'I t has been also agreed that the man named• Emmanuel be confirmed in his position as hospital. attendant with a salary of 500 livres per year,

payable in piastres, and his board, lodging,heating, lighting, and his washing for hill1Selfand wife as it is specified in the register with­out being entitled to any further claims.

In the third article it is stated that the saidinstitution is in need of 200 posts to build acabin, a store room, and a pantry. Mr. Foucault,presently gi ve s an order to supply tho said postsfrom those in stock used for fences around thecity. Mr. Dreux obligates himself to supply,free of charge, ~~lvo rafters twenty-two feetlong; Mr. Foucault promises ' t o gi ve a ceNT andits calf, to supply the foundlings with theirnourishment.

Taking up t he article concerning the cabarets andthe taxes on games, the board postponed its de­liberations thereon.

After deliberating upon the exchange of the lotand home, situated on Chartres Street belonging tothe Almshouse, and the house and lot on ContiStreet belonging to Mr. Cheloc, the Board authorizesthe administrators to exchange the properties underthe condition that the said Andre Cheloc will notbe reimbursed by the Almshouse for any repairs al­ready made by him to the said house, and that hewill also supply two hundred fifty cords of woodper year, during three years, the said wood to becarted to the Almshouse or to any other placedesignated.

Considering the promissoly note of Mr. lasize,the Board authorizes the said directors to filesuit before the Council to enforce collection ofit. The Board also authorizes the administrators

Acting upon al additional motion, the Board ofDirectors resolved that the administrator shallfile suit after the first of March, to enforoethe execution of the decree in favor of theBoard of Directors against Messr s . Prevost andDreux.

Thus done and resolved at the offioe of thedirectors, this day and year .

In answer to Miss. Jeanne Elizabeth. Anne Dutiller I s suit by her attorney against

Sieur Ducros, .plaintiff, ,observes that thetitle upon which action was taken is very old,dating back to 1765, \vithout diligence on thepart of the plaintiff at maturity to obtainpayment, neither during the life of her brother,vmo died only in September 1766. That the saidlady made no judicial effort during this longlapse of time, to obtain payment, compels thecurator to claim prescription of this debt. A~­

mitting that the ,court woul.d adjudge the sum of4867 livres on the validity of bills receivedfrom France. The repeated interest cannot beaccorded by the principle of right which is es­tablished, that a capital loaned or advanced can­not bear in~erest only from the day of demand injustice, but as this demand is only made today,the said lady must be non-suited of this preten­tion, furthermore the succession being in defeatfor her to be advised to enter in competitionvn t h the creditors of the colony without doingthem considerable harm.

Plaintiff prays that it please the court: to non-s uit Miss Dutiller of her demands to be, paid in this colony, and in consequence recognise

the invalidity of her title of principal made byher. To have interest without action in the delayof the ordinance, and that the interest will betotaly rejected as non-demandable by default of acondemnation that establishes them.
