The ballots were in the possession of CPA firm, Kirk Summa, in East Stroudsburg, and access to the ballots was authorized by Association Solicitor, Joseph Weismeth, Esquire. Analysis procedures were conducted at the offices of Kirk Summa. The process required multiple sessions which were arranged by appointment so that Kirk Summa could provide a staff member to be present and to observe my proce- dures at all times. (See attached letter from Kirk Summa.) II. Investigation Details Duplicate Ballots - There were 44 duplicate ballots reported by Kirk Summa in the election summary. These ballots provided an ideal laboratory for comparing original voting returns to their copies. They enabled me to establish a fool proof template for evaluating the legitimacy of the 403 counted ballots from the 2010 election. The following distinctions were observed about each pair of envelopes: each envelope of the pair 1) was mailed from a different post office, 2) contained a different formatting of the return address, 3) showed a frequent spelling difference in the mailing address, 4) showed variance in ink quality, 5) featured distinctively different owner member signatures, 6) were consistently different stock (2 different envelopes were observed), 7) contained ballots which showed differences in fabrication, that is, professionally produced v. homemade, and 8) the votes on the enclosed ballots were inconsistent between the pair. Of the 8 distinctions listed above, two (2) were reliably consistent: 1. All printing of envelopes and ballots used in the election by WLPOA was handled by Main Street Printing in Stroudsburg. In order to answer questions concerning the observable differences of the return envelopes, Mr. Ron Bittenbender, owner of Main Street Printing, personally examined the election documents at the offices of Kirk Summa. The identification of the legitimate envelope used in the 2010 election was made by Mr. Bittenbender. In a written summary of his examination, Mr. Bittenbender also pointed out other features that would indicate a duplicate, or fraudulent, ballot. Those distinctions were strongly consistent but they were not 100% so I did not use them for the template. 2. The ballot from each duplicate return showed an identical voting pattern. The same candidates, without exception, were the beneficiaries of the duplicate, or fraudulent vote. By contrast, the voting patterns of the original, legitimate ballots were not identical, nor were they consistent with the duplicates. Election RecountOmbudsman ReportI. Introduction

The purpose of the Ombudsman investigation was to determine if election tamperingor election fraud had occurred in the 2010 election. This required analyzing all of theballots from said election. The ballots were in the possession of CPA firm, Kirk Summa,in East Stroudsburg, and access to the ballots was authorized by Association Solicitor,Joseph Weismeth, Esquire. II. Investigation DetailsDuplicate Ballots - There were 44 duplicate ballots reported by Kirk Summa in the

election summary. These ballots provided an ideal laboratory for comparing originalvoting returns to their copies. They enabled me to establish a fool proof template forevaluating the legitimacy of the 403 counted ballots from the 2010 election.

The following distinctions were observed about each pair of envelopes: each envelopeof the pair

1) was mailed from a different post office,2) contained a different formatting of the return address,3) showed a frequent spelling difference in the mailing address,4) showed variance in ink quality,5) featured distinctively different owner member signatures,6) were consistently different stock (2 different envelopes were observed),7) contained ballots which showed differences in fabrication, that is, professionally produced v. homemade, and8) the votes on the enclosed ballots were inconsistent between the pair.

Of the 8 distinctions listed above, two (2) were reliably consistent:1. The 44 duplicates showed 100% consistency in the type of mailing envelopes used

for the duplicate returns, and 100% consistency in the type of mailing envelopes used forthe originals. The WLPOA Board of Directors approved a capital improvement project to give someof our deteriorated amenities a much-needed facelift! These exciting revitalizations arenow complete. Our members in Section 18 now have brandnew Mailboxes, installed by our Maintenance crew.

Our Maintenance crew has prepared for plowing and salting our community. I’m sureby the time this issue reaches you, we will have seen some snow. Please use caution whenour roads are snow covered and try to limit all non-essential traffic while our plows are atwork. We ask that all members be patient and rest assured that we will get to your road asquickly as possible. Keep in mind that we have 23 miles of roads in Winona Lakes.Should you notice a hazardous condition on our roadways please report it to the office,and if you are involved in an accident or other emergency please dial 9-1-1 first.

Our Maintenance crew works around the clock during snow storms to keep the roadssafe for our members, so when you see them on the road wave and/or honk to thank themfor all their hard work. Small gestures like that go a long way to keep our crew warmduring the cold winter months.

