MAJOR IMPACT PROJECT

2016-01590 GILSUM, TOWN OFGILSUM Ashuelot River

Requested Action:Dredge and fill 1,253 square feet in the bed and bank of Hayward Brook (impacting 150 linear feet) to replace an existing culvertwith a precast 18 by 53” open bottom span structure. In addition, temporarily impact 1,460 square feet ($0 linear feet) forconstruction access and installation.************************************

APPROVE PERMIT:Dredge and fill 1,253 square feet in the bed and bank of Hayward Brook (impacting 150 linear feet) to replace an existing culvertwith a precast 18’ by 53” open bottom span structure. In addition, temporarily impact 1,460 square feet (80 linear feet) forconstruction access and installation.

With Conditions:1. All work shall be in accordance with plans by Michie Corporation dated January 28, 2016 as received by the NH Department ofEnvironmental Services (DES) on October 12, 2016.2. Prior to commencing construction, the pennittee/permittee’s contractor shall submit to DES a final erosion and sediment controlplan.3. All in-stream work shall be conducted during low flow conditions and in a manner that will not cause or contribute to anyviolations of surface water quality standards in RSA 485-A or New Hampshire Code of Administrative Rules Env-Wq 1700.4. A Certified Wetlands Scientist or qualified professional, as applicable, shall monitor the project during construction to verify thatall work is done in accordance with the approved plans and narratives, adequate siltation and erosion controls are properlyimplemented. and no water quality violations occur. A follow-up report including photographs of all stages of construction shall besubmitted to the DES Wetlands Program within 60 days of final site stabilization.5. The permittee or permittees contractor shall conduct a follow-up inspection in October or November following the first growingseason to review the success of the construction area and schedule remedial actions if necessary.6. To prevent the introduction of invasive plant species to the site, the permittee’s contractor(s) shall clean all soils and vegetationfrom construction equipment and matting before such equipment is moved to the site.7. No person shall collect, transport, import, export, move, buy, sell, distribute, propagate or transplant any living and viableportion of any plant, which includes all of their cultivars and varieties listed in Table 3800.1 of the New Hampshire prohibitedinvasive species list (Agr 3802.01).8. Native material removed from the streambed during culvert installation shall be stockpiled separately and reused to emulate anatural channel bottom within the culvert, between wing walls, and beyond. Materials used to emulate a natural stream channelsurface must be rounded stones similar to those identified in the reference reach and shall not include angular rip-rap.9. All work shall be done from the top of the bank only. No excavation shall be done in flowing water. No construction equipmentshall be operated in flowing water.10. Extreme precautions shall be taken within riparian areas to prevent unnecessary removal of vegetation during construction.11. Upland and bank areas landward of the work area shall not be disturbed by regrading or filling.12. The adjacent stream bed and bank (i.e., up and downstream reaches) shall not be disturbed.13. The permittee/permittee’s contractor shall regrade temporary impacts to pre-construction conditions and plant native speciessimilar to those within the wetland prior to impact. The permittee shall implement corrective measure promptly if needed to ensurethe plantings survive.14. Seed mix within the restoration area shall be a wetland seed mix appropriate to the area and shall be applied in accordance withmanufacturers’ specifications.15. The permittee/permittee’s contractor shall revegetate the disturbed area with trees, shrubs and ground covers representing thedensity and species diversity of the existing stand of vegetation removed for this project, exclusive of any invasive or nuisancespecies.All dredged and excavated material and construction-related debris shall be placed outside of the areas subject to RSA 482-A. Any

