    Finance minister Arun Jaitley takes his new responsibility seriously. He has literally ad-

    opted the secrecy requirements of his budgeting exercise in spirit as there are hardly any letters about it.

    It is part of North Block lore to bar the media from entering the finance ministry headquarters a couple of months ahead of the budget presenta-tion in normal course. Hence, by De-cember, the finance ministry scribes entry into North Block are forbidden. This unwritten code is accepted by both sides although those who cover the finance ministry for the media en-joy fairly comfortable bonhomie with the ministry mandarins.

    But now Jaitley has hit upon a nov-el though rather discomforting idea for communicating with the media, in times of a gag. He calls press meets

    informally these days and addresses media persons outside the North Block buildings. This serves a dual purpose: he could convey what he wants to say, but the scribes do not enter the build-ing. The first time that he adopted this method of communication was to an-nounce the extension of duty conces-sions on motor cars and machines re-cently.

    There was, however, a little snag: these informal meets were held right under the blazing Delhi sun. That must

    have been uncomfortable for Jaitley who emerged out of the cold confines of his office. But it must have been even more so for the media persons who came well in advance of the ministers presence. For the television reporters and crew, the task of putting up their gadgets and waiting was even harder.

    Jaitley called another such meet on Friday. Now this was taking things too far. North Block is a cavernous build-ing having innumerable rooms and

    meeting spaces. There are conference halls even on the ground floor where the finance minister meets represen-tatives of chambers of commerce and other interest groups for consulta-tions in preparing the budget. They are herded into the rooms and then carefully shepherded out. The minister could have met the scribes in any such place, but the minister possibly consid-ered the media a more sinister threat. He might have considered putting up a shamiana at a preferred point outside

    North Block! And there was still another way out.

    The finance minister could have been more considerate to himself as well as to his interlocutors. He could have uti-lised the spanking new National Media Centre (NMC), not very far from his North Block headquarters. The NMC now houses the Press Information Bu-reau (PIB) of the Government of India, which is the official arm for interaction with the media. It is imaginatively con-

    structed and centrally air-conditioned unlike the old Shastri Bhavan, which is like any other old government build-ing.

    Jaitley addressing the media from the new NMC could have another im-port. If nothing else has changed in the government in the aftermath of the NDAs huge victory, at least one signif-icant difference was found at the NMC. An inscription on the plaque in front of the NMC building informed that the new press centre was inaugurated by

    Smt Sonia Gandhi in the presence of Prime Minister Dr Manmohan Singh. With the new government taking charge, the plaque was immediately taken down and it has since been re-placed by another similar black gran-ite plaque announcing that the foun-dation stone of the building was laid by Shri Atal Bihari Vajpayee. Jaitley could perhaps have taken advantage of what his BJP predecessors in govern-ment had achieved.

    We are constantly bombarded with news about women and children caught in the middle of bloody con-flicts, from the Central African Repub-lic to Syria. What is more, even when the talk is about accidents or natural disasters, and not purposefully inflict-ed violence, women and children are always high on the media agenda.

    We watch their victimised faces on TV, post pictures of them crying on the front covers of magazines and online, and learn that they have to be protect-ed, rescued and always evacuated first out of sinking ships and besieged cities alike, before the other, stronger repre-sentatives of the human race can fol-low suit. But what does this expression women and children really mean?

    Well, women and children are the more vulnerable members of our soci-ety, a well-intentioned person would retort. It is only natural that they are protected and rescued first. But is this link between women and children all that natural? If we meant to identify those who are more helpless in the face of calamities, wouldnt it make more sense to allude, apart from children, to the infirm and the elderly?

    This is not to deny the terrible toll that armed conflicts levy on girls and women, especially in the form of sexual

    violence, as a weapon of war. Regretta-bly, in many countries, women are still the preferred targets of aggression, a situation that tends to be exacerbated once organised society starts to dis-integrate. But the same could be said about gay men, as the recent wave of homophobia in sub-Saharan countries such as Uganda has demonstrated.

    Inside Syria - The female factorPerhaps, our spokesperson for

    common sense would add, the reason for associating women and children is that infants cannot take care of them-selves. Children are unable to escape dangerous areas alone and therefore need to be accompanied by their moth-ers.

    There are a number of flaws in this line of argumentation. First, why dont we say mothers and children if they are really the ones intended? Second, could infants not leave with their fa-thers, grandparents or other family members? Why do we assume that the task of caretaking automatically falls on mothers? What if women wanted to stay on in a disaster zone and help with the rescue efforts or fight alongside men in a war, as many have actually done?

    The persistent connection between women and children harks back to tra-ditional views on social roles, accord-ing to which women are perceived as

    belonging in the private sphere and, therefore, as being less able to fend for themselves in the public domain than men. This cultural conception lies at the root of the large pay gap between men and women performing the same jobs, even in the so-called developed world.

