1. INTRODUCTION AND SCOPE OF WORKU 1.1. Objectives of the ProjectThe Project is aimed to develop rural distribution power net work for
remoted communes. This will be a base for economic and social development ofreral areas of the sourthern provinces of Vietnam.
3 Project will electrify 16 communes in 6 provinces of Southern of Vietnam;3 of them are in Mekong river delta (Kien Giang, Soc Trang, Tra Vinh); otherthree provinces are in the South East of Vietnam (Binh Thuan, Binh Phuoc. Lam
5 Dong).
By implementation of the Project, an area of 861 km2 with 178.641U ;) habitants from 34.693 households will get benefit from electricity supply.
Obiectives of the Project are:-Extend and strengthen rural power network in 6 provinces: Lam Dong. binhPhuoc, Binh Thuan, Tra Vinh. Soc Trang, Kien Giang.
| - Increase electrification ratio from 35.5% (at the end of 2004) to 75.9% at the endof 2005;- Decrease power losses in low voltage power network from 25% to approximatelv5%;- Increase power supply quality in the Project's areas;- Improve power quality in the Project's areas.
1.2. Selected Project's communesGenerally, existing power networks in selected provinces are in very bad
* consition. The networks are the weaknest ones in sourthem provinces of Vietnam.All of selected communes is 25 km to 30 km far from supply substation. In somecases this distance is even over 40 km. The quality of power supply, therefore, isat very low quality, power losses are high, quanlity and quality of power supplyare not satisfactory. Power demand for production and consumption can not be

lSix Project's provinces are located in two different regions, the population
distribution is also different.- Population in South East Provinces are located mainly along transportationroads. Population distribution is quite event along the roads system and density isquite high. Therefore, the development of new power supply system for theseprovinces are very convinient, the investment cost is not as high as in provinces ofMekong River Delta.- In provinces of Mekong River Delta, water canals are very dense. Natural area ofone commune is larger than in South East provinces. Population is mainlydistributed along the roads and the water canals system. In some cases people areliving scatering in quite isolated areas, far from the road and water canals. Theelectrification therefore is more difficult and the investment cost higher than in3 remaining provinces.

3. LEGAL FRAMEWORK FOR PROJECT'S ENVIRONMENTAL IMPACTASSESSMENT .4.
3.1. VIETNAM REGULATIONS AND LAWS
j | - Law on Protection of the Environment (LEP) was enacted in 1993.
- Decree 175/CP was promulgated in 1994 to guide implementation of the LEP and -provides broad guidelines for division of responsibility among Ministries; environmentalimpact assessments; pollution prevention and disaster control; sources of finance; andenvironmental inspections and standards.
- Dercees 143 on amendment of Item 14 of Decree 175 CP dated 18/10/1994 ofGovernment on guidance for implementation of LEP.
- Circular No. 490 "Guidance on setting up and appraising environmental impactI assessment reports for investment projects" .
- Law on Forest Protection (1992). This law regulates forest management, protection,|ii development, and exploitation, prevention of woodcutting, and. forest destruction. It also
encourages individuals and organizations to protect and develop forests.
- Decree 54/1999/ND-CP relating to the protection of high-voltage networks.
- Decree 70/1987-HDBT specifies safety casements of high-voltage transmission lines.
- Decree 24/2000/ND-CP specifies the implementation on the Law on Foreign Investmentin Vietnam (Article 82) conceming environmental protection.
- Decree 52/1999/ND-CP includes environmental considerations for constructionmanagement.
- Decree 26/1996/CP provides regulations on the punishment of administrative violation ofEnvironmental Protection Law.
- Vietnam National standards (TCVN) are national standards established by the Ministry ofScience and Technology (MoSTE) and applied to all government agencies. They includeengineering, construction, scientific, and environmental standards. TCVN environmentalstandards include acceptable limits of many air, noise, and water quality parameters.
- 11 TCN-1984 sets the standard for minimum clearance between live parts of a line and
trees.

4. SCREENING FOR ENVIRONMENTAL IMPACTS; 4.1. CLASSIFICATION OF IMPACTS
* The Environmental Impact Assessment focuses on the major environmental issues of ;, ,l | the Project's Most Favoured Alternative. The potential impacts of the Project's pre- --
construction, construction, and operation phases were assessed as being in one of five3 | categories:
I| i. NO IMPACT. The potential impact of the Project activity is assessed as NOI | IMPACT if the project activity is physically removed in space or time from theI environmental component
* | ii. MAJOR IMPACT. An impact is said to be MAJOR if the project activity haspotential to affect an environmental component. Major impacts could be "Major
l - Negative" or "Major Positive." The following criteria were used to determine*. whether a given impact is MAJOR:
a) Spatial scale of the impact (site, local, regional, or national/ international);
b) Time horizon of the impact (short, medium, or long term);
* c) Magnitude of the change in the environmental component brought about bythe Project activities (small, moderate, large);
d) Importance to local human populations;
e) Compliance with national, provincial, or district environmental protectionlaws, standards, and regulations
3 f) Compliance with Vietnam's international commitments. These include theConvention on Wetlands of International Importance especially asWaterfowl Habitat (RAMSAR), the Convention Concerning the Protection
| of the World Cultural and Natural Heritage (World Heritage Convention),and the Convention on International Trade in Endangered Species of WildFauna and Flora (CITES); and
g) Compliance with World Bank guidelines, policies, and regulations.
iii. MINOR IMPACT. If an impact occurs but does not meet the criteria for a MajorI Impact it is assigned the category MINOR. Minor impacts could be "Minornegative" or "Minor Positive."
3 MITIGABLE IMPACT. The potential impact of a project activity on an environmentalcomponent is said to be MITIGABLE if there is potential for a major negative impact andthe proposed mitigation measure will prevent the impact or reduce the impact toacceptable levels.

4.2. IDENTIFICATION OF POTENTUIL IMPACTS OF THE PROJECT
The Project will play an important role in the electrification program and inimplementation of the policy of poverty alleviation of 16 communes within 6 Project'sI provinces. It will also promote the policy of industrialization and modernization of theGovernment of Vietnam as well as create a great opportunity for overall socio-economic
| development of the poor area.
When the distribution lines are constructed, there is a trend of local people to moveto live near the lines. The local people committee will have a proper planning accordinglyI to support the development of the areas. These planning are included: road, residentialarea, industrial development and farming etc. The communes/districts or provinces willmove toward its planning.
Once the distribution network is improved and completed, many farmers will nothave to use diesel generators to serve for their shrimp farms. 5. PUBLIC CONSULTATION AND DISCLOSUREDuring project preparation stage (2002-2003), the following activities were carried out:
Activity 1: Information & Discussion with Local Authorities on the Line RouteI Activity 2: Impact Survey and StatisticsActivity 3: Meetings with PAHs
When the survey was completed, District Compensation Committee (in
coordination with the commune officials) held meetings with PAHs having land in the
line ROW and with village representatives. During the meetings, the ConsultantI presented numerous materials, including: Project Summary, draft RAP and draft EIA,maps of the project site, figures, tables, photos, pictures, and other support materials.
Meeting officials informed participants of the Project purpose; presented the ProjectI) impacts on land and crops in detail; introduced the principles and policies of
compensation and advised people not to build new structures in the line ROW. PAHs
were consulted on the entitlement policy, property affected, and the compensationI amount to each household. Questions posed by the PAHs were addressed and
recommendations/concerns of PAHs and PC were recorded.
The main comments of local peoples on the Project and the environmental issues
of the Project are summarised in Table 5.1.