spoil material deposited within 250 feet of any surface water shall comply with RSA-483-B.16. Dredged materials, whether to be stockpiled or disposed of, shall be dewatered in sedimentation basins lined with siltation anderosion controls, and located outside of areas subject to RSA 482-A jurisdiction.17. Any fill used shall be clean sand, gravel, rock, or other suitable material.18. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surface waters,all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within the growing season, bymulching with tackifiers on slopes less than 3:1 or netting and pinning on slopes steeper than 3:1.19. Where construction activities occur between November30 and May 1, all exposed soil areas shall be stabilized within 1 day ofestablishing the grade that is final or that otherwise will exist for more than 5 days. Stabilization shall include placing 3-inches ofbase course gravels, or loaming and mulching with tack or netting and pinning on slopes steeper than 3:1.20. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.21. Prior to commencing work on a substructure located within surface waters, the permittee or permittee’s contractors shallconstruct a cofferdam to isolate the substructure work area from the surface waters.22. Cofferdams shall not be installed during periods of high flow, whether due to seasonal runoff or precipitation. Once thecofferdam is fully effective, confined work can proceed without restriction.23. Work within the stream, inclusive of work associated with installation of a cofferdam, shall be done during periods of low flowonly. The permittee shall monitor local weather forecasts to avoid working during or following precipitation events.24. Discharge from dewatering of work areas shall be to sediment basins that are: a) located in uplands; b) lined with hay bales orother acceptable sediment trapping liners; c) set back as far as possible from wetlands and surface waters, with a preferredundisturbed vegetated buffer of at least 50 feet and a minimum undisturbed vegetative buffer of 20 feet.25. The temporary cofferdam shall be entirely removed within 2 days after work within the cofferdam is completed and water hasreturned to normal clarity.26. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, andshall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.27. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that noturbidity escapes the immediate dredge area and shall remain until suspended particles have settled and water at the work site hasreturned to normal clarity.28. Work shall be conducted in a manner so as to minimize turbidity and sedimentation to surface waters and wetlands.29. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater Manual,Volume 3, Erosion and Sediment Controls During Construction (December 2008).30. Erosion control products shall be installed per manufacturers recommended specifications.31. Construction equipment shall be inspected daily for leaking fuel, oil, and hydraulic fluid prior to entering surface waters orwetlands or operating in an area where such fluids could reach groundwater, surface waters, or wetlands.32. The permitte&s contractor shall maintain appropriate oil/diesel fuel spill kits on site that are readily accessible at all times duringconstruction, and shall train each operator in the use of the kits.33. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall be staged andrefueled in upland areas only.34. Faulty equipment shall be repaired immediately prior to entering areas that are subject to RSA 482-A jurisdiction.

With Findings:1. This is a Major Project per Administrative Rule Env-Wt 303 .02(i), projects that disturb 200 or more linear feet of a perennialnontidal stream.2. The need for the proposed impacts has been demonstrated by the applicant per Env-Wt 302.01.3. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impact toareas and environments under the departments jurisdiction per Env-Wt 302.03.4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(a), Requirements for ApplicationEvaluation, has been considered in the design of the project.5. In accordance with RSA 482-A:8, DES finds that the requirements for a public hearing do not apply as the permitted project isnot of substantial public interest, and will not have a significant impact on or adversely affect the values of the riverine resource, asidentified under RSA 482-A: 1.6. Geomorphic assessment revealed a bankfull width in the reference reach of 14.3 feet. The applicant has incorporated bestpractices in the design to accommodate 1.2 times the bankfull width. The proposed bridge has a clear span of 18 feet.

7. In correspondence dated October 10, 2016 the applicant’s agent stated that the proposed crossing will result in reduced velocitiesrelative to existing conditions, thereby alleviating sediment discharge to downstream infrastructure.8. The applicant has identified a channel constriction for 125 tinear feet upstream of the existing crossing and has proposed towiden this reach from the 9-10 feet (existing conditions) to 14 feet wide, to further alleviate erosion concerns and to replicatechannel geometry in the reference reach.9. Assessment of the reference reach was also used to determine the appropriate size class and gradation of streambed simulationmaterials.10. Contrary to the watershed area delineated by USGS Stream Stats, the observed path of Hayward Brook crosses Whitney StageRoad approximately 0.4 miles north of the intersection of Banks Road, Pinacle Road and Whitney Stage Road. The actual watershedarea received by the subject crossing, delineated by the applicant’s agent, is 1,211 acres.11. In accordance with NH Administrative Rule Env-Wt 904.04(f) compensatory mitigation shall not be required for aself-mitigating design. The proposal will maintain watercourse continuity under low flow conditions, improve the capacity to conveyhigh flows and allow for uninterrupted aquatic organism passage.12. The Natural Heritage Bureau report submitted with the application (N}1316-0704) stated that there are “no recorded occurrencesfor sensitive species near this project area”.13. No comments of concern were received by abutters or local governing organizations. In correspondence dated June 24, 2016,the Ashuelot River Local Advisory Committee expressed support for the project as proposed.