    Women are associated with chil-dren because they are, in fact, regarded as children. They are presented as in-fantilised creatures in need of constant protection. Deemed too immature to make their own decisions, they are au-tomatically removed from dangerous areas. Their evacuation from the the-atres of devastation and war goes hand in hand with the evisceration of their political agency.

    But the emphasis on safeguard-ing women and children has yet another disturbing implication. If children represent the promise of renewal in the face of a catastrophe, women stand for the possibility of begetting more children. While their minds are considered unfit to make rational choices and to par-ticipate alongside men in rescue and war operations, their bodies are saved as potential bearers of the new generation.

    This way of thinking is responsible for the reluctance of many to allow women to join the armed forces and, es-

    pecially, to participate in combat situa-tions. In a context where technological skill has become at least as important as raw physical strength, there is no reason why women should be banned from the front line. Yet, the idea of womens bodies being mutilated in war still appears to be much more shocking than the more common scenario of in-jured male veterans.

    It is unclear why many media out-lets still use the expression women and children when reporting on disasters and war zones and why politicians from all sides of the political spectrum continue to talk about the need to de-fend women and children from vio-lence. Are we just thoughtlessly repro-ducing cultural stereotypes inherited from the past? Or does our language simply reflect the sad, everyday reality of gender discrimination?

    Be this as it may, with a steady stream of conflicts and other disasters, which unfortunately does not show signs of abating, it is high time we ad-opted a more gender-neutral approach. Why should only women and children be shielded from harm and not every-one else? What about protecting, first of all, vulnerable adults and children instead?

    OnJune 20, two respected NGOs released a list of 53 of the 541 MPs recently elect-ed to the Lok Sabha against whom charges have been framed in criminal

    courts. As many as 24 are from the rul-ing Bharatiya Janata Party. If convict-ed they will be disqualified. They need not lose sleep. The average pendency of criminal cases is 10 years.

    If anything, the figures err on the side of caution. For, on May 19, In-dian Express carried a report which said that as many as 186 of the newly elected MPs had criminal cases pend-ing against them in the courts; while 112 faced serious criminal cases. The serious charges are murder, attempt to murder, kidnapping, crimes against women and disturbing communal har-mony.

    Presumption of innocence till ad-judged guilty is a fundamental of our

    jurisprudence. However, what late Indian chief justice Mohammad Hi-dayatullah said in a case before the Supreme Court is as relevant now as it was 45 years ago and as applicable to legislators as to ministers. It can-not be stated sufficiently strongly that the public life of persons in authority must never admit of such charges be-ing even framed against them.

    There is another aspect suggesting a deeper malaise. B.K. Nehru of the Punjab cadre of the Indian Civil Ser-vice, put his finger on the spot when he said, The new entrants into politi-cal life are, by and large, not men who are interested in policy They are in the legislatures in the pursuit of power and they pursue power not only for its intoxication, but for the pelf that is the accompaniment of power.

    It is interesting that in one par-ticular state no less than 30pc of the leg-islators are involved in criminal cas-es.... The aim is to become a minister; but opportunities for private gain are not limited to ministers alone; these are available in plenty to all members of the legislatures.

    Nehru was speaking in 1981 of the malaise in the states. Already by then it had spread to New Delhi which brings us to another disturbing feature high-lighted by the Indian Express report;

    namely the enormous affluence of some MPs in the Lok Sabha. A report of the Association for Democratic Reforms shows the average assets of crorepatis in the soon-to-be constituted Lok Sabha is Rs14.61 crores which translates into a total of Rs6,500 crores.

    Of them, 237 crorepatis belong to the ruling BJP; 35 to the Congress; 29 to the All India Anna Dravida Munnetra Ka-zhagam of Tamil Nadu and 21 to West Bengals Trinamool Congress.

    These salutary disclosures were made possible by the Supreme Courts order in 2002, calling for the disclosure on a sworn affidavit by all candidates for election to the legislatures, of con-victions, pending criminal cases, as-sets and educational qualifications. The law was amended to compel disclo-sure of assets.

    These problems were not absent

    from the minds of the framers of In-dias constitution. Dr B.R. Ambedkar discussed both, the law-breaking legis-lator and the inexplicably affluent one. But his approach was superficial.

    He said in December 1948: I think it would be too shameful an imputation to the people of this country to say that it is necessary to make an express pro-vision of this sort in the constitution because the people of this country are likely to elect persons who are crimi-nals, who have committed breach of

    trust and who have failed the public in the performance of their public duties.

    I think these weaknesses are inher-ent in all societies and no good purpose will be served by advertising them by putting them in the constitution.

    He ignored the fact that while a con-victed person could not stand for elec-tions, one whose conduct has invited grave charges was free to do so. It is only persons against whom charges are actually framed by a court of law in respect of specified grave charges who should be disqualified. In law, charges of criminal offences are framed only if the court is satisfied that a prima facie case exists. The law cries for amend-ment on these lines.

