TERMS OF SETTI,EMMIENT

8. The Tribe agrees that it submitted the qumerly sta:cn~ents and fees for the Sky Dancer Casino for the 22008 calendar year to the NTGC in an wtirnely fashion.

8. The T r i h a p e s that the fililurc to submit quartmly statements and fee pnymcnts for its gazing upmtion in a timely fasflion is a violation of NXI';C rezulations.

10. The T~ibe awes to pay za civil fine of three-thousand dollars ($3,000).

Tl~c Tribe agrecs thnt if il misses any of h e reg~latary dead tincs for the suhrnission of qlidcrly statements or fee payments outlined in paragrap11 12, onc t i~oucand five hundred dollars ($1,500) iinc will becon~c payable to the l!.S. Treasury and deiivcrcd to the NEGC wiihin thirty (30) days of the misscd deaifline. In s11ch circumstance, t l~c NiGC will issue a writtcn notice to tlre Trihc pursuant ro N 1C.X dcbt collection regulations. 25 C.F.R. par& 5 13. 16, The Tribe stipulates that this Agreement shall he deenicd to be the subjcct af a final ~ r d e r of the NIGC tinder 25 C.F.R. fi 575.$(c)(l) and n final agency action pursuant la 2 C.F.R. 3 577.9(d).
