Srinagar, June 5: In a defamation suit filed by chairman Hurriyat Conference (G), Syed Ali Geelani, a lower Court here has summoned the three officials of “Times of India” including its managing director with a direction for their per- sonal appearance before the court here on June 16. Geelani had filed a defamation suit against the Delhi based newspaper after a news report appeared in it on 14 March 2014 in wherein it was mentioned that “Geelani has nominated his son as his successor and when Geelani was leaving to New Delhi for treatment on 13 March 2014, he was driven to the tarmac and taken towards the aircraft on a wheel chair but the 84 year old leader surpris- ingly climbed up the stairs of the plane without any support”. According to a statement issued to KNS by Hurriyat (G) spokesman said that on behalf of Geelani his counsels Advocate M. Shafi Reshi and Advocate Sadiq Par- ray had filed a defamation suit before the Judicial Magistrate first class sub registrar Srinagar against the said news paper. When the court asked for Geelani to record his statement, it was told that he is under house arrest and the police are not allowing him to move out of his home due to which he can’t attend the court hearing. After hearing this, the concerned Judge ordered DC Srinagar to record the statement of Geelani at his residence. DC Srinagar appointed Tehsildar South for this and the government officer came to Hyderpora and recorded a detailed statement of Geelani. According to the spokesman when the statement of Geelani was presented in the court by the administration, the Judge after having its detailed examina- tion, issued summons to the managing Director of the newspaper Veniet Jain, Editor Jay Deep Bose and its Srinagar correspondent Saleem Pandit and the three officials have been ordered to pres- ent themselves before the court on June 16, 2014. Srinagar, Jun 5 : The state gov- ernment is likely to lift the ban it imposed earlier on the news aired on cable channels in valley with the talks expected between the government and channel owners in the near future. According to the reports received by KNS, the government here imposed the ban on news shows that used to be aired via local ca- ble networks during the alleged Shopian rape case in 2009. After a year, a complete ban on news telecast was imposed by the state authorities with the reason that the content telecasted is threat to law and order and could disrupt the situation. The opposition Peoples’ Demo- cratic Party (PDP) while slam- ming the state authorities over imposing curbs on the channels questioned the reason behind al- lowing the channels to telecast the news in Jammu region. Sev- eral legislators of the party in the past while raising the issue of ban on local news in valley asked the government to lift the same at an earliest. The government later swung into action and decided to review the ban. The then divisional commis- sioner Kashmir Asgar Samoon had in the year 2012 asked the district authorities to prepare a detailed report over the curbs on local news in Kashmir. Sources privy to this development stat- ed that the decision was kept in abeyance due to some other pri- orities of the state authorities and also the reluctance of some coun- cil of ministers in lifting the ban. After the recent debacle in the LS polls in the state, the coalition headed by chief minister Omar Abdullah has taken serious note of the reasons behind his party’s rout. He also asked for the sug- gestions from the masses, asking them to inform him what went wrong and where. Omar later lifted the ban on SMS facility and also scrapped the new job policy of the youth. Ironically, journalism is taught at just two colleges in the val- ley-GDC Baramulla and Govern- ment College for Women, MA Road, Srinagar and not even a single faculty member is perma- nent. While the departments face se- vere dearth of teaching faculty, the Higher Education Depart- ment in its recently advertised posts have called applications for only six posts among which three posts are reserved under various categories. “There are nearly 25 eligible as- pirants to teach journalism at higher education level but none of them belong to the category of any sort so the problem will per- sist as most of the posts will re- main vacant,” said a contractual faculty member at one of these colleges. Lack of permanent faculty is hampering education at these colleges as contractual faculty members have limited mandate to take major academic deci- sions. “Our teachers are well qualified in their subjects, but irony is that they are not able to take de- cisions for our benefit on their own. They have to consult pro- fessors from other departments on minor issues. How can pro- fessors from other departments understand basic requirements of journalism course,” said an- other faculty member. The Huriyat (G) stated that the “attempt to change the demog- raphy” will be strongly opposed and that the conglomerate will come up with its detailed stand vis-à-vis this issue in the near future. “We are keenly moni- toring the situation and also the reports that are coming up over providing permanent set- tlement to the Pak refugees in Jammu region,” said Huriyat (G) chief spokesman Ayaz Ak- bar. He further told KNS that the amalgam is preparing a ground report and the same shall be presented before the people of Kashmir in a near future. “This is for sure that we will not allow anyone to fiddle with the demography of Jammu and Kashmir,” remarked Akbar. Pertinently, the reports in the recent past came to fore that Government of India (GOI) has asked its Intelligence agencies to conduct detailed survey of all the refugees including their numbers, families, localities inhabited by them and their de- mands for which they had been ‘struggling for years together but never got any justice from the successive Governments ex- cept for the assurances. Srinagar, Jun 5 : Reacting sharply to the reports that the Government of India is plan-ning to make major announce-ments for West Pak, PAK, Chhamb refugees presently staying in Jammu, the Huri-yat Conference (G) led by Syed Ali Geelani Thursday stated that the amalgam will come up with its stand on the issue and ‘will oppose any settlement pro-grammes vehemently’.The Huriyat (G) stated that the “attempt to change the demog-raphy” will be strongly opposed and that the conglomerate will come up with its detailed stand vis-à-vis this issue in the near future. “We are keenly moni-toring the situation and also the reports that are coming up over providing permanent set-tlement to the Pak refugees in Jammu region,” said Huriyat (G) chief spokesman Ayaz Ak-bar.He further told KNS that the amalgam is preparing a ground report and the same shall be presented before the people of Kashmir in a near future. “This is for sure that we will not allow anyone to fiddle with the demography of Jammu and