The 2010-2011 dues statements will be mailed out again shortly for those of you whochose the two payment option. I would be remiss if I began my first President’s Message with anything but a state-ment of gratitude to the Presidents of Winona Lakes who served before me, especially mypredecessor, Bob Fenlon. We are glad to hear that he is enjoying his time off fromWinona Lakes. I now know firsthand how demanding this office can be, but I also knowBob, and I doubt we have seen the last of him.

Since buying my home in Stony Hollow Village of Winona Lakes in December of2005, I have learned a lot. I remember when I first read our budget and thought we werewasting an awful lot of money. After two terms as Treasurer, I now understand howexpensive it is to run a community with 23 miles of roads and 1,257 members. It is alwayseasier to criticize than to help, and I learned this lesson the hard way by volunteering forWinona Lakes as a committee member, director, Treasurer, and now President.

As a member, I love that our dues are low—and as a real estate broker I am certain wepay among the least in the Pocono Mountains—but as an officer charged with the gover-nance of the Association, it can be frustrating. Members want it all, feel that since we payour dues we deserve it all, without much regard for budgetary concerns. I go to workevery day, but that does not mean I can afford a yacht. I pay my dues every year, but thatdoes not mean my community can provide me with 23 miles of paved roads and a skislope all for $724 a year. Having to explain this to members almost every day was theworst part of being Treasurer. We simply do not have enough money to provide ourmembership with all of the services you deserve.

Why do we suffer this problem? Some people feel I should be removed from office forsaying that homeowners associations are antiquated and that we should seek to dissolvethe Winona Lakes Property Owners Association and turn our roads to the care of town-ships. I disagree with them, and instead agree with Thomas Jefferson, when he said thatmost bad government comes from too much government. Surely, if such a patriot as hecan serve as President of the United States while fighting for less government, so can thePresident of Winona Lakes seek to find a better form of government for our community(and let us not confuse our community with our homeowners association).

Consider this example. As folks who bought our homes inside of planned communitiesestablished in the 1970s, we are forced to pay dues plus taxes—and we receive lessservices in total from both than a homeowner outside of a planned community receivesfrom one alone. As residents of Middle Smithfield and Lehman Townships, we pay for theplowing and maintenance of the paved roads of these townships, but we pay a second timefor the plowing and maintenance of our own Winona Lakes roads. Most remain dirt.

Of course we also pay taxes for the construction and maintenance of township bridges,and when we seek help with our own failing bridges, the local governments deny ourpleas and tell us we are on our own since we are a private corporation. (They still cash ourtax payments, though.)

What if we were the Winona Lakes Borough instead of the Winona Lakes PropertyOwners Association? No doubt many will tell us it cannot be done. I believe otherwise—ifwe can work together and stop the bickering and the lawsuits.

Strategies on solving our long term financial ruin aside, today I have two mostpressing problems on my desk. The first is allegations of election fraud. Having servedour country in such places as Liberia, Kosovo, and Iraq, where people are forced to fightfor the rights we Americans take for granted, I believe this is a most serious concern. Ihold democratic elections as a sacred right of all people, from nations and states rightdown to our humble homeowners association, and the evidence in front of us is strong:Someone tampered with the board of directors election of 2010-2011. The full report is inthis issue of the WinonaGram.

The second problem on my desk is missing or stolen money from the Associationoffice. There is exactly $2,757.84 missing from the Association office. I have involvedPennsylvania State Police, a police report has been filed, and a police investigation isongoing. As of this writing, a second meeting of the board of directors is called for thisSunday to continue our in-house investigation, to consider offers of repayment byresponsible staff (responsible for safeguarding our money, but not necessarily guilty ofstealing it—an important distinction), and to tighten procedures to ensure this does nothappen again. By the time this WinonaGram is printed, these tasks will have beenaddressed.

I want the members of Winona Lakes to know that these two problems are in front ofus, and that while they are most serious, both are being addressed by capable people. I amconfident we are going to get through this with due process. Please be patient and don’tlisten to rumors or otherwise slanderous, politically motivated, or anonymous letters.We’ve seen enough of all that.

Based on these findings, the template for this investigation would be the illegitimatemailing envelopes, further proved by the fixed voting pattern therein.

Election BallotsAll 403 election returns were analyzed using the aforementioned template. The results

of the examination are:305 legitimate + 98 fraudulent = 403 total ballots

The voting pattern of each of the 98 fraudulent ballots was examined and found to beidentical to the voting pattern observed in the duplicate ballot analysis. The same candi-dates were the beneficiaries of the fraudulent vote. For the election, voters were instructedto vote for three (3) candidates. The three candidates who benefited from fraudulentvoting were: Tom Fels, Jeff Reichl and Judith Weigand.

