West Goshen is the second-largesttownship in the county in population, be-hind Tredyffrin, which has an estimated29,457 residents.

According to the data, nearly threequarters (74.0 percent) of the growth inthe state's population since 2010 can beattributed to townships. From 2010 to2012, the population of its 1,547 town-ships grew from 7,098,888 to 7,143,594.

Cities also experienced growth overthe time period., gaining 17,313 people, or28.3 percent.

Meanwhile, the state's boroughsshowed a decline of 2.3 percent.

In Chester County, boroughs increasedin population overall, rising by 970 resi-dents, or an increase of 12.6 percent.

Leading the way was West Chester, thecounty seat, which added 396 residents,making it the third-fastest growing boroughin the state, behind Mount Joy in Lancaster.

Avondale added 125 residents, fol-lowed by Phoenixville with 78, Elversonwith 54, and Kennett Square with 41.

Only Modena failed to add new residents,losing one person in the census estimates.

West, Chester Borough Manager Er-nie McNeely said the growth in popula-tion was most likely attributable to thedevelopment of two new townhousedevelopments, one on the former Bish-op Shanahan High School property onWest Gay Street, and the other on theformer Hoffman Lumber Yard site onSouth Franklin Street.

McNeely said that rather than bring mu-nicipal challenges to the borough, the popu-lation increase has been a benefit, as the newresidents pay earned-income taxes into itsbudget. "Those are working folks paying tax-es that contribute to the borough," he said.

In addition, the developments do notrequire the borough to add to its existing in-frastructure the way township developmentmight.

Meanwhile, townships are having togauge how best to handle the new popula-tion. Michael Lynch, township managerin East Bradford, said .his municipal lead-ers had been able to stabilize growth insome part by purchasing open space anddevelopment rights of acres of undevel-oped land in the township.

Conrail responds toa Paulsboro lawsuitRailroad companies maintain they should be exemptfrom strict liability in derailment damages, injuries.

Conrail and its parent compa-nies, in a substantive response toone of a flood of lawsuits filedagainst them after the Novembertrain derailment and chemicalleak in Paulsboro, maintain thatthey are "exempt from strict liabili-ty" for injuries and damages be-cause they are common carrierslegally obliged to transport hazard-ous freight.

The companies filed the re-sponse last Wednesday in theCourt of Common Pleas in. Phila-delphia, where Conrail has itsheadquarters.

The strict standard of liabilityholds that the defendant is legallyresponsible for injuries regardlessof intent or carelessness.

"The logic is, if you choose to,say, use dynamite in a construc-tion project, you ought to be ableto bear the risk that you injuresomeone. Common carriers don'thave that choice," said Jay M. Fein-man, a professor at the Rutgers-Camden School of Law. '"By law,they have 'to accept shipmentsfrom anybody who pays thefreight."

Some courts have departedfrom that rule, he said.

The suit, filed May 2 by 20 Pauls-boro and Westville residents in thePhiladelphia Court of CommonPleas, seeks compensatory and pu-nitive damages, as well as medicalmonitoring to detect health risksrelated to significant exposure tothe toxic chemical vinyl chloride.

•The Railroad' Defendants en-gaged in an abnormally dangerousactivity ... in a manner the Rail-road Defendants knew to be dan-gerous and without taking properprecautions," the suit alleges.

It adds that the railroad compa-nies' "willful and reckless con-duct" caused the derailment andsubsequent spill of vinyl chloride.

The plaintiffs are representedby the Philadelphia firm-Messa &Associates.

Nearly 700 residents. had toleave Paulsboro, some for weeks,after a freight train derailed off anautomated drawbridge, sendingfour tanker cars into MantuaCreek and releasing thousands ofgallons of hazardous vinyl chlorideinto the atmosphere.

In their response, Conrail, Nor-folk Southern Railway Co., andCSX Týansportation Inc. arguethat the complaint "does not con-tain factual allegations showingthat Plaintiffs suffered any signifi-cant exposure to vinyl chloride,that such an exposure would putany specific plaintiff, at a signifi-cantly increased risk of developingany specific disease, or that a rea-sonable and effective medical-mon-itoring regimen exists for that dis-ease."

The response does not addressthe charge of negligence. At least adozen lawsuits have been filedagainst Conrail in relation to thetrain derailment.

In an earlier response to a sepa-rate lawsuit, filed by more than 50Paulsboro residents in the Court ofCommon Pleas, -Conrail deniedthat there was a massive spill ofvinyl chloride as a result of thecollapse of the East JeffersonStreet Bridge.

That response, filed in Decem-ber, attributes any injuries sus-tained by the plaintiffs to their"own negligence."

'The bottom line is, if they're notheld strictly liable, they were al-most certainly negligent andthey'll be held liable for negli-gence," said Mark R. Cuker, an at-torney representing plaintiffs inthe December suit.

His suit, which seeks medicalmonitoring and compensatory andpunitive damages, does not holdConrail to the strict liability stan-dard.