Not less than 5 state business days prior to starting work authorized by this permit, the permitted shall notify the DES WetlandsProgram and the Hampton Conservation Commission in writing of the date on which work under this permit is expected to start.3. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.4. All development activities associated with this project shall be conducted in compliance with applicable requirements of RSA483-B and N.H. Code Admin. Rules Env-Wq 1400 during and after construction.5. No person undertaking any activity shall cause or contribute to, or allow the activity to cause or contribute to, any violations ofthe surface water quality standards in RSA 485-A and Env-Wq 1700.6. Work shall be carried out in a time and manner to avoid disturbances to migratory waterfowl breeding and nesting areas.7. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, andshall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.8. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater Manual,Volume 3, Erosion and Sediment Controls During Construction (December 2008).9. Any fill used shall be clean sand, gravel, rock, or other suitable material.10. The permittee’s contractor shall maintain appropriate oilldiesel fuel spill kits on site that are readily accessible at all times during

construction, and shall train each operator in the use of the kits.11. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall be staged andrefueled in upland areas only.12. Faulty equipment shall be repaired immediately prior to entering areas that are subject to RSA 482-A jurisdiction.13. No more than 56.6% of the area of the lot within the protected shoreland shall be covered by impervious surfaces unlessadditional approval is obtained from DES.

With Findings:1. This is a major impact project per Administrative Rule Env-Wt 303.02(f), projects located in or adjacent to designated primewetlands under RSA 482-A:15.2. The impacts are necessary to build a single-family dwelling; therefore, the need for the proposed impacts has been demonstratedby the applicant per Env-Wt 302.01.3. The impacts will occur within the previously-developed 100-foot upland tidal buffer zone and the lots adjacent to the propertyhave been developed; therefore, the applicant has provided evidence which demonstrates that his/her project, as approved andconditioned, is the alternative with the least adverse impact to areas and environments under the departments jurisdiction perEnv-Wt 302.03.4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(a)&(c), Requirements forApplication Evaluation, has been considered in the design of the project.5. The applicant received written concurrence from those abutters whose property is within 20-feet of the proposed impacts inaccordance with Env-Wt 304.04(a).6. The agent satisfactorily addressed Env-Wt 703(b).7. The project as approved and constructed in adherence to install erosion controls offsets impacts from any increased runoff createdby the development.8. Based on the inspection conducted on October 14, 2016 by DES personnel, the project involves negligible environmental impactsas the impacts occur within the previously-developed 100-foot upland tidal buffer zone, siltation fencing will be correctly installedprior to soil disturbance, and a stomiwater management system has been designed by a professional engineering in accordance withRSA 483-B:9, V(g)(l). Therefore, the salt marsh complex will not be adversely impacted as a result of this project.9. No comments were submitted from the NHFG Nongame and Endangered Wildlife Program or the Natural Heritage Bureau..10. An email from the Hampton Conservation Commission states, “Since the [Hampton Conservation] Commission is in favor of theproject, there is no objection waiving the additional 20 day waiting period for prime wetland projects,” pursuant to Env-Wt 704.01.11. Based on the findings above, there is clear and convincing evidence this proposal will have no significant loss of values to theprime wetlands as set forth in RSA 482-A:1, and the project meets the criteria set forth in Rule Env-Wt 703.01 Criteria for Approval.12. In accordance with RSA 482-A:8, DES finds that the requirements for a public hearing do not apply as the permitted project isnot of substantial public interest, and will not have a significant impact on or adversely affect the values of the estuarine resource, asidentified under RSA 482-A: 1.

4. DES Wetlands Bureau Southeast Region staff and the Rye Conservation Commission shall be notified in writing prior tocommencement of work and upon its completion.5. Appropriate siltation, erosion, and turbidity controls shall be in place prior to construction, shall be maintained duringconstruction, and remain in place until the area is stabilized. Silt fence(s) must be removed once the area is stabilized.6. Installation of the culvert under US Rte. lA is contingent upon obtaining an excavation permit consistent with current policies toperform work within the NH DOT ROW.7. Any fill used shall be clean sand, gravel, rock, or other suitable material.8. Culvert outlet/outfall shall be protected in accordance with the DES Best Management Practices for Urban Stormwater RunoffManual (January 1996) and the Stormwater Management and Erosion and Sediment Control Handbook for Urban and DevelopingAreas in New Hampshire (August 1992).9. Proper headwalls shall be constructed within seven days of culvert installation.10. No machinery shall enter the water.11. With findings:1. This is a minimum impact project per Administrative Rule Env-Wt 303.04(b), projects in previously developed upland areaswithin 100 feet of the highest observable tide tine.2. The impacts are necessary to alleviate flooding on the property; therefore, the need for the proposed impacts has beendemonstrated by the applicant per Env-Wt 302.01.3. The impacts occur within the previously developed 100-foot tidal buffer zone. Stormtech subsurface stormwater treatmentchambers will be installed on the property. Therefore, the applicant has provided evidence which demonstrates that this proposal isthe alternative with the least adverse impact to areas and environments under the department’s jurisdiction per Env-Wt 302.03.4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(b) and (c) Requirements forApplication Evaluation, has been considered in the design of the project.5. The reasonableness of constructing a storm water drainage outfall to the Atlantic Ocean to abate flooding conditions associatedwith 2575 Ocean Boulevard was discussed with staff from the DES Watershed Management Bureau who found that this residentialstorm water discharge from a relatively small collection area would result in no negative water quality issue at the proposed location.6. The alternative of an on-site detention pond as suggested by the Rye Conservation Commission to deal with site drainage issueswas investigated and found not to be feasible or practicable at this location.7. No comments were submitted from the NHFG Nongame and Endangered Wildlife Program or the Natural Heritage Bureau.8. NH DHR found ‘No Historic Properties Affected.’9. This amended permit reflects the addition of a catch basin within the existing ROW at the request of NH DOT and does notchange the previously approved area of impact.

