idea to rent a new unit to clean
rugs but, if you are only cleaning
one or two a week, you need to
question whether you have put the
correct marketing in place to
increase the volume of work, and whether you can
you afford the down payment and subsequent
rent, rates and associated costs until you finally
make it into profit.
I have a small unit that is part of a group of eight
and in five years I have seen only one company
grow and move to larger premises. Those who'd
made plans to move failed.
McClure Naismith are solicitors. Who would ever
have thought of a solicitor going broke, yet after
nearly two hundred years of continuous trading
this is precisely what has happened.
Never forget that the money you put in the till
isn't your earnings. So, don't use it for buying a
new car, a larger house, or anything else, without
counting the costs first.
Count the costs first! Keith Robertson

James Appleby (Eversheds LLP)
'Self-policing' by the self-employed
Summary
The Health and Safety at Work etc Act 1974
(“HSWA”) imposes a number of broad duties on
employers to ensure the health and safety of
those they come into contact with. This duty
applies equally to public companies, as it does to
smaller operations, including the self-employed.
There is, in fact, a specific provision within Section
3(2) HSWA that requires the self-employed to look
after themselves and to ensure that those they
come into contact with are kept safe.
Following the publication of the Löfstedt report
in 2011, which reviewed aspects of health and
safety enforcement in the UK, there has been a
push to reduce the 'red tape' that applies to those
who are self-employed. This has since culminated
in the Health and Safety at Work etc. Act 1974
(General Duties of Self-Employed Persons)
(Prescribed Undertakings) Regulations 2015 (the
“Regulations”) which brings formal changes in to
law.
The Regulations come into force shortly and
have been heralded by some as being a significant
turning point in the health and safety duties
applicable to the self-employed; representing
another blow to the mythical 'health and safety
dragon'. When we look behind the headlines,
however, the changes may be narrower in scope
than originally anticipated.
For those working in this sector, you need to be
aware of the changes and what they mean for
you.
The Duties
Suggested changes to the Duties
The term 'self-employed' is defined for these
purposes as “an individual who works for gain
otherwise than under a contract of employment”.
The broad health and safety duty, under Section
3(2) HSWA requires every self-employed person to
“conduct his undertaking in such a way as to
ensure, so far as reasonably practicable, that he
and other persons (not being his employees) who
may be affected thereby are not thereby exposed
to risks to their health and safety.”
There is a clear obligation on all self-employed
persons to proactively consider the health and
safety risks associated with their work, and how
they might expose others to harm. Practically, that
may involve planning work (using methods
statements, risk assessments, etc.), investing in
protective equipment, and working with clients
when on third party properties.
A 2011 report sanctioned by the Health and Safety
Executive, carried out by Professor Löfstedt, made
a recommendation that self-employed persons
should be exempt from the broad duty of care (as
it applies to non-employees) where they pose no
potential risk of harm to others through their work
activities.
A list was proposed to capture those activities
that would not benefit from any exemption. This
included:
1. Social care
2. Waste management
page 25 newslink
3. Those involved in any agricultural activity
4. Landscaping
5. Construction work
6. Electrical work
7. Examining and maintaining plant
This proposal was received well by much of the
small business community, due to the potential to
remove the obligations on self-run businesses to
comply with this element of health and safety
legislation, and would have brought the UK's
legislation in line with
much of the rest of
Europe.
The proposals were less
well received by various
safety bodies who raised
concerns around the
impact the changes could
have on standards of
health and safety and
work related accidents.
There was also the potential risk that contractors
and businesses would avoid the use of self-
employed persons for fear of their lack of
accountability for health and safety related
breaches that they may ultimately be responsible
for.
The changes that have been implemented do not
utilise a list of supposedly 'risky' activities. Instead,
it requires the self-employed to assess
themselves, and consider whether their work or
activities “may pose a risk to the health and safety
of another person”. If they will, the normal duties
apply in accordance with the HSWA.
The final changes to the Duties
If there is genuinely no risk to the health and
safety of another person, the duty is lessened by
way of the Regulations. The Health and Safety
Executive's guidance on the changes¹ provides
some examples of activities where the duties will
not apply, such as for an artist making cards or a
baker baking cakes at home, though generally
puts the obligation as to determining whether the
duties apply on the self-employed person
themselves, noting “you must consider the work
you are doing and judge for
yourself if it creates a risk or
not.”
In summary, it is very much
'business as usual' for the
majority of self-employed
persons reading this
publication. There will not
be many instances, giving
the industry and the
environment you are working in, where it can
truly be said that there is no risk to the health and
safety of others.
In any event, even if the broad HSWA duty is
lessened, this does not allow a self-employed
person to ignore any client health and safety
requirements, their insurance conditions and the
financial and moral benefits to keeping people
safe.
