Specifications and Instructions to Bidders
Whatcom County is requesting bids from firms and individuals who are interested in making their maintenance and construction equipment available to the County at various job locations on an occasional basis as needed, during the period May 1, 2018 through April 30, 2019.
The County intends to compile a list of available equipment from bids submitted. When equipment is needed, the County will select it for rental from the list, based on equipment availability and suitability for the need, with preference to low bidders.
Whatcom County may need to rent some of this equipment, particularly trucks, excavators, or loaders, during emergency circumstances such as snowstorms or floods. All bidders should be aware that the equipment could be used almost continually under arduous conditions for the duration of a storm or flood.
To be considered, bidders must supply the information requested on the attached bid response form, including:
• Make and Model available • Equipment location • Prices by the hour, day, week, and month.
This bid is for the rental of equipment only.
Provide an hourly or lump sum flat rate for the cost of delivery. This is to include both mobilization and demobilization of the equipment to and from the job location within Whatcom County, unless otherwise authorized in advance.
All other conditions for rental must be written on the form, except for Washington State Sales Tax. The County will pay sales tax on rental of equipment, but do not include sales tax in quoted prices. Prices quoted are to apply under conditions of continuous usage.
All equipment must be in first-class condition. Whatcom County reserves the right to inspect equipment prior to any rental order. The County may credit against rental payments any down time due to equipment malfunction that is not the result of County usage.
All service and maintenance costs (excludes fueling) will be the responsibility of the equipment owner on equipment bid.
The same piece of equipment may be listed in multiple groups if it has attachments that would make its use applicable to other groups.
Bidders may make equipment inventory adjustments during the year. Any changes to the equipment list must be made in writing and such correspondence sent to Purchasing.

Any additional equipment available for use may be offered by listing it on attached sheets of paper. Include prices and any other conditions of rental, and submit attached sheets with the bid.
Prices quoted are to remain firm on any call during the period May 1, 2018 through April 30, 2019, subject to regulatory revision, if applicable.
All bidders must provide proof of current liability insurance in force by submitting a copy of the applicable insurance certificate with their bid. Bids not meeting this requirement will not be considered. Bidders must notify the County if their insurance is cancelled during the period May 1, 2018 through April 30, 2019. Proof of insurance must include the following minimum coverages:
• General liability insurance, naming County as additional insured with contractors insurance being primary and non-contributory with a waiver of subrogation. Minimum limits: Property damage, $500,000 per occurrence; Bodily injury, $1,000,000 per occurrence.
All equipment must be properly licensed in full conformity with state and local laws and regulations. Equipment owners must notify the County if required licenses are suspended or cancelled.
Trucks must be properly inspected in full conformity with state and local laws and regulations. Owners must notify the County if equipment fails to pass inspection. Trucks rented to haul rip-rap rock larger than 2 foot minus must have a rock gate rather than a regular tailgate.

SPECIAL CIRCUMSTANCES
Generally, the County will select the supplier submitting the lowest bid price for the specific material needed. However, under special circumstances, the County may select the supplier or suppliers that best meet the requirements for that particular job based on criteria other than lowest bid price.
Special circumstances which may be considered include: • Differences in ability to deliver • Delivery time • Availability of equipment • Special loading or unloading conditions • Total cost including transport and or labor, if not included with bid item • Performance of the delivered equipment • Location of the source • Coordination with other equipment required from the same owner • Proximity to the delivery point
SUBMITTAL
To be accepted, bids must be signed and filled out clearly and legibly in ink or typed.
Original documents must be submitted.

Whatcom County does not consider faxed or emailed bids.
Responses must be received no later than 2:30 PM on Tuesday April 17, 2018.
Bids arriving after that time will not be considered. It is the bidder’s responsibility to deliver the bid to the proper address by the assigned time. Whatcom County accepts no responsibility for misdirected or lost bids.
The Bid Response Forms include a list of the equipment that the County tends to rent most frequently. Please use these forms for specific equipment listed. Bidders are requested to provide a price list of other available rental equipment.

The equipment listed is that which the County has most frequently had a need for. It is acceptable to attach additional sheets with rental prices for equipment other than that listed on these pages. To be considered the following forms must be completed. Providing a separate list for the items listed on these response forms is not acceptable.