Personnel working on the job site and all employees shall be made aware of the potential to encounter wood turtles especiallyduring turtle nesting season which extends from late May through the end of June. NH Fish and Game Department and DESWetlands Bureau shall be contacted immediately if these species are encountered.4. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.5. No person undertaking any activity shall cause or contribute to, or allow the activity to cause or contribute to, any violations ofthe surface water quality standards in RSA 485-A and Env-Wq 1700.6. Work shall be done during low flow and in the dry only.7. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, andshall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.8. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that noturbidity escapes the immediate dredge area and shall remain until suspended particles have settled and water at the work site hasreturned to normal clarity.9. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater Manual,Volume 3, Erosion and Sediment Controls During Construction (December 2008).10. Extreme precautions shall be taken within riparian areas to prevent unnecessary removal of vegetation during construction.Areas cleared of vegetation must be revegetated with like native species within three days of the completion of the disturbance.11. Discharge from dewatering of work areas shall be to sediment basins that are: a) located in uplands; b) lined with hay bales orother acceptable sediment trapping liners; c) set back as far as possible from wetlands and surface waters, with a preferredundisturbed vegetated buffer of at least 50 feet and a minimum undisturbed vegetative buffer of 20 feet.12. Dredged materials, whether to be stockpiled or disposed of, shall be dewatered in sedimentation basins lined with siltation anderosion controls, and located outside of areas subject to RSA 482-A jurisdiction.13. Construction equipment shall be inspected daily for leaking fuel, oil, and hydraulic fluid prior to entering surface waters orwetlands or operating in an area where such fluids could reach groundwater, surface waters, or wetlands.14. The pennittee’s contractor shall maintain appropriate oil/diesel fuel spill kits on site that are readily accessible at all times duringconstruction, and shall train each operator in the use of the kits.15. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall be staged andrefueled in upland areas only.16. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surfacewaters, all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within the growingseason, by mulching with tackifiers on slopes less than 3:1 or netting and pinning on slopes steeper than 3:1.

Restoration Monitoring17. The permittee shall properly construct, monitor, and manage the restoration areas in accordance with plans.18. A NH certified wetland scientist shall supervise and be on site during restoration work to ensure the project is in accordancewith approved plans.19. failure to complete the restoration of 1,710 sq. ft. of wetlands in accordance with plans received by DES on July 12, 2016constitutes a violation of RSA 482-A.20. The schedule for the restoration of the wetland areas shall coincide with site construction unless otherwise authorized by theDES Wetlands Bureau.21. Within 60 days of completing the restoration portion of the project, A NH certified wetland scientist shall submit apost-construction monitoring report, documenting the conditions of the restored wetland.

22. A NI-I certified wetland scientist shall submit subsequent monitoring reports to DES by December 1 for two (2) consecutiveyears post-construction to document the success of the restoration and outline a schedule for remedial actions if necessary. Suchreports shall be submitted to DES with photographs demonstrating the conditions on the restoration site, include any necessaryremedial actions, and contain a schedule for completing the remedial actions and conducting follow up inspections.23. If the restoration project has met or exceeded its performance standards in fewer than two (2) growing seasons, the permitteemay request the department to waive subsequent monitoring by submitting a statement that all performance standards have been met;and documentation to support the statement, including photo documentation and certification from a certified wetland scientist whoconducted the monitoring that the project has met its performance standards. The department shall waive the requirement for furthermonitoring if the information provided demonstrates that the performance standards have been met or exceeded and that continuedmonitoring is not needed.