LoC in Poonch Poonch, June 05: A Leopard was found dead in forest area, near the Line of Control in Poonch district of Jammu and Kashmir on Thursday. Sources said some villagers saw body of full grown Leopard lying in the bushes in Pattri forest area of Mendhar in the district and informed forest and police offi-cials. The officials rushed to the spot and shift-ed the body of the leopard to Mendhar where postmortem of Leopard was conduct-ed by the Veterinary doctors in presence of Tehsildar. Four more persons sus-pected of having links with a Hindu outfit have been arrested in connection with the murder of a 28-year-old Pune IT professional, the police said.With the fresh arrests made late last night, a total of 17 people have been arrested in the case involving the murder of Shaikh Mohasin Sadiq in Bankar Colony in Hadapsar area of the city on Monday night.

The arrested are said to be linked to Hindu Rashtra Sena, a right wing organ-isation.Thirteen persons, earlier arrested by police in this connection, have been booked for murder, attempt to murder and rioting.

Shaikh, a resident of sub-urban Hadapsar, was alleg-edly beaten to death with hockey sticks on Monday

night, when he was return-ing to his home at Bankar colony.The trigger for the attack was apparently up-loading of derogatory pic-tures of warrior king Shivaji and late Shiv Sena supremo Bal Thackeray on Facebook, which led to a protest, po-lice said.While the situation in the area has remained peaceful since Tuesday with heavy deployment of secu-rity force, Pune police com-missioner Satish Mathur said stringent provisions of Maharashtra Prevention of Dangerous Activities Act (MPDA) would be invoked to book the miscreants sus-pected of involvement in inciting violence.

All the po-litical parties now have to talk and debate on this is-sue and as soon as the Par-liament session starts there will be a debate about the rising crimes against wom-en and law and order situ-ation in the state,” Bharti told reporters outside Par-liament.

The Minister went around the shrine complex and directed the officers to ensure that devotees do not face any sort of inconvenience.

The temple complex has been constructed at a cost of Rs. 16 crore, having 64 one-room sets, one prayer hall, 2 langars and 2 dining-halls, besides 64 bathrooms. The complex is also fitted with sewer-

age treatment plant and a 40-KW generator set.

The Minister stressed upon the officers to work with mission-

ary spirit and proper coordination so that all possible facilities are made available to the devotees dur-ing Mela days at the Ashthapan. He directed the concerned authorities to ensure cleanliness in and around of the Bhawan besides making all toilets temporarily functional.

of various facilities for the visiting devotees at the various pilgrimage sites of the state. He said reforma-tive initiatives are under way to upgrade the boarding and lodging facilities at pilgrimage sites for the convenience of the devotees.

The global warming has put a question mark on the very existence of human life as the ecological imbalance

