The 14th Amendment

“No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws…”

Waite quoted Marshall:

“The framers did not intend to restrain states in the regulation of their civil institutions, adopted for internal government, and…the instrument they have given us is not to be so construed.”

Santa Clara decision 1886

To Judge Waite from John CB Davis, May 25, 1886:

‘The court stated that it did not wish to hear argument on the question whether the 14th Amendment applies to such corporations as are parties in these suits…. All the judges were of the opinion that it does.’

Reply From Judge Waite to Court Reporter Davis:

“I leave it to you to determine whether anything need be said about it in the report, inasmuch as we avoided meeting the constitutional question in the decision.”