With findings:1. This is a minimum impact project per Administrative Rule Env-Wt 303.04(k), maintenance dredging, when necessary to providecontinued usefulness of nontidal drainage ditches, man-made ponds, and spillways, provided that: (a) The work is done within theoriginal bounds of a legally-constructed project; (b) The project is not located in or adjacent to prime wetlands; and(c) The work does not exceed 20,000 square feet.2. Findings of Fact:1. On August 26, 2016, the Wetlands Bureau received a wetland permit application to fill 932 sq. ft. of poorly drained forestedwetland and restore 108 sq. ft. of filled wetlands on the lot identified as Belmont Tax Map 107 Lot 52.2. The proposed wetland fill does not meet Rule 302.01 as the demonstration of need for the impacts has not been met. Theapplicant indicated the project is intended to provide a safer backyard area for the house. A building permit was acquired in February2005, and the house was completed in 2007. The existence of the wetland was identified by 2004 and does not represent a safetyissue requiring filling of the wetland.3. The proposed wetland fill does not meet Rule Env-Wt 302.03 as impacts have not been minimized or avoided to the maximumextent practicable. The proposed slope grading can be performed in upland. Potential safety concerns can be addressed byinstallation of a fence located in uplands.4. The Belmont Conservation Commission has reviewed the proposed project application and voted to oppose the granting of thewetland permit. The Belmont Conservation Commission has noted the site wetland is part of a wetland complex that is the last andonly filtration for both sediment and nutrients carried from neighborhood stonnwater prior to outlet to Lake Winnesquam. TheCommission indicated there is currently a program in place at Sun Ray shores to eradicate milfoil in the vicinity and noted thatterrestrial runoff of sediment and nutrients may exacerbate the existing milfoil problem.5. The Town of Belmont Conservation Commission performed an on-site inspection of the 9 June Circle property. The Town ofBelmont Conservation Commission Meeting Minutes dated October 5, 2016 indicate that following the on-site inspection theCommission agreed to stand by their original letter (dated September 7, 2016) opposing the project.6. The wetland permit application plan and narrative indicate the wetland delineation was performed by Michael Seekamp in July2004. The Army Corps of Engineers indicates wetland delineations (jurisdictional determinations) are valid for a period of 5-years.7. In accordance with Env-Wt 304.04, the DES Wetlands Bureau shall limit the location of a project to at least 20 feet from anabutting property line or imaginary extension thereof over surface water unless it receives written agreement from the affectedabutter concurring with any impact that may result relative to the abutter’s interests. The applicant has not submitted writtenagreements from the Owners of the abutting properties located within 20 feet of the proposed project area.8. A site observations visit was performed by NHDES on November 3, 2016. Fill was observed in locations identified withinwetlands per submitted plan.9. The application plan indicates there are 210 sq. ft. of previously filled wetlands located on the site. There are no wetland permitsassociated with placement of fill at the subject property.

Rulings in Support of Denial:1. The applicant failed to present evidence which demonstrates the need for the alteration of nontidal wetlands per Rule 302.01.2. The applicant failed to provide evidence which demonstrates that his/her proposal is the alternative with the least adverse impactto areas and environments under the department’s jurisdiction per Rule Wt 302.03.3. Pursuant to Rule Env-Wt 302.04, Requirements for Application Evaluation, (b), (5), applicants for Minimum projects shalldemonstrate by plan and example that the alternative proposed by the applicant is the one with the least impact to wetlands or surfacewaters on site.4. With Findings:1. This project is classified as a Minimum Impact Project per Administrative Rule Env-Wt 303.04(o), projects deemed minimum

impact by the department based on the degree of environmental impact. Typically, repair/rehabilitation work is not permitted on

existing Tier 3 crossings, per Chapter Env-Wt 900 rules on Stream Crossings. The nature of the proposed repairs was deemed

minimum and permitted under and Emergency Authorization while the stream was not flowing due to severe drought conditions.

2. As described in correspondence from the Walpole Road Agent, dated November 7, 2016, existing concrete and bedrock was

drilled for rebar installation then concrete forms were installed by hand. Concrete was mixed in upland areas and lowered by bucket

into the repair area. Concrete was also injected into a washed-out void behind the corrugated metal pipe arch then patched with a

welded plate.3. The project was necessary to repair the footings of an existing corrugated metal pipe arch, due to concrete deterioration. In

correspondence dated September 19, 2016, the Walpole Road Agent stated that “it is necessary for public safety to do the job now

and before high water damages the structural integrity even more.”4. Emergency authorization for this work was issued by DES Wetlands Bureau Staff on September 19, 2016.

5. Review of the application submitted pursuant the emergency authorization indicates that work has been completed in accordance

with the emergency authorization. A photo log and narrative describing the work was received by DES on October 27, 2016.
