General Liability Policy

• Provides legal liability protection for the State Association and Member Leagues, Clubs, Players, Coaches, Volunteers, Officials, Directors, Officers, Employees and Referees

• Typical covered sanctioned activities: – Games– Tryouts– Practices– Tournaments– Fund Raising Activities

General Liability Policy• Typical Covered Incidents Include:

– Liability for player injuries (unsecured goals, field obstructions, rough play)

– Third party property damage caused by negligent use of premises

– Trips, falls by spectators attending sanctioned activities – even getting hit by that tournament golf cart

General Liability Policy• Typical Covered Incidents Include:

– Sexual abuse & molestation – including coach/player liaison situations

– Hired/Non-Owned auto coverage – primary for rented autos and excess over non-owned auto. Example: Tournament volunteer picking up tournament supplies or Board Member using rented auto to attend a convention.

• You are NOT covered for:

– Punitive or exemplary damages (punishment)

– Fines, penalties or sanctions imposed by law (or their defense costs)

General Liability Policy• Automobile Use Is NOT covered for:

– Liability coverage to a coach, parent, volunteer or referee who is driving players to and from a soccer event

– Physical damage to vehicle

– All coverage is secondary. The vehicle owner’s auto insurance will respond to any claim first.

Excess Accident Medical Policy

• Provides excess accident medical coverage to registered players, officials, coaches, administrators, managers, volunteers, ODP administrators

• Non-registered players participating in scheduled tryouts

Typical Limits of Liability

$100,000 per accident

Benefit period of 2 yrs. from date of accident

Secondary to Other Coverage. Can have Deductible.

Excess Accident Medical Policy

• Typical Coverage Includes:

– Coverage of medical expenses for injuries

– Doctors, office visits, hospitalization, therapy, etc. are covered

– Necessary medications, medical appliances required for treatment

Coverage becomes primary when otherinsurance coverage is not available.

• What is NOT Covered:

– Treatment of teeth – except treatment for an injury to natural teeth

– Eyeglasses, hearing aids and the examination for fitting them

Watch for policies with sub-limits for physical therapy and/or prescription drugs

• What is NOT Covered:

– Insured who is intoxicated or under the influence

– Suicide, attempted suicide, intentional self injury

– Participation in a riot

Non-Profit (D&O) Liability• Typical Covered Incidents Include:

– Wrongful acts, errors and omissions committed in governance of the organization

– Discrimination charges

– Negligent hiring or termination

– Eligibility matters (Example: player does not make select team)

– Sexual Abuse/Molestation (Covered under General Liability)

– Prior Knowledge exclusion

• What Is NOT covered:

– Watch for “cost to defend” being included in policy limit. (Example: If a lawsuit costs $250,000 to defend, only $750,000 would be left for payment of the award.)

– Aggregate policy can mean that one claim depletes all available coverage