worldwide has drastically tilt-ed towards those factors which are the basis of increasing dan-gers to life, may it be human, wild, or aquatic. The climate has changed in such a way that unprecedented long spells of winters and summers are expe-rienced in every nook and cor-ner of the universe. The flora and fauna are endangered be-cause the forest cover has been reduced to less than one fourth and cold deserts have emerged thus making the life of living things impossible. The hu-man greed has resulted in con-cretization of green belts. The colony after colony has come into existence due to increase in the population. It is a pity that we are celebrating Forest Preservation Day, Ecological day, Earth day, Environment Day and all sorts of days but without doing anything which would help in preservation of our environment and save all kinds of life from extinction. Seminars, symposium, ral-lies, can help in creating some kind of awareness but it is the human greed, designs, expan-sionist instincts which have to be curbed so that we may not face the worst condition than what we are facing today. For this purpose, it is a person or a society itself which can incul-cate this kind of spirit and re-solve to do everything which helps in the preservation of nature. No external force, mo-tivation or persuasion can help better than what an indi-vidual or group of individuals can do. We are not responsible for ourselves only but the re-sponsibility of future genera-tion lies on our shoulders. We have to commit ourselves in a way that the future generation will be proud of us and they may not feel let down from what we did with the environ-ment. It is individual as well as collective responsibility of different societies to become pro-active and without wast-ing time to go all out for in preservation of our environ-ment. At least if not more, we can plant more trees, devel-op green belts, save our wa-ter-bodies from pollution and avoid polluting air which is be-coming poisonous for us with every passing day.

Environment Protection under Constitutional Framework of India

he constitution of India is not an inert but a liv-ing document which evolves and grows with time. The specific provisions on environment protection in the constitution are also result of this evolving nature and growth potential of the fundamental law of the land. The preamble to our constitution ensures socialist pattern of the so-ciety and dignity of the individual. Decent stan-dard of living and pollution free environment is inherent in this. The Environment (Protection) Act, 1986 defines environment as “environment includes water, air and land and the interrela-tionship which exists among and between air, water and land and human beings, other living creatures, plants, micro-organism and proper-ty”. The chapter on fundamental duties of the Indian Constitution clearly imposes duty on ev-ery citizen to protect environment. Article 51-A (g), says that “It shall be duty of every citizen of India to protect and improve the natural envi-ronment including forests, lakes, rivers and wild life and to have compassion for living creatures.” The Directive principles under the Indian constitution directed towards ideals of building welfare state. Healthy environment is also one of the elements of welfare state. Article 47 pro-vides that the State shall regard the raising of the level of nutrition and the standard of living of its people and the improvement of public health as among its primary duties. The improvement of public health also includes the protection and im-provement of environment without which public health cannot be assured. Article 48 deals with organization of agriculture and animal husband-ry. It directs the State to take steps to organize agriculture and animal husbandry on modern and scientific lines. In particular, it should take steps for preserving and improving the breeds and prohibiting the slaughter of cows and calves and other milch and draught cattle. Article 48 -A of the constitution says that “the state shall en-deavor to protect and improve the environment and to safeguard the forests and wild life of the country”. The Constitution of India under part III guarantees fundamental rights which are essen-tial for the development of every individual and

to which a person is inherently entitled by virtue of being human alone. Right to environment is also a right without which development of indi-vidual and realisation of his or her full potential shall not be possible. Articles 21, 14 and 19 of this part have been used for environmental protec-tion. According to Article 21 of the constitu-tion, “no person shall be deprived of his life or personal liberty except according to procedure established by law”. Article 21 has received liber-al interpretation from time to time after the deci-sion of the Supreme Court in Maneka Gandhi vs. Union of India, (AIR 1978 SC 597). Article 21 guar-antees fundamental right to life. Right to envi-ronment, free of danger of disease and infection is inherent in it. Right to healthy environment is important attribute of right to live with human dignity. The right to live in a healthy environ-ment as part of Article 21 of the Constitution was first recognized in the case of Rural Liti-gation and Entitlement Kendra vs. State, AIR 1988 SC 2187 (Popularly known as Dehradun Quarrying Case). It is the first case of this kind in India, involving issues relating to environ-ment and ecological balance in which Supreme Court directed to stop the excavation (illegal mining) under the Environment (Protection) Act, 1986. In M.C. Mehta vs. Union of India, AIR 1987 SC 1086 the Supreme Court treated the right to live in pollution free environment as a part of fundamental right to life under Article 21 of the Constitution. Excessive noise creates pollution in the society. The constitution of India under Article 19 (1) (a) read with Article 21 of the constitution guarantees right to decent environment and right to live peacefully. In PA Jacob vs. The Su-perintendent of Police Kottayam, AIR 1993 Ker 1, the Kerala High Court held that freedom of speech under article 19 (1)(a) does not include freedom to use loud speakers or sound amplifi-ers. Thus, noise pollution caused by the loud speakers can be controlled under article 19 (1) (a) of the constitution. Article 19 (1) (g) of the Indian constitution confers fundamental right on every citizen to practice any profession or to carry on any oc-

