Employment Based 5th Level USCIS administers the Immigrant Investor Program, also known as
“EB-5,” created by Congress in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors.
Under a pilot immigration program first enacted in 1992 and regularly reauthorized since, certain EB-5 visas also are set aside for
investors in Regional Centers designated by USCIS based on proposals for promoting economic growth.

In Other Words… Congress created the fifth employment-based preference (EB-5) immigrant visa category in 1990 for qualified foreigners seeking to invest in a business that will
(1) Benefit the U.S. economy and (2) Create or save at least 10 full-time jobs for U.S. workers in exchange
for lawful permanent residency in the U.S.!

What is an EB5 Regional Center An EB5 Regional Center is a private enterprise or corporation with a targeted investment program within a defined geographic region.

EB5 Regional Center: Direct AND Indirect Jobs!The Regional Center Investment Program allocates 3,000 green cards each year for people who invest in designated Regional Centers. The 3,000 is not a limit, just the amount reserved specifically for regional center based investments.!

How is a Regional Center formed? A Regional Center obtains its designation by submitting a detailed application to the U.S. Citizenship and Immigration Services (USCIS). The application must state: (1) the kinds of businesses that will receive capital from investors; (2) the jobs that will be created directly or indirectly as a result of the investment of capital; and (3) the other positive economic impacts that will result from the investment of capital

How are EB5 Projects funded through the EB5 Program? Once USCIS has approved a Regional Center application, an investor seeking and EB-5 green card through the Program must:
(1) Sign the *Subscription Documents for the EB5 project
(2) Make the qualifying investment
(3) File a I-526 Petition
(4) EB5 funds then are disbursed to the project.
Who is qualified to be an EB5 Investor? Before an investor can participate in a Regional Center’s EB-5 investment program, each investor must independently petition USCIS for an EB-5 visa. USCIS’ diligence includes:
(1) a detailed review of the sources of investor’s funds,
(2) family history, and
(3) other representations of the head of household and his/her immediate
family members under the age of 21!

1-2 Years Investment Exit Strategy The whole EB-5 process takes approximately 3-5 years or longer depending upon the timeliness, quality and validity of the investor’s submissions.