A very small number of the 98 ballots contained less than three votes. In those cases,when only two votes were cast, Jeff Reichl and Judith Weigand were the beneficiaries.When only one vote was cast, the beneficiary was either Jeff Reichl or Judith Weigand.There were no exceptions to this pattern.

Adding the 98 fraudulent votes of the election to the 22 duplicate/fraudulent votesfound in the set of 44 duplicates, a grand total of 120 fraudulent votes were injected intothe election process of WLPOA. This translates to an election where approximately 1 outof every 4 votes was fraudulent. Only 305 of the 403 votes were legitimate.

III. Conclusions1. The complaints of election fraud are confirmed.2. By removing the fraudulent ballots, it appears that the election results would have been different.

IV. Recommendations1. The 2010 election should be immediately decertified.2. All Directors on the Board who were candidates in the 2010 election should immediately recuse themselves from all activities and duties of a Director.3. The remaining Board of Directors should request an immediate recount of the elections by Kirk Summa, CPA.4. Based on Kirk Summa’s recount, certify the election and seat the duly elected Board members.5. Report the recount results to the community via the WinonaGram or special edition of the WinonaGram.

If the Board of Directors fails in it’s obligation to serve the owner members by acting onthis issue, then any owner member(s) in good standing could, and should, challenge the2010 election by filing a petition in the Monroe County Court of Common Pleas. TheOmbudsman’s report belongs to the owner members of Winona Lakes.

V. Closing CommentsThis inquiry was not exhaustive. Additional research and investigation could be done

but it would be costly to the community. What’s more, expert analysis and reportingwould only serve to underscore the conclusions of this investigation so they were notpursued. If it were deemed necessary, the following detail items might be examined:

1. Paper analysis. Purpose: to identify differences, if any, in the paper products usedfor the election. Original stock from Main Street Printing would be compared to thefraudulent stock.

2. Ink analysis. Purpose: to identify differences in the ink used for printing ballots andenvelopes, comparing those produced by Main Street Printing to those which were not.The analysis could determine printing sources such as printer, copy machine, etc.

3. Paper cutting technique. Purpose: to demonstrate differences in the quality of the cutthat is made to create the voting ballot. A print shop uses a commercial cutting machine.Non-commercial cutting equipment and techniques produce a different type of cut.

4. Return address analysis. Purpose: to determine how address formatting is handledby the computers of Winona Lakes and Main Street Printing, and to compare that with theformatting printed on the duplicate and fraudulent envelopes.

5. Handwriting analysis. Purpose: to confirm voter fraud by forgery and to possiblyidentify the perpetrators of the fraud. (Given that many of the fraudulent ballots weremailed from postal centers in New York, the perpetrators may be subject to felonycharges.)

All details of this investigation were witnessed by and approved by Kirk Summa CPA,who maintained oversight throughout. Furthermore, all attachments in this document,including a copy of this document, are in the possession of Kirk Summa.

What is an Ombudsman?By Jeff LeFevre

Several people have asked me, “Are you part of the Board of Directors? What does anOmbudsman do?” I thought I’d take this opportunity to answer those questions.

According to the American Heritage College Dictionary, an Ombudsman is a person“who investigates complaints and mediates fair settlements, especially between aggrievedparties.” In Scandinavian countries (Norway, Denmark, Sweden) an Ombudsman is “agovernment official who investigates citizens’ complaints against the government.”

Ombudsman positions are found in governments and other organizations around theglobe. Terms such as “defender of rights”, “protector of citizens”, “protector of humanrights and freedoms” are associated with the Ombudsman’s role in society.

The word “ombudsman” is rooted in an old Norwegian word, “umbudsmann”, whichessentially means “representative”. Thus, an Ombudsman represents the interests of thepublic by investigating and addressing complaints reported by individual citizens. Thecomplaints are often related to human rights violations or abuses of authority by a centralor local government.

In addition to the Board of Directors, the bylaws of Winona Lakes establish anOmbudsman position to provide a “check and balance” system for our communitygovernment. Unlike our state and federal governments which have a “check and balance”structure by virtue of the three branches of government (Executive, Legislative, Judicial),Winona Lakes has only one branch, the Board of Directors.

Thus, the Ombudsman exists to investigate the Board of Directors when ownermembers have complaints against the Board. If it is possible to mediate a solution, theOmbudsman will do so. If not, the Ombudsman will report the findings of the investiga-tion and offer recommendations to resolve the issue.

Understanding the definition and purpose of the Ombudsman enables us to see severalimportant distinctions:

• First, the Ombudsman is not elected to the Board of Directors norappointed by the Board.