cupation, trade or business. This is subject to reasonable restrictions. A citizen cannot carry on business activity, if it is health hazards to the society or general public. Thus safeguards for environment protection are inherent in this. The Supreme Court, while deciding the matter relating to carrying on trade of liquor in Cooverjee B. Bharucha Vs Excise commis-sioner, Ajmer (1954, SC 220) observed that, if there is clash between environmental protec-tion and right to freedom of trade and occupa-tion, the courts have to balance environmental interests with the fundamental rights to carry on any occupations. Public Interest Litigation under Ar-ticle 32 and 226 of the constitution of India re-sulted in a wave of environmental litigation. The leading environmental cases decided by the Supreme Court includes case of closure of limestone quarries in the Dehradun region (Dehradun Quarrying case, AIR 1985 SC 652), the installation of safeguard at a chlorine plant in Delhi (M.C. Mehta V. Union of India, AIR 1988 SC 1037) etc. In Vellore Citizens Welfare Forum vs. Union of India (1996) 5 SCC 647, the Court observed that “the Precautionary Prin-ciple” and “the Polluter Pays Principle” are es-sential features of “Sustainable Development.” At local and village level also, Panchayats have been empowered under the constitution to take measures such as soil conservation, wa-ter management, forestry and protection of the environment and promotion of ecological aspect. Environment protection is part of our cultural values and traditions. In Atharvaveda, it has been said that “Man’s paradise is on earth; this living world is the beloved place of all; It has the blessings of nature’s bounties; live in a lovely spirit”. Earth is our paradise and it is our duty to protect our paradise. The constitution of India embodies the framework of protection and pres-ervation of nature without which life cannot be enjoyed. The knowledge of constitutional provi-sions regarding environment protection is need of the day to bring greater public participation, environmental awareness, environmental edu-cation and sensitize the people to preserve ecol-ogy and environment.

This day is primarily devot-ed to implement United Nations recom-mendations on clean drinking water, sustain safe drinking water facilities, conservation of water, sustaining fresh water bodies and to promote concrete activities within the countries regard-ing the world's fresh water resources. International World Water Day tries to remind people about the significance of fresh water and to promote sustainabil-ity for fresh water resources. Organi-zations all around the world use World Water day to promote awareness about clean water and sustainable aquatic habitats. Also as a day to focus public attention on the critical water issues of the present era.Moving towards Indian scenario, the country receives abundant amount of rain, but factors like increase in popu-lation, is among the main reasons of wa-ter scarcity to the country. Due to pop-ulation increase, natural resources are consumed more. A large number of wa-ter bodies local ponds, lakes, rivers and reservoirs get polluted and depleted. At

present a considerable amount of water of the country's population lack access to safe drinking water. Also, Indian ag-riculture is rain fed. The goals and suc-cess of agriculture in India are based on availability of water, mostly rain water. Good amount of rain means a good crop harvest. Preserving rain water is must and ensuring that almost no toxic mate-rial present should get mixed with rain water, which can eventually pollute it as well as the water body in which it eventually flows.In the light of the above, it is a general understanding that, there is a need of water conservation in the country and the major issues with regard to water usage in India can be summed up as under:-1. Every year, The World Water Day em-phasizes on a different aspect of fresh-water. This year the theme of the World Water Day is Water and Energy. As wa-ter and energy are related to each other and both are necessary for the survival of our planet. To generate energy par-ticularly hydro electric and thermal power we need water resources.In order to keep the water and energy relationship alive, an emphasis needs to be placed on increasing the water conservation and to preserve the natu-ral water bodies for energy production today as well as in future. There is also a need to increase the efficiency of wa-ter with regard to energy production.

To produce energy water is required and to provide water you need energy. Due to this inter-connection between water and energy, deficiency of any of the two creates problem for the other. If water resources, meant for the produc-tion of electricity get depleted, it will certainly cause a decrease in electricity generation. At present there is a tre-mendous need for appliances which are energy efficient, if appliances are able to save electric energy, it in turn means they are saving water.Many of us may think as to what an individual can do to conserve water, and this thinking of many of us leads to wastage of water daily. In today's world we are in a rat race to construct big house with lavish bathrooms, but we forget to think that without water they are useless. We go on using water more than what is required to us. We as individuals can at least use water in a proper manner in our homes and places of work.Many a times, water taps on road sides, are seen running and water is wasted, we pass without bothering to close it. We should think on these is-sues and try to conserve water in what-ever way it is possible for us in our daily life. Use of electricity should also be limited to our need and not want; electric appliances should be used only when needed.One bulb will give us enough light, so what is the need to switch on multiple lights. We should make sure to mini-mize switching on lights and other elec-tric appliances unnecessarily any time. With this we shall not only be able to conserve electricity but in turn we will also conserve water.