    On Dec 31 1948, Dr Ambedkar said that to be effective the law should re-quire such a declaration at the end of the tenure as well, and a legal obliga-

    tion to explain if the increase is ab-normal enough to arouse suspicion. Failure to explain would be an offence followed up by a penalty or by a fine. Unfortunately, he not only refused to pursue this suggestion but ridiculed it.

    The whole thing is simply good for nothing, so to say. It might still be possible, notwithstanding this amend-ment, for the minister to arrange the transfer of his assets during the period in such a manner that nobody might be able to know what he has done.

    Modis JK visit and Omars wishful thinkingThough announcement of some policy state-ment over Kashmir issue was expected from Prime Minister Narendra Modis during

    his first visit to Jammu and Kashmir this week, but he belied expectations by not uttering even a single word over either internal or external Confidence Building Measures (CBMs) over Kashmir issue. As expected he did not bother to go beyond the agenda of inaugurating two development projects, one in the Kashmir Valley and the other one in Jammu region. Since some measures were taken to give a fillip to

    cross LoC trade in recent day , Prime Minister was expected to make some remark over the future of such measures but he choose to remain silent over this issue also. Knowing that barely 3-4 months are

    left for the commencement of the assembly elections in the state , Prime Minister did not want to give concessions to Omar Abdullah government of which Congress is a major ally. Interestingly days before the Prime Ministers maiden visit to the state Chief minister Omar Abdullah, allayed the fears of Naren-dra Modi having a political agenda behind the visit and went on record to say that he has no wish list for the Prime minister but would expect him to give the state what it deserves as a matter of right. Keeping in view the treatment meted out to the state during the reigns of non BJP central governments hoping for what is a matter of right is just a wishful think-ing. Had Omar Abdullahs remark not been a wishful thinking Prime Minister Narendra Modi had enough reasons to talk atleast about Prime Ministers Recon-struction Plan (PMRP) which he has already prom-ised to continue in the state. By not going beyond the simple brief of the inaugurals Prime Minister Nar-endra Modi has conveyed the message that he would like to work with the new government in Jammu & Kashmir than to give any concessions political or apolitical, to Omar Abdullah Governmnt of which Congress is a major ally.He did not want to make usu-al frilly statements, which are not implemented on the ground later. This time he did not even reiterate the slogan of Kashmiriyat, Jamhooriyat and Insani-yaat floated by former Prime Minister Attal Bihari Vajpayee for addressing the political dimensions of Kashmir issue.. So one can only wish for things that should not be part of his suitcase during his future visits to Jammu and Kashmir. He must be know-ing that the visits of Prime Ministers have always aroused suspicions in Kashmir Valley in the past and so he should not allow that to happen as Prime Minis-ter of the country.People in Kashmir are well aware about the BJPs stated position on the Kashmir issue surrounding the controversy over Article 370 and they know it better than any one else that BJP plans to create an explosive situation in the upcoming as-sembly in this sensitive border state. Article 370 has figured in Modis own rally in Jammu during his pre-election campaign and BJP will try its best to raise emotions of the people over the issue in the upcom-ing assembly elections. Though It would be in the larger interests of the peace and political stability of Jammu & Kashmir state if Prime Minister Narendra Modi tries to remove the misgivings by spelling out the broad contours of the policy over Kashmir but ev-ery one knows he has his own compulsion. So Omar Abdullahs remark was just wishful thinking noth-ing else.

    It is notified for the information of all the concerned that the Type test of the candidates on Computer Key Board, who have applied for the post of Junior Assistant (Revenue/ Power Dev./ Education/ Ind. & Com Department) District Cadre Doda and (Cooperative/ Forest (Fisheries)/ Revenue/ Transport/ Ind. & Com./ Education Department) District Cadre Kishtwar, under Item No 364 and 374, advertised vide Notification No 03 of 2012 dated 28-12-2012, shall be conducted w.e.f 15th of July 2014 onwards at NIELIT Jammu (An Institution Under Ministry of Communications & Information Technology, Govt of India), New University Campus, University of Jammu, as per the schedule annexed as Annexure A and B to this notification (Alphabetically. 1. A complete list of the candidates is also available on the Official website of the Board i.e www.jkssb.nic.in and in the office of the Administrative Officer, J&K Services Selection Board, Opposite B.S.F Paloura, Jammu, for the information of intending candidates.2. The candidate shall have to produce all original certificates / testimonials before the responsible official of the Board, failing which he/she will lose the right to sit in the Type Test. A photocopy of each such certificate duly attested by the Gazetted Officer with his / her seal and signature of the officer and self attested by the candidate shall be deposited with the Staff. Further, in case of any deficiency with reference to eligibility is proved, the candidate shall not be considered for selection and will be treated as ineligible and disqualified accordingly.3. Any candidate found guilty of impersonating or submitting fabricated / tampered documents / testimonials or making false, incorrect or suppressing material information shall render him / her liable for criminal prosecution under law and may be debarred permanently or for a specific period for consideration of any or all recruitments made by the Board. Also canvassing / lobbying in any form will entail disqualification of the candidate(s).4.
